Although the conventional acid-reductive leaching method effectively extracts copper (Cu) and cobalt (Co) from Cu–Co oxide ores, efforts to enhance hydrometallurgical performance are ongoing. This study evaluates the influence of sulphuric acid (H2SO4) and sodium metabisulphite (Na2S2O5) on metal extraction from Zebesha Cu–Co oxide ore using ferrous sulphate heptahydrate (FeSO4·7H2O) and ferric sulphate (Fe2(SO4)3) as lixiviants. Ore samples (<150 μm) were leached at ambient temperature for two hours, and metal concentrations were determined via X-ray fluorescence analysis. In the FeSO4·7H2O system, Co, Mn, and Ni recoveries increased w=ith Na2S2O5 concentration, reaching a maximum of approximately 80% Co at 150 kg/t, while Cu recovery remained below 5%. Conversely, with Fe2(SO4)3, Cu recovery peaked at 88% at 50 kg/t Na2S2O5, then declined to 79% at 150 kg/t. The addition of H2SO4 improved metal recoveries in both systems. Notably, 60 kg/t H2SO4 yielded 92% Cu extraction in Fe2(SO4)3, while Co, Ni, and Mn remained below 40%. However, in FeSO4·7H2O, Co recovery improved from 40% to 84%. These findings suggest Na2S2O5 is more effective for cobalt extraction with FeSO4·7H2O, whereas H2SO4 enhances copper extraction in Fe2(SO4)3.

The presence of dust and fume suspended in the freeboard region is a common feature of the operation of direct current (DC) plasma smelting furnaces. This occurs primarily as a result of the use of fine feed materials together with the open-arc, open-bath operation of such smelters, and is exacerbated by the high velocities and turbulent mixing of the gas in the vicinity of the arc jet. Dust and fume losses into the furnace off-gas system can be significant in some cases and may have economic, operational, and environmental impacts on the process. A computational modelling study is presented in which the concentration of dust material was considered as a continuous field subject to a governing partial differential equation. Settling behaviour was calculated as a function of particle size, local gas/plasma temperature, and other physical properties. Development of the coupling between the concentration field and a magneto-hydrodynamic description of the arc is shown, and the resulting models were used to compute various aspects of the behaviour of the concentration field in the arc region for a variety of furnace conditions. Time-averaged as well as transient models of the arc were used to generate the results presented. Qualitative case studies produced several practical suggestions for furnace operation, including increased dust capture by the bath when feed ports are located closer to the electrode, and the possible effects of feed segregation in the furnace freeboard based on dust particle size and density.

"SynopsisA number of important areas in nuclear fuel cycle, at both the front end and back end, offer ideal opportunities for the application of non-destructive evaluation techniques. These techniques do not only provide opportunities for non-invasive testing of e.g. irradiated materials, but also play an important role in the development of new materials in the nuclear sector. The advantage of penetrating radiation used as probe in the investigation and testing of nuclear materials makes X-ray and neutron radiography (2D) and tomography (3D) suitable for various applications in the total nuclear fuel cycle. The unique and different interaction modes of the two radiation probes with materials provide several opportunities. Their complementary nature and non-destructive character makes them most suitable for nuclear material analyses, analytical method development, and the evaluation of the performance of existing nuclear material compositions. This article gives an overview of the X-ray and neutron radiography/tomography applications in the field of nuclear material testing, and highlights a few of the success stories. Several selected areas of application in the nuclear fuel cycle are discussed to illustrate the complementary nature of these techniques as applied to nuclear materials.IntroductionDuring the development of new materials for the nuclear industry, materials testing and characterization are of the outmost importance to maintain safety standards and reliability. No compromise on safety in the workplace in any area within the total nuclear fuel cycle can be tolerated, and therefore most in-situ material characterization and testing is conducted by certified and qualified personnel schooled in destructive and non-destructive testing (DT and NDT) methods. Certification and qualification in NDT can be obtained through many training centres in South Africa in accordance with European, American, and other international standards (SGS, n.d.; SAIW, n.d.; African NTD Centre, n.d.)."

Scandium is an important industrial metal for which demand is projected to increase in the future. Although many Sc deposits are secondary, Sc is scavenged by clinopyroxene during fractional crystallization of primary, mafic-ultramafic magmas. Sc may thus occur in sub-economic concentrations in mafic-ultramafic intrusions. In this work, we present new data on the concentration of Sc in the Bushveld Complex (BC) of South Africa. The eastern and western limbs of the BC are considered to be largely pristine, primary magmatic deposits, whereas the northern limb shows evidence of largescale, localized crustal contamination. Samples from the primary magmatic cumulates of the eastern limb, from the mineralized Flatreef of the northern limb, and from the crustal-contaminated Footwall Assimilation Zone (FAZ) of the Flatreef were analysed for Sc. Despite the FAZ containing abundant clinopyroxene, interpreted to have recrystallized from the original cumulates in the presence of melted sedimentary rocks, no significant differences are seen in the concentration of Sc compared to other cumulate rocks of the BC containing less-abundant clinopyroxene. The concentration of Sc in the analysed samples is mainly controlled by mineralogy, with anorthosites, chromitites, and harzburgites containing under 20 ppm, and norites and pyroxenites containing 20–40 ppm. The parapyroxenites of the FAZ are less enriched in Sc than expected, suggesting that Sc may have been lost during alteration and recrystallization.

Mine stope is typically backfilled with cemented paste backfill, which provides a regional underground stability and also a reduction of aboveground tailings accumulation. During backfilling, a phenomenon known as arching occurs and affects the stress distribution of the cemented paste backfill. The change in temperature due to uncontrolled heat transfer from the surrounding rock mass and/or generation from hydration process complicates the stress distribution development of cemented paste backfill. This paper presents results of the investigation on the effects of hydration to cemented paste backfill behaviour when backfilled into a narrow wall model using uncemented paste backfill as controlled sample. The parameters considered include backfill type (cemented paste backfill vs uncemented paste backfill), curing temperature (30°C–60°C), and stress evolution during pouring, consolidation, and curing stages. Results show that uncemented paste backfill re-establishes arching effects more readily, with lower peak stresses and greater stress relaxation than cemented paste backfill, of which its behaviour is significantly influenced by hydration under elevated temperatures. The main outcome of this work is that hydration critically controls the stress-temperature response of cemented paste backfill, and the balance between hydration-driven strength gain and stress relaxation can be leveraged to optimise backfill mix design for safer and more efficient stope filling.

"Physical and numerical modelling methods were followed to identify mechanism(s) for tundish slag entrainment in a bare tundish and one with a flow control device (FCD).The physical and numerical models made use of water and paraffin to model steel and slag respectively. Observations from the physical model showed that the steel-slag interface remains immobile in both cases. Entrained paraffin formed droplets approximately 1 mm in diameter. Results from both models (numerical and physical) showed that in both cases (bare and FCD case), areas of high entrained slag concentration exist near the inlet region. The entrained slag concentration decreases towards the tundish endwalls.Flow patterns and velocities tangential to the steel-slag interface from the numerical model showed that slag entrainment in both the bare tundish and tundish with a FCD possibly takes place via two mechanisms. First, the slag moves across the steel-slag interface via mass transfer; secondly small velocities tangential to the interface at depths greater than 10 mm below the interface carry the already ‘entrained’ slag into the bulk steel phase. These tangential flow patterns are dominant in the inlet region, hence the high concentration of entrained slag in this region. IntroductionThe tundish serves as the last metallurgical vessel through which steel passes before solidifying in the moulds. It is in the tundish that the last traces of non-metallic inclusions should be removed, otherwise the inclusions carry over to the moulds and cause defects in the steel product. In the tundish, the slag is less dense than the melt and thus resides on the top of the melt. The slag provides a sink into which the non-metallic inclusions float to and dissolve. The slag also protects the melt from air and heat loss. However, when slag is entrained in the melt as a result of increased turbulence or shearing at the steel-slag interface, slag can become a source of nonmetallic inclusions.Numerous studies on flow patterns in the tundish have been carried out since the introduction of the tundish. It highlights the limitations of traditional technology adoption models, such as the Technology Acceptance Model (TAM), Diffusion of Innovations (DOI), and Unified Theory of Acceptance and Use of Technology (UTAUT), which focus on individual factors and overlook the strategic and organizational roles of leadership. The study proposes the Ambidextrous Leadership-Technology Adoption (ALTA) model, which integrates leadership styles such as transformational, transactional, adaptive, and ambidextrous leadership into the technology adoption process. The model emphasizes the balance between exploration (fostering innovation) and exploitation (ensuring operational efficiency). The findings suggest that transformational leadership fosters innovation by encouraging risk-taking and creativity, while transactional leadership ensures efficient technology integration. In this paper we develop a physics-based model for lining erosion in steel ladles. The model predicts the temperature evolution in the liquid slag, steel, refractory bricks, and outer steel shell of the ladle. The flow of slag and steel is due to forced convection induced by inert gas injection, vacuum treatment (extreme bubble expansion), natural convection, and waves caused by the gas stirring. The lining erosion takes place by dissolution of refractory elements into the steel or slag. The mass and heat transfer coefficients inside the ladle during gas stirring are modelled based on wall functions which take the distribution of wall shear velocities as a critical input. The wall shear velocities are obtained from computational fluid dynamics (CFD) simulations for a sample of scenarios, spanning out the operational space, and a model is developed using curve fitting. The model is capable of reproducing both thermal and erosion evolution well. Deviations between model predictions and industrial data are discussed. The model is fast and has been tested successfully in a ‘semi-online’ application. The model source code is available to the public at [https://github.com/SINTEF/refractorywear].

BEEDON AND C. J. JONKER* Dr Bleloch&apos;s paper has outlined the advantages of recycling stack-gas of low nitrogen content in the blast furnace. In the first instance it would appear to be extremely beneficial in controlling the hearth temperature and allowing a 100 per cent oxygen-blast to be used. On a second point however we have to disagree. It is claimed that heat is liberated in the combustion zones by the oxidation of CO to CO2 near the tuyeres and in the subsequent reduction of the CO2 by CO. The author has hypothesized as follows, and we quote: &apos;The C+CO2=2 CO reaction in the outer combustion zone at about 1 700°C is no longer endothermic due to loss of stability of CO2 and its consequent dissociation into CO and free oxygen.&apos; This statement requires closer examination. If we consider the individual events occurring with the CO in the recycled topgas, with the oxygen in the blast and with the coke in the burden, as done by Dr Bleloch, the following heat considerations emerge. All heats of reaction are calculated from the enthalpy values of each reactant and product, as well as the temperature dependence of their molar heat capacities. (a) At the tuyeres: CO+1/2 O2-+CO2 . . . . . (1) CO, CO2 at 500°C; O2 at 25°C. ?H reaction = -65 000 cals/mole CO The reaction (1) is exothermic. (b) In the outer combustion zone: CO2+C?2 CO . . . . . . . . (2) C, CO at 1 700°C; CO2 at 500 0C. ?H reaction = -56 000 cals/mole CO Reaction (2) is endothermic. The overall heat gain of reactions (1) and (2) is ?H=+56 000 - 65 000= -9000 cals/mole CO i.e. the overall reaction is slightly exothermic, the amount of heat liberated is however smaller than suggested by Dr Bleloch. (c) The dissociation CO2+CO+1/2 O2 . . . . . (3) is a highly endothermic reaction at 1 700 0C, requiring 82 000 cals/mole CO2 to proceed to completion. Furthermore, this reaction (3) is energetically not favoured to proceed, as can be observed from the free energy-temperature relationship of figure (3), which favours the formation of CO2 at 1 700 0C. Hence direct dissociation of CO2 at 1 700 0C appears to be unlikely.* The concept of recycling topgas is however still intriguing from many other points of view. Apart from providing a very efficient method of hearth temperature control, it will create a much higher CO partial pressure in the stack. Sy Edele Dr de Wet het geen bekendstelling nodig nie-alhoewel hy ons minister vir slegs die afgelope twee jaar is, het hy reeds talle funksies van ons Mynbedryf bygewoon en het baie vriende gemaak onder ons. The Honourable Dr de Wet was born in the Free State. He is a grandson of that very famous general Christiaan de Wet, who caused so much pain to the British forces and for so many months so successfully eluded them in the Transvaal and Orange Free State. He was educated at both the Pretoria and Witwatersrand Universities. He first practised medicine at Boksburg and then moved to Vanderbijlpark, so you see he has an early association with gold mining on the Witwatersrand, and in moving to the Vereeniging-Vanderbijlpark district he became closely involved in our coal mining and metallurgical industries. South Africa&apos;s first steel was poured from a l0-ton open hearth furnace belonging to the Union Steel Corporation in Vereeniging in 1913. Dr de Wet has been mayor of Vanderbijlpark and for several years has been their member of parliament. More recently, the Honourable Dr de Wet has filled with great honour that most important office of Ambassador for the Republic of South Africa in London. At present he wears two hats, in that he is Minister of Planning and of Health, but more important is his cloak, that of Minister of Mines, which I trust offers him the greatest comfort. To fulfill these three arduous tasks must demand of him a terrific devotion to duty, and in doing this he carries on that loyal tradition of service to his fatherland so evident in his grandfather. Commencing with the Pre-Feasibility Study (PFS) conclusions, the Orapa 3 process design evolved through a phase of value-engineering studies. An overall re-evaluation of the originally proposed process design was necessary both in order to address the interim increase in target throughput from 9.8 Mtpa to 12 Mtpa as well as to increase capital efficiency. In the interests of clarity, the PFS process design for Orapa 3 has been omitted from this paper, as it is no longer relevant. Recognition is however due to those engaged in earlier phases of the Orapa 3 project with respect to fundamental mass-balancing modelling; and ore and diamond characterization, which fanned the basis for the process design that has evolved from feasibility study activities.

The aims of this study were to investigate the factors that influence women’s engagement in technical positions in the South African mining sector and to determine what could be done to promote their successful participation. A convergent parallel mixed-methods research design was used to ascertain the factors that facilitate, inhibit, and influence engagement. In the quantitative phase of the study, questionnaires were circulated to women employeees; and in the qualitative phase, semistructured interviews were conducted with employer representatives, most of whom were human resource personnel. Confirmatory factor analysis showed that the three-factor structure (vigour, dedication, and absorption) of the Utrecht Work Engagement Scale fit the sample data reasonably well. Although there is room for improvement, respondents demonstrated acceptable levels of engagement in their work. On the other hand, the qualitative findings showed that employee engagement is impacted by unfavourable working conditions, work–life balance, and the mining industry’s male-dominated work culture. The findings showed that employee engagement should be elevated to a core human resource function. To increase the participation of women in mining, human resource professionals are encouraged to collaborate with mine supervisors, managers, and employees to develop programmes that promote employees’ absorption in and dedication to their work.

Introduction In South African metalliferous mines, stoping operations are largely confined to narrow, tabular orebodies making mechanization extremely difficult. Limited flexibility in terms of stope width has necessitated drilling by means of hand held, pneumatic rock drills at most of our operations. As the largest producer of platinum in the world, we drill in excess of forty million stope blast holes per annum. Cleaning of the broken ore is also done by conventional means—utilizing scrapers and scraper winches. Conventional methods such as these carry high costs in terms of risk exposure as well as labour intensity. The purpose of this paper is to describe the development of a long hole stoping system suitable for the narrow platinum reefs. The new system had to be substantially safer and more cost effective than conventional mining. We selected a site that was conducive to mechanized mining and set out the parameters that we considered would meet our requirements. We then conducted a feasibility study to evaluate the conceptualized long hole stoping system in terms of specific goals. An analysis of the proposed system identified the Key Performance Indicators (KPIs). One of the most critical goals was to be able to create a man-freestope. This would mitigate the safety risk associated with normal stoping operations, as well as the inefficiency cost previously referred to. Other challenges included setting targets for long hole accuracy, stoping width reduction and specific blasting system performance for long hole stoping. We also modelled a critical span that we considered to be inherently safe and to ensure hangingwall stability, throw-blastcleaning and overall system productivity. Anglo Platinum Research and Development and Sandvik Tamrock entered into an agreement for the supply of a specialized long hole-drilling machine. The system was implemented and tested by the mine with the support of the other participants. The results achieved met our expectations. It was demonstrated that with this method of mining it is possible to have a man-free/support-free stope face and to achieve a reduction in shaft head cost per ton whilst reducing dilution. Mine personnel and Tamrock carried out a full risk assessment on the drill rig before transporting underground. A further risk assessment was carried out when the machine was in position underground. Mining layout See Figure 1 and Figure 2 for a detailed description. Drill rig The drill rig was a combination of a Secoma P-Low LC 10long hole feed and an Axera low profile carrier. Discussion R. E. Rarnes (Member): The original concepts and the pioneering work now brought to the practical test stage by the Mining Research Laboratory team deserve our highest praise. The authors of this comprehensive paper rightly stress the urgency of establishing the extent to which the apparent potential can profitably be realised in practice. It is to be hoped that adequate funds will be made available by individual mining companies, the Chamber of Mines and manufacturers to attract the necessary staff and maintain the high rate of achievement of the last two years. From the Seventy-Eighth Annual Report of the Chamber of Mines and its members we see that, in 1967, with a Working Revenue of R759.8 million from gold and R54.6 million pit mouth coal sales and with profits from gold and uranium and pyrite of R307.9 million, only R1.9 million was spent by the Chamber on all forms of Research. It is considered unlikely that the associated mining companies and manufacturers exceeded this investment expenditure. Assuming a total of R4 million spent by the industry on Research and Development, this is less than half of 1 per cent of sales of gold and coal. This percentage, so low in comparison to North America and Europe, is no worse than that of Exploration expenditure which, in 1967, with South Africa&apos;s total mineral production of R1,287 million, was estimated to have been R6 million (Pretorius 1968). In a primary industry with ever present depletion of ore deposits and with cost escalation, expenditure on Exploration and on Research and Development is not a risky luxury but a tactical obligation. The potential rate of return on research expenditure into rock breaking is high. Stores consumed by gold and coal mines, members of the Chamber of Mines, totalled R316.2 million in 1967. Except for purchased power costing R42.2 million the highest cost group was explosives, drills and drill steel totalling R33.8 million or 10.7 per cent of the total stores consumed. In the paper under discussion it is claimed that the low &apos;effective stoping width&apos; should greatly reduce the likelihood of rock falls or rock bursts to the extent that permanent support can be dispensed with. Insofar as this narrow cut is only 12 in. in advance of the working area which, with a 10 in. channel, is unlikely to be much reduced in width from that achieved by current methods, this claim is not readily understandable. Were it to have been based upon the regional support gained from packed waste it would have been more acceptable. Pre-developed stope drives may give serious trouble at depth and for this reason it is questioned whether a stoping area can avoid periodic sub-development blasting-the spoil and fumes from which will interfere with the rock flow and continuous mining of the rock-cutter. If, in the mining method proposed by the authors, stope drives are cut as small as possible (6 ft by 6 ft) then 25 per cent of the total tons handled (excluding resued waste) and 5 per cent of the gold will be blasted conventionally in the stope. At this stage one cannot envisage tunnelling machines economically or practically capable of such work. The various methods described by the authors and subsequent contributors for breaking waste are most interesting. It was noted that the &apos;bull wedge&apos; and &apos;explosives&apos; in Fig. 1 of the paper were no further from the ideal point &apos;A&apos; than was &apos;cutting&apos;. The writer considers that the bold and imaginative steps taken by the Mining Research Laboratory Team, the mining companies and the manufacturers concerned will eventually lead to a successful rock cutting machine with universal application largely independent of rock type. This may take many years. In the meantime other methods of improving productivity of saleable metal by rock breaking teams should be investigated even if such methods have local applications only. In 1955 the writer conducted tests with a wire saw similar to those used in quarries in the Northern Transvaal and elsewhere. Jeppestown shale, the immediate footwall of much of the East Rand gold field, was cut at the rate of 6 in. per hour using sand, water and a special endless rope driven by a low h.p. motor. A hypothesis on its application was submitted to the Office of the Government Mining Engineer in 1955 and to other mining institutions in 1966 after the writer returned to South Africa. By inference, rope sawing was classed as less promising than other methods tested in the Orange Free State Goldfields (Parker 1969). With highly resilicified hanging and footwall quartzites this was not surprising and confirmed the writers findings when testing hanging wall quartzite from the East Rand in 1955. The relatively uniform conditions, the low strength, hardness, and silica content of the Merensky Reef platinum deposits (Gray and von Bardeleben 1969) and in particular, the existence of overlying Merensky pyroxenite (Cousins 1964) make this and the East Rand attractive areas for larger scale testing of wire saws. It is envisaged that in suitable rock types the 5/8 in. slot would be advanced down dip or down a minor dip. In undisturbed areas &apos;faces&apos; of up to 200 ft in length could be cut several feet in advance of breaking which could then consist of light blasting to the second free face or some of the methods now being tested for breaking waste in rock-cutting operations. A wire saw is an inexpensive and simple machine which, in some areas, could make significant and early gains in rock breaking efficiency as well as in ground and stoping width control.

Eccentric High Pressure Centrifugal Comminution (eHPCC) is a novel comminution device that provides a single step to achieve a desired target grind size. The mechanisms within the unit mirror particle breakage that is akin to high-pressure-grinding rolls (HPGR) and high-intensity-attrition with air classification. eHPCC receives lump and can produce a product P80 such that the progeny are at or less than natural grain size of the feed. The unit operates in either closed or open-circuit. The grinding zone is dry and free of steel grinding media. This paper presents evidence of eHPCC-2 capable of selective and preferential mineral liberation. A recent test campaign on a blend of underground quartzgold- vein ore was completed. The feed to eHPCC-2 trial was SAG mill trommel oversize (low-grade pebble rejects). eHPCC-2 operated open-circuit with air-fluidisation in the rotating-grinding-chamber, classifying particles based on terminal velocity of the air-swept product particles, displaying size and mineral composition classification taking place at the same time. There is an opportunity for future industrial research targeting eHPCC as an advanced integrated comminution and classification technology. Mining is a significant economic activity in most Southern African Development Community (SADC) countries, and mineral beneficiation has been identified, and controversially discussed as one of the possibilities for industrialisation. With many member countries being economically too small to muster the human and financial resources which beneficiation requires, the recently adopted Regional Mining Vision (RMV) envisages interventions at a regional level. An opportunity arose to ask industry role players to what extent the SADC appears to support regional beneficiation policy interventions undertaken by member countries, and what the challenges are in undertaking beneficiation regionally, as a complement to, or substitute for country-specific beneficiation policies. Twenty-five semistructured interviews were conducted with experts from SADC member countries during the 2019 Mining Indaba. Participants were divided on whether beneficiation should be carried out nationally or in the SADC region. While beneficiation could support value-keeping, key challenges were found to be infrastructure development (i.e. energy, water), scarce skills, access to technology and related costs, but also lack of free trade and movement. We submit that a more integrated beneficiation strategy for the SADC region, as is being developed through the RMV, would indeed be relevant in the future. The Centenary Luncheon for Past Presidents was held on Thursday, 24 March, 1994 at The President&apos;s Room at Gold Reef City, Johannesburg at 12:30. Herewith the proceedings that followed. Dr H. Scot-Russell It is with great pleasure that my fellow Office Bearers and I welcome you, our Past Presidents, to this luncheon to mark the centenary of the SAIMM. Today one hundred years ago, a group of professionals met and agreed to draw up the constitution and by-laws of a society later to be called an Institute. The Presidents of the Institute, of course, become its Past Presidents and help to guide its progress. A number of our sister institutes cannot wait for their Past Presidents to move of their councils, and cannot understand how we can give such free reign to ours! We believe it one of our strengths. The successful cooperation between our Past Presidents and ourselves is due to the personalities of these men. They attend meetings not to ensure that the status quo is maintained, but allow the current Office Bearers freedom to lead the Institute as they think fit. But they are always present to give sound advice, a helping hand, and support to the Institute in every way.

Several aspects of the behaviour and properties of backfills consisting of cemented cyclone underflow tailings are illustrated by means of examples, and guidelines are given on the optimization of the performance of cemented fills. The stretch characteristics of the geofabric used to contain freshly placed backfill are described, as well as the relationship between these characteristics and the forces acting on retaining barricades. The properties required to achieve a self-supporting, stable free face in cemented backfill are explored, and a graphic relationship between stable height and shear strength is presented and compared with that for uncemented (classified) tailings. After a description of the characteristics of Witwatersrand quartzite gold-tailings backfill and commonly used cements, the process of drainage and air entry into backfill is outlined. Following this, the early-age gain in strength and the shear-strength characteristics, as well as the compressibility characteristics of cemented backfill, are described. Two phenomena that are potentially damaging to cemented backfill are seismic effects (or blasting acceleration) and the closure that takes place during the curing of cement. Investigations show that neither of these phenomena is actually significantly deleterious to gold-tailings backfill: liquefaction does not Occur as a result of seismicity, and hydration of cemented fill is not significantly impeded by closure.

Mine dumps created in terms of the pre-MPRDA regime (old order mine dumps) are currently not regulated by the MPRDA, and the common law owners of such dumps are free to process them without the need to obtain the relevant rights. The MPRDA Amendment Act purports to change this position. However, the wording of the Amendment Act raises a number of problems which render the post-amendment position at best unclear and at worst absurd and unworkable. The primary concern with the Amendment Act is that, on one interpretation, material placed on the same dump at different times may be treated differently at law. Thus, parts of a dump may be subject to one person?s right while others may be subject to another?s right. Moreover, case law has generally regarded mine dumps as movable property and, by extending the MPRDA to apply to all mine dumps, the Legislature is extending the ambit of the Act to cover movable property, a scenario not contemplated by the wording of the Act (even after its amendment) in relation to applications for rights. The better interpretation of the amendments, which are not yet in force, is that they will not apply retrospectively to old order mine dumps.
