THE great improvements which have been made in late years in the different systems and instruments used to perforate the crust of the earth for purposes of testing and exploring for mineral resources or for other reasons, by means of bore-holes of greater or less diameter and to greater or less depths, are manifold. It may therefore be of interest to make an impartial comparison of them, or of such as are most commonly used. Being well aware of the difficulties which are encountered in such a task, a reasonable allowance must be made in such a comparison. It is a rare instance when even two decidedly different systems or instruments have been used in the same locality, penetrating identically the same strata to the same depth. The diameter of a borehole as well as its greater or less depth must also be considered in regard to its cost per foot, etc. But for practical purposes, for ex¬ploration at least, we may assert this rule Any borehole, of whatever diameter, which allows the means of examining the strata most carefully and completely, will be sufficient for this purpose, but that one which will do it most economically and in the least space of time, must be considered the best for it. It will, therefore, partially depend upon circumstances, what system, in spite of other superiorities, may be the best in each case, and the following remarks may aid in deciding this question. To make the attempt here to review all that has been published upon the different systems and means of boring would be out of place. Reference can be had to the able publications treating upon this subject. A difference in this respect exists in regard to the use of the hollow rods in connection with the diamond drill, used for that purpose. The great future, which appears to be evident for this instrument, will be warrant enough for any one, who has had the opportunity to test it, to give his experience to the public. IN reverberatory smelting, fuel is the chief item of expense, as it commonly is in processes using large percentages of it. Hence the most suitable supply is eagerly sought; that is, the supply which, in the end, yields the greatest net profit. The better grades are not infrequently bought, even at an advanced price, because they are apt to be decidedly more economical. High price, of itself, however, is no merit, for freight is generally the largest part of the cost of fuel, and the nearby supply may yield as high efficiency as that from a greater distance. If a poorer grade is reasonably good, and if its cost is low enough to more than offset the decreased technical efficiency, it is of course the more suitable. Any smelting, operation depends for both efficiency and economy on raising the furnace atmosphere considerably above the "critical" temperature; that is, above the temperature at which smelting is completed. If this temperature is not exceeded, smelting stops, no matter how much coal is burned; and the real value of a fuel depends on the number of degrees that the temperature is continuously kept above this point. For example, if one fuel maintains 2,500° F. and another only 2,100° F., while the "critical" temperature is 2,000° F., the first is worth at least five times as much as the second, although the increase above atmospheric temperature is only one-fifth more in one case than in the other. This "margin of temperature" above the smelting point is much more significant than the total number of heat units developed from the fuel. The case is parallel to that of water flowing from a pipe. The reservoir may contain a billion gallons of water; but, even though the fluid has come to the nozzle, not a drop will run out, where it can be of practical use, unless the level in the reservoir is higher than the nozzle; and the speed and volume of flow depend on how much higher the level is in the reservoir than at this point. If the temperature inn a furnace is not above the critical level there will be no slag to flow over the skimming plate, even though there are enough heat units to bring an unlimited quantity of charge up to the point of slag formation; and just as the value of a water supply for the purpose of putting out a fire depends largely on the effective head, so the difficulties of furnace management

RECENTLY the head burner at a brick. plant with over 40 years' experience said that he had burned brick by guess for over half his lifetime and had used pyrometers for 2 1/2 years but hoped that he would never have to burn kilns without pyrometers again. The ceramic engineer in making a special study of the burning of clay ware and the effect the heat of the kiln has on color and vitrification is also rapidly placing the burning of clay on a twentieth-century basis. Clay ware may be divided into various groups, brick and drain tile; sewer pipe; firebrick; and pottery, which, in turn may be subdivided into special classes. As nearly as the analysis of the clay type of kiln, etc., will allow, there are practically the same problems to solve in burning in all of the processes or operations. The underlying objective is the same, namely the production of the best grade of ware under the most efficient and economical manufacturing system. The principal problem in the production of clay ware is the burning off of the kilns. The most modern steam shovel may dig the clay and the most advanced types of pug mills and wire cut machines or molds of various kinds may be installed, but unless the drying and burning of the ware is successful, all of the previous operations will be useless. On this final operation depends the entire result of the plant. In reality, burning of all. clay ware is purely a heating proposition. The kilns, or furnaces, should be so designed as to give equal distribution of heat. Consequently, the problems of design and construction of kilns to produce equal distribution of heat require serious consideration, as do also the questions of heat control and draft control. DALY (communication to the Secretary?).-The fundamental disagreement between Eugene Coste and the writer proceeds essentially from the contradictory views they hold on the origin of petroleum. This difference cannot be bridged, nor can inorganic and organic theories be discussed here. The writer has suggested that the proper thing in such a case would be to agree to disagree. Coming to the detailed objections further presented by Mr. Coste, the writer feels that, in the main, they take their source in a wrong interpretation of the theory, and the writer is sometimes too generously invested with views that are not his own. 1. The only requirement for the theory is that the oil proceeding from organic remains be distributed in a water-laden sediment, and that this sediment be submitted to the increasing compression due to the continuous accumulation of superimposed strata, which would tend to squeeze out the liquid contents (p. 1152). This squeezing out would be further aided by the distortion of the strata (p. 1148, a). Nothing here makes impossible the slow formation of the oil, if this is considered necessary, as the piling up of the strata in the syncline would require by itself a protracted length of time, and, further, the squeezing-out process is a slow one. Possibly the formation of the oil may even continue during part of the process of distortion. But the mode of formation of the oil and the time and temperature required for it are left to the chemist to decide. The diastrophic theory, which is essentially a theory of motion and accumulation dependent on the laws of mechanics, is not directly concerned with them, provided the general points heretofore outlined be agreed upon. Perhaps it would be wise not to claim too many "eons" for the formation of the hydrocarbons, if the statement made by Sir Boverton Redwood is correct that "the coral reefs of the Red Sea are charged in places with recent petroleum, formed in that torrid climate from the swarming organisms occupying the shallow pools."1

COAL, like most other minerals, only exceptionally occurs in a sufficiently pure state to he directly available for general manufacturing purposes. And even where this is the case, the small coal or slack is usually more impure than the lump coal, as the slate, clay, etc., from the roof and bottom of the vein become mixed with it in the handling it undergoes. These impurities often exceed ten or more percent in addition to the impurities of the coal itself. The most common impurities of the coal are slate, or shale, clay, and sulphur. The latter occurs in different forms, but most frequently as bisulphide of iron, or iron pyrites, and as sulphate of lime, or gypsum. In both cases the impurities add greatly to the amount of ash, and where they are present in considerable quantities the raw coal, and still more the coke made from it, is unfit for the, manufacture of iron. Coke will contain on an average at least ;fifty per cent, more ash and sulphur than the raw coal from which it is, made. To the manufacturer of iron every additional per cent. of ash which his coal or .coke contains is a source of additional expense, seemingly small, and yet very important in the aggregate. In the blast-furnace, for instance, the ash must be heated up to the melting-point, and, since it is composed largely of refractory substances, the consumption of carbon in melting it will be equal to at least one-half of its weight ; that is, a certain part of the coke is consumed for the melting and fluxing of the ash and is lost. Besides this, it is well enough known to the-iron-master that coke containing less ash makes the slag or cinder more liquid and less inclined to stick to- the walls of the furnace. Fuel containing much sulphur produces generally a white iron, poor in carbon, while from the same ore and flux, with a pure fuel, a good foundry iron might be obtained. The work of separating slate, sulphur, etc:, from the coal 'has as yet only been succesafully accomplished by the washing process. The rapidly increasing use in coal mines of portable auxiliary fans, which are generally 'blowers" employed in connection with canvas tubing, raises questions concerning the hazards of such equipment, especially where the practices are opposed to established methods of ventilating face workings. Half a dozen or more coal-mine explosions and some fires have been attributed to the use of auxiliary fans; moreover, competent mining engineers have found many dangerous installations and methods of use-for example, intermittent running of the fans in gassy mines with consequent accumulations of firedamp at the faces. These facts have led the U. S. Bureau of Mines to issue this recommendation: "In the interest of safety, the Bureau of Mines, Department of Commerce, recommends that auxiliary fans or blowers should not be used in coal mines as a substitute for methods of regular and continuous coursing of the air to every face in the mine." The comparatively recent introduction of new types of mining machines, mechanical loaders, face conveyors, and slabbing machines has encouraged the trial of new systems of face mining, all of which have for their object the rapid advance of the faces. Although the latter has certain economic advantages, in gassy mines the rate at which gas is given off is generally found to increase in proportion to the speed of advance into new territory, which in turn increases the difficulties of efficient ventilation of the face workings. Some of the systems of advance mining being tried in connection with new mechanizing methods practically compel the use of blower fans and tubing, as single narrow places arc now driven 300 ft. or more without crosscuts. Previous studies1 by the writer dealing with the embrittlement of copper have been concerned with the behavior of various pure and deoxidized coppers when exposed to an oxidation-reduction cycle, and the consequent evaluation of these materials on the basis of their resistance to this action. No attention was devoted to the variations in penetration of embrittlement with time, when these copper materials are exposed to a strong reducing gas, such as hydrogen, nor to the variations in oxygen penetration, with time and temperature, into the "pure" coppers. The cause of the embrittlement is the reduction of the oxygen in the copper by the hot reducing gas, so that a consideration of time, temperature, the occurrence of hydrogen and oxygen must be given. For the purpose of differentiating some of the involved factors, the present work may be divided into two separate series of experiments. The first of these deals with the oxidation of purified coppers under various conditions and then the subjection of these to a standard hydrogen treatment. The second series concerns the reduction, under different conditions, of tough-pitch coppers of several oxygen contents. The resulting data will give the rates of oxidation, and of reduction, for the materials involved. The first series of experiments will reveal how rapidly copper may become oxidized, while the second series will indicate how rapidly embrittlement will penetrate into an oxygen-containing copper when it is exposed to hydrogen at different temperatures. Materials For the purpose of determining these variables, three types of material were selected, to cover the extremes in the ranges of materials commercially obtainable. The first class of materials is represented by an oxygen-free copper, as well as the high-purity vacuum-melted copper2 used in previous work. INTRODUCTION IT is well known that ferric. oxide, Fe.-,03, is paramagnetic, while magnetite, Fe304, is classed among the highly ferromagnetic substances. But magnetic data on oxides intermediate in composition between Fe-03 and Fe304 have been almost completely lacking. Fe203 and Fe304 form a solid-solution series, according to present evidence.' In this series the properties change continuously from Fe203 toward Fe304, as the percentage of FeO increases from zero toward 31.03, which is the percentage in magnetite. It is possible that there is a break in the series near Fe304, but it has not yet been possible to establish the existence-of such a break experimentally. The occurrence of solid solution ill this series is shown by the dissociation pressure, or oxygen pressure in equilibrium with the oxides, which falls continuously over the range from Fe203 to Fe304. The oxygen-pressure curves at 1,100° and 1,200° are shown in Fig. 1. The existence of solid solution is also demonstrated by the continuous change in optical properties from Fe203 over to a composition containing about 18 per cent. FeO, at which point the opacity of the oxide becomes so great that it is im-possible to obtain measurements at higher percentages of ferrous iron. Natural oxides of iron intermediate in composition between Fe2O3 and Fe304 are much more common than is generally supposed. If a mineral oxide is not strongly attracted by a small hand magnet and if it gives a red streak, it is usually labeled "hematite." If it is strongly attracted by the hand magnet it is usually labeled "magnetite" without further tests. As we shall show later, oxides containing from 1 up to 31 per cent. FeO can be thus erroneously lumped together as "magnetite." It is a fact, nevertheless, that the great hulk of natural oxides of iron lie fairly near either Fe203 Or Fe304 in composition. In brief, this is the story of an attempt to Americanize a process originally developed in Europe. The story will be recited in two sections, the first dealing with the process as developed by the European engineers; the second containing the improvements and modifications of American origin, together with some details of the operating results of the unit as finally assembled. Developments in other directions in this same field have not, up to the present, pointed out an economic future for the process, therefore our record here is largely a report of development progress. Whether some particularly favorable location will be found at some future time for a commercial installation cannot as yet be foretold. The project is now at a standstill. The peculiar tools of the electrometallurgist should be of great interest to the zinc smelter. The low thermal efficiency of the zinc retort, its comparatively small-scale unit and its intermittent cycle as it stood in 1925, should make this art a particularly fertile field for the electric furnace. Yet in spite of years of work recorded in volumes of literature, and an expenditure of large sums of money, there is not a single electrothermic zinc smelter operating anywhere in the world. In this industry the electric furnace plays only a secondary part today. Historical The first serious proposal to use the electric furnace for the smelting of zinc ores was made by the Cowles Brothers in 1885, but their experimental work did not advance the art to any extent. The next investigator of this field was Dr. Gustav DeLaval, a Swedish engineer well known to the industrial world through his development of the centrifugal and the steam turbine. The DeLaval cream separator is a familiar household appliance in most parts of the world. Although Dr. DeLaval commenced his experiments in the field of electric zinc smelting in 1893, it was not until 1898 that he had a practicable furnace, even then operating but intermittently. The newly opened Hayden Creek lead mine represents a variation from the usual Southeast Missouri type. Galena mineralization occurs in sandy dolomite cementing a conglomerate of granite boulders and in cracks in the boulders. The conglomerate occurs at the base of the Bonneterre formation on the slopes of two buried pre-Cambrian knobs. IN 1943 diamond drilling from the surface in an area 2 miles southwest of Leadwood, Mo., discovered a lead deposit of a markedly different character from the usual southeast Missouri type. Subsequent drilling of about 500 holes indicated several million tons of ore, and in 1950 a 701-ft vertical shaft was sunk into the orebody. This paper describes the geology of this interesting occurrence insofar as it is known from the drilling and the small underground exposure at the bottom of the shaft. Geology The location of the Southeast Missouri Lead Belt and of the Hayden Creek property are shown in Fig. 1. As shown here, there are two separate producing areas, one from which the larger tonnage has come, located near Bonne Terre, Flat River, Desloge, and Leadwood, and the other to the south around Fred-ericktown and including famous old Mine LaMotte. The best published description of Lead Belt geology is by Tarr.* In pre-Cambrian time in this area, an assemblage of granites and rhyolitic flow rocks was eroded to a mature topography. Sedimentation, beginning in the Upper Cambrian, filled in the valleys and gradually covered even the highest hills. The first formation deposited was the La-motte sandstone; it is successively overlain by the Bonneterre dolomite, the principal lead-prodbcing formation, then the Davis shale. the Derby-Doerun limestone, and a succession of Cambro-Ordovician cherty dolomites. Several of these formations may be found in direct contact with the pre-Cambrian as their deposition progressively overlapped the older rocks on the flanks of the igneous knobs and ridges. Immediately overlying the pre-Cambrian there is, not uncommonly, a thin basal conglomerate of granite or porphyry boulders, which is incorporated into the overlying sediments. Deposition of the lower part of the rock section was fairly continuous, and the Lamotte sometimes grades almost imperceptibly into the lower sandy Bonneterre. Since the sediments were deposited on an uneven floor, they tend to reflect the irregularities in that floor. Most of the steep dips found in the district, that is, dips in excess of 10°, are original dips and not caused by deformation. Such domelike structures in the sedimentary rocks around the igneous knobs have localized a considerable number of the orebodies in the district and particularly those in the Frederick-town area. Many of the larger orebodies, however, have no close relation to the pre-Cambrian topography. Most of the lead production has come from the lower 150 ft of the Bonneterre formation, where disseminated ore spreads laterally parallel to the bedding for great distances. Average stoping height is about 20 ft, but in a few places there are stopes over 175 ft high.

SIZING is the process of separating mixed particles into groups of particles all of the same size, or into groups in which all particles range between certain definite maximum and minimum sizes. In coal preparation, sizing is generally accomplished by passing the coal over screens. Separation by differential settling in air or water currents has been adapted to the special field of separating very fine sizes, and these processes are in commercial use to a relatively small extent in the coal industry. Separation with screens is a very old industrial practice. Agricola described the use of screens for ore treatment in the middle ages. In the literature of the British coal industry references were made to the screening of coal as early as 1589, but the practice of extensive sizing for the market did not become general until the last half of the nineteenth century. In America, the practice of sizing developed first in the Pennsylvania anthracite region, beginning with the use of rakes in the mine working places to recover coarse coal. This mining procedure left the fines in the mine. Preparation outside the mine started with the installation of stationary cast-iron plates with 4 to 6-in. square holes. The run-of-mine coal was dumped upon the platforms, the large pieces of rock were picked out by hand, and the large lumps of coal were broken with hammers. The term "breaker," which still applies to the anthracite-preparation plant, originated with this practice, but the term is no longer descriptive of the entire function of the plant. In 1884, the first power-operated anthracite coal breaker was erected by Gideon Bart at his colliery at Wolf Creek near Minersville, Pa. This plant utilized a system of rolls for breaking the coal and revolving screens for sizing. The plant was driven by a steam engine. It could handle coal at the rate of 200 tons a day. By 1860, revolving screens were in wide use in the Pennsylvania anthracite field. Shaking screens were introduced in the Pennsylvania anthracite region in the 90's and they rapidly displaced the lower-capacity revolving screens.

Much valuable scientific research has been performed in recent years on the subject of phase behavior of hydrocarbons.l-11 Engineers employed in petroleum production are interesting themselves in this work as well as in methods of applying the fundamental data available to the solution of their various problems. Recently a number of papers have been published in which applications of phase behavior have been made to specific cases pertaining to critical phenomena.l2-16 Little effort, however, has been made in the literature to show the relation between changes occurring in the critical region and the more common phase behavior, therefore it is believed that a presentation of the fundamentals of phase behavior with reference to hydrocarbons is timely. Study of phase behavior is not new. In the metallurgical field, knowledge of heterogeneous equilibria has advanced tremendously, particularly with reference to solid-solid and solid-liquid behavior. Much is known about vapor-liquid equilibria too, but few engineers are familiar with this subject. Definition of Terms In a discussion of this sort, a definition of terms used is most important. Such terms as "pressure," "temperature" and "volume" need little definition other than mention of the units in which they are considered. Pressure is expressed in pounds per square inch absolute. Temperature is usually expressed as degrees Fahrenheit or degrees Rankine. In considering thermodynamic and phase behavior, the use of the absolute, Rankine, scale is desirable. Volume is expressed as specific volume, such as cubic feet per pound. This will be recognized as the reciprocal of the specific weight. IN some districts of the bituminous coal field the problem of construct-ing bulkheads to seal off water under pressure is becoming increasingly important. Recently this matter has been brought very much to the front by the loss of a large Illinois mine due to failure of a bulkhead that separated it from several old, flooded mines. As this great misfortune has provoked much inquiry about proper bulkhead design, it-is felt that a description, of the successful and extensive water-sealing practice at three mines that have different natural conditions will be of considerable interest to those connected with properties having a present or future water problem and to engineers that may have to design safe bulkheads of economical construction. These three mines are the Saxton and Dresser, near Terre Haute, Ind., and the Hegeler, near Danville, Ill. All three have water conditions that make it necessary to regularly seal off all worked-out sections of the mine, and there are considerably over a hundred bulkheads in each. As far as the writers know, these three mines are the only ones in the bitu-minous coal fields of the United States with anything like so large number of water seals and experience, although a number of other mines are known to have a few bulkheads. More detail will be included herein on the Saxton mine than on the others, as the writers are more familiar with it.

The manganese ore reserves of Lake Superior, because of their location and nature, have recently achieved a rnarked degree of importance as compared with the world's manganese reserves. To appreciate fully the significance and the adequacy of this reserve, one should understand how such ores are used, where obtainable, the quantity used, possible avenues for increasing use or application, and the chemical and physical characteristics of the available ores. Only with those data at hand, is it possible to arrive at a convincing answer to the question whether the reserves of manganiferous iron ores are adequate to satisfy the annual demand of the presently known iron ores for the full life of the latter. That they should last is vital; and to ascertain whether they will last was the purpose of the present investigation, which marks the first attempt to study these Lake Superior reserves. The Lake Superior region possesses and supplies the full assortment of iron ores needed for the conversion of ore into pig iron and steel ingots and castings. These ores are named bessemer, low-phosphorus and high-phosphorus non-bessemer, manganiferous and siliceous; and to include the term aluminiferous would be in keeping with the most recent nomenclature adopted by some dealers. About 35 or 40 years ago, perhaps less, most of the Lake Superior ore which is being used today was the material then considered either useless or too poor for immediate use; perhaps it was considered no more than a future reserve. An examination of the analyses of ores and the guarantees in the sales of those older times convince one that the opinions of those days must have been governed by only small differences in analyses. Some grades of ores used today in substantial amounts were used most sparingly only one or two decades ago. The relative quantities of the different ores used are ever changing; and, bit by bit, the metallurgy and the opinions are ever changing and the prejudices against certain ores and practices decrease. This is unquestionably more pronounced for the manganiferous ores than for any other kind. If, when using the present data for manganiferous ores, we will only be content to make allowances for the same experiences other kinds of ores

OF the various methods of sampling gas-condensate wells, a method that secures a continuous representative sample of the well stream is desirable. Such a method, consisting of a sampling tube introduced into the well tubing, has proved satisfactory. The method is sufficiently accurate for operating and engineering problems A portable testing apparatus can be used with the sampling tube to obtain data useful in studying the economic and technical aspects of the development and operation of gas-condensate properties. Introduction The recent discovery and development of gas reserves that contain hydrocarbons that condense with reduction of temperature or Pressure, or both, to form a product known as condensate, has brought many new problems to the oil and gas industries. With further discovery of deep, high-pressure fields it is presumable that many more gas fields of this type will be added to the steadily increasing number. Such gas reserves are found either associated with oil as a gas cap or in separate formations. There seems to be no positive correlation between the physical or geological nature of the reservoir, and the chemical composition or phase characteristics of its contents. Knowledge of the chemical make-up and phase behavior of gas-condensate reserves is needed to cope with many problems. OF the various methods of sampling gas-condensate wells, a method that secures a continuous representative sample of the well stream is desirable. Such a method, consisting of a sampling tube introduced into the well tubing, has proved satisfactory. Introduction The recent discovery and development of gas reserves that contain hydrocarbons that condense with reduction of temperature or Pressure, or both, to form a product known as condensate, has brought many new problems to the oil and gas industries. With further discovery of deep, high-pressure fields it is presumable that many more gas fields of this type will be added to the steadily increasing number. Such gas reserves are found either associated with oil as a gas cap or in separate formations. Empirical data from 91 rock excavations have been used to construct a family of slope curves on a chart relating excavation height and inclination. The highest and steepest slopes from each excavation are plotted and connected by a line. The 31 1ines appear to establish one or two geometrical slope fields through which the curves are projected. The curves apparently represent a lumped eflect of many factors too complex to be considered individually. Important factors such as geological structure or ground-water conditions can dominate the picture, but where these factors do not overshadow others, the slope chart should be useful for estimating or checking optimum inclination. The U.S. Army Corps of Engineers (USAE) has been engaged since 1962 with the U.S. Atomic Energy Commission in a joint research program to develop nuclear excavation technology. The Corps is responsible for collecting the requisite data on engineering and construction problems associated with nuclear excavation. The ultimate objective is to develop a capability to use nuclear explosives as a construction tool on public works projects such as harbors and canals. The present study on empirical inclination-height curves for conventionally excavated slopes is an outgrowth of an investigation' sponsored by the USAE Nuclear Cratering Group on applicability of data from existing excavations in establishing guides for engineering judgment in crater excavation. Data were generously contributed by over 50 mining companies among other organizations. Inasmuch as several companies preferred that their contribution be anonymous, all data are treated so here. Some Factors Affecting Stability Many factors affect or are suspected of affecting the stability of excavated slopes, e.g., adverse structural orientation, degree of structural ordering, ground water, climatic conditions, mechanics of excavation, and plan-profile configuration. Such factors are lumped together in developing a slope chart. Obviously geological structure and ground water can overshadow all other factors. Where such is the case, the simplification of slope charts may give an erroneous picture (not conservative enough). A further complication results from the fact that the concept of stability may vary according to the use of the excavations. For example, slope adjustments that would be regarded as failure in a powerhouse excavation, might be tolerable in a mining operation. Mine slopes are continually being modified by further excavation, and instability that would develop in a similar permanent excavation slope over a period of years might not have time to develop in a mine. Inclination vs. Height Charts Charts of inclination vs. height for particular formations or conditions have been used in the past as an aid for designing excavation slopes. Some of these have been based upon empirical analyses of collections of data and experience. MacDonald" and Lane have presented slope tables and charts for excavated and natural slopes in relatively weak sandstone and shale. Coates' has shown an inclination-height chart for slopes in incompetent rock. Most organizations have developed slope design criteria which relate bench widths, heights, and inclinations to use in various rocks. Slope data collected in present studies can be similarly used to develop inclination-height charts; however, a plot of all slopes on such a chart shows very little because of the wide spread of the data. Reasons for the dispersion of points are: (1) many slopes are not carried at optimum inclination, particularly in mines where maintaining roadways and following irregularities of ore bodies are more important than achieving steep inclinations; (2) many engineers and geologists with varied backgrounds and viewpoints have been involved in designing these slopes; and (3) each slope is characterized by a unique combination of factors affecting stability and in turn optimum inclination. Significant curves can sometimes be constructed where the points can be grouped into related clusters from the same excavation. The essence of this approach appears when only two slopes from each excavation are considered—the highest slope and the steepest slope, connected by a line segment (Fig. 1). This reduces considerably the usable data because in many cases only one of these two slopes is available. Nevertheless, the concession seems justified. Construction of Slope Curves Ninety-one pairs of points and connecting line segments were assembled in this study. INTRODUCTION Virtually all countries have general legislation covering most aspects of mining and mineral processing, including investment and tax laws, safety and health regulation, and specific rules applying to exploration reporting procedures. Yet most developing countries negotiate individual agreements with foreign investors for major mineral projects, in particular when all or part of the expected output is exported. Such agreements are known under several different names, as for example concession agreement; technical assistance agreement or service contract; management agreement; production sharing contract; joint venture; or contract of work. The objectives and conditions governing such contracts are as diverse as these titles are. While a mining project is only one among a large mumber of similar undertakings in industrial countries, in most developing countries such projects usually have a dominating position within the country's economy. The general legislation is often inadequate and insufficiently detailed to cover all aspects of large projects with extensive foreign inputs and international markets. Therefore, the need for specific arrangements. Specific arrangements may also become necessary due to the complexity of markets for mineral products, the large number of participants - equity partners, suppliers, financial institutions, buyers, etc. - or economic and political conditions in the host country and fiscal regulations in the home country of the investors. Most agreements are concluded between governments, or government agencies, in developing countries and private industry headquartered in developed market economies - Canada and the United States of America in North America, Western European countries, Japan, South Africa and Australia - or, in some instances, with state-owned firms in these countries. There are fewer agreements between developing countries and the centrally planned economy countries - Eastern Europe and the USSR - which cannot be considered here because of absence of adequate information. Agreements can be concluded at any of the different stages from exploration through closing of a mine. While most contracts are negotiated at the time when a potentially viable ore body has been delineated and investigated sufficiently to anticipate a realistic time for commencement of production, other agreements start with "grass-roots" exploration, during operation of a mine, smelter or refinery or, exceptionally, after a temporary shutdown. While several major provisions are included in all types of agreements, others are covered in much more detail (or not at all) in some contracts reflecting the specific work programme of each project. While it is realized that subdivision and classification of complex contractual relations is necessarily arbitrary to a certain extent, such grouping is useful in practical terms, especially for the non-specialist. The following discussion, therefore, will start with a description of the major forms of contractual relation - concession, investment contract, joint venture, management agreement, service and production sharing contracts. Major issues covered in all, or almost all, agreements will then be dealt with. These include stages of development, corporate structure and control, fiscal arrangements, infrastructure development and environmental law, and dispute settlement and renegotiation. FORMS OF CONTRACT RELATIONS There has been marked change in the type of agreement entered into during the 1960s (and before) and the early 1970s and the period thereafter. While straight "concessions" - granting of exclusive rights to foreign investors over a certain deposit or areas with little restriction or well-defined obligations - were the rule during the first half of this century, more complex agreements have evolved since. Some of these cover every conceivable aspect, foreseen or only possible, and define rights and obligations of all partners to the last detail. Over the years, agreements have without doubt become more beneficial for the developing host countries, in part as a result of well-publicized nationalizations, as for example in Chile, and in part due to changed attitudes in all countries
