Blasters are usually strictly liable for injury or damage caused by flyrock (trespassory invasion) and blast-induced vibrations (non-trespassory invasion). The application of strict liability to non-trespassory invasions has resulted in significant litigation that has hampered the use of blasting and the blasting industry. Stark (2002) proposes that blasters should not be held strictly liable for non-trespassory invasions but should be liable only if their conduct is proven to be negligent. This change in legal standard was proposed because improvements in blasting technology over the last thirty years allow blasting to be conducted without substantial risk of harm to property and thus the amount of harm imposed by a blast can be related to the level of care exercised by the blaster. It is anticipated that a negligence standard will reduce the amount of litigation because a plaintiff will have a greater burden to overcome. To facilitate the acceptance of a negligence standard by a court of law, this paper summarizes the standard of care using the 1977 Surface Mining Control and Reclamation Act, extensive U.S. Bureau of Mines research, and current blasting techniques, such as blasting mats. It is important for the blasting industry to promulgate a standard of care so a judge can feel confident that blasting can be routinely and systematically controlled and if the legal standard is changed from strict liability to negligence a subsequent judge or jury will be able to evaluate the level of care exercised by the blaster. This paper also suggests that the industry and/or ISEE develop and disseminate a comprehensive standard of care that courts can use to further justify a change from strict liability to negligence and evaluate the standard of care.

Real-world levels of attenuation from hearing protection devices are usually much lower than the rated values obtained under near-ideal circumstances. The shortfall is even more extreme for earplugs than it is for earmuffs, primarily because of the complicated process of fitting the plugs within the ear canal. This study examines the use of a commercially-available lubricant for hearing aids to determine whether it would facilitate improved fit and attenuation for earplugs. In this experiment, ten participants inserted earplugs with and without using the lubricant. Average attenuation was assessed with the Real-Ear-Attenuation-at-Threshold (REAT) technique, and showed over 5 dB improvement when the lubricant was used. Participants obtained an 85% mastery rate using the lubricant versus a 50% mastery rate without. These results indicate several possible applications for improved earplug performance in real-world settings where hazardous noise is unavoidable and effective hearing protection is necessary.

Overall mineral industry productive activity in Europe increased in 1965, following general upward trends in gross national product and total industrial production4 recorded. The gross national product of non-Communist Europe in market prices in 1965 was estimated at $572 billion and that of Communist Europe at $409 billion. However, the extractive sectors of the mineral industries generally did not fare as well as the processing sectors. In fact, a number of countries recorded lower production levels in this sector in 1965 than in 1964 and most countries had a lower growth rate in extractive industry output than in overall industrial output. Among the non-Communist nations of Europe, a general decline in coal production and lower levels of iron ore output in France, West Germany, and Luxembourg contributed significantly to the smaller growth rates or declines in extractive indexes. Where higher indexes were registered, this generally resulted from the performance of the petroleum and natural gas industry; exceptions were Greece, Norway, and Sweden. The decline recorded for Czechoslovakia was attributable entirely to poorer performance by that nation's coal industry.

At mine sites, the operational and required storage volumes of solution and water storage ponds and reservoirs are usually calculated based upon a water-balance approach. Many climatological variables including precipitation, air temperature, solar radiation, pan evaporation and relative humidity along with operating parameters, are used in the water-balance model. The water-balance model often seeks to find a “critical period” of wet or dry climatological sequences which result in a “maximum” pond storage volume or water demand. The problem with this approach is that the designer usually does not know when the project will come on line in relation to the historical record. To avoid this pitfall, we use a more robust approach. In the more robust method, the water-balance calculations begin in each year of the historic climatological record. This method results in the same number of water-balance runs (or realizations) as the number of years of climatological record. Results of this type of analysis guarantee that the critical period or maximum required pond volume will be found if it is assumed that the historical climatological record repeats itself or if a synthetic time series is used. In addition, this method permits calculation of the likelihood (probability) that a given pond volume will be equaled or exceeded in any given month of the operational life of the facility. In this paper, the results of the sizing of a heap leach pad solution pond are presented along with the probabilities of a given solution pond size being equaled or exceeded based on the robust water-balance approach.

(B) Selected injury data: Tables 19 to 43: Contain current data on various selected factors of operating and physical conditions that contributed to the occurrence of injuries at bituminous-coal, lignite, and anthracite mines. These factors include extent of hand and machine loading, size of mine by employment and production groups, thickness of bed or vein, duration and number of work shifts, rating of mine as gassy or nongassy, types of cap lamps, explosives, and combination of factors that influence mine safety. (C) Injury experience by States: Tables 44 to 50: Contain current data on number of fatalities and nonfatal injuries, frequency and severity rates, average severity, major causes and principal agencies, injury records of all coal-producing States, and the relative standing by States according to injury-frequency rates. "Environmental considerations are a key driver within marine mining consenting processes across different national and international legislative regimes and are critical in shaping the global public perception of the industry. As a result, it is vital that mining companies seeking to operate within marine environments establish a robust understanding of the sensitivities of the seabed environments in which they are active, the impacts of their activities and the ability of the environment to recover from these impacts. The significant risks of failing to do so include an inability to either obtain or maintain operating permits. At the individual project level, the environmental effects of any given development project are typically defined within the scope of an Environmental Impact Assessment (EIA). For well-established industries operating in well-studied environments this approach typically works well. However, where emerging industries or existing industries that are operating within new environments are concerned, there may be significant knowledge gaps pertaining to our understanding of how specific anthropogenic practices or activities interact with the marine environment. These knowledge gaps can cause significant uncertainties pertaining to the likely significant effects of a project. Such uncertainties may result in barriers to industry and economic progress, increased consenting risks, increased project costs to be borne by individual project developers through the acquisition of additional environmental data during the pre-consent or post-consent project phases, project delays and/or significant increases in environmental monitoring burdens with corresponding increases in project costs."

Occupational exposure to whole body vibration has long been associated with increased incidence of low back pain and low back injuries1. A number of studies have investigated transmissibility of seat pan vibration 5, 6. While transmissibility has been well researched, the mechanism by which vibration may induce injury has not been thoroughly studied. Winter et al. identified increased reflex response delay after vibration exposure and speculated that muscular fatigue may be the cause of this increase9. However, a mechanism has yet to be demonstrated completely. A potential mechanism that may explain the increased risk is neuromotor habituation. Muscle spindle organs have been shown in the extremities to be sensitive to muscle and tendon vibration. Rapid length changes in muscle have been shown to result in kinesthetic illusions as the regular firing of the muscle spindles is interpreted as muscle lengthening4, 7. These illusions have also been demonstrated in the paraspinal musculature2. With removal of vibration, research in the extremities has demonstrated increased positioning errors, probably due to neuromotor habituation8. In this research, it has been hypothesized that neuromotor habituation after exposure to occupational vibration will increase positioning errors. It is further hypothesized that these errors can be shown to be linked to increased reflex response time. Such increased reflex response time could, in turn, decrease spinal stability and increase low back injury risk. Methods Both positioning error and sudden load response were measured before and after exposure to 20 minutes of 5 Hz, 0.223 m/s2 RMS seat pan vibration. Subjects were asked to sit on an unpadded seat without a backrest. Throughout the whole body vibration period, subjects were instructed to put their hands on a stable hand rest and feet on an adjustable stable footrest. The subjects were instructed to assume a comfortable and relax sitting posture for the duration of the exposure. Positioning error was measured using an active-active reposition sense protocol. Electromagnetic markers (Motionstar, Ascension Tech, Burlington, VT) were used to track trunk motion. With markers attached to the skin at the T10 vertebra, the S1 vertebra and manubrium, trunk flexion (the angle from vertical of the line connecting T10 and S1) and lumbar curvature (the difference in inclination of the T10 and S1 markers) were tracked. In the reposition sense protocol, subjects were asked to maintain an upright trunk flexion and to rotate their pelvis and lumbar curvature to assume a target lumbar curvature. In the protocol subjects completed training trials, where they were asked to match their lumbar curvature using a visual display, and assessment trials, where they were asked to reproduce the lumbar curvature from memory. After two initial training trials, training trials and assessment trials were alternated for a total of 3 assessment trials. Reposition error was defined as the absolute difference between the target lumbar curvature and the lumbar curvature the subject assumed during the assessment trials.

Longwall extraction in the Phalen Scam in the Sydney Coalfield of Nova Scotia is carried out under flooded abandoned workings in the Harbour Seam 140 m above, and at depth of up to 700 m beneath the Atlantic Ocean. Careful planning of panel and pillar dimensions is necessary to prevent inflows from the overlying workings and to prevent the development of excessive subsidence strains at the seabed. This paper briefly summarises the research undertaken over the past five years by CBDC and CBCRL into the problems associated with mining under water, and then describes the development and application of a design/planning code of practice developed jointly by CBDC, CBCRL and mine regulatory agencies. The design method employed in the Code of Practise is based on empirical data from the coalfield and parameters developed from subsidence modelling and previous water inflow experience. It includes precautionary measures to be adopted during development and mining, and monitoring procedures to be followed. It is flexible enough to allow future developments in the understanding of inflow mechanisms to be incoporated without major modifications, and represents a major step forward in reducing the potential hazards associated with coal extraction in the coalfield.

The primary objective of this program was to determine the toxic fume and fire hazard of elastomeric noise abatement materials with a limited effort expended on the evaluation of specific treatments applied to mine timbers. Under the conditions employed, for a dimethyl silicone rubber, formaldehyde presented the major toxic threat; acrolein was the main toxic species for both polyester and polyether urethanes and an acrylonitrile-butadiene-styrene resin; in the case of flame-retardant styrene-butadiene rubber compositions, hydrogen chloride, and in the case of PFA-treated timber, furfural, were the major toxic compounds. Of the materials studied, the flame-retardant styrene-butadiene rubbers presented the greatest toxic hazard. The generated data have been reduced to toxic load tabulations amenable to employment for potential hazard assessment.

G.F. Learning The paper by R.V. Ramani and R.J. Sweigard is a wonderful description of the labyrinthine web that has been spun about the mining industry by energetic bureaucrats and politicians over the past 50 years. The remedy for the problem, however, is not more of the same, but less. That may be difficult for the industry to achieve, for it is not a technical solution but a political one. And the current fervor for more detailed planning at all levels of government and private enterprise has become deeply ingrained. The authors recommend the provision of more information about mining and mineral resources to "macro" (i.e., government) land use planners. They apparently overlook, however, the already strong tendency on the part of most government land use planners to consider themselves omniscient. Thus, giving them more information about the technical problems of mining will only make them want to get more and more involved in the "micro" (private, site specific) mine development and production plans of the individual mining firm. In fact, this has already happened at all levels of jurisdiction from municipal to federal government. Examples are legion. The most effective way to ameliorate the adverse impacts of government land use planning on existing and potential mining operations is to: (1) introduce greater flexibility in the definition of land use zones by local and state governments; (2) adopt realistic and relevant ambient environmental performance standards in governing relationships between mineral land uses and concurrent or subsequent nonmining land uses; (3) allow greater leeway for economic considerations in land use decisions in contrast to the explicit legalistic approach now in vogue; (4) recognize that all minerals are not the same and that sand and gravel mining should not be treated the same as underground metal mining, coal stripping, oil field production, or in situ leaching; and (5) eliminate the notion that mining operators should be responsible for determining in detail the use of land by subsequent owners of mined land. This last bit of conventional ethic really makes no more sense than requiring the builders of every shopping center or government office complex to provide detailed plans for the use of that land when its use for shopping or government is ended. Did the builder of Ebbetts Field plan for Brooklyn after the Dodgers went to Los Angeles? Should the developer of the Bingham Pit plan for suburban Salt Lake City after the copper mining goes to Chile? The nation's mining industry must address these questions before further bankrupting itself to provide more data to planners and spending thousands of dollars per acre to create land that when reclaimed is worth only a few hundred dollars per acre. Reply by R.V. Ramani and R.J. Sweigard We thank Mr. Leaming for his valuable contribution. His views on the problems of land use planning and mineral resources are most welcome additions to our paper. As the title indicates, our paper was more concerned with the impacts of land use planning on mineral resource conservation than with the details of the planning process. On the whole, his five recommendations would be helpful for mineral resource conservation. However, we would suggest that the argument he presents for his final recommendation does not address the differences between mining as a land use and commercial or institutional uses. We believe that this difference is the crux of the issue. We share Mr. Leaming's desire to ameliorate the adverse impacts of land use planning. Possibly the most detrimental impact is the loss of mineral resources. Any development, whether mineral or community, that does not give proper consideration to other resources can result in permanent loss or sterilization of resources. With proper planning, some of these losses can be avoided. As our paper indicated, one factor that limits the consideration of mineral resources, and ultimately leads to their sterilization, is the generally inadequate levels of resource characterization and understanding of the unique nature of mineral resources and mining operations. The last point raised by Mr. Leaming is also important. In terms of reclamation and land use planning in mining districts, we certainly do not advocate spending more than what the results are worth. The main thrust of the paper was to explore the avenues for conserving the mineral resources so that, at some appropriate time, the issue of mining and reclamation can still be addressed.

"I. IntroductionThe alveolar surface of the lung is covered by two populations of pneumocytes, type I and type II epithelium. The type I cell, which accounts for most of the alveolar surface area and provides a highly specialized barrier for gas exchange (Rannels et al., 1991), is poorly understood. Although approaches to type I cell purification have been discussed, they have not been applied widely because of the lack of phenotypic markers to monitor isolation procedures (Dobbs et al., 1988; Danto et al., 1992). In contrast, the type II cell has been studied extensively, largely because of the development of reliable procedures for its isolation and primary culture. Investigations based on the use of purified populations of cultured type II cells have provided convincing evidence to support a role for the pneumocytes both in the maintenance of normal lung function and in the response of the lung to injury (for review, see Rannels and Rannels, 1989).While type II cells can be isolated by a variety of approaches, the protocols used most commonly are modifications of the gradient method of Dobbs and Mason (1979) or of the panning method of Dobbs et al. (1986). Purification of the cells based on density gradient centrifugation is reliable and consistent, with yields of 30 to 40 X 106 type II cells per rat of 230 g body weight. Isolation procedures applied to a minimum of three to four rats provide the best results, as lower cell yields are common with the use of fewer animals. In the present study, the production of low carbon ferrochromium (LC-FeCr) from chromite concentrates containing 55.09% Cr2O3 and 13.06% Fe via metallothermic process was investigated. For this aim, in the experiments, the aluminothermic reduction method was applied in an open crucible. 10% CrO3 + 10% NaClO3, 15% CrO3 + 5% NaClO3 and 20% CrO3 by weight of concentrate were added to the charge, respectively and the charge was reduced with aluminium. The experiments were done with the additions of 90, 100, 110, 120 and 130% of stoichiometric requirement of aluminium. The highest Cr content in alloys was found as 71.7% at 120% of stoichiometric Al whereas the highest Cr recovery in alloys was found as 71.8% at 130% of stoichiometric Al when the both charge contained 15% CrO3 + 5% NaClO3 by weight of chromite concentrate.

Clay minerals are one of the more important industrial minerals. They are used in many products and because of different specifications may require special processing which can be either wet or dry. The clays discussed are bentonites, kaolins including ball clays, and palygorskite (attapulgite). In order to design a process flow sheet for these clay minerals, the physical, chemical, mineralogical, and optical properties need to be evaluated. Each species of clay minerals require a group of special tests which are described in this paper.

Since World War II, the need for the use of explosives with testing, construction, demolition, mining and quarrying near urban areas has increased dramatically. Once remote, testing areas have been encroached upon by commercial and residential areas. Evidence has been found that overpressure levels near these areas can be estimated using meteorological conditions. This paper reviews a study where 205 test shots were fired, meteorological conditions recorded, and over-pressure levels estimated using multiple regression techniques.

The control of converter slag chemistry and slag viscosity has played an important role in optimizing converter operations. A thermodynamic model of copper P-S converter and a viscosity model of converter slag have been used to predict the chemistry and viscosity of converter slag. The effect of oxygen potential, SiO2/Fe in slag, detection of slag blow endpoint, and temperature on slag viscosity, liquidus temperature of converter slag and skimming operation has been discussed. Some applications of the industrial operations have been presented.

Cross passageways between adjacent tunnels in passenger rail or transit systems may be used during train fire emergencies to evacuate passengers to points of safety in the non-incident tunnel. Rescue trains can be brought into the non-incident tunnel to remove passengers to expedite evacuation times as compared to walking along bench walls to the nearest egress stairs. In cases of multiple train emergencies, the required ventilation capacities can result in high pressure differences between the incident and non-incident tunnels. These pressure differences can make it difficult or impossible for a normal person to open doors of a cross passageway between adjacent tunnels. If opened, the velocity of the airflow through an open cross passageway can reach levels high enough to impede passenger evacuation. This paper describes the analysis of this problem for a sample rail tunnel. A ventilation concept that mitigates the problems of high cross passageway door opening forces and high velocities through open cross passageways is presented.

All parameters influencing the decision for selection of a suitable extraction method were first selected as the base of this study. Then these parameters were categorized in two main groups. The first group of the parameters includes ?geomechanical and inherent characteristics of the dimension stones? such as hardness, RQD, compressive strength, joints plane orientation and spacing, and water content. The second group was named ?technical and economical parameters associated with the investor?s objectives? like for example extraction capacity (production rate), blocks recovery, mechanization, capital investment and operational costs. Finally, the influences of all mentioned parameters on the selection of the most applicable extraction methods have been assessed and discussed.
