"REVIEW OF ISA's DRAFT EXPLOITATION REGULATIONS – HAVE KEY STAKEHOLDERS' CONCERNS BEEN ADDRESSED ADEQUATELY?In early August 2017, the ISA published a revised draft of the exploitation regulations. My presentation will focus on the extent to which key State and Contractor issues raised in formal submissions in November 2016 have been addressed in the revised draft and any additional key issues in the revised draft which are likely to cause significant concern for Contractors.ABSTRACTFollowing the ISA's call for submissions in response to draft zero of the exploitation regulations in July 2016, 43 responses from stakeholders were received by the ISA in November 2016. My presentation will start by briefly looking at how the ISA has continued to engage with stakeholders following the publication of draft zero of the exploitation regulations, including at payment regime workshops in London (November 2016) and Singapore (April 2017) and at the environmental workshop held in Berlin in March 2017. It will also touch on the publication in February 2017 of what was in effect a very preliminary draft of the environmental regulations before moving on to consider in detail the extent to which key State and Contractor issues have been addressed in the ISA revised draft exploitation regulations which were published in August 2017. My review of the formal submissions will include, amongst other things, commentary on:(i) the level of Stakeholder response (State Parties to UNCLOS, Sponsoring States, Privately owned Contractors, State Owned Contractors and NGOs);(ii) the quality of the submissions (particularly by States and Contractors); (iii) the key concerns raised by State and Contractor stakeholders and how those issues have been addressed in the revised draft exploitation regulations; and(iv) how all stakeholders need to further engage with the ISA to ensure that the exploitation code adequately addresses the legitimate and reasonable concerns of each Stakeholder group (e.g. Contractors, Sponsoring States, Developing States and NGOs)."

"An environmental impact assessment (EIA) of a deep sea mining project typically describes the environmental baseline, impacts of the project to the environmental values, and proposed management techniques. Comprehensive EIAs also consider the impact of the mining project on existing industries, including deep sea fishing. However, few projects to date have included other industries in the EIA process in more than a cursory manner, due to the confidentiality of the process, conflicting priorities, and bureaucratic limitation. However, if the United Nations Sustainable Development Goals (particularly Goal 17: Collaboration) are to be achieved, a new way of thinking will be necessary for deep sea mining projects, starting with collaboration at the very beginning of the project life cycle.STRUCTURE OF PRESENTATIONThis presentation will be in the format of an oral (20 minute presentation).The presentation will cover the process of inter-industry collaboration throughout the life cycle of a deep sea mining project, drawing on historical and existing examples, including that of the Chatham Rock Phosphate Project in New Zealand."

IHC Merwede is world market leader in the construction of specialist dredging equipment; it is a company with a rich history. The Netherlands is a coastal western country for which water management is a very important issue. Without the enclosure of the coastal areas with dikes and dunes almost two third of the Netherlands would be flooded. These activities are mostly performed by the dredging industry and are the foundation of the dredging industry as it is today. Besides land protection this industry also carries out infrastructure maintenance and performs land reclamation projects. In essence the dredging industry is specialized in horizontal excavation activities and operations in shallow waters with the purpose of gathering bottom sediments and disposing it at a different location. The development is that the activities are moving to deeper waters to a depth of up to 150m. A few years ago IHC Merwede received a request to perform the shallow water excavation techniques at a depth of approximately 2000 meters for the deep sea mining market. In response to the increasing number of requests for deep sea dredging and mining application solutions, IHC Merwede combined all of its activities in this sector to create a new, specially equipped operational unit, IHC Deep Sea Dredging & Mining (IHC DSDM).

Deepsea Mining will soon become a reality with Nautilus Minerals getting their equipment ready to mine SMS at Solwara 1 off the coast of Papua New Guinea. The vertical transport system (VTS) adopted by Nautilus consists of a riser hanging ‘freely’ from the mining production vessel with a lifting pump unit suspended at its lower end. A compliant jumper connects the pump to the seabed crawler without restraining its movements. In this free-hanging VTS arrangement, the vessel can be re-positioned to follow the crawler should it want to extend the mining area and start stretching the jumper. A recently proposed alternative to this is a free-standing VTS whereby the riser is grounded on the seabed with a base and maintained in an upright position by distributed buoyancy modules or a buoyancy tank at the top. A compliant jumper connects the seabed crawler to the riser base, and another connects the riser top to the vessel. In this free-standing arrangement, the entire VTS can be lifted clear of the seabed for relocation to a new mining area. This paper will describe the important features of the two options and discuss the advantages and disadvantages in respect of riser dynamic behavior, water depth, weather and mining windows, pump maintenance, installation and retrieval, continency measures, etc. The two systems will also be appraised separately for mining SMS and SMnN deposits.

Magmatic-hydrothermal activity in the South-West Pacific and SE Asian island arcs during the Tertiary has created a premier copper-gold province with numerous, commercially attractive base and precious metal deposits. This activity continues to the present day, especially in submarine sectors of those arcs where modern technologies enable direct observation of ore-forming processes in action. Until recently, however, the volcanic island arcs of Indonesia escaped such attention. The Indonesia-Australia Survey for Submarine Hydrothermal Activity (IASSHA), involved three cruises with KR Baruna Jaya VIII, focused particularly on the Sangihe arc; Tomini Bay, Sulawesi, including the vicinity of isolated Colo volcano; and the Sunda Strait including the neighborhood of Krakatau volcano. IASSHA 2001 and 2003 cruises studied the arc and behind-arc sectors of the Sangihe volcanic island chain extending northwards from Quaternary volcanoes on the northeastern tip of Sulawesi, near Manado, to the Kawio Islands near the border with the Philippines (Fig. 1). This chain lies above a west-dipping Wadati-Benioff seismic zone whose subduction trench is obscured by accreted sediments and mélange, forming the Talaud-Mayu ridge. West of the main active chain and extending northwards from Manado there is a subparallel ridge (The Manado Line) surmounted by a number of high (>2000 m) seamounts of uncertain age.

"TOML’s ISA Contract comprises six areas (A-F) that span from 118° to 152° W and from 7° to 15° N or over 70% of the CCZ.During a 2015 exploration cruise, TOML scientists found that the a logging system developed by ISA (2010) was able to be adapted and enhanced, to describe in some detail the varied morphology of nodules both within the TOML areas and between them.The shapes and sizes of nodules seen were then found to relate to substrate type and setting, and thus likely thickness and long-term stability of the geochemically active layer. Consideration of the various processes that might influence growth helps constrain nodule formation further. INTRODUCTION Starting in February 2014, 19 partners from EU industry, research institutions and academia joined forces and formed the Blue Mining consortium. In the following four years, they have set out to work on the development of deep sea mining technology, looking into exploration, identification, economic assessment and vertical transport systems for the mining of seafloor massive sulphides and polymetallic nodules. In the beginning 2018 this research & development project has come to an end. The Blue Mining project was one of the first EU subsidised projects embracing the TRL system. This system describes a method of de-risking technology using a simple 9-step approach. This method requires experimental testing in laboratory and relevant environments to be able to reach the higher levels (TRL>5) This paper will discuss the progress in development of the vertical transport system, with a focus on the performed experimental work. This paper will discuss three topics: • Booster station technology • Riser dynamics • Vertical hydraulic transport process. BOOSTER STATION TECHNOLOGY Deep knowledge of transport processes is a prerequisite for a clog free vertical transport One of the key technologies in the VTS is the booster station. The centrifugal pump booster station concept is developed in Blue Mining, it consists of two centrifugal pumps and multiple valves, assembled in member-type frame. Deep sea conditions pose special requirements on all components due to the extreme pressures at large water depths. In the Blue Mining project a Deep Sea Special Motor has been developed and tested in laboratory and in the field. The motor is completely filled, lubricated and cooled using seawater due to its unique open structure, furthermore it does not require any lubricants minimizing the environmental pressure of the motor. The motor is first extensively tested in a laboratory, after these tests have been concluded successfully, the motor is shipped to Norway where it has been successfully tested for more than 100 hours at 425 meter water depth.

Joshua Brien has acted for a range of Governments throughout the world, including smallisland States and the developing world. This has included engagement in matters before the International Court of Justice, the Tribunal for the Law of the Sea in contentious and advisory proceedings, including provisional measures applications and prompt release cases.

Exploring for minerals on the seabed is challenging and expensive – and the ability to collect representative sub surface samples is essential. The research project MarMine led by NTNU has together with Seattle based Williamson and Associates developed and tested an ROV-based drill rig for mineral (seafloor massive sulfides and crusts) and rock sampling. The ROCS system is a single stroke drill and is simple, robust and possible to use from various larger ROVs. For the vehicle to provide a stable platform, the vertical bollard pull of the ROV and the vehicle mass are important variables. The developed drill uses a thin wall drill bit and barrel and operates at high RPM to reduce the required down weight and drilling moments. The system also contains an emergency release to be used if the core barrel is stuck. The drill is hydraulically powered with cylinders operating the tower and a rotation unit. It can rapidly be modified to provide samples from softer samples like unconsolidated material. At the Arctic Mid Ocean Ridge, a work class ROV was deployed with the drill mounted for testing at 2700 m depth in basalt rock. The recovery from the system was above 80%. Such core samples can be used for chemical analyses of metal and mineral grades, mineralogy and rock mechanical testing. The system provides a probing tool for marine mineral exploration, with low cost, low operational complexity and low risk. Proper resource estimation requires drilling deeper into the deposit, but the short core samples provided by the ROCS provide valuable a priori information planning for more extensive drilling campaigns.

Accumulation of cobalt -rich ferromanganese crusts on Pacific seamounts located off-ridge in the Hawaiian EEZ, represents a complex process that involves geologic aging of the seamounts, geographic transportation- of the seamounts on the Pacific plate during the past 80 million years, and geochemical history of the oceans for that period. A comparative study of the building and erosion processes of the young Loihi Submarine Volcano, located south of the Island of Hawaii , and the 80 million year old Cross Seamount, located west of Hawaii , shows that both edifices show wide armchair-shaped talus chutes and intervening ridges of exposed dikes. The similarity between the observed mass wasting process on Loihi and Cross suggests that the slopes of submarine volcanoes are geologically unstable from the time of their origin on the seafloor through their entire geological history. The slopes of Cross are covered by coalesced ferromanganese crust covered talus, steep exposed dike faces, and crust covered dike ridges. A study of the stratigraphy of the crusts shows a range of thicknesses and number of unconformities present. The thickest crusts, up to 8 centimeters, are found preserved within the larger coalesced slabs along the shallower slopes of the talus chutes and along the crests of the ridges between water depths of 400 and 1800 meters. The platinum content was used in stratigraphic correlation between the crusts in the coalesced slabs and those collected from ridges with the PISCES V submersible. From an interesting and intriguing scientific research topic, deep sea mining has altered into an interesting mining prospect over the last years. Ten years ago most of the focus was on geological investigations, searching for typical deep sea deposits and getting answers on where we can find them and how these deposits were formed. At this moment we know much more about the interesting deposit possibilities and with our quest for minerals, metals and other materials to feed global economic growth, answers as to the technical and economic feasibility to mine these deposits are sought. This is not a new phenomenon as we already witnessed such question late 1970?s and early 1980?s. Most of the focus was on mining manganese nodules and brines in the Red Sea driven by the report of the Club of Rome that predicted shortages in near future at that time. Development went different, but later in the 1990?s a rival of interest could be noticed for mining deep sea deposits.

"Seafloor massive sulfide (SMS) deposits are a new frontier in global metal resources. Hydrothermal chimney’s (black smokers) precipitate Cu, Zn, Ag and Au rich from hot fluids (>250°C) during interaction with cold seawater ~2-4°C. Here we compare the sulfide mineralogy and geochemistry of Cu-sulfide chimney samples from two different tectonic locations: Solwara 1, a Cu-rich, transitional arc-back arc (Arc-BA) type SMS ore deposit and; Ashadze-1, a Cu-rich, ocean ridge type SMS deposit (Hannington et al., 2011).This work represents the first stage of a project aimed at investigating and understanding the significance of high Cu concentrations in SMS systems. Comparing these particular systems is significant because they share critical similarities despite being located at different seafloor depths, hosted in different rocks and are located in two different endmember tectonic environments. Critical similarities include: 1) age of mineralization, ~6000 years to current (Firstova et al., 2016; Johns et al., 2014); and 2) high copper contents, with chalcopyrite dominating sulfide mineralization (Firstova et al., 2016; Lipton, 2012). The reason for high Cu concentrations in both of these locations is still not entirely understood. The youthfulness (<6000y to current) of both locations is important because it reduces the possibility of increased zone refining, allowing us to understand the source characteristics better. This research will advance our understanding of the copper systematics of SMS systems by investigating and comparing the mineralogical and geochemical signatures from two, Cu-rich, end-member type SMS sites."

Active development of the exploration and further exploitation of deep-sea minerals requires special emphasis on the protection of the marine environment. The complexity of this subject lies in the fact that potential impact and effects of future mining activity are not completely known. One of the main sources of potential impact near the seafloor, as it expected, would be a generation of sediment plumes, their dispersion and redeposition of sediment. Meanwhile, their dimensions, rates of dispersion and redeposition are a big issue. Other plumes are expected in the surface layer as a result of discharges of processing waters and particles after sorting on board of mining vessel, and their features are also not clear. At the same time, understanding of these aspects would be crucial for definition of environment impact area, delineation and designation of different types of protected areas (Areas of Particular Environmental Interest, Impact and Preservation Reference Zones) and future assessment of environmental impacts. Attempts to address these issues demonstrated wide variations between the data of field experiments on the one hand and the results of analytical and numerical models on the other. According to in situ measurements, plumes were detected at a distance vary from one to less than 20 km [e.g., Burns et al., 1980; Sharma et al., 2001; Nautilus Minerals, 2008 etc.], whilst some models show results up to 100 km [Rolinski S. et al., 2001] and more. It seemed that results of in-situ experiments are preferable, but they were not many indeed. However, these data were used in different investigations rather widely, but their focus, as far as we know, was not on the matters related directly with plumes.

The 21-year long-term Japan-SOPAC Cooperative Deep-sea Mineral Resources Study Programme was completed in March 2006. The Programme, which commenced in 1985, has seen numerous marine research surveys being conducted within the Exclusive Economic Zones (EEZs) of 12 SOPAC member countries (Figure 1). The various research and government institutions that have been closely involved in this longstanding Programme include: the Japan International Cooperation Agency (JICA); Japan Oil, Gas and Metals National Corporation (JOGMEC) (formerly, the Metal Mining Agency of Japan, MMAJ) and relevant ministries of the participating Pacific Island governments.

Annual metal consumption per capita has increased several orders of magnitude worldwide since the turn of the 19th century, yet grades of terrestrial ores are decreasing as reserves dwindle. Consequently, deep sea metal deposits are gradually transitioning from identified resources to economically viable reserves. Deposits in the Red Sea deeps along the axial trough result from tectonic and local hydrothermal processes. Continental rifting and ocean floor spreading produce fresh oceanic crust; concurrently, seafloor evaporites flow into the spreading zone and form isolated deeps. The deeps are often filled with hot stratified brines maintained by locally discharged fluids during hydrothermal circulation. Metalliferous sediments precipitate from the brines within the deeps. The ongoing multipronged study at KAUST involves: (1) acoustic characterization of the metalliferous accumulations using advanced signal processing techniques that capture the physics of granular materials; (2) comprehensive mineralogical and textural characterization of sampled sediments using SEM, EDS, XRD, XRF, and ICP-OES; (3) multiphysics instruments deployed to measure undisturbed sediment properties in-situ; (4) development of a distributed seafloor observatory for monitoring field operations; (5) innovative concentration and separation technologies; and (6) new strategies for proper tailings disposal purposely conceived for the unique field conditions in the Red Sea deeps.

From December 2004 through March of 2005 an extensive geophysical program was conducted to delineate polymetallic sulfide deposits in the Bismark Sea for a major mining concern. Deeply towed sidescan sonar, interferometric swath bathymetry, subbottom profiling, magnetic gradiometry, electrical resistivity, induced polarization. self-potential, gravimetry, water temperature/conductivity and towed video were among the methodologies tested against known occurrences of polymetallic sulfides in 1500 m -- 2200 m water depths. Known active and currently inactive sulfide areas were characterized using the various remote sensing techniques followed by survey with these same tools in other areas where they successfully discovered new prospects. Dredge sampling was used to ground truth both previously known sulfide areas and newly found deposits.

KIOST has developed the pilot mining robot, named MineRo ?? from early-2011 to mid- 2012. The robot consists of two unit-modules having an identical mechanical structure and hydraulic system. One unit-module has two track systems, two pick-up devices, two crushers, one lifting pump and one thruster. The pick-up device is fitted on the frame of the track device. All actuators are driven hydraulically, which are manipulated by valves and the controllers. Each unit-module is equipped with one dual HPU of 250kW / 4,000V. PWM-16 (INNOVA AS) as hydraulic valve controller is adopted, which outputs PWM signals of 16 channels and can be used under pressure in oil-filled box. To measure angular velocity or displacement of hydraulic actuator, turbine-type flow-meters are adopted. The flow-meter has RF (Radio Frequency) type pulse detector, which extends the flow range by eliminating drag on the rotor. Two track motors, two crusher motors, lifting pump, one thruster can be controlled their velocities through feedback of the measured flow-rates. As well as the flow-rates, the states of the hydraulic system such as hydraulic pressures, temperatures, leakages are measured through a self-developed flow-pressure canister. In that canister, multi-channel amplifier boards are installed, through which the vast amount of data is acquired and transmitted to the main controller using serial communication.

From July 29 to September 15, 2004, the 178th cruise of the R/V Sonne took place under the KOMEX program in the Sea of Okhotsk. One of the cruise objectives was to dredge two different kinds of seamounts: 1 ? underwater volcanoes from the north slope of the Kurile Basin; 2 ? a seamount formed by tectonic (non volcanic) processes from the Kashevarov Trough. The underwater volcanoes are young edifices (0.84 ± 06 Ma, Baranov et al., 2002) with heights ranging from 150 to 300 m. Tops of the volcanoes are located at depth of 1260 to 2340 meters. The volcanic edifices are formed by olivine-clinopyroxene-plagioclase basalts. Dredge samples are covered by Fe-Mn crusts up to 40 mm thick. The seamount from the Kashevarov Trough is a tilted block. The height of the seamount is about 400 m and its top is located at a depth of 960 meters. Biotite hornfels, conglomerates, granodiorites, dropstones, and Fe-Mn crusts were recovered there. The thicknesses of crusts are up to 150 mm. Fe-Mn crusts from the underwater volcanoes differ from Fe-Mn crusts from the Kasevarov Trough seamount in morphology as well as in mineralogical and chemical compositions. The research was supported by the Program of the Presidium of the Far East Branch of the Russian Academy of Sciences (project ? 05-III-G-08-086).

The chemical composition of the nodules varies with the type of manganese minerals and the size and characteristics of their nucleus, but those who have an economic interest have the following composition: Mn 29%, Fe 6% Si 5%, Al 3%, Ni 1.4%, Cu 1.3%, Co 0.25%, Na 1.5%, Ca 1.5%, Mg 0.5%, K 0.5%, Ti 0.2 0.2% and Ba 0.2% (Morgan, 2000; ISA, 2002). The Pacific Rim is an area of abundant occurrence of polymetallic nodules (Glasby et al., 1980; Morgan, 2000). According to these authors, the Pacific sea floor of the Clarion-Clipperton Zone (CCZ) is one of the most interesting areas in regard to the genesis of polymetallic nodules. Their abundance in the ocean floor is very variable, as there are places where they cover more than 70% of the ocean floor. The nodules can be found at any depth, but the highest concentrations are between 4000 and 6000m (Morgan et al., 1993). In studies conducted in the EEZ of the Mexican Pacific are those made within the project "Research on the origin, process and distribution of minerals in the Pacific ocean floor in the Exclusive Economic Zone of Mexico". Within this project Rosales (1989) conducted studies on the origin, process and distribution of polymetallic nodules, finding that a number of processes give origin to nodules, being diagenesis one of the main mechanisms of elements that contribute to the nodules. Besides hydrothermal processes that are carried near the East Pacific Rise at 21° N, inputs are contributing to the nodules metallic elements and sediments, especially in regions close to the dorsal, as a greater influence hydrogenetic processes occurs westward (Rosales and Carranza, 1990). In 1993, after cruise MIMAR II, Carranza and Rosales refer that metals such as Cu, Co, Ni, Sn, Fe, Mg, Pb, Zn and Ba may have a relationship with the East Pacific hydrothermal activity and sea currents carry these metals in solution to the Clarion-Clipperton fracture area, where there are hydrogenic metals sources (Al, Fe and Mn).

Introduction Technology development for sustainable, safe, reliable and efficient mining of polymetallic nodules in the deep seas requires careful design, thorough understanding and integrated testing of all equipment, physical processes and (sub) systems involved (Dasselaar et al [1]). Proceeding from Vertical Transport System (VTS) experiments at IHC laboratory scale by Van Wijk [2], with typical system dimensions of several meters, to prototype or pilot scale testing with typical dimensions of several kilometers, is a giant leap. Naturally, intermediate steps are required in order to mitigate the possible risks in the full-scale system’s (physical) processes. Within the EU program Blue Mining (2014-2018), possibilities emerged for performing experiments at intermediate scale: the so-called medium-scale vertical slurry experiments. Near Freiberg, Germany, the village Halsbrücke possesses a 140 meter deep empty vertical mine shaft, perfectly suited for housing the test setup. For this purpose, a 318 meter long 145 mm pipeline circuit was constructed, including both a 130 meter high vertical riser and fall pipe section. A purpose-built sediment injection and separation system was deployed, including a 55 kW centrifugal pump. The riser section has been equipped with sensors capturing pressure, temperature, flow velocity, volumetric concentration and flow visualization. The planning, modification and construction of the test facility site itself is described by Müller et al [3]. The present paper describes the objectives, experimental program, equipment, and the preliminary results. Publications on in-depth results are foreseen in the (near) future.
