"It now becomes my privilege and duty to call to order this fifty-first meeting of the Rocky Mountain Coal Mining Institute. "I bid you a hearty welcome and I know by your attendance at these meetings you will gain a great deal of valuable information, as well as have a wonderful time. "We have been very ably represented by Mr. John H. Emrick as General Chairman, assisted by our good friend Mr. Fred W. Whiteside, our secretary and treasurer. I know they have worked very hard in selecting the various committees, who in turn - by the looks of our program have gone all out to prepare material that should be of great interest to us. I trust we will be attentive to the subjects presented and freely enter into the discussions, also relating our problems and experiences. I am sure this will prove both profitable and beneficial to all present. "The main purpose of these conventions is to become acquainted with each other, renew old acquaintances, talk over our problems, and have a little fun and relaxation from our every day routine. "Let us not forget the manufacturers, the distributors, the operators, or the press because it is through their splendid support that this organization is successful. "Since our last meeting we have gained many new members, whom we especially welcome. We are sorry to have lost a few. I am mindful, at this time, of two very good members from my home state who have passed away, Walter Wetzel, a former president of this institute, and Lee Alger, at the time of his death, Vice-President from Utah. We also lost very recently our assistant Secretary-Treasurer, Everret Davis. These men contributed a great deal to the institute and the coal industry in general. I am sure they are greatly missed by all who knew them."

The thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute was called to order in the Cosmopolitan Hotel, Denver, Colorado, Thurs- day, June 26, 1941, at 11:20 a.m., by President Charles M. Shott, following which President Shott made his opening address. On motion of H. C. Marchant, duly seconded, voted and carried, the reading of the minutes of the thirty-eighth regular meeting was dispensed with. On motion of Ronald C. Oliver, duly seconded, voted and carried, the President was authorized to appoint auditing, new members, resolutions and nominating committees, which appointments he then announced would be made at the afternoon session. An interesting talkie entitled "Coal Mine Explosions" was shown by Mr. William Forbes for the U. S. Bureau of Mines.

It's my pleasure to welcome the Rocky Mountain Coal Institute to Montana. Now that you've ended a 74 year history of meeting outside our borders, I hope you'll be back more often. Even if I can't convince you to come back before 2060, when another 74 years will be up, I'm confident the Kalispell and Flathead Lake area will do the persuading for me. In recent weeks, I've made a number of speeches around the state pointing out just how wrong the revenue projections in Montana's state government made in April of '85 were when we came to April of '86. Since the middle of this month, Montana's legislators have been in Helena struggling to balance a state budget that, by the end of fiscal year '87, threatened to be some $88 million in the red. Other western states reliant on natural resource and agricultural economies have found themselves caught in the same deflationary spiral. The "window of opportunity" I proposed and the 1985 Montana Legislature passed, couldn't have been opened at a more difficult time. What was envisioned as an incentive to expand Montana's coal production, and our tax base, ran aground on low oil prices and excess hydroelectric power. De- spite the one-third severance tax rebate offered on new coal production, year-to-date figures published in the June 2nd Coal Week show that production in Montana is down almost 10 per- cent from last year. Again, we're not alone. Production in Wyoming is down 8 percent and in North Dakota, it has dropped 13 percent. An over- all 3 percent production decline in western states looks even worse when contrasted against a 12 percent increase for your eastern competitors. Montana's "window of opportunity" had the potential to be a significant signal to your industry. That potential was quickly tempered by the inability of Arab nations to stabilize world energy prices. If any of us had forgotten, the last twelve months have reminded western states that the well-being of our natural resource economies has a tremendous impact on the ability of all levels of government to provide services. The past year has also driven home that in the world of business and in the business of the world, risk-taking is still the name of the game. The Western Governors recognize the problems facing this industry - and our states - and we're prepared to fight for the future of western coal. In the past two decades, legitimate environmental concerns have created a vast body of new legislation affecting coal producers. The industry has been required to meet new reclamation standards - tough regulations relating to ground water, air quality and wildlife habitat. To the industry's credit, coal companies have hired professionals with the technical know-how to do it right. Rather than considering reclamation laws to be an unreasonable burden, today's coal company is more likely to view its reclamation efforts as a source of corporate pride. In a sense, the industry and the agencies which regulate it have matured together . . . although at times OSM is reluctant to admit that either of us capable of or willing to play by the rules. Certainly some abuses exist and OSM's oversight has been helpful in ensuring parity between those states willing to comply and those that would rather defy federal law. Nonetheless, penalizing the more modem and responsible western coal industry for abuses that occur elsewhere is both unfair and counterproductive. Federal penalties range from "cruel and unusual" reporting requirements to the proposed electricity tax that would effectively force utilities and ratepayers who have already met the sulphur emission standards to subsidize those who have dodged their cleanup responsibilities. Profiled below are the eight RMCMI 1999 Scholarship Award winners. Seven of the eight attended the 95th Regular Meeting and convention at Crested Butte, Colorado in late June. Each spoke during the Scholarship Awards Monday luncheon and shared their goals with attendees. In addition to receiving a $1,500 tuition credit, thanks to the Patrons of the Institute annual funding of scholarships, each received recognition at the luncheon with a brass plaque signifying this honor. The winners are guests of the Institute Sunday through Tuesday and have an incredible opportunity to meet many in the coal industry who could be potential employers. The state vice presidents host the winners and pay for their travel and hotel expenses. This is a continuing scholarship and may be renewed for tuition credit again in the senior year if they remain a full time student and if recommended by the dean of their college or university. A resident from each of the eight member RMCMI states is selected by the Scholarship committee from Board approved institutions. Criteria for these annual awards is that the recipient (1) is a full time sophomore student who will use the tuition credit the junior year. (2) Be both a U. S. citizen and a legal resident of the member stare. (3) Maintain good academic standing, be pursuing a degree in a mining related field and have an expressed interest in western coal as a possible career path. Contributions to this worthwhile project are tax deductible to each individual RMCMI member or his company. Through donations of $100 or more to the Patrons of the Institute, each Patron receives a plaque and a year bar for each additional year contributions are made. [ ] ARIZONA WINNER Jennifer Jannusch University of Arizona Jennifer is the daughter of Peggy and Larry Jannusch of Phoenix. She graduated from Shadow Mountain High School in the top 15% of her class. She has been on the Dean's List and won the National Collegiate Engineering Award. Jennifer belongs to the Association of Engineering Geologists, SME, Best Buddies, and enjoys running, painting and languages. [ ] COLORADO WINNER Alan S. Maste¬rs Colorado School of ties Alan is the son of Lee and Ellen Masters of Lakewood, Colorado. He graduated from Lakewood High School and has been on the Dean's List at CSM. He resides with his wife, Karen, and children Morgan, Nicole and Scott. Spending twelve years as a mechanic and semi-truck driver, Alan decided to return to school to pursue an engineering degree. Having maintained a 4.0 G.P.A. at Arapahoe Community College, he was accepted at CSM where he continues to excel. He firmly believes that the future of our country will be enhanced by our ability to utilize our natural resources. Alan enjoys time with his family, fishing, water skiing, bowling and reading Tom Clancy or John Grisham novels.

The tenth annual Mine Resale Evaluation was held in conjunction with the RMCMI 2001 convention at the Steamboat Springs Sheraton Resort, Steamboat Springs, Colorado June 23 through 26. The purpose of the mine rescue evaluation program is to provide an opportunity for mine rescue teams to learn new skills and improve their existing ones in a non-competitive environment. Several staged ?disaster? scenarios were held where the teams are called upon to exhibit their life saving abilities. The evaluators meanwhile are offering suggestions, both verbal and written, to help the teams better understand the situations presented them. This non-competitive environment allows the teams to work together and share their knowledge with fellow mine rescue teams providing everyone with a positive learning experience. Mine Rescue Chairman Bill Balaz, Balaz & Associates, was in charge of coordinating the events. Six teams consisting of seven to twelve members each (totaling 60 members) participated in the three-day event. Each ream was required to respond to direr different real-life scenarios plus a written general knowledge test daily. Cindy Burnham has assisted Bali, for a few years. Her responsibilities include grading all of the written tests. This year's tour professional evaluators included Art Seanz (Hazardous Ma¬terials) of Western Environmental Associates ; Guy Norton (Ropes), Guy Horton Rope Rescue; Mary Bailey (Medical), MBA Training and Morley Hense (Confined Space). Carolyn Durga, BHP Coal, also assisted in hazardous materials and medical scenarios. They each provided three different challenging mock situations per day per team. The teams had no prior knowledge of what the scenarios would be as details were provided only as they arrived. Ten volunteer victims added much drama and excitement to the event. Their realistic enactment, complete with false blood makeup and severed limbs, made for some very tense scenarios. The Mine Rescue Teams participating this year were BHP LaPlata, BHP Navjo, BHP San Juan, all from Farmington, New Mexico; Bridger Coal Co., Rock Springs, Wyoming; Sabine Mining, Longview, Texas; Solway Minerals, Green River, Wyoming and Western Energy Co., Colstrip, Montana. Many new friendships were made and much knowledge shared. A swap meet was held Saturday afternoon for the teams to exchange miscellaneous equipment, hats, shirts, etc. The trams were asked to evaluate the program and the evaluators. They responded with many positive suggestions that will help improve the upcoming events in the years to come. Culmination of the Mine Rescue program was a Tuesday morning awards breakfast where the teams were presented with trophies. Each member was also given a gold pin with the words Continuing Challenge - Ropes.' The pin was the first in a series that will be given over the next few years. The participating victims and evaluators were also commended for their outstanding efforts. Special signed "Victim" shirts were given to select volunteers. Sponsors for the Mine Rescue program were Flanders Electric Motors, Magnum Metals, Rocky Mountain Electric Motors, Sedona Consulting and Balaz & Associates. Many hours of volunteer tine and effort from various family members of participants helped make the 2001 event a huge success.

Dear Member: The Proceedings for the Institute for the past year are enclosed. We hope you will read them, for there are some good ideas expressed, and the papers are far above the average. The job of publishing the Proceedings has always worried the Secretary. The Secretary, being at the same time the Treasurer, has to pay the bills, and this time he enlisted the co-operation of some of our friends. You will find this co-operation shown in the ads in the proceedings. Read the ads just as carefully, even more so, than you do the text. They carry messages from our friends. Don't forget the winter meeting in Denver, the last of February, the 26, 27 and 28. Another good paper to be read then will be that of A. L. Jones on the subject of "Power Problems of the Coal Mine." In the meantime you can do two things for the Secretary. Let the few who haven't paid their dues remit quickly so we can get our books closed. Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during he 84th Regular Meeting of the Institute was called to order by the president, H. Dean Jacot at 11:30 a.m Tuesday, June 28. 1988 in Peak Room 5 of Beaver Run Resort at Breckenridge, Colorado. Twenty three were present and a quorum was established. The president stated the purpose of the annual meeting is to inform members of the status of the affairs and activities of the corporation during the year. It was moved by Loren Linville, seconded and carried to approve the minutes of the previous meeting as published in the 1987 Proceedings. The chair called for reports of the various com¬mittees and these reports will he placed on file in the RMCMI office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted two resolutions: (I) Noting the passing of members since the last convention-Richard T. Brownrigg. Don A Dewey, John T. Maulshy. Hugh D. Nyquist and Mike Zakotnik. (2) Recognizing the superior skills of J. Brett Harvey. RMCMI Vice President of Utah. For recruiting 26 new members from the State of Utah and named him as #1 Recruiter in the Institute?s 1988 membership drive. Linville further commended the Executive Secretary officers, chairmen and committees loran excellent job in planning the 84th Regular Meeting and convention. Membership. In the absence of chairman Ed Sullivan. the secretary reported there are currently 718 active or dues paying members, 51 Life Members and 250 delinquent in dues payment. In the 1988 membership drive. 132 new members have been recruited and 74 of them attended this convention making up 27V, of the total attendance. Patrons of the Institute. This report was given by the secretary for chairman Ira McKeever. A total of 124 plaques has been prepared during the low year life of the program. It has been culled to 119 possible donors as some firms have gone out of business or consolidated. Of this number 46 renewed their annual $100 donation and three new Patrons have joined prior to the convention for a total of 49. During the convention. four new Patrons donated $100 each. tour former Patrons pledged $100 each and seven would be-new Patrons pledged $100 each for a total of 15. This would bring the grand total to 64 if all pledges are received prior to the close of this fiscal year as opposed to 59 renewals in 1987. Program. Co-Chairman Pete Nielsen announced the convention program theme "Broadening OUR Horizons" was well received despite the loss of three speakers during the final days prior to convention. Because the remarks of the Monday luncheon keynote speaker ran over the first time-to-be-tried Monday afternoon Poster Session was delayed almost an hour in beginning. This well thought out feature will he run again next year but in a different time frame. Nielsen thanked his co-chairmen, Bill Balaz and the Poster Session chairman Marcie Greenberg. Publicity. Chairman Tom Egan reported three newsletters including the convention newspaper were sent members during the year. He and Bob Jacob of Bob Jacob Public Relations were at registration daily to secure business card ads and to solicit advertising for the Proceedings. Scholarship. Chairman Keith McGinnis reported that six of the seven scholarship recipients were present at the convention. The University of Arizona at Tucson was added this year and it was the only university visited this year by the chairman. Each scholarship recipient was introduced to the membership at the Monday morning Welcome Session, presented a plaque and responded. The input Iron each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. McGinnis noted that the mining engineering department at the University of Wyoming may be dropped during the coming year. Joe Dunlap suggested that every member rally support of this department.
