ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. (b) An individual who has devoted long and dedicated service to the corporation and to its goals and purposes may become a life member of the corporation upon being elected to that status by the Board of Directors, and such individual shall retain such status for life. (c) An individual who has been at any time an active member of the corporation and who has reached 70 years of age may become a senior member upon payment of such annual dues as the Board of

The Wednesday morning session was opened by President Joe Ward at 9:30 a.m. He complimented Walter Mueller, Program Chairman, for the excellent job he did as head of that very important committee. He also thanked all those on the various committees, speakers, and all who participated in making the 1972 meeting a success. He called on William S. Landers, Chairman of the Auditing Committee, to give his report. He read the report and asked for a motion of approval. Motion was made, seconded and approved. (See Treasurer's report on page 5.) A. E. Pagnotta of the Resolutions Committee read their report as follows: RESOLVED: Whereas, since the 67th Regular Meeting of the Rocky Mountain Coal Mining Institute. held at Park City, Utah, the Institute and the coal mining .industry has suffered the loss through death of service and fellowship of the following members: W. President Ziolkowski called the meeting to order at 9:30 a.m. He called on the Auditing Committee to give its report. Jack Leech read the report and asked that it be approved. A motion was made, seconded and approved. The Resolution Committee was asked to give its report. The following was submitted: (1) RESOLVED, WHEREAS, in the year since the last convention of The Rocky Mountain Coal Mining Institute, the Institute and the Coal Mining Industry have suffered the loss through death of the services of the following: James A. Flint John L. Paynich Joseph E. Ward NOW, THEREFORE, BE IT RESOLVED, that there be spread upon the minutes of The Rocky Mountain Coal Mining Institute recognition of the passing of these members, who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere regard and sympathy of the members of the Institute.

The Wednesday morning session was called to order by President Lewis at 9:00 am, He called on Bob Wilson to conduct the business meeting. In the absence of any of the Auditing Committee, the treasurer's report, which had previously been examined by them was read. He asked for a motion of approval. It was made, granted and approved. The Resolution Committee was called on to make its report. Mr. Shirl McArthur read the following report: (1) "WHEREAS, the Pneumoconiosis or Black Lung provisions of the Federal Coal Mine Health and Safety Act which have been construed and administered largely as a welfare program rather than as just compensation for occupational disease has resulted in enormous expenditures and commitments from the Federal Treasury, WHEREAS, the imposition of the full cost of future welfare oriented black lung awards on coal operators without regard to workmen's compensation standards and without due process in granting benefits is grossly unfair and discriminatory to the coal operator and places an undue burden on the present cost of coal,

Coal mining as an occupation, is hazardous under the most, ideal conditions. Confronted with this inescapable fact, every possible emphasis is placed by the Phelps Dodge Corporation, at the Dawson mines upon the employment of every means available for safeguarding its employes from the dangers attending their vocation. Accidents have a human aspect and a direct bearing upon the well-being of the workmen themselves. They cause a loss of wages, suffering and often privation of the employe and those dependent upon him. In case of death, his children are often forced into the wage earning class without preparation to fight the battles of life, with the result that the efficiency of the next generation is lowered. Dr. Jones, formerly of the war industries board, is responsible for the following statement. "Accident prevention as it is now conducted is principally a matter of education and not merely one of protection against physical hazards as frequently believed. In fact, the last ten years experience in accident prevention has demonstrated conclusively two things: 1. That three-fourths of all deaths and serious injuries in industry can be prevented. 2. In the industries doing the most efficient work, two-thirds have been accomplished thru organization and education as against one-third accomplished by means of mechanical safeguards or equipment. Experience in the past decade has conclusively proven that the work of accident prevention is not a "one man job" that satisfactory results can be secured only thru the highest measure of co-operation between the employer and employe, and this by means of organization. The employer must be vitally interested in the work if he expects to educate his men to share the responsibility with him. The men must be given a part to perform in it, if their interest is to be aroused and maintained. It is only thru organization that this is possible. In this connection it is interesting to note the results obtained by the Old Dominion Co. of Globe, Ariz., in reducing accidents after the organization of their safety department. The O. D. Co. are pioneers in the adoption of the workmens safety committees and and the results obtained by this, company after their safety work was well organized are truly wonderful. For the years 1913 to 1916, inclusive, at which time the safety work was not well organized, there were a total of 18 fatal accidents, the years 1917 to 1920, inclusive, was a period of intensive safety work, during which time there were only three fatal accidents, none having occured during 1919.
