IT is popular today to dramatize in a journalistic spirit, some particular factor among the causes of unemployment. Naturally the time chosen for such emphasis is usually when the factor in question is temporarily a particularly active one. A few months ago, in the unemployment then current, we saw largely the results of a healthy acceleration in changes in processes, greater efficiency, a more intensified use of labor-saving devices, perhaps also a change in products. So we have been hearing a great deal about the influence of mechanization on unemployment, the so-called technological unemployment. Many talk as if this kind of unemployment were a wholly new phenomenon, for- getting that it is a constant process in a growing industrialism, though it sometimes becomes more pronounced. At other times one would think that seasonal unemployment is the only type of unemployment, and then again the fashion changes and we hear .about nothing except cyclical unemployment. Every few years there seems to be a different fashion in labelling the germ supposed to be the cause of unemployment.

ABOUT 1929 an engineer was engaged to organize a Safety Department, lay out an educational program, and achieve a reduction in accident frequency. Due to the large number of employees, about 12,000, and the distances between the various properties, it was a big undertaking. Most of the workmen are from the Sierra and for generations have been agricultural people, with little conception of modern tools and machinery, and to a large degree are illiterate. However, gratifying results have been obtained, as evidenced by the accident frequency curve during the sixteen-year period. Safety offices have been established in each of the six major properties, staffed by men who devote their entire efforts to inspections of working conditions and equipment, instructions as to safe methods, and investigations of accidents. The Corporation is a member of the Inter-American Safety Council, receiving their publications and literature, which serve to keep us up to date and informed on modern methods. Dissemination of this material is accomplished chiefly through word-of-mouth and bulletin boards. When it is found that the accident rate is increasing in a certain occupation, as for instance underground haulage or mine hoisting, the operators so engaged are assembled and given renewed instructions on the safety code pertaining to their work. Inter-camp competitions in accident avoidance are being conducted, with annual awards for that unit having the lowest severity rate for the year.

It is proposed to consider here only comparisons made between results obtained when the materials employed are precisely the same, two furnaces at the same works for example, or the same furnace under different conditions as respects temperature of blast, method of charging, etc. With this limitation, the most important point in the comparison is the amount of fuel consumed per ton of iron. This, in fact, is the only item in the prime cost of the iron which can properly be said to vary in consequence of changes in the furnace process; for of the other principal items, the ore used per ton of iron, and also the amount of fluxing material, will depend on its richness, which, under the assumed conditions, will be practically invariable when taken over any considerable period; the labor cost also, from its nature, should be very nearly constant when estimated on the ton of iron. The structures formed when austenite is quenched to subcritical temperatures and allowed to transform isothermally have been the subject of intensive study since the work of Davcnport and Bain.' Isothermal transformation diagrams summarizing the results of many of these studies have become widely familiar to metallurgists. Of particular interest to metallographers are the dark-etchingl acicular products of transformation formed by isothermal reaction below the temperature of maximum velocity of the austenite to pearlite reaction. These products, the bainite structures, can he formed in a wide variety of steels. However, the constitution of bainite is not well understood and divergent views have been expressed as to its mode of formation. In this investigation a combination of dilatometric, microscopic and X-ray methods has been brought to bear upon the problem in the hope of some elucidation of the bainite reaction as it occurs in hypo-eutectoid steels. Mechanism OF Bainite Formation Davenport and Bainl considered the mechanism of bainite formation to consist of two steps—an allotropic transformation followed by precipitation of carbide. The separation in time of the two processes was considered to be very slight in the upper temperature range and very marked at temperatures just above the martensite range. This concept has been restated by Vilella, Guellich and Bain2 in the form of a definition of the acicular mode of transformation as: The successive, abrupt formation of flat plates of supersaturated ferrite along certain crystallographic planes of the austenite grains; this supersaturated ferrite begins at once to reject carbide palticles, (not lamellae), at a rate depending upon temperature In effect, this is the acicular mode of transformation, even though the temperature be such as to limit the actual life of the quasi-martensite to millionths of a second. The investigation of isothermal decomposition of austenite in certain alloy steels (notably those containing chromium or molybdenum) has revealed that there may be a range of temperatures between the pearlite and bainite reactions in which the austenite decomposes at a relatively low rate.3-6 Further, it is characteristic that in the second region of fast reaction the decomposition of the austenite is incomplete by one reaction but goes to completion by a second reaction. These observations led Wever7 to a description of the bainite reaction as follows: I. The reaction takes place by initial precipi. tation of a martensitic intermediate structure. 2. In the upper temperature range this structure readily decomposes into ferrite and cementite. In the lower range carbon separates in an unknown form. 3. Water laws important to the mining industry are those which govern or affect the right to use water, to dispose of water after using it in mining or milling, and to discharge waste material into watercourses. They include statutes and court decisions having general applicability, as well as others that pertain specifically to mining. THE INDUSTRY'S CONTRIBUTION TO WESTERN WATER LAW Despite sharp differences of opinion, the water law the Spaniards brought to the Southwest appears to have included some form of appropriation of water. The Mormons, who settled in Utah in the mid-nineteenth century, also developed a system of appro-priative water titles. But by far the most profound impact on western water law was made by the gold-seekers who flocked to the Sierra Nevada foothills of California after the discovery of gold in 1848. Much of the gold was extracted from the ground by hydraulic or placer mining, and so the miners' rights to the use of water became fundamentally important. Since there was no organized government in the foothills and no laws other than those made by the miners, they helped themselves to the land, the gold, and the water needed to work their claims.1 They established and enforced regulations governing the acquirement and holding of mining claims and their rights to the water they needed.' In 1879 Justice Field, former Chief Justice of the California Supreme Court, spoke for the U. S. Supreme Court in saying that the miners were "emphatically the law-makers, as respects mining, upon the public lands in the State."" Rules of the California mining camps were based on two essential principles: 1) priority in discovering claims and appropriating water by diverting it from streams and putting it to use, and 2) diligence in working claims and applying water in mining. The customs so developed, which were copied in mining areas of other states and territories, were enacted into law in one western jurisdiction after another. They form the basis of what is called the arid-region doctrine of prior appropriation of water, which received the attention of Congress in legislation recognizing and protecting appropriations of water for mining, agriculture, and other purposes on the public domain.' In several western states a great number of water cases decided in the early years involved relative rights to the use of water for mining purposes or for milling connected with mining." The miner's inch, the customary unit for measuring water in the mining camps, is still used in various western communities, although its relation to the cubic foot per second varies from one area to another. Undoubtedly, the miners of a century ago made the major contribution to the appropriation doctrine as it is now recognized and applied throughout the West. What inspired the California gold-seekers to develop these principles? Thoughtful writers have pointed out that their regulations and customs were strikingly characteristic of much earlier mining enterprises in the Old World.D It is said that the right of free mining and free use of flowing water therefor —so similar to the California conditions and practices—-was a part of the customs of Germanic miners in the Middle Ages, that it spread from middle Europe to other countries and colonies, and that the doctrine of prior appropriation was widespread in the important mining regions of the world. Certainly the Forty-niners came to California from many countries. It does not tax the imagination to consider that they may have brought with them some knowledge of the old Germanic customs and applied this knowledge in their new environment. RIGHTS TO USE OF WATER IN GENERAL In the West, rights to the use of water of watercourses fall into two categories—appropriative and riparian. The doctrine of prior appropriation is recognized in each of the 17 western states. The riparian doctrine is recognized concurrently with the appropriation doctrine in some of these states but has been abrogated in the others. The riparian doctrine prevails generally throughout the East, although there is now considerable interest in developing something else. Generally speaking, the appropriation doctrine has been highly developed in the West, whereas the principles of riparian doctrine have been comprehensively established in only a few states throughout the country. The subject of water rights is a big one. Space permits no more than a brief discussion of aspects that bear upon the title of this article. RIGHTS OF PRIOR APPROPRIATION Fundamental to the doctrine of prior appropriation is the principle first in time, first in right. Although in some states there are statutory exceptions. the original and still generally prevailing rule is that the first one who initiates a right to divert and use water of a stream, and who completes his undertaking with reasonable diligence, acquires thereby the first right of appropriation of the specific quantity of water involved. Each succeeding right in point of time is junior to all earlier rights but senior to all later ones. The practical effect of this priority system is that when the water supply is not enough for all, the earliest rights must be fully satisfied before any water may be taken by those later in time. Acquirement of Appropriative Rights: Each of the 17 western states has a statute under which water may be appropriated pursuant to a prescribed procedure. Generally, the first step to be taken by the intending appropriator is to file application in the office of the State Engineer for a permit to make the appropriation. QUESTIONS as to the methods of smelting ores and of obtaining metals I discussed in Book IX. Following this, I should explain in what manner the precious metals are parted from the base metals, or on the other hand the base metals from the precious'. Frequently two metals, occasionally more than two, are melted out of one ore, because in nature generally there is some amount of gold in silver and in copper, and some silver in gold, copper, lead, and iron ; likewise some copper in gold, silver, lead, id iron, and some lead in silver ; and lastly, some iron in copper2. But I will begin with gold. Gold is parted from silver, or likewise the latter from the former, whether it be mixed by nature or by art, by means of aqua valens3, and by powders which consist of almost the same things as this aqua. In order to preserve the sequence, I will first speak of the ingredients of which this aqua is made, then of the method of making it, then of the manner in which gold is parted from silver or silver from gold. Almost all these ingredients contain vitriol or alum, which, by themselves, but much more when joined with saltpetre, are powerful to part silver from gold. As to the other things that are added to them, they cannot individually by their own strength and nature separate those metals, but joined they are very powerful. Since there are many combinations, I will set out a few. In the first, the use of which is common and general, there is one libra of vitriol and as much salt, added to a third of a libra of spring water. The second contains two librae of vitriol, one of salt-petre, and as much spring or river water by weight as will pass away whilst the vitriol is being reduced to powder by the fire. The third consists of four librae of vitriol, two and a half librae of saltpetre, half a libra of alum, and one and a half librae of spring water. The fourth consists of two librae of vitriol, as many librae of saltpetre, one quarter of a libra of alum, and three-quarters of a Mbra of spring water. REPORTS from smelters show that all were so occupied with the in- creased production called for during the first half of the year that little time was devoted to metallurgical developments. Improvements which have been made such as gas-firing and other alterations ill the reconstructed Hayden smelter, will require time for reporting. The labor situation at all plants held the most prominent place and put all other problems in the background. Coming events of considerable importance concerti the construction of two new smelters. The Chino unit of Nevada Consolidated which has long had its concentrate smelted at the El Paso plant of the American Smelting and Refining Co. is constructing its own smelter at the property in New Mexico. The newest Phelps Dodge development of the Clay ore body at Morenci, Ariz., will call for another new smelter.

ANNOUNCEMENT on August 6 of the historic event of dropping an atomic bomb on Hiroshima, Japan, was more dramatic even than V-E day, since that had so long been forecast whereas the bomb production had been the best-kept secret of the war, even though at one time more than 100,000 people had been at work in connection with its production, and some two billion dollars had been spent on the project. Mining men had long been aware of an unexplained abnormal interest in uranium production, and suspected that something of the sort was on foot, while metallurgists were aware that various men of their acquaintance were engaged in some top secret research. The first announcement was soon supplemented by other official releases which told more about the research laboratories for theoretical and pilot studies, and the plants in Tennessee and Washington, but none of them made clear what the modus operandi is of these terrific bombs. Inquiry at Colum. bia University, where Dr. Dunning and his associates had succeeded in 1939 in splitting the uranium atom, and where laboratories known only as SAM have been feverishly active since the beginning of the war, was unproductive, since none of those officially connected with the project could give out anything beyond the official releases.

(San Francisco Meeting, September, 1915) THE iron ores of southeastern Cuba present a subject of exceptional geological interest. Their relations to the inclosing rocks are varied and in some cases unusual. The problem of their geological origin is not a simple one and for this reason has occasioned some divergence of views among previous observers. Profiting, however, by. these earlier studies and by more detailed field and laboratory observations as well as by the experience of added years of mining, much more satisfactory descriptions and interpretations can now be prepared. PREVIOUS WORK In 1884, interest in the southeastern coast of Cuba became active among the consumers of iron ore along the Atlantic seaboard of the United States. Active development was undertaken by the Juragua Iron Co., Ltd., a corporation affiliated with the Bethlehem Steel Co., and the Pennsylvania Steel Co. The property of the Juragua company, which is situated about 15 miles east of Santiago, was studied in June and July, 1884, by Dr. James P. Kimball, at the tine Professor of Economic Geology in Lehigh University and one of the best known of American mining geologists. Dr. Kimball published on his return two papers, the first important descriptions which we have of the local geology.1 It is

This paper describes displacement mechanisms of micel-lur solution slugs, displuced by a thickened water "mobility buffer", in a glass micromodel and in consolidated Berea sandstone cores. Colored motion pictures, taken through a microscope, recorded interactions on a pore-to-pore bash in the micromodel. Production and differential pressure data from consolidated cores previously waterflooded to residua1 oil saturation revealed displacement mechani.sm.s macroscopically. Oil is displaced miscibly, while interstitia1 water is displaced immiscibly by the injected micellar. solution slug. Part of this water is dispersed and carried near the lead ing edge of the .slug, and some may remain as a residual saturation. Thickened water displaces any residual water. It also emulsifies with the. slug material, thereby displacing it. The displacement sequence forms banks of oil and water with relatively constant fractional flows, saturations, and mobilities. The mobility of oil and water flowing ahead of the .slug defines .slug viscosity required for stable displacement. Equations are presented that describe. several aspecis of the displacement flow behavior: oil breakthrough, oil cut during production of the stabilized bank, breakthrough of banked water and the resulting decreased fractional flow of oil, fluid mobilities, etc. Breakthroughs, calculated from the equations, are compared with experimental data. Slugs of micellar sollution, ranging from 1 to 5 percent PV, produced unusually high oil recoveries (up to 100 percent) in previously waterflooded consolidated cores. Investigation of the effect of mobility buffer size on oil recovery indicated that recovery is reduced in 3-in. X 4-ft cores for mobility buffer sizes .smaller than 50 percent of the pore volume. Introduction A new oil recovery process,* conceived in 1962, utilizes a slug of micellar solution' that has sufficient viscosity to avoid an unfavorable mobility ratio with respect to the oil and water it displaces. These micellar solutions are composed of hydrocarbons, water, and surfactants, and may contain electrolytes and co-surfactants. The micellar solution is displaced by a "mobility buffer". The mobility buffer is a bank of reduced-mobility fluid, preferably an aqueous polymer solution. The entire system is displaced by unthickened water. This paper describes some of the microscopic and macroscopic displacement mechanisms observed during laboratory development of the fluids for a potential field test. Microscopic phenomena were observed photographically in a specially constructed glass flow model and macroscopic data were taken from constant rate, tertiary displacements conducted in Berea sandstone cores. Qualitative Description of Micellar Solution Flooding This section qualitatively describes displacement mechanisms that occur when a slug of micellar solution is injected into a previously waterflooded core. The slug completely removes oil from the portion of core it contacts, and banks oil in the process. The oil saturation in this bank and the flowing WOR reach definite, fixed values that are determined by water and oil mobilities and slug characteristics. This zone of constant WOR and oil saturation will be called "stabilized oil bank" in the following discussion. When this stabilized bank reaches the outlet end of the core, the oil cut jumps from zero to a constant value equal to the fractional flow of oil. Saline water has little or no solubility in the slug. Because of this. the slug displaces in-place brine immiscibly. During slug injection, most of the brine is displaced ahead of the slug, some is carried along in the leading portion of the slug, and part of the brine may become immobile. The immobile, residual brine is later miscibly displaced by thickened water. Displacement of all the oil and only part of the water during slug injection results in a higher fractional flow of oil ahead of the slug than occurs when all the water is displaced after injection of thickened water is begun. The slug spontaneously emulsifies fresh (low-salt content) water. By emulsification, the slug can become infinitely diluted, and hence totally displaced, by thickened water. (communication to the Secretary*):—In my paper on the Conservation of Natural Resources, I referred to the slow replacement of bee-hive ovens by the by-product ovens as a most notable instance of waste. And I quoted from Mr. Parker's report for 1906 an explanation given by him in accounting for the small production of by-product coke. It was that the market for the by-products of the coke-ovens was so limited that some of the ovens constructed were out of operation. His report on the manufacture of coke in 1908' does not record an improvement, and attributes the strange fact that we alone, of all the industrial peoples, delay the adoption of this cardinal improvement from the continuance of the same almost inexplicable cause. To quote again from his report, he says (p. 241): "The year 1908 was not marked by any notable gain in the construction of byproduct coking plants, though some new work was done. As the result of my stridy of them I came to the conclusion that, together with the oil of Hardin county (since extended to Beaumont by the work of Capt. Lucas) and the rock-salt and gypsum-deposits of the coast country, extending southward to the Rio Grande, these were simply a continuation of similar deposits in Louisiana described by Hilgard, Hopkins, and others; and I recommended the sinking of wells wberever they were found.

In answer to inquiries from members, Mr. Sheafer said that the culm-banks of which his paper gave the shipments were of about the average quality of the banks in the Mahanoy region of the Schuylkill field,.made prior to 1881 or 1882, when the practice of preparing buckwheat coal was introduced; but that in a very old hank, made about 1849, no coal above pea-size had been found. Apparently it was then the practice to ship everything. In reply to an inquiry concerning the utilization of the fine coaldust, Mr. Sheafer said that it was not utilized in connection with the washing described in his paper, but was carried away in the water as waste; that during Mr. Corbin's presidency the Reading Company built at Mahanoy City an extensive plant for making artificial fuel, but difficulty was encountered, due to the circumstance that the small coal from different collieries varied in its combustible quality and also in the amount of pitch required to be mixed with it, and he believed they concluded that from some varieties of the coal-dust a very good fuel could be made, but at a cost entirely too great for successful competition with cheap coal. Of course, the anthracite dust was not so well suited to this manufacture as bituminous slack. R. W. Raymond, New York City : I believe that was the practical outcome of the enterprise of a member of the Institute, Mr. E. F. Loiseau, now deceased. It was found, I think, as an additional drawback, that the manufacture of artificial compressed fuel from anthracite dust could not be successfully practiced with material so impure as that of the culm-banks. Consequently, the manufacture could be based on that source of supply only when accompanied with a preparatory washing. The most favorable location for it would be at large yards where the waste from the handling of coal, which is comparatively pure material, could be thus treated. I believe the manufacture of compressed fuel from bituminous coal was at one time a profitable business in Nova Scotia, but was destroyed by the indirect effect of the general introduction of watergas for illuminating purposes. IN making a glass model of mine-workings, each mine will present some little individualities, to meet which will call for the exercise of special ingenuity. Having made several models, I offer the following details of the model of the Montana-Tonopah mine-workings, believing that with small changes for different conditions the method described can be successfully used in making a glass model of the workings of any mine. The model, Fig. 1, has the top, one end, and the front removed. The case is made of kiln-dried pine, painted with several coats of dead-white paint. It is made to take sheets of glass 24 by 42 in. in size, and is 18 in. high, the workings shown being on a scale of 1 in. = 40 ft., or 4800 : 1 scale. The base is made of four pieces of 2-in. material, well pinned and glued together. The back, of material 1 in. thick, is secured rigidly to the base by screws and countersinking. The four posts, 1.5 in. square, are so cut that. the front and two ends of the model fit in flush with the outside edges of the posts. The top rails, 1 in. square, are fastened rigidly to the front and back posts by means of small iron braces. The ends, front, and top of the case are of 0.5-in. material; the ends and front are held in place at the bottom by pegs fitting into the base ; at the top the ends are held by buttons and the front by cupboard-hooks on the inside. Hinged hasps on the cover, fitting over staples in the end-pieces, make it easy to lock the entire case. Before the back is fastened to the base, it is cut with horizontal and vertical grooves to receive the horizontal and vertical sheets of glass, shown clearly in Figs. 1 and 2. The horizontal grooves, spaced to scale, represent the vertical distances between the levels at the shaft. The vertical grooves are placed wherever cross-sections of the workings are desired.

The general absence of surface-outcrops of important ore-bodies, and their occurrence, when present, at relatively low points, are noticeable characteristics of this district, and the statements made by Dr. Jenncy agree in general with our observations. The approximately horizontal upper limit of the Silver Gem ore-body in the Bullion-Beck mine is figured in this report, and mention made also of the horizontal pipes of ore found in several mines." PROMINENCE has been given lately in engineering circles to the question whether an organisation with manifold interests can be as effective as one with a single aim, especially if that single aim be the furtherance of affairs of moment and the welfare of engineers in general. In its earlier days, the A. I. M. E. was forbidden by its constitution to engage in non-technical public affairs, but the members altered the constitution in this respect, in the year 1912, in response to the growing demand that engineers be more human in their interests and that the engineering societies represent them in this respect. Since that time, the activity of mining engineers in public affairs has been growing rapidly, and we are happy that the Institute has been able to render very valuable economic services. Doubtless the greatest public service rendered by engineers in a recent great emergency was the work of the Naval Consulting Board, without which the U. S. Navy would never have been able to enter promptly into service upon our entrance into the war, ,and both Navy and Army would have been a long time without the munitions that came at an early date. We can never forget that this Board was established through the direct activity of the then President of the A. I. M. E., with the hearty cooperation of other national organizations.
