INTRODUCTION The tax structure of foreign mining investment into the United States has a significant impact on the financing and the profitability of the operation. For these reasons, it is critical for the foreign investor to develop and implement a well planned tax strategy that will enable its venture to: (1) reduce its U.S. income tax liability (2) lower U.S. withholding taxes when funds are transferred from the United States, and (3) decrease or defer home country taxation on its U.S. earnings ALTERNATIVE FORMS OF INVESTMENT A threshold business and tax consideration is the form in which the investment is to be made. The most common alternatives include: forming or acquiring a U.S. mining corporation, directly establishing a branch mining operation, or entering into a joint venture or partnership with a U.S. mining company. U.S. Corporations The most common structure through which foreign mining companies engage in business in the United States is to form a U.S. mining corporation. Forming a U.S. Corporation. If the investor decides to establish a new U.S. corporation the organization is relatively simple. No distinctions are made in the United States between "public" and "private" forms of incorporation. Minimum share capital is not usually required and share capital may consist of shares with no par value. Since corporate law is the responsibility of the individual states, the foreign investor must choose a state in which to incorporate. If appreciated mining property is transferred to a corporation solely in exchange for stock or securities in that corporation, and the transferors have control of the corporation (defined as at least 80 percent of all voting shares and at least 80 percent of all other shares) immediately after the exchange, no gain or loss will be recognized. However, if the transferors receive cash or other mining properties in addition to stock, any resulting gain may, in certain situations, be taxed to the extent of the cash and the fair market value of other property received. Acquiring an Existing U.S. Corporation. Acquiring an existing U.S. mining corporation is not as straight-forward as forming a corporation. This alternative may be accomplished through either a stock or an asset acquisition. Generally, with a stock acquisition the purchaser inherits all of the business and tax attributes of the former mining corporation. If the investor is able to acquire mining assets, however, the purchaser will usually be able to avoid any unknown or hidden liabilities that could be attached to an existing corporation. Another principal advantage in acquiring assets is that the purchase price may be directly allocated to the acquired mines or other mineral-related assets with the result that the assets' depreciable base may be increased. Assuming the domestic seller and the foreign purchaser can agree, it is generally advisable to allocate the purchase price in the sales agreement to specific individual assets. From the foreign investor's standpoint, it is preferable to allocate the purchase price to depreciable assets such as buildings and equipment versus an allocation to mineral land holdings or intangibles such as goodwill, which are generally not depreciable. The need for mechanized drilling to decrease mining costs has resulted in the development of the jumbo from column-and-bar drill carriages to hydraulically controlled jib jumbos. Resultant savings from use of improved jumbos have been high enough usually to retire the machinery investment within a year. The jib jumbo unit has been applied successfully to development and preparation programs and flat-bedded stopes, and an even wider field is forecast for its use.

Zirconium single crystals of various specific orientations were fabricated by rolling or drawing. The resulting textures were determined and are discussed with respect to the deformation modes that produced them. The crystals deformed in a predictable manner by combinations of up to third-order twinning with three twinning modes and by slip. Twinning was found to play a major role in initial texture formation. Texture changes produced by slip occurred only at the higher reductions. The twinning sequences that produced each intensity peak during the initial reductions could be identified. Schmid factor criteria were found useful in predicting which deformation modes to expect for each crystal orientation and fabrication procedure. The possible application of these data to poly-crystalline material is discussed. PREFERRED orientation or texture has a significant effect on the properties of most materials, causing anisotropy in fabricated cubic metals and enhancing the natural anisotropy of noncubic metals. This study evaluates the effects of several fabrication methods on the textures formed from specific starting orientations of zirconium single crystals and, it is hoped, gives an insight into the effects of the same operations on poly-crystalline material. BACKGROUND In fcc and bcc metals, texture changes take place by gradual lattice rotations caused by the operation of one or more slip systems. Deformation twinning plays an insignificant role in the deformation of such metals. In zirconium and its alloys, however, and in many other hep metals the ability to twin allows very rapid texture changes to be made with very small amounts of deformation. The deformation systems found in zirconium and its alloys are prism slip and three twinning modes.1 Slip occurs on the {1010}< 1120) system. There is little or no appreciable basal slip in zirconium. The twinning planes, illustrated in Fig. 1, are {1012}, {ll2l}, and {1122}. Two twinning modes, the {1012} and the {ll2l} operate for a tensile stress along the basal pole. A compressive stress parallel to the basal pole is required for {ll22} twinning. These twinning operations cause a 35- to 85-deg reorientation of the basal pole. The {1012} twin is the predominant tensile twin at room temperature. The twinning shears, S, are shown in the figure. A criterion for predicting which deformation system will operate when a grain is subjected to a known stress state is the Schmid (orientation) factor. This factor gives the fraction of the applied stress that computer program was written2 to calculate the Schmid factors for the four deformation modes in zirconium. It assumed three orthogonal stress axes and considered ninety-one different orientations of the basal pole in one octant of this stress space. At each basal pole position the Schmid factors were calculated for seven positions of rotation at 10-deg increments of the unit cell about the basal pole. Schmid factors were determined for a total of 637 orientations and for twenty-four deformation systems in each orientation. The program listed the Schmid factors for uniaxial stress parallel to each axis and, to approximate rolling, or-thonormal biaxial stress was also considered. Fig. 2 shows the range of orientations over which the various types of deformation would tend to predominate in biaxial plane strain with the stresses, equal magnitude. The exact boundary position between regions of different deformation modes depends, however, on the relative values of the critical shear stress for each deformation mode. Fig. 2 is drawn on the assumption that they are equal and it therefore may be only approximately correct. It is also recognized that the biaxial stress analysis may not be applicable in certain crystal orientations. EXPERIMENTAL PROCEDURE Single crystals of zone-refined zirconium, produced by Wilson of this Laboratory,3 were electrical-discharge-machined to form specimens for rolling, tube-drawing, and rod-drawing studies. Specimens were rolled at room temperature on 2-|--in.-diam hand-powered rolls from three different starting orientations: 1) the basal plane parallel to the rolling plane and the [1120] in the rolling direction, (0001)[ll20]; 2) the (1120) plane parallel to the rolling plane and the basal pole in the rolling direction, (1120)[0001]; and 3)_the (1120) plane parallel to the rolling plane and the [1100] in the rolling direction, (1120)[ll00]. When a blast furnace has a certain defined burden and is operated under fixed conditions of blast temperature, etc., the fuel efficiency is determined by the extent to which the reducing gases can remove oxygen from the burden in the furnace stack. This is determined by two distinct factors: 1) The uniformity of gas-solid contact, and 2) The ease with which oxygen can be removed from individual pieces of burden. This latter is often called burden reducibility. When burdens were poorly prepared the first factor was by far the most important and a study of the reducibility of individual lumps was of rather academic interest. In recent years good burden preparation with emphasis on uniformly sized material has led to greatly improved gas distribution in the stack, and thus the second factor has become much more important and there has been a marked increase in interest in methods of measuring reducibility. This paper explores the Linder method of measuring such reducibility. The measurement of reducibility of burden materials must be carried out under conditions duplicating, as nearly as possible, those of the blast furnace stack. This is very difficult since the blast furnace process is a counter-current one, and thus the initial conditions encountered by the solid (gas temperature, composition, etc.) are the result of heat and mass transfer occurring lower down the stack. Any method of burden testing which does not take this into account is, at least to some extent, based on arbitrary assumptions. In an attempt to study blast furnace reactions under non-arbitrary conditions BISRA adopted the SCICE technique as a method of investigation. This technique has been used with a measure of success.&apos; The SCICE technique, however, was found to be too slow for use as a routine test for burden materials and it was decided to construct additional equipment for burden testing. A test was required which would: 1) Be as realistic as possible. 2) Be quick and easy to operate. 3) Give some indication of the breakdown likely to take place during reduction in addition to a reducibility index. After a critical assessment of the reducibility tests which have been proposed it was decided to adopt the Linder test equipment and procedure as a basis for burden testing. THE LINDER TEST APPARATUS AND PROCEDURE The apparatus which was constructed (Fig. 1) was the same as that described by Linder2 except for minor changes in design. Linder also laid down a test procedure which he had derived from the results of investigations on Swedish blast furnaces. The variations of temperature and gas composition during the test were defined; these are shown diagram-matically in Fig. 2. BISRA&apos;s intention was to use the standard temperature and gas composition programmes for testing a variety of burden materials and also to investigate the influence of different programmes on standard burden materials, making use of information from the SCICE apparatus wherever this is possible. Up to the present, effort has been concentrated on the first part of the programme, and work on the second part has only just commenced. For each test 200 g of coke and 500 g of burden material were used. Linder had recommended that the coke and burden material should be between 1 and 1 1/2 in. and this was adhered to in early experiments on ores and sinters. Since the eventual aim of this work was to relate the test results to blast furnace operation, it was decided to carry out subsequent experiments using burden material in the size range used in the blast furnace, as far as this was possible. If the main interest was, for example, a comparison of the products resulting from different methods of agglomeration, then there would be advantages in using burden materials as close as possible to a standard size. After the charge had been placed in the reaction tube and this had been connected to the gas supply, rotation of the reaction tube at 30 rpm was started and the reduction programme was commenced, the gas temperature and composition being manually controlled according to the programme shown in Fig. 2. After the reduction test the charge was cooled in a nitrogen atmosphere. It was then removed from the reaction tube, the coke and burden separated, and the extent of burden breakdown assessed by screening it at 10 and 30 mesh. The extent of reduction was then

A mathematical tnodel of forward combustion in an oil reservoir is treated in this paper. The model describes a radial system having a vertical section of essentially infinite thickness, all of which is permeable to gas flow. Combustion, however, is presumed initiated over a limited thickness of the total vertical section. In the interval supporting cotnbustion, the mechanisms of radial conduction, convection and heat generation are taken into account. Above and below the burning interval, heat transport in the radial direction is by cottduction and convection. Vertical heat losses from the ignited interval are accounted for by conduction alone. A general solution is presented for the temperature distribution caused by radial movement of the combustion front. The results show that no feedback of heat occurs into the ignited interval when convection and conduction are acting in the bounding media. Peak temperatures are also 5 to 10 per cent higher than in the case where heat transport in the bounding media is by conduction alone. We arbitrarily define vertical coverage to be that fraction of the total ignited interval which is at 600F above atnbient, or greater, at any given time. The radial distance at which the vertical coverage becomes zero is the propagation range of the combustion front. It was found that an increase in vertical coverage results when the oxygen concentration, fuel concentration or gas-injection rate is increased. Moreover, the combustion front can be propagated 10 to 15 per cent further than in the case where only conduction is acting above and below the ignited interval. INTRODUCTION In the theoretical treatment of forward combustion in a radial system, one of the problems encountered is the determination of the transient temperature distributions caused by an expanding cylindrical heat source. Bailey and Larkin&apos; and Ramey&apos; simultaneously presented analytical solutions to the problem assuming heat transport by conduction alone. In a subsequent publication, Bailey and Larkin3 included the effects of both conduction and convection while treating linear and radial models. In this latter work, however, vertical heat losses were largely neglected. Selig and Couch&apos; dealt with a radial model in which both conduction and convection were acting. Only a limiting case involving vertical heat losses was considered, however. Namely, temperatures on the boundary of the bed of interest were set equal to zero. Solutions thus obtained were representative of a system having a maximum vertical heat flux. Chu5 recently treated a more general case in which a permeable bed was considered bounded by impermeable media. Conduction and convection took place within the bed, and only conduction outside of the bed. The effects of vertical heat losses were included in his study. Solutions were obtained by numerical techniques. This paper is an extension of the theoretical work of other authors pertaining to forward combustion in a radial system. In particular, a mathematical model of the process is treated in which heat generation occurs over a small vertical interval of a larger permeable section. In the interval supporting heat generation, and above and below this interval, the mechanisms of radial conduction and convection are also presumed acting. Heat losses from the ignited interval are accounted for by vertical conduction. An analytical solution for the temperature distribution caused by radial movement of the burning front is presented. The effects of certain process variables are indicated and comparisons with Chu&apos;s results are made. THEORY To render the mechanism of forward combustion tractable to mathematical treatment, we idealize the problem to the extent of assuming continuous reservoir media possessing homogeneous and isotropic properties. The following additional assumptions are implicit in this analysis. 1. The thermal parameters, i.e., heat capacities, thermal conductivities and thermal diffusivities are invariant with temperature and pressure. Moreover, the bounding media possess the same thermal properties as the bed of interest. 2. The temperatures of the porous media and its contained fluids at any point and at any time are equal. 3. The reaction rate between the oxidant gas and the fuel is infinite. This assumption implies that the incoming oxygen concentration instantaneously goes to zero within an infinitesimal distance, i.e., the width of the combustion zone is negligible. 4. The rate of gas injection is constant and corresponds to the average rate throughout the lifetime of the project. 5. The fuel concentration is constant throughout the volume of rock swept out by the burning zone. 6. There is complete burnoff of fuel. This assumption demands that the rate of propagation of the burning front equals the rate of fuel burnoff. In a radial system, with a

John L. Miles (Arthur D. Little, 1nc.)—Pollack and orris" have reported measurements on electron tunneling through A1-A12O3-A1 sandwiches in which the oxide was formed by gaseous oxidation in a glow discharge. From these measurements they deduced the asymmetry of the barrier and, since this is small, conclude that the mechanism suggested by Mott19 for the growth of oxide in thin A12O3 films is inapplicable. In earlier papers20 Pollack and Morris report similar work for oxide films grown thermally. In this case they find a greater asymmetry and conclude that the Mott mechanism is valid. I would like to point out that both these conclusions are quite unjustified. Mott suggests that the growth of the oxide film on aluminum results from the passage of ions through the already present film of oxide under the action of an electric field. This field results from a constant voltage which is in effect a contact potential between metal on one side of the barrier and adsorbed oxygen ions on the other side of the barrier. The theory does not require that the oxide grown is nonuniform either in stoichiometry or structure. It does however specifically assume that the partial layer of ionized oxygen on the surface remains adsorbed on the surface of the growing oxide. In other words, the so-called "built-in field" remains in the oxide only as long as the ionized oxygen is present. When a counter electrode of aluminum is deposited on the oxide, it will react with the adsorbed oxygen on the surface of the oxide, thus forming a small additional amount of oxide. It is clear, then, that there is no requirement in the Mott theory of oxide growth which would necessitate tunneling currents through an Al-A1203-A1 sample to be different when the polarity is reversed. Neither does the theory eliminate the possibility that some additional mechanism could cause the tunneling barrier to be asymmetric and hence tunneling currents to be a function of polarity in such a sandwich. Thus these tunneling-currents measurements are not germane to the question of whether the Mott mechanism is the true method of growth of aluminum oxide films. In fact, it is not surprising that there should be a difference between the oxide properties at the two interfaces (with resulting asymmetry in the tunneling barrier) since the growth conditions and growth rates must have been quite different at these two positions. S. R. Pollack and C. E. Morris (authors&apos; reply)— The point raised by Miles above is one has caused some confusion in the past. The following is an attempt to clarify this point. The built-in field which is responsible for the growth of the thermal oxide at low temperatures arises, according to Mott, because of the passage of electrons from the Fermi surface of the oxidizing metal to surface states introduced by the adsorbed oxygen. It is assumed that the energy of these surface states lies below the Fermi energy of the metal. Electrons therefore continue to flow from the metal to the surface until the built-in electric field raises the potential energy of the surface states to the value of the Fermi energy in the metal, at which time equilibrium is obtained between the surface states and the metal. That is in equilibrium as many excess electrons pass from the metal to the surface per unit time as vice versa. The surface of the oxide prior to deposition of a metallic counterelectrode can then be pictured as follows. The Fermi energy lies in the energy gap of the oxide and is essentially pinned at the energy of the oxygen surface states. The vacuum work function of the oxide is then given by the sum of the electron affinity of the oxide (i.e., the difference in energy between the vacuum and the conduction-band minimum) plus the energy difference between the conduction-band minimum and the Fermi energy. The deposition of a metal onto the surface of the oxide can result in a transfer of electrons across the extremely thin oxide only if there is a contact potential difference between the deposited metal and the parent metal or oxide. That is if the vacuum work function of the deposited metal differs from that of the parent metal, then charge can be redistributed across the oxide in order to equilibriate the Fermi energy across the structure. A dew-point technique was used to determine the thermodynamic activity of zinc at 430°C in a series of e phase Ag-Zn alloys. The composition of the alloys ranged from 72 to 88 at. pct Zn. This range included the composition at which Massalski and King3 found a reversal in the composition variation of the crystallo-graphic c/a ratio, which they attributed to an overlap of the Fermi surface across the (002) faces of the Brillouin zone. The data is presented in a graph in which RT In yz,, where yz, is the activity coefficient of zinc, is shown as a function of atomic percent zinc. This curve has an unmistakable change in slope at the same composition that Massalski and King observed the beginning of the reversal in the c/a ratio. This change in slope of the thermodynamic data is also attributed to a Brillouin zone overlap. Equations are presented to demonstrate that the thermodynamic activity can be related to the density of states of the conduction electrons, and that the observed phenomena are consistent with this model. It is also demonstrated that the contribution of the density of states can be related to the excess stability, a phenomenological parameter recently shown by Darkeen" to be significant in the interpretation of thermodynamic data of metallic phases. The data seem to indicate that zone overlap has caused a spinodal point, and the resulting misci-bility gap, in the phase diagram. THE problem of developing an adequate thermodynamic model of solid solutions has proven to be difficult, and is still only partially solved. The main approach has been to develop a statistical model, such as that of an ideal solution, regular solution, and so forth, to which can be attached corrections for electronic, vibrational, magnetic, ordering, or other contributions. Such corrective terms are usually derived on an ad hoc basis, and it is difficult to predict in advance what their relative importance will be. This problem has been discussed in general terms by Oriani and Alcock,&apos; who have reviewed several thermodynamic models and a few empirical correlations. The measurements described in the present paper were made to demonstrate in a special case the importance of one such corrective term, the contribu- tion of the energy of the conduction electrons of an alloy. It was our premise that the contribution of the energy of the conduction electrons to the thermodynamic activity of the alloy components could be detected; further, that such an effect would be observed at alloy compositions where other phenomena, also ascribed to the energy and density of states of the conduction electrons, are observed. The idea of the importance of the conduction electrons is hardly new. Hume-Rothery and his adherents have developed the well-known theory of alloy phases in which the sequence of phase fields in binary equilibrium diagrams, especially those involving the noble metals with the IIB, IIIB, and IVB subgroups, can be correlated by replacing the composition variable with the ratio of conduction electrons to atoms, e/a. Jones and others have developed a physical explanation for this correlation, in which they consider the solubility limits of phase fields to be restricted by an intersection between the Fermi surface and a Brillouin zone. The general features of the model are also quite well-known—presumably zone intersection causes the density of states to decrease at critical alloy compositions. The attendant increase in energy of conduction electrons in the original crystal structure allows an alternate structure to become more stable as the concentration of polyvalent solute is increased. In spite of the wide acceptance of these ideas on phase stability, there is only indirect* evidence, such as the variations in lattice parameter recorded extensively by Massalskizy3 and others, that Brillouin zone interactions occur. There are few experimental measurements, other than the correlations of the phase sequence, that substantiate the premise that the energy of conduction electrons affects the solubility limits of alloy phases. Much thermodynamic data of alloys has been found to be consistent with the theory; yet there is a lack of detailed data at compositions where zone intersection and overlap are thought to occur. One would expect that the energy of the conduction electrons would make a measurable contribution to the thermodynamic properties of alloys at compositions near zone intersection and overlap if the theory of Hume-Rothery and Jones is correct. This conclusion cannot be avoided, because the phase boundaries are determined by the requirement that the chemical potential of the components be equal in both phases at equilibrium. An electronic effect large enough to alter the stability of a phase should also affect the thermodynamic activity by a measurable amount.

ENROLLMENT in geological and mining engineering curricula is declining at an accelerated rate despite the greatest need for trained men ever extant in the minerals industry. Industrial and military demand is mounting, but the number of freshmen selecting the mineral field continues to fall. Estimates on the needs of industry range as high as 30,000 new engineers a year. The current deficit is more than 60,000 engineers less than the 350,000 to 450,000 which eventually will be needed. The indisputable fact is that the colleges are turning out fewer and fewer engineers despite the greatest enrollment in colleges and universities ever experienced in the United States. In 1950 a record 52,000 young men stepped out of the confines of ivy covered walls with engineering degrees in their hands. By 1951, however, the number dropped to 41,000 and present enrollment indicates a national graduating class of only 25,000 for 1952. No letup in the drop is forecast. About 19,000 can be looked for in 1953 and 1954 may reach an unhappy 12,000. It becomes clear that something must be done to attract high school graduates to engineering. One immediate possibility could be to make the course burden carried by the engineering student somewhat lighter. The prescribed curriculum in many schools is such that the student takes the path of least resistance, and instead of training for an engineering future, studies for a vocation which will allow him to learn and at the same time get at least a nominal enjoyment out of college life. Review geological and mining curricula of 20 colleges and it will be found that the engineering student is a veritable pack mule compared to a lad taking liberal arts or some other non-technical program of study. The curriculum for geological engineering at one school calls for 202 semester hr, with almost 23 hr carried per semester. Multiply this figure by three hr, the minimum supposedly to be devoted to a credit and you get 69 hr per week. With a bare minimum of 84 hr for sleeping and eating, about two hours a day remain for recreation. However, the load of other schools investigated is about 19 hr. The University of Utah requires 238 quarter hr for graduation with a degree in geological engineering, while requiring only 183 quarter hr for baccalaureate degree from University college, Utah&apos;s liberal arts school. It can be stated with a measure of surety that the same proportions exist in other universities. The first step would be for ECPD to review its requirements for mining and geological engineering. It must recognize that mining and geological engineers operate in a specialized field, as do other types of engineers. Although a geological engineer may not design a bridge, as pictured by the ECPD Committee on Engineering Schools, his field of design calls for similar engineering precision, a knowledge of materials, construction methods, economic considerations, and financing. Six schools have been accredited by the ECPD. What is the basis for approval and can the requirements be modified and still be kept in line with the needs of the geological engineer? Course work from school to school varies with the exception of mathematics, chemistry, and physics. Even in those courses the not inconsiderable variation lends dubious creditability to the mean. One accredited school requires 7 1/3 semester hr of chemistry, compared with 24 hr required by another, making an average for the six schools of 17 1 /3 hr. Required credit hr in mechanics ranges from 4 to 18 and in surveying from 2 to 15. Several non-accredited schools require more hr than do the accredited schools in some courses. Why is the engineering student forced to carry such a back-breaking load? The answer is of course fairly obvious. He is irrevocably set apart from the rest of the student body because of the nature of his life&apos;s work. He is training for a place in a world where technology is becoming increasingly involved. He must be prepared to do a job now-and not later. Mining and geological engineering require the same essential backgrounds as other engineers, and more. The "more" is a knowledge of mining methods, metallurgy and geology for the mining engineer. The geological engineer must know in addition, mineralogy, petrography, and geophysics. The load is compounded finally by the addition of liberal arts courses. Should anything be done to relieve the situation? Today&apos;s engineer must be a whole man, capable of handling the tools of communication and with an understanding of the economics of industry. He must be able to write clear simple English, and he must be man who can think from some other position than bent over a work table. He must be aware of the history of his country and to some extent that of the world. Not all schools share this view. Only two of the accredited schools require history courses. However, five of the non-accredited schools make it mandatory. Four accredited and five of the nonaccredited schools require economics. Courses in mathematics, physics, and chemistry are fundamental in engineer training. The average for the accredited schools could serve as a guide in

THE results are presented of an investigation to discover the fundamental atomic conditions existing in Corson&apos;s high-copper alloys hardenable by means of silicide solution and reprecipitation. The study attracted the writer because it offered a very convenient example of the general type of hardenable alloys exemplified by duralumin. Sykes&apos; iron-tungsten and iron-molybdenum alloys and the hardenable lead-antimony. SUMMARY OF RESULTS AND CONCLUSIONS In brief, the investigation shows that very perfect crystallinity exists in the solid solutions prepared at high temperature to contain as much dissolved silicide as possible. The lattice parameter of copper is altered very little by the amount of cobalt, nickel or chromium, and silicon dissolved. The hardening by drawing at a temperature to initiate precipitation of excess silicon and metal produces a remarkable change in the atomistics of the solid solution. The old perfection of crystallinity in the solid solution is destroyed and the new atomic spacings are of variable magnitude even in one grain, and a condition in a measure resembling that found in martensite is observed. Were no particles whatever precipitated by the drawing action, still ample causes for hardness would be in evidence in the solid solution alone. The lack of plane continuity in the crystal grains would oppose slip in a very effective manner. Complete annealing restores the crystalline perfection in large measure. In these alloys even the most sensitive methods failed to reveal the characteristic pattern of the silicide precipitated by the anneal, but this was largely to be expected as the amount is relatively small.

WHEN Spain established colonies on the North American continent, some of her land grants, in what is now the United States, reserved to the Crown deposits of gold, silver, and mercury. Later mineral rights were reserved under some of the English Crown charters involving land in the eastern part of North America, with provisions for the payment of royalties thereon to the Crown. Reservation of mineral deposits to the United States Government was instituted by an ordinance of Congress on May 20, 1785, which applied to such deposits in the Northwest Territory, then north of the Ohio River and east of the Mississippi River, and provided that there should be reserved "one third of all gold, silver, lead, and copper mines, to be sold or otherwise disposed of as Congress shall hereafter direct." Little was known then of the mineral resources of the country; the Great Lakes copper region had just come into the possession of the United States by treaty and much of the western mineral land still belonged to France and Spain. The policy of leasing mineral deposits was enacted by Congress under the act of March 3, 1807, which provided that "the President of the United States shall be, and is hereby, authorized to lease any lead mine which has been or may hereafter be discovered in the Indiana Territory, for a term not exceeding five years," and in the same year the Government reserved 345,600 acres of land in northern Illinois, valuable for lead. In 1816 Congress provided that in all cases where a tract of public land containing a lead mine or salt spring was applied for by settlers on the public domain, no permission to work the mine or spring would be granted without the approbation of the President of the United States. By the act of March 1, 1847 (9 Stat. 146), the control of mineral lands was transferred, with all records, from the War Department to the Treasury Department, and by the act of March 3, 1849 (9 Stat. 395), supervisory powers over lead and other mines of the United States were transferred to the Secretary of the Interior. Following the discovery of gold in California in 1848, President Polk advocated the leasing of mineral lands acquired from Mexico under the treaty of 1848. However, owing to the lack of communication and transportation facilities and the consequent difficulty of checking on production and operations, leasing was found impracticable. Mining was permitted to be carried on in each district under rules made by the miners themselves and patterned after the Mexican mining system. To meet the situation, Congress enacted mining laws in 1866, 1870, and 1872, which provided for possession by location and for private ownership, after discovery, by patent of essentially all mineral deposits belonging to the United States, except coal. Many other acts were passed by Congress applying to specific regions and states, reserving salt, lead, or other minerals, some of which provided for the leasing of such deposits. However, very few if any leases were issued thereunder. Not until 1901 (31 Stat. 745) were the mining laws extended to include salt, and in 1910 they were revised to specify salines and associated products. At the turn of the century, it became more and more evident that the mining laws developed for metallic minerals were not practical for the development and conservation of oil and gas, coal, potash, phosphate, or oil shale. Following withdrawals by the Secretary of the Interior as authorized by the act of June 25, 1910, the Department of the Interior recommended leasing legislation; however, it was not until February 25, 1920, that the Mineral Leasing Act was passed by Congress. This act authorized leasing all public lands potentially valuable for oil, gas, coal, phosphate, sodium, or oil shale. The Organic Act, creating the Geological Survey in 1879, imposed upon its director the duty of classifying the public lands.&apos; The early years of the Survey were devoted largely to the accumulation of fundamental data and, with only minor exceptions, land classification was not seriously undertaken until 1906. Since that year, it has been actively pursued with respect particularly to leasable minerals and water power values. On March 3, 1873 (17 Stat. 607) Congress authorized the sale of coal lands of limited acreage to individuals at $10 to $20 an acre, depending on the distance from a railroad, and in 1907 a new scale of prices was adopted by the Secretary of the Interior, based, more logically, on the quality and thickness of the coal deposits, their depth below the earth&apos;s surface, and their accessibility. At that time it was much cheaper and easier to obtain incidental title to coal rights under the homestead laws at $1.25 an acre. On March 3, 1909, the first separation act (35 Stat. 844) became a law. It authorized patents, with a reservation of the coal and mining rights involved to the United States, to persons who in good faith had entered public lands under the non-mineral land laws prior to withdrawal, classification, claim, or report that such lands were valuable for coal. It solved the problem only partially, and the practice thereupon adopted by the department of making coal withdrawals "from all forms of entry" instead of "from coal entry" expedited the more complete solution effected by later acts. By the act of June 22, 1910 (36.Stat. 583) withdrawn and classified coal lands were declared subject to entry under the homestead, desert land, and Carey acts, provided a waiver of the coal rights accompanied the application, and by the act of April 30, 1912 (37 Stat. 105) the same privilege was extended to State selections and isolated tracts. The act of August 24, 1912 (37 Stat. 496) extended the separation policy to lands withdrawn for oil and gas in Utah, and finally the act of July 17, 1914 (38 Stat. 509) extended it to all nonmineral filings on public lands theretofore or thereafter

A theory is presented for calculating the performance history of complete water-drive systems producing from idealized stratified formations. The general equations are applied to systems where the permeability stratification is either of the exponential or linear type. Calculations were carried through for different degrees of permeability stratification, but with special emphasis on the effect of the mobility ratio between the produced oil and the invading water on the resultant performance. These results are also expressed graphically as curves for the initial water breakthrough recovery, for the different degrees of stratification, as a function of the mobility ratio, and of the composition of the produced fluid stream as a function of the cumulative oil recovery. For several typical cases the latter has also been plotted as a function of the cumulative oil and water throughflow. The general result is that when the mobility of the oil is lower than that of the invading water the channelling tendency resulting from the permeability stratification becomes aggravated as the higher permeability zones become flooded out. Situations of this type would obtain when producing low gravity or highly viscous oils. Conversely, if the mobility of the oil is high compared to that of the invading water, the flooding of the high permeability zones will lead to a retarding and choking effect, and the gross bypassing phenomena will be partially suppressed. These conditions would correspond to those of flooding high gravity or low viscosity oils. A discussion is given of the various basic assumptions made in the analysis, including that of ignoring the stripping phase of the production history as implied by relative permeability concepts. INTRODUCTION The physical ultimate recoveries from oil reservoirs are basically determined and limited by the physical oil displacement processes associated with the reservoir producing mechanism. In practice, however, the economic ultimate recoveries are further limited by the mobility of the reservoir fluids and the uniformity and continuity of the producing formation. In fact, it is the differential depletion between the component parts of the composite reservoir which ultimately determines the total recovery at the time of field abandonment. While this observation applies to both the solution gas drive and gravity drainage mechanisms, in which use is made only of the energy contained within the original oil-bearing reservoir, it is of even more paramount importance under operations wherein the energy associated with extraneous fluids provides the ultimate oil expulsion mechanism. Whether the invading fluid is the water from an edgewater drive, water injected for pressure maintenance, gas injected for pressure maintenance, or gas returned to the formation in a cycling program, it is often the continuity and uniformity of the producing section which will control the economic efficiency of the operations. The importance of the problem of reservoir non-uniformity does not, of course, lessen its complexity or the difficulties of its solution. In fact, these are inherently such that the concept of a "general" solution is virtually meaningless. About all that can be reasonably hoped for is the analysis of specific and well-defined types of non-uniformity which may give some degree of approximation to actual reservoir conditions. Since variations in the nature of the reservoir which depend only on the position along the streamlines will not lead directly to major differential depletion development within the reservoir, the types of non-uniformity considered thus far have involved stratification assumptions. That is, the producing section has been replaced by a multi-layer "sandwich," each uniform areally, and differing from the others only in its basic physical constants as to thickness, porosity and permeability. The fluid motion in the composite system is thus approximated by a parallel superposition of the independent fluid movements in the individual strata. For the specific application to cycling operations the theory of the effect of permeability stratification has been developed for both discontinuous&apos; and continuous types of permeability stratification. Among the latter, treatments have been given of systems in which permeability distributions are governed by exponential, linear&apos; or probability3 functions. In all these studies complete dynamical equivalence was assumed between the injected dry gas and the displaced wet gas. The overall effective permeability of each stratum was therefore considered as constant and independent of the degree of invasion of the injected fluid. In the case of the displacement of oil by water, the assumption of dynamical equivalence between the water and oil will be strictly valid only by accident. Even if the oil viscosity should be the same as that of the water, the effective permeability to the oil in the presence of the connate water will in general be quite different from that of the water behind the water-oil interface flowing past the trapped residual oil. As a result the effective permeability for the stratum as a whole and rate of water invasion will change with time as the intrusion continues. The differential fluid motion in the individual strata will thus also vary with time. Qualitatively, it is easy to predict the resultant effects. If the permeability to viscosity ratio of the invading fluid exceeds that of the fluid displaced, the stratification and bypassing effect of the perme-
