IT is indeed an honor and a responsibility to have been selected to present the thirty-fourth in this series of Henry Marion Howe lectures, established to perpetuate the memory of a great teacher and one of America's outstanding scientists. Previous Howe lecturers have established high standards for this annual AIME event. It has been my good fortune to have enjoyed close association with five of these former lecturers; namely, Bain, Grossmann, Johnston, Sosman, and Vilella, all of whom have been prominently identified with the research activities of the organization with which I am connected. Some years ago I had an opportunity to examine a letter written by Professor Howe in 1904. This document was particularly interesting to me since I never had the privilege of personal acquaintance with Professor Howe and do not recall even having seen him during his long and active career. In view of the fact that the letter dealt, to some extent, with matters related to the subject of today's lecture, I would like to quote briefly from it. The letter is datelined, "Bad Kissingen, June 11, 1904." The salutation reads, "Dear Bradley," which suggests that it was probably addressed to Bradley Stoughton, who, I believe, was working with Howe at Columbia University at that time. The letter reads, in part, as follows: "Austenite and Martensite. I have not examined what Osmond says in his new book. His former remarks about austenite I found very confusing, indeed unintelligible. I think we can reconcile matters well enough for the present by assuming that martensite is a transition step between austenite at one end and ferrite and cementite at the other. Above critical range for steel of 0 to 1.80 carbon, austenite is normal state; below Ar1, ferrite and cementite are normal." The letter then continues with a discussion of Osmond's ideas on metallographic nomenclature, particularly his use of the terms martensite, troostite, and sorbite, including the following pointed comment: "For common purposes it seems to me unwise to drag them in, and much simpler to confine ourselves to the end stages Austenite Ferrite plus Cementite Osmond does not really know his own mind— or does not clarify his ideas to others—as to nomenclature." From the Pittsburgh coal bed in the four states of Pennsylvania, Ohio, Maryland and West Virginia has been produced an output that, at mine prices, represents a greater value than any other single mineral deposit in the world has yielded.12 While this distinction may in a few years pass to the gold reef of the Witwatersrand, it is possible that eventually, owing to the tremendous reserves still remaining, the ultimate yield of the Pittsburgh bed will be greater than that of any other known single deposit. Considering its importance, not a great deal has been written of its early history and development as a whole; most of the accounts have been of limited localities, or, at the most, of the area within a single state. In "Coal through the Ages" the writer mentioned some references to its early history, but this study will deal not only with its history but with the character of the bed, where and why it was first developed, and its effect upon the states in which it is found. It has not been the intention to write a detailed history of the development of the seam in each locality, as neither time nor inclination were available for doing such work, but only to show the influences that tended to hasten or retard such development. In general the historical matter ends about 1830, when geological surveys began to be made. Some of the maps show data available only since that time, and the sections about coal preparation and coking have been extended to the present time to show the changing conditions. It is believed that the early history includes all published records, and many more sources than those shown in the bibliography were consulted. It is quite likely that some references to coal in this area may be found in the unpublished papers of some of our early soldiers and colonizers, which exist in several libraries, and it is hoped that some future * Dedicated to Dr. Thomas S. The knowledge-feigning, theory- straining mining engineer." -Anonymous INTRODUCTION Taxes levied against mining properties and operations are a critical cost in the economic evaluation of mining investments. Indeed, taxes represent a substantial cost of doing business in the minerals industry and often have a significant impact on corporate investment decisions. A good example was the postponement of mineral development in the state of Wisconsin, primarily because of what was perceived to be excessive taxes imposed by that state. In many respects mining investments are no different from other industrial investments. Astute taxing authorities should recognize that geologic endowment is a necessary but clearly not a sufficient condition for mineral investments. The fact that a mineral deposit exists does not necessarily mean that it will ultimately be developed-a point that many taxing authorities fail to recognize. While it is true that ore deposits are not mobile in the sense that they cannot be physically moved to a district having more favorable taxes, corporate investment capital certainly is mobile and flows to ventures which maximize wealth to the firm. In short, higher taxes reduce project yields and tend to drive investment capital elsewhere. The appropriate type and level of taxation imposed upon the mining industry continues to be a very controversial and emotion-charged topic. Mining activities have been taxed at various levels over the years due to widely differing taxation philosophies. Location has also influenced taxation policies, as evidenced by the diversity of tax laws and assessment procedures applied to mineral deposits by the various states. Indeed, mineral taxation varies from state to state, from county to county, and from one mineral commodity to another. Whether or not a given tax is appropriate for a specific mineral deposit, or even an industry, is a difficult problem to assess. First, the type or kind of tax which should be imposed must be considered. Second, it is most important to define a fair and unambiguous base against which to levy the tax. Finally, one must consider the tax rate to be applied to this base. It is the combination of these two components

Only in recent years has any practical headway been made in the application of aerial photography to geological problems, and up to the present time its principal value to the geologist and mining engineer has been in "areal geology;" i. e., the study of formations as revealed at the surface. The object of this paper is to set forth briefly the principal advantages that may be derived from aerial photographic data in geological work and to serve in a measure as a guide to those who may be contemplating its use. Geophysical prospecting has for object the locating of mineral under the surface. Inasmuch as the geologist's chief complaint in life is a dual one—inability to see under the surface and inability to visualize comprehensively what he does see on top of the ground—geophysical prospecting coupled with aerial photography should do much to lessen his burdens. To what extent aerial photography can be made a useful adjunct to geophysical prospecting remains to be proved, but the inference drawn here is that it holds many alluring possibilities. To avoid disappointments, it should be stated at the outset that to the geologist or mining engineer an aerial photograph or mosaic is only a tool, the efficient use of which he must set out to master. Upon his skill and ingenuity in applying it to particular problems will depend largely the value of the results that he will obtain. Under the most favorable conditions an aerial mosaic, or even a few loose photographs, because of the exceptionally comprehensive oversight which they afford of field data, such as dips and strike observations at isolated outcrops, local indications of faulting, mineral and fossil finds, greatly facilitate study and correlation, save much tedious foot work, and may repay their cost many times. Even so, types of country may be found where the most skillful use of the best of pictures will produce results so meager as to render the cost of aerial photography entirely unwarranted. Between these two extremes will be found endless variations and possibilities. Hence no set rules can be promulgated. The safest procedure is to treat each case as a separate problem and to carefully weigh the relative advantages and shortcomings of aerial photography before embarking on its use.

To the Board of' Trustees, United Engineering Society I beg to submit herewith the report of the Treasurer as of December 31, 1907. Your attention is called to the fact that the resources and liabilities, receipts and disbursements statements cover all the financial transactions of the United Engineering Society from its organization up to December 31, 1907. The income and expenses of operating the building during the whole operating period from December 1 to December 31, 1907, somewhat in excess of twelve months, are given. Included in the expenses, amounting in all to $52,647.11, will be found an item entitled "Building Equipment (construction account)." The expenditures under this item were not made for the operating expenses of the building, they represent a construction account, properly speaking, covering expenditures for furnishings and equipment of the building. The Founders' Agreement specifically provides for this class of expenditure under the provision that the Founder Societies shall each be liable for a charge not to exceed $200,000 of principal, which shall include the land and building completed and ready for occupancy, together with the " furnishings, equipment and personal property therein." Certain details of equipment are yet to be supplied, and it. is proposed in the near future to call upon the Founder Societies for an assessment on their respective land and building funds to cover this item of building equipment. Such action would enable the item of $10,039.85 to be transferred to the income account and reduce correspondingly the assessment

Abstract-The sharp drop in world phosphate demand that took place in 1975, due to temporarily high prices, now seems to be reversing itself. And prices for both phosphate rock and phosphate fertilizers, which declined dramatically from their 1975 highs, now appear to be bottoming out. This recent price weakness has delayed new mining ventures that had previously been planned for completion by around 1980. While there is ample capacity to supply near-term rock needs, the stage seems to be emerging for a better supply-demand and price environment in the late 1970's and early 1980's.

INTRODUCTION. This paper is a discussion of a part of the mineral wealth of the States of Oaxaca and Puebla, Mexico. It does not refer to the precious metals, some miles of which, in these States, are said to have been worked before the advent of the Spanish conquistadores in the sixteenth century, as my purpose is to invite attention to the exploration of deposits of coal and iron-ores in the Mixteca region. The prominence given to coal is warranted by the great effect of the scarcity of fuel upon the industrial development of Mexico. Under the progressive administration of President Porfirio Diaz, the Republic has made wonderful advances in the past three decades; and this progress would have been greater but for the limitations imposed by expensive fuel. In the spring of 1906 I was detailed by the Birkinbine Engineering Offices, of Philadelphia, to accompany A. B. Adams, of New York, in a reconnoissance of reported deposits of iron-ores in the State of Oaxaca. The result of this expedition was the formation, in 1907, of the Oaxaca Iron & Coal Co., of which Mr. Adams became, and has remained, President and General Manager, and I have spent the past three years as Chief Engineer of this company in Mexico, principally in western Oaxaca, where field-headquarters were established. EDUCATIONAL trends as reflected in curricular changes are of interest and importance in engineering educa¬tion both as matters of record and as considerations for the future. The data on which the evidence of this report is based were obtained by sending questionnaires to all schools in the United States granting the undergraduate degree in mining engineering, metallurgy, or metallurgical engineering. The questionnaire had two parts, one inquiring as to the general nature of revisions made or planned, and the other asking for information on specific courses added to or dropped from the curriculum, or given more or less time than formerly. The frequency with which curricular changes are made, even in normal times, is notable. Although it was expected that the period since 1939-40 would show numerous revisions, it was somewhat surprising to find that of 62 mining or metallurgical curricula in existence in 1939-40 and reported in the present survey, 58 had been revised or are shortly to be revised, 52 having already been changed during this period. Moreover, approximately half of the mining schools that have already revised their curricula, and probably a similar proportion of the metallurgical schools, are about to make further important changes.

ZINC smelters in the central western. States have established a very high standard of purity for blende-concentrates, viz., zinc 60, iron less than 3, and lead less than 1 per cent. The very low percentage of iron is made possible by the blende containing less than 0.5 percent of isomorphous iron sulphide and by the sparing occurrence of pyritic material in the large blende-deposits of southwestern Missouri and southeastern Kansas. The blende in these districts occurs in sub-Carboniferous limestone, and is associated with chert, residual clay, calcite, pyrite or rnarcasite and bitumen. The different minerals are coarse and therefore readily separated by mechanical washing from the blende, with the exception of pyrite and marcasite, as blende has a specific gravity of from 3.9 to 4.1, marcasite, from 4.85 to 4.90, and pyrite, from 4.95 to 5.10. The common procedure of dressing the ores is to crush in a breaker, size in a trommel with 0.5-in. holes, pass the over-size through roughing-rolls and then jig the ore, now reduced to 0.5 in. maximum size, in roughing multiple-sieve jigs. The products of these are waste-tailings, sine-discharge coarse concentrates, side-discharge coarse middlings and bottom-discharge fine middlings. The coarse concentrates are sent to the market. The coarse middlings are crushed in middlings-rolls and brought back into the system by feeding into the main trommel. The fine middlings are cleaned upon finishing-jigs. THE preparation of specimens for microscopic examination from metal articles of relatively large cross-section offers no particular difficulty. It often happens, however, that articles submitted for examination are so thin that specimens satisfactory for microscopic examination can not be successfully pre- pared by the methods commonly employed when working with larger articles. Ordinarily, the preparation of metallographic specimens involves the following operations : (1) cutting the small specimens to be examined out of the larger mass of metal, (2) cleaning and electroplating, (3) mounting to furnish support during the grinding and polishing operations, (4) grinding and polishing to produce a scratch-free surface, (5) etching and drying. All of these operations must be carried out in such a manner that when the specimen is finally examined under the microscope, the structure seen is a true and well-defined representation of the structure that the larger mass of metal possesses at the place where the small specimen was removed. It is important that the deformation involved in cutting out the specimen be as slight as possible, in order that the subsequent grinding and polishing operations will completely eliminate the cold- working effects in the vicinity of the cuts. It is also important that the specimen never be allowed to attain a temperature high enough to alter its structure; the maximum permissible depends on the metal being handled. With some metals, zinc for example, consider- able care must be taken to avoid heating; with other metals, annealed steel -for example, no particular pre- cautions need be observed because there is no tendency for structural change to occur at relatively low temperatures.

INTRODUCTION The Japanese dependency for mineral raw materials from foreign sources increased rapidly within the 20 years since the Korean war. During this 20 year period Japan has attempted to industrialize and develop her economy while depending mostly on heavy import of nearly all kinds of mineral raw materials. She has fabricated them using energy generated mostly by mineral fuel that are also imported. Fabricated goods are either used domestically to accelerate more fabrication industry or exported after adding more refinement or fabrication. In this paper iron ore as a major raw material for the Iron and Steel industry, three major base metals, copper, zinc and lead, and petroleum as a major energy source have been selected as examples to represent the general features of various kinds of mineral raw materials that are imported. Among other important mineral commodities for which Japan dependa upon foreign sources are: Aluminium, nickel and cobalt, potash and phosphorous 100 percent dependent and tin, tungusten, chromium and molybdenum over 95 percent dependent. IRON ORE Statistics for the important iron and steel raw materials, namely iron ore, coal and scrap iron are shown in Tables 1, 2 and Fig. 1. Iron ore is by far the most important and basic among these three commodities. There has been practically no steel or iron imported as a metal into Japan during this period. Iron ore, including aggregate such as pellets, and metallurgical coal are mostly transported in large ore cargo boats to the port where very efficient port facilities unload them directly at the steel mill site. Existing measurements for the steady-state permeation of hydrogen in a iron above 100°C have been examined for contribution of determinate errors. The analysis leads to a recommended equation for the permeability of hydrogen in a iron: o= (2.9 ±0.5) x 10-3 exp - (8400 ± 400)/RT cu cm (ntp H2) cm-1 sec-1 atm-1/2 THE permeability of a iron to hydrogen has been the subject of numerous investigations over the past 40 years, and at present there are thirteen sets of published results for the rate of steady-state permeation of hydrogen in a iron above 100°C. The numerical values in each set of results are entirely self-consis-tent, but the spread among the sets is too large to be attributed solely to experimental error, i.e., to error other than in the specimen itself. Several reasons have been advanced to explain the disparities, but to date the relative importance of experimental inaccuracy to the spread remains uncertain. The purpose of this report is to examine in detail the sources of determinate errors inherent in the experiments and to assess as far as possible the contribution of the errors to the results. The ultimate goal is the selection of values for the permeability and heat of permeation most nearly representative of hydrogen in a iron. The analysis is limited to those experiments in which the permeation rate was observed at steady state—a condition in which traps for hydrogen within the metal are filled to a fixed level15 so that the trapping mechanism is not reflected in the rate of passage of the gas. Furthermore only data are examined in which surface processes are judged to have little or no influence on the flow. It is hoped with these restrictions to obtain values of the permeability and the heat of permeation which will be as closely related as possible to the mechanism of lattice diffusion. I) DEFINITION OF TERMS; UNITS In this report the data for permeation are given in terms of a coefficient oj permeability, ?, which is defined by the equation: jt=?A/?x{p1/2-po1/2) [1] where jt is the total flow of gas normal to the surface of a membrane of planar geometry, e.g., a disc, of area A and thickness ?x; pi and po are the pressures in the input and output sides, respectively. For flow radial to the walls of a membrane of cylindrical geometry, e.g., a tube, the corresponding equation is: where 1 is the length of the cylinder, and ri and ro are the inner and outer radii, respectively. The flux normal to the surface is given by Fick's law: j= -D(dc/dx) [3] At steady state the concentration gradient will be constant, and integration of Eq. [3] gives for the total flow through a disc of area A and thickness Ax: h =-DA(co - ci) [4] where c, and ci are the concentrations of solute at the output and input surfaces, respectively. When surface control is absent, co and ci are given by Sievert's law c = Kp1/2, and substitution therewith into Eq. [4] gives directly Eq. [I] where ? = DK. Integration of Fick's Eq. [3] in cylindrical coordinates will give Eq. [2] where again ? = DK and is thus shown to be independent of geometry (provided that surface control is negligible). The coefficient of permeability, or simply the permeability,* must be expressed in proper units. In *The term permeability will refer in this report always to the coefficient defined above; permeation will be used to specify the general phenomenon of gas passage through a membrane. this report ? will be expressed in the units of cu cm (ntp H2) cm-1 sec-1 atm-1/2. The variations of D and K with temperature are given by D = Do exp(-Ea/RT) and K = KO exp(-?Hs/RT) where E, is the activation energy for diffusion and AH, the heat of solution, each usually expressed in calories per mole of solute. The variation of permeability with temperature will thus be given (for conditions where surface control is negligible) by ? = ?o exp(-?Hp/RT) where ?0 = DoKo and ?Hp = Ea + ?Hs. The units of ?0 are the same as those of 6, and??Hp will be expressed in calories per mole H. 11) SUMMARY OF PERMEABILITY RESULTS Table I gives the values reported to date for the permeability of H2 in a iron in terms of ?o and ?Hp. Except where noted the parameters listed were taken directly from the numbers reported by the various investigators with only a change in units. The temperature limits within which the listed ?o and ?Hp hold are given in column 7; the limits marked in parentheses in this column indicate the entire temperature range covered in each investigation. The listed values of ?o and ?Hp are those giving a linear plot of ln? against T-1 at the higher temperatures in each set of measurements, and thus presumably represent the case for which surface control was negligible. The recovery process in 400 Monel filings was followed, principally, by using the Warren-Averbach technique of X-ray peak profile analysis. The deformation fault probability, a, was 0.006 in samples of unannealed filings. a , the twin fault Probability , was approximately 0.002 in samples of unannealed filings. Both a and 0 were found to "anneal out" at 600°F. The effective particle size and mzs strain increased and decreased in the (111) direction, respectively, with increasing annealing temperature. The actual particle size was found to be almost equivalent to the effective particle size. Tile small values of deformation and twin fault probabilities accounted for the similarity in values of the effective and actual particle sizes. Stored strain energy and dislocation density calculations based on rms strain decreased with increasing annealing temperature. The dislocation density decreased from 10" per sq cm in the unannealed filings to 10' per sq cm in the partially re-crystallized filings. The square root of the dislocation density based on strain to that based on particle size indicated a random dislocation distribution in the unannealed filings. The dislocation arrangement changed to one with dislocations in cell walls with increasing annealing temperature. THE recovery processes which occur in metals are generally thought to be a redistribution and/or annihilation of defects.' Investigators' have shown that recovery processes can be characterized by X-ray line-broadening analyses. Michell and Haig4 measured the stored energy of nickel powder by calori-metry and found the value to be greater by a factor of 2.5 than that from X-ray data obtained by the Warren-Averbach technique.= Minor increases in particle size occurred up to 752°F (recovery), while above 752°F the particle size increased greatly due to recrystalliza-tion. X-ray microstrain values decreased between room temperature and 392"F, remained constant from 392" to 752"F, and decreased from 752°F to a negligible value at 1112°F. Faulkner developed an equation for calculating stored strain energy based on X-ray line-broadening data which gave a closer correlation of measured and calculated stored strain energy based on the data of Michell and Haig. The stored strain energy released during recovery is predominately dependent on the decrease in dislocation density which was p-enerated from cold work.7 Stored energy has been measured8 in alkali halides during recovery and recrystallization and 80 pct of the stored energy was found to be released during recovery. Dislocation distributions have been studiedg in a number of fcc metals by thin-film electron microscopy. Howie and Swann" found the stacking fault energy of copper and nickel to be 40 and 150 ergs per sq cm, respectively. ~rown" has pointed out that these stacking fault energy values should be corrected to 92 and 345 ergs per sq cm, respectively. The dislocation distribution of a metal is directly dependent on the stacking fault energy of the system. Metals of high stacking fault energy such as aluminum cross-slip readily and do not form planar arrays of dislocations. Metals of lower stacking fault energy such as stainless steels" do not cross-slip readily. Cold-worked nickel has been found to form a cellular dislocation structure after annealing.13 The relatively high stacking fault energy of nickel and copperlo to a lesser extent favor cellular structures of dislocations rather than planar arrays after deformation. The present study of recovery was carried out on a Ni-Cu alloy (Monel 400) to compare with prior studies for pure nickel and pure copper. X-ray line-broadening techniques were used to measure the effect of recovery temperature on rms strain and particle size and the results were compared with previous studies on copper'4-'7 and nickel., Calculations were also made on stacking fault probabilities, dislocation density, dislocation distribution, and stored strain energy as affected by temperature. EXPERIMENTAL PROCEDURE The nominal analysis of the Monel 400 used in this investigation was: 66.0 pct Ni, 31.5 pct Cu, 0.12 pct C, 0.90 pct Mn, 1.35 pct Fe, 0.005 pct S, 0.15 pct Si. The annealed material was cold-reduced in two batches, one 50 pct and the other 80 pct. It was originally planned to conduct line-broadening studies of these bulk samples; however, rolling textures that developed produced low-intensity peaks which were not suitable for line-broadening analysis. Filings were prepared at room temperature from both the 50 and 80 pct cold-reduced specimens, series A and series B, respectively, and were not screened prior to heat treatment or X-ray studies. Heating to the annealing temperature, 200" to 120O°F, was accomplished in a matter of minutes in a hydrogen atmosphere. Following heat treatment, some of the filings were mounted and polished for microhardness measurements with a Bergsman microhardness tester, using a 10-g load. A G.E. XRD-5 diffractometer using nickel-filtered Cum radiation was used to obtain all diffraction patterns. BIANCO*—I should like to ask Mr. Collins if that statement he made about the addition of drosses to the blast furnace slowing down the blast furnace is a result of his own experience or a result of the experience of some older metallurgists; and perhaps I should ask him to define the type of drosses that he means. A. A. COLLINS (author's reply)— That has been my own personal experience with dross. On various occasions at Chihuahua we attempted to incorporate the dross in our regular blast furnace charge and to shut down the dross re-verberatory to try to save some money. As expected, we had very poor results. I think that Ed Fleming will well remember on one occasion, that was back about 1933, when we attempted the first experiment along this line, and as a result of the sulphur addition to the blast furnace to matte out the copper we ended up with hanging furnaces and mushy slags and abandoned the dross experiment, once again turning to the use of the reverbera-tory for handling dross. H. R. BIANCO—Is that dross you refer to from the drossing kettle ? A. A. COLLINS—Yes, the dross that I am referring to came from drossing kettles. Furthermore, to back up my previous assertion, I had occasion in 1943, while up at Leadville, to once again experience the routing of dross through the blast furnace with its sulphur addition, since they had no dross re-verberatory, and to observe that once thf dross was removed, the furnace was speeded up almost 100 tons a day. All of these are personal experiences and I think that Mr. Feddersen also has had a little experience along this line —in fact, I believe all of us have had some experience. H. R. BIANCO—I know at Trail they recirculate considerable dross through the blast furnaces and we also recirculate dross at Herculaneuin and I am not aware that it has done much towards slowing down the blast furnace. A. A. COLLINS—We have always had very poor results. In the first place you have got to add a sulphur addition to pick up that copper and once you do that, that sulphur is apt to combine with some of the zinc and you are going to form a little mush; before you know it you have furnace hangs and a poor working furnace. Now of course that depends on the amount of zinc you have on charge. But in 1943, Leadville had roughly about 7 pet zinc in their slag and it worked very poorly. Previously when they had 4 or 5 pet zinc in their slag it did not matter. B. L. SACKETT* At Tooele we had a great deal of experience with copper. We have always been able to keep a lead well, however, in spite of the fact we have run as much as 5 pet copper and only 15 pet lead on the charge. But regarding the handling of dross, our dross reverberatory furnace is only 7 or 8 years old. Before that we recirculated the dross through the furnace and thought we were doing a pretty nice job. Of course these things are all more or less relative—in other words you establish a certain condition much better than one of a few years ago and possibly as good as any other of which you know and you think you have pretty good results. When we first took the dross off of the blast furnace and put it through the dross reverberatory furnace we immediately found out that we had gained something very real in furnace speed. Since that time there have been occasions when, because of the dross reverberatory being down, we have had to use dross again through the blast furnace and that has checked our original experience in slowing down the furnace very definitely. So we feel that a dross reverberatory is a very valuable asset at the Tooele Plant. A. A. CENTER*—Mr. Sackett's being here reminds me of trying to run with a minimum of lead concentrates the maximum of dross producing electrolytic zinc plant residue. He came up from International Smelting Co. to help us get started on that. We took an old copper blast furnace at Great Falls, Montana, and made a lead furnace out of it by putting a lead well on the other long side which of course is a very unorthodox lead blast furnace. Our aim was to treat the residue from the electrolytic zinc plant, as I said, with a minimum of lead concentrates. That meant a maximum amount of dross. At that time selective flotation was not general practice, so our zinc concentrates ran relatively high in copper and other dross-producing elements; and of course these were largely in the zinc plant residue. I think we might call it muscle metallurgy, but we had an interesting, successful experience there and we ran for over a year thanks to Mr. Sackett's helping us get started. I have the details, but time does not permit. We did well enough so that the A. S. and R. Co. at East Helena kept boosting up the offer to us for the electrolytic zinc plant residue and there was not enough lead concentrate to supply two lead smelters there in Montana, so the matter finally finished up by the A. S. and R. Co. taking all of the residue under long term contracts.

Costly damage by severe wave attack to many engineering structures has illustrated the need for a consideration of the nature of wave action in plans for offshore drilling operations. Using wave data it is possible to answer questions pertaining to engineering problems such as platform elevation, structure orientation, and expected wave forces. For locations where wave records are not available a technique can be used to obtain information about wave characteristics from past meteorological data and near shore submarine topography. Forces exerted on structures by waves may be divided into four parts. A completed study is given in which frequencies of various wave heights and maximum frictional drag forces are computed for a typical offshore drilling site. INTRODUCTION Waves of tremendous proportions accompanying hurricane winds crash against breakwaters and other offshore structures causing untold damages. Wave forces exerted on structures at these times are enormous, as shown by past records of incidents where massive portions of breakwaters have been broken off and moved by waves. On other similar occasions, whole structure; have been unloosed and smashed or floated away. These incidents, which seem almost incredible, serve to illustrate the great amount of energy contained in large waves, and to show that this energy results in powerful forces destructive to offshore installation~ which are not designed sufficiently strong to withstand wave attack. In the past the expected frequencies of waves having various characteristic.% have rarely been considered in the design of structure affected by wave action. As a result, many structures have failed to accomplish the purpose for which they were designed or have collapsed under wave attack. Others have been constructed to withstand greater wave energy than is ever encountered, with resulting waste of material and construction time. In this study an analysis is made of the frequencies of waves having different characteristics which affect the plans for offshore drilling installations. After such an analysis the erection of these structures can proceed with less risk involved and with more efficiency and economy. ENGINEERING ASPECTS In the offshore drilling program wave forces play an extremely important part in design and construction of drilling rigs in shallow water. The design of a platform or other structure from which drilling equipment is operated is critical, becauze any damage to the platform may endanger personnel and result in complete loss of equipment. Since a platform built too close to the water would be battered by breakers, and one built unnecessarily high would involve undue expense, it is necessary to know the most desirable elevation at which the platform should be erected. This is only one of many questions about structural planning which can be answered using existing technique for determining wave characteristics. The purpose of efficient design for the portions of many types of offshore structures which are acted upon by wave forces is the same as that of all designs which deal with frictional forces of a fluid on a solid. For these structures the problem is comparable to that encountered by undersea craft moving through water, except that in the case of a fixed structure the force is produced by the water moving past the model. For off shore sructures which are extremely rigid the frictional forces may be nearly negligible compared with the impact or shock forces imparted by breaking waves. In all case; the better design is that which offers the least resistance to the opposing forces. From a consideration of wave forces, each drilling structure varies in efficiency depending upon the type and amount of superstructure in contact with the waves. For example, round piling and bracing offer less resistance to wave forces than do I-shaped ones. All network superstructure such as cross bracing should be kept to a minimum and at as low an elevation as possible, so that it will not expecience the pressure exerted at the tops of breaking waves. Models of proposed structures can be tested in wave tanks and in the field to ascertain the efficiency of specific designs. Past experience in beach and shoreline engineering has shown that, although changes in the topography of the bottom very near shore do not seem to be occurring, the natural forces involved may be in a delicate balance such that a static state exists. Interruptions of any of these natural forces by erecting offshore structures are likely to cause undesirable effects. Changes in beach profile result partly from sediment being brought into suspension by the orbital motion of waves and partly from the transport of sediment by longshore currents. With the erection of an offshore structure and consequent change in the combined effects of these two forces, unfavorable deposition upon, or erosion of, the bottom at the site may occur. Therefore, combination wave and current studies are essential for the solution of problems involved in the design of most marine structures. TECHNIQUE FOR OBTAINING WAVE INFORMATION In determining the probable effect of wave action on an offshore drilling structure, it is first necessary to know the usual frequencies of certain wave types for the given location. INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation.
