WHILE working, during the summer of 1877, upon the "Chemical Composition and Physical Properties of Steel Rails," the results of which are given in my report with this title, I was struck with the surprising wear which some of the rails, which would ordinarily be called soft rails, had endured. At that time I knew of no chemical measure of softness except low carbon, and I found that a number of rails with low carbon had endured as high or higher tonnage, with apparently as little loss of metal by wear, as those with higher carbon. My own work on steel rails that summer did not embrace any definite experiments as to the amount of metal worn off the rail per million tons which had passed over it; and so I could get no more definite answer from that work, to the question at the head of this paper, than was given by comparing the appearance of the worn section of the rail with its tonnage. This comparison, however, served to arouse in my mind the query, whether the commonly received opinion as to the relation between the hardness and wearing power of steel is correct, as applied to steel rails. This opinion, if I am right, is: the harder the steel, the better will be the wear, and the limit of hardness is simply one of safety ; hard, brittle steel being, of course, more liable to break than soft, tough steel. The query, although aroused, did not bear any immediate fruit, and, as will be evident to any one reading it, the report above referred to was written with the commonly received opinion in mind. Since that time I have collected a little information upon this subject, which I should be glad to submit to the Institute, if for no other purpose, for the sake of arousing attention, and directing study to the question of hardness versus wear in steel rails. Before making known this information, however, permit me a few words in reference to hardness. How shall we measure the hardness of steel ? Of the various ways of getting indications as to the hardness of steel, which are known, three will serve our present purpose. These are: 1st. High carbon. It is generally agreed, I think, that at least within proper limits, the greater the amount of combined carbon in a piece of steel, the harder the steel, and I need not do

Recent studies of inelastic behavior and acoustic emission in geologic materials further validate the concept that such materials may be considered to consist of an elastic media containing an array of pores and cracks. In the present paper this concept is investigated further by experiments in which the mechanical behavior of a number of geologic materials were studied in detail at low stress levels using ultrasonic pulse methods. Experiments were carried out on cylindrical test specimens of Indiana Limestone, Tennessee Sand- stone and Barre Granite under relatively low confining pressures (0-5000 psi). Analysis of data from these experiments indicated that there existed a low-level critical stress at which there appeared to be a transition in the mechanical behavior of the material. Under triaxial stress, results indicated that the differential critical stress was relatively independent of confining pressure, i.e., the mechanism responsible for the transition in mechanical behavior was governed by a maximum shear stress criteria.

COMING over from the plant on the Denver and Rio Grande yesterday afternoon I was an interested listener to a smoking-room conversation that had to do with the experimental plant near Rifle. The people who were talking didn't know me and I didn't know them, but I learned quite a little. I understood that the plant would never operate; that it was not intended to operate; that the "oil trust" would keep it from operating; that our tramway had eaten up all our money and still was not working and would not work; that the plant was run by a bunch of kids, and that the superintendent was probably the biggest kid of the bunch. I plead guilty to the latter. But the people who were talking were misinformed. The plant is producing oil. The first sample of oil that came from our unit at the Bureau of Mines experimental plant at Rifle, Colo., was produced on Sept. 18, the first that came out of the condenser, and it is still coming. This sample of oil may mean to the United States what the first oil produced from the first well meant.

0PINION was general that this year's meeting of the Institute of Metals Division was one of the best in its history. In addition to its full and exceptionally fine program of professional papers, there were several other features of general interest-an in-spiring annual lecture by Dr. Cecil H. Desch which appears in abstract elsewhere in this issue, Mr. Sing-master's talk on the zinc industry at the annual dinner, and the presentation of the James Douglas Medal to one of the members of the Division, Dr. Zay Jeffries. Four technical sessions of the Division were held, dealing respectively with zinc, copper, aluminum, and general metallography, and in addition there was a joint session with the Non-ferrous Metallurgical Committee of the Institute. All of the papers presented were at-tended with much interest and followed by considerable discussion. The papers on plastic deformation of zinc by Messrs. Mathewson and Phillips, Romig, and Hoyt were of particular interest and awakened an extended discus-sion. They well illustrated the progress which is being -made today in the understanding of the mechanism of flow of metals, and the ingenuity of the authors in their crystallographic method of attack of this difficult problem was quite generally admired. A very old subject was treated in a modern way by Messrs. Corson and Bain in two papers on the harden-ing of copper and copper alloys. There has always existed a myth that the ancient Egyptians were masters of an art not possessed by ourselves; viz., that of hard-ening copper. This myth must have been quite defi-nitely dispelled in the minds of all those who listened to this admirable paper. Mr. Corson has applied the modern art of precipitation hardening to this old prob-lem with substantial success, employing small amounts of chromium, nickel, silicon, and cobalt for this purpose. The commercial application of these very important .developments of Mr. Corson is being actively investi-gated at the present time.

A man well placed, happy in his work and happy in his home, will stay put and incidentally decrease the labor turnover in any industry. C. R. In the first place, I want you to understand that I realize that what may be a possible accomplishment in the plant with which I happen to be connected, may not be possible of accomplishment in the same way in your plant. Our problems might be quite different; our location might be quite different, and therefore our employment problem would be very much affected by the community conditions. S. J. SINDEBAND*—(1) Discussing the properties of the powders used, Mr. Rostoker mentioned a silicon powder as being between 150 and 325 mesh. We always had much difficulty in measuring particle size of silicon powder by screen analysis, because of its tendency to agglomerate. I would be interested in the method used to measure these particle sizes. (2) Mr. Rostoker maintains that the measurement of magnetic properties is more accurate in determining complete homogenization of an alloy, than is the X ray diffraction technique. I wonder whether this is really true. Even when diffusion is complete, magnetic properties will change during continuation of the heat treatment, due to change in density and pore shapes, as has been demonstrated by Mr. Rostoker himself. Which effect is faster, the diffusion of the alloy components or the attainment of final density, will, in my opinion, depend very much on initial material and sintering conditions used. For magnetic applications, of course, the magnetic measurements are most suited for determining the point at which equilibrium conditions are reached. (3) I was glad to see that Mr. Rostoker had used sample sizes which are similar to those I had used previously, and I believe that ring samples of about 2 in. od will become more or less standard samples for the determination of magnetic properties of powder metallurgy products. I should like to ask how the density was changed for the samples on which the effect of porosity was investi- gated, and, further, why the sintering temperature used for this series of experiments was so low. It is somewhat surprising that a 24-hr treatment at 850°C acts so much more to spheroidize the pores than a treatment for 1 hr at 1100°C. But the effect seems to be indisputable. I have made an investigation of the influence of sintering temperature for longer times on the maximum permeabilities of iron powder compacts which was presented at the International Powder Metallurgy Conference in Graz, in 1948, and I hope that these results will be published here within a short time. The results of this investigation are confirmed by Mr. Rostoker's findings that the change of time from 1 to 24 hr changes the permeability behavior considerably in the direction as indicated by Polder and Van Santen for spheroidiza-tion of pores. THE Johnson award for 1926 was given to T. L. Joseph for his experimental work on blast-furnace operation. When the Bureau of Mines undertook its experimental blast-furnace investigation in 1919, a number of operators and metallurgists were doubtful as to the practicability of small-scale tests. Several pre-vious attempts, outside the Bureau, to operate small furnaces had been unsuccessful. However, pig iron was produced in three and four-ton furnaces during the first half of the nineteenth century. The operation of a small furnace did not therefore seem an impossible task. This point of view, together with a realization of the importance of problems connected with the pro-duction of pig iron, prompted the Bureau to undertake this work. Such problems as the feasibility of using charcoal briquets as a fuel, the application of oxygen enriched blast, and the use of new ores and raw ma-terials, in general, can be investigated only at consider-able cost on full sized furnaces, while with an experimental furnace they can be conducted at a com-paratively ;small, cost. The results of small-scale tests are sufficient to determine whether the problem. War-rants the expenditure required for a trial on a com-mercial scale. The accompanying photographs and chart show the various stages of the experimental furnace development. Some idea of the size and shape of furnaces which were tested can be had from the development chart. In oper-ating furnaces A to F, a series of changes were made to increase hearth temperature. Perhaps the most im-portant change was the position of the tuyeres with respect to the bottom of the hearth. The height of the tuyeres above the hearth was gradually increased and the hearth diameter decreased. It was shown by this series of furnaces that metal and slag are the chief source of heat supply to the crucible. For this reason there is a minimum rate at which these materials can be brought into the hearth of a small furnace if it is to function properly. The rate of slag "and metal fall are determined by the burden on the furnace and the rate of blowing. Due to lack of funds necessary to provide ample blowing equipment, hot blast stoves, essential mechani-cal features, and to meet operating expenses, it. was necessary to work with much smaller furnaces, such as G to K shown in the chart. The particular object of these tests was to study the extent to which reactions could be speeded up by decreasing the size of the stock. One decided change, noticed at the beginning of this series of tests, was the effect which coke size had on the production of a strongly reducing gas. Furnace G, 22 in. high, operating on coke crushed to pass 10 mesh, made a gas richer in carbon monoxide than did fur-naces A to F, operating on run-of-the-oven coke.

SINCE the discussion on steel rails in America has forcibly drawn attention to the value of chemical analysis, if not as a necessary stipulation, at least as a guide to control the usual mechanical tests, some doubt has been thrown upon the accuracy of the analytical results obtained by different chemists. To any one having the least acquaintance with chemistry, it is quite clear that if exactly similar results are to be obtained from the same borings of steel, exactly the same methods must be used by the different analysts. Hence the necessity (if complications are to be avoided) of establishing what I may call standard or normal methods, to be used both by the inspectors and by the chemists at the works. Remembering that the application of chemistry to steelrail inspection is yet in its infancy, it is of great importance to possess a perfect acquaintance with the best methods in use. Being myself a grateful pupil of Professor Eggertz, of the School of Mines in Sweden, it occurred to me, two years ago, that I could not do better than start a laboratory of my own, and engage one of his pupils, Mr. Troilius, for the purpose of analyzing the steel borings from mechanically-tested rails, so that I might thus obtain without delay thoroughly accurate determinations. Moreover, in order to carry on the operations in perfect accordance with the methods used at the steel works in England and Germany, where I had to control the manufacture, I deemed it desirable to allow Mr. Troilius to go through a course of training at these works; and I gladly seize this opportunity of expressing my grateful acknowledgments to several works in England and in Germany for affording every facility for such an exchange of information as mas found necessary in arriving at the best analytical methods to be used.

Thirty years ago, when I stood on the cliff of red fossil iron-ore, on Red mountain, Jefferson county, Ala., I asked what were the geological relations of this remarkable deposit. In reply I was told that it was a limestone, colored and saturated by some unknown but wholly external influences, and that at a reasonable distance from the surface the color would disappear. I could find no satisfactory explanation, either of the nature of this wonderful external permeating influence, or of the cause of such a ferrous impregnation selecting this one particular bed of limestone, to the exclusion of the higher and lower beds of the same material which are not even stained. I. The Present Theory. Referring to this subject, Dana says :' "The clays, clayey sandstones and limestones of the Clinton epoch, through New York and the Appalachians, show that the mud-flats and sand-banks, and hence the shallow seas of the coast region, still continued.... The beds of argillaceous iron-ore, which spread so widely through New York and some of the other States, west and south, could not have been formed in an open sea; for clayey iron-deposits do not accumulate under such circumstances. They are proof of extensive marshes, and, therefore, of land near the sea-level. The fragments of crinoids and shells found in these beds are evidence that they were, in part at least, salt-water marshes, and that the tides sometimes reached them." At first, this explanation seemed satisfactory, but the more I studied the ore the less satisfying the explanation became. 1. PrePatory Note.—The first part of this paper was sent to me by Mr. Emrich nearly nine months ago; and I held it, waiting for the second part, which he had promised to forward soon, so that I might submit the whole to some of his former professional associates, and advise him of their criticisms and suggestions before off'ering his work to the Institute. But, five days before the second part reached me, I received by telegraph the news of Mr. Emrich's sudden death. The paper has therefore not had the benefit of such a revision by the author as might have made it ill some respects clearer and more cornplete. Nevertheless, I believe that experts in the branch of metallurgy with which it deals will find it both original and suggestive.—A. Eilers. I. Partial ReFining iN the ANode-Furnace. During my connection with one of the large New Jersey copper-refineries, and probably before that period, from 15 to 30 per cent. of the copper-bullion received was the very foul, leady blister-copper produced from lead blast-furuace matte. It had been customary to mix a small part of this blister with each charge of purer pig-copper, in the effort to dilute it as much as possible before casting into anodes; but tank-house conditions were such that I was led to try making entire furnace-charges of this blister, and refining it as much as possible in the furnace—afterwards casting to anodes and refining elec-trolytically, in tanks and solution separate from the main bulk of the purer copper. In making this experiment, notes were made, for several furnace-charges, of everything thought to have a bearing on the question, and some interesting facts were brought out, both in the furnace-working and afterwards in the tanks.

IN October last, I was call upon to examine a copper deposit in the South Mountain, near the Pennsylvania and Maryland boundary. The specimens shown me contained oxides and carbonates with native copper, and were similar to some that had been described to me some years ago as existing at the Luray Gap in Virginia. An examination of Rogers's Report on the Geology of Pennsylvania, led me to expect to see his so-called "Primal Formation," such as exists throughout the southeastern district of the State. I was therefore much surprised on arriving at the summit of the Western Maryland Railroad to find myself on familiar ground. Instead of the "Primal" as I had known it in Southeastern Pennsylvania, I soon decided that the rocks were identical with the "Lake Superior Copper Formation." My visit was unfortunately a short one, part of two days, and in that time I had to pass over a good many miles, but I saw sufficient to convince me that instead of the Lake Superior Copper Formation being a local geological feature, it would have to be considered as a widely extended series of rocks. I was unable to even approximately estimate the thickness either of the trap zone or other members, schists and slates, of the series. In an article on the Copper Range of Michigan, prepared by C. P. Williams and myself in 1862, and published, in vol. xxxiv of the American Journal of Arts and Sciences, we endeavored to divide that range into zones, according to the character of the traps. Discussion of the paper of DAVID COLE, presented at the New York meeting, February, 1915, and printed in Bulletin No. 9S, February, 191.5, pp. 431 to 444. R. H. RICHARDS, Boston, Mass.-The Butchart riffle seems to violate, according to our preconceived notions, some of the very essential principles of the Wilfley riffle, and therefore ought not to succeed, but it does. On this account it must conform to other very important principles, or it would not succeed. It would beinteresting to know what these principles are which enable it to succeed. E. P. MATHEWSON, Butte, Mont.-I cannot, explain the principles on which this riffle acts, because I have not given it personal attention. All I can say is that I first saw the riffle in operation several years ago at the Steptoe Valley mill in Nevada, and I was told that a man had been around there guaranteeing that these riffles would make the table do twice as much work and do it better than with the ordinary Wilfley riffles. I heard nothing further about it for a long time. I heard about a year ago, from David Cole, the author of this paper, that the riffles were a success, and that he was using them at Morenci, and if, we were interested he would send the inventor to show us how they worked. As we knew of David Cole's reputation, we invited Mr. Butchart to come up and show us how his riffles worked. We did not have sufficient confidence in the invention to guarantee Mr. Butchart his traveling expenses, but lie came up entirely at his own expense and put in a set of the riffles on one table. I FEAR most of the Institute members are already weary of the perennial controversy about the apex law. I feel that way about it myself now, though I have been guilty of considerable contribution to the discussion in the past. The discussion does not seem to perceptibly influence previously held views and I would not again break into print on the subject but for the urgent invitation of the Chairman of our, Law Committee. This energetic and able member has firmly determined to secure a revision of the mining law and among other things to eliminate the so-called apex provision from the U. S. mining statutes. He is, however, fair about it and has invited me to make "the strongest possible argument in its favor." I am suspicious that he is acting on the psychological principle that it is usually easier to convince an audience against a cause vigorously but unsuccessfully defended than against one wholly mute. Nevertheless, I realize that personally he wishes me no harm, much as he hates the apex law, and so am willing that the Institute have whatever benefit may accrue from my taking up again the unpopular side of the discussion. I say this because the attitude of a large part of our "articulate" membership seems irreconcilably hostile; their minds are made up; favorable consideration is foreclosed; and they become impatient and even sarcastic at any attempt to elucidate a favorable view of the apex law. The exact question for discussion at the present time is not whether on abstract, or any other considerations, the apex law is the best possible rule, but the very different proposition whether, after nearly 50 years of statutory life and much longer as a practically universal miners' custom, it is now just and expedient to repeal the apex law.

Curlisle: We're sitting in Don McLaughlin's office overlooking Sun Francisco Bay, and he's going to be good enough to talk about early days in California, maybe about his college years in Berkeley, maybe about his first jobs in mining. Now, Don, would you be good enough to start it off by saying something about George Hearst. I know he died before you were born, but you know a lot about the family, and you no doubt know a lot about him. Certainly, nobody in those days matched his record in getting hold of good mines. McLaughlin: George Hearst died, actually, in the very year that I was born, but as I more or less grew up in the home of Mrs. Phoebe Hearst, who was his widow, I heard a great deal about the mines and the people that made the great fortune she inherited and used so wisely. But I don't think I really had an appreciation of George Hearst until 1 became active in the mining world and realized how many major mines he had picked in the early days and how much he had to do with their development into successful properties. He started in the California gold fields, but it was on the Comstock that he made his first big stake out of his substantial share in the Ophir mine. I believe at that time he was on his own. Then, later, he became associated with Ben Ali Haggin and Lloyd Tevis in San Francisco, and scoured the West for them. They made a little money in Eureka, Nevada, and other places, but the first important property that he obtained for them was the famous Ontario Mine in Park City, which became one of the great silver lead producers of the Continent. Then later he acquired the Homestake.

THE September issue of the Engineering and Mining Journal carried an item regarding the Cercapuquio Mining Co. which was mentioned as a large producer of lead, zinc, and cadmium, situated near Huancayo, Peru. The paragraph caught my eye because I had not heard of the property in thirty years and I recollect all too well the circumstances of its accouchement. In 1916 1 was making my headquarters in the town of Huancayo, then the terminus of the Central Railway of Peru, and was examining mines and prospects in that general area for Cerro de Pasco. In the course of my work I became acquainted with an engaging and energetic "practical" miner named Balarin, a Dalmatian living in Huan¬cayo, and made numerous trips in his excellent company. One day Balarin came to the down-at-heels hostelry where I stopped and told me that a Cholo prospector, a character by the name of Jose, had just reached town and claimed to have made a discovery in a little known locality called Cercapuquio. Lead-silver, Balarin said, and showed me a sample of galena about the size of his fist. "Fine," I remarked. "When do we leave?"

QUENEAU-One of the difficulties in metallurgy has always been a lack of precision in measurement, and I think the authors are to be congratulated on developing a method which will give us an accurate and dependable quantitative estimate of the amount of retained austenite. O. ZMESKAL*-As Chairman Queneau said, this is indeed an ingenious and needed determination. We have seen figures presented of 1/2 pct retained austenite determined, and I would like to ask the authors the lower limits of this method. How far down do they feel they can go in improving the technique still more?

IT is indeed an honor and a responsibility to have been selected to present the thirty-fourth in this series of Henry Marion Howe lectures, established to perpetuate the memory of a great teacher and one of America's outstanding scientists. Previous Howe lecturers have established high standards for this annual AIME event. It has been my good fortune to have enjoyed close association with five of these former lecturers; namely, Bain, Grossmann, Johnston, Sosman, and Vilella, all of whom have been prominently identified with the research activities of the organization with which I am connected. Some years ago I had an opportunity to examine a letter written by Professor Howe in 1904. This document was particularly interesting to me since I never had the privilege of personal acquaintance with Professor Howe and do not recall even having seen him during his long and active career. In view of the fact that the letter dealt, to some extent, with matters related to the subject of today's lecture, I would like to quote briefly from it. The letter is datelined, "Bad Kissingen, June 11, 1904." The salutation reads, "Dear Bradley," which suggests that it was probably addressed to Bradley Stoughton, who, I believe, was working with Howe at Columbia University at that time. The letter reads, in part, as follows: "Austenite and Martensite. I have not examined what Osmond says in his new book. His former remarks about austenite I found very confusing, indeed unintelligible. I think we can reconcile matters well enough for the present by assuming that martensite is a transition step between austenite at one end and ferrite and cementite at the other. Above critical range for steel of 0 to 1.80 carbon, austenite is normal state; below Ar1, ferrite and cementite are normal."
