Mine drainage and mine reclamation are topics of major interest to the mining industry, federal and local governments, and the general public. This publication and its companion three volumes are the proceedings of a conference held in Pittsburgh, Pennsylvania, April 24-29, 1994. There were twelve sessions (69 papers) that dealt with mine drainage, including modeling, geochemistry, prediction, treatment, control strategies, characterization, hydrology, and case studies. These sessions comprise volumes 1 and 2. The six sessions (34 papers) that dealt with reclamation and revegetation of disturbed lands are included in volume 3. Volume 4 includes the six sessions (34 papers) that dealt with such topical issues as fires at abandoned mine sites, subsidence, hydrology, mine wastes, and policy. Poster session presentations are represented by 49 papers and 92 abstracts that have been placed in the back of volumes 2, 3, and 4, consistent with the subject of that volume.

"This paper discusses the author’s work on international law norms of consultation with Indigenous communities and examines unexpected corporate stakeholder impacts on these norms. Customary international law, which governs the area, does not traditionally refer to corporate conduct. This paper surveys several sources on developing international law on consultation obligations; it also discusses the impacts these norms can have on corporate stakeholders in the mining industry. Finally, it asks how interactions of corporate stakeholders in this area can indirectly impact future law and suggests implications for different business models in the mining sector.RÉSUMÉ Le présent article traite du travail de l’auteur sur les normes de consultation avec les communautés autochtones contenues dans le droit international et examine les impacts inattendus des parties prenantes sur ces normes. Le droit coutumier international, qui gouverne ce domaine, ne réfère traditionnellement pas à la conduite des sociétés. International lending institutions have charters requiring projects that are seeking loans to adhere to certain environmental performance standards, including compliance with host-country environmental laws, as well as observance of international environmental policies and guidelines. The most commonly applied international environmental policies and guidelines are those established by The World Bank. Lenders require a review by an independent engineer to determine that the feasibility study plans have been developed in accordance with the applicable environmental commitments. Lender agreements require independent engineer evaluation of environmental performance through the construction phase and initial operations phase of the project, culminating in the issuance of an "Environ- mental Completion Certificate."

World demand of sulphur-in-all-forms (SAF), which in 1985 is estimated to total 57.5 million tonnes S equivalent, is expected to increase to 77.6 million tonnes S by the year 2000. Key factors are the evolution of sulphur demand in the USSR, China, and the developing countries notably India, Brazil, and the countries in North Africa and the Near East with vertically integrated phosphate industries. Brimstone will remain the dominant sulphurous raw material notwithstanding the progressive increase in the supply and use of sulphur in other forms resulting mainly from the enhanced recovery df pollution sulphur and the increased use of sulphur in pyrites in those countries with this sulphur resource. Sulphur demand for phosphate fertilizer manufacture is expected to have the main impact on world sulphur demand, but in contrast to the industrially advanced countries where non- fertilizer sulphur use is not expected to increase measurably, this demand sector is expected to be of some importance in those developing countries with dynamic economies and in the centrally planned economies of East Europe and the Far East.

"Over the years, it has been increasingly difficult for the minerals industry to raise the necessary capital for its activities. To alleviate this phenomenon, complete transparency and capital market efficiency is needed. Since a company’s mineral resources and mineral reserves base is an essential component to obtaining capital, reporting these assets must also be transparent and efficient. This must occur, however, at an international level given that mineral industry operations, and its financing, are international. To achieve this, an international committee (i.e. Australia, Canada, South Africa, the United Kingdom and Europe, and the United States) was formed and has been developing standards for the reporting of mineral resources and mineral reserves.The effectiveness of these standards, however, depends on adoption by the required regulators. Unfortunately, these standards have not been recognized by the U.S. Securities and Exchange Commission (SEC). Instead, the SEC adheres to its old standard (Industry Guide 7), making it increasingly expensive and difficult for international mining companies to obtain capital in the United States. Compounding the problem is the SEC’s influence over the current work of the International Accounting Standards Board and the International Organization Organization of Securities Commissions. These organizations are in the process of standardizing international accounting practices and international securities rules and regulations. Their current position may prevent adoption of the industry-developed mineral resources and mineral reserves standards which are internationally recognized."

The significant chromite producers listed in Table I11 are not major steel producers, with the exception of the USSR. After manganese, chromium is the most important alloying metal in steel. It would not be surprising to find a direct relationship between steel production and chromite imports. The precise connection is concealed by the other uses of chromite and the grades of steel produced by the various countries involved. In addition, the amount of ferrochromium made for export must figure in any calculation. Norway, a producer of considerable amounts of ferromanganese, imports significant quantities of chromite for ferrochromium manufacture. Most of the ferrochromium is exported to European steel- producing nations. Sweden imports only half as much chromite as Norway but makes far more chromium-bearing steel. Thus Sweden has far less ferro-chromium for export, although it supplies about 2000 tons per year to the U.S. and probably some- what more to such chromite-poor steel producers as Germany and Belgium-Luxemburg.

The quantities and destinations of the metallic ores and concentrates and partially or fully refined metals in international trade result from the interaction of many factors, of which geographic location is only one. How far the processes of concentration and refining are to be carried in the country in which the mining is done and what dictates the destinations to which the more or less completely processed raw materials will move are determined not only by present-day geologic, political, and economic conditions, but also by the patterns set up by these same conditions as they obtained in the past. The first generalization that can be made regarding trade in metal raw materials-one that affects the form in which the material is transported, rather than the patterns followed by that trade-is that concentration is carried out for all low grade ores, nonferrous or ferrous, in the country in which they originate. (Rule 1.) Economic considerations alone almost always require that this be done; only high grade iron, manganese, and chromite ores can be shipped as they are mined.

The amount of lead in concentrates that moved in international trade in 1952 was only 16 pct of the world mine production of lead and was less than 27 pct of the total of lead in concentrates and lead metal that traveled from one country to another. Because almost all lead is derived from galena, lead concentrates are high grade, with a theoretical maximum of 86 pct lead, and can be shipped as such without transporting a considerable weight of waste material. It would not be surprising, therefore, to find the large share of lead in international trade moves in concentrates (Rule 5). This is not, as has just been mentioned, actually the case. There is more than one explanation for the situation. Lead smelting is not a particularly difficult process and is one for which smelting equipment can readily be made of the best size for the tonnage to be handled. Another factor that encourages local smelting is the effort of many mining countries to see that a maximum of profit from their raw materials remains in the home country. Still another factor is the newness of large scale lead mining in two of the three largest exporters of lead in concentrates. In these countries, South West Africa and French Morocco, there has not yet been time to erect enough smelting capacity to process all of the concentrate output. Even in these countries, however, it will not be long, if present trends continue and plans are fulfilled, before most or all of the lead mined is domestically smelted.

In contrast to international trade in lead, a much larger percentage of zinc shipped from one country to another is shipped in concentrate form. In 1952 international commerce in zinc concentrates accounted for 37 pct of world zinc mine production, and of the total zinc which traveled from one country to another, slightly more than 65 pct was in concentrates. The comparable figures for lead, given in Part VI, were 16 and 27 pct. Of the zinc mined in the world in 1952, 56.6 pct entered international trade; the analogous figure for lead was 57.4. This similarity in proportion of production traded is paralleled by a similarity in sources of exports. The three leading exporters of zinc in all forms in 1952 were Canada, Mexico, and Australia, in that order; the three largest exporters of lead were Mexico, Australia, and Canada. In contrast to the 86 pct theoretical maximum in lead concentrates, the maximum for zinc concentrate is only 67 pct. On this basis alone, it would be reasonable to expect that more zinc would be traded as zinc metal than lead as lead metal. Actually, the reverse is true. Less than 28 pct of the lead in international commerce moves as lead in concentrates, while 65 pct of the zinc so traded is as concentrates. Mexico, a country which has attempted to retain as much metal processing activity as possible within its own borders, has negligible exports of lead in concentrates.

INTRODUCTION In 1974, Industrial Miners Mexico, S.A. (IMMSA), agent for the borrowers, was the largest privately-held mining, smelting, and refining company in Mexico (accounting for 32% of Mexico's nonferrous metal and coal production in 1974), the fourth largest company in terms of sales, and the second most profitable company in Mexico, excluding government wholly-owned and operated industries. The company was engaged in the mining, smelting and refining of coal, copper, fluorite, gold, lead, silver, zinc and related by-products for domestic consumption and export. A combination of favorable factors led IMMSA to propose an investment plan amounting to US$286 million for 1974 through 1978, of which US$150 million was to be financed. These factors included: Substantial profits in 1973 and 1974 Positive near-term outlook for metal prices Success of the reinvestment program in increasing productivity Substantial additions to proved reserves during 1973-1974 and Fiscal incentives provided by the Mexican government to stimulate investment in the mining industry. The primary purpose of the investment program was to construct a new electrolytic zinc refinery and to expand and modernize many of the company's existing mining and refining facilities. THE BORROWER Company History Compania Miners Mexico, S.A. was incorporated in the city of Monterrey in 1918 as a wholly-owned subsidery of ASARCO Inc. (formerly American Smelting and Refining Company, New York) for the purpose of mining and processing non-ferrous metals and related products. In compliance with the Government's Mexicanization program, ASARCO Inc. divested itself of 51% of its equity in Compania Miners Asarco, S.A. on June 30, 1965. Subsequently, ownership in the divested share was apportioned as follows: 15% ownership in Compania Miners Asarco, S.A. to a group of private investors, and 36% in trust for subsequent public sale. The company's name was changed to Asarco Mexicana, S.A. in 1965. Mexican ownership in Asarco Mexicans, S.A. was increased to 51% in 1967, following the purchase of the 36% share ownership held in trust, and then to 66% in 1974 when ASARCO Inc. divested itself of an additional 15% of its holdings in Asarco Mexicans, S.A. Following its 1974 divestiture of 15% of Asarco Mexicans, S.A., ASARCO Inc's ownership in Asarco Mexicana, S.A. was reduced to 34%. In 1974, the company changed its name for the second time to Industrial Miners Mexico, S.A. (IMMSA). Fiscal Agreement IMMSA entered into a fiscal agreement with the Mexican government in 1969. The agreement, which was renewed in 1974, provided for 100% of the production and export tax corresponding to the federal government with a minimum of 50% of the amount refunded to be reinvested in fixed assets. The International Mining Convention held in Nelson, B; C., May 17 , to 19, was attended by nearly 500 delegates, of whom about 100 were from Spokane, 150 from the Slocan district, and the others from different points in Canada and the United States. Arrangements were in charge of the Nelson, Slocan and Eastern British Columbia Mining Men's Club, under the direction of Secretary Fred A. Starkey, assisted by the City of Nelson, Associated Boards of Trade of Eastern British Columbia and Nelson Board of Trade. The Columbia Section of the American Institute of Mining Engineers; cooperating with the Western Branch of the Canadian Mining Institute, provided the technical program, under the management of Secretary E. Jacobs, of Victoria, and Secretary L. K. Armstrong, of Spokane. Three technical sessions were held, at which the following were read: Difficulties of the Electrolytic Zinc Process, by Thomas French. In recent years there has been a trend among mining companies to diversify exploration and development away from the countries that have dominated mining activity for the latter half of this century. With some exceptions, this trend is accelerating and is a function of the recognition that many parts of the world, with no previous exposure to modern exploration, are endowed with considerable mineral potential. In addition coincident with changing political and economic circumstances, many countries have recognised the benefits of attracting international mining investment and have radically changed policies, fiscal and legal regimes so as to encourage exploration and mining. Some countries, however, have not readily accepted mining for cultural or social reasons and have yet to make effective changes to mining legislation. For historical reasons, other countries may have little or no direct experience of western economics, nor may they fully recognise the need for stability and competitive fiscal and legal systems to attract foreign investment. Not all ventures in new countries have been commercial successes and there have been some lamentable and recent lapses from grace. Company strategies, company standards and management objectives can also vary widely from company to company. What may be an acceptable risk or rate of return for one may be completely

In 1997, a group of Canadian mining companies met to review the Mine Environment Neutral Drainage (MEND) program and to consider future activities. They concluded that (1) that Canadian industry and Natural Resources Canada (NRCan) should fund a small secretariat in Ottawa to support technology transfer in Canada and, (2) that it was important for industry to continue the momentum of MEND on an international scale. The need for the International Network for Acid Prevention (INAP) was strongly endorsed by consultants, company, university, and government experts from Australia, Canada, and the United States who convened in Vancouver in February 1998. The initial focus was the development of a solid knowledge base covering the collective experience of INAP?s members to promote the dissemination of successful practices, the identification of knowledge gaps, and the formulation of effective research proposals. The sharing of information on past successes and failures alone was viewed as sufficient justification for the formation of INAP. INAP was officially launched in October 1998, and is now an effective, industry-based initiative to globally coordinate research and development in the management of sulphide mine waste. Significant improvements in the management of sulphidic mine materials through knowledge sharing, research, and development of technology by INAP will reduce liability associated with acid drainage. The International Symposium-cum-Workshop on Management andControl of High Gas Emissions and Outbursts in Underground CoalMines was held in Wollongong in March 1995. Coverage of high gasemissions was virtually confined to instantaneous outburst implications, essentially seam gas pre-drainage. Globally, instantaneous outbursts have been known for 150 years, andthe first Australian outburst occurred in 1895 and Australian occurrences and mines affected have increased since. Few significant coal producing countries are unaffected. The coals affected range in rank from lignites to anthracites. Geological disturbances are the most likely environments for occurrences. The most likely mining geometry is of virgin headings, with some occurrences on longwalls and in other situations. Widespread research into many aspects of the problem has yet to produce a generally accepted explanation. Explosive inducement is a well-known control. Apparently high advance rates increase face gassiness and create higher stress abutments, increasing proneness. The most popular preventive measure, pre-drainage of virgin coal ahead of faces has produced highly successful very long hole drilling performances but without the precision necessary for accurate geometric hole patterns, despite quite sophisticated drilling equipment and hole surveying instruments. For the future, more precise degasification is sought, even from the surface, together with rapid face coal gassiness assessments to confirm lowering below threshold values, as well as other proneness lowering measures, perhaps related to new heading and longwall geometries and to new equipment to provide them. But above all, safe management plans are required for each operation, to safeguard the miners and their working environments, and thus to protect underground coal mining from this mounting threatening problem.
