Events of the mid-1970s have materially affected US coal production and transportation by railroad. Coal, as a replacement or substitute for petroleum fuels, has been hauled in significantly increased tonnages. Concurrent with the new demand, the railroad regulatory environment has undergone major changes, especially in deregulation activity. Those two events have produced considerable litigation regarding coal rates. This paper discusses the factors involved with railroad rates and topics such as revenue adequacy, Ramsey Pricing, stand-alone cost, and differential pricing. In addition, an update on the western railroad merger situation and the implications for coal transportation are presented. The paper concludes with an evaluation of the current regulatory climate and future prospects.

IT has been suggested by a number of people that it would be worth while for some one to attempt to summarize or condense the proceedings of this symposium. This task has fallen to me as organizer and co-chairman. Its difficulty will be appreciated by anyone who attempts to read the whole proceedings. It is therefore with trepidation that I offer the following digest. In recent years there has been a renewal of interest in America on this subject of the cohesive strength of materials, and a growing appreciation of the need for a better theory of cohesion failure. The theories of elastic action and plastic action are well developed, particularly the former. The theory of plastic action is still in the course of development, but it is well along. Plastic action is terminated by cohesion failure and what is needed is a theory that will tell us when to expect the cohesion failure. In the past it has generally been assumed that cohesion failure will occur when a critical value of the maximum tensile stress has been reached. Many experiments have shown that this is not strictly true, and this symposium concerns itself with the failures of this simple hypothesis, and with the efforts that have been made to devise a more satisfactory theory. The most active contributor in recent years to knowledge in this field is Dr. McAdam, and he was asked to open the symposium with a summary or condensation of his papers and views. Undoubtedly it is presumptuous to attempt a still greater condensation, but perhaps it will be useful, because even his contribution to this symposium contains no summary, no concise statement of just what his contribution has bees. Dr. McAdam makes two main points. The first is that the cohesive strength is not a single valued quantity, but that it is a function of all three principal stresses and hence must be represented diagrammatically by a surface in a three-dimensional figure. INTRODUCTION A small, independent mining enterprise (SIME) is an independently owned and operated business concern engaged primarily in mineral development, from the exploration to the production stage. By definition, a SIME is not dominant in its field and has no long-term financial backing. It is not a major producer of minerals, nor is it a petroleum company, a government organization or a subsidiary of such organizations. A SIME may or may not be listed on stock exchanges. The SIME is also called small miner, junior mining company, speculative mining company, and penny-stock mining company. The survival and growth of a SIME is most often controlled by an independently minded entrepreneur, who not only conceives and carries out new projects, but is materially affected by the success or failure of these projects. Usually, a SIME does not have a large or constant cash flow. Such a lack of long-term financial backing forces the SIME to meet the challenge of finding capital for its activities on a step-by-step basis. Its survival strategy is thus based on finding funds at the right time, of the right type and in the right quantities. The purpose of this paper is to show that the type of venture in which a SIME is involved affects the difficulty of raising new capital and the choice of possible sources of funds. The Small, Independent Mining Enterprise (SIME) The SIME is not a figment of the imagination of financial speculators. In Canada, there are more than 1,800 small mineral enterprises which spend on the average less than $1,000,000 per year on activity which is directed at bringing forth new mineral supply. In the United States, 64% of the non-fuel mining operations are conducted by nine or fewer men, and the coal industry is characterized by several thousand smaller independent producers, still predominantly family owned or controlled. In Chile, 80% of the mines can be classified as small mines. In the Philippines, approximately 60% of metal mining operations are classified as small mines. The SIME is actively engaged in mining all over the world, and very much so in the Pacific Rim. The Mineral Supply Process The whole process of bringing forth new mineral supply involves a dynamic sequence of activities, ranging from the initial exploration for a mineral occurrence to the production of a marketable product. A typical sequence is outlined in Figure 1. At the grass-roots exploration stage, a series of geological, geophysical and geochemical tests is aimed at locating a mineral occurrence. Especially in the early phases of such activities, the uncertainty (risk) surrounding a venture is high, since only general geological information exists on which to base a judgement of the economic viability of the venture. Such risk is attractive to few investors. As the information-gathering process continues, uncertainty diminishes. Once exploration efforts result in the discovery of a mineral occurrence, i.e. when indications of mineralization and mineable widths are obtained by drilling, there is still uncertainty concerning the extent of mineralization and the probability of having located an economic mineral deposit. The expected return on investment at such a stage may well be negative but the slight possibility of a very high positive return will make a number of financial sources available to an exploration company. West Texas and New Mexico have been overshadowed by the dcvelopment in East Texas to such an extent that the area has been placed on a settled production basis by most of the operators. Considerable develop-mCnt work on both proven and unproven acreage remains to be carried 011, but the incentive, a ready and profitable market, has been lacking. The main characteristics of the fields in this area are so well known that they are not described again in this paper, which thus resolves itself into a statistical review of the more important production features of the area. Proration has been in effect during the year and has been rigorously applied with the full cooperation of all producers. Proration in West Texas and New Mexico is based in the more productive fields on a potential and acreage distribution of the allowance to the individual wells or acreage units. Potentials are determined generally by a short production test of from 1 to 4 hr.; and the hourly rate is multiplied by 24 to obtain the 24-hr. production or rated potential of the separate wells. The potential values thus set up have been questioned by many production men who are not willing to concede that the instantaneous (hourly) capacity of a well to produce is its potential capacity for a day with all other wells in the pool producing at their capacity. However, the potential of a well determined as above remains its chief rating as a measure of the permeability in place and as an indication of the possible reserve feeding that well. The acreage factor has made it unnecessary to overdevelop properties in order to obtain an allowance proportionate to neighbors who are willing to drill an excessive number of wells on a piece of acreage in the hopes of a quick drainage and a corresponding profit. Proration has resulted in an orderly development of many of the pools in this area on the base as outlined above, resulting in more reasonable spacing of wells and the more even withdrawal of oil and the ensuing expectation of high recoveries. Big Lake.—Production from the shallow or 3000-ft. pay at Big Lake totaled a little more than 3,000,000 bbl. during the year, and we may expect a smaller recovery for 1933. THE East Texas oil field is the largest in the United States and perhaps the largest 'in the world ; likewise, it is one of the most interesting. The East Texas oil field is a water-drive field. Small amounts of salt water were produced from wells on the western side of the field from the bt-ginning of the development. By the end of 1933 (the field having been discovered in September 1930) water production had reached 9000 barrels per day. By the end of 1936, approximately 2000 wells were producing about 45,000 barrels of water per day, and the problem of salt water disposal attracted the serious attention of the operators. Salt water production in the field has steadily increased and today approximately 450,000 barrels of water per day is produced while the oil production averages about 375,000 barrels. Soon after the Waelz p1an.t for the fire concentration of low-grade zinc ores was put into operation in the early part of 1929 at Katowice, it was found that the conveyor equipment for transporting the hot residue from the furnace dust chambers was inadequate. Hand tramming with water cooling was used for a time, but that method was injurious to the workmen as well as costly. The problem was to find some practical mechanical means of conveying flue dust at temperatures of from 450" to 600°C. as it was drawn from the dust chambers. After considerable preliminary investigation it was decided to install pneumatic equipment for conveying the hot materials to a central mixing plant, where it would be mixed with slime and from which it would be returned to the furnace feed hoppers. The first pnenmatic equipment was installed in 1930, and has been in successful operation since that time. The pneumatic method of transportation has shown a considerable saving in operating costs over the former methods of dust handling and a decided improvement in working and hygienic conditions at the plant, through the elimination of the dust hazard. Additional pneumatic equipment mas installed in 1933 for conveying the furnace fume from the baghouses to the roaster plant. At the same time pick-up lines were provided for collecting the cleanings from the vertical and horizontal cooling pipes that are between the furnace dust chambers and the baghouses. The latter installation has practically eliminated a dusty and costly hand-tramming operation. A third extension was made to the pneumatic system in 1938 for conveying 'the zinc-lead-cadmium fume from the roaster-plant baghouses and flues to a new re-treatment plant for secondary products. The success of pneumatic conveying at the Waelz plant was the determining factor in the decision to install another pneumatic unit at the Saeger zinc-roasting and sintering plant. The new unit at Saeger was installed early in 1938 for the transportation of flue and Cottrell dust, small amounts of flotation concentrates to the sinter machines, and

The plummet lamp, to which I called the attention of the Institute, at the Bethlehem meeting, in August, 1871, with the improvement of the compensating ring, suggested by Mr. Heller, having come into general use for mine surveying in this country, and my attention having been called to the fact that it could not be employed in mines in which there was danger of meeting with fire-damp, I have so modified it that it can be used in all cases with safety. Mining engineers, who are in active practice in those districts where fire-damp is met with in the mines (and I am sorry to say it is becoming much more common in the anthracite regions), know how dangerous their work is when they are called upon to survey such mines, particularly when they are obliged to run lines in those parts of a mine which have been unworked, since by opening of doors, brattice, etc., to get the sights, they are liable to disarrange the currents of air, and cause any fire-damp that may have accumulated in the old workings to find its way into the levels, etc., where the party is at work. It is, therefore, very dangerous to leave an open light (such as the original form of plummet lamp) in an old breast or gangway, even when the safety lamp has shown that no fire-damp is present, for the opening of the doors, etc., may drive the fire-damp to the light, and thus endanger the lives of the engineers. The improved form of plummet lamp, now shown to you, can be used either with or without the safety apparatus. Upon the top of the plumb-bob portion of the old lamp a screw is cut, upon which a ring A is screwed. (See Plate 11.) On the external cylindrical part of this ring two small conical holes are drilled, 180' apart. The compensating ring, by which the plumb-bob part of the lamp is suspended, passes over the ring A, and is fastened to it by two small screws having conical points, which fit into the conical holes in the ring A. The safety apparatus resembles, to a certain extent, that of the Mueseler lamp. It consists of a ring B and plate C, which are united by four rods. The plate C has a cylindrical hole in the middle, and four apertures distributed radially around it. For a very brief description of the North Texas area, and the general geological features with which it is associated, the reader is referred to the opening paragraph of last year's summary1. A more complete discussion of the structure of the area, together with other interesting data concerning it, has been published recently by the Bureau of Economic Geology at the University of Texas2. It has been impossible for the authors to isolate the statistics for production for each of the many small pools of this district, as such statistics are not kept by operators except by counties or arbitrary divisions of counties. The total number of wells drilled in Archer, Wichita and Clay counties also has been subject to some estimate, as many of the shallower holes are not reported. While both routine development in proven or semiproven areas and exploratory drilling during 1935 showed an increase over the year 1934, the discovery of new producing areas of importance did not show improvement over that period. Several extremely local productive spots within semiproven areas were found in Archer, Cooke and Wilbarger counties; and extensions to older producing areas were developed in Archer, Baylor, Cooke, Montague, Wichita and Wilbarger counties. In Archer County, the Grace and Woods No. 1 Archer County (Fee), 4 miles northwest of Archer City, in the Thomas Glass survey, encountered a sand from 2836 to 2845 ft. of Pennsylvanian (lower Canyon) age, which showed an initial yield of 75 bbl. daily. While its production is of negligible importance, it is given special mention in this review because of the fact that it is producing from a new and deeper horizon than has been previously exploited in the county. Little deep development occurred in the district during the year. The Walter Gant No. 2 C. M. Worsham in J. M. The chromium, iron, and tungsten borides have been treated with ammonia at different temperatures. They are attacked, forming metal nitride and boron nitride, and the results are summarized in the tables. In the tungsten-nitrogen system a new phase has been observed, closely related to the known ß phase. THE present investigations were begun to determine whether any ternary phases exist in the transition metal-boron-nitrogen systems for the metals chromium, iron, and tungsten. Attempts to prepare such phases were made by using the borides of the metals as starting materials and ammonia as the nitriding agent. Although no new ternary phases have been found to exist, the results may be of some interest with regard to the technical use of the borides. General Procedure A steady stream of dry ammonia was passed through a silica reaction tube, the central part of which was kept at the reaction temperature while its ends were water-cooled. Weighed amounts of the borides were placed in a silica or porcelain boat and heated at different temperatures for a period of 10 to 24 hr. The boat was then rapidly removed from the reaction zone to the quenching zone, the water-cooled end of the tube, by means of a simple magnetic device. The nitrogen content of the products was determined by the increase in weight of the specimens, and the phase analysis was carried out by X-ray methods. For this analysis a Guinier-type camera, constructed at this Institute, was used with a bent, ground quartz crystal monochromator. The general reaction, which occurred in all the experiments, may be summarized as: metal boride + nitrogen -* boron nitride + metal nitride For the higher temperatures pure metal was formed instead of metal nitride. It is sometimes difficult to Discussi detect boron nitride among the reaction products by X-ray methods. Prolonged exposures of some specimens showed, however, that the strongest reflections of boron nitride were present. Additional evidence for its presence was given by the increase in weight of the specimens after nitriding. This increase was always greater than that corresponding to nitride formation only and was often in close agreement with the formula given above. Finally, a white powder, which was shown by X-ray methods to be boron nitride, was left if the reaction products after nitriding Fe,B at 448°C and FeB at 768°C were dissolved in diluted sulphuric acid. Ch rom iu m - Boron - N itrogen Five phases have been found to exist in the Cr-B system,' , and all were used as starting materials. Investigations on the Cr-N system have shown the existence of two nitrides with ideal composition Cr,N and CrN.".' * The results are summarized in Table I. All the borides are attacked and decomposed into chromium nitride and boron nitride, and the kind of nitride formed depends only on the temperature and not on the boride used as starting material. Most crude oils contain asphaltic substances that may be naturally or artificially precipitated. In the Greeley field, California, this asphaltic bitumen is precipitated during the flow of the oil from the reservoir to the stock tank The mechanism of such precipitation is not well understood. This paper presents the progress that has been made by using the electron microscope as a new tool and by observing the effects of the streaming potential on the formation of bitumen particles. Crude oils at atmospheric pressure viewed in the electron microscope in very thin films under a vacuum showed no asphaltic particles. A technique of preparing slides of thin films by dilution of the oil with benzene and washing in petroleum ether was used at first, and these observations showed that the solvents caused the formation of the particles, varying from 0.01 to 0.2 micron in diameter. The electrical effects of fluids flowing through porous solid were studied, with emphasis on the formation of colloidal particles by the streaming potential. The streaming potential of crude oil flowing through sand was measured and was shown to be responsible for the formation of bitumen particles. These results bring out a new phenomenon, which may occur when crude oil flows through the porous oil reservoir. mechanisms. Asphalt has been the subject of widespread investigation but, owing to the complexity of the substances being considered, progress has been slow. Investigators working primarily with the asphaltic substances have treated the subject from the colloidal standpoint and have developed theories that picture the asphaltic particles as surrounded by adsorbed materia1s.14,15,17,24 The deasphaltization of lubricating oil by the use of solvents treats the subject primarily from the standpoint of liquid-liquid equilibria.'' A complete understanding of asphaltic substances would make possible the following of the material from its initial state in the crude oil through precipitation processes to the final plastic stage, the most common form of which is used in asphaltic pavements. Since these asphaltic particles are very small, it appears 'hat the electron microscope4 might be a useful tool in studying the precipitation processes. Specimens are examined by the electron microscope in a vacuum and as very thin films, requiring special techniques in preparation of samples. A brief description of the electron microscope and its operation will bring out the difficulties and advantages of its use for this problem. The first work was done with crude oils that had been diluted with solvents for the preparation of the film to be examined. Later a technique was developed by which the undiluted oil film could be made thin enough for direct examination. In discussing the classification of iron to-day, we are to leave out of consideration the general division into non-malleable or cast iron and malleable iron, as to the adequacy of which no question has been raised; and to confine ourselves to the subdivisions of malleable iron. This has been classified, according to the extent to which the properties imparted by carbon are present (viz., resilience, hardness,strength, and, above all, the capacity for being hardened by sudden cooling from a high temperature), into (1) wrought iron which cannot be hardened, and (2) steel which can be hardened; and this classification I shall, for briefness, term the carbon classification. Until within a few years all authorities, both metallurgical and general, have concurred in explicitly recognizing the carbon-given qualities, and preeminently the capacity for being hardened, as the essential qualities of steel; this is laid down with clearness by every writer on the subject. For several years this old classification has not been sufficient to meet all our needs, since the genius of Bessemer, Siemens, and, I may add, Holley, has produced wrought iron which has been perfectly melted, and thus freed from certain mechanical adhering impurities. This causes what we call homogeneousness for want of a better word, and gives rise to many important qualities which the old wrought iron had not; qualities universally recognized, though not readily described. I shall, for briefness, style them the fusion qualities, and a classification based on them, a fusion classification. These qualities render the new product so vastly superior, for most purposes, to the wrought iron formerly known, that it is neces-

EARLY this year the Board of Directors announced that, through the generous gift of past-president W. L. Saunders, a gold medal to be awarded for distinguished achievement in mining had been estab-lished. At the December meeting of the Board the medal committee reported that it recommended that the first medal be awarded to David William Brunton for "development and exposition of the principles and prac-tice of ore sampling; for systematic daily mapping of mine geology; for the Brunton mining compass; and for engineering achievements in connection with great tunnels." The formal presentation of the medal will be at the din-ner, on Feb. 16, in connec-tion with the annual meet-ing. Mr. Brunton, like several other prominent Institute members, was born in Can-ada, and came to the United States when he was twenty-four years old. He had then been in civil en-gineering work for three years and after a year more of it, deciding that mining was more attrac-tive he spent two years at the University of Michigan doing advanced work in geology a n d chemistry. His first mining engage-ment was with the Dakota and San Juan Mining Co., at Mineral Point, Ouray County, Colo. That was in June, 1875, and the young engineer had to travel 230 miles by trail from the then nearest railroad station at Pueblo. Having to come out because the company did not get in enough supplies to last through the winter he became metallurgist for the Hunt, Douglas & Stewart Co., at Georgetown, Colo. When the Hunt and Douglas plant proved a success, H. A. Taylor, the father of Mr. Brunton's later partner, Frank M. Taylor, engaged him to build the Clear Creek Reduction Works. Eighteen months later he built the Native Silver Mining Co. mill at Caribou and a year later a mill at Silver Peak, Nev., that was so successful that the principal owner shut it down to freeze out the minority stockholders. The winter of 1879 found him at Leadville where he did engineering work for the Robert E. Lee, Duncan, Wolftone, A. Y. & Minnie, and Dinero mines, eventually becoming manager of the Colonel Sellers. In 1886 he was called in on apex-side-line litigation at Aspen with the result that he went there to develop the mines for economic and legal pur-poses, and later became the manager of three of them. The chemical reaction occurring in collection of nonmetallic minerals with amine-type collectors was early postulated by students of flotation phenomena to be metathesis between the mineral and the collector, involving exchange between the amine-bearing (aminium) ion and the cation of the mineral, and formation at the mineral surface of an oriented film of the amine salt of the mineral anion. Qualitative evidence of exchange has been obtained on several occasions at Columbia. Thus 1000 C.C. of a solution containing 495 mg of laurylamine hydrochloride was shaken 17 min. with 100 grams of barite and ground in a porcelain mill to pass a 200-mesh screen; the mixture was then set aside for 48 hr. Filtrate therefrom analyzed 476 mg. per liter of laurylamine hydrochloride. There was no substantial loss of chloride ion (78.4 mg. per liter in the original; 74 in the filtrate). No successful analyses were concluded for barium ion. Earlier, confessedly rough work with scheelite indicated a solution gain in Ca++ equivalent to about one-half the aminium ion lost. Real quantitative roof of the exchange, in the form of an established stoichiometric balance, is unknown to the authors. The data of the present paper, however, obtained from experiments designed on the basis of the exchange hypothesis, constitute strong evidence of its truth, and at the same time point the way to economic utilization of the expensive nitrogen-bearing collectors in concentration of the low-priced nonmetallic minerals. The basic postulate underlying the experiments performed was that, if the collecting reaction is of the type R+ + Y- + MX = RX + M+ + Y- where R = aminium ion, Y = the anion of the amine salt, and M and X are, respectively, the cation and anion of the mineral, the reaction should obey qualitatively the implications of the mass-action and solubility-product laws. This is to say that coating and collection should be aided by the addition to the solution of either ion (R+ or X-) of the collector-coating compound, and hindered by the addition of either of the ions M+ or y-. Experimental work comprised determination of (,) the relative solubilities of the laurylammonium salts of a variety of nonmetallic-mineral anions; and (21 the contact angles' of various minerals in solutions containing different concentrations of the postulated controlling ions. THE recrystallization of cold-worked metals is studied ordinarily by determining the temperatures required for complete recrystallization to occur within a given arbitrary time period, usually within 15 min. to 2 hr. The results obtained are conventionally assembled in a three-dimensional diagram relating this temperature to the amount of cold-work (percentage deformation) and the resultant grain size, though sometimes other modes of representation are employed.1 Such three-dimensional diagrams are not complete, for the number of variables exceeds the number represented. The process of recrystallization is characterized by a time-rate, a fact that is not portrayed upon ordinary recrystallization diagrams. It is known that recrystallization consists in the formation of new nuclei and the growth of these nuclei, a process that continues until the matrix is completely consumed and the original set of grains entirely replaced by the new. This knowledge is old.2 Truly heterogeneous reactions invariably proceed by nucleation and growth; the decomposition of eutectoid solid solutions provides an example about which much is known,3 and freezing, originally studied by Tammann, provides the classic example. Although recrystallization is not a heterogeneous reaction within the orthodox meaning of the term, the mechanism of the process is the same. As in eutectoid inversion and freezing, it should be possible to study the rate of isothermal recrystallization as a function of time, and it should also be possible to analyze the isothermal reaction curve into the component rates of nucleation and growth that determine them.* Other methods, not employing the rates of nucleation and growth, have been used to represent the rates of such reactions, but these in general have been artificial and have not led to progress .4,5† The theory of recrystallization is not in advanced state; if recrystallization data were obtained in terms of the rate of isothermal recrystallization, and in terms of the rate of nucleation and the rate of growth of recrystallized grains, and in particular if the temperature coefficients of these rates were measured accurately, an adequate theory should be more readily developed .27 Such an effort requires proper experimental technique, but especially requires suitable methods of mathematical analysis to convert measurements made upon a surface of polish into values for the rate of nucleation and the rate of growth and to combine these into a rate of isothermal recrystallization. The smelting of galena in the ore hearth has been practiced in many countries for several hundred years with varying success. In the United States, the water-jacketed American hearths and the Jumbb hearths have found some favor in the Missouri lead belt, where large quantities of non-argentiferous galena concentrates are produced. In form and method of operation the ore hearth has changed but little since its earliest conception. A detailed description of the furnace is lot needed here; it has been fully described in most works on the metallurgy of lead and in many technical papers. Since its field is restricted to non-argentiferous galena, containing over 68 per cent. of lead, its use is limited to a few districts; and, on account of certain disadvantages attending its operation, modern sintering and blast-furnace practice has nearly driven it out of the Missouri field. It is not generally known that the cost of producing pig lead is smaller by the hearth method than by sintering and blast-furnace smelting. Yet it is doubtful if any metallurgist knowing this to be true would recommend an American hearth installation—by reason of the disadvantages which will be briefly enumerated. The furnace has been limited to a length of from 4 to 5 ft., requiring for its operation two men working an 8-hr. shift as a maximum. The product per man is small; the work is hot and laborious; and the difficulty of completely removing the dust and fume has made it a notorious source of lead poisoning, Although suitable for operations on a small scale a large number of hearths would be required for a plant smelting 10,000 tons of 68 to 70 per cent. concentrates per month; and the number of semi-skilled laborers would be six times the number of hearths—a condition which is prohibitive. On account of the high percentage of dust and fume produced, a large flue and bag-house installation is required and, in the past, the handling and re-treatment of this dust and fume has -been a serious problem.
