Introduction The Surface Mining Control and Reclamation Act (Public Law 9587) (hereinafter the "Act" or "SMCRA") passed by Congress in August 1977 represents a comprehensive federal scheme for controlling surface coal mining and the surface effects of underground mining through permitting requirements, performance guidelines and reclamation planning. While the provisions of the Act have been the subject of numerous legal challenges and court battles over the years, it is difficult to identify a more controversial program within the Act than the provisions for designating lands as unsuitable for surface coal mining operations. The lands unsuitable designation process provides for the acceptance and review of petitions submitted by citizens or organizations seeking to have specified land areas designated unsuitable for all or certain types of surface coal mining activities. In filing these petitions, the interested parties or petitioners are required to make allegations about potential adverse impacts on people or the environment and submit evidence supporting their allegations. In 30 U.S.C. § 1272, Congress provided that "[a]ny person having an interest which is or may be adversely affected shall have the right to petition ... to have an area designated as unsuitable for surface coal mining operations." Under the Act, an area can be designated as unsuitable where the mining operation will (1) be incompatible with existing state or local land use plans, (2) affect fragile or historic lands, (3) affect renewable resource lands where mining operations could result in substantial loss or reduction of long-range productivity, or (4) affect natural hazard lands where such operations could substantially endanger life and property. In enacting SMCRA, Congress mandated that each state establish a process to determine which, if any, lands within the state are unsuitable for all or certain types of surface mining operations. In response to this federal legislation, the Kentucky General Assembly adopted a state regulatory program for surface mining that included provisions direct¬ing the Secretary of the Natural Resources and Environmental Protection Cabinet to establish a program for designating lands as unsuitable for surface mining as required by the Act. In recent litigation in Kentucky, several environmental groups filed a lands unsuitable petition, later joined by the University of Kentucky, challenging a proposal by Arch Mineral Corporation to surface mine over 3 million tons of recoverable coal. The petition sought to designate over 10,000 acres of land adjacent to Arch's proposed operations as unsuitable for surface mining operations, basically alleging that the mining would disturb an outdoor laboratory. The filing of the petition activated Kentucky's regulatory scheme for reviewing lands unsuitable petitions that can result in an absolute prohibition against surface mining on the petitioned land for historical, environmental and other related reasons. The designation process involves vague petition requirements creating a situation that Arch argued is devoid of constitutional due process and subject to abuse by the petitioner on many fronts. Arch maintained that the lands unsuitable regulations do not grant adequate protection to Arch's legitimate property rights under the due process clauses of the United States and Kentucky Constitutions and are thus void and unenforceable. The entire process resulting in a decision on the petition took just under 12 months in the Arch case, and although Arch was ultimately successful in preserving its right to mine, Arch's surface mining permit was held up for this period of time. This delay led to the cessation of mining operations by Arch and the idling of over 250 workers. This paper will review the lands unsuitable designation process and the significant implications the process has for existing surface mining operations, currently proposed operations and even those long-range operations not yet contemplated. Special emphasis will be given to Kentucky's lands unsuitable program. Finally, the recent litigation involving Arch Mineral Corporation and its effort to surface mine 81.5 acres of Arch controlled property will be utilized to illustrate this very unusual regulatory scheme. Regulatory background Chapter 30, Subchapter F of the Code of Federal Regulations (C.F.R.) promulgated to implement the provisions of SMCRA, requires that each state establish procedures under the state's surface mining program for designating non-federal and non-Indian state lands as unsuitable for all or certain types of surface coal mining operations. 30 C.F.R. § 764.1. The C.F.R. establishes minimum standards for state lands unsuitable programs and sets out requirements for filing a Lands Unsuitable Petition (hereinafter "LUP"), processing LUPs, decision-making guidelines and hearing requirements. Kentucky has adopted regulations providing for the implementation of the lands unsuitable process as part of the state's regulatory program under SMCRA. The following discussion summarizes the principle components of the Kentucky lands unsuitable program.

Polysaccharides have been used as depressants for naturally hydrophobic talc in the flotation of base metal sulfide ores, precious metal sulfide ores and platinum group metal (PGM) sulfide ores. The results of this surface chemistry study confirm guar gum as a preferred polysaccharide for talc depression in the flotation of these ores. In addition to the practical application of the research results, the surface chemistry results are of academic significance, providing further information to understand how polysaccharide depressants function in these complex sulfide flotation systems.

With the price of precious metals at an 18-year low, every ounce of metal produced is important. The theft of metals from mining and refining sites can mean the diffrence between profit and loss for many mining companies. Low metal prices do not reduce the potential for the theft of precious metals. History has shown that the price of gold has little to do with the desire for employees to steal precious or base metals. There is actually evidence that the theft of precious metals increases when the price of this commodity goes down. Several of the major precious metal thefts in the past year took place at silver mines when the price of silver was less than 16 cents/g ($5/oz). How does the lowest gold price in 18 years affect the need for security at precious metals properties? There is no short answer to this question. One reason is because the exposure to theft of precious metals is unique to each property. This makes it important that each property be evaluated individually. More than 95% of all precious metals thefts can be attributed to those working at the mine site. So preventing employee theft is the primary concern. One consideration is the location of the property. Gold selling at any price is still an attractive commodity in countries where the employees are making between US$400 and US$600 a month. It is not uncommon for employees at mines in countries where low wages are the norm to consider the value of a gram or two of gold to be a significant amount of money. A gram or two of gold a day may not seem like much. But if 15 employees steal two grams a day, that equates to a significant amount of money during a year. The type of property where the precious metals product is being recovered is also important. For example, a property with a gravity circuit is more likely to suffer from the theft of gold product than a property where all gold is finely disseminated and the only gold seen in the ore body is through a microscope. Gravity circuits increase an operation's exposure to theft because the grinding circuit that is associated with a gravity circuit often becomes a giant concentrator. Areas such as the bottom of grinding-mill pump boxes, cyclone-feed-pump clean out traps and the sumps often become locations where precious metals concentrate (Figs. 1 and 2). Muck concentrations in these locations can be as high as 25% to 40% of gold or silver. Not long ago, muck was removed from a barren-solution sump at a Merrill Crowe circuit that had concentrated to more than 40% gold. At a milling site in the Pacific Rim, residents of the community adjacent to the mine learned about the value of the concentrates in the sump under the ball mill and committed an armed rob¬bery. While several of their co-conspirators held the em¬ployees at bay with machetes, the others emptied the contents of the sump into buckets and removed it from the site. Armed robbery is not as common as employee theft. However, while this article was being written, an armed robbery occurred at a gold property in Central America. Armed perpetrators took as hostages the night shift employees at a process plant and used cutting torches that were on site to cut into the high-security and gold-storage areas. The perpetrators then stole a company vehicle to remove the stolen gold buttons and sludge from the site. Unfortunately, this type of activity goes on regularly. But managements of most mining companies are reluctant to discuss theft scenarios. So information pertaining to the theft of precious metals seldom becomes a newsworthy item. An audit conducted at a mine site with a gravity circuit recommended that the gravity recovery area be shut down until adequate protection could be provided. Although it was not connected with the audit, it was necessary to shut down the gravity area for a pro¬longed period because of problems with the gravity table. In the two months that followed, gold production at the site increased by about 31 kg/month (1,000 oz/month). It is difficult to attribute all of this increase to the theft of concentrates. But there was a good chance that at least part of the increase was due to the fact that concentrates were being stolen from the gravity area.

The measurement principle of the Coulter Counter for particle size analyses is described. The application of the Coulter Counter to cement particle content and size analysis and to the size distribution of clinker from standard grindability tests are described. Methods of calibration, sample preparation and data reduction are presented. The results of the analyses obtained are compared with characteristics associated with performance showing both concordance and non-concordance of test data., Future uses of the Coulter Counter for particle size analysis in research and plant control adaptations are indicated.

Introduction It is generally accepted as dogma that sampling contributes most of the error in gold fire assays. Differences in assay results on pulps from the same sample interval are frequently regarded as evidence of the presence of the so called "nugget effect" of relatively coarse gold particles. It is true that coarse gold particles can contribute to substantial sampling fluctuations. But, while the process of sampling is probably the major source of error, the analytical process cannot be completely ignored as a possible contributor to erratic assay results. To maintain a stable assay process, the analytic part of the system must also be kept in control. One method of monitoring the performance of the analytic system is to systematically assay standard materials, whose sampling characteristics are carefully controlled. Gold assay standards are not prepared, nor can they be prepared, to account for both sampling and analytical errors. It is not possible to send coarse material to a lab for both preparation (i.e., comminution and splitting) and fire assaying and then come to conclusions only about the fire-assay process. Because most gold ores are very heterogeneous, sampling errors would, in most cases, completely mask the contribution of the analytical errors. Assay-standard material is prepared only to assess the accuracy and variability in the fire assay process. Because the objective of the assay standard is to provide information about the fire assaying, it is necessary to control the sampling error of the standard material, so that it is only a minor constituent of the discrepancies observed in any assay results. To do this requires that the particle size of the standard material be reduced to a point where the relative standard deviation of the sampling error (i.e... the standard deviation of the errors divided by the average gold content of the material) is 2% or less. For all but very homogeneous mineralization, this means that the material must be reduced to 100% -150 mesh before the sampling errors are adequately controlled. However, even reducing the particle size can contribute to sampling problems. The liberation of gold may cause segregation that can cause large sampling fluctuations that are not easily controlled while maintaining the desired grade. Because, in most cases, the standard material would already be in the "pulp" state when it is submitted to a lab for assay, it is not possible to entirely conceal the nature of the sample from the lab. This is a problem inherent in using assay standard material. Because of the contribution of sampling to error generation in the assay process, the use of "coarse" material does not solve the problem of submitting a totally "blind" standard to the lab. In the sections that follow, the selection, preparation, testing and use of gold fire assay standard material is discussed. While some may dismiss the production of standard material as folly, it is possible to produce and utilize standard material to stabilize and improve the fire-assay process to produce more reliable assay results. Material selection It is desirable to use material that has as nearly the same metallurgical characteristics as the samples with which the standards will be included. However, this is usually difficult. For many reasons, including the particle size at which a significant amount of the gold mineral is liberated, the sampling characteristics of even -150-mesh material may preclude the use of geologically and metallurgically similar ore as a standard. It is usually easier to get material having desirable grade characteristics with the necessary sampling properties than it is to find geologically and metallurgically similar material with the required sampling characteristics. High-grade standards are especially difficult to find and prepare. This is because, as grade increases, the size of the gold particles usually increases. Larger gold particles are liberated and tend to segregate during comminution, and the homogeneity of the material cannot be maintained. For grades much above 3 g/t (0.088 oz/ton), it is very difficult to find material that has the proper sampling properties. Old mill tailings are likely candidates for assay standards. Some of these have sufficiently homogeneous mineral contents, so that the sampling errors can be effectively controlled. Where mill tailings are either not available or are not acceptable, mineralization that has exhibited homogeneous results in reassays of the pulp material is also a good candidate for the standard. Finally, the mineralized rock being sampled may (and should) be used if adequate homogeneity in the -150mesh material exists. "Adequate" ("acceptable") homogeneity is defined below.) It is important to use standards having a wide range of grades. This alone may preclude the material being

A.B. Rushton The work and resulting publications of the Committee on Underground Coal Mine Safety and The President's Commission on Coal were appropriate at the time of publication. The statistics cited in the publications appeared to be valid, and the actions proposed by the committee had merit. Although the actions proposed to achieve further improvements in safety may have been worthy of repeating, to associate statistics (Table 1) that are seven to eight years old with company names is bad. Statistics are readily available from the Mine Safety and Health Administration (MSHA) and are usually within three months of being up to date. A review of the most recent Coal Controlling Co. Report will reveal significant changes in the rankings. The more recent statistics should have been cited, or at least compared with those used in the article. Westmoreland Coal Co. is listed as having a 21.1 disabling injury rate for the period (1/78-12/80). The disabling injury rate for the Company for the year ending 1985 was 7.4 for the underground mines and 6.25 for the total facilities. Through March 1986, the dis- abling rate for the underground mines was 2.86. The management and employees of Westmoreland Coal Co. are committed to safety. The improvements achieved over the past five years attest to that commitment. We are justifiably proud of the achievement and dislike being misrepresented as in the April 1986 article Reply by E.M. Spokes I regret that the lapse of time since the original work gives a picture of safety practice that is no longer true today. That Westmoreland has reduced its disabling injury rate by 65% to 7.4 in 1985 is most commendable, and I congratulate you for this accomplishment. It is typical of the progress sought by the National Academy of Science and National Research Council when they funded the original study and published "Toward Safer Underground Coal Mines" in 1982. If a significant number of companies do as well as Westmoreland, the report will have served its purpose. Since the paper was primarily a condensation of the original report, it would not have been appropriate to seek access to later statistics. The purpose in seeking its publication at the time of presentation was to reach those who might have missed the original report. The fact that publication was delayed has not voided that purpose and may have reminded some who were aware of the original that its recommendations still apply to improvement of underground coal mine safety

The Alumet Company of Golden, Colorado, is currently engaged in the development of their Diamond Creek and Lanes Creek phosphate ore bodies located near Soda Springs, Idaho. The Alumet Company is a partnership of National Steel, Southwire Co., and Earth Science Inc. Davy Powergas, Inc., of Florida was contracted by Alumet to perform an evaluation study of these properties and, in general, determine the tonnage of altered and unaltered phosphate reserves which would be amenable to beneficiation and production of merchantable phosphate rock (defined as material with a P2O5 content of 3 1.0% and greater). The Colorado School of Mines Research Institute was retained by Davy Powergas to develop a beneficiation method for the studies of the altered and unaltered ores. Ore reserves were classified by Davy in a comprehensive range of categories such that any partial grouping could be made as dictated by future mine planning, mine or mill design, or prevalent economic conditions. Categories included ore horizon, stripping ratio, degree of certainty of their existence, and physical and chemical characteristics. The last category was of interest for beneficiation considerations in that it dealt with the degree of alteration of the phosphate ore.

Although past investigations (2, 5)have been conducted to determine crushing relationships, no program which covered a broad range of crushing conditions had been conducted. The previous studies appear to concentrate on small segments of the overall picture and did not fullfill our desired information objectives. The Crusher Variables Research Program conducted at the Mineral Research and Test Center (MRTC) of Rexnord, due to the broad range of variables utilized in a production size crusher, is believed to be the most comprehensive study of its kind as of this date. The principles developed by the Symons brothers in 1925, when they patented the cone crusher as we know it today, are still being used in the machine known as the Symons Cone Crusher, During the development of this novel crushing concept, a technique known as the fall of material (called the Bouncing Ball Theory1 by some) was used to determine an idea as to the proper head angle, eccentric and speed of eccentric rotation, The final variables used for the Symons Cone Crusher design were, therefore, the logical conditions to start with and use as a reference against which other variables could be compared.

"INTRODUCTION Successful management of megaprojects, meaning delivery within budget, on time and according to expectations, is a fundamental requirement. Many projects have been successful, some have not. This paper reviews megaprojects1, drawn from the author’s projects over the last 50 years, with “lessons-learned” and a summary of recommendations that, if implemented, would improve megaproject management and delivery. Characteristics of these projects are summarized – including outcomes related to key factors such as politics, management, organizational structure, contracting methods, cost estimates, risk and other elements. The projects include the Washington D.C. Metro, Boston Southwest Corridor, LA Metro, Toronto Rapid Transit Expansion Program, BART San Francisco, MARTA Atlanta, London Underground and the Washington State Highway megaprojects – including the SR520 Floating Bridge and the Alaskan Way tunnel. Other projects that illustrate successful, innovative management and contracting methods include the Madrid Metro (low-cost delivery), the Sydney Northside Storage tunnel (outturn cost, alliancing) and the Lake Mead tunnel (working in partnership, risk management). KEY ISSUES A characteristic of megaprojects is that their complexity increases exponentially with size (Reilly 2010, Galloway et al. 2012). These projects are very visible politically, have many stakeholders who must be satisfied and generally span many years and political election cycles. To be successful they must meet expectations, function efficiently, and be delivered under, at or close to budget and schedule. There is a widely-based perception that large, complex projects are always delivered late, over budget and with problems. Specific examples include projects such as Tren Urbano in Puerto Rico – $1.28 billion over initial budget (+133%), the Silver Line Transitway Project in Boston – $286 million over budget (+90%), the London Jubilee Line Transit Project – 2 years late and £1.4 billion (+67%) over budget, the Channel Tunnel Rail Project – £3.7 billion (+80%) over budget, Denmark’s Great Belt Link rail and road link (54% over budget), the 2003 Woodrow Wilson bridge tender in Virginia (72% over estimate) and Boston’s Central Artery Project – several billion (perhaps 100%) over what would have been a realistic initial budget and years late (Reilly 2001c, 2004a; Salvucci 2003)."

The coming years should see moderate growth in the US coal industry. That growth may come at the expense of the oil and natural gas industries. Conoco pegs coal growth at 2% a year, until the year 2000. During that same period, Conoco projects only 0.5% annual oil growth and "a flat or negative trendline" for natural gas. This is compounded by the fact that coal has a delivered cost per Btu that is only half as much as it is for natural gas and only a third as much as it is for oil. So said Ralph Bailey to many of the 2600 attending the opening session of the American Mining Congress Coal Convention, May 12-15, in Pittsburgh, PA. Bailey is chairman of the AMC. He is also chairman of Conoco. While coal's projected growth is not spectacular, "it is in fact almost an assured growth," Bailey said. Weak oil and gas prices will likely prevent faster growth for US coal. Most of coal's increased demand will come from the electric utility industry and expanded steam coal exports. Conoco's study projects that domestic coal demand will be strengthened in the 1990s. By then, the present surge of nuclear power plant constuction will be over. And there will be a lack of acceptably priced, large-scale generation alternatives for utilities. "It is not likely that any electric utility is going to be ordering new nuclear reactors," Bailey said. "And as oil and gas supplies become scarcer and more costly, it is only logical that coal is going to fill the gap." At the same time, Bailey believes the US coal industry must find ways to lower its costs. He said cost excesses can be found in "regulatory overkill, labor, and simply bad habits" hidden by years of high inflation. "Those costs have now been laid bare, because we are going through a pe¬riod of disinflation. We have to put our house in order, particularly if we are going to compete in world markets." Bailey also touched on coal research. "The industry certainly accepts the fact that we must find a way to burn coal as cleanly as possible. A lot of work in that regard is going on. I expect there will be some significant break-throughs." Bailey said the coal industry is being squeezed this year. Last year, coal customers accumulated inventories in anticipation of a major coal strike that never materialized. Now, many utility customers are working down these inventories. So they are not taking deliveries on their coal contracts. But coal use is up in 1985, compared with 1984, Bailey said. So increased coal use, along with supply drawdown, should strengthen the coal market before the year is out, he said. After Bailey's presentation, some 100 speakers addressed policy and technical topics at 15 sessions during the four-day meeting. It was the first time since 1977 that the AMC Coal Convention has been held in Pittsburgh. And this year's attendance was up 40% from the last AMC Coal Convention held two years ago in St. Louis, MO. This year's registrants included 228 companies, 225 manufacturers, and 106 associated members. The only negative was the David Lawrence Convention Center. It was less than ideal. By turns, meeting rooms were too small, too cramped, or too far from one another. The session on longwall mining was so crowded that the doors were propped open so conference delegates could peer in. A concurrent manufacturers' forum session needed 50 more chairs to accommodate those wanting to attend. However, on to summaries of some of the presentations. Coal transportation and export Since Congress approved the 1980 Staggers Rail Act, railroad rates for hauling coal have not been excessive. In fact, rail rates for coal have increased less than 0.5% a year, in real terms, since 1980. Moreover, the market oriented principles written into Staggers are contributing to the improved financial and operational health of the nation's railroads. But no railroad is earning excessive profits. That is the gist of a coal transportation study being completed by the US Department of Energy. William Vaughan is DOE's assistant secretary for fossil energy. He affirmed the thrust of the upcoming report. Vaughan did allow that Interstate Commerce Commission (ICC) regulations on rate reasonableness could permit the railroads to exploit their monopoly power on captive shippers. In the context of this session on "Practical Placer Mining," a projection of the present into the future first assumes that there is a future for Placers. The second assumption is that there is the combination of adequate reserves and a willing, mining investment source to finance placers. This paper will point out the opportunities on both assumptions, illustrating my positive position on the future of gold placers. In order to focus this paper more effectively, I have chosen GOLD as the subject mineral. However, it is recognized that much of the technology for exploring and mining gold placers has been applied to other alluvial deposits; including platinum, diamond, tin, and various industrial minerals (which are often referred to as "placers" though this contradicts historical definitions). Over the past 10 years I have presented several papers on the general subject of placers, most of which are listed under References. These have included topics such as exploration, evaluation, small-scale gold placer mining and decision-making, mining and processing equipment designs, and dredge-mining operations. In an attempt to identify the more promising, undeveloped placer potentials in the world I have usually mentioned the USSR and China but qualified them as being either inaccessible, or, politically difficult to obtain. However, with recent developments in the USSR, the obstacles appear to be somewhat diminished.

Good morning ladies and gentlemen. I would like to thank Hans von Michaelis for inviting me here today to talk to you on the subject of "How to Reduce Capital and Operating Costs at Heap Leaching Projects". The comments I have to offer are based on my experiences in gold heap leaching by Newmont Gold Company in Nevada, by Newcrest in Western Australia (formerly Newmont Australia), by Minera Yanacocha in Peru, by Penmont in Mexico, by Z­Mont in Uzbekistan, by the Hochschild Group in Peru and expe­riences in copper heap leaching by Magma Copper Company in Arizona and as a consultant on several other smaller projects worldwide. These comments are a mixture of technology, ideology, philos­ophy, strategy, logic and opinions and might be looked at by many of you as "one man's view". I like to look at them as "a view from the bridge". Let me add that it doesn't bother me that you may not agree with my comments and that I would be interested in your comments or criticisms at the end of this presentation. I don't intend to discuss the details of the mineralogical and metallurgical test work. I will assume, for this talk, that the test work has been conducted very carefully and that the ore in ques­tion has been determined to be heap or dump leachable. Let's begin with a couple of don'ts! ! First, "don't build the mill until you have a mine". This might sound to many of you as fundamental but believe me it continues to happen. The minable reserves should be well known and established as being economical to mine and leach. NPVs, ROis and IRRs are fine if you can be sure of the gold price you use in your calculations. The best method is to carefully estimate the capital cost and, most importantly, the operating cost per ounce of gold recovered which should include the repayment of the borrowed capital and the interest thereon. For example, if the operating cost under these conditions is $200 per ounce, you have a project. If it is $400 per ounce, walk away f om it. Incidentally, the same prin­ciple can be applied to projects involving other metals such as silver, copper, lead, zinc, etc. The second don't is - "don't be sheep". Don't climb on the bandwagon with respect to design and operation because every­one else does it a certain way. Keep an open mind, be versatile, look for change, look for every possible innovation for reducing capital and operating costs. Beware of those who will tell you "we tried that it won't work" or "it's too expensive" or "that's a crazy idea" , <' ''what do you know about mining - you are a metallurgist aren't you" or "what do you know about metallurgy - you are a miner aren't you" or "only geologists can handle this issue". Be careful about pigeon-holing people according to their basic degree and experience. In these days of low metal prices, we need to consider everybody's ideas, as crazy as some of them might seem.

The National Institute for Occupational Safety and Health (NIOSH) is conducting research to develop safe practices for the use of shotcrete as ground support in underground mines, particularly mines operating in weak host rock. As part of this research, tests were conducted with a commercial poly-fiber reinforced shotcrete mix to develop a practical means of measuring shotcrete adhesion strength. Full-scale tests were conducted in a test frame equipped with concrete panels having three distinct surface roughness profiles. Adhesion test fixtures either embedded or epoxied in the shotcrete were overcored into the underlying concrete, and direct tensile tests were conducted to determine the bond strength of the shotcrete cores to the substrate after a selected shotcrete curing interval (1, 3, 7, 14, 28, or 90 days). Measured adhesion strengths typically ranged from 0.5 to 2.0 MPa depending on the curing age of the shotcrete samples. This paper presents the results of these tests, describes the portable test system components, and addresses some of the design issues encountered in the development of a rugged and reliable method for determining shotcrete adhesion strength in underground mines.

INTRODUCTION Since several years the author is engaged in research activities in the field of mining method modelling (Oberndorfer, 1993 and 1994). The initial goal was to improve and assist the selection of the most appropriate mining method. However during investigations it became obvious that the most beneficial application of computer support is the fast calculation of numerical assessment rather than the consideration of all, i.e. also qualitative, criterions necessary for final decision. Numerical results serve - together with qualitative considerations based on the experience of the mining engineer - as a basis for decision. The emphasis is on "fast" calculation, as only this property makes it possible to calculate and compare many distinct variations. As long as no procedure exists, which optimizes all involved parameters, calculating many variations is of great important, because it is the only way to increase the chance to pick a alternative "close to optimum", but also to learn about the sensitivity the result will react on changes of input parameters, which are rarely known exactly. Generally speaking many trials give a better basis for final decision. It is no secrete that the most important obstacle towards quick calculations of a series of alternatives is not the processing time of the computer, but the time required for setting the input data in way that the computer can start processing, which is usually inter- active man work on the screen. Furthermore usually several distinct programs are required to cover the whole range of involved problems, with corresponding problems in automatic data transfer. The research work&apos;s goal was to overcome these problems. The approach developed was to describe a mining method more in a theoretical way (i.e. to give the computer some degree of "consciousness" on mining methods), which then can be applied under any specific conditions. E.g. a cut-and-fill operation will be "generally" the same in narrow or thick deposit areas, but the resulting keyfigures, e.g. total tonnage, productivity, dilution and loss, or finally costs per ton, will differ significantly. The approach (MMM = mining method modelling) presented reflects a deduction from the general case to a specific one (rather than the other way round). The developed model is general enough to be applicable to any mining method, and also to any degree of precision the mining method should be described, contrary to programs designed for specific mining method layouts which can be adjusted in a more or less wide range. PROGRAM DEVELOPMENT The principle correctness and feasibility of the approach was proved by a prototype program. However this program was more on a research level and far away from application for "real world" problems. The reason for this was, that it was regarded wasted time to re-invent certain tools, e.g. geometry intersection, deposit modelling or visualization. Hence it was tried to attract several software producers to invest in finalizing the model. Unfortunately this endeavor was not successful. Despite this defeat - and after some months of resignation - a final start on the project was decided. he reason for this decision was not at last the research activity in respect of low-cost underground mining methods for bulk- material as a substitute of typical quarry operations due to environmental restriction. This research work - which is in particular important for Austrian mining activities in beautiful and touristically used landscape - requires a lot of calculations in the way described. Both are still in state of progress, but - regarding mining method modelling - preliminary results can be presented. A complete re-programming of the program was required. Most obvious are the changes of programming language and operating system environment. Instead of Pascal under DOS C++ under MS-WindowsNT is now used. Several problems could be solved by this, in particular memory management, device drivers for input/output, and user friendlyness by up-to-date windows technology. However also more basic structures were changed. The idea was to utilize as many existing commercially available programs as possible to minimize programming efforts. Your interesting and well-written paper brings up the issue of the purpose or use of a mineral property appraisal, specifically the value of these evaluations when the quality and quantity of the mineral resource to be exploited have not been thoroughly investigated. I am not a practicing professional in regards to valuation of limestone investment opportunities. I simply wish to make a few generic observations about the appraisal process in order to stimulate meaningful thinking by appraisal professionals whose reports may be reviewed by professional investors and "laypersons" alike. It is my contention that the analysis given in your paper is very thorough, considering the data that was made available to you. But I would not like to be the person responsible for investment decision making without having a feel for the risk involved. Therefore, the reviewer must classify this type of analysis as relatively "subjective" because they have not received an indication of the inherent risk involved in exploiting a mineral resource. This risk can best be quantified by using probabilistic methods in conjunction with the quality and quantity of the mineral to be produced. Most appraisals passively ignore this problem. Specifically, you have accurately identified the various costs and values entering the economic appraisal process. These can usually be quantified with a great deal more certainty than the capability of the resource to provide 25 years of quality material. Also, in Cases A (West Virginia)and B (Alabama), you are fortunate enough to have previous operations data. What if there had never been production from these properties? How does a potential mineral property investor evaluate the resource capability to meet various projected financial outcomes without spending a good deal of up-front capital to drill and delineate enough quality resources for a 20-plus year operation. These questions pose a substantial risk to any potential mineral investor. Only probabilistic methods should be used to quantify this type of problem, short of drilling and metallurgical testing. The reclamation of surface land areas disturbed during the course of coal recovery became a major, universal consideration upon the implementation of the Surface Mining Control and Reclamation Act of 1977. This legislation not only established reclamation as an absolute requirement, but also presented guidelines for reclamation standards and required bond-posting procedures to assure completion of the reclamation process. The Office of Surface Mining was established to enforce the provisions of the Congressional mandate by promulgating specifically detailed regulations and supervising the State participation in this regulatory process. The major operational consequences of the reclamation-related provisions of the Act and the OSM regulations are the increased costs and complex procedures necessary to accommodate the regulatory authorities. It is anticipated that many of these costs and procedures have not been adequately evaluated by either the coal operators or the regulatory bodies. It is, therefore, necessary to proceed with an examination of the general reclamation processes, the effect of these processes on product costs, and the methods, if any, which may be utilized to minimize their impact on the overall operation.

The purpose of this paper is to relate progress in the engineering field called Minerals Beneficiation to undergraduate and graduate education in our colleges and universities. So mach has been written recently about the education of scientists and engineers that I&apos;ve had to struggle against the temptation to repeat what has been often said before, particularly because man like Robert Mehl of Carnegie Tech, Antoine Gaudin of MIT, H. M. Davis of Penn State, and John Vanderwilt of Colorado School of Mines have recently written many quotable paragraphs on the subject. In the matter of progress, the rapidity of proliferation in the area of physical and chemical beneficiation is convincing proof that this is indeed a lively art, and having been a millman for 35 uninterrupted years I prefer to lean on personal observations to some extent, rather than on statistics and charts v culled from the journals. I propose in this paper to talk first about the progress we&apos;ve made in our branch of the mining industry in the last 3 decades--particularly in the last few years--and try to show that future progress will depend upon the quality of education and capacity for research possessed by our colleges. "Construction projects involve a great many risks. The risk that material prices will increase during construction or that the work under construction will be destroyed by fire, storm or some other act of God are just a few examples. In tunneling or other underground projects, one of the most significant risks is that the subsurface conditions encountered during construction will differ from what is expected. Each of these risks must be accounted for, managed and, ultimately, the duty of one party or the other to bear. The primary tool used to allocate the risks among the parties is the construction contract.How construction contracts allocate the risk that subsurface conditions will differ have changed substantially over the past century. Today, construction contracts typically allocate the risk through a series of provisions. The first is the differing site condition or changed condition clause. That clause, when included, typically provides that the owner bears the risk that the subsurface conditions will differ from what is indicated in the contract documents or what is reasonably expected. The second clause is one that provides that the contractor must conduct a reasonable site investigation and bear the risk of any conditions that such an investigation would reveal. The third provision includes disclaimers that are often included in geotechnical data provided by the owner (or the owner’s engineer) to the contractor which attempts to limit the information on which the contractor can rely. Because these risk-allocating devices seem to be somewhat conflicting, a brief discussion of each provides critical insight in understanding how the modern construction contract allocates the risk of differing site conditions.At the start of the 20th century, construction contracts looked substantially different than they do today. For example, one contract for the construction of a public water tunnel in Chicago, IL, drafted around 1895 contained the following clause:The contractor must take the work entirely at his own risk. No extra allowance will be made for quicksand, hardpan or boulders."
