Electron spin resonance measurements have now been completed on the decay kinetics of the organic free radicals formed on crushing or grinding of a well characterized anthracite coal. The free radicals exhibit a complex decay pattern for the first few hours after the grinding, and a smooth decay thereafter. Parallel hemolysis studies indicate. a half-life of the decrease in the cytotoxicity of the fresh· dust to be about half-a-day. The cytotoxicity of the freshly-made dust decreases on addition of superoxide dismutase, catalase and sodium benzoate. The hemolysis rate is lower for the dust stored in buffers as compared to air. A chemical model will be presented to accomodate the cytotoxicity and spectroscopic data, and ~heir implicati6ns to pneumoconiosis.

A significant risk factor in assessing and modeling potential catastrophic slope movement in open-pit mines is the presence of argillic alteration in host rocks. High-resolution hyperspectral imagery operating in the visible to shortwave infrared can be a useful tool for identifying and mapping potentially dangerous argillic zones. We have conducted preliminary experiments with a new type of hyperspectral imager that employs an acousto-optic tunable filter, a variable retardation plate and a standard digital camera. The instrument we tested operates in the .5-1.0 micrometer range. A shortwave infrared instrument is planned, and mid-infrared instruments have been designed. An AOTF consists of an acoustic transducer that generates an acoustic wave that propagates through an attached crystalline substance. The wave sinusoidally modulates the refractive index of the crystal, selectively diffracting incident light according to its wavelength. The instrument also measures polarization signatures of reflecting surfaces as well as their spectral properties, opening up new areas of possible research. Images can be acquired and processed at 30 frames/second. The AOTF camera system offers numerous advantages to geologists. It can be used as an airborne imager or as a portable field device to image pit walls, outcrops, rock specimens or drill core. It can be adapted to image polished sections under a microscope, and it could be used in underground workings. Algorithms can produce processed images in real time (e.g., ratio images), and, because it is a camera system, aerial images can be orthorectified.

This chapter details the perspective from which collected data have been examined. The first part, intended primarily for lay readers, discusses several topics related to mining as an enterprise. Initially, the organizational functioning of atypical large mine will be described. It is the formal structure above a miner that decides the conditions of his or her work. A second point of concern is the technology itself An underground coal mine is a sociotechnical system, with workers and machines organized in particular ways during production. Third, general conditions and dangers underground will be described in detail. The physical environment of an operation is a powerful factor in the work life of miners. Fourth, a discussion of the process of formal training is given. During this training, a new worker is taught what the organization expects of him or her in the role of safe, productive, coal miner. Next, there are outside organizations that act as significant forces in the workplace. Examples include the Mine Safety and Health Administration (MSHA), State agencies, and the United Mine Workers of America (UMWA). The roles of these entities will also be examined. The second part of this chapter will depict each study site as a concrete setting, so that findings can be interpreted in their proper context. The Organizational and Technical Nature of Mining A coal mine is a complex system. It is defined as all parts of a mining plant's property (both underground and surface) that contribute, under one management, to the extraction or handling of coal [American Geological Institute 1997]. As suggested, many functions that must be carried out at an operation are only indirectly related to coal mining and processing. Even the jobs that are di¬rectly related tend to be numerous and varied [Wallwork 1981]. According to Palowitch [1982], the chief reason for this sophistication is that "after more than two centuries of exploiting our coal resources, today's coal industry finds itself saddled with a horrendous legacy of human impairments and environmental damages which society demands be corrected." Now, the effects of government regulation are evident in every aspect of the mining industry. Any operation, if it is to survive, must be administered with an eye for social efficiency and accountability. Long-range planning is needed to ensure that the mine produces coal in a cost-effective manner. One of the first things that must be considered is location and method of access. To extract coal from an underground mine, a coalbed (or "seam") must be reached from the surface. The term "portal" is generally given to any entrance that provides access to a coal mine. In hilly terrain, such as is found in Appalachia, the coal may "outcrop" on a hillside. This allows direct

In its investigations looking to the improvement of health condi- tions and the increase of efficiency in the mining industry, the Bureau of Mines, in cooperation with the Bureau of Public Health, is studying sanitary conditions in and about mines with the intent of pointing out how those conditions that are a menace to the health of the miner may be most efficiently removed or remedied. An out- line of sanitary betterment work at mining villages in the Birming- ham district of Alabama has already been published by the bureau," and in this bulletin are presented suggestions on the planning of mining towns and the construction of miners' houses. The bulletin does not pretend to be a treatise on the so-called "housing problem," and mentions sociologic issues only incidentally. It is assumed that the influence of proper shelter on health is understood and that not a lack of appreciation so much as a lack of knowledge of the best remedies is responsible for many of the undesirable conditions that exist at mining towns. The purpose of this bulletin is to supply facts on the building of well-lighted, well- ventilated, warm, attractive, and economical houses for miners, these houses being assumed to be units of an industrial village or town the building and management of which are under the control of a corporation, so that special conditions hold which do not apply to houses built and owned by individual miners. From this it is not to be inferred that the company-controlled town is the best system or the only one in vogue. The discussion of this side of the subject in all its phases is too involved to be included in this paper. One element in favor of the company-controlled town is its possible immediate responsiveness. Hence this assumption. Also the assumption is made that a-new isolated town is being built, and hence the selection of the site, the arrangement of the streets, and the situation of the houses are discussed before the house itself is treated, for one of the most important factors in obtaining an economical sanitary house is a well-selected town site. Many of the suggestions, however, may be applied in improving conditions in existing towns, in building new houses in old towns, or in repairing old houses. Emphasis must be laid on the fact that as a rule a mining village has a shorter life than a manufacturing town. Economy is emphasized frequently because the discussion is predi- cated upon the assumption that the miner himself is to pay for all that he gets. House rent will doubtless be expected to bring in a reasonable return on all money invested in streets, sidewalks, water supply, sewer system, and houses; in other words, the town is to be run on a business and not on a paternal or charitable basis. "Fair and reasonable" precludes, of course, the idea of excessive returns. Some companies do not consider it good policy to realize as high a rate of interest as an independent realty company would be war- ranted in realizing. Under some circumstances part of the town improvements might be charged as "expense of the industry," that is, to the consumer. The isolation of a mining town introduces a unique responsibility. As the miners are practically obliged to rent the company houses, the officials of the company ought to scrutinize all expenditures in- volved so that house rent may be reduced to a minimum. In a way the town builders are placed in the position of trustees. They deter- mine, within certain limits, what proportion of a man's wages shall be spent on house rent. This consideration should restrain fanciful and unnecessarily expensive building; the other extreme should like- wise be avoided. True economy should be distinguished from cheap- ness. Ugly, insanitary, uncomfortable shacks should not be built even if, because of their cheapness, there is a demand for them from tenants. The obligation of the industry to society as a whole as well us to the tenant ought to forbid this. A cheerful, strong, healthy, virile race will not rise out of the filth and squalor of cheap hovels. An insanitary environment often does its damage slowly and silently; vitiated air does not, like mine gas, announce its deadly work by an explosion. As Talbot⚫ says: Health depends in part on freedom from infection. The probability of obtain- ing that freedom will be greatly increased by maintaining the body at a high state of vigor, or "vitality," as it is popularly called. This implies the promo- tion of all agencies which have to do with the physical well-being as well as with the control of sources of infection. Many men realize that in building houses for their workmen they are invested with a peculiar responsibility that must be wielded wisely, and in large developments they call into consultation the land- scape architect, the sanitary engineer, and the building architect, as well as the mining engineer.

The mining laws of Russia (Collection of Laws, vol. 7, 1912) are still in force in Latvia. The Free State of Latvia (declared independent on November 8, 1918) is composed chiefly of the Baltic Provinces of the former Russian Empire, which are ethnographically Lettish: The Province of Courland, four districts of the Province of Livonia, and three districts of the Province of Vitebsk. Since the establishment of its independence, Latvia has not felt the need of a special mining law, inasmuch as mining so far has not been found profitable in that country. A supplement to this paper, entitled "Mineral Resources," is a brief summary of the minerals found and utilized in latvia. RIGHTS OF FOREIGNERS A foreign individual is permitted to explore for minerals and to own and operate mines in Latvia on equal terms with Latvians. A foreign corporation is required to establish a branch in Latvia, which shall be subject to the corporation laws of the country. A certain number of the partners or incorporators must be citizens of Latvia.

General A review of the literature has revealed important areas which should be investigated during the field work. Of the utmost importance is the safety of mine personnel. Should a phase-to-ground fault occur on a shovel or other piece of equipment, current may return to the substation through the machine's contact surface with the mine floor, thereby raising the frame above ground potential and posing a shock hazard to anyone who touches the equipment. If the frame-to-earth resistance is very low, then no dangerous potentials will be developed, and a basis for elimination of the ground conductors from trailing cables could be postulated. However, should the contact resistance be high, then lethal voltages could be present on the machine frame. In this instance, low-resistance ground conductors in the trailing cable would be a necessity. Therefore, field tests should include measurements of the earth resistance of electrically operated portable or mobile mining equipment such as shovels, draglines, and drills. When the electrical distribution system is subject to lightning discharges, the grounding grid must safely carry to earth and dissipate enormous current surges. It is essential that the grounding grid have a low value of earth resistance, because any potential developed across the grounding grid as a result of current flow will appear on the frames of all machinery connected to the grid. OWNERSHIP OF ORE-CONSTRUCTION OF CONTRACT. A contract between the Republic Mines Corporation and the Quilp Gold Mining Co. provided that upon forfeiture of its rights under a contract the Republic Mines Corporation was required to give a good and sufficient deed conveying to the Quilp Gold Mining Co. all ore bodies of every description lying east of the west line of the Quilp Mining Co. claim extended downward vertically and lying south of the north end line of the Quilp claim extended downward vertically and which may apex within the lines of the Surprise, an adjoining mining claim. It must be presumed that the contracting parties under such circumstances had in view their statutory rights as provided by the mining statutes of the United States, and that both were familiar with the provisions as to extra- lateral rights granted by the statute to locators of mining claims. This contract means to include all ore bodies of every description lying east (or easterly) of the west (or westerly) line of the Quilp claim extended downward vertically and south (or southerly) of the north end line of the Quilp claim extended downward vertically within the Quilp claim excepting the part that was overlapped by the Surprise claim, owned by the Republic Mines Corporation. Quilp Gold Min. Co. v. Republic Mines Corp. (Washington), 165 Pacific 57, p. 61. PURCHASE OF GAS-REFUSAL TO DELIVER SALE TO OTHERS. A gas company that had entered into a contract to purchase a quantity of natural gas refused to receive and accept the gas that was tendered on the ground that it did not conform to the requirements of the contract; subsequently the company refused to sign a writing by which it was asked to consent to the sale of such gas to other persons. But the refusal of the purchasing company to sign such a writing giving its consent or its refusal to consent to such sale did. not affect the rights of the seller to dispose of the gas elsewhere and to other persons. OWNERSHIP OF MINERALS IN HIGHWAY. All mineral deposits within the limits of a highway belong to the owner of the fee and he is entitled to remove them so long as he does not interfere with the public use of the highway. City of Scranton v. Scranton Coal Co. (Pennsylvania), 100 Atlantic 813, p. 819. SALE AND CONVEYANCE. SALE AND CONVEYANCE EXCEPTION AND RESERVATION. The owner of an undivided interest in oil and gas lands conveyed the same to certain named grantees by deed containing a clause excepting and reserving all the oil and gas produced from the undi- vided interest in the land described. The language is not apt for the creation of either an exception or a reservation, but is rather that of a layman unfamiliar with legal distinctions. Strictly and literally construed, it affords a basis for a contention that that which was excepted and reserved was not realty in any form or anything inci- dent thereto, but personalty produced from the land. Immediately following the description of the tract, the grantor excepted and reserved something from the land described. What he excepted and reserved, he excepted and reserved then, and it was from his interest in the land. The clause expressed according to the evident intention of the grantor would read: "Excepting and reserving from the above all oil or gas which may hereafter be produced therefrom." No other construction can reasonably be placed upon the language used. The carving out of a separate estate in the oil and gas in land is a common occurrence in oil and gas producing fields. Mandle v. Gharing (Pennsylvania), 100 Atlantic 535, p. 536. RESERVATION CONSTRUED AS AN EXCEPTION. Where apt words of reservation are used in a deed they will be construed as an exception where this is the evident intention of the parties to the instrument. Although an exception and a reservation differ in legal effect, yet in their creation there is no magic in words, and if the meaning is clear either expression will operate for the purpose designed. The technical distinction between an exception and a reservation is frequently disregarded in the ordinary use of the word, and whether the language used creates an exception or a reservation must be determined from the intention of the parties ascertained from the entire instrument.

"A million tons of coal mined in the Pennsylvania anthracite region without a fatality is a feat of which to be proud and one that deserves the commendation of the entire mining industry. The average production per fatality in this region for 1933 was 206,823 tons, an exceptional record showing the results of an intensive drive made by the Pennsylvania Department of Mines and the anthracite operators and-workers to curtail the high accident rates heretofore prevailing in the region.This paper gives information about a mine with a record five times better than the average which should prove to the industry that mine accidents can be reduced through the proper safety organization and effort. The Pine Hill Coal Co., managed by Weston Dodson & Co., Inc., and located at Minersville, Schuylkill County, Pa., has made such a record at its Oak all colliery by studying its accident experience, realizing the facts, and pursuing a definite safety policy with a view to bettering its accident occurrence.As a direct result of its safety policy this colliery has produced 1,044,000 tons of anthracite without a fatality; within 3 years it has reduced its total accidents from 645 to 105 per year, its compensable accidents from 204 to 45 per year, and its lost-time accidents from 335- to 67 per year. In addition, it has set up a smoothly functioning safety organization that will go fax in aiding in the continuance of this great work of mining anthracite at a lower .cost in human suffering.This circular describes the accident-prevention methods perfected and the results obtained by this colliery in the belief that similar methods will produce essentially similar results at any other colliery where they may be adopted.The writer acknowledges his indebtedness to the officials of the company who furnished him with the details of the safety organization and the data from which this report was prepared. He especially desires to thank Messrs. Stockett, general manager, Wells, general superintendent, Morgan, safety engineer, and Kistler,- statistical department, for their hind assistance.The mine is opened by shafts, slopes, and drifts, a characteristic of minas in the Southern anthracite field. Thirteen different beds of coal are being mined. The thickness of the beds ranges from 3.5 to 16 feet and the pitch from 0 to 900. The roof and floor exhibit the entire range of conditions found in anthracite mines. Table 1 describes the coal seams being worked."

"The transportation of explosives, and especially their distribution from the supply magazines of the manufacturers or dealers to the mines, quarries, or other points where they are to be used, by means of horse-drawn vehicles is an old-time practice, and the records of accidents of the past show this to have been a hazardous undertaking requiring for safety the taking of many precautions not required in the transportation of other merchandise.Displacement of the horse-drawn vehicle by the motor vehicle for the transportation of explosives is increasing rapidly. A consideration of the facts that the vehicle is operated by an explosion engine, using easily vaporized liquid fuel; that the charges in the engine are fired and the vehicle lighted by electricity; and that the vehicle, being operated insulated from the ground, may accumulate static charges led to the conclusion that new hazards are being introduced into the transportation of explosives through the use of motor-operate& vehicles, and that therefore additional special precautions must be taken against these additional hazards.That accidents have already occurred in this use of motor-vehicle transportation is evidenced from the following examples:Recently in California a driver loaded a box of granular powder in the rear of an automobile truck and a box of electric detonators in the front. Suddenly, while traveling along a highway, the explosives detonated, demolished the truck, and blew the body of the driver into small pieces. No evidence was left to show the cause of the explosion, but it is assumed that a jar or other means caused the detonators to fire, and that they in turn detonated the explosive. It should be recognized that it is unsafe to transport detonators and explosives in the same compartment, and this rule should be strictly enforced. At present this rule appears to be either unknown or, at least, frequently ignored.There are usually so many possible causes of ignition or detonation of a truck load of explosives that it is often impossible to state definitely the exact cause in a given case. This is well illustrated in the following account of an accident: A trucking company was hired to haul a truck load of explosives about 200 miles. The driver had had experience in driving trucks of explosives, and it was stated that he inspected the truck carefully before leaving the garage. Eighty 50-pound boxes of explosive were placed in tiers on each side of the truck and 265 25-pound kegs of black blasting powder were placed in the center of the truck. The boxes were placed flat and the kegs were placed on end, arranged in tiers. While the truck was being driven along the highway there was a muffled explosion. When some men, who were about a quarter of a mile away, arrived at the scene the truck was in flames and they could get no nearer than 100 feet. The driver was sitting in his seat and had apparently been killed instantly either by shock or fumes. When the flames were finally quenched, the driver's body was recovered, badly charred. It was, found that several boxes of explosives had been thrown about 40 feet by the initial explosion but were uninjured. A total of half a ton of dynamite was recovered. The cover to the gasoline tank could not be found."

Contour maps, useful in mineral industries, for example, in analysis of trends in mineralization, may be constructed through statistical methods of regression analysis programed for an electronic computer, For many applica­tions, the resulting maps are more useful and objective than conventional contour maps that are necessarily subjective because they are drawn by hand methods. In principle, an equation is found that fits a quadratic surface to observed elevations of points referred to a datum plane, The quadratic sur­face, represented by a contour map may take the form of a ridge, valley, dome, or basin, Once an equation has been derived, its coefficients may be used to construct a contour map--showing lines of equal value that are derived from the original observed data points by the averaging process of fitting the quadratic surface. Methods employed are illustrated by an example analysis, based on data from a large vein of the Fresnillo mine, Zacatecas, Mexico. Computer programs to implement the methods are described in an appendix,

A National Institute for Occupational Safety and Health’s (NIOSH) mine fire detection re-search project was undertaken to evaluate multiple mine fire sensor types for nuisance alarm discrimination. The response of multiple fire sensor types to three small coal fire and three small conveyor belt fires in the presence of diesel emissions was evaluated in NIOSH’s Pittsburgh Research Laboratory (PRL) Safety Re-search Coal Mine (SRCM). An array of fire sensors which included an optical and ionization smoke sensor, a chemical cell CO sensor, and Metal Oxide Semiconductor (MOS) sensors, was used to sample the diesel engine and fire source emissions. The mine fire detection experiments demonstrated the ability of a MOS sensor with a bimodal response to NOx and products-of-combustion (POC) to respond to the onset of smoldering combustion in the presence of CO and POC particulates from a diesel locomotive. As part of an in-mine evaluation in an operating coal mine, the MOS NOx responsive sensor and an ionization smoke sensor was demonstrated as a method to discriminate diesel emissions and cross-interference of H2 on a CO chemical cell fire sensor at a battery charging station. The reinforcement of mine fire sensor information with the use of multiple sensor types, such as an MOS sensor and ionization and optical smoke sensors, is shown to be important for nuisance alarm discrimination and early mine fire detection.

Twelve subjects participated in an investigation of the biomechanical stresses of asymmetric lifting in stooped and kneeling postures. Three factors were manipulated in this study: Posture (stooped or kneeling), height of lift (35 or 70 cm), and weight of lift (15, 20, or 25 kg). Subjects were required to lift or lower a box every 10 seconds for a period of 2 minutes. Electromyography (PIG) of eight trunk muscles was collected during a lift in this period. The PIG data, normalized to maximum extension and flexion exertions in each posture, were input to a biomechanical model and used to predict compression and shear forces at the L, level of the lumbar spine. Results from the EMG-driven biomechanical model indicated that compression was greater when lifting to a higher shelf (p < 0.001), and indicated a significant interaction between posture and the weight of the lifting box (p < 0.01). Peak lateral shear was not significantly affected by any main effects or interactions (p < 0.05). Anterior shear was increased with increasing height of lift (p < 0.001), and also by the posture x weight interaction (p c 0.01). A multivariate analysis of variance (MANOVA) indicated a complex relationship for recruitment of the eight trunk muscles, with the triple interaction being significant (p < 0.001). The results of this investigation will be used to evaluate safe loads for lifting in these restricted postures.

In June 1992, the Mine Safety and Health Administration (MSHA) published the "Report of the Coal Mine Respirable Dust Task Group, Review of the Program to Control Respirable Coal Mine Dust in the United States." As one of its recommendations, the report called for the accelerated development of two mine dust monitors: (1) a fixed-site monitor capable of providing continuous information on dust levels to the miner, mine operator, and to MSHA, if necessary, and (2) a personal sampling device capable of providing both a short-term personal exposure measurement as well as a full-shift measurement. In response to this recommendation, the National Institute for Occupational Safety and Health (NIOSH), Pittsburgh Research Center, initiated the development of a fixed-site machine-mounted continuous respirable dust monitor. The technology chosen for monitor development is the Rupprecht and Patashnick Co., Inc. tapered element oscillating microbalance. Laboratory and in-mine tests have indicated that, with modification, this sensor can meet the humidity and vibration requirements for underground coal mine use. NIOSH is continuing that effort by developing prototypes of a continuous dust monitor based on this technology. These prototypes are being evaluated in underground coal mines as they become available. This effort, conducted as a joint venture with MSHA, is nearing completion with every promise of success. The immediate benefit of this effort will be to researchers, regulatory personnel, and mine personnel, by permitting evaluation of specific mining practices to see which expose mine workers to excessive dust levels. Using this information, mine personnel can optimize mining procedures to reduce dust exposure. MSHA and the operators will also be able to use the dust concentration data to judge whether dust plan parameters are adequate to continuously maintaining environmental dust levels below the applicable standard. The second development recommended by the Dust Task Group was a person-wearable version of the continuous dust monitor. It will be a monitoring system designed to provide a measurement of worker exposure to respirable dust, both during and at the end of the shift.

A flood in mine workings is a crisis even if no lives are lost, and when the crisis is past and the excitement wanes there is usually a rapid return to unwarranted complacency in those regions where floods occur, even though the danger of imminent recurrence is known. Experience in flood control, regardless of its nature, has taught that in a flood the work does not cease when the emergency passes; rather, it increases as the water recedes. To do nothing, when it is known that a hazard exists, is inexcusable for those that should do something. To prevent floods in mines, data should be collected and something constructive done with those data, not alone for present conditions but for the future.

The National Institute for Occupational Safety and Health (NIOSH) has been working with diesel emissions control technology and the underground mining industry for a number of years. Underground isolated zone studies provided the emissions reduction performance of all of the alternative technologies currently available. A NIOSH/MSHA guide is available which provides mines with information and a process for selecting diesel particulate filters (DPF). Recent NIOSH experience suggests that more attention may be needed in managing the issues associated with diesel emissions and their control. The author argues that a holistic approach is needed which involves several key mine operations departments or disciplines by positing that workplace air can be considered as the product of a complex manufacturing process and examining how that process could be managed.

Condition-based maintenance (CBM) of industrial equipment is generally recognized as being the most cost-effective means for improving equipment availability. However, prerequisite to successful implementation of CBM is a reliable detector of failing components. One such detector, termed the effective negative-sequence impedance, had previously been identified as an indicator of induction motor stator winding degradation. However, a limitation of this detector is that it does not change in a predicable manner under certain motor operating conditions. This paper presents an experimental investigation of an improved technique for on-line detection of induction motor stator winding degradation. The paper begins with a brief description of the detectors, followed by a detailed description of the experimental setup, the experiments conducted, and results.

"In our laboratory several impactors have been developed in the past which have penetration characteristics that approximate that of the ACGIH or the British MRC respirable curves. In these impactors the large nonrespirable particles are collected on an impaction plate of a multiple round nozzle stage where the nozzles are of different diameters. The principle for designing a respirable cut impactor is quite simple in that the respirable curve is divided into two or more segments and the nozzles are designed with the correct diameters and number of nozzles to have collection characteristics with 50% cutpoints at the center of each segment. The particles not collected on the impaction plates are then collected upon a filter. These particles represent the respirable fraction of the aerosol. Therefore the respirable curve is approximated in a stepwise fashion with the approximation becoming better as the respirable curve is divided up into increasing numbers of segments. It has generally been felt that three segments is satisfactory for most cases.A new version of the respirable impactor has recently been developed in our laboratory. This impactor approximates the ACGIH respirable curve in three steps at a flow rate of 30 liters per minute. However, unlike previous models where all of the particles larger than the three cut points designated by the three steps are collected upon one impaction plate, a separate impaction plate is now used for each of the three cut sizes. To approximate the respirable curve in three steps, the cut sizes must be 2.2, 3.5 and 5.8 microns diameter. Therefore, on each of these stages the particles collected will be the mass of particles that are larger than these three cut sizes. By determining the mass of particles collected on each of these three stages plus that on the after filter using Gravimetric techniques, some information can be obtained on the size distribution of the aerosol being sampled. Furthermore, the impaction plates of the three stages are rotated and the nozzles are placed in such a position such that a uniform deposit is obtained on each of the impaction plates. Therefore, the deposits collected are suitable for X-ray fluorescence analysis or other types of analysis where a uniform deposit is required."

A primary objective of the Surface Mining Control and Reclamation Act is to establish uniform national regulatory standards to protect the environment during mining and for reclaiming land after it is disturbed by current and future surface coal mining. In recognition of the wide range of climatic and geologic conditions in coal-producing areas, Congress provided that individual states may establish their own programs for regulating surface and underground coal mining and reclamation on private land. The standards for state programs must be at least as effective as the federal standards. Initial and Permanent Regulatory Programs Congress recognized the importance of establishing regulations to implement the Act as quickly as possible, while recognizing that the preparation of such complex regulations would be a lengthy process. Consequently, a two-phase schedule was established. An abbreviated initial program was put in place immediately, followed by a more extensive and detailed permanent regulatory program. The initial program regulations were published in December 1977, and mine permits issued by states after February 1978 were required to conform with those regulations. Regulatory provisions contained in the initial program included 12 basic performance standards, continuation of existing state permitting, bonding, and enforcement processes (although if those features did not already exist, they did not have to be added), a federal inspection frequency of once every six months, joint state and federal inspection and enforcement in states that had existing programs, and the prohibition of mining in the specific areas listed in the Act. Permanent program regulations were published in March 1979, following extensive review and comment from the public, including the coal industry and organized environmental groups. The regula¬tory provisions in the permanent program expanded those in the interim program by including the implementation of all performance standards contained in SMCRA, a new permitting process, a requirement for performance bonds, an increased inspection frequency (one per month), a new enforcement process, and a process for designating lands unsuitable for surface mining. The regulations for the permanent program have been revised several times since 1979; more revisions can be made as new mining and reclamation tech¬niques are developed. Such changes were anticipated by Congress; in fact, a provision in SMCRA for experimental practices encourages advances in mining and reclamation techniques.
