At the time of mine accidents one frequently hears the expression "there will be accidents as long as there are mines", or it may be varied to state that the accident in question was unavoidable, or something similar indicating inability to prevent accidents. However, it is the opinion of the writer, after over twenty-one years experience in both coal and metal mining, seven years being spent wholly in safety work, that by far the greater number of all accidents is due to carelessness or negligence. This carelessness or negligence may be on part of the victim of the accident or of one of his companions, or on part of his employer or possibly even of the inspector or safety man, and in some cases all of these agencies are involved. It manifests itself in various guises, one of the most serious being violation of state mining laws or regulations or of mine rules, and frequently the rules of ordinary common-sense. The cause very frequently is that trait in human nature to "take a chance" and it has been the writer's observation that the worst offender is the old-time miner who has come safely through many years experience, who was mining when the "safety man was a baby", and who clings to old-time ideas and practices and has "no use" for "newfangled" present-day "notions". Unquestionably, there are accidents, wholly unavoidable and many are caused by ignorance and by the new-comer in mining, yet as previously indicated, the writer's observation is that the old-timer is by far the worst offender, bringing grief to himself, companions and employer. Of the numerous manifestations of carelessness and negligence in connection with mine accidents, which have come to the notice of the writer, only one will be treated in this paper, viz: Violation of State Mining Law, and mention will be made only of explosions and major accidents in coal' mines with which the writer came in personal contact as investigator. In most cases, in addition to mine inspection after the accident, the writer heard the evidence given at Coroner's inquest and thus was enabled to for¬mulate fairly definite impressions as to events and conditions leading up to the occurrence.

It is quite generally conceded that the coal mining industry is among the most progressive in the adoption of modern and efficient equipment and mining methods, but most woefully antiquated in many respects in the matter of systematic accounting. The cause of this condition is problematical, but is usually thought to be due to false economy. We realize that those who do not understand accounts, or like accounting, are inclined to be disdainful of accounts and statistics, and to under-estimate the benefits derived from the expense and labor involved in proper accounting. The business that is run without a proper accounting system is subject to haphazard financing and courts disaster. Furthermore, the operator who disposes of his product without due regard to the requirements of the industry as a whole, as reflected in the cost of doing business, is an unfair competitor. No one will deny that the possible production of coal in the United States is much in excess of the demand. While it is true there is an occasional shortage in certain localities, it is due to temporary abnormal conditions which are overcome in a short period of time, when the mines are again obliged to take idle time, and herein lies the danger, not alone to the operator who neglects to keep informed as to operating costs; but to his competitor as well. While physical conditions and operating methods differ materially, accounting methods must likewise differ in some respects, but irrespective of how the result may be obtained, a true statement of cost is absolutely essential. Daily cost statements may be preferred by some, but have proven unsatisfactory, generally speaking, because of variation in production as well as in both labor and material expense from day to day; therefore, we will confine our attention to a monthly cost statement. To be most effective, operating cost statements should be prepared and submitted to the officers as soon after the close of the month's busi¬ness as possible, to enable them to remedy any defects in the operations that might be discovered by an analysis thereof. Opinions differ materially with respect to the most efficient method of compiling and the distribution of labor and material. The writer believes that a time book which provides space in which to enter the number of hours worked each day of the month by each employe, together with distribution thereof, is the most accurate, simple and complete. This record will show the service performed by an employe each day of the month and the account to which same is properly chargeable. This, of course, refers only to the employe working by the-day or month. Mr. O. F. Lewis opened the meeting at 9:00 a.m. lie announced that Stan Shuhart, had the following announcement. to make: Stan. Shubart: George Delamater of Fort, Lauderdale, Florida scads greetings to his friends here at the meeting. O. F. Lewis: Thank yon, Stan. This morning we will start our meeting by turning it over to a very distinguished gentleman. I'm sure all of you know him. He started his work career many, many years ago, but lie doesn't look nearly this old, and his energy belies this. From 1.910 to 1916 he was a chemist with the American Smelting & Refining Co. at. Garfield, Utah. From 16 to '17 he was a broker with J. A. Hogle Company at Salt Lake. From 1917 to 1948 he was a metallurgist, ore buyer, assistant manager and later general manager of the Utah department. ASRC at Salt Lake City; and also president of the Garfield Chemical Co. Since 1951 to the present. time he has been President and General Manager of the Independent Coal & Coke Co. and Vice President of the Western Rock Bit Co. He has held many, many honorary positions; former Chairman of the Board of Regents of the University of Utah, former President of the Salt Lake Winter Sports Association, Past President. of the Community Chest there, and is presently a Director of National Coal Association, a Director of the First Security Bank of Salt Lake City, Utah, and also a Director of the Hotel Utah.

PRESIDENT MOSES: I think this will conclude our program for this afternoon, unless you have some- thing else. Mr. Holman, will you tell us what you are doing in the way of your local chapter, around Dawson? W. C. HOLMAN: (Chief Engineer, Phelps-Dodge Corporation, Dawson, New Mexico.) We have organized a local chapter of the Rocky Mountain Coal Mining Institute, and we invite all foremen, fire bosses, shot firers or anybody interested, either on the surface or in the mine. I think at the last meeting we had sixty to seventy men present. We hold meetings once a month; usually on a certain set Tuesday or second Friday of the month, or so on. We have a President, a Vice-President and a Secretary-Treasurer. There are no dues connected with it. We aim to take up the' papers that are presented at the various meetings of the Rocky Mountain Coal Mining Institute, and also any other subject that would be of interest, connected with our own mining operation. We usually ask two or three men to pre- sent papers, rather than one man. We find it difficult in getting one man to work up any subject, but two or three men work up very interesting papers. While we have just recently organized, we aim to have luncheons in connection with it, and possibly once a year a banquet or .some similar activity that we think would interest the men. We feel it is going to be a great help in carrying on the work of the present organization in presenting the activities around the mines. PRESIDENT MOSES: I thank you, Mr. Holman. Has any one any- thing to bring up at this time? MR. LITTLEJOHN: I would like to ask Mr. Holman if the Institute or the Chapter there is confined to Dawson alone, or open to other camps in New Mexico? MR. HOLMAN: At the present, Mr. Littlejohn, it is just confined to our own camp, although we intend to invite the members and the officials of the other camps later on, perhaps. Especially, if we gave a banquet, no doubt we would invite the others. MR. LITTLEJOHN: Is there any other Chapter in New Mexico besides yours in Dawson, Mr. Holman? MR. HOLMAN: None that I know of, right now.

(The following discussion took place on this screen lecture in the dark.) MR. SHUBART: Would you give us a little .explanation as to the operation of this machine and what you are doing with it? MR. TESCHER: There is a 20- horsepower motor, rheostat, crusher, and a fan mounted on one base plate and operating on one shaft. The fan is overhung on the shaft. The only bearings you have are the bearings on each side of the crusher and the motor hearings. On one side of the ma- chine there is an opening for feeding shale. The machine is operated at 1,200 revolution per minute and as the shale is pulverized, the fan automatically exhausts fine dust from the crusher from an opening in the top of the crusher. The machine pulverizes 3,000 pounds in eight hours, reducing the materid to one hundred mesh. The last ma- chine we put in has been operating continuously fifteen hours a day for the past sixty days, without repairs of any kind. PRESIDENT LITTLEJOHN: Where is the machine in operation? MR. TESCHER. At the Royal mine. We have used ordinary mining ma- chine cable in local movements of the machines. This has enabled us to have twenty-two locations throughout the mines. The mine is highly gaesous, and the machines had to be placed on intake air. MR. SHUBSRT: What type of crusher do you use? MR. TESCHER. A No. 16 Universal, operating at 1,200 revolution per minute. M. SHURART: What material do you feed to it? MR. TESCHER: We have shale three-quarters of a mile from the mine. In the winter months we have been troubled with moisture. We build a kiln and get this shale and load it into the kiln for drying and then place it into a pit car and take it into the mine. The material must be dry. We have also used slate in the mine and have had good success. The slate at the mine is fairly hard. I presume, however, that the slate will probably carry a high silica content. MR. SHUBART: Mr. Harrington claims that silica does not do the harm, as was formerly supposed. MR. TESCHER: There is still a question as to whether it is harmful or not. PRESIDENT LITTLEJOHN: Are there any of these machines in operation closer than Aguilar? MR. TESCHER: There is one at the Alamo mine. Mr. Quealy also purchased a couple of them for use at his Wyoming mines. PRESIDENT LITTLEJOHN: Are there any other questions you would like to ask Mr. Tescher regarding his rock dusting machine while it is on the table for discussion? MR. DALRYMPLE, SR.: How many men does it take to operate it? MR. TESCHER: One man operates the machine. Sometimes we put the

PRESIDENT PRYDE: Any discussion on Mr. Poster's paper? MR. J. BEVAN: I would like to ask the gentleman how fine the dust has to be to cause an explosion? MR. T. FOSTER: According to the Bureau of Mines, it is claimed coal passing through a 100 mesh screen would be considered fine enough. That is all I can learn from the different bulletins. MR. BEVAN: Will the coal dust be that fine; going back in the empty cars on the tipple in the mine? MR. FOSTER: Possibly a great deal of it would be. MR. BEVAN: Will the coal dust be that fine, going back, in the empty the coal dust going back in the cars on the tipple, and into the mine? MR. FOSTER: In some places, they are wetting the cars at the tipple, -in the Rock Springs District, we have as the trip goes out, they have a big pipe, and they souse the car, and wet the load, and in some places, near the timbers; that helps to a certain extent. That does not absolutely eliminate it all, but it helps considerable. MR. WM. LITTLEJOHN (Utah Fuel Company) : I think we have all listened very attentively to the paper that Mr. Foster has just read. He has brought up a subject rather close to my heart, for a long time. He mentions particularly, the Scofield disaster, which happened the first of May, 1900; two hundred men lost their lives in the explosion; and I think it is generally conceded that is about the first time it had ever been brought to the attention of coal miners or operators that such a thing was possible, namely, a purely coal dust explosion. The term "Scofield disaster" is rather a mistake, in a way; while the mine that exploded at the time is in the Scofield District all right, it is now known, and probably was known at that time, as the Winter Quarters Mine, one of the mines which belongs to the Utah Fuel Company at the present time, and did at that time. MR. TESCHER (Disaster at Dawson) : I move that you appoint a committee of nine members of this Institute to draft a set of resolutions that we can send out to all members of this Institute, to the mine officials in all four states, that might go towards preventing these disasters; that we reach all men, all mining men, mine officials of all kinds. I think we have enough brains to carry out a few suggestions of that kind. I think you are fully familiar or know men who are fully qualified to act on this committee. The only qualification that I have is to ask that Mr. Harrington be appointed a member of this committee. PRESIDENT WHITESIDE: You have heard the motion, and I believe it was seconded. Is there any discussion? That is a subject that really needs a great deal of thought. MR. LAMB: Things like that can't be handled in a minute. What Mr. Tescher suggested is all right, but to my mind, going into a great many of these different properties, seeing the conditions, such things hit pretty close to home. I would suggest that you put this off; lay it over until such time as the people who had the disaster have some time to think these things over. It is too soon to offer even a suggestion. Suggestions are all right, but there are no nine living men in the United States who can stand up or sit down and talk it over and give you any reasonable answer, in one hour or six months. First, you would naturally have to go down there and converse with the men who were at the camp at the time. You are all operators; all you operators would -like to talk it over today. You realize that anything that is good for the camp is always acceptable in disasters of this kind. I say, do it gracefully and not by publication. MR. TESCHER: I feel that the men present know these suggestions by heart and they don't have to discuss them. They know them instinctively and they know they will apply to any mine. It must be understood that if these suggestions are not carried out, they ought to be; and there is a motion before the house. PRESIDENT WHITESIDE: Mr. Murphy, you started to rise to your feet a moment ago. Have you anything to say on the subject? MR. MURPHY: I have just returned from a visit to Mr. Brennan. Mr. Brennan and I have worked together for twenty years. The manager of our company asked me to go down there and express his sympathy. Those things come to all men if they live long enough, in the coal business, and he wanted me to express to Mr. Brennan personally his sympathy and deep regret. What I had in mind when I started to rise, was to suggest that the Institute as a whole express its sympathy to Mr. Brennan. I don't think there is a man in Utah, Wyoming, Colorado or New Mexico who has done more in safety' lines than Mr. Brennan, and it just seems bad luck that he had this disaster, and I am in hearty sympathy with the gentleman who spoke about not appointing this committee. I believe a resolution to Mr. Brennan would be very much better. JAMES DALRYMPLE: I am in sympathy with this gentleman here. I think it is going to hurt the feelings of those connected with the mines in which this disaster occurred. If you will give me the privilege for a few minutes, I will gladly express myself and the action that has been taken in the past by this Institute, and my opinion combined with a great many other opinions. And what I am going to say is going to be said by the-well, I am going to say it as I see it. I am going to say it not in an unfriendly spirit, but from a spirit of not undue criticism. I happen to be one of the original members who organized this Institute. I did what I could to obtain memberships. I remember very well when we had our first meeting that we had a very large membership. I think I have a photograph of the members which was taken on the steps of the Capitol building at that time. Our membership at that time was composed largely of underground officials. I mean by "underground" officials, the superintendents to some extent, the mine foremen, their assistants,

The Fortieth Regular Meeting of the Rocky Mountain Coal Mining Institute was called to order in the Hotel Utah, Salt Lake City, Utah, Wednesday, June 10, 1942, at 11:30 a.m., by President, Wetzel, who presented Mr. William A. Fealey who, in turn, introduced Mr. Bracken Lee, Mayor of Price, Utah, who made the address of welcome. President Wetzel then made a few remarks. The Secretary announced with regret that, due to the critical illness of Mr. Sidney Hale, he would be unable to at- tend the meeting. On motion of Charles M. Schloss, duly seconded and carried, the reading of the minutes of the Thirty-ninth Regular Meeting was dispensed with. Mr. Schloss also moved that the Chair appoint the usual committees, which motion was seconded and carried. President Wetzel then announced that the committees would be appointed during the afternoon session. Following routine announcements, the meeting recessed at 12 o'clock noon to reconvene at 1:30 p.m.

Dennison, Jr., Superintendent, Raton Operations, Kaiser Steel Corporation, Raton, New Mexico. His speech of welcome to the Institute follows: The President's Remarks Guests and Members of the Rocky Mountain Coal Mining Institute: It is my privilege and pleasure to welcome you to the 56th regular meeting of the Institute. A look at the program will show that the various chairmen and their committees, headed by General Chairman A. Z. Dimitroff, have been hard at work to prepare a program which I am sure you will find to be informative as well as entertaining. I think that a special vote of thanks and appreciation is due Glenn Sorensen, who stepped in to head the Program Committee when Clint Cornelius moved from this area.

President Robert Wilson opened the meeting at 9:00 a.m. He introduced William A. Bear, General Manager Bear Coal Company, Inc., Somerset, Colorado, who presided over the session. George Nugent, Peter Kiewit Sons' Company, Sheridan, Wyoming, presented a most interesting film "Montana Mine Reclamation." His biography follows: George Nugent first entered the coal business in 1943 when he developed Peter Kiewit Sons' Co.'s first coal mine-Big Horn Coal Company at Sheridan, Wyoming. Since that time he managed an expansion program for P.K.S. in mining that resulted in the development of two other producing mines - Rosebud Coal Sales Company at Hanna, Wyoming and Decker Coal Company at Decker, Montana, in which Pacific Power and Light is a partner. Applications are now pending for a third mine. Black Butte, a joint venture of P.K.S. and Rocky Mountain Energy Company, near Point of Rocks, Wyoming. Nugent is a Past President of the Wyoming Chapter, Association of General Con- tractors, Wyoming Mining Association and Rocky Mountain Coal Mining Institute. He was President of Big Horn Coal Company and Rosebud Coal Sales Company as well as Manager of the Mining Division of Peter Kiewit Sons' Co. and Decker Coal Company when he retired Jan. 1, 1975.

The question of disposition of the slack and dust so troublesome to coal mine operators of the West has been divided by your committee chairman into three heads, viz: The preparation and transportation of fine and powdered coal. The developments along the line of low heat carbonization. The uses to which fine and pulverized coal have been put. The development of low heat carbonization has been assigned to me. This is really not a part of the subject but as it has a most important bearing on the future use of coal, I presume the chairman thought best to include it. An English committee on smoke abatement makes the statement that the burning of raw coal is "dirty, wasteful and unscientific". I will go a step further and characterize it as an "economic crime." It has been predicted by eminent scientific men that eventually no raw coal will be burned for heat or power purposes. All this will take time, experimentation and large expenditure, but it will surely come. The question of disposition of slack and dust so troublesome to coal and utilization of its by-products has been retarded by the abundance and cheapness of the raw coal, and by the abundance of suitable coking coals for metallurgical purposes. But necessity is surely, if slowly, demanding that the enormous waste ensuing from the burning of raw coal for heat and power must cease. For instance, smoke abatement investigations in Manchester, England, showed that the increased cost of household washing was about $1,250,000 per year due to smoke and soot. It is estimated that in London 200 tons of soot and smoke particles are suspended in the atmosphere over that city during dense fogs and that much more than this is emitted from the chimneys each winter day during the forenoon. As an example of what benefits a smokeless fuel gives, it is cited that in the mill town of Shaw, England, the burning of smokeless fuels in the factories has reduced the so-called fogs by about 80%. At nearly all of the copper smelters in the Southwest, at some time, calculations have been made having in view the economy of replacing fuel oil with pulverized coal as a heat-producing medium for smelting operations This matter has been, and is more so now than at any time heretofore, of very great importance. Due to the intensive development of oil-producing areas of the world and the tremendous use of fuel oil for many purposes, it seems that before many years the supply of oil will become so small as to prohibit its use for such operations as smelting. This may be caused by prohibitive prices, or even by government decree as a conservation measure. In the event that the use of fuel oil becomes out of the question, the copper companies have just two alternatives: the use of pulverized coal or electricity. The copper companies of the Southwest produced an average of 808,400,000 pounds of copper per year for the war years of 1916, 1917 and 1918. This figure is, of course, a higher one than has prevailed since the war, but at the present time nearly all of the mines and smelters are getting back to capacity. There is no doubt whatever that the consumption of copper is going to increase, perhaps for the next ten years. This means that more copper mines will be discovered and developed, and that the mines which are now producing will be called upon for a greater production. This all tends to show that the mine manager who is looking ahead must develop some substitute for fuel oil in the event of its use becoming prohibitive, and all indications seem to point in that direction. The only coal which is commercially available to the smelters in the district under discussion must come from Colorado and New Mexico. These coals are high in ash and volatile matter and comparatively low in calorific value. The proximity of the smelter to the coal mines is a large factor in determining which fuel is more economical. Most of the smelters within two or three hundred miles of the coal mines find it more profitable to burn coal, while those at greater distance find that the higher freight charges on the coal make the use of oil more economical.

Dear Sir: Yours of July 23rd, relative to my appointment on the Safety Committee in connection with the Rocky Mountain Coal Mining Institute. As you say in your letter, "The duty of this committee is to draft suggestions as to safer mining practices with the idea of preventing disasters in coal mines." Much has been written and many suggestions made on this same subject, and it is very hard to put up further recommendations than have already been made. The disasters you mention in your letter unquestionably have direct reference to coal mine explosions, which from time to time still occur in this and other countries. As far as our Western mines are concerned, you know that sprinkling and shot firing by electricity have been very extensively carried out. Notwithstanding these precautions; we have had a few rather serious disasters in the past in these mines. I do not care to place any blame or responsibility on the companies having these disasters, but it is a fact that in each and all of them, after careful investigation has been made, that the human element has had more or less bearing on the accidents happening. From most reports that we gain, either directly or indirectly, it is very evident that investigation shows after an explosion that the rules governing one or both of the above safety measures have been somewhat carelessly or negligently carried out. Much has been written and read about rock dust sprinkling, but it is questionable if this method is doing a great deal toward the eliminating of disasters. While it is true it may have the effect of preventing propagation, still I do not believe anyone claims for it a sure preventative against initial explosions. I had occasion not long ago to visit a mine, after an explosion, in which dust barriers were supposed to be hung, and from indications it was quite evident that the dust barriers had been in operation, but they did not prevent the explosion from reaching all open parts of the mine. It is also true that profuse scattering of rock dust throughout a mine would have a beneficial effect, but there is a question arises here as to whether the sprinkling by rock dust or the spraying by water, if available, is the most effective. I am satisfied that if all coal mines are kept well sprinkled and all open workings maintained in a thorough moist condition, that the biggest factor in a coal mine explosion is in this way eliminated. There is no doubt but what the use of permissible powder, particularly if shot by electricity, has had a very marked effect on the number of disasters in mines, and if this method of shooting was energetically carried out there would be a difference in the number of explosions, both minor and Major, all over the country. Some of the recent explosions have taken place where no shooting was being done, but there is no denying the fact that the other ingredient, namely, coal dust, entered in the elements very extensively. Much has been written by men connected with the coal mining industry, and mining laws have been enacted for the safety of the men employed in the mines, and for the protection of property connected therewith. It seems almost impossible for anyone to select a subject that has not already been read, discussed and put into effect, especially in the coal mines of Western America. There is, however, a subject of much interest to the mining public, and to which I have given a great deal of study and consideration, and which I believe will be received by this convention, and will be given due consideration in the future in applying it to the safety of the mine,- "Efficiency in Shot Firing." Beginning with 1865, and for a period of 28 years in the state of Colorado, the annual reports of the chief inspectors show that 1159 coal miners were killed in the following manner: Five hundred eighty-two by falls of rock and coal ; 517 by gas and dust explosions; 6o by careless handling of explosives and the shooting of coal by the, individual, miner. It is my firm belief that 75 per cent of these fatal accidents might have been avoided, if a safe and proper shot firing system had been installed, at each and every mine. This may sound unreasonable, but I believe that the blasting of coal by the individual miner, and the use of black powder, squibs and fuse has, in reality, caused the death of many miners, from shock after blasting, the shooting out 'of timbers, and working in powder smoke, which fatal accidents were attributed to falls of rock or coal. These conditions led the people of Colorado, through their representatives of the General Assembly of Colorado, to enact a new coal mining law, and in 1913 this law became effective, containing twelve sections devoted to the subject of Efficiency in the System of Shot Firing. During the period 1913 to 1920, the employment of a shot firer, the use of permissible. powder, and the electric hand battery has resulted in safer mines, safer miners and safer shot firers, and I believe every coal mine in the state should employ first-class, certified shot firers, use permissible powder and fire the shots with an electric hand battery. I believe where gas generates in dangerous quantities, which is generally determined by inspection of the mine, and the daily report, the shooting in. such a mine should be done by electric battery located outside of the mine. Where permissible powder is used, I have seen the shot firer start down the mine with a belt around his waist containing one hundred caps, a safety lamp to test for gas, and an open light to ignite the fuse. Would it not be much safer for the shot firer if he used the electric hand battery? In non-gaseous mines where black powder is used, I have. seen the miners carry fuse into the mine, and shot firers have been known to partly tamp the holes, which was
