ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. (b) An individual who has devoted long and dedicated service to the corporation and to its goals and purposes may become a life member of the corporation upon being elected to that status by the Board of Directors, and such individual shall retain such status for life. (c) An individual who has been at any time an active member of the corporation and who has reached 70 years of age may become a senior member upon payment of such annual dues as the Board of

Pictured on these pages are the seven RMCMI Scholarship Award Winners for the 1992-93 year followed by a brief profile. All winners were present as guests of the Institute at the June convention in Beaver Creek, Colorado to receive recognition at the Institute Awards Luncheon Monday, June 28. 1993. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Alan Czarnowsky, each winner receives $750 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the member state. (3) That the recipient have good academic standing, be pursing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship pro- gram and the various vice presidents contribute the travel expenses to convention for these outstanding young collegiates. It is sad to see people out of work in this country, but the third world is largely undeveloped, and many jobs are moving abroad." Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,

Profiled here are the six RMCMI Scholarship Award Winners for the 1987-88 academic year. Five attended the Diamond Jubilee Convention as guests of the Institute at the June 83rd Regular Meeting held in Snowmass Village. Colorado. Each received a recognition plaque and $500.00 to be used toward tuition in his junior year beginning September, 1987. Keith McGinnis. Scholarship Chairman, personally interviewed candidates at three of six colleges and universities in the program. As this is a continuing award the winners this year and those from last year will receive an additional $500.00credit toward tuition if they maintain a satisfactory academic average and are again recommended by their colleges or universities. The Morning Session of the Forty-Eighth Meeting of the Rocky Mountain Coal Mining Institute convened in the Little Theater of the Broadmoor Hotel, Colorado Springs, Colorado, at 10:00.a. m.; June 2, 1952, Howard B. Crandell, President, presiding. PRESIDENT CRANDELL: Gentlemen, the meeting will come to order. I presume most: of you have heard the decision of the Supreme Court in the steel case. The decision was six to three that the President had no legal authority to seize the steel industry, and it is reported that the strike is already under way. Gentlemen, it is both a pleasure and an honor to talk to you who come to the meeting of the Coal Mining Institute, many of you, from long distances. Our program committee has suggested that the president give a 30-minute talk, but you may be at case because I assure you I won't take anywhere near that long, when we will pass to more instructive and enlightening subjects. Another reason for the short talk that I am going to make is that many men in this audience know more about coal mining, specialized subjects, than I do.

PRESIDENT WHITESIDE: I am sure we are very grateful indeed for this very interesting talk that Mr. McClure has given us. If anyone has any questions to ask Mr. McClure I am sure he will be glad to answer them at this time. MR. WEITZEL: I want to ask Mr. McClure whether in the instance he described by-passing the drier, whether there was any rest period between the crusher and the furnace, whether the powdered coal that was not dry was allowed to rest in the pipe or was blown directly into combustion chambers. MR. McCLURE: Yes, it moved directly; there might have been some difference had we given it an opportunity to rest. We just had to get in and get out so as not to interfere with operations. MR. WEITZEL: Your idea is, even though you did use a high moisture lignite, you could store it under water if you eliminated surface moisture later. That is a new idea to me; I always had thought that you had to reduce the moisture down under 2 per cent, and to try to store it with anything more than that, any higher moisture, you would have to break the stuff loose again, as it gets so hard it won't move. MR. McCLURE: It might develop I am absolutely wrong; I am just saying what I observed, and I may have had some unusual condition, which I did not detect; something may actually develop which will make my statement of drying lignite entirely wrong. Thank you Clark, for that extraordinary introduction, but Paul Harvey would be disappointed if I didn't tell you ... the rest of the story. It's true that I began my career at the Boston Traveler newspaper, one of the last of the breed that started as an office boy and eventually advanced to staff reporter. However, what the biography doesn't tell you is that after that stellar rise to prominence in the Boston financial community, the afternoon Traveler was merged into the morning Boston Herald, and I was out of a job. Between the Traveler - which I closed - and the Brockton Enterprise - where I helped bring about the first labor strike in the newspaper's 100 year history - for a short period I worked double shifts at a bomb factory where we made beanbag mines for use in Vietnam. That is until the plant blew up one morning between my shifts - my last shift, as you can guess. Incidentally, my job was quality control. Before accepting my first public relations job with Boston Gas Company - and handling the media during that companies longest strike in history - I worked part time as a police officer in the small Massachusetts town of Halifax, during which time I wrecked the town's only patrol car - twice. Having contributed all I could to Boston Gas Company, I moved on to the parent company - Eastern Gas and Fuel Associates - where I was instrumental in closing down the last remaining coke plant in the Northeast in the Bridesburg section of Philadelphia - and got my first exposure to the coal industry - a visit to Eastern's last two coal mines in western Pennsylvania, Culver and Delmont - which were closed a month later. With the coal boom at its apex in the late '70s, the bosses thought it would be safe - and safer for the other subsidiary companies - for me to be given the opportunity to establish a formal public relations department at Eastern Associated Coal Corp. In my 10 years with Eastern Associated, I was able to help take the company from 17 operating mines down to 6, from 8 longwall sections down to 5, and eventually have the entire company sold to Peabody, While at the same time, bringing an end to the coal boom. It was at this point that journalism again beckoned, which coincided with COAL magazine purchasing Coal Age from McGraw Hill Publishing. In my l l years with the magazine, we've taken it from Coal Mining and Processing, to Coal Mining, to just COAL, and back to Coal Age - which is the best thing we ever did - and we've had the company sold ... twice.

MR. LITTLEJOHN: Have you any maximum length that you make your dust barriers? What I mean by that is, your entries are 10 feet wide, and I believe if I remember right, in your single track entries you had only one dust barrier to cover the full width of the. entry in your double track entries, I believe you had two-I would like to know, have you any maximum length you make these barriers? MR. CHAS. LEGER, ROYAL FUEL CO., UTAH: It is stated that they shouldn't be over 8 feet long to obtain sensitiveness. If they make them over 8 feet they are not as sensitive as they should be. They should be made short for two reasons in order to keep the sagging out and to make them as sensitive as possible. MR. DAN HARRINGTON, U. S. BUREAU OF MINES: I didn't come here to enter into any extended discussion on rock dusting or to discuss in particular the situation at Dawson. At the February meeting at Denver, we made a complete study of this matter. Since that time a report was completed and reported to the Phelps-Dodge Corporation and Mr. Moorhead probably has a copy of it, which can give you more complete information as to what we found. We found that with the adobe dusting that they have done, they had six miles of entry pretty thoroughly dusted and of all the samples we took, at least 95 percent of them showed that not only the floor but the ribs and roof were in such a condition that an explosion could not originate in any part of this entry. In other words, this entry as it was dusted was absolutely protected from ignition and propagation. The adobe they used was of material that was non-combustible. In most instances there was not more than 3 per cent of moisture in it.

The Wednesday morning session was opened by President Joe Ward at 9:30 a.m. He complimented Walter Mueller, Program Chairman, for the excellent job he did as head of that very important committee. He also thanked all those on the various committees, speakers, and all who participated in making the 1972 meeting a success. He called on William S. Landers, Chairman of the Auditing Committee, to give his report. He read the report and asked for a motion of approval. Motion was made, seconded and approved. (See Treasurer's report on page 5.) A. E. The seventh Annual RMCMI Mine Rescue Evaluation was held during the 1998 Institute convention at the Silvertree Hotel, in Snowmass Village, Colorado. The Mine Rescue committee, co-chaired by Becki Boam and Elliott Tsosie, is one of 18 committees of the Institute. In 1998 a record number of 10 teams participated in the program. The teams were from the four western states of Montana, New Mexico, Texas and Wyoming and were comprised of about eight members each. Teams participating were BHP-La Plata Mine, BHP-Navajo Mine, BHP-San Juan Mine, all from Farmington, New Mexico; Bridger Coal Company, Rock Springs, Wyoming; General Chemical, Green River, Wyoming; Jacobs Ranch Mine, Gillette, Wyoming; Powder River Coal Company-North Antelope/Rochelle, Gillette, Wyoming; Sabine Mining, Hallsville, Texas; Solvay Minerals, Green River Wyoming, and Western Energy-Colstrip, Montana. The professional evaluators provided challenging scenarios for over 90 participants and many observers. The evaluators were: Art Saenz and Tom Bass of Western Environmental Associates, Keith Mitchell and Jim Jennings of Emergency Services Detail; Mary Bailey of Mary Bailey Associates; and John Peleaux of Innovative Access. Teams are not given advance warning of what the problem will entail. They are provided the necessary details when they arrive at the scenario location and work to resolve the problem in an effective and efficient manner. [ ] Seven participants made up each team with an . eighth member as an alternate. Team trainers and other mine personnel traveled with the team from scenario to scenario providing support and encouragement. The teams were presented with four scenarios each day, involving High Angle Rescue, Low Angle Rescue/Medical, Hazmat, and Confined Space. All of the victims, except for one, were provided through the cooperative efforts of the Snowmass Fire Department, who also assisted with providing several evaluators. Snowmass Fire Department is to be commended for providing over 20 victims/evaluators each day to facilitate the evaluations. Training sessions were held Friday afternoon and Saturday evening to help the teams prepare for the scenarios. A swap meet was held Friday evening for teams to trade hats, shirts, belt buckles, stickers, etc. All mine rescue participants and spouses and registered families attended the Bar-B-Q on Sunday evening followed by an adult dance. MR. ENZI: hank you very much. I'm sure there?s a lot of you out there just realizing that Rock Springs and Gillette is not one city. I'm sure there's a lot of you wondering why a person from a town who has the image in the national media that the town of Gillette has is talking to you about image. I had a person this morning ask me if Gillette wasn't the end of the world. The only response I can give is "no, but you can see it from there." We have been researched a lot and, I realize, we've been very lucky because I've observed that researchers cause cancer in rats. In fact a wonder drug is one that has no effect on mice. In fact I've been thinking of posting a sign in my office that would read "due to the large number of interviews by journalists who already have their articles written, we would most respectfully request that anyone wishing to insult the city of Gillette, please limit themselves to 3,000 words or 15 insults, whichever is shorter." I don't know if any of you saw the article in Playboy about three months ago on the city of Gillette. What you probably don't realize about that article is that that was an attempt by Playboy magazine to see if they couldn't change their image to a national municipal magazine. I think it's important to know Gillette is the frontier city, a pioneer city, it's a shopping center for northeast Wyoming and most importantly, we're the energy capital of the nation. We're on the threshold of the Powder River Basin and we will be the nation's energy solution. Besides coal, we're, already the heart of the state's leading oil producing area and we have vast uranium resources. But I, want to tell you the biggest resource that we have is, the people who have come to live in Gillette. You will find Gillette a busy, young, pulsating community. We're experiencing the excitement of growth. We're welcoming a higher percentage of newcomers than any other town in the nation. Yes, growth to us is exciting. Where else can you get ten years of experience in two years? We realize you can't maintain the status quo. Growth can be painful but not as painful as the alternative, recession and depression. For a little bit of background, we are now at 16,000 people and we have another 4,000 people who live on the outside but look like they live on the inside. The Census Bureau says that we have, 11,225 people but we have that many people in a traffic jam on the Douglas Highway in one day. I?ll , tell you about a few things happening in Gillette. I think it's very important to emphasize that I didn't , do these things; it's the youth and the energy of the community that has done these things. Right now the city of Gillette has 32 major projects underway. We have water for 50,000 people and we're seeking more water. The city in 1975 was 1 .8 square miles. Last year alone we annexed I square mile. We build 10 miles of paved streets a year. For the last 8 years we've doubled our parks' budget. I

Pictured on these pages are the six RMCMI Scholarship Award Winners for the 1988-89 year followed by a brief profile. All winners were present as guests of the Institute at the June convention in Durango, Colorado to receive recognition at the Welcome Session Monday, June 26, 1989. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Keith McGinnis, each winner receives $500.00 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $500.00 for tuition credit in their senior year if they have maintained good academic standing and have been recommended by their university. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the state involved. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in the engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100.00 or more, the Patrons of the Institute fund the scholarship program and the various vice presidents contribute the travel expenses to convention for these outstanding young collegiates. Profiles of the 1989 Scholarship Winners follow. [ ] David P. Pelletier University of Arizona Tucson, Arizona David is a Mining Engineering major and graduated from Santa Fe High School in 1981. He served in the Sixth Marine Regiment, Second Marine Division of the United States Marine Corps from December 1982 thru December 1985. He is a student member of SME-AIME and has held the offices of treasurer, vice president and president. He works volunteer shifts at the University of Arizona San Xavier Mining Laboratory [ ] Johnny F. Blizzard Colorado School of Mines Golden, Colorado A high school graduate of Longmont, Colorado, Johnny carries a 3.968/4.000 at Mines, majoring in Mining Engineering with a minor in Metallurgy. His name has appeared on the Academic Dean's list for the past two years. He received the Robert M. & George R. Harris Scholarship during this past year. He is a student member of SME-AIMMP and an executive council member of CSM's chapter of AIME. Summertimes, Johnny works as a miner for Edger Mine in Idaho Springs, CO on an experimental project for USBM.
