RAILROAD GRANT-MDIERALS. Diatomaceous or infusorial earth when found in such quantity and quality as to render lands containing deposits valuable therefor are mineral lands within the meaning of the mining laws and must be excepted from grants to the Central Pacific Railway Company. RAILROAD GRANT-CLASSIFICATION, If any evidence of minerals is found upon lands within a railroad grant and the showing is sufficient in the opinion of prudent and qualified persons to warrant further exploration and expenditure, with reasonable prospects of success, then the land can not be classified as nonmineral and is not subject to the grant to a railroad company. But where there is no present indication of minerals nor any geological evidence upon which to base a mineral finding, land should not be classified as mineral, or held for further classification and reserved from the railroad's grant, upon the surmise that future prospects might disclose evidences of minerals. INDEMNITY SELECTION BY RAILWAY COMPANY, Under section 3 of the act of July 2, 1864 (13 Stat., 365), and the joint resolution of May 31, 1870 (16 Stat., 378), the Northern Pacific Railway Company could take coal and iron land within its primary or grant limits. It could not base an indemnity selection upon the claim that certain land was coal or iron in ;;haracter, as such land was not lost to it as part of the grant. But the company was authorized to select other lands in lieu of those lost because of their mineral character, but the word "mineral" did not include iron or coal, and, accordingly, the railroad company was entitled to take coal lands under its indemnity selection.

The commission may be permitted to express its earnest hope that the litigation which comes to an end with the findings and recom- mendations herein set forth will be considered by both parties to the action as definitely and equitably decided. The commission trusts that its work will show the value of the commission form of settlement and that its work will serve as a prece- dent to be followed in disputes relative to technical subjects. If the work of the commission is productive of a tendency on the part of technical litigants to avoid the use of the courts for the settlement of disputes it will not have been done in vain. Such tendency will surely grow and ultimately such differences will be arbitrated by technically trained men without recourse to the courts of law. Appended to the report of the findings of the commission are to be found the detailed reports covering the several lines of inquiry and investigation carried on by the commission and upon which its findings are based, and also a detailed statement of the fiscal affairs of the commission. A word of explanation is necessary in regard to the fiscal statement. While each party to the litigation has agreed to bear one-half of the expense of the investigations of the commission, it will be noted that the Selby Smelting & Lead Co. is credited with $21,000, while Solano County is credited with but $6,000. In order that the investigations of the commission might go forward without interruption the Selby Smelting & Lead Co. has generously supplied funds at the times they were needed. "INTRODUCTION The Federal Explosives Act (55 Stat., 863), as amended, was passed by Congress on December 26, 1941, and became effective immediately; it amended the Act of October 6, 1917 (4o Stat., 385). The purpose of the Act was to regulate the manufacture, storage, use, and possession of explosives in order to prevent sabotage and to assure that explosives and ingredients would not fall into unauthorized hands. Under the provisions of the Act, the Director of the Bureau of Mines was authorized to administer its provisions under the supervisions of the Secretary of the Interior.EXPLOSIVES-CONTROL DIVISIONTo administer the Act, necessary personnel were employed in accordance with the appropriation made from a special presidential fund and later by Congress, and the Explosives Control Division was organized as a part of the Health and Safety Branch of the Bureau of Mines constituting the fourth division of that branch. A central office was established in Washington, D. C., and field offices were designated largely at the offices of the Health and Safety Branch throughout the country, and 50 explosives investigators were employed and assigned to work from these offices under the direction of the district engineers of the eight districts into which the United States is divided by the Health and Safety Branch. The territory assigned to each investigator was based on the approximate amount of explosives stored in that area; however, smaller territories were assigned to investigators stationed near the Pacific coast, which was indicated as critical by the armed forces."

Mining regulations pertaining to the use of diesel engines were solicited from foreign countries with mining operations by the Bureau of Mines. Responses were received from 27 countries; the information received and U.S. regulations were reviewed, and those parts pertaining to the use of diesel engines in underground mining were synopsized according to the following subject categories: types of engines permitted, testing and certification procedures, fuel quality specifications, emission control requirements, procedures and frequency of testing exhaust gases, mine air quality and quantity (ventilation) requirements, procedures for testing mine air quality and quantity, and noise standards. All categories except the types of engines permitted and testing and certification procedures are summarized in tables. Contacts are provided for each country to facilitate inquiries concerning regulation revisions or interpretation.

During the past two years the Bureau of Mines has issued a series of mimeographed reports giving the results of research work and experiments conducted as part of its war minerals investigations. In this bulletin the reports on manganese are presented, which range in scope from the beneficiation of the ore to the utilization of the metal. The bulletin is in eleven chapters, each comprising a separate report, arranged in the order given below. 1. General information regarding manganese, by C. M. Weld. 2. Uses of manganese other than in steel making, by W. C. Phalen. 3. Problems involved in the concentration and utilization of domestic low-grade manganese ores, by Edmund Newton. 4. Preparation of manganese ore, by W. R. Crane. 5. Leaching of manganese ores with sulphur dioxide, by C. E. Van Barneveld. 6. The Jones process for concentrating manganese ores; results of laboratory investigations, by Peter Christianson and W. H. Hunter. 7. Cost of producing ferromanganese ores, by C. M. Weld and W. R. Crane. 8. Production of manganese alloys in the blast furnace, by P. H. Royster. 9. National importance of allocating low-ash coke to the man- ganese-alloy furnaces, by P. H. Royster. 10. Electric smelting of domestic manganese ores, by H. W. Gillett and C. E. Williams. 11. Use of manganese alloys in open-hearth steel practice, by Samuel L. Hoyt. As each chapter was originally prepared as a unit, there is neces- sarily some duplication and overlapping. With certain exceptions, however, each paper is reproduced in practically its original form. In chapter 1, covering certain general phases of the industry, such as uses, specifications, prices, and statistics, the subject matter has been somewhat modified in view of changes in conditions.About 95 per cent of the manganese consumed in the United States goes into the manufacture of steel. The remaining 5 per cent is used in a number of minor industries, the chief of which is the manufacture of dry cells. These minor uses are described in chapter 2. No discussion of the geology of manganese eres is presented, but a short bibliography on the subject is appended. With few excep- tions the manganese deposits of the United States are irregular, pockety, and uncertain. Largely for this reason, mining methods are crude and hardly warrant descriptions. The concentration of manganese ores, however, is an important problem and involves some details not common to other ores. Chapter 3 discusses the concentration and utilization of low-grade ones, notes the relationship of concentration to metallurgical prao- tices, outlines concentrating processes, and treats of commercial problems. In general, as regards concentration methods, manganese ores may be divided into two groups, as follows: (1) Ores permitting mechanical separation of the manganese minerals and the gangue, and (2) ores in which the manganese minerals and the gangues are so intimately associated that separation requires some hydrometal- lurgical or pyrometallurgical process. Heretofore, attention has been confined almost wholly to mechanical separation, chiefly by gravity. In fact, so far as known, all production of concentrates has been by wet gravity methods, although during the war some companies investigated the commercial pessibilities of magnetic separation and reported favorable results, the construction of one magnetic con- centration mill being started. The usual wet gravity methods are described in chapter 4. During the war, the Bureau of Mines undertook investigations of methods applicable to ores of group 2. A hydrometallurgical process involving leaching with sulphur dioxide was studied at the mining experiment station of the bureau at Tucson, Ariz. The results of this work, presented in chapter 5, indicate that the process is metallurgically feasible but the cost makes it unattractive. The results of an investigation of a pyrometallurgical process known as the Jones process are presented in chapter 6. The process, which is still in the experimental stage, was found to be metal- lurgically sound. The manganese product is not a concentrate but an alloy, made directly from a lean unconcentrated ore. The custom- ary method is to manufacture alloys from high-grade ores or from concentrates of leaner ores. A discussion of the costs of ferro-grade manganese ores is pre- sented in chapter 7. This discussion is in general terms only, but should be of use in so far as it relates to competitive conditions.

To improve communication among Government, industry, and academic researchers in the field of thermodynamics, the Federal Bureau of Mines sponsored a Workshop on Techniques for Measurement of Thermodynamic Properties in August 1979. Participants at the workshop presented 33 papers on the subjects of temperature measurement and control, general calorimetric techniques, low-temperature calorimetry, high-temperature calorimetry, galvanic cells, ionic solutions, and heterogeneous phase equilibria. A special invited lecture was presented by E. F. Westrum, Jr., on the resolution of lattice heat capacity. This Information Circular comprises the proceedings of the workshop and includes the texts of papers presented and discussion by attendees.

This volume constitutes the Survival Subsystem portion of the final report for the Coal Mine Rescue and Survival System (CMR&SS) program, which was conducted by the Westinghouse Electric Corporation under contract to the United States Bureau of Mines (Contract Number H0101262 dated June 17, 1970). The program was directed by the Special Systems Department of the Westinghouse Baltimore, Maryland, facility. The basic objectives of the CMR&SS program were to develop and test hardware to determine the efficacy of a variety of coal mine rescue and survival concepts and techniques. These concepts were drawn from two major sources: the Request for Proposal from the Bureau of Mines1 and the final report on the Mine Rescue and Survival Study conducted by the National Academy of Engineering2 (NAE).

Lightweight aggregates have become increasingly important to the construction industry. From 1953 to 1960, the quantity of the aggregates used in concrete block, precast and prestressed concrete, and monolithic structures increased about 92 percent. The present study was conducted in Bureau of Mines Area IV which encompasses the South-Central States of Arkansas, Kansas, Louisiana, Mississippi, Missouri, Oklahoma, and Texas. This is an administrative area and does not delimit a market area or imply an economic unit. Because of the increasing importance of metropolitan areas in evaluating economic growth, significant data showing relationships between growth of the metropolitan areas and the lightweight aggregate industry are included.

This two volume report addresses slope stability of surface mine spoils within the Interior Coal Province. Sixteen (16) mines were visited, pertinent data and samples collected, and reported spoil instabilities back-analyzed. Laboratory test results are compared to back-analyzed material properties. Available methods of slope stability analysis are reviewed and evaluated with respect to application to mine spoil stability evaluation and prediction. Correlation and tentative relationships among spoil material properties, highwall conditions, mining equipment and procedures and empirical observations are presented. Slope stability sensitivity plots illustrate the relative significance of various input parameters on stability. Slope stability input parameters are correlated with site and mining conditions to identify the primary factors controlling spoil stability. Investigative methods, spoil stability enhancement techniques, spoil stability prediction procedures and future study areas are discussed. Appendices include a glossary of terms, annotated bibliography, details of mine visits, and detailed laboratory test procedures and results.

THIS-report gives results of in investigation of the carbonizing properties of 18 coals, including 2 from Alaska, 12 from British Columbia, 3 from Washington, and 1 from Utah. Each coal was carbonized in the standard 13-inch Bureau of Mines-American Gas Association (BM-AGA) retort at 900° C. Plastic properties were determined by the Gieseler and Davis methods, and agglutinating and free-swelling properties were determined by standard methods. Expanding properties were measured in the Bureau of Mines sole-heated oven. From the results of the tests on these single coals, three coals from the Crowsnest area in British Columbia, representing Elk River Nos. 4, 9, and 10, were selected for blending with the Utah coal, which was from the Lower Sunnyside bed, Horse Canyon mine, Emery County. Lower Sunnyside also was blended with Wilkeson -Nos. 2 and 3 (Washington) coals, Pocahontas No. 3 from McDowell County, W. Va., and the Oklahoma low-volatile coal used in the blend carbonized at, the Provo, (Utah) coke plant at the time this investigation was started. Most of the blends contained 3 percent hard pitch, which is the proportion used at the Provo plant. The blends were also carbonized in 13-inch BM AGA retorts at 900° C. High-volatile B coal from the No. 3 bed, Evan-Jones mine, Lower Matanuska, Valley, Alaska, yielded poorly fused coke or char. M-bed coal from the Chickaloon mine, Upper Matanuska. Valley, Alaska, ranked as medium-volatile bituminous and coked strongly. It expanded 39.6 percent in the sole-heated oven at a. charge density of 55.5 pounds per cubic foot..

Fatalities caused by highwall/spoil bank failure in the surface mines, coal and non-metal, increased to an alarming rate of seven during 1999. To determine the causes of slope failure and successful mining practices, the National Institute for Occupational Health and Safety undertook a study. The study included: 1.A review of accident statistics; 2.A review of Federal and state mining laws pertaining to surface mining; 3.A literature review, and; 4.Mine visits. The study emphasized surface mines in the states of West Virginia, Ohio, and Pennsylvania. The review of a decade’s accident statistics using the mine Safety and Health Administration’s (MSHA) database showed that approximately 40% of all ground control related incidents reported to MSHA occurred in just four eastern states: Kentucky, West Virginia, Pennsylvania, and Ohio. The comprehensive literature search provided a historical perspective of highwall stability issues. Eleven mines we visited to obtain data on their mining practice or design. Commodities included coal, sandstone, and limestone. Based on the visits, five case studies were developed to represent typical mining methods and effective ground control practices used in eastern surface mines. Benching was found to be a common technique to reduce the overall highwall slope angle. Decking in the softer zones, such as shale, proved useful in controlling damage due to blasting.

The use of the Scanning Electron Microscope to characterize Coal Mine Dust has been possible because of two circumstances. First, the imaging process of the SEM allows multiple signals (secondary electrons, back scattered electrons, x-ray emission, etc.) to be viewed. Second, the use of a computer to analyze the signals and perform statistical tests on the results. The parameters described are size, shape, chemical composition, mass distributions, and particle thickness. Although the system is intended for particular systems, those of agglomerates (whether tile same or not) are handled by special aspects of the computer programs. The work on fibers is not completed at the time of this report. This work discusses the hardware (developed especially for this process) and software (both on an IBM 360/370 and a PDP 11/20). The latter system allows direct interaction between the operator of the SEM and computer for maximum information at the least time.

This report covers the activities of a feasibility study of fiber optics technology fur use in mines. The objective of the study was to evaluate, both technically and cost-wise, the possible use of fiber optic technology for underground mine communication and monitoring systems. The first phase of the study was devoted to the collection of information on the present underground mine communication systems and monitoring techniques, and the status of applicable fiber optic technology. In the second ph se of the study, a communication and monitoring system for a hypothetical underground coal mine was designed and the costs estimated. The significant findings and conclusions are presented.

The STATE MINERAL SUMMARIES publication provides estimated data and summaries of mineral activities at the State level for 1993. Most of the estimates are based on nine months data. Individual State summaries are published separately as State Mineral Industry Surveys and copies can be obtained from the appropriate State mineral officer. In an effort to facilitate the rapid dissemination of information and publications produced by the U.S. Bureau of Mine, an electronic document dissemination system is now available for use. The major health concern for uranium miners is the release of radon gas and the resultant ingrowth of the short lived daughters in the mine atmosphere. Present methods of control are the utilization of mine ventilation systems for dilution and control of ingrowth time to maintain working levels below those set by regulations. This study examined pressure cycling efforts on the radon emanation. The mechanical ventilation systems were altered to allow pressure changes throughout the mine to increase radon influx during the off shifts and thus deplete the sources of radon gas. Continuous radon working level and environmental monitors, developed by the Bureau of Mines, were employed to monitor radiation and physical parameters in the mine workings. The mine ventilation system was then varied to induce radon flows during off shifts, thus, depleting the radon sources during normal production shifts. Electro-static precipitators were also tested to determine radon daughter collection efficiencies. Both radon and radon daughter concentrations were monitored and evaluated. Major problems were found in the simple mechanical operation of cleaning these units.

This bulletin presents a summary of available information regarding the sources of uranium, radium, and vanadium, the methods used in treating the ores, and the uses of the finished products. In particular the paper describes the ores found in the United States, giving especial attention to those characteristics of the ores and the conditions of their occurrence that affect mining and treatment.
