Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

Mr. President and Members of the Rocky Mountain Coal Mining Institute: It is a great pleasure to be with you at this meeting, to enjoy the entertainments, and the good fellowship of all present., as well as to become better acquainted with the men in general. In presenting my subject today, .1 feel like the darky, who was home-, ward bound, had become weary and sat down by the wayside to rest. Presently glancing about to view the scenery, he spied a. large brown bear slowly coming down the path scenting his tracks one by 'one as he advanced. The darky to be polite said, "Mr. Bear, I see you like my tracks, I will make you some more." I have on. a few occasions given some interesting information on the various subjects such as The Prolonged Famines of Arabia, Movements and Migrations of the Races of Men, Life Indications on the Planet Mars, and today I have come before you with a new step in the roadway-Coal Geology. It is sometimes difficult to interpret the geological processes so as to be understood intelligently, but it shall be my aim to make this as plain as possible.

ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. Pictured on these pages are the seven RMCMI Scholarship Award Winners for the 1992-93 year followed by a brief profile. All winners were present as guests of the Institute at the June convention in Beaver Creek, Colorado to receive recognition at the Institute Awards Luncheon Monday, June 28. 1993. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Alan Czarnowsky, each winner receives $750 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the member state. (3) That the recipient have good academic standing, be pursing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship pro- gram and the various vice presidents contribute the travel expenses to convention for these outstanding young collegiates. The thirty-second regular meeting of the Rocky Mountain Coal Mining Institute was called to order at ll: 40 o'clock A. M., Monday, February 26th, 1934, President L. R. Weber presiding. Misses Helen Kelly and Marian Rodell presented President Weber with vases of flowers in behalf of the Institute. On motion of Harry Bubb, duly seconded, it was voted that the reading of the minutes be dispensed with, inasmuch as they are printed in the proceedings. The President made hi annual report. The Secretary-Treasurer made his annual report. The following committees were appointed by the President: Nomination s Committee-David Brown, chairman; G. A. Knox, G. C. Davis, George B. Twentymile Coal Company?s first longwall face in the late 1980?s was oriented approximately 45 degrees to the major coal cleats and 45 degrees to the primary horizontal stresses. This combination of stress and coal cleating resulted in frequent violent bursts of coal along the longwall face. The bursts created particles of sufficient size and force with the potential of causing injury to employees and occasional damage to shield components. Partial web cutting was subsequently developed in an attempt to relieve the stress on the coal face and required the shearing machine to travel to the tailgate and back for a full 36 inch web. The partial web cutting pattern is focused on first cutting the lower 90% of the seam to relieve the stress as the shearer travels from the headgate to the tailgate. The web depth during the headgate to tailgate pass is typically in the range of 70% to 80% and varies with conditions to maximize production rates. The top and bottom of the seam in the remaining 20 to 30% of the web are then cut out to allow the shields and face conveyor to advance. 100% of the web is cut at each gate end for a distance of approximately 19 shields. This paper addresses some general mine geology and the procedures and benefits of partial web cutting with respect to safety, production and maintenance on a high production longwall face.

The thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute was called to order in the Cosmopolitan Hotel, Denver, Colorado, Thurs- day, June 26, 1941, at 11:20 a.m., by President Charles M. Shott, following which President Shott made his opening address. On motion of H. C. Marchant, duly seconded, voted and carried, the reading of the minutes of the thirty-eighth regular meeting was dispensed with. On motion of Ronald C. Oliver, duly seconded, voted and carried, the President was authorized to appoint auditing, new members, resolutions and nominating committees, which appointments he then announced would be made at the afternoon session. An interesting talkie entitled "Coal Mine Explosions" was shown by Mr. William Forbes for the U. S. Bureau of Mines.

The first Mine Rescue Performance Evaluation for mine rescue teams was held just prior to the 1992 RMCMI convention meeting schedule on June 27 and 28. Six teams took part in this year's evaluation; Decker Coal, Decker, Montana; BHP Minerals' White Team and BHP Minerals' Purple Team, both of Aztec, New Mexico; Kerr McGee Coal Corporation, Jacob's Ranch Mine, Gillette, Wyoming; The Coteau Properties Company, Freedom Mine, Beulah, North Dakota and The Falkirk Mining Company, Falkirk Mine, Underwood, North Dakota. This was the first mine rescue evaluation program developed to measure a unit's proficiency in their skills rather than emphasis on a ranking order of teams. The objectives for the evaluation were to promote learning and to evaluate the current level of experience of the attending rescue units. The priority goal for this evaluation was to recognize current rescue skills, knowledge and abilities of each team participating. In doing this, each team is provided with individual evaluations and a path for improvement as needed. [ ] Realistic industrial related scenarios, closely simulating the stress of actual rescue incidents, was provided by members of the Hermosa Cliffs Colorado Fire Department under the direction of Dan Noonan, Fire Chief. On Saturday, June 27, five rescue scenarios were presented for each team to complete and on Sunday three of a more difficult nature were encountered by each team. On the final day of the RMCMI convention two of the teams performed rescue demonstra¬tions. Onlookers were afforded the opportunity to view the teams in action as they simulated actual rescue operations. The value and importance of mine rescue teams such as those participating in this year's Rescue Team Performance Evaluation are very evident as in many cases they are the only rescue personnel and medical staff on the work site in case of an emergency. Most of these persons are volunteers who spend many hours studying, practicing and perfecting their expertise in the lifesaving techniques needed in the event of a mine emergency. At the same time, they are very qualified coal miners who perform their respective duties at their mine locations, Their dedication to gaining the most knowledge they can get to handle these life and death situations is evident in their participation in evaluations such as this one. [ ] If a highly educational, informative, sharing of knowledge and expertise, while at the same time providing a very enjoyable experience, deems this evaluation a success ... the Rescue Team Performance Evaluation held during the RMCMI Convention at Tamarron this year was certainly a SUCCESS!! Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,
