Land access and tenure certainty for exploration and mine development is absolutely critical to the foundation of a healthy, sustainable and environmentally-sound mineral exploration and mining sector. Without certainty, mineral exploration will be severely eroded, resulting in reduced possibility of discovering and developing new mines. The development of positive relationships based on a shared commitment of understanding, mutual respect and trust by First Nations and the mineral sector can provide this increased business certainty and social and economic benefits for local First Nations. As a sector, we face many challenges in regard to building relationships with First Nations. The root solution to addressing these challenges lies in recognizing and understanding the unique cultural differences that exist between indigenous people and the business community. From the Canadian perspective, the First Nations culture differs vastly from non-Aboriginal culture. It is equally as imperative that cultural differences be acknowledged and respected at home as they are when seeking business opportunities in other countries. The traditional “business” approaches and relationships that one understands and incorporates with one’s contractors, legal counsel, investors and Board are generally not be the best approach for the introductory and subsequent meetings with indigenous peoples. This paper is written from the perspective of my experiences accumulated over the past ten years, first as Manager of Aboriginal Affairs for one of the largest forest companies in British Columbia and now, as President and CEO of the Association for Mineral Exploration BC (AME BC). My opinions are not necessarily endorsed by AME BC. Before the gritty issues of consultation and benefit sharing are dealt with, it is worthwhile to clear up the confusion surrounding terminology. “Indigenous Peoples” is used in a global context; “Aboriginal Peoples” is used in the Canadian context therefore includes Métis, Inuit and First Nations Peoples. The term “First Nations”, in the context of British Columbia, perhaps has its roots in the fact that treaties have largely not been settled. Therefore it is important to reaffirm that British Columbia was not discovered. First Nations have resided in British Columbia since time immemorial.

In the mid-1970?s, the market value of tangible assets of S&P 500 companies far outstripped the value of intangible assets, including intellectual property (e.g., 83% tangible assets v. 17% intangible assets).1 By 2005, the picture was quite different. By that time and continuing to 2010, S&P 500 companies? market value of intangibles was about 80%, with tangible assets accounting for only 16% of market value.2 This swing highlights the importance in today?s world of understanding intellectual property rights and varying strategies and options for protecting them. This paper discusses intellectual property rights particularly patents and trade secrets, specifically: 1) types of intellectual property; 2) choosing the mode of intellectual property protection; 3) obtaining patent protection; and 4) using patents as a sword versus a shield.

The tailings from beneficiation of Florida phosphate ore contain considerable phosphate values. These tailings are currently discharged into large disposal areas. More than three million tons of P2O5 are discarded with the phosphatic slimes (clays) in Florida each year. These phosphatic clays not only create one of the most difficult disposal problems in the mining industry, but also represent a tremendous loss of P2O5. As the quality and quantity of Florida’s phosphate reserves diminish, recovery of phosphate values from these wastes becomes more vital. This will also significantly lengthen the life of these important phosphate resources. Thus, it is the goal of this study is to recover more than 80% of the phosphate values in phosphatic clays. A systematic study to characterize samples taken from inactive disposal area has been conducted. The data suggest that natural segregation takes place in the settling pond. In other words, coarser particles settle closer to the feeding point of the pond. Flotation tests were conducted using the +325 mesh fraction of samples obtained from sites close to the feeding point (sample# A) and further from that point (sample# B) and (sample# C) which is even further away from the feeding point. The results show the following: Sample# A gives the highest grade and recovery, followed by that of # B and then of # C. There is a great potential to upgrade sample# A where concentrates of high grade (68.9-70.1 % BPL or 31.5- 32.1% P2O5) and recovery (~86.6-95.4 %) can be obtained under the investigated operating conditions (1.0 – 2.0 kg/ton sodium silicate and 1.5—3.0 kg/ton collector mixture of fatty acid and fuel oil). The mineralogical and chemical analysis of all samples is presented in this paper for comparison. Only in this paper, the flotation data of (site # A) are discussed below.

The need for onsite gas monitoring during, or following, a major incident at an underground coal mine has long been recognised. Recommendations from inquiries following Queensland mine disasters have included ?qualified persons and equipment for rapid analysis of gas samples be available in times of emergency? and that ?this may be accomplished by either mobile laboratories or laboratories established in each mining locality.? Following the Moura No. 2 disaster, the Queensland Government allocated funds to Simtars for a mobile laboratory to respond should such a disaster occur again in the future. This vehicle was commissioned in 1997 and has been used at many mine sites under a wide range of scenarios. Simtars, armed with over ten years of operational experience with this mobile laboratory, has taken an active role in the design and construction of a modernised replacement unit. With a twenty point tube bundle system and ultrafast gas chromatograph the result is, arguably, the best equipped mobile gas analysis laboratory for mine emergency response in the world. This paper outlines the features of the new laboratory, its capabilities and the philosophy behind the design and inclusions.

During the last twenty years computers have be-come widely used to assist with the simulation and design of large scale, primary ventilation systems. However, to date there are few computer programs available to help with the modeling of auxiliary ventilation in dead-end headings or tunnels. This paper presents the results of the first year of a research and programming study dedicated to the development of a user-friendly duct simulation tool. Included is a literature review that summarises publications on duct leakage and resistance, on previous programs developed for the simulation of airflow in ducts, and case studies on extended ductlines in mines and tunnels. The methodology behind the development of Ductsim, a Windows based simulation program is presented.

Introduction US dependence on external energy sources is dangerous because of unstable political situations existing in key energy exporting countries. So, recent national energy policies call for increased reliance on domestic energy sources. Coal ranks as the most feasible domestic energy source due to its abundant reserves and continental distribution. But to efficiently extract these coal reserves, huge sums of capital funds are needed. Due to the depressed economy, lenders of capital funds are forced to be more stringent with loan applications. This results in fewer loans granted. In many cases, it is uncertain if funding can be obtained. Furthermore, the greatest level of domestic mine financing is expected to be in the coal sector. Demand for capital in the domestic coal industry is anticipated to increase 80% by 1990. The Chase Manhattan Bank in New York warns that these future needs cannot be met by the present capital markets. This article analyzes the current and expected situations of the capital markets available to the domestic coal industry, including: • current and expected future types of financing used in the domestic coal industry; • problems the domestic coal industry may encounter as it seeks capital; and • the future availability of capital funds as concluded from analysis of the first two items. Background Information Regardless of industry, all projects or ventures can be divided into four basic stages: generation; evaluation; selection; and execution. Within the mining industry, one can break down these stages to draw a clear picture of mine development, as shown in Fig. 1. Each successive stage has a corresponding risk level. This risk level defines the type of financing available to the mine operator. Mining Venture Risks A coal mining venture can be characterized by its unique blend of technical and financial risk. As the mine moves through different development stages, varying proportions of each of these risks are encountered. It is these risks that the lender evaluates to determine project suitability. For a coal mining venture, the major complexities generally occur with the technical risk. These include: • quantifying the coal reserves: • assessing the feasibility of the mining method; and • evaluating the design of the wash plant. The reserve risk is gauged by the amount of measured, mineable, and saleable reserves. The greater the latter amounts, the lower the risk. Secure title to the reserves plus title for any surface areas required are also of concern to the banker. The Upgraded Coal Interest Group (UCIG), focuses on clean, low-cost options for coal-based power generation via pre-combustion, co-firing and reburn options. Its mission is to preserve and expand the economic use of coal for energy. By reducing the fuel costs and environmental impacts of coal-fired power generation, existing units become more cost effective and thus new units utilizing advanced combustion technologies are more likely to be coal-fired. Two great forces are reshaping the power generation industry, the Clean Air Act Amendment and deregulation of generation. The Clean Air Act Amendment is forcing change by making it necessary for power producers to plan for reducing emissions of sulfur and nitrogen oxides and possibly trace elements. At the same time, deregulation of generation is forcing utilities to focus their attention closely on the short term impact of any change on cost of power. Fuel is a utility's largest cost element; maximum fuel flexibility will be a utility's best weapon in an environment of rapid change. In a regulated environment, a utility was limited in how involved he might get into fuel supply, in a purely deregulated environment he need only be guided by the impact on the bottom line. It is clear that these two forces will promote a close look at factors such as coal upgrading which can have an impact on the availability of low sulfur coal or emission of NOX and trace elements.

Introduction This paper attempts to summarize some of the major criticisms of drug testing. Eight problems with drug testing are discussed. These are: • It does not measure something employers have a reasonable need to know, • It is a distortion of priorities, • Drug use is not known to be associated with increased risk of occupational injuries, • Drug testing is proposed as a dangerously simplistic solution to poorly conceived problems, • In the absence of safeguards, it is unacceptably inaccurate, • In the absence of treatment commitments and confidentiality protection for persons dependent on drugs, it is an unethical practice of medicine, • Drug testing is an invasion of privacy, and • It will have a negative effect on treatment of persons with drug or alcohol dependencies. Employers' need to know It does not measure something employers have a reasonable need to know. It is reasonable for employers and fellow workers to want to know if workers are functionally impaired (intoxicated) while on the job. Drug testing does not measure impairment. It measures the concentration of drug metabolities in urine or blood. Unlike measurements of blood alcohol concentration (BAC), drug metabolites are not correlated with impairment or intoxication. They indicate only drug use in the one to two weeks before a urine sample. And, in some instances, they indicate chronic use. Impairment caused by drug use, on the other hand, occurs immediately and declines rapidly within hours. Drug metabolites may linger for days afterwards. Drug metabolite concentrations in urine are a function of (Morgan, 1984; Schartz and Hawks, 1985; MMWR, 1983): • the amount and purity of drug consumed before taking the test, • when the drug was consumed, • whether the person was a chronic user, in which case a certain amount of drug metabolites would be stored in body fat and slowly released, • the person's metabolic rate, and • for metabolites in urine, any dilution effects of urine. Introduction Inco is the major North American nickel producer. Initially based in Sudbury, Ontario, its past exploration activity was directed toward finding new nickel deposits. New nickel sulfide discoveries outside Sudbury have included Thompson, Manitoba; Shebandowan, Ontario; and Widgiemooltha in Western Australia as well as a host of nickel laterite deposits. The company is currently diversifying into other commodities, including gold. Inco's exploration department participated in uranium discoveries in Saskatchewan and chromite discoveries at Tiebaghi in New Caledonia. In addition, it found new gold deposits at Lupin, Northwest Territories; Crixas, Brazil; Hoyle Township, Ontario; and Casa Berardi in Quebec. Crixas and Casa Berardi are currently being evaluated by underground exploration. Figure 1 shows some Canadian Shield gold locations where Inco is or was an active participant. Base metal developments Base metal exploration in shield areas has been greatly eased by applying scientific studies. Archean nickel sulfide deposits have been found using komatiitic-flow models (Fardon, 1971). Volcanogenic massive sulfide model has been applied to copper-zinc deposits (Sangster and Scott, 1976). Such deposits were subsequently seen developing on the sea floor through black smokers (Spiess, MacDonald, and Atwater, 1980). Sedimentary processes were recognized early as important in ore formation, particularly in the southern hemisphere (King, 1976). And many ore deposits are now regarded as a simple part of the geological column (Stanton, 1960 and 1972). Petrographic work on alteration patterns in and around ore bodies was used to develop standard porphyry copper models (Lowell and Guilbert, 1970). Epithermal models for precious metals followed. Stratigraphic zonation patterns have been formulated for base metal deposits, including keel facies, ore facies, and cap or distal facies. Gold developments The work on base metal deposits naturally spilled over into precious metal exploration when the gold price was allowed to float on world money markets. Early work on elements associated with gold deposits, especially arsenic, tellurium, selenium, and mercury, pioneered more detailed geochemical work (Bagby and Berger, 1985; and Groves, Ho, and Houstoun, 1984). Geochemical patterns have been recognized around microfine gold deposits. And the study of gold precipitation patterns in modern geothermal systems has helped understand gold deposition. In the late 1960s and early 1970s, it was noticed that numerous Archean banded iron formations contained anomalous gold values. From this and other observations, the syngenetic exhalite gold model has developed. Gold deposits also occur along shears in some plutons such as the Belmoral mine in Quebec. This indicates the importance of epigenetic processes in ore formation. Shield ore settings Initial studies recognized that the major gold camps in the Canadian Shield were mostly in greenstone belts and found along "breaks," especially zones of faulting and sedimentation. Gill (1948) wrote, "Only recently, as a result of detailed mapping, has the importance of major schist zones such as the Larder Lake, Cadillac, Porcupine Creek, and Destor Breaks been recognized. These zones of persistent adjustment mark broad belts favorable for ore occurrence." The importance of shearing in ore location and regional greenstone stratigraphic position close to late sedimentary packages was clearly understood. And structural models have been further developed for some Canadian ore deposits (Hubert, Trudel, and Gelinas, 1984). In the Beardmore-Geraldton camp of northwest Ontario, the importance was soon recognized of fold noses in banded iron formation, as localizers for gold ore. The application of aluminum matrix composites, due to their unique properties, is significantly growing in the variety of industries such as aerospace and automobile. In comparison to other light metals, such as magnesium and titanium, aluminum is lower in price. These are the advantages that this metal dominates the others. In this research, first by applying the lost foam casting method, the SiCp/A356 composite was cast in the bottom and side gate conditions with 690°C and volume fraction of 10%. Furthermore, the effects of reinforcement particles (60 µm, 75 µm) were examined. The results present the particles distribution in the side gate methods is more homogeneous than the bottom gate casting method. Also, by increasing the particles sizes, the fading rate in the side gate are reduced from 22% to 19%, as well as from 26.4% to 25.4% in the bottom gate. Recent NIOSH published information has shown an increase of rapidly progressive coal workers? pneumoconiosis (CWP) in the southern Appalachian coal region (SAR) of the U.S., despite the fact that compliance data indicates that most coal miners have been exposed to coal mine dust concentrations below the statutory limit of 2.0 mg/m³. While the exact cause of these elevated CWP levels in the SAR has not been established, several factors may be contributing to the increase in occupational lung disease among coal miners. The mining of high rank coal is known to lead to higher CWP rates, and this type of coal is mined in a portion of this region. Also, a high percentage of the mines in the region are on reduced dust standards because of the high silica content of the airborne dust resulting in miners possibly being exposed to excessive amounts of respirable silica dust. Exposure to excessive amounts of respirable silica dust can lead to silicosis, a disabling and potentially fatal lung disease. NIOSH's Respiratory Hazards Control Branch has been investigating the possible causes that would account for the observed higher trends in disease progression through literature review, data analysis, and in-mine surveying. The investigation to date has revealed that underground mines are faced with cutting large amounts of rock in order to maintain haulage clearances. Cutting rock not only increases the potential for silica exposure, it increases the requirement for machine maintenance which was a concern observed during dust surveys conducted by NIOSH. Over half of the mines operating in the SAR are on reduced standards due to high silica content. Adequate face ventilation of the continuous miner and roof bolter and limited down-wind operations from the miner are also issues of concern and items which require the constant attention of miners operating in these conditions. In 1994, the East Bay Municipal Utility District (EBMUD) commenced a system-wide Seismic Improvement Program to protect their facilities from catastrophic damage. A primary focus of this program has been on retrofitting the 75-year old Claremont Tunnel, which crosses the active Hayward Fault zone. A large earthquake on the Hayward Fault could generate enough right-lateral fault slip to effectively sever this important lifeline. The retrofit project involves construction of a new bypass tunnel through the Hayward Fault zone, together with systematic contact grouting and localized structural repair of the existing concrete liner. Several innovative design measures have been incorporated into the seismic retrofit design, including an oversized tunnel cross section, backfill concrete side drifts, seismic isolation of an internal structural pipe, and shear fuses in the final lining.

Atmospheric conditions underground are constantly changing and from a safety perspective, it is critical to identify when conditions are trending abnormally. Atmospheric monitoring in underground coal mines allows mine operators to analyze atmospheric conditions underground in real-time. Real-time monitoring can then be used to identify whether atmospheric conditions underground have become problematic. The implementation of a risk assessment and management process allows operators to then use a risk-informed decision making to identify comprehensive site specific ventilation parameters. Establishing risk-informed ventilation parameters and tracking conditions relative to these parameters, management can modify ventilation plans as mine conditions develop to manage evolving risks. Ventilation risk assessment and management allows developing atmospheric monitoring technologies to be fully utilized in order to increase safety standards in the United States. This paper reviews general risk assessment approaches, state of the art ventilation based risk assessment, and the risk assessment and management application within the United States regulatory framework.

"The evaluation of data and information provided by the existing traditional indicators in sustainability assessments is most important. Therefore the Institute of Mining Engineering I from the RWTH Aachen University developed indicators and an assessment system for the mineral raw materials industry on operation, company and sector level on behalf of the Federal Ministry of Economics and Labour (Bundesministerium für Wirtschaft und Arbeit, BMWA) and the Federal Institute for Geosciences and Natural Resources (Bundesanstalt für Geowissenschaften und Rohstoffe, BGR). In the course of the development of indicators for the raw materials industry quality indicators on different levels of the sustainability assessment procedure have been identified and developed. The following paper describes some of the results focussing on the development and integration of quality indicators into sustainability assessment systems."

High Pressure Water Jet Assisted Tunneling The high pressure water jet assisted tunneling project was conducted in a granite quarry near Skykomish, Washington, approximately 90 miles east of Seattle. A 7-ft diam tunnel boring machine was modified and equipped with high pressure water jets. The concept that tunneling rates can be improved by using high pressure water jets was validated, with an average increased advance rate of 50% to 60%. For some tests, the advance rate was more than doubled. A comprehensive economic analysis has shown that very significant savings are possible. At a 50% increase in advance rate, cost savings of 14% and 24% were projected for 10-ft and 20-ft diam tunnels respectively. These benefits were seen to be relatively insensitive to water jet equipment costs.

In report the results of performance of research works on building up of the connected geoecological and geomechanical monitoring system for modelling and study of a state of mining massif in a region with large-scale underground mining works are discussed. The connected geoecological monitoring requires radical change of methodology of carried out works. To carry out modelling and researches it is impossible without construction of the integrated connected information model of region. Basis of construction of information systems and databases for all sections of Earth Sciences is the set of the approaches, among which, for example, methods of remote sounding, GIS- and GPS-technology etc. Computer technologies are basis on the "supercomputer" technology. The results of performance of some researches for regions of excavation of deposits of potash salts in Russia and Belarus are presented.

Were the legislators and politicians responsible for the closing of the U.S. Department of the Interior?s Bureau of Mines (Bureau) in March 1996 fully aware of what they were doing? Throughout the United States? history, the domestic mining and minerals industry has been largely responsible for the nation?s growth and prosperity that had made it a world leader. The mining and minerals industry made it possible for the young nation to catch up with Europe during the Industrial Revolution, played an essential role leading to victories in World Wars I and II and was a core ingredient for continued economic growth. For a number of decades, America?s import dependency on non-fuel mineral materials has continued to increase. (USGS Mineral Commodity Summaries). Developing domestic resources to meet current and future demands ? particularly those resources considered to be of strategic and critical value to national security ? is necessary. Federal involvement is required since many of these resources are located on public lands. Another reason for federal involvement is that the success of the industry depends on long-range research programs and advances that may take up to 25 years to become commercially available. This situation requires federal partnership to coordinate the programs necessary to collectively involve the industry, individual mining companies and colleges and universities. So, how was it possible to close a federal agency that had contributed so much to the nation?s welfare in a mandated 90-day period, with more than 1,200 employees losing their jobs?

The case study of a highland area in the Central Andes of Peru, where many abandoned polymetallic mines are found, is presented. Some of these mines generate metal leaching and acid rock drainage (ML/ARD) or have potentially ARD generating (PAG) tailings/waste rock storage. Effluents are discharged into the first of two lakes in line, which act as reservoirs for irrigating an important valley in the desert coastal region. Drainage fees, their relationship with the deposit and the solid-wastes mineralogy are discussed, as well as variations in water and sediments composition, the benthos, and the aquatic/riparian flora/fauna in these lakes.

The objective of this research was to establish the relationship between production, consumption and energy cost in the surface mining of bituminous coal. Specific energy sources such as diesel, gasoline, electricity, explosives and bituminous coal were considered in this study. Gain in net energy, proportion of the cost of energy consumption and total energy cost relative to total revenue of extracted coal were determined, and a new energy efficiency index and a new energy-cost ratio were established. A case study on an operating surface coal mine was carried out to demonstrate the application of the newly developed method. The results of this study can be used by the mine operators in establishing strategies for the optimization of energy production and consumption, and for reducing the cost of bituminous coal extraction.

Lebanon used a TBM for the firsttime to excavate a tunnel in the country. A main beam TBM, built in 1979, bored the 3.8 m (12.5-ft) diameter by 4,020 m (2.5-miles) Madiq Tunnel. The TBM bored through karstic terrain of dolomitic limestone, limestone and marly-limestone rock having near horizontal beds with more than twelve faults crossing the axis of the tunnel. The TBM also encountered more than six major karst features, filled with various combinations of boulders, clay, void space and water. The excavation through these collapsed-breccia zones drastically slowed the TBM?s progress. When complete, which the Madiq Tunnel is a part, the Kesrouane Water Project along the coast will bring fresh and irrigation waters to the parched and heavily populated region north of Beirut.
