The 78th Regular Meeting of the Rocky Mountain Coal Mining Institute (hereafter referred to as RMCMI) convened at the Marriott's Mark Conference Center, Lionshead Village in Vail, Colorado. The meeting was called to order at 8:45 a.m. by the President, Ira E. McKeever, Jr., who is President, Western Mining Operations, Natural Resources Group, W. R. Grace & Co. McKeever was introduced by Past President Edward F. Ziolkowski, Senior Vice President and General Manager, Energy Development Company in Hanna, Wyoming. MR. ZIOLKOWSKI: The first order of business this morning is to introduce the president and for a business meeting as well as other items on the program. It is my pleasure to introduce Ira McKeever to you this morning. Ira was born and raised in Kit Carson, Colorado, and served in the U.S. Navy prior to obtaining his geological engineering degree in 1952 from Colorado School of Mines in Golden. He then spent the next 20 years involved in mining sulphur, pot ash and coal with Texas Gulf Sulphur at that time and Gulf Resources Chemical Corporation. In 1972 he joined W. R. Grace & Co. as president of the Mining Division, Natural Resources Group. He was named Colowyo Coal Company's president and general manager in 1976 to develop what is currently Colorado's largest coal surface mining operation. Last year he became W. R. Grace's president of Western Mining Operations which is the position he presently holds. Ira is active in civic affairs; he is currently serving on the Colorado Energy Impact Assistance Advisory Committee. He is a member of the Colorado's Metropolitan Water Roundtable, he is also a director of Project Colorado, a member of the committee for the Colorado Division of Commerce and Industry. He has, in the past, served as chair- man of the Craig Hospital Board. In 1967 Ira was the recipient of the Colorado School of Mines van Diest Gold Medal Award, and in 1981 was given the individual service award for outstanding accomplishments in the field of health, promotion, physical fitness by Colorado's Governor's Council for the Health and Promotion of Physical Fitness. Memberships are also held in Denver Coal Club, the Colorado Mining Association, and the American Mining Congress. Will you please welcome Ira McKeever? I do have one other piece of business here. If you will all join with me, yesterday was Ira's birthday. I asked what year that was, but I couldn't get that out. So, I'm not going to lead the singing. Someone is going to lead the singing. But I think it would be appropriate if we did sing happy birthday this morning and I think it would also wake us up. How's that? All right, will you join me please? (A chorus of the Happy Birthday song followed.) President McKeever's address: MR. McKEEVER: The secret is that I'm double nickles. So I've got a few more years hopefully to be with you and this wonderful industry that we represent. Thank you Ed. I realize now more than ever, the tremendous effort that you put in the program last year and the magnitude of the job that is placed in the presidency of the Institute. It was indeed with tremulous hands that I undertook to lead the Institute this year, and I found a tremendous amount of strength and guidance in my friend Ed whom we've known since college days and worked together. On behalf of that lifetime of memories and good thoughts, Ed, I would like to present to you a little token of appreciation. 1 would like to join Ed in welcoming you all to Vail. Ed arranged the weather, 1 arranged the program along with Charlie Margolf. This is the 70th regular meeting of the Rocky Mountain Coal Mining Institute; and in accepting the leadership a year ago, 1 obligated one very special person to fill the role of chairlady and hostess for this meeting. I would like to have you all, if you haven't already, meet my wife, Linda. I would like to thank her publicly for her guidance and help she continues to provide me. It's absolutely necessary that you also meet and recognize Charlie Margolf our program chairman who will be helping through the meeting to present and monitor our program; and anyone who knows Charlie knows the sincerity and dedication he brings to anything or any phase of life he touches. We will be seeing him in action this afternoon when he chairs the most interesting panel presentations. Don't miss it if you can help it. A couple of logistical comments. Executive Summary The future of coal as an important energy source in the 21st century will depend heavily on whether or not our industry is recognized for its performance. We have had a major role in powering our nation through the 20th century ... but many today do not understand that role nor do they know that 56% of our nation's electricity today comes from coal. Corporate communications, marketing, and public relations must be a high priority of our industry if we are to survive in the society of the 21st century as a viable energy option for powering our nation. The time to start is now. The place to start is locally. The way to strengthen local and regional efforts is to network on a regional and national level with associations who have the ability and the will to develop effective communications strategies. Introduction The Minnkota Power Systems is a regional association of 26 electrical suppliers. Serving more than 96,000 customers in a 34,500 square mile service area in Minnesota and North Dakota, the association includes 12 municipal utilities, 12 distribution cooperatives, a municipal power agency, and a generation and transmission cooperative. The Minnkota Power Systems generating capacity totals 613 megawatts, and 83% of it is fired by lignite coal. On an annual basis, 80% of our total energy is derived from coal. We are proud of our long association with the coal industry. Our pride shows in the very visible role that coal plays in our marketing and public relations efforts. In 1993, the Minnkota Power Systems had one of the lowest wholesale rates in the country, at 3.1 cents per kWh. Average residential rates were 5.8 cents per kWh. Minnkota Power Cooperative, One of the Minnkota Power Systems, is a generation and transmission cooperative headquartered in Grand Forks, North Dakota. Minnkota's Strategic Plan - Shaping the Future Minnkota recently completed a strategic planning process which is intended to give direction to our future and allow us to proactively influence the shape of that future. Minnkota's mission is to assist the associated systems in Improving the quality of life of their consumers by continuously improving the value of electric energy to the consumer. The 70th Regular Meeting of the Rocky Mountain Coal Mining Institute convened at the Steamboat Village Inn, Steamboat Springs, Colorado, and was in session at 10:00 a.m. The session was called to order by Past President O. F. Lewis. Consultant, Colowyo Coal Co., Denver, Colorado. Mr. Lewis introduced President A. F. Geiger, Manager, Navajo Mine, Utah International, Inc., Fruitland, New Mexico. Following are Mr. Lewis' remarks: Ladies and gentlemen, members of the institute, guests and friends, welcome to Steamboat Springs and the 70th meeting of the Rocky Mountain Coal Mining Institute. From all appearances this is our largest meeting and should be the most successful. When I last spoke to you I was President of Colowyo Coal Company and the Rocky Mountain Coal Institute but that has changed. Colowyo Coal Company was acquired last Dec. by W. R. Grace & Co. and operates as Colowyo Coal Company, Division of W. R. Grace & Co. I am confident these people will make a worthwhile contribution to the coal Industry.

The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during he 84th Regular Meeting of the Institute was called to order by the president, H. Dean Jacot at 11:30 a.m Tuesday, June 28. 1988 in Peak Room 5 of Beaver Run Resort at Breckenridge, Colorado. Twenty three were present and a quorum was established. The president stated the purpose of the annual meeting is to inform members of the status of the affairs and activities of the corporation during the year. It was moved by Loren Linville, seconded and carried to approve the minutes of the previous meeting as published in the 1987 Proceedings. The chair called for reports of the various com¬mittees and these reports will he placed on file in the RMCMI office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted two resolutions: (I) Noting the passing of members since the last convention-Richard T. Brownrigg. Don A Dewey, John T. Maulshy. Hugh D. Nyquist and Mike Zakotnik. (2) Recognizing the superior skills of J. Brett Harvey. RMCMI Vice President of Utah. For recruiting 26 new members from the State of Utah and named him as #1 Recruiter in the Institute?s 1988 membership drive. Linville further commended the Executive Secretary officers, chairmen and committees loran excellent job in planning the 84th Regular Meeting and convention. Membership. In the absence of chairman Ed Sullivan. the secretary reported there are currently 718 active or dues paying members, 51 Life Members and 250 delinquent in dues payment. In the 1988 membership drive. 132 new members have been recruited and 74 of them attended this convention making up 27V, of the total attendance. Patrons of the Institute. This report was given by the secretary for chairman Ira McKeever. A total of 124 plaques has been prepared during the low year life of the program. It has been culled to 119 possible donors as some firms have gone out of business or consolidated. Of this number 46 renewed their annual $100 donation and three new Patrons have joined prior to the convention for a total of 49. During the convention. four new Patrons donated $100 each. tour former Patrons pledged $100 each and seven would be-new Patrons pledged $100 each for a total of 15. This would bring the grand total to 64 if all pledges are received prior to the close of this fiscal year as opposed to 59 renewals in 1987. Program. Co-Chairman Pete Nielsen announced the convention program theme "Broadening OUR Horizons" was well received despite the loss of three speakers during the final days prior to convention. Because the remarks of the Monday luncheon keynote speaker ran over the first time-to-be-tried Monday afternoon Poster Session was delayed almost an hour in beginning. This well thought out feature will he run again next year but in a different time frame. Nielsen thanked his co-chairmen, Bill Balaz and the Poster Session chairman Marcie Greenberg. Publicity. Chairman Tom Egan reported three newsletters including the convention newspaper were sent members during the year. He and Bob Jacob of Bob Jacob Public Relations were at registration daily to secure business card ads and to solicit advertising for the Proceedings. Scholarship. Chairman Keith McGinnis reported that six of the seven scholarship recipients were present at the convention. The University of Arizona at Tucson was added this year and it was the only university visited this year by the chairman. Each scholarship recipient was introduced to the membership at the Monday morning Welcome Session, presented a plaque and responded. The input Iron each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. McGinnis noted that the mining engineering department at the University of Wyoming may be dropped during the coming year. Joe Dunlap suggested that every member rally support of this department. The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. (Articles of Incorporation and Bylaws as adopted are printed following these minutes.) Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Holland THEREFORE, BE IT RESOLVED, that we record in the minutes of the RMCMI, recognition of the passing of these members who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere sympathy and deep regard of the members of the Institute. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Item 4: RESOLVED, that the RMCMI express its gratitude to K&P, INC. of Golden, Colorado for their generous donation of office facilities and furniture for the RMCMI office and to K&P SALES ENGINEERS, INC. also of Golden, Colorado for their assistance in telephone answering, other office procedures and the use of certain office equipment. Item 5: RESOLVED, that six scholarships be awarded annually to advance the education program of the Institute to worthy students pursuing career paths in mining or other related industry in the six states in which the Institute generally operates and has members and in accordance with the criteria set forth by the Scholarship Committee. The Bituminous Coal Industry has for the past year been faced with a most serious problem. I am sure that you have had your own individual and local problems, as do we all. In my thirty years of practical experience with coal mining, I have never found an operating man nor a coal mine without problems. The very nature of mining, with so many unknown factors involved, precludes the absence of problems. But they are not insurmountable, and one should not dwell on them interminably. They should be recognized as a challenge to our ability and ingenuity to solve them, and once the proper solution is found, it should be applied and the problem dismissed. However, we find ourselves at the moment in the midst of a serious challenge to our very existence. In the early thirties, many in the industry welcomed the re-establishment of Unionism as a balance wheel, in the belief that the stabilization of wage scales would also stabilize prices and eliminate disastrous price cutting practices. The ultimate effects of having twenty-six years of benevolent paternalism in the administrative branches of Federal and State Governments with their labor courting policies, could hardly have been anticipated. And so with wages spiralling under government sponsorship, we have finally reached the point where competitive fuels, such as natural gas and oil are more attractive to the consumer, from the economic angle of cents per BTU cost, than coal.

Thank you, Tom, I appreciate that generous introduction - and your generous welcome. When Doris Finnie asked me to speak here today, my decision to join you couldn't have been easier - for two reasons. First, I can't say no to an opportunity to return to Steamboat Springs. My family has wonderful memories of skiing here. And this time of year, golf in the mountains is so good you almost don't miss the skiing. The second reason this was such an easy decision is that The Rocky Mountain Coal Mining Institute is such an important forum for the coal industry, and it's certainly important to Peabody. We have mines in five western states - Arizona, Colorado, Montana, New Mexico and Wyoming. Last year, our western mines produced more than 110 million tons of coal. That's about two-thirds of our total domestic production. So western states are obviously critical to us. A couple of weeks ago, the west became even more significant to Peabody. Of course, I'm speaking of PacifiCorp's planned acquisition of The Energy Group - including Peabody - announced the middle of this month. Admittedly, when I agreed to speak here - some months ago - I had no idea just how much change Peabody would face in this relatively brief period. Still, not knowing then about the PacifiCorp announcement, I chose change as the subject for this talk. I'll update you on our recent news. But, first I want to establish a broad context for the PacifiCorp/Energy Group announcement and other change in the electricity business, change here in the United States and all over the world. ? We'll see how change is driven by two major trends - privatization in emerging markets and deregulation in mature markets, In turn, those two trends will cause ever-increasing consolidation - in both the coal industry and the broader power industry. ? After outlining those trends, I'll discuss the change that will dramatically affect Peabody following the announcement a week ago that PacifiCorp and The Energy Group intend to join forces to create one of the world's largest international integrated energy companies - an event that adds considerable credibility to the prophesies I'll outline in my remarks today. ? Finally, I will discuss an issue that threatens our industry's future - and, indeed, the economic future of all Americans. That issue is the inappropriate response to the unproven possibility of global climate change. Let's set the stage for change. And let's begin with the first trend I mentioned - the trend to privatization in developing economies. What drives the trend to privatization? Economics. It's all about the supply and demand of capital. And the engine that drives the supply/demand ratio is growth in electricity demand - tremendous growth in demand in developing economies. The U.S. EIA projects worldwide growth in electricity demand at 63 percent between 1990 and 2010, most of it in developing countries. This strong growth means that a new 500 MW power plant will be needed every three and one-half days until the year 2010. Now, if we say that a 500 MW plant will cost about $500 million dollars, we're talking about a bill of about $1 billion dollars a week - through 2010. That voracious demand for capital drives the trend to privatization. It means countries in Eastern Europe and the former Soviet Union want to sell generating assets. And Asian countries - for example, India, Indonesia and the Philippines - want to find private investors to build power plants. Privatization already is well underway. In the future, it will grow, with countries in South America, Central America, and Africa joining the trend. Bottom line: The privatization trend means rich new opportunities for companies willing to think beyond "business as usual." Meanwhile, developed economies face a different but no less fundamental change. Western European countries, the United States and Australia face deregulation. Why does deregulation represent such a big change? Consider a few basic facts about the U.S. electricity market to see what a big change -

CONCLUSIONS: Our experience, where we attempt to remove a continuous face with a seam more than six and one-half feet in thickness, has been rather disastrous. We have been able to open up faces and retreat for a distance of 75 to 100 feet in this particular character of coal, but after the supporting timbers have been removed for the second or third time we have found that the roof has a tendency to ride over the props and break off at the face of the coal support. However, where our coal is below six and one-half feet in thickness we have had very good success in handling the roof and breaking it off systematically with our break line of props, which are usually from 12 to 15 feet from the face of the coal. Our practice in to set props at about two-foot intervals in each direction and remove two sets of props, at the same time two additional sets are placed along the coal face. At all times we are very insistent that all props be removed from the gob and that entire coal be taken out so that it is possible for the roof to break freely and all come down, not having any supporting pillars in the gob. The conclusion of our experiments to date is that if all the supports beyond the breaking line of props are taken out as the long face retreats and the closer the breaking line of props is kept to the face the better the results will be. We have never felt it safe to have less than four rows of props to protect the machinery and men working along the coal face. We feel that the time element as to the rapidity with which these faces are advanced or retreated, is of vast importance, but to date have not had an opportunity or experience enough to reach any conclusion as to what time element is proper here with us. We feel that the crushing strength of the overlying strata will govern this to a large extent, and as ours varies considerably, it is going to he very difficult for us to reach a definite conclusion. My opinion is, that conditions may be such that rather than have a short face and retreat rapidly, it will be found that a longer facewith a slower retreat will work out better. Such a condition might give the overlying strata time to settle. The caving of roof or of control of this caving, with us, is quite closely associated with the ventilation. We find that the places where the strata overlying the coal are composed of shale, that the effect of the air on this is of very great importance. It is our endeavor, at all times, not only to remove obnoxious gases, but to keep a current of fresh air moving along the face and, of course, a portion of this travels over the gob and comes in contact with the roof and overlying strata. This, we find, helps materially in keeping the roof on the move. As it is our practice to keep water for sprinkling purposes at all places, we also use this water to keep the roof wet back in the gob. The effect of water on the shale is to cause it to disintegrate quite rapidly. MR. HOLMAN (Concluding): If there are any questions about this, I will be glad to answer them. I have some prints and also some pictures of the scraper loader and the shaking conveyors (distributes.) PRESIDENT MOSES: We wish to thank you, Mr. Holman, and also wish that you would thank Mr. Dupont for his paper. Are there any discussions? Do you wish to ask Mr. Holman any questions? (No response.) PRESIDENT MOSES: Mr. Holman, I would like to ask you how you take the photographs; were they taken by flashlight, or were globes used, or how were they taken, in a gaseous mine? MR. HOLMAN: Our mines being gaseous, we do not use the ordinary flashlight for taking underground photographs, but we have had considerable success, I think, with underground pictures by means of electric lights. We use 250 watt globes. We have six of these rigged up with tin reflectors, 18 inches in diameter, on standards, and we carry two or three hundred feet of wire connected with these six lights, and they can be turned on in the room where we take the photograph, by means of this extra wire. ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. All winners were present as guests of the Institute at the June convention in Durango, Colorado to receive recognition at the Welcome Session Monday, June 26, 1989. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Keith McGinnis, each winner receives $500.00 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $500.00 for tuition credit in their senior year if they have maintained good academic standing and have been recommended by their university. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the state involved. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in the engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Blizzard Colorado School of Mines Golden, Colorado A high school graduate of Longmont, Colorado, Johnny carries a 3.968/4.000 at Mines, majoring in Mining Engineering with a minor in Metallurgy. His name has appeared on the Academic Dean's list for the past two years. He received the Robert M. & George R. Harris Scholarship during this past year. He is a student member of SME-AIMMP and an executive council member of CSM's chapter of AIME. When it was announced that the economy grew at an annual rate of 4.7 percent in the Fourth Quarter of 1992, it appeared that our long awaited recovery from recession was here. Unfortunately that much growth proved to be unsustainable, and in the First Quarter of 1993, the number dropped to less than one percent. Today it is clear that the recovery is continuing, but at a very slow rate. One of the Most disturbing statistics during this recovery is that unemployment has not improved as one would expect but has been hovering around 7 percent for over a year, making this recovery a ?jobless? one. In a recent Harvard Business School presentation, a professor reported that the United States has slipped from its leadership position in almost every manufacturing category since World War II. From the production of cars to consumer electronics, we have lost significant world market share to others, most notably Japan and Germany. Obviously this is not new news, but the magnitude of the loss and the number of industries affected was surprising to me. The result has been that our negative balance of payments has soared, and the United States of America now has the dubious distinction of being one of the world's largest debtor nations. It has been common for politicians, and political want-a-be's, to blame all of our trade problems on industry. They say that the moguls of American industry spend too much time seeking short-term gain at the expense of long-term growth. They say that we are interested more in our own perks and economic security than in producing quality products that can compete in the world marketplace. One of the stared goals of the Clinton Administration is the targeting of strategic industries to receive help from the government so they can compete on the world stage more effectively. Personally. I think that is an oxymoron. My experience has been that whenev-

The 73rd Regular Meeting of the Rocky Mountain Coal Mining Institute convened at The Mark Conference Center, Lionshead Village, Vail, Colorado, and was in session at 10:00 a.m. Past President, Robert W. Wilson, President and General Manager, K&P, Inc., Golden, Colorado, called the meeting to order. The membership was asked to stand and pledge allegiance to the flag. As your immediate past president, it is my pleasure to have the responsibility of introducing our current President. But before I tell you about Ralph, I would like to make the following brief reflection, which I feel very strongly about: In these days of so much negativism toward our coal industry by so many people, we all must remember one thing as we go about producing energy for our country. Coal mining is just as American as the American hamburger, the American hot dog, and just as American as the flag to which we just pledged allegiance.

PRESIDENT HERRES: If you will come to order, please, we will get started on this morning's program. This morning's program takes up the matter of mechanized mining, particularly mechanical loading. There has been considerable progress made in the West with mechanical loading, but we are interested particularly in what is being done in other fields. We are particularly fortunate in being able to have with us Mr. G. B. Southward, Mechanization Engineer of the American Mining Congress. Mr. Southward has devoted his time for the past several years entirely to a national study of mechanized mining. He is the author of the Year Book published by the American Mining Congress, which is the authority for progress and development on mechanical loading. Mr. Southward has come here from Washington, D. C., particularly for this meeting. We have asked him to speak on the national phases of mechanized mining, and particularly on what is being clone in the East, since we are familiar with what is being done in the western field. I take great pleasure in introducing Mr. Southward. (Applause.) MR. SOUTHWARD: Mr. President and Gentlemen: Before starting on this gaper, I would like to express to all of you and to your President my appreciation in being asked to come here. It is a privilege. This question of coal mine mechanization, as you all know, is a big one. It is too big a problem for any one company to handle and it is through such meetings as these, through the co-operation of the various companies throughout the United States, that we have been able to make the progress that we have made. As Mr. Herres has said, I am not going to try to tell you gentlemen anything that is going on out here, in the West. You already know that yourselves. But he has asked me to give a brief resume of the progress that mechanization has made in the eastern coal states.

Horne, Acting Chairman of that committee. Motion was made by Dock Schloss that the report he accepted; seconded and carried. Oren Bridwell, Chairman of the Resolutions Committee, gave the following report: Resolved: That the members of the Rocky Mountain Coal Mining Institute in convention assembled, hereby ratify and confirm all official actions of the officers, the Executive Committee and other committees of the Institute between June 29, 1960, and the present time.

It's my pleasure to welcome the Rocky Mountain Coal Institute to Montana. Now that you've ended a 74 year history of meeting outside our borders, I hope you'll be back more often. Even if I can't convince you to come back before 2060, when another 74 years will be up, I'm confident the Kalispell and Flathead Lake area will do the persuading for me. In recent weeks, I've made a number of speeches around the state pointing out just how wrong the revenue projections in Montana's state government made in April of '85 were when we came to April of '86. Since the middle of this month, Montana's legislators have been in Helena struggling to balance a state budget that, by the end of fiscal year '87, threatened to be some $88 million in the red. Other western states reliant on natural resource and agricultural economies have found themselves caught in the same deflationary spiral. The "window of opportunity" I proposed and the 1985 Montana Legislature passed, couldn't have been opened at a more difficult time. What was envisioned as an incentive to expand Montana's coal production, and our tax base, ran aground on low oil prices and excess hydroelectric power. De- spite the one-third severance tax rebate offered on new coal production, year-to-date figures published in the June 2nd Coal Week show that production in Montana is down almost 10 per- cent from last year. Again, we're not alone. Production in Wyoming is down 8 percent and in North Dakota, it has dropped 13 percent. An over- all 3 percent production decline in western states looks even worse when contrasted against a 12 percent increase for your eastern competitors. Montana's "window of opportunity" had the potential to be a significant signal to your industry. That potential was quickly tempered by the inability of Arab nations to stabilize world energy prices. If any of us had forgotten, the last twelve months have reminded western states that the well-being of our natural resource economies has a tremendous impact on the ability of all levels of government to provide services. The past year has also driven home that in the world of business and in the business of the world, risk-taking is still the name of the game. The Western Governors recognize the problems facing this industry - and our states - and we're prepared to fight for the future of western coal. In the past two decades, legitimate environmental concerns have created a vast body of new legislation affecting coal producers. The industry has been required to meet new reclamation standards - tough regulations relating to ground water, air quality and wildlife habitat. To the industry's credit, coal companies have hired professionals with the technical know-how to do it right. Rather than considering reclamation laws to be an unreasonable burden, today's coal company is more likely to view its reclamation efforts as a source of corporate pride. In a sense, the industry and the agencies which regulate it have matured together . . . although at times OSM is reluctant to admit that either of us capable of or willing to play by the rules. Certainly some abuses exist and OSM's oversight has been helpful in ensuring parity between those states willing to comply and those that would rather defy federal law. Nonetheless, penalizing the more modem and responsible western coal industry for abuses that occur elsewhere is both unfair and counterproductive. Federal penalties range from "cruel and unusual" reporting requirements to the proposed electricity tax that would effectively force utilities and ratepayers who have already met the sulphur emission standards to subsidize those who have dodged their cleanup responsibilities. At the Annual Meeting of the RMCMI Board of Directors held June 29, 1985, the following amendments to the corporation bylaws Article III were made: Section 2. Advisory Board. There shall be an Advisory Board of Directors which shall be com- posed of all former presidents of the corporation and of the unincorporated association, also known as The Rocky Mountain Coal Mining Institute, of which the corporation is the successor. The Advisory Board shall periodically review the philosophy and policies of the corporation and make recommendations concerning the same to the Board of Directors. The Advisory Board shall hold an annual meeting at the same place as and immediately pre- ceding the annual meeting of the members in each year and written notice stating the place, day, and hour of the meeting shall be given or mailed to each member of the Advisory Board at least thirty days prior to the date fixed for such annual meeting. The annual meeting of the Advisory Board shall be for the purpose of electing a chairman from among its members and the person so elected chairman shall also serve as a member of the Board of Directors of the corporation. The Advisory Board shall meet at such other times and conduct its affairs in such a manner as it shall determine from time to time by resolution. Section 4. Regular Meetings. A regular meeting of the Board of Directors shall be held immediately following the annual meeting of the members, at the site of the annual meeting of the members, the day and time to be fixed by the Board of Directors at its annual meeting immediately pre- ceding the annual meeting of the members in each year, without the necessity of any other or advance notice. Such regular meeting of the Board of Directors shall be for the purpose of considering committee appointments, and for the transaction of such other business as may come before the meeting. A regular meeting of the Board of Directors shall also be held in the Fall of each year following the annual meeting of the members and written notice stating the place day and hour of the meeting shall be given or mailed each member of the Board of Directors at least thirty days prior to the date fixed for such regular meeting. Such Fall regular meeting of the Board of Directors shall be for the purpose of receiving the treasurer's annual financial report of the previous fiscal year as reviewed and approved by the auditor, to take action on the budget, and for the transaction of such other business as may come before the meeting. Section 8. Standing Committees. The Board of Directors may create by resolution adopted by a majority of the entire Board of Directors, a Bylaws and Resolutions Committee, a Nominating Committee, a Finance Committee, and one or more other committees each of which shall consist of two or more directors and which shall have and may exercise such authority in the management of the corporation as shall be provided in such resolution or in these bylaws. Section 9. Ad Hoc committees. The Board of Directors from time to time may by resolution create a Membership Committee, a Scholarship Committee, an Education Committee, various convention committees, and one or more other committees each of which shall consist of members of the corporation and which shall have and may exercise such authority, other than in connection with the management of the corporation, as the Board of Directors may determine. MINUTES of the Rocky Mountain Coal Mining Institute 81 st Member Annual Business Meeting July 2, 1985 The 81st Annual Business Meeting of the mem¬bers of The Rocky Mountain Coal Mining Institute was called to order by the president, Charles W. Margolf at 1:35 p.m. Tuesday, July 2, 1985 in the Windom Peak Room of the Tamarron Resort near Durango, Colorado. Thirty members were present and a quorum was established. It was moved by Bill Balaz, seconded and car¬ried to dispense with the reading of the minutes as these were published on pages 67 thru 77 of the 1984 issue of the Proceedings. The chair called for reports of the various com¬mittees and these reports will be placed on file in the RMCMI Office. Bylaws and Resolutions. Chairman Loren V. Linville reported that the Board of Directors had adopted changes to Article III, Sections 2, 4, 8 and 9 calling for clarification of Ad Hoc and Standing Committees as well as setting forth a purpose for the Advisory Board meetings and stating a time for an annual meeting. Upon completion of her, schooling she hopes to pursue a career in the coal mining industry. In preparation for her goal, her work experience includes being a lab technician, a mining engineer intern, and a lab technician assistant; she also is very skilled in various computer applications. She has been a member of SME-AIME, and secretary to the U of A Student Chapter, and recipient of the SME Coal Division Scholarship and past recipient of the Navajo Tribal Scholarship. [ ] Joshua Olmsted Colorado School of Mines Golden, Colorado Josh is a sophomore majoring in mining engineering at the Colorado School of Mines. He is an outstanding student as well as an accomplished athlete. Josh was on the Academic Honor Roll 1988-1989 and has been awarded an athletic scholarship. He plays varsity soccer and intramural basketball.
