Law is as old as civilization. In its early stages the so-called law of the jungle, "the survival of the fittest," was entirely operative. Man was quite largely a law unto himself and was likewise his own lawyer. As civilization developed and individuals segregated themselves into bands or communities, man-made laws became a reality, the individual sacrificing certain privileges for the benefit of the band or community in which he was privileged to live. Our present system of law is a continued development of that process. Very early in this development the exigencies of the occasion called into being classes of individuals who were given to study the laws then existing, and this group became known as lawyers. They advised what could or could not be done under existing laws. They were the aggressors in formulating new laws and principles under which the communities must live. Concurrently with the development of the law and the lawyer, the engineering profession was born. In our early civilization, each man was his own engineer; he built his own home, constructed his own bridge, and provided his own means of conveyance. As civilization became more complex, technical study was required to consummate projects and thus meet the requirements of an expanding community. The engineering profession assumed this burden. Both groups were human and thus susceptible to human mistakes and errors. It was Macaulay who said: "The world generally gives its admiration not to the man who does what nobody else ever attempts to do, but to the man who does best what multitudes do well." BiRth of Petroleum Industry In 1859, by the completion of the Drake well in Pennsylvania, the petroleum industry as we know it was born. Its rapid progress since that time has been both extraordinary and remarkable. The zeal of the individual operator to secure all possible oil in the shortest time, even to the extent of bringing into possession a part of the oil underlying a neighbor's property, developed unnecessary drilling, wasteful methods of recovery, great loss of gas, the early abandonment of property with much unrecovered oil thereunder. Introduction THAT an oil-land law is the most needed item in the proposed program of mineral-land legislation follows from the fact that Congress has never enacted a law really applicable to petroleum and natural gas. The action of Congress in 1597 in authorizing entry of oil-lands under the placer law, enacted 27 years before for the mining of gold in surface gravels, was plainly only makeshift legislation. Naturally the provisions of this placer law with its requirement of discovery as a prerequisite to location are nothing less than absurd when applied to petroleum deposits hundreds or thousands of feet beneath the surface. Other reasons which render oil-land legislation an urgent necessity arise first from the large acreage of lands believed to be valuable for their deposits of oil and gas and therefore withdrawn by Executive order from all entry pending the enactment of an appropriate law for their disposition-a withdrawal that has been specially ratified by Congress in the case of one State, Utah-and second from the exceptional importance of this resource to the nation, the large industrial worth of petroleum, and indeed its paramount value to the navy, not being suspected 17 years ago when Congress last legislated upon this subject. Mineral land of this type is also well adapted to serve for purposes of illustration in discussing the general principles that demand recognition in legislative reform. Most of the issues involved in the consideration of oil-land legislation are clean-cut, and essential differences of opinion will be seen to be based upon radical divergence in economic theory rather than upon conflicting views concerning unimportant details. For the last five years or more the geologists of the Federal Survey have discussed this subject and prepared memorandums and reports on .the various bills introduced in Congress. Most of the provisions suggested in the present outline have been under consideration at one time or another during that period, and many of the statements which follow can be said to represent the consensus of opinion among those of us who, both in the field and in the office, have given special attention to the public oil-lands.

That the death of Martin Coryell, which occurred at Lambertville, New Jersey, on Monday morning, November 29th, touched the sympathies of a wide circle of professional associates and personal friends, was amply testified by the gathering at the funeral services on Friday. Like his distinguished friend and neighbor, the late Ashbel Welch, Mr. Coryell was one of those pioneers in American engineering to whom we owe the great railway and canal systems which lie at the base of our national prosperity, and who have consequently enjoyed the respect and esteem of their successors of the present generation. Martin Coryell was born July 20th, 1815, at New ope, Rucks County, Pa., and was educated principally in the schools of his native town arid of Lambertville, New Jersey, to which place he returned for permanent residence fifty years later. With the exception of a brief period in youth, during which, to restore his failing health, he learned and practiced for a few months the carpenter's trade, and another brief period, later in life, when he read law for a time in the office of B. H. Brewster, of Philadelphia, afterwards Attorney-General of the United States, Mr. Coryell may be said to have spent his life as an active civil and mining engineer. Even these two episodes can scarcely be said to have been deviations from that profession, since they served to give him more thorough preparation for constructive and administrative work. The Delaware Division Canal, the Raritan Canal, and the Brunswick Canal, are among those upon which Mr. Coryell was employed. For the Raritan Canal Company, under the superintendence of Ashbel Welch, he located the greater part of the Belvidere Railroad (now the Belvidere division of the Pennsylvania Railroad), and directed its construction from Trenton to Lambertville. He was also active as a mining engineer, being one of the early pioneers of mining in the Lake Superior copper region, and had much to do with the development of the Hazleton coalfield and the railroad which has since expanded into the Lehigh Valley system. In 1862, he removed to Wilkes-Barre, where, in 1864, he became manager of the Warrior Run Mining Company. One of the editors

THE elementary mechanism of deformation in the body-centered cubic metals has been a subject of dispute for many years. If the problem were merely that of designating the crystallographic plane or planes of slip, the solution would have appeared long ago. However, there must be greater differences in the deformation behaviors of the body-centered and face-centered types than the differences in their lattices would suggest. The lines of slip formed on the polished surface of a strained face-centered cubic metal conform to glide over a single plane of the crystal. Slip in body-centered cubic iron, however, is frequently observed as curved and forked lines which could not possibly define a single plane of atoms. This alone is sufficient reason to expect different modes of deformation to operate in the two lattice types. The literature in this field now has generally accepted the proposition that {110), {112), or (1231 planes will act as slip planes in iron. It is essential that the experimental evidence supposedly supporting this proposition be critically examined. Taylor and Elam1 in 1926, using relatively small single crystals, determined the operative slip systems by measurements of the distortion of a grid engraved on the specimens prior to deformation. Their results indicated that shearing had taken place in the close-packed direction on a plane adjacent to or coinciding with the plane of maximum shear which contained the slip direction. This led the authors to propose a theory of noncrystallographic or banal slip. The authors considered an alternate rationalization of banal glide. Slip on two (1101 planes or possibly two {112} planes containing the same <1ll> direction could produce the wavy slip lines. By employing plane segments of varying widths, the integrated plane could take any position in the <111> zone. They rejected this explanation, however, feeling that the preponderance of evidence was against it. Taylor&apos; continued the investigation of the plasticity of the body-centered cubic lattice on ß brass. He reasoned that the resistance to shearing of a given plane in the zone of the slip direction was a function of the angle between the glide plane and the closest (110),: P F=—cose sine cos(X —?) [1] where F is the resistance to shear; P, the axial load at yielding; A, the cross sectional area; e, the angle between slip direction and load axis; x, the angle between plane of maximum shear containing the slip direction and the (101) pole; and ?, the angle between observed glide plane and the (101) pole. Vibrating wire stressmeters (VWS&apos;s) and borehole deformation gages (BDG) were deployed in two in-situ heater experiments at Stripa, Sweden to determine the thermally induced stress changes in the rock mass. The heater experiments ran for 18 months, including a six- month cool-down period after the heaters were turned off. Gages were installed in both horizontal and vertical boreholes and were subjected to temperatures ranging from 10°C to 120°C, depending upon the distance of a gage from the central heater. Most gages operated in a moist environment because groundwater flowed into many of the instrument boreholes during the experiments Of the 36 VWS&apos;s installed, six failed. Failures were attributed to corrosion of the vibrating wire due to moisture entering the gage body. Of the 30 BDG&apos;s installed at the beginning of the experiments, 22 failed, also as the result of water entering the gage body. Modification and reinstallation of the gages eliminated the problem of water infiltration, but much data from early stages of the experiments was lost due to gage failures. Calibration of the VWS in blocks of Stripa granite showed a lack of repeatability. Variability in calibration results are attributed to seating effects, to variations in the elastic modulus of the rock, and to changes in temperature. These three effects combined to produce an error judged to be approximately ±33% of the stress changes measured at Stripa. In contrast, the major source of error in determining stress with the BDG appears to be the uncertainty in rock modulus and thermal expansion coefficient. LAWRENCE ADDICKS, Douglas, Ariz.-It does not seem to me that the role played by carrying heat away from one surface to another has been brought out. A cellular construction prevents the motion of air currents. Also in the installation on the top of a reverberatory furnace, that Mr. Krieger mentions, where it stopped the cooling, there is besides the question of overheating. Another complex question, entirely apart from the necessity of not carrying a brick above a certain temperature, is that of not allowing acids and bases to come together at too high a temperature. J. W. BECKMAN.-What cements together the individual cells in the insulating material? Also, how does the material behave in the presence of acids and alkalies, both strong and weak? A. H. KRIEGER, New York, N. Y.-The material is formed or composed of myriads of lace-like skeleton remains of diatoms visible only -under a powerful microscope. The diatom lives in salt and fresh water. On the Pacific Coast there must have been an abundant life of the diatom, because the beds, still in existence in Southern California, are fully 1,000 ft. through, and are hard and strong, standing a pressure of more than 400 lb. per square inch. The beds must have been many ages in forming and the diatoms have become firmly packed together. The samples shown are typical of the entire deposit as it was formed at the bottom of the sea. This paper gives a brief description of an investigation made several years ago on the diffusion of zinc into copper. The material for that study was furnished in the form of thin copper strips coated with zinc. The result was required rather quickly and at not too great an expense, and especially information was desired as to the rate at which zinc would diffuse from the zinc coating into the copper and the temperature at which the operation should be carried out. A study of the requirements of this problem indicated that the solution might be secured by means of six determinations. This is the smallest number that will give the information desired and, at the same time, furnish checks on the accuracy of the determinations which justify an abbreviated experimental program. This does not count a preliminary test which was designed to give some idea of the correct temperature to use. The minimum number of temperatures that can be used is two. Knowing the rates of diffusion of zinc into copper at two properly chosen temperatures, it is possible to calculate the rate for any other temperature, and also to check the accuracy of the determination by means of the heat of diffusion, which is calculated from the effect of temperature on the rate of diffusion. The minimum number of determinations at any one temperature is three. The amount of diffusion which occurs at a fixed temperature is definitely related to the time of diffusion, so that by determining the amount of diffusion for three different time intervals, this relationship may be established and possibly a check on the accuracy may be secured. This accounts for the six determinations or experiments, and suggests the logical plan of the work. The check used here is not generally applicable to diffusion phenomena, but it seems to hold closely enough for the limited amount of diffusion in this investigation to justify its use. The samples used were 5 to 6 mils thick and about 1 in. square. They were placed between iron blocks and set in the hot zone of a nichrome furnace which had been brought to the desired temperature Time was taken from the moment the samples reached the furnace

TO obtain the best results from hammer drills, close attention must be paid to two factors in drill maintenance, which are of equal importance; one is lubrication, the other is the shank. With the exception of stoping drills, most modern rock drills require both oil and grease. The oil ports are in the lubricator, on or behind the hammer cylinder; the grease port for the lubrication of the chuck sleeve and rotating mechanism is on the chuck end. Ordinary machine oil is not adapted to rock drills; a heavier more gelatinous oil such as castor machine oil or liquid grease should be used. The lubricators should be filled once for every 12 or 14 ft. (3.5 to 4 m.) of hole drilled. Grease guns should be used to fill the port in the chuck end once a shift; a medium (No. 3) grease is well adapted to this purpose. Hard grease must not be put into the lubricators, as it will not flow through that part. Contrary to the popular belief, oiling a machine once or twice a shift does not provide sufficient lubrication; the drills should be oiled once for every 12 or 14 ft. of hole drilled. The rotating handle of a stoping drill is an oil reservoir and is provided with a port for oiling. The rotating handle is packed with wick-ing, or similar material, which causes the oil to feed slowly from the handle to the other parts of the machine. Stoping drills require oil at least twice a shift; lighter oils than castor, such as Arctic Ammonia, may be used. Drills used in shaft sinking can be oiled satisfactorily by placing a good-sized, drop, sight lubricator on the station above the sinking operations and connecting it with the air-line supplying the sinking drills. If this lubricator is properly filled and adjusted, a uniform oiling of the sinking machines will be effected without the necessity of oiling the drills individually. The grease end should be filled at the station or surface before each drilling period. The shift boss should see that the machines are greased and also that the lubricators at the station function properly. The life of the air-drill hose is somewhat shortened by this method, as oil attacks the inner tube; but as some oil is always present in the compressed air, this is not a serious objection to the method.

THE increasing need for the products of our mines, mills, and processing plants, the loss of mine manpower to plants other than those concerned with the mineral industry, and the drafting of our younger men into military service have created an acute situation in many places as to workers and production. This, in turn, has focused attention on the need for conserving manpower by conserving the health and life of our mining people. Health A world-wide tendency is noticeable in the mineral industry toward protecting the health of workmen,-particularly younger workers, as well as older workers who can continue to produce in many places where manpower is lacking. This matter was emphasized at the Geneva Labor Conference for Coal Mines at the Committee&apos;s fourth session, held in Geneva, Switzerland, May 7 through 19, 1951. Papers concerning the health of workers were presented at the annual meetings of the mining sections of the National Safety Council, the Coal Mine Inspectors&apos; Institute of America, the American Public Health Association, and other organizations. Safety Conferences Without exception, the attendance at mining-safety conferences in widely separated places throughout the country during the year was the largest to date. What is needed at the safety meetings throughout the country is more-widespread attendance by those who can sell the idea to the workers that they are the focal point in accident prevention and that safety is not going to be achieved alone or even in part by laws, decrees, or commands, but by quiet influence, unconscious suggestion, and personal&apos; guidance. If these are acquired by the workmen, a safe environment and ample, capable supervision supplied by management, accidents will be fewer and less severe. Many safety conferences attempt to develop the foregoing idea by enumerating and describing training programs for supervisors and workers alike. Nothing can replace a course in first aid for all persons employed at any mine or plant as an introductory and basic step to a successful safety program. During the year 1878-79, Anton Eilers, who was then interested in the lead smelting and refining business near Salt Lake City, Utah, made a somewhat radical departure from the regular practice at that time, which was to use but little lime in the slag, with a high percentage of iron. Lime was not only a cheaper flux than iron, but it enabled the metallurgist to make a more siliceous slag, an economical advantage in smelting where the smelting companies had to purchase either iron or lime to neutraiize the excess silica, and penalize the ore shippers accordingly. The larger amount of both lime and silica in the slag also made it of lighter specific gravity, and a better separation of the metals and mattes was secured. This change in the formation of slags for lead smelting was brought about by Anton Eilers, prior to the Leadville mining excitement of 1879.. We must also give Mr. Eilers credit for the general introduction of the hollow water-cooled cast-iron jacket for the blast furnace. Again referring to the use of more lime and less iron in the formation of slags, there is no doubt but that it prevents the formation of a great many so-called "sows" in the lead crucible, such as were made in the early history of lead smelting in the Rocky Mountains; these sows consisted of lead, iron, arsenic, sulphur, copper, and other metals, including gold and silver, mixed with unconsumed fuel, and often, after vain attempts to cut them up or melt them to a suitable size for handling, were buried in the slag dumps to get them out of sight. Another advantage derived from the adoption of high-lime slags when smelting ore containing arsenic is the production of less speiss (a byproduct heavier than matte, resulting from careless operation of the furnace, in the lead being driven out of the crucible and sows built up). This speiss, while usually not as rich in precious metals as matte made at the same time, is too valuable to be thrown away; but it is difficult to treat, and it was thrown away or piled on the slag dumps in the pioneer days of lead smelting in this country. The present article calls attention to the activities of a committee on coal research of the sister society of Economic Geologists. The field of coal geology crosses the boundary between the two societies and joint meetings are as applicable here as in the metallic and other nonfuel fields of mining and natural resources recovery. The six fields of coal geology are briefly described and some of the ways in which they touch on coal mining, preparation, and recovery briefly indicated.

Mining, including quarrying, dates back almost to the dawn of history, beginning almost with the beginning of what we call civilization. State surveys date back about 100 years. Evidently mining flourished for thousands of years before state surveys were thought of. Why should it not continue to flourish without state surveys? First, it may be noted that as mining and civilization were contemporaneous, so state surveys and the science of geology were almost contemporaneous. As recently as 30 years ago the United States mineral laws were interpreted to mean that coal lands in the public domain were only those lands on which workable coal outcropped. The half billion acres of public land underlain by .coal but on which it did not outcrop were treated as homestead lands and open to settlement. Just what did the science of geology do to or for the mining industry? Until geology arose rocks or minerals or ores were where they were found. Their finding might be accidental, or might be the result of deliberate search or prospecting. In open, rocky country, with little or no vegetation, as in parts of the West, prospecting served very well, though at an enormous expenditure of human time and effort, if not money. The old saying that every dollar&apos;s worth of gold taken from the earth has cost two dollars may largely be charged to the time value of the usual method of prospecting. Geology changed all that. The science is still young and it still labors under handicaps of immaturity and early errors. Geology, however, has gradually been discovering the relations and conditions under which the several mineral deposits occur. Its elaborate studies of exhausted or nearly exhausted mineral deposits has done for it what human autopsy has done for medicine and surgery. Perhaps in no field is this plainer than in the oil and gas industry. Note might also be made of several important coal fields in England and on the Continent, in which the coal is everywhere deeply buried. Passing over the long period of growth during the past 100 years, geology today is prepared to offer the mining industry: first, a knowledge of the geologic conditions under which most minerals occur and to explore

Drilling for oil in the eastern producing states was fairly active during the first part of 1931, although less so than in 1930. With low prices development declined during the year, until the low prices of the summer resulted in an almost complete shut-down of drilling. This coincided with the action of the Conservation Board of the Pennsylvania Crude Oil Producers Assn, in limiting pipe line runs to 50 per cent of the 1930 normal for the Bradford district and upper country, and to 70 per cent for the balance of the region. Not only was new drilling halted but in many cases oil-producing properties were shut in. In November crude prices were partly restored, and all oil offered was being taken except in the Bradford district which was restricted to 80 per cent of the 1930 normal. During the latter part of the year drilling was being resumed on a moderate scale, and new production indicated a resumption of the proration order. The interest in gas development which has been under way for several years, maintained its supremacy over the search for oil in 1931. New reserves of importance were developed during the year in the Western Kentucky Coal Basin, in the Eastern Kentucky shale gas territory, in Stark County, Ohio, as well as the Oriskany sand development in northern Pennsylvania and central New York. A gas line was completed to the Eastern Seaboard serving Washington and Baltimore, and other lines were under construction designed to serve portions of the territory not hitherto supplied with natural gas. The low price of fuel oil at seaboard is understood to be the deterrent factor against further extension of natural gas lines to these markets at present. The development of these new reserves, as well as those developed by intensive drilling in old areas, resulted in the building up of large potential gas production and a lowering of rates paid to the producer. This, coupled with the country-wide tendency to lower the consumer rates of all public utilities, resulted in a general threat to reopen rate cases before various state commissions. Unlike the furnaces employed in the reduction of ores to mattes and metals, the foundry-cupola has only melting to do. This looks simple enough; and its development has progressed through centuries by cut-and-try methods; but there is still much to be learned concerning the causes which underlie the production of defective castings, even from first-rate materials. There are other differences between the smelter and the cupola. The former is usually, the latter rarely, run continuously. In the smelter there is some chance for experiment, since rich slags can be treated again; while in the cupola the metal must be good for casting from the first tap to the drop of the bottom ; otherwise, heavy damage will result. In the smelter, the object sought is the production of metal or matte with a minimum loss in the slag; whereas, in the foundry, a variety of castings of different compositions must often be run from the same heat, one after the other. Experience with the cupola has shown that the melting should take place, throughout the heat, in one zone, the zone of maximum temperature, which is clearly marked on the cupola-lining by the severe cutting action of the slag and iron oxide. The design and operation of the cupola must conform to this condition. This conformity having been secured, other considerations resolve themselves into those details of construction which will involve least trouble and cost of repairs. The very high temperatures required to melt iron and steel in the cupola, leaving the metal sufficiently superheated for casting, render the use of water-jackets inadvisable. It is always possible to patch up the lining at the melting-zone between daily heats; and the rest of the lining is seldom affected enough by abrasion and chemical action to require replacement oftener than once in nine months. The cupola is practically a shell of steel, lined with the proper refractory material, and provided with a sct of tuyeres for the admission of air to burn the fuel and melt the metallic

The important place in the economic life of the country that is occupied by the United States Geological Survey and the various state surveys is appreciatcd by most members of our Institute. To the public at large, the functions of these surveys are no doubt largely unknown, and taken for granted. Possibly a realization of the value of the work of these government branches is brought home most fully to that group of our members whose duties as examining engineers and mining geologists take them to mines and prospects in many different parts. The examining engineer or geologist is usually seeking for a judgment on the value of an enterprise from the standpoint of the useful minerals that may or may not be present; he must also attempt some prediction as to future market prices. On his opinion rests the determination of the expenditure of money, which rendered into other language means the expenditure of human effort. An opinion on an exploring venture or the reasoning out of the probable extensions of an orebody requires among many other things a background of knowledge covering the geologic horizons not only of an immediate area but of the surrounding area, a knowledge of the structural geology and of the causes that have operated to form the ores as they are. The great storehouses of this knowledge are the statistics, reports and maps issued by the various geological surveys. They supply the groundwork for additional observations. To these, reference is always made when going into a new district. The technique of work in the field and laboratory, and to some extent the hypotheses that underlie our methods of approach, have been formed by men such as Van Hise, Leith, Kemp, Spurr, Emmons and Lindgren, who developed their powers in the service of the geological surveys. In addition to whatever originality of thought, or power to observe facts and analyze them, may be our portion, we require, in the application of the arts and sciences, a knowledge of what has already been done. We stand on the shoulders of those who have gone before, and the extent of our vision often depends upon the thoroughness with which we form earlier work into one whole and make use of it.
