THE object of taxation is the raising of a revenue. Unless a tax accomplishes this, it is a failure. The right to take for public purposes a part of the moneys obtained from the carrying on of private enterprises is an attribute possessed only by a lawful government, and may indeed he called the supreme attribute of government. In free, democratic communities this power must of necessity rest upon the consent of the governed. Power implies obligation, hence it is obviously the duty of a government, in framing a system of taxation, to provide one which, while effective in producing a revenue, is also just and impartial. It will be conceded that mines and mining property ought to bear a fair share of the public expenditure. The question is, upon what basis taxation should proceed. Two separate taxing principles are usually contended for: Taxation should be proportionate to the benefits received by the person or property taxed; taxation should be based on ability to pay. A third is sometimes added, taxation should have reference to the extent and value of the natural resources enjoyed. As applied to mining taxation, it is pointed out by those who support the first mentioned basis that, mines being usually situated in rocky and hence sparsely peopled regions, mining companies are frequently obliged to construct roads, railways, telegraph and telephone lines, schools, water and sewerage systems, and many other amenities and conveniences of civilization, the cost of which in regions better suited for agriculture and consequently more thickly populated, has either been defrayed locally, or can be spread over a sufficiently large taxable group of people to materially lighten the financial burden on the mine. The mining com¬pany, it is argued, having made these outlays, should receive credit for, them and be relieved of taxation to a corresponding extent. There may be some force in this contention, but the situation is capable of relief without attempting to place taxation upon so unworkable a basis as the value of benefits received. Who is to be the judge of these benefits, and how are they to be valued? The very existence of a mining company and its ability to carry on business in peace and security, depend on the prevalence of law and order, which is a result of good government. "This presentation will provide an overview and understanding of Mine Safety and Health Administration (MSHA) and Ontario Regulations for Mines and Mining Plants. It includes discussions on the history and practical development of the standards and an overview of engineering best practices from a construction, maintenance and operational viewpoint. INTRODUCTION Ontario is one of the safest mining jurisdictions in the world and has some of the most comprehensive regulations for the construction, operation and maintenance of a mine. In the USA, several operators have adopted some or all of the practices prescribed by the Ontario Regulations as an internal procedure. Experience has demonstrated that these plants are indicating less unplanned downtime and fewer issues with MSHA inspectors in their hoist plants. HISTORY AND THE REGULATIONS Both Canada and the USA have had some form of laws governing the operation of mines since the late 1890s. The paths of legislation have run in reasonably parallel lines, continually improving the health and safety conditions in the mining industry. Ontario Mine Health and Safety In the 1970s the accident rates in mining were higher than any other industrial sector; this prompted a Royal Commission on the Health and Safety of Workers in Mines (the Ham Report). The recommendations of this report, published in 1976, generated several changes in the regulations regarding worker safety in mines. Following the release of the Ham report, the Occupational Health and Safety Act (OHS) was passed by the Legislature in 1978. The Act is a set of comprehensive laws governing almost all Ontario workplaces, and it replaced separate laws governing different industrial sectors. OHS is enforced by the Ministry of Labour (MOL), and this discussion will focus specifically on Ontario’s Occupational Health and Safety Act, R.R.O. 1990, Regulation 854, Mines and Mining Plants, Part X Mine Hoisting Plant (Ontario Regulations). USA Mine Health and Safety A coal mine explosion in West Virginia and medical studies on occupational disease led to the 1969 Federal Coal Mine Health and Safety Act (Coal Act). The Coal Act was the most comprehensive and stringent Federal legislation governing the mining industry to date. The Mining Enforcement and Safety Administration (MESA) was formed, following the 1973 Act, as a new departmental agency to assume the enforcement of safety and health in mines. The Federal Mine Safety and Health Act of 1977 (Mine Act) transferred enforcement responsibilities from the Department of the Interior to the Department of Labor and named the new agency the Mine Safety and Health Administration (MSHA). This agency enforces the Code of Federal Regulations (CFR), and this discussion refers to CFR Title 30 Mineral Resources, Chapter I Mine Safety and Health Administration, Department of Labor, Subchapter K—Metal and Non-metal Mine Safety and Health (MSHA)."

"INTRODUCTION Brutally honest mining executives will tell you that “safety is job #1 but.. dollars are also extremely important”. When economic times are tough, as they are now in mining, it can feel like you need to choose between safety and cost control. Leading edge companies know that it is excellence at both that provides the best performance. FLUID POWER SYSTEMS Fluid power systems are ubiquitous in mining – longwall systems, continuous miners, drills, haul trucks and excavators, etc. And fluid power systems are getting more powerful and using higher pressures to move greater volumes and achieve higher productivity. Average operating pressures in mobile equipment has been rising to 450 bar (6,500 psi) over the last decade. With increased system pressure comes ever increasing levels of stored energy. Stored energy that, if released in an uncontrolled fashion, can do tremendous harm to people and things.Fluid power systems are composed of pipe, flexible hoses, pumps, valves and actuators. They are filled with fluid (mineral oil or fire-resistant) to transmit power to where it’s needed for performing work. With time and use fittings can loosen, component performance diminishes and hoses wear and tear. In hostile environments, like coal mining, hydraulic hoses can fail in as little as 2 years according to DGUV (umbrella association of German Accident Insurers), maybe sooner in some particularly challenging environments. FLUID POWER SYSTEM SAFETY While appearing simple and benign on the surface, fluid power systems, particularly such systems on mobile equipment, have many potential hazards. Hazards that most workers aren’t aware of – particularly young, new hires. And those hazards that can quickly turn deadly. During the past couple of years, including at last year’s SME Conference, I talked to a wide variety of mining people about high pressure fluid injection injuries. Some people, often with little or no field experience, never heard of it. But, people with mine operations / maintenance experience were almost always aware of such injuries.Some had even seen it happen right in front of them. But most claimed it didn’t happen all that often. It just wasn’t seen as a problem!"

A fairly recent development in the field of particle separation is now under investigation to determine its value to the mining industry. The method employed is probability sizing through a vibrating network of decreasing screen openings. While probability sizing as such is not new, the possibility of using it for coarse, highly abrasive ores at high tonnage rates has only recently appeared to merit practical consideration. The advantages to be gained by the use of probability sizing vs. conventional screening methods are: reduced space requirements for a high capacity unit, fewer moving parts, more versatile product sizing selection, reduced maintenance requirements and lower power consumption.

The rheology artificial mixtures of bitumen with fine quartz of varying bitumen content, as well as actual oil sand ores, was investigated under different physicochemical conditions (pH, temperature). All rheological measurements were conducted using a Haake Rotovisco VT550 rotational viscometer, connected to a fixture specifically designed to measure properties of settling suspensions. It was found that at low bitumen contents (1 %, wt.) the pH of the slurries was the most important parameter that controlled the rheology of quartz-bitumen slurries. At higher bitumen contents (10%, wt.), it was a combination of high temperature and high pH that gave the lowest apparent viscosities and yield stresses of the model mixtures. These model observations correlated well with the rheology data obtained for slurries of actual oil sand ores. The overall results were discussed in terms of aggregation-dispersion phenomena between bitumen and mineral particles.

A fast-flow reactor mass spectrometer has been utilized to investigate the reactions of gas-phase gold cluster anions with CO and oxygen. Addition of CO to Aun - produces species of the form Au(CO)m -, where m = 2-5. However, CO does not bind to Au2 - or Au3 -. With oxygen addition in the cluster source, gold oxide species with both molecular and atomized oxygen are produced. The addition of carbon monoxide to these preoxidized gold cluster anions reveals that select species with 1, 2, and 3 gold atoms participate in the oxidation reaction to produce CO2. Bimolecular rate constants for the reactions between these species and CO are also discussed.

ALTHOUGH the United States has long led all other countries in both the production and consumption of mineral products, the trend seems definitely toward an increasing dependence upon foreign sources of supply. This is not to take the position that we are either a have or a have-not nation. For years we shall continue to secure a large proportion of our needed minerals: from our own mines, but we must face the fact that this century has seen "a more thorough and intense development of the mineral resources of the United States and a greater depletion of its irreplaceable mineral reserves than has occurred in most other countries. An audit of our mineral production given in the attached charts discloses the extent of our deficiencies. Because of these facts, low-cost foreign sources offer a promising field for the investment of a portion of our mining capital and an opportunity to obtain for the United States a greater supply of strategic metals and minerals. How. ever, to reach this end, the industrialist investing in the foreign field must have the full co-operation and strong backing of the Federal Government and the involved Federal agencies.

Surface subsidence monitoring is the most effective means for investigating the nature of, and developing the techniques for predicting, the surface movement and deformation process. However, because of imperfection in survey equipment and field practices, the surface movement data collected from field survey are not error-free. Also due to lack of proper numerical techniques for computing surface deformation from the measured surface movement data, a relatively large portion of the subsidence data collected could not provide more information other than surface movement. In this paper, the sources and magnitude of errors in the measured surface movements and calculated surface deformation are discussed. Techniques for improving the accuracy of the calculated deformation indices (i.e., slope, strain, and curvature) are developed. The proposed techniques include: (1) proper selection of monument spacing for subsidence monitoring; (2) a data smoothing technique for data pre-processing; and (3) a number of numerical methods and/or procedures for calculating surface deformation indices from the measured surface movement data.

ARTHUR KNAPP, Ardmore, Pa. (communication to the Secretary*).¬On p. 2275 I find a quotation from Mr. Thompson regarding the fountains of the Baku field. I have seen a large number of these gushers or fountains. In every case where unusual amounts of sand were produced the wells caved in and shut off in a few clays and were an absolute loss Very often the formation had caved so far up as to allow the water to enter the oil strata, and not only was the well lost but the ground for many acres around the well was useless for drilling purposes because the disturbed ground had allowed the gas and oil to dissipate and the water to enter. On p. 2268, Mr. Thompson is again quoted regarding the Balakhany field. If the text is consulted further, it will be found that the oil at Balakhany is heavy only in contradistinction to the Bibi Eibat, field. The gravity of the oil at Balakhany is from 28 to 32. Also, it must be noted that the illustration is taken from the conditions in the older part of the field. This field was first chilled 40 years ago, and was a worn-out field 15 years ago. The wells which produce sand are wells in which the casings are practically gone and the formations are full of water. The sand must be bailed from these wells because the clays from the upper stratum have caved into the wells and are obstructing the passage of oil. On p. 2262 is the statement that the Russian wells cannot be pumped on account of the large amounts of free sand produced. They have never tried pumping in the Baku field to any extent. Wherever tried, it has proven a great success. If we take the author's theories as correct and wish to put them into practice, it would first be necessary to consider a few figures. Let us assume that we produce oil and sand together in the proportion in which they exist in the productive strata. It is not uncommon to have wells in the California field which are not gushers, but which, by pumping, produce 1,000 bbl. per clay the first 100 clays.

ENGINEERS from industrialized countries are frequently called upon to examine mining operations in primitive areas and make recommendations regarding mechanization and modernization. They often set forth with self-confidence, knowing full well that all that is needed is their experience and several shiploads of mining machinery, and at times they mentally provide the answers before the problems have been clearly stated. In primitive areas it is absolutely essential that the examining engineer spend enough time at the site to acquire a thorough understanding of what is being done now and why it is done the way it is. The objective here is to state in simple terms some of the problems that may be encountered, in- as much as solutions, if they can be found at all, will differ with each experience.

THOUGH the flotation of gold ores has come into the lime- light largely in recent years, it is not a product of recent economic conditions but rather as old as flotation itself. It could hardly be other- wise, since gold, when in the right state of comminution and surface condition, is one of the more readily floated of minerals. In early practice it was not generally recognized that gold was floated as well; it was - thought that the gold was bound up with sulphide minerals that floated, but now we know that free gold must have been floated as well.

An experimental procedure was developed for studying magnetic roasting on a accurately-controlled laboratory scale. The loss-in-weight method was used and the course of reduction could be followed under a reducing gas atmosphere containing as many as five different components. Some important variables of the operation were checked on a marginal Mesabi iron ore containing porous and dense varieties of hematite as well as pure goethite. The conditions simulated were those for the grate roasting of a coarsely-sized ore burden. Temperature was maintained at 600°C; gas composition at 4.25% CO, 4.25% H2, 17.0% CO2, 15.0% H20, and 59.5% N2,, and gas flow rate at about 1,5 lineal feet per minute. The ore charge was composed of quarter-inch cubes. Under these conditions, the ore porosity was found to be one of the governing variables of the operation. Results showed that an ore size limitation existed as a function of this ore porosity. For efficient magnetic conversion, the size limit was 3/8 inch for very porous ores and about 65 mesh for very dense ores. An anomaly was noted in the weight losses incurred during actual magnetic conversion. For goethitic ores, these were generally about 13 per cent higher than could be accounted for theoretically. The effect was attributed to possible non-stoichiometric structures forming during the reduction process.

IT is with particular pleasure that I welcome the members of the Open-hearth Conference of the I American Institute of Mining and Metallurgical Engineers to this meeting, as I feel this is one of the most useful activities of the Institute in the field of ferrous metallurgy. For the information of our other members I might say the Open-hearth Conference was organized by Mr. Reynders when he was president, and is made up of open-hearth superintendents and metallurgists. All the plants are invited to send representatives, and practically all do, with the exception of the U. S. Steel Corporation. It meets twice a year to discuss various problems in connection with the manufacture of steel, and its minutes are published for the benefit of those attending, the expense being defrayed by the participating companies. This conference, .1 believe, should be a model for activities in the other branches of the work covered by this Institute. It works, not by reading formal papers, which we all know is not a very satisfactory method to bring out the experience of others, but rather by a round-table method of discussion. The spirit of the meetings is such that each member feels perfectly free to state his experience, and he gets as much as he gives. A series of topics for, discussion is brought to the attention of the chairman and after one is exhausted the next point is taken up. In this way there is a real interchange of ideas and experiences which cannot fail l to be of the greatest benefit to those attending. That these meetings are beneficial is evidenced by the "continued growing attendance and lively discussions at these half-yearly meetings.

AS is well known, there are large and valuable deposits of coal in British Columbia, both on the mainland and on Vancouver island. These deposits are widely distributed over the Province. The chief sources of supply on the mainland are found in the Fernie and Princeton-Nicola districts and on Vancouver island in the Comox and Nanaimo districts. The coals range from a very high quality bituminous coal to lignite. On the Upper Skeena river there is said to be a very large deposit of anthracite or semi-anthracite, but this field has not been developed. Coal was first discovered in British Columbia on the north end of Vancouver island in the year 1835, but it was not until 1852 that coal mining was seriously undertaken by the Hudson's Bay Company at Nanaimo, where mining has been carried on continuously ever since that date. The production of coal in the Province continued to increase until the year 1910, when the annual output reached its peak at 3,100,000 tons and a total of 7,800 men were employed in the industry. Since 1910, the production has dropped steadily until, in 1934, only 1,347,000 tons of coal were produced and less than 3,000 men were employed. This continued decrease in production has in no way been caused by lack of coal reserves. It has been due entirely to curtailment of markets. I do not propose to discuss coal mining practice in British Columbia, where we have all sorts of mining conditions, including submarine mining. There is no lack of coal supplies for either industrial or domestic purposes, nor is there likely to be any shortage of coal in the Province for many generations. We have our mining troubles, which increase the cost of production, but there are no insuperable difficulties to prevent the extraction of a large and increasing supply of coal. Our main difficulty-in fact our only serious difficulty-is to find a market for our output, and we must consider means which can be evolved not only to conserve our existing markets but also to expand them, at any rate within the boundaries of Canada. I will therefore confine my remarks chiefly to the all-important factor of Markets for our coal.

Recently there has been much discussion of the use of pipelines for the long-distance transportation of solids. Many have come to recognize the economies inherent in pipeline transportation. The widespread movement of oil and gas at astonishingly low costs - a gallon of oil moves from Montana to New York for less than that for the delivery of a postcard - has spurred others to sturdy this mode of transportation. Most interested people are aware of the inherent advantages of pipelines - continuity and reliability of operations - low manpower requirements per ton mile - moderate capital costs per ton mile - low maintenance costs per ton mile - low operating costs per ton mile.

THE PETROLEUM DIVISION of the A.I.M.E. continued with its diversified activities during 1.935. Sessions at the New York meeting in February were devoted to production engineering, domestic and foreign oil production, and petroleum economics. The symposiums on domestic and foreign production proved their increased usefulness. The data accumulated for 1935 were added to those published during prior years in "Petroleum Development and Technology." A joint session on the use of metals in the petroleum industry was held by the Institute of Metals, Iron and Steel, and Petroleum Divisions. W. S. Farish, chairman of the board of the Standard Oil Co. (N. J.), was the principal speaker at the annual dinner. The October meeting, held in Hous¬ton, was characterized by an excellent program and large attendance. Four sessions were devoted to problems in estimating reserves, reservoir energy, properties of drilling muds, electrical logging, water flooding, and other subsurface studies. Foreign representatives of the Anglo-Persian Oil Co. presented a paper on surface tension and specific gravity of crude oil under reservoir conditions. The Crewstation Analysis Programs (CAP) is a package of computer programs that can be used to analyze some human engineering aspects of crewstation design (such as visibility and illumination) that have particular significance in underground mining. It was developed under the U. S. Bureau of Mines (USBM) Health, Safety and Mining Technology program at the Pittsburgh Research Center, Pittsburgh, PA. This manual describes the steps necessary to collect data in the laboratory to develop luminaire profiles for the CAP illumination analysis. It also describes how the CAP Illumination Model calculates illumination. 1.1 How CAP Calculates Illumination 1.1.1 Background -CAP currently includes assessments of visibility and illumination in the surrounding work area. The advantage of using computers for these types of analyses is that many design iterations can be tested quickly and efficiently to learn the effects of changes. This reduces the need for expensive testing using physical mockups. Another advantage is that design ideas can be tested in situations where it would not normally be possible. For instance, the effects of modifications to a lighting system or canopy design on visibility could be tested while the machine remains in service.
