The purpose of this paper is to present in a convenient form data and examples necessary in making dynamometer card analyses; also to outline a procedure of well weighing. Many articles and papers have been written delving into the mathematical considerations relative to the shape and characteristics of dynamometer cards. However. it is recognized that there are too many unknown factors involved in such calculations to assure a workable degree of accuracy. For this reason the accepted procedure is to take dynamometer cards on wells in question rather than try to calculate the load curve. The polished rod dynamometer is now recognized as a necessary tool for measuring loads, torque, and horsepower. It is also used to determine pump action and trouble-shoot for any seemingly abnormal pumping condition. FIG. 1 dynamometer cards that can be obtained is one reason for the general lack of usage of the dynamometer as a control instrument rather than a means for making routine measurements of leads and horsepower. When it is considered that the dynamometer card is a record of the resultant of all forces acting on the polished rod at any particular instant during the pumping stroke. the problem is then one of breaking down this resultant into its various components. As a means of a quick review we shall consider the examples shown in Figs. 1 to 9: and Tables I and II and then proceed to the interpretation of variously shaped cards caused by some abnormal operating condition. In Table 11, when we were considering the factors involved in calculating the peak polished rod load, it can be seen that the factors involved greatly oversimplify the problem. Certain assumptions are made which may or may not he even close to the actual field conditions, such as the specific gravity of the fluid generally considered as one; that the crank has constant angular velocity; that the down-hole friction is zero; and that the fluid lift is from the pump. In the following examples we shall see what a variation in fluid weight and friction can do to the general shape and magnitude of the dynamometer card. (Figs. 10 to 22.) MAKING THE WELL STUDY It is obvious that it would be impractical to consider in detail all of these factors each time a well study is made, inasmuch as each well study job could conceivably be extended into a research project rather than serve the practical requirements of finding the answer to a specific problem. For this reason it is important that some objective be established previous to the time the well study is made. WHEN the history of American business during these momentous war years is written, an absorbing chapter will be devoted to the Maclntyre Development, in northern New York. It will tell of a timely mining project, deep in the wilds of the Adirondacks, blasted into being by Axis torpedoes. It will recount the labors of 1500 engineers and workmen, miles from a highway, rail line, or power source, who built a huge enterprise in a few short months' time. And it will list these major contributions to the war effort: more than a quarter million tons per year of ilmenite, source of titanium dioxide-man's most opaque white pigment-to be used in paints for warships, tanks, guns, planes and the plants that build them; as a co-product, over 500,000 tons each year of magnetite-an important type of iron ore- to help feed the cavernous maw of America's wartime steel industry.

SEARCH for a consistent theory to explain the relationship between energy input and size reduction in a comminution process has accumulated, over the years, an enormous amount of plant and laboratory data. Although some correlation of these data has been possible for purposes of engineering design and for the advancement of research in fracture, there is still great need of a means of predicting behaviour of a solid when it is reduced in size by mechanical forces. The best known hypotheses proposed to describe the energy-size reduction relationships in crushing and grinding stem from a common origin. The present article analyzes problems of comminution in the light of the precepts of this origin. Its object is to reconcile points of difference between these well known hypotheses and to present relationships more widely applicable to comminution studies. Theoretical Considerations: Most existing relationships between energy and size reduction of a brittle solid stem from a single, simple, empirical proposition.&apos; Although this proposition can be demonstrated by observation and experiment, no theoretical derivation is yet possible. Mathematically, the proposition may be stated as follows: dE = -Cdx/xn [1] where dE = infinitesimal energy change, C = a constant, dx = infinitesimal size change, x = object size, and n = a constant. Eq. 1 states that the energy required to make a small change in the size of an object is proportional to the size change and inversely proportional to the object size to some power n. No stipulations are placed on the exponent n in either magnitude or sign. In 1867 Rittinger2 postulated that the energy required for size reduction of a solid would be proportional to the new surface area created during the size reduction. As far as can be determined there is as yet no physical basis for Rittinger&apos;s hypothesis. Rittinger&apos;s hypothesis can be stated mathematically as follows: E, = K(oa-a-0 . [2] Er = energy input per unit volume, K = a constant, <ti = initial specific surface, and o2 = final specific surface. In the size reduction of particles of size x, to particles of another smaller size, x2, Eq. 2 becomes the well known relation: ET = K&apos; {l/x2-l/xx) [3] where K&apos; is a constant. Eq. 3 may be arrived at from the proposition given in Eq. 1 by integrating and by assigning a value of 2 to the exponent n. J dE = J - C dx/x2 E = Kt (1x - 1x) where K&apos; = C. In 1885 Kick3 proposed the theory that equivalent amounts of energy should result in equivalent geometrical changes in the sizes of the pieces of a solid. For example, if one unit of energy reduced a number of equal-sized particles to particles of one half the size, then the same amount of energy applied to the particles resulting from the first test should result again in a size reduction of one half or a final size one quarter the original size. The Kick concept may be expressed as follows: Ek = K" log x1/x2 [41 K" = a constant and E, = energy per unit volume. Application of Kick&apos;s and Rittinger&apos;s laws to comminution has met with varied success. Gross and Zimmerley4 and Piret5 have shown that Rittinger&apos;s equation applies under certain conditions of experimentation. Walker and Shaw6 express the belief that in metal turning and shaping and in grinding of both metals and minerals the production of very fine particles (less than lP) follows Kick&apos;s hypothesis, whereas Rittinger&apos;s concept is valid for the size reduction of coarse particles. For the practical case of crushing and grinding, however, neither of the above hypotheses has received general acceptance. Bond&apos; has lately proposed that since neither Kick&apos;s nor Rittinger&apos;s hypotheses seem correct for plant design work, an energy-size reduction relationship somewhere between the two would be more applicable. Drag coefficients for a cylinder being towed through water at constant velocity and also at constant linear acceleration were measured. Drag coefficients for constant velocity towing showed reasonable agreement with previous results. The drag coefficients found for constant acceleration showed little correlation with either the magnitude of the acceleration or the value of the modulus AD/V2 and tended to be slightly lower than those for constant velocity. INTRODUCTION For the design of offshore structures, wave forces acting on immersed cylinders are of importance. Several investigations have been made of these forces and of how they can be predicted from wave theories. A paper by Crooke&apos; summarizes much of the work already done. More recent research by the Wave Research Laboratory at the University of California, Berkeley, has added much to the body of data collected under ocean wave conditions, but has not found a reliable method of force prediction from basic theories of wave motion. The present investigation is part of a long-range program to collect data with which to test current and future theories and correlations. The immediate objective was to measure drag forces on a circular cylinder subjected to linear accelerations over the range of Reynolds numbers between l04 and 105 where the drag coefficient was a constant for constant velocities. In particular, the effect of constant acceleration from rest and from uniform motion was to be investigated. The effect of acceleration may be evaluated in terms of drag coefficients. A useful resistance coefficient, C, is defined by the equation for total drag force, D, exerted by the fluid on the cylinder. DT =CSp V2/2.........(1) The coefficient C may be plotted as a function of the parameter AD/V2. Here D is the diameter and S is the projected area of the cylinder. The acceleration and velocity are A and V. The mass density of the fluid is p. An alternate drag coefficient, C, corresponds to the total force of the fluid opposing the motion minus the virtual mass force. This drag coefficient, arising from the velocity of the fluid, may be compared with that for the same cylinder in uniform motion. The similarities and differences between this coefficient as calculated for accelerated and for steady motion are of interest in the inverse process of predicting drag forces on cylinders under arbitrary conditions. One serious difficulty in this method is the specification of the virtual mass which depends also on the flow picture about the cylinder.1 EXPERIMENTAL EQUIPMENT The experiment was performed in the combination wave and towing tank at the Engineering Field Station of the University of California. The tank is 200 ft long, 8 ft wide, and 6 ft deep. The tow carriage is externally propelled by a cable, and the velocity of the carriage is maintained essentially constant by means of an am-plidyne. For the purpose of the present investigation, the speed control of the amplidyne was modified by inserting a linear speed control rheostat, which was rotated at a constant speed by a small d-c motor equipped with a slip-clutch. Accelerations which were constant over a reasonable length of time were thus produced. The magnitude of the acceleration depended upon the speed of the d-c motor and the limiting speed of the carriage. Data were obtained for a range of accelerations of 2 to 10 ft/sec,2 and a range of velocities of 2 to 15 ft/sec. An accelerometer (Statham Type C-2-350) with a range of ±2g was attached to the carriage and connected to a Brush analyzer and penmotor. A continuous coil of wire with 10 turns/ft wound around a fixed wooden form extending for a distance of 40 ft along the length of the tank was connected by an electrical contact mounted on the carriage to a Brush analyzer and penmotor, to give the time-position history for each run. Iron-Ore Resources. In a paper presented to the Institute in 1897,* I discussed the iron-resources of the United States as then developed, calling attention to some principal sources upon which other countries depended. The following statement will give a general idea of the amounts, as compiled from the latest official records, of ores won, and metal produced, in the nations which are important contributors to the world&apos;s output. Unfortunately these are not all contemporaneous, since in some countries the statistics do not appear until after one or more years. The statement covers not only pig-iron and iron-ore, but also manganese-ore —the manganese mined being principally used in the production of spiegeleisen or ferro-manganese, and these alloys being generally included in the pig-iron output. The communication which I hare to lay before my fellow-members of the Institute, is no elaborate paper, nor the statement of any great discovery; it is simply the record of convenient methods of conducting topographical survey?, and of keeping the notes of the same; methods that have grown out of practical experience, and have saved me many a day&apos;s labor by facilitating office and field work, and at the same time secured a greater degree of accuracy than is obtained by the methods now in general use. I assume it as granted that no topographical map is worthy of the name, except it represent the elevations and depressions of the surface by means of horizontal or contour lines. In the Ordnance Survey of Great Britain, the contour lines are traced for every fifty feet vertical height, I believe, by running out the line with level and compass through all its meanderings on the surface; this, of course, is a very tedious, though accurate process, but " in the woods," where many of our surveys have to be made, it would be practically impossible. Some time ago, I made an extensive and quite elaborate topographical survey and contour map of the southern portion of the Cahaba coal-field, in Alabama, the object of the survey being to

We all realize, I think, that this question of developing our home industries and support-ing the new industries which have developed during the great war is very important at present. Mr. Dolman has well shown the quantity and quality of the raw magnesite in the United States, and the commercial and industrial possibility of our home magnesite and I believe, with him, that our home industries should receive adequate protection. There are two reasons, however, for believing that this may be difficult. One reason is that much American capital is invested in the Austro-Hungarian magnesite industry. The raw magnesite can be quarried and prepared for the market in Austria with much cheaper labor expense than in the United States; large deposits which are very easy to quarry and good transportation facilities also contribute to the cheapness of production. The second reason is the old saying that the magnesite found in the United States is not of the same quality as the Austro-Hungarian mag-nesite; this I doubt. Even if the magnesite found here does not in a raw state equal the Austro-Hungarian, it can be synthetized so that the finished article will have the same properties as the Austro-Hun-garian finished magnesite refractory possesses. Thaw magnesite from Greece is not the same as the. Austro-Hungarian, but it has linen demon-strated that a good refractory can be made from the Greek product.

SHORTAGES of metals and minerals and substitution of less critical materials for those in which a virtual famine exists received detailed and frank discussion at a recent conference in Washington called by Robert E. McConnell, director of the Conservation Section, Office of Production Management. Representatives of the large engineering societies in the United States and O.P.M. department heads participated in the discussion. To open the session Mr. McConnell called upon Zay Jeffries, chairman of the O.P.M. Advisory Committee on Metal Conservation and Substitution, to summarize the present situation. Dr. Jeffries touched briefly on the status of metal shortages, which has already received considerable attention in the popular press, and said that much of the present difficulty was caused by the too-hasty substitution-without sufficient con¬sideration of the immediate conse¬quences-of metals having ordinarily a small yearly consumption, for those having a much larger annual consumption. As a result, all the alloying metals used in alloy-steel manufacture have become scarce, with the exception of molybdenum; further¬more, despite a reserve of 11,000 tons of molybdenum in this country and despite a normal consumption of only about 3500 tons and a prospective annual production rate of 21,000 tons by October, a shortage of molybdenum is possible before this war is over.

"The method of conveying ore from the ore-pocket at the shaft collar to the railroad ore bins, whence it is transported to the reduction works, is by cars with electric haulage.The cut shows the car coupled to the electric locomotive at the moment of dumping into the railroad ore bins.The locomotives used are of several makes, usually having two 12 ½ h-p. motors of a rated draw-bar pull of about 1,200 lbs., using 500 volts D. C. Track gauge is 30 inches, and speed is six miles per hour.The car holds two skip loads-10 tons—and has sides opening outwards the full length of the car, for rapid side-dumping. One man operates car and motor, and loads and unloads the car. The trolley pole runs in both directions without reversing.Loading is clone by operating a valve connected to a compressed air lift, which raises and lowers a gate in the ore-pocket chute, the ore running by gravity into the ore car spotted under the gate of the chute. Dogs hold the sides of the car in place at the bottom, the tops of the sides being hinged, and a hand lever releases the dogs, permitting the sides by the pressure of the ore against them to open at the bottom.With little manual effort one man does the work which was formerly done, when hoisting ore with cars and cage, by 10 men under laborious conditions."

IN this survey of the progressive development (of education for the mineral industries throughout the United States, the review of .the history of each school has usually been completed wherever it is first mentioned, but the history of the schools in the cities of the eastern seaboard was not carried beyond 1870. It is necessary now to cover what happened during the period of approximately the last quarter of the nineteenth century in several of the schools in the east. Philadelphia Of Philadelphia, it has been related in chapter 4 that the Polytechnic College of Pennsylvania began offering a curriculum leading to the B.S. in mining in 1853; that the school did not prosper, and finally closed about 1890. The establishment of a Department of Mining, Arts, and Manufactures at the University of Pennsylvania in 1855-56 was also mentioned, but its history was not carried beyond 1860. In 1859 J. Peter Lesley was appointed professor of mining in the University of Pennsylvania. The son of a cabinetmaker, born in Philadelphia Sept. 17, 1819, he had taken his A.B. degree at the University of Pennsylvania in 1838 and then secured a position on the Geological Survey of Pennsylvania under H. D. Rogers. When the Survey was discontinued, in 1841, he went to Princeton to study theology, was ordained a Presbyterian minister and followed that career until 1852, when the Pennsylvania, Geological Survey was again started and he rejoined its staff. He published "A Manual of Coal and its Topography" in 1856, and studied at the École des Mines, Paris, in 1856-57. He published an 800-page "Iron Manufactures Guide" the year that he was appointed to the staff at the University of Pennsylvania. In 1863-64 a College of Agriculture, Mines, Arts and the Mechanic Arts was established, but it was not a separate school

THE importance, to geologists and metallurgists, of knowing the mineralogical forms in which the silver occurs in ores has increased during the past few years, and will continue to increase as long as working hypotheses are converted into proved theories and rule of thumb methods are supplanted by scientific data. The methods used for the determination of these silver minerals have been: (1) careful study of polished ore sections with the microscope, and more recently, (2) metallurgical separation of the ground ore by flotation, tabling and panning, supplemented by microscopic examination of these separated minerals, and chemical analyses. During the course of some experimental work carried on by the testing department of the International Smelting Co. and myself, it becomes important to determine, in a general way, the distribution of the silver values in the minerals, as they exist in Tintic Standard and North Lilly siliceous oxidized lead-silver ores. These mines are in the East Tintic Mining District, State of Utah. In this work the second method was used. Differential flotation tests were run, separating the sulfide from the oxidized minerals, and the products were assayed. Various concentrates were carefully panned and the separated products assayed; special samples of ore were selected and assayed. The microscope was used only for the purpose of determining whether the individual minerals were in the so-called "free" state.

I WISH to urge on this Committee the task of evaluating mining geology. -My motive is as follows: It, is a. duty of the Institute from time to5 time, to establish the social perspective of the professions grouped within it, not simply to promote their use, but to determine with engineering definiteness their true powers and functions. This becomes the delegated duty, therefore, of this committee in respect to geology. Be- cause my own subject is mining, I shall confine my remarks to mining geology. But I believe that the evaluation should be made to include all of that geology termed economic. The perspective for such evaluation is shown in the nature of the public support given to geology. The federal Geological Survey, the leading organization on the economic side, is actuated by the zeal of a small group of devoted professionals who consider its work valuable, &apos; It proceeds, however, on a starvation ration of appropriations, and that implies that neither the corporations, the voters nor the vote getters consider it important. Altogether, in&apos; the public consciousness, geology is negligible. That, at the same moment, .the profession should act with full confidence, while everyone else should act&apos; with opposite motives, is not fitting. For us, as a committee, to remain incurious regarding such a disparity of beliefs is quite impossible.

INCREASING military demands on the petroleum industry have brought into bold relief the crude-oil reserves now available to meet combined military and civilian demands, emphasizing the necessity for a greater efficiency in recovery from what has been discovered than ever before, particularly in light of the absence of new discoveries. This situation-and the fact that the industry, as well as members of the Government charged with governing oil production, desire to meet all crude-oil demands made of the industry with the least loss in tangible reserves through production practices-paves the way for increasing application of sound principles of production engineering and conservation.

Mineral aggregates experience degradation during field and laboratory compaction. Reduction in the aggregate size is accomplished by abrasion of the particle edges and fracturing of individual pieces which have become overstressed. Little is known of the factors that govern the amount of breakdown experienced for a given situation. A field study was made of the factors affecting aggregate breakdown under compaction using three carbonate aggregates of different physical properties. The preliminary results indicate that rock type, compactive effort, gradation, and thickness of compactive layer are factors which exert the greatest influence. Mineral aggregates experience a mechanical breakdown of some of the aggregate pieces into smaller fragments during any compaction process, whether in the field or laboratory. This phenomenon occurs as abrasion of the sharp edges during movement and reorientation of the particles in densifying and/or as granulation and fracturing of those pieces which have become overstressed. Two types of aggregate breakdown occur in the field. These may be classed in a general category of aggregate degradation.* One occurs during the con- * Aggregate degradation has been defined in many different ways. For this paper it is considered as any breakdown of larger particles into smaller ones, whether mechanical or chemical. struction period and is related to the densification of the aggregate body from a loose state to a relatively dense mass by heavy compaction equipment. This type is almost entirely a mechanical action. The other occurs after the construction period when the roadway has been put into use. This in-service breakdown is; a different phenomenon from the breakdown during construction in the sense that it combines mechanical with chemical changes. Time becomes an important consideration that may cause subordinate factors in construction degradation to develop into principal ones for in-service breakdown. THE Pennsylvania Legislature, on March 13, 1837, passed an act authorizing the Lehigh Coal & Navigation Co. to construct a railway to connect the North Branch Division of the Pennsylvania Canal with the slack water navigation f the Lehigh River; the navigation company accepted this act on May 10, 1837. Edwin A. Douglas, chief engineer for the navigation company, located the route for this railway from White Haven to Wilkes-Barre, which was called the Lehigh & Susquehanna Railroad. The object was to transport coal from the Wyoming Valley, of Pennsylvania, to the Atlantic seaboard. This railway was considered a marvelous piece of engineering, as it included a tunnel nearly 13 mi. long, and a series of inclines, or planes, up which the cars laden with coal were raised from the vicinity of Ashley to the summit f the mountain near Solomon&apos;s Gap, whence they were taken to White Haven by rail. There the coal was transferred to canal boats. In June, 1862, floods almost completely destroyed the upper division of the canal, so on March 4, 1863, the Pennsylvania Legislature passed an act prohibiting its restoration, but granted a charter for the construction of a railway from White Haven to Mauch Chunk to connect with the line from White Haven to Wilkes-Barre, previously built. On March 16, 1864, a supplementary act was passed extending the Lehigh & Susquehanna Railroad to Easton, Pa. This completed a direct all-rail route from Wilkes-Barre to the New York harbor (by way of the Central Railroad of New Jersey). Up to this time, all freight and passenger traffic passed over the planes, but in 1866 and 1867 there was constructed what was known as the "back track" down the mountain side between Solomon&apos;s Gap and Ashley over which all the passenger traffic and empty cars thereafter passed; it is now known as part of the main line. For the handling of the heavy coal traffic, however, this would have involved a continuous climb from Ashley, 170.27 mi., from New York, to Solomon&apos;s Gap, 157.8 mi. from New York, or a distance of 12.47 mi., and a total ascent of 1,013.75

The main value of earth magnetic measurements, outside of certain mining problems, resides in the study of deeply buried tectonic phenomena related to regional and local geology. Magnetic surveys are a necessary complement of gravimetric measurements, especially of pendulum surveys. To date, magnetometer prospecting has been used chiefly in the study of sedimentary basins where petroleum structures are associated with the uplifted basement rocks. There are, in the literature, innumerable articles dealing with such surveys as applied to oil geology but few treat of broad geological features related to regional magnetic disturbances of the earth field. An important piece of coordination work has been made by Jean Jungl for the magnetic and gravimetric measurements made in France and their geologic significance. A similar attempt at correlation of the known geology with the anomalies of the vertical component of the earth magnetic field has been made for the United States by George B. Somers2. Taking the magnetic vector as a whole, W. P. Jenny3 made a coordination of magnetism and geology for the main producing oil states of the United States. A more detailed study along the same lines is published by A. The main value of earth magnetic measurements, outside of certain mining problems, resides in the study of deeply buried tectonic phenomena related to regional and local geology. Magnetic surveys are a necessary complement of gravimetric measurements, especially of pendulum surveys. To date, magnetometer prospecting has been used chiefly in the study of sedimentary basins where petroleum structures are associated with the uplifted basement rocks. There are, in the literature, innumerable articles dealing with such surveys as applied to oil geology but few treat of broad geological features related to regional magnetic disturbances of the earth field. An important piece of coordination work has been made by Jean Jungl for the magnetic and gravimetric measurements made in France and their geologic significance. A similar attempt at correlation of the known geology with the anomalies of the vertical component of the earth magnetic field has been made for the United States by George B. Somers2. Taking the magnetic vector as a whole, W. P. Jenny3 made a coordination of magnetism and geology for the main producing oil states of the United States. A more detailed study along the same lines is published by A. Two distinct types of depth-dependent variations in texture have been observed in niobium cold-rolled various amounts up to 99.5 pct reduction in thickness. These nonuniformities are thought to be the results of nonhomogeneous plastic dewmation during rolling. The first type is characterized by a zone at intermediate depths that tends to lack certain strong orientations which are present in the surface and center layers of the rolled stock. This type of texture modification seemed to be associuted with "high" body rolling and may be related to the shape of the zone of deformation in rolling. The second type of texture inhomogeneity found involved the formation of a unique texture in the surface layers of heavily rolled strip. High fiiction forces between work piece and rolls appear to be needed to generate and maintain this texture. We believe that this unique surface texture results from a shear mode of deformation in the surface layers. THE evolution of texture in both the surface and center regions of cold-rolled niobium as a function of increasing deformation from 43 to 99.5 pct reduction in thickness was reported in a previous paper.&apos; It was noted that for strips rolled between 95 and 98 pct reduction a distinctly different texture appeared in the surface layers which was unlike the center texture. Certain other layer to layer textural variations were also detected during the experimental phase of that work but were not described in the paper. Surface textures have been reported previously for the bcc materials iron and Steel2-4 and are well known in the fcc metals.5 It is usually stated that these are shear textures which arise under conditions of high friction between specimen and rolls. Work by Mayer-Rosa and Haessner5 n niobium rolled under conditions presumed to be high roll friction gave no indication, however, of a surface texture in that material. This is indeed puzzling in view of our results.&apos; Thus we undertook additional experiments designed to study the stability of the surface texture for certain rolling variables. The variables investigated were the presence or absence of lubrication, amount of reduction per pass, and reverse vs unidirectional rolling. It is the purpose of the present paper to describe the kinds of depth-dependent textural inhomogeneities that we have observed in rolled niobium as well as to present the results of our recent experiments on the stability of the surface texture. Possible explanations for the depth-dependent texture variations will be discussed in terms of nonhomogeneous plastic deformation during rolling. EXPERIMENTAL Specimens cut from the niobium rolled to different reductions in the previous study1 were examined at various layer levels throughout the strip thickness for textural inhomogeneity. The specimen surfaces were either etched or machine ground and etched to remove material to a specific depth. Textures were determined by means of the Schulz X-ray reflection pole figure method with a Siemens texture goniometer and Cum X radiation. Since the important intensity peaks of the textures in niobium are usually located on the normal direction (N.D.) to rolling direction (R.D.) radius of the (110) pole figures, it was sufficient in many cases to scan only along this radius. At selected depths or where additional information was required the entire (110) pole figure was also obtained. In studying the stability and formation of the surface texture, experiments were conducted on 0.400-in.-thick, fine-grained, randomly oriented niobium specimens extracted from the same starting stock as that used in the earlier study.&apos; Two of these specimens were rolled at room temperature to a total reduction of 96.4 pct. One was rolled between cleaned and degreased rolls with no lubrication. The other was lubricated between passes with Welch Duo Seal vacuum pump oil. The rolling schedules of each were kept as nearly identical as possible. Drafts were of the order of 0.006 to 0.012 in. per pass. Other experiments consisted of rolling specimens at constant fractional reduction per pass, i.e., (ta- tb)/ta equals a constant where ta and tb are the entrance and exit thickness of the rolled stock, rather than at a constant draft, i.e., ta- tb equals a constant. Ten specimens were rolled at room temperature on a two-high, motor-driven rolling mill with 8-in.-diam rolls. These specimens were rolled to thicknesses of between 0.041 and 0.073 in. (82 to 90 pct total reduction) at approximately constant reductions per pass ranging from 9 to 45 pct. Kerosene was used as a lubricant. Half of the specimens were always rolled in the same direction while the other half were reversed end to end at each pass. The texture in the surface regions was determined with the X-ray technique described above. RESULTS The textural inhomogeneities noted in niobium rolled from fine-grained, randomly oriented stock 1.5 in. long by 0.75 in. wide by 0.40 in. thick can be classified into two types. The first may be discussed with the aid of Figs. 1 to 3. INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty&apos;s pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation.
