American mining companies operate many drum hoists that hoist from various depths with varying payloads. This paper will review the procedure of selecting optimum wire rope constructions for these existing hoisting installations. Selection for proposed installations along with recommended hoisting parameters will also be presented. To achieve this optimum rope performance, preventative and corrective maintenance procedures will be reviewed along with examples of rope problems and their causes.

With ever rising energy costs, it is increasingly important for mines to operate with energy efficiency. As a large portion of a mine?s energy consumption is often attributed to the operation of mine ventilation fans, maintaining an efficient ventilation system is a critical pro-active way for mining companies to reduce power costs. A common way to measure a mine?s ventilation system efficiency is to calculate the volumetric efficiency, which is simply a calculation of the percentage of total mine air that is usefully employed for production. The purpose of this study is to document a nationwide comparison of the volumetric efficiency of U.S. underground coal mining operations. The results will aim to show just how efficient today?s coal mine ventilation systems are and what factors may be causing their various efficiencies and inefficiencies.

This summary of international mineral exploration activities for the year 2007 draws upon available information from industry, literature and U.S. Geological Survey (USGS) specialists. The summary provides data on exploration budgets by region and mineral commodity, identifies significant mineral discoveries and areas of mineral exploration, discusses government programs affecting the mineral exploration industry and presents analysis of the mineral industry based upon these data. Two types of information are reported and analyzed in this annual review of international exploration for the year 2007: 1) budgetary statistics expressed in U.S. nominal dollars provided by Metals Economics Group (MEG) of Halifax, Nova Scotia, and 2) information on regional and site-specific exploration activities that took place in 2007 and compiled by the USGS.

Adverse geological condition is a major factor which makes construction difficulty in tunneling. But if it is predicted and tunnel support is made efficiently in time, the above difficulty can be reduced. It is necessary to develop one or several effective and economical geological methods for prediction of tunnel geology while expensive and time-consuming instruments are used. This paper reviews and proposes several geological methods for prediction of fault, seam, contact zone, and groundwater inrush. These methods have been proved to be effective and economical in tunneling practice in China.

The future of the world's minerals industries is often painted as bleak. Peter Drucker has repeatedly proposed that the demand for minerals has become "uncoupled" from world economic growth.' This implies that, while mineral demand was in the past linked to the growing demand for and consumption of goods and services, further world development will not require substantial mineral inputs. Lester Thurow noted that for these reasons the US minerals industry is diminishing in scale and economic importance.2 There is some documented evidence of such uncoupling, and the demand for minerals may indeed diminish in the future. But such announcements are, to this point, no more than speculation. For instance, is it not just as likely that renewed environmental concerns will cause increased demand for the relatively innocuous environmental properties of metals, replacing plastics? And even if the prophesied demand decreases do occur, a sufficient fall in metal prices due to technological advances could increase the quantity of minerals demanded above current levels, in spite of leftward shifting demand curves. Thus, worldwide mineral production activity may increase or decrease in the future and no one can say whether more or fewer of the earth's citizens will become involved in the extraction and processing of minerals.

At the beginning of the 20th century, barite was a mineral of minor importance in the USA. Its primary use was to extend lead oxide in white paint. Barite also added the special qualities of hiding power and flatness to paint. Because white lead sometimes turns black or yellow and barite does not, ground barite became a pigment on its own merit. Barium chloride was added to bricks before firing to stop efflorescence when exposed to weather. Barium carbonate or nitrate added luster and brilliance to glass. Barium chemicals were added to refining sugar, enameling iron, making oilcloths and paper collars, and in the manufacture of paper, artificial ivory, rubber and lithopone. Lithopone became a major paint ingredient in the 1920s; its use lasted until the 1950s, peaking at 150,000 metric tons of barite in both 1937 and 1947 for the manufacture of lithopone. Later in the 20th century, titanium dioxide replaced lead oxide, barite and zinc oxide in the coatings industry. In the 21st century, barite is used as a filler, extender, or weighting agent in products such as paints, plastics, and rubber. Some specific uses include its use in brake and clutch pads for automobiles, automobile paint primer for metal protection and gloss, add weight to rubber mud flaps on trucks, and add weight to the cement jacket around petroleum pipelines under water. In the metals casting industry, barite is part of mold release compounds. Because barite significantly blocks X-ray and gamma ray emissions, it is used as aggregate in high density concrete for radiation shielding around x-ray units in hospitals, nuclear power plants, and university nuclear research facilities. Ultra-pure barite consumed as liquid is used as a contrast medium in medical X-ray examinations. Barite is the raw material for barium chemicals, such as barium carbonate, which is an ingredient in faceplate glass in the cathode-ray tubes of televisions and computer monitors. In the 21st century, barite industrial uses account for an estimated 78,000 tons per year in the United States. Another barite use was patented in 1926 by the oil industry. In this patent, barite is primarily used as a non-abrasive weighting agent for drilling for oil and gas exploration and production. As a weighting agent, it provides the downward force in a water based or oil based drilling fluid for cutting through rock with a tri-cone diamond drill bit. In order to minimize the wear on the drill bit and drill stem, minimum abrasion of the weighting agent is preferred. In recent years in the USA, 95% of the barite produced and about 80% on a world basis are used as a fluid weighting material during the search for oil and gas. During the latter part of the 20th century, barite was used in the drilling mud of oil and gas wells, particularly for wells deeper than 2000 meters, and petroleum well drilling demand for barite became the mineral?s major end use during economic expansions after World War II and subsequent increased use of oil and gas in the USA. The profitability of oil and gas production had a strong effect on the number of drill rigs and consumption of barite. The United States was the leading petroleum well drilling country starting in 1970, reaching 4,530 drill rigs in December 1981, and was the largest consumer of barite. In the USA, record highs of about 2.6 million tons of barite produced and 4.3 million tons consumed were reported in 1981. From 1997 to 2006, barite production declined from 662,000 to 589,000 metric tons. However, USA imports increased from 1,470,000 to 2,530,000 metric tons for lump barite. World production of barite increased from 6,780,000 to 7,960,000 metric tons during the same period. Table 1 (see Appendix) lists USA production, imports and exports and world production from 1997 to 2006. Major sources of imported barite include China, India and Morocco. Table 2 (see Appendix) lists the USA imports and price of barite by country. China, India and Morocco are the three largest exporters of barite to the USA and the world. Vietnam is a new producer, beginning in 2006. IMPACT OF CHINA ON DRILLING GRADE BARITE In the 1970s or before, China began supplying barite to the world drilling market in order to help develop their economy. When China first entered the barite export market, their high production volume, low pricing and low ocean transport expenses to the Gulf Coast forced barite producers in the USA to supply only regional markets, such as Battle Mountain Nevada barite for the western and Rocky Mountain states and Canada. Until recently, it was China?s government policy for domestic consumers to use barite below the API 4.20 specific gravity specification, leaving higher grades for export, but this is no longer the case. In recent years the internal demand for barite in China increased tremendously as their economy rapidly developed. China reduced their former 15% VAT tax rebates to 5% for Chinese barite producers, and then eliminated all VAT tax rebates on December 15, 2006. On the supply side, some high-grade barite deposits in China have been depleted. In particular, the low heavy metals sources are less plentiful. Additional mine capacity is being developed, but the new mines are underground and therefore costs will be higher. China?s appetite for other raw materials has tied up a large portion of the world?s bulk vessel fleet, including Panamax vessels (preferred for barite ore transport). Ocean transport freight rates have increased in recent years, and receiving ports in the USA are congested with imports of higher-added-value products. The Panamax Index, which tracks maritime shipping rates, more than doubled in 2006. China has also devalued its currency from RMB8.30 to RMB7.80 per dollar. These factors are driving up the import price of crude and ground barite for drilling. In addition, in the USA, rail congestion and high fuel prices led to higher trucking rates, increasing the delivered cost of ground barite to oil customers. India is the second largest supplier of crude barite to the USA and world drilling market. It produces all of its barite from a single deposit in the Cuddapah region of Andhra Pradesh State. More than 90% of production comes from the State-owned Andhra Pradesh Mineral Development Corp., and the government continues to closely control production, export volumes, and prices. India saw a dramatic increase in barite prices as a result of its last 3-year tender in 2004. However, in 2004 and 2005 their shipments of crude barite to the USA were not significant. In 2005, India began supplying barite pulverized to meet API specifications to the Gulf Coast. In 2006, Indian production was reduced owing to severe flooding in November 2005 that curtailed mining until mid-April 2006. Morocco has been the third largest supplier of crude barite to the USA and world drilling market. In 2003 and 2004 their shipments of crude barite to the USA were not significant. In 2005, Morocco resumed shipment of crude barite to the Gulf Coast and began supplying barite ground to meet API specifications to the Gulf Coast.

"Due to recent coal bursts in Australian coalmines, research of coal bursts has attracted intensive interest from mining researchers and engineers worldwide. Previous research has shown that the sudden drop of fractal dimension may be a precursor of catastrophic failure of rock. This paper examines the fractal characteristics of temporal-spatial distribution of acoustic emission signals released during the compression loading process of coal. This research suggests the possibility of coal burst forecasting based on acoustic emission data. The concept and calculation equation of fractal dimension is introduced in this paper. Additionally, uniaxial compression experiments of Australian coal samples are conducted, and the acoustic emission waveform and 3D location are recorded simultaneously by eight sensors Express-8 AE monitoring equipment in the loading process. The experimental results indicate that the continued slowdown of fractal dimension in time sequence can be used as a precursory signal of coal sample brittle failure. The fractal dimension of the spatial distribution of acoustic emission events decreases with the evolution of coal fracturing.INTRODUCTIONCoal bursts refer to the catastrophic failure of overstressed coal subject to the dynamic and static loads. In recent years, coal bursts have occurred in major coal mining countries and this phenomenon has attracted the research interests of international mining and geotechnical scholars. A total of five coal burst accidents happened in Australian coalmines since 2014. On October 20, 2018, a coal burst occurred at Longyun Coalmine in China’s Shandong province, which led to 21 fatalities. Unfortunately, even after decades of research, it seems neither more accurate forecasting methods nor comprehensive controlling measures put forward by researchers have solved the problems posed by coal bursts.As an instantons energy releasing process, coal bursts are always associated with energy dissipation in the forms of acoustic emission, micro seismicity, and electromagnetic radiation (Yamada, Masuda, and Mizutani, 1989). It is believed by many researchers that the frequency–magnitude relationship of micro seismicity induced by rock failure satisfies Gutenberg-Richer relationship as well (Feng et al., 2017). Hence, based on the principal and theory of earthquake source locating, micro-seismicity monitoring equipment has been adopted in many coalmines to locate seismic event origins associated with coal and rock failure in an attempt to better forecast coal and rock bursts. Although many parameters such as b value (parameter of Gutenberg and Richter’s law) (Lu et al., 2015) have been adopted as indicators of risk, the forecasting of coal bursts is still of low accuracy. The same is true with earthquake prediction, as it remains as a worldwide problem even after decades of research and practice. Acoustic emission (AE) methods are now widely adopted to detect rock failure processes under an applied stress for application predicting the abrupt failure of rock in the laboratory (Li et al., 2017). Previous studies have found that significant overlap exists between research regarding AE and micro seismicity with respect to generation process (both are concerned with the generation and propagation of elastic wave) and event origin location, as geophysical signals of both are same (Lockner, 1993). That is, the frequency–magnitude relationship and early-warning indicators found by AE research in the laboratory have a potential applicability to in-field micro seismic monitoring of coal bursts. Through experimental study, Feng and Seto found that the temporal distribution of acoustic emission counts of rock have distinct fractal structures during load-increase processes (Feng and Seto, 1999). The US Bureau of Mines and the Santa Cruz Joint Venture (SCJV) are working on a production-scale, in situ copper recovery project in Arizona. The research is being conducted at the Santa Cruz site, located 11.2 km (7 miles) west of Casa Grande, AZ (Fig. 1). Santa Cruz is a 1.36-Gt (1.5 billion st) porphyry deposit averaging 0.6% Cu, of which 65% is oxidized, concealed beneath post-mineral alluvium at depths of 365-914 m (1500-3000 ft). The Bureau and the SCJV will evaluate in situ mining as a method for extracting copper from this previously unmined deposit. Research objectives of the Santa Cruz project are: - to demonstrate that an in situ research test can be operated in an environmentally acceptable manner ; and * to operate an in situ well pattern long enough to develop information on copper recovery and economic feasibility data. In situ mining of copper from undisturbed deposits has not been attempted commercially. There are several potential advantages with in situ mining: less exposure of miners to hazards, lower pital costs for the mine and plant and lower operating costs. In addition, there are no pits, dumps or tailings, which means less environmental impact.

Borates are essential to life, and to many products that are essential to an acceptable standard of living. They occur naturally in seawater at an average concentration of five milligrams of boron per liter. Fresh water lakes, rivers, streams and ground water generally have concentrations of about one milligram boron per liter. Borates are also present in soil at concentrations ranging from 0.1 to three milligrams of boron per kilogram. Because most of that boron is locked into insoluble minerals, clay or organic matter, boron deficiency is more widespread than boron enrichment. Borates evaporate into the atmosphere from seawater, rain, snow and hot springs. In rain and snow, natural boron concentrations range from 0.002 and 0.1 milligrams boron per liter. All told, boron moves through the atmosphere at a rate of 5 Mt to 7 Mt/a (5.5 million to 7.7 million stpy).

Pre-combustion coal cleaning and post-combustion flue gas desulfurization (FGD) using lime or limestone are the primary methods employed to reduce sulfur dioxide (SO2) emission from coal combustion. These processes generate voluminous pyrite and gypsum solid wastes that are usually landfilled, occupying thousands of acres of land and creating serious land and water pollution problems due to the release of acids and toxic substances. An integrated process has been developed for the combined utilization of gypsum and pyrite wastes by converting them into useful products including lime, sulfur, and direct reduced iron (DRI). The process includes four major steps. The first step is to concentrate pyrite from coal preparation tailings using flotation or gravity separation. The second is the thermal decomposition of pyrite into pyrrhotite and sulfur. This is followed by the reduction of pyrrhotite with carbon in the presence of lime to produce iron and calcium sulfide. The fourth step involves the reaction of calcium sulfide with gypsum to produce lime. The chemical reactions involved in the process were studied using thermogravimetric analysis (TGA) and X-ray diffraction (XRD)techniques. Process variables studied included reaction temperature, time, reactant composition, and purity of reactants.

The discovery that triggered the current gold rush in southeastern Peru was made in about 1975 along the Rio Madre de Dios in Madre de Dios Department (Fig. 1). About 5000 to 10,000 miners (called chichiqueros) were working in the area as of 1990. Placer mining is the principal source of revenue for people living along the Rio Inambari and west of Puerto Maldonado. As in past gold rushes, working and living condition are harsh. Supplies are expensive, and the area has poor access compared with other areas in Peru. Food, fuel and all mining supplies are trucked over dirt roads from Cuzco, a three-to-five-day trip (Fig. 1). Some material also comes from Brazil. Many placers have a similar life cycle, beginning with small-volume mining (surface or underground). At the end of this small-scale mining, the placer is exhausted or it has a sufficient volume of gravel high enough in gold grade to be worked by large-volume methods, which lead to exhaustion of the resource. The level of maturity of a placer can be determined from its gold grade. The amount of gold production from large-volume mining can be predicted, given detailed, cumulative gold-production data on placer deposits during small-scale mining (Bliss et al., 1987). Using this general model, the authors analyzed the placers in the Rio Madre de Dios area. Small-volume mining Most placer mining in the Rio Madre de Dios area is in alluvial deposits either in or bordering the major rivers. Locally, some placer mining is in terrace deposits above the rivers. All minerals (including the subsoil) in Peru belong to the state. However, a mining claim (denuncia) is easily obtained for mineral exploitation. It is separate from property ownership.

During the last twenty years computers have be-come widely used to assist with the simulation and design of large scale, primary ventilation systems. However, to date there are few computer programs available to help with the modeling of auxiliary ventilation in dead-end headings or tunnels. This paper presents the results of the first year of a research and programming study dedicated to the development of a user-friendly duct simulation tool. Included is a literature review that summarises publications on duct leakage and resistance, on previous programs developed for the simulation of airflow in ducts, and case studies on extended ductlines in mines and tunnels. The methodology behind the development of Ductsim, a Windows based simulation program is presented.

Tarkwa Gold Mine is located in south western Ghana, and is majority owned and operated by Gold Fields Ghana Limited. The Tarkwa CIL plant utilises a single low aspect 27' x 42' 14MW dual pinion drive SAG mill designed to mill 4.2mtpa (525tph). The plant was designed and constructed in a manner that would facilitate its expansion to 8.4mtpa (1,050tph). Since the plant was commissioned in September 2004, the SAG mill has consistently exceeded its nameplate throughput by up to 25%. Through the installation of a 26? x 36? 14MW dual pinion drive Ball mill along with additional upstream and downstream equipment, the plant will now be expanded to 12mtpa (1,500tph). This paper endeavours to outline the process and engineering design challenges along with the future construction challenges of the expansion in the midst of a fully operational plant.

Near misses recorded and reported by workers can provide awarenessto the potential causes of injury and prompt safety management initiatives. Although most companies require near-miss reporting, it is unclear what the value of these reports are, if any, and how they influence subsequent actions or controls to reduce on-the-job risks. Researchers at the National Institute for Occupational Safety and Health (NIOSH) conducted a case study with an aggregates company in which near-miss reports were analyzed at each of their locations over an entire quarter during the summer of 2018. Within that quarter, workers recorded 249 near misses. Of those, 167 were valid near misses that occurred at work. Researchers coded the reports using a qualitative 5 × 5 risk matrix. Of the 167 near misses, 19% were deemed low risk, 25% moderate risk, 30% high risk, and 26% critical risk. Several patterns in the near-miss incidents were documented, including classification of incidents and common corrective actions referenced (i.e., elimination/substitution, engineering control or redesign, work process/procedures, and personal protective equipment). The analysis provides insight into ways that risk communication and management programs can be improved to reengage workers and their situational awareness on the job.

The rheological properties of mineral suspensions affect the design and operation of transport, mixing, size classification, grinding, gravity concentration, flotation and de-watering systems. In many cases, the rheological properties can be modified to improve processing through the addition of chemical additives. These additives may be either organic or inorganic and generally affect the state of particle aggregation or dispersion. Inorganic modifiers act primarily by affecting the surface charge of mineral particles and thus control the magnitude of electrostatic attraction/repulsion between particles. The action of organic additives (polymers and surfactants) is a combination of electrostatic and steric forces – the latter being related to the molecular weight of these reagents. While low molecular weight polymers are dispersants (viscosity reducers), high molecular weight polymers are likely to induce flocculation and increase yield stress.

Introduction The Cove gold-silver deposit is located in Lander County, NV about 50 km (30 miles) southwest of Battle Mountain, NV (Fig. 1). The deposit is in the north-central part of the Fish Creek Mountains within the McCoy mining district. Gold was first discovered in the McCoy district in 1914 by Joseph H. McCoy (Vanderburg, 1939). From 1928 to the early 1930s, minor production occurred from shallow underground workings. Total gold production was less than 311 kg (10,000 oz; Stager, 1977). The district was inactive until the mid-1960s when it was explored by Bear Creek Mining, Summa Corp., Houston Oil and Minerals Corp., Gold Fields, and Tenneco Minerals. Tenneco began a detailed reevaluation of the McCoy deposit in the fall of 1984. Tenneco's decision to place the deposit into production was based on a geological reserve of 8.7 t (280,000 oz) of gold (Kuyper, 1987). Subsequent exploration and development drilling of the McCoy skarn deposit has more than doubled the mineable skarn reserves to 19 t (615,000 oz) of gold. In September 1985, Tenneco began development work on the McCoy gold-skarn deposit. The project is an open-pit, heap leach mine. The first gold was poured in April 1986. Echo Bay Mines acquired Tenneco's precious metals properties in October 1986. The mining operation and district exploration started by Tenneco is continuing under the Echo Bay's ownership. The Cove deposit was discovered in January 1987 and production began in February 1988. The deposit will begin as an open-pit, heap leach operation. It will be converted into an open-pit and underground mine with a 9-kt (10,000-stpd) mill. Geologic setting The Cove gold-silver deposit is situated on the east flank of the Fish Creek Range. Surface elevations range from 1460 to 1680 m (4800 to 5500 ft). The deposit is 1.6 km (1 mile) northeast of the McCoy gold-skarn deposit. The Cove deposit is hosted by the Augusta Sequence of Triassic age. Three formations of the sequence are mineralized at the Cove. In ascending order they are the Favret, Panther Canyon, and Augusta Mountain formations. The Favret formation is a gray, locally silty limestone that is commonly fossiliferous. The base of the formation is not exposed. Exposed and drilled intervals are more than 60 m (200 ft) thick. Conformably overlying the Favret formation is the Panther Canyon formation. This formation is 215 m (700 ft) thick and consists of a siliclastic and carbonate sequence of conglomerate, quartzite (sandstone), mudstone, limestone, and dolomite. It is a distinctly coarsening-upward sequence of rocks. The top of the unit is conglomerate with chert and quartzite clasts up to 150 mm-diam (6 in.-diam). The Augusta Mountain forma-

INTRODUCTION Tunnels are commonly constructed in the very weak St. Peter sandstone in the Twin Cities area of Minnesota. Historically, core recovery in this weak sandstone was very small in the critical weaker strata resulting in little preconstruction information on the ground conditions. Improved core recovery techniques have been utilized for recent projects, allowing rock quality rating methods to be developed for the recovered core. Down-the-hole tests, and the use of combination ratings between different types of core data provide for more detailed characterization of ground conditions. THE ST. PETER SANDSTONE The 45 m thick St. Peter is an unusually pure quartz sandstone. It underlies all the Twin Cities area, except where it has been eroded by the present day Mississippi River or by pre-glacial rivers. It forms conspicuous steep bluffs along the Mississippi River where the upper Platteville limestone formation protects it from erosion. Where the Platteville formation is missing, the sandstone slopes are often more gentle. Natural case hardening of the exposed sandstone bluffs often forms a resistant crust and reduces sloughing. This case-hardened surface is not representative of the sandstone back from the bluff.

The fluidized solids technique for the calcination of phosphate rock has been well established for over 10 years. This paper is intended to review the recent performance of many of the Dorr-Oliver FluoSolids* calciners. In addition, design features of these three compartment refrac¬tory construction reactors will be described and a comparison made with fuel requirements for single compartment calcination. Also presented will be certain, aspects of the use of the rock including a discussion of non sulfate sulfur in the rock. A system is described for producing a blended mixture of calcined and uncalcined rock.

"Hard rock mines move large volumes of material, which can cause the conveyors that are essential to this movement to suffer lots of problems, including carryback, spillage, dust and belt wander. Many of these issues are created at the transfer points where the belts are loaded.This article provides an overview of the latest transfer point systems that incorporate safety and serviceability by design as well as a report on recent projects. One project is the Conveyor B Transfer at the Coeur Rochester silver mine near Lovelock, NV. Here, performance was improved with the installation of belt support cradles, engineered chute walls with external wear liner, and a compact dust collector. A second project is the improvement of belt support idlers and skirtboard sealing in a long loading zone of a conveyor under the concentrator at an Arizona copper mine.The importance of transfer pointsConveyors are essential in mine material handling. Their performance will often make the difference in mine productivity and profitability. A key to conveyor performance is the transfer points where the conveyor belt is loaded and discharges. At these transfer points, many of the problems encountered with the conveyor system are created.The problems that arise at the transfer stations include off-center and segregated loading, mistracking, blockages and plugging. And there are a variety of problems originating with fugitive material — cargo released in the form of carryback, spillage or airborne dust — that are created or exacerbated in the transfer points. These fugitive materials turn into other conveyor-related problems, including shortened component life, unplanned outages for conveyor maintenance, unexpectedly high labor costs for maintenance and cleanup, worker health and safety problems and issues with community relations. Introduction The Surface Mining Control and Reclamation Act was passed in 1977 to put an end to the uneven environmental standards and enforcement established by various coal mining states in the US. One year after passage, the Secretary of Interior was directed to promulgate permanent program regulations implementing Title V provisions of the Act. These regulations were to form the basis for state regulatory programs under the Act and to allow states to assume primary regulatory responsibility. To implement the underground mining provision of the Act, the Secretary is directed in section 516(a) of the Act to promulgate rules. But they must take into consideration the differences between surface and underground coal mining. The regulations developed by the Secretary in 1979, with respect to subsidence control, included: • a subsidence control plan as part of the permitting process; • substantive provisions establishing performance standards for subsidence control; and • provisions providing for the prohibition of mining under perennial streams, impoundments larger than 24.6 dam3 (20 acre ft), and certain public facilities and urban areas. Industry challenged the Secretary's regulations implementing the subsidence control provisions. The litigation was consolidated with all other challenges to the permanent program regulations. (Permanent Surface Mining Regulation Litigation, Civil Action No. 79-1144; D. D.C., May 16, 1980.) In two opinions dealing with the multitude of issues raised by both industry and environmental groups, the US District Court of the District of Columbia ruled against industry. It upheld the promulgated subsidence control provisions. The US Court of Appeals stayed the appeals pending the agency's review and revision of its regulations. The regulatory reform was conducted in accordance with the order from the Secretary of Interior and the President in 1981. As a result, the subsidence control regulation was revised, reproposed, and finalized in June 1983 (Federal Register). This regulation, along with others, was again challenged by environmental groups and industry. On Oct. 1, 1984, the court, after finding the Secretary's reading of the Act reasonable, upheld the 1983 subsidence regulation except for one section. On Feb. 21, 1985, in accordance with the court's ruling, the Office of Surface Mining (OSM) suspended a portion of 30 CFR 817.121 (c)(2) concerning the damage correction requirement for structures or facilities and reproposed it on July 8, 1985 (Federal Register). In conjunction with a request for public comments, OSM now also seeks comments on the omission from the 1983 rule of the requirement in the 1979 rule regarding a presubsidence survey and monitoring of damage to structures. Technical issues related to subsidence regulations The subsidence regulations of June 1, 1983, consist mainly of two parts: a subsidence control plan as part of the permitting process; and substantive provisions establishing performance standards.
