In the mid-1970?s, the market value of tangible assets of S&P 500 companies far outstripped the value of intangible assets, including intellectual property (e.g., 83% tangible assets v. 17% intangible assets).1 By 2005, the picture was quite different. By that time and continuing to 2010, S&P 500 companies? market value of intangibles was about 80%, with tangible assets accounting for only 16% of market value.2 This swing highlights the importance in today?s world of understanding intellectual property rights and varying strategies and options for protecting them. This paper discusses intellectual property rights particularly patents and trade secrets, specifically: 1) types of intellectual property; 2) choosing the mode of intellectual property protection; 3) obtaining patent protection; and 4) using patents as a sword versus a shield.

The year 2010 will mark the 100th anniversary of the beginning of the research efforts by the U.S. government to improve the health and safety of miners working in the United States. This research began in 1910 with the establishment of the U.S. Bureau of Mines (the Bureau) and it has continued during the past 10 decades, even after the closure of the Bureau in 1996. The research on safer mining technology, formerly done by the Bureau, has now been combined with National Institute for Occupational Safety and Health (NIOSH) studies of miners? health to form a unified federal research program to improve the health and safety of miners. This article describes this research and places some of the accomplishments into perspective with other activities in the U.S. Mine Safety and Health Time Line (insert).

In this study, the cyclonic static microbubble flotation column (FCSMC) was investigated for fluorite beneficiation. The structure and principle of the specially designed column are described. Fluorite samples from the tungsten separation tailings of the Shizhuyuan Mine, Chenzhou, Hunan Province, P.R. China, were tested using a small-scale continuous flotation test unit, and concentrates with a fluorite grade higher than 98% were obtained. One rougher and three cleaner stages in the FCSMC achieved the same separation performance as one rougher and eight cleaners in conventional flotation cells. This greatly simplified the flotation circuit and reduced operating costs.

The number of Native Americans presently working as mining engineers is extremely low-perhaps three in the entire US. At the New Mexico Institute of Mining and Technology, it was felt that introducing high ability students to mining engineering at the high school level would encourage more to consider mining engineering as a career. New Mexico Tech, in Socorro, NM, has initiated a continuing summer college program for Native American high school students. The program, which began in the summer of 1980, is designed to introduce participants to college life, enrich their high school curricula, and expose them to the problems and challenges of a career in mining and related engineering fields. Students From reservations throughout New Mexico with a demonstrated aptitude for science and mathematics were encouraged to apply for admission. Preference was given to high school sophomores and juniors since it is hoped that students will want to return for a second year before graduating from high school and beginning university studies. The program seeks to impress upon the students the need fir Native Americans in the fields of seience and mineral engineering.

Until a few years ago tunnel construction was based exclusively on experience. In recent years, however, numerical models have increasingly become an integrated part of tunnel design [2]. These models permit good evaluation of the tunnel's support behavior even before it is designed. In particular, numerical methods are highly suited for the development of new construction methods. The prerequisite for this is the application of high-performance pre- and postprocessors, permitting the design engineer to come to a quick interpretation of the analysis results. In future, 3D analysis will take on increasing significance, for which reason this paper also deals with this type of models.

The East Side Access (ESA) project is the largest underground rail infrastructure project under construction in New York City, USA. The Manhattan segment of the project is to be mined through rock and consists of 4.1 miles of Tunnel Boring Machine tunnels for track work and mined excavations to house rail switches, air plenums, and other rail facilities. This paper considers different methods for concrete lining, such as the use of fixed forms, adjustable forms, and pneumatically applied shotcrete. The advantages and disadvantages of these methods are discussed and the basis for considering one over the other are illustrated. Further discussions on design development and preparation of documents to facilitate quality and constructability in the field are presented.

New approaches that increase hydrometallurgical recovery from refractory minerals in below-mill-cut-off-grade sulfide copper ore can add significant value, improve profitability and increase ore reserves. This paper describes the development and implementation of an engineered heap (EH) approach to leaching low-grade, chalcopyrite-bearing ore at Freeport-McMoRan?s mine in Morenci, Arizona. The technical evolution of the engineered heap concept is described together with the challenges and benefits following implementation.

On the 2nd of June 2007 SELI S.p.A. started the excavation of Beles Tailrace Tunnel (Ethiopia). The new 8,07 m diameter DS Universal TBM utilized for the tunnel excavation was manufactured by SELI S.p.A. and allowed the installation of 30 cm thick concrete lining, contemporaneously with the excavation of 7,200 m of tunnel. The greatest part of the tunnel alignment was excavated in hard and sound basal-tic rocks. The paper describes the main steps of the tunnelling operations which led to a remarkably rapid excavation, with a peak production of 36 m / day and a final break-through achieved 46 days ahead of the contractual deadline. Furthermore the paper describes the work and logistic organization that was set up to efficiently perform the mechanized excavation in the very remote area of the project.

Historically, boulders are a frequent source of problems in soft ground tunneling. During tunnel construction, the need to manually break and remove boulders as obstructions causes delays to the project. Repairs to a tunnel boring machine (TBM) can also be a source of delays. Managing these problems is difficult since normal soil investigation techniques do not accurately predict the presence or frequency of boulders. This has lead to considerable number of claims for extra costs and delays during the construction of soft ground tunneling projects. These issues are exacerbated in pressurized face tunneling systems where there is limited access to the TBM cutterhead for obstruction removal and/or cutterhead maintenance. The project team that built the Big Walnut Augmentation/Rickenbacker Interceptor (BWARI) Project for the City of Columbus successfully managed the design and construction of a 4,267 mm (14 ft) diameter soft ground tunnel with high boulder concentrations in a complex geologic setting. The management of the boulder issue tookplace during several phases of the project.

This article is part of a presentation Strauss made Dec. 3, 1988 at the sixth annual American Mining Hall of Fame (AMHofF) banquet in Tucson, AZ. At the banquet, the Mining Club of the Southwest honored Strauss by naming him the 1988 recipient to the AMHofF. (Industry newswatch, page 6). Introduction In the last two decades, there have been two previous periods of sharply rising copper prices. One was in 1973-74; the other in 1979-80. In both cases, a short period of high copper prices was followed by steep and prolonged periods of low prices. In the language of the market analyst, the high prices were called spikes. Is it likely, then, that three or four years from now the present price of copper will show up as a spike in the charts? There are substantial differences between the current position and the markets of 1973-74 and 1979-80. In 1973-74, US copper prices were subject to government-imposed price ceilings of $0.60 per lb through early December, 1973. These were increased to $0.68 per lb through May, 1974. Meanwhile, mines outside the United States were free of restraint. Rising demand in London pushed the price above $1 per lb in the third quarter of 1973. In early April 1974, it reached a peak of $1.50 a lb. In May of that year, the US ceilings were removed and the domestic price began to rise. What were the causes of this price strength? While ceilings held the domestic price below the world market, domestic consumers acquired all the tonnage offered by US mines. Meanwhile, in the world market, buyers feared prolonged shortages. The Club of Rome had warned that world economic growth would be limited by impending depletion of mineral resources. There was al so concern about a copper cartel that might increase copper prices even more. In early 1974, at a special United Nations session, developing-country spokesmen warned the industrialized world to expect high commodity prices. Also adding to the concerns of copper buyers was the fear that when US wage contracts expired in mid-1974, protracted strikes might ensue. The combined effect of this atmosphere was that consumers accumulated large amounts of copper, far above their normal carry. By midsummer, the position changed radically. While some strikes did occur in the United States, they proved short-lived. The most significant development was a massive economic recession. The energy crisis was causing enormous dislocations in the world economy. Construction activities were sharply reduced and automobile sales plummeted. Public confidence was shaken. Copper sales fell precipitately as consumers decided to draw down their swollen inventories. The price came down too. In April 1974, the London price- as noted-was $1.50 per lb. By the end of the year, it was down to $0.57 per lb. In 1973-74, the copper price rise was fed by fears of shortages, cartels, and strikes. In 1979-80, the market rose on the strength of good demand plus political and military instability. The price rise was also fed by inflationary trends, exemplified by speculation in precious metals. Prior to this second spike in copper prices, the market had been depressed despite economic recovery. Despite reduced US output, copper production in the rest of the world was increasing. Though consumption was rising, surplus stocks reached unprecedented levels. At the end of 1977, the aggregate of stocks at the refineries and in the exchange warehouses was 1.5 Mt (1.67 million st). That was more than three months' shipments at then rates of consumption. In 1978, the statistical position improved. Shipments of refined copper that year were 8% greater than in 1977. The result was reduced visible stocks but -just as was to be the case in 1984-86 - the price remained depressed. In 1979, an even sharper drop in visible stocks occurred as shipments rose by another 4%. This time, though, the price responded. In December 1978, the price in current dollars had been less than $0.70 per lb. By the end of 1979, it was above $1 per lb. And in the first quarter of 1980, it averaged more than $1.20 per lb. Military and political developments were a factor. The hostage crisis in Iran was followed by the Soviet invasion of Afghanistan. To many, it appeared that war might result if the Soviets pushed on into Pakistan. At the same time, speculation drove gold and silver prices to incredible levels. As silver prices rose above $40 per oz), copper above $1 per lb did not seem unreasonable. Then, in March 1980, the precious metals price boom collapsed. Copper prices also retreated, though not as much. In February 1980, the copperprice averaged $1.32 per lb. By December, it had dropped to $0.85 per lb. In 1981 and 1982, the decline continued. The present copper situation Why is the current situation different from these two previous episodes of high prices? First of all, today's inventories are far lower than they were in either 1974 or 1980, when the price declines began. The stocks at refineries and in exchange warehouses are substantially less than they were then. More significantly, consumers today have very limited holdings compared with stocks they carried in 1974 and 1980. Even if faced with a downturn in their own business, copper consumers will not be able to stay out of the market. To the extent they have any business at all, they will have to buy copper. And on the supply side, there is also a significant difference. The year 1988 has been unusual. US production is up sharply, responding to higher prices. But production is little changed in the rest of the Free World. Indeed, several of the major producing countries have mined less copper this year than in 1987 despite the prices increases. Peru has had labor problems that have cut its output. Zambia and Zaire suffer from shortages of expatriate technicians, not to mention spare parts. They also suffer from the failure to maintain equipment or perform adequate development. In Chile, the two largest mines, Chuquicamata and El Teniente, have not met their production targets. Chuquicamata is struggling with high arsenic content in its ore. And, in late 1987, severe rockbursts hampered operations at El Teniente. The iron nugget process is an economical, environmentally friendly, cokeless, single-step pig iron making process. Residence time dependent process requirements for production of pig iron nuggets at a fixed furnace temperature (1425 C) were investigated. Three chemically and physically different products were produced after complete reduction to iron, depending on the residence time in the furnace. These products were direct reduced iron (DRI), transition direct reduced iron (TDRI), and pig iron nuggets (PIN). The increase in the carbon content of the system as a function of residence time was detected by optical microscopy and Microhardness measurements. Sufficient carbon dissolution for the production of pig iron nuggets was obtained after 40 minutes residence time. The pig iron nuggets produced had chemical and physical properties similar to blast furnace pig iron. They were liquid state products and slag was completely separated from the metal.

A large lab apparatus was designed using a scale-down methodology based on the design legacy of the current FLSmidth commercial forced air flotation machines. This new apparatus, along with a new test methodology, was used to evaluate new rapid prototype concepts. The apparatus was designed to monitor bubble size, power, pumping capacity, Jg, velocity profiles, froth character, and tip speed. The methodology developed follows a sequence that goes from hydrodynamic tests and solids suspension tests to a flotation kinetic test. This methodology has been demonstrated to be a good tool to determine the effect of machine design changes on flotation.

Now imagine the challenges of installing new, or re-placing aging infrastructure, in this setting. Every shovel full of dirt, every stick of pipe and every roadway sub-surface has its own historic story to tell. For engineering minded individuals, Charleston?s infrastructure has almost as fascinating a history as its more visible surface structures. Charleston was among one of the first American cities to construct separate sanitary and storm water drainage infrastructure. This concept has roots dating back to the city?s founding and is a credit to the foresight of its founding fathers who understood the basic health differences between sanitary and storm water.

Horizontal stresses are caused by global plate tectonic forces. During 1995 alone, they were largely responsible for closing two U.S. longwall mines. This paper presents six case histories from Pennsylvania. West Virginia, Kentucky and Alabama. In each case history, a mine encountered roof falls or difficult ground conditions in the headgate, caused by horizontal stress concentrations. The problems are detailed and the control measures adopted are described. In most cases, nearby longwall panels without stress concentrations were trouble-free. The paper also discusses detailed measurements made at two adjacent Pennsylvania longwalls. One headgate was oriented to avoid a horizontal stress concentration, and the other was not. Eliminating the stress concentration dramatically reduced roof support loads and roof deformation. The paper concludes that proper panel orientation and sequence is the key to maintaining headgate ground control. The optimum orientation is not parallel with the maximum horizontal stress, as previously thought but rather 200 in the stress shadow of the gob. Other stress control techniques, including artificial support, are briefly discussed.

Researchers from the National Institute for Occupational Safety and Health (NIOSH) are developing a coal pillar rib rating (CPRR) technique to measure the integrity of coal ribs. The CPRR characterizes the rib composition and evaluates its impact on the inherent stability of the coal ribs. The CPRR utilizes four parameters: rib homogeneity, bedding condition, face cleat orientation with respect to entry direction, and rib height. All these parameters are measurable in the field. A rib data collecting procedure and a simple sheet to calculate the CPRR were developed.

Peng The highlights of this paper are : • The shield supports with lemniscate links will exert a tangential force on the roof strata, causing unnecessary and harmful roof movements, thus damaging the roof structure. The principal source of the tangential force is the horizontal movement of the point O, the pivotal joint between the canopy and the caving shield. When the support height is changed during setting, the point O will move along a curve upward and rearward toward the gob. As a result, it produces a vertical movement, causing the roof to move up a distance of ?d, and a horizontal movement toward the gob, creating vertical fractures in the roof. • The major purpose for employing the lemniscate-link system is to protect the hydraulic legs against the action of the bending moments induced by the tangential force that causes deformation or destruction of the legs. • Based on these two points, the author suggested that, in order to eliminate the harmful effects of the lemniscate-link system and strengthen its advantageous features, a shield support with a new design of that mechanism has been developed. With the new design, the conventional rigid lemniscate links are replaced by hydraulic rams. When the pressure inside the rams reaches a certain level, the ram will yield.

Blast-induced rock mass displacement can have a significant impact on ore loss & dilution. The mischaracterisation of the grade boundaries both prior to, as well as a result of blasting can lead to significant financial losses on account of ore loss and dilution. Ore dilution occurs when waste material is miscategorised as ore and sent for processing or stockpiling, diluting the run of mine head grade and recovery. Ore loss takes place when valuable mineral is miscategorised as waste and sent to the waste dumps, thus never being processed and recovered. Extensive research has been conducted at the University of Queensland over the last fifteen years to understand the impact of blast movement on ore loss and dilution. Recent outcomes of this research have developed innovative tools and techniques to measure and model blast movement. These techniques have been implemented at Ahafo gold mine in Ghana to understand blast movement dynamics and to implement solutions to reduce blast-induced ore loss and dilution. These solutions are validated through controlled trials and have been incorporated into site standard operating procedures to sustain the benefits.

Sustainability issues are from rising interest and importance for the mineral industry worldwide. In order to bring them into management processes and to improve decision processes, economic, ecological and social aspects of products, services or technologies have to be assessed. In this paper, the concept of integrated sustainability assessment is presented. Each aspect is assessed with quantitative or qualitative methods. The results of these ecological, social and economic sub-assessments are integrated by the means of Fuzzy Logic in order to regard preferences of decision maker and circumstances of decision situation. An example demonstrates the application of this new instrument.
