MR. MONAY (Vice President Kinney Coal Co., Scofield, Utah): The past year and a half has witnessed a series of coal mine disasters in Utah and Wyoming, concentrated into the short space of a few months, following a long period of years in which the industry was comparatively free from devastating calamities. The natural result has been a hysterical activity on the part of bureaus, commissions and professional reformers who know little about coal mining from a practical standpoint. This activity has been met by the industry in Utah with an attitude of submission, no doubt the result of the fear of being misunderstood by the public. But it is my firm conviction that the lives and property of the coal industry will find their surest guaranty of protection in the humanity, and in the self interest of those operating and working in the mines, rather than in governmental regulation. Inelastic, inflexible blanket statutes and rules will simply stifle and hamper the initiative and progress of our industry in working out its own salvation, under the varying and changing conditions of different localities, different conditions, and in different mines. We who have spent our lives in digging in the mines and operating them, know more about this business than anyone else and I believe it is time for us to speak up and no longer sit meekly by while inexperienced bureaus and unskilled commissions make up laws, rules and regulations for us which when made are on the books to stay, even though in a short time they may prove inapplicable, in whole or in part, or be superseded by something different, and which in some cases create new dangers or lull us into a false sense of security. Shortly after the Castle Gate explosion in March, 1924, a new set of safety rules was issued by the Indus- trial Commission of the State of Utah to become effective July 1st of the same year, the most important of which prohibits the use of black powder in any mine--gaseous or non-gaseous; prohibits the use of open flame lamps in any mine-gaseous or non-gaseous; and requires that rock dusting in all main haulage ways as far as the freezing point and required that all mining machines be equipped with water to be applied while cutting. These rules have been characterized as "Utah's Monument to her Dead Miners" in a large poster spread broadcast over the country from an office in New York that styles itself the Association for Labor Legislation. In reviewing the coal mining history of the State of Utah, in the year 1900, a serious disaster occurred at Winter Quarters. The cause of the same is believed to be an explosion of powder that was stored in the mine, which was a common practice in the early days, and from that time until the Castle Gate disaster, March 8, 1924, a period of some twenty-four years, no explosion of any kind occurred in this district. During all this period open lamps were used, considerable black powder was used, rock dusting was unheard of, sprinkling with water was very generally done-all without any catastrophe. Since the adoption of the new rules, we have 'had a very violent explosion at the Carbon Fuel mine in Spring Canyon. At the time of this explosion, 3,000 feet of the main slope had been rock dusted several times between July 1st and September 21st. The second left entry, which is a main haulage way, a distance of 3,000 feet was completely rock dusted on the date of the explosion. This mine is not considered extremely gaseous, yet an explosion as violent as that of the Castle Gate mine occurred. Some thirty men who had been loading coal in various parts of the mine on this Sun- day, the day of the explosion, and other men employed in rock dusting the second left entry, had just left the mine a little while before it occurred, and no abnormal condition in the mine was noted. At the time of the explosion five machine men were in the mine.

I am not an orator and have never said a word in public during my thirty years' experience in the coal mines of Colorado; but, being requested to speak by our worthy chairman, and as I am deeply interested in the future welfare of this organization, 1 will make an effort to say a few words in behalf of the Rocky Mountain Coal-Mining Institute, which we are about to organize. As 1 understand it, it is the object and intent of this organization not merely to assemble occasionally for the purpose of discussing various problems in coal-mining, and thus to obtain the best possible results in economic operations, but its especial duty will be to devise ways and means whereby accidents in coal mines will be minimized. Figuratively speaking. we are about to plant a tree in the State House of Colorado, and desire its roots and branches to extend over Wyoming on the north, New Mexico on the south. and Utah on the west. So we expect this tree to bear fruit over a vast area. We must remember that the planting of a tree, even in good soil, is useless unless we cultivate, prune, and nurture its development. If we will not do so, the tree will not bear the desired fruit. So, in order to make the Rocky Mountain Institute a success, we must not only start it off in good shape, but we must keep on adding to its strength in various ways, so that it will become a known factor and a recognized power over this broad territory. In other coal-mining states and countries of the world much has been accomplished through similar organizations to reduce loss of life among men engaged in the production of coal, and there is no reason why our institute in the West should not be equally useful and attain the same results. There are many ways by which this organization can be made beneficial to the men engaged, in various capacities, in handling the "dusky diamond." I will endeavor to confine my brief remarks to the necessity of a crusade of an educational nature among three classes of men that are directly and indirectly connected with coal mines. First-We need to educate ouselves. It is amazing how few of our number, holding positions of trust, and having charge of men in and around coal mines, are conversant with our brief mining laws and cognizant of our duties in enforcing them. Going down the line to our company men and miners, I think 1 can safely say that not over 5 per cent of them are in any way familiar with the statutes that have been enacted for their especial benefit and protection. This condition, 1 think, can be, and ought to be, remedied, and. if thoroughly done, the effect in reducing loss of life will soon become apparent. Now, to reach the officers or men in charge I consider an easy matter, which could be accomplished in this manner: Have our general managers or owners of coal properties issue a circular, compelling every superintendent pit boss, fire boss, or other officer having charge of men, to send them a copy of the mining law in their own handwriting every six months. But to come to the masses engaged in coal-mining. to get these men of various nationalities educated in the mining law, will be a difficult task indeed; but I think I have an original scheme that is practical, and which, if put in operation, would work wonders in educating our company men and miners. This plan is as follows: Have every school in every coal-mining district devote one-half hour on Friday afternoon after school hours to the familiarizing of all male pupils between the ages of twelve and sixteen years with the contents of our laws governing coal mines. At the end of each term of school, award small prizes- say, $5, $3, and $2- to those that are best posted, the principal of the school to be the sole adjudicator. Now, someone may say that this is causing extra work to our teachers, with no compensation. In this respect, I will vouch that 95 percent of our teachers will do this work gratis, providing we can show them the benefit of the system. If we go a step farther, and put an incentive before our teachers, probably it would be a good scheme to award a prize-say, $20 or more-for the best set of practical amendments to our mining laws complied by any school and its teachers, judges of the amendment to be members of this Institute and appointed by the President. There is no denying the fact that we need to be educated, and that we should adopt some system that will encourage a knowledge of practical and scientific mining amoung our present forces and the rising generation. Modern civilization is centered around a small group of essential occupations, the three principal ones which are agriculture, mining and manufacturing. Agriculture might be called the most important of the three, as it has to do directly with the supply of food for the human race. Mining, however, is certainly next in importance, as it furnishes the supply of fuel and many of the raw materials used in manufacturing. Without mining, modern machinery and many industrial operations would be impossible. Mining takes advantage of the, natural resources in fuel and minerals that lie underneath the surface of mother earth, and while at times some of these metals are hard to find and mines come and go, mining must continue to increase. Mining is no longer a haphazard proposition but one calling for careful study and complete plans of operation for years to come. The shafts, power houses, rock dump crusher, concentrator, and other machinery must be located advantageously in order to enable owners to make a profit. Many tons of rock or mineral must be mined frequently to get one ton of concentrated metallic ore or metal itself. Economy in mining is just as essential as it is in manufacturing. The mining engineer of today is called upon to utilize every branch of engineering, and not only, is a wide: range of knowledge required, but ingenuity to meet the unusual conditions which are constantly arising from week to week. On account of the wide variety of information required by the mining engineer, some things with which he is in almost daily contact may be passed over with only a small amount of attention, provided everything is going well, in order that time and attention may be focused on what might be termed the more important features of mining operations. Because competition has become keener than ever, owing to overproduction at times of certain minerals, it becomes a matter of first, importance to understand as far as possible the factors which enter into the cost of production of any mineral which may be mined. In such times of overproduction, the high cost mine is forced to close down while the low cost mine may, if desired, be kept running constantly. In keeping a cost record, wire rope on account of its high first cost 19 coming into the lime light, and a comparison of records of one mine with another is now frequently made in order to see whether the rope service is satisfactory or not. Every rope maker, on the other hand, is interested in seeing that the rope which he produces gives the maximum possible return for the money invested. Modern mining owes much of its success to the use of wire rope for hoisting materials from beneath the surface of the ground. Deep mining would be impossible without the use of wire rope as a means of hoisting. A study, therefore, of rope problems in mining work and a discussion of the points which are beneficial to maximum life will enable the mining engineer, manager, or superintendent to keep his costs down to the minimum while at the same time he provides a suitable and sufficient safety factor for operations at all times. Mining might be defined as the extraction of coal, metallic ores, or minerals from below the surface of the ground. The writer has been asked to set forth for this Institute, the experience of the past eleven months in the mining operation conducted at Sweetwater Mine in which coal has been produced by the use of Link-Belt Conveyors on long faces. The coal in this mine has an average of six feet three inches in thickness, and lies on an average pitch of five degrees. The roof is a sandy shale of medium hardness and has been generally considered as good top in the room and pillar method of mining. When our company became interested in conveyors, the writer visited most all of the mines in the East where conveyors and other mechanical methods of mining were in use and decided that the modified method of w-hat is in use at the Norton-West Virginia mine would be the most feasible for our conditions. We in- stalled three hundred feet of conveyor as an experiment to see whether or not our roof could be handled and taken care of on long faces. This three hundred feet was installed as two separate conveyors, one as a face conveyor-100 feet in length, the other as a heading conveyor that delivered the coal into the mine car on the main entry. This face was worked directly on .the strike and down the pitch. This did not prove to be a success as the caving of the roof carried over to the working face and necessitated propping between the conveyor and the face and it was also necessary to shovel coal on the conveyor up the pitch. After working out this block, 200 feet in length, we installed these two conveyors at a place adjoining this worked out block, but on a half V shape shown on the sketch. This block of coal was sixty feet wide. This method proved to be very successful. We cut a place, moved the conveyor against the face before shooting and carried two rows of cribs between the conveyor and the cave, and caved the roof every second cut. After working out this block we were satisfied that this system was feasible with our mine. We then ordered twelve hundred feet more of the same type as the trial conveyor with the exception of a very few modifications. We then installed this fifteen hundred foot unit on the four faces shown on the sketch, with one hundred feet to each face, two hundred feet on each heading and three hundred feet on the main conveyor that delivered the coal into the pit cars. We also had a head and rear section for each of the four advancing places shown on the sketch. As the sections were taken out of the heading conveyors they were installed on the advancing conveyors, and when the faces approached the main conveyor, the main conveyor was taken out and installed in the next uphill or main conveyor place. The roof caved very well in line of the points and was broken about every twenty feet. It broke in a straight line and did not curve at each V. We encountered no trouble unless we permitted one of the points to get behind. The maximum tonnage possible to be produced on this method was estimated to be seven hundred and twenty-five tons a day, assuming that all places were cut and cleaned up in one shift, and this we did for several consecutive days. Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement
