The highly reactive Ti-Mo and Ti-Cb alloys were prepared and heat treated under protective conditions. Phase diagrams were established based on micrographic and X-ray diffraction analysis and detection of incipient melting. ß titanium forms a continuous series of solid solutions with both molybdenum and columbium, whereas these metals are only slightly soluble in the a titanium modification. PREVIOUS work on the Ti-Mo and Ti-Cb systems was very limited and is discussed in succeeding sections of this paper relating to the respective phase diagrams. The diagrams in the present work were determined principally by micrographic analysis, because other methods such as thermal analysis and dilatometry are not suitable, due to the low diffusion rates of these alloys in the transformation range. X-ray analysis was believed less useful than micrographic analysis because: 1—On quenching certain high titanium alloys from above their transformation range, the body-centered cubic ß phase decomposes into acicular a (hexagonal close-packed) which room temperature X-ray diffraction techniques cannot differentiate from isothermal a. 2— High temperature X-ray techniques might be used, but are difficult to apply and are subject to error because of the high reactivity of titanium with gases such as oxygen and nitrogen. Although metallo-graphic study was the basic method used, X-ray diffraction analysis was applied to a limited extent, to further substantiate the findings. The transformation ranges on the titanium side of the Ti-Cb and Ti-Mo systems were studied both with DuPont Process A (magnesium-reduced) titanium alloys and with iodide titanium alloys. The Process A metal was used chiefly to bracket the transformation range in order to reduce the number of alloys given a particular treatment for the more accurate final study with iodide titanium alloys. Experimental Procedure The analyses of the metals used in the preparation of alloys for this study are presented in Table I. Melting Practice: Early in the work, a consumable electrode, arc melting furnace was used in the preparation of the Process A Ti-base Mo and Cb alloys. This type of furnace has been described by other investigators.', ' One of the major difficulties of the consumable electrode melting process was the prep- aration of homogeneous electrodes (with the mixture of coarse titanium sponge and fine powder alloying addition) which would give homogeneous ingots. Composition gradients encountered may have been due to a tendency for powdered alloying metals to drop away from the electrode in handling. This difficulty in the preparation of homogeneous alloys was overcome by the use of a nonconsumable electrode furnace for later work. This furnace is similar to the one used by Mc-Pherson and Fontana a Ohio State University. A diagram of the nonconsumable electrode arc furnace is given elsewhere.' The source of power was a 400 amp dc welding generator. Electrode tips of tungsten (% in. in diam) were used for all columbium melts and for a limited number of molybdenum melts. Molybdenum tips were used for the majority of molybdenum alloy melts. Columbium tipped electrodes were tried, but disintegrated rapidly at currents above 300 amp. In the Process A titanium melting practice the metals were charged into the water-cooled spun copper crucible in the following forms: l—titanium: sponge (—4 + 16 mesh); 2—molybdenum: sections of 0.003 in. sheet (approximately ½ in. sq); and 3— columbium: powder compacts (? in. lumps broken from large section). The flow stress in some latent slip systems of aluminum and silver crystals after various deformations in single slip was investigated by transverse compression and supplemented by experiments on overshoot of the compression axis and the stability of corner orientations. Work hardening was found to be remarkably isotropic, the ratio of the flow stress in the latent system to that in the primary system being between 1.0 and 1.3. The strain-rate dependence was not significantly larger in the latent system. This low anisotropy suggests that specific dislocation interactions are not the direct cause of work hardening. Either the obstacles are essentially impenetrable so that only their distance enters, or a fairly random distribution of dislocations of all systems is. in fact. formed during single slip. The latter seems to he excluded by the observations on the strain-mte dependence and on the amount of secondary strain. The amount of seconzdary strains occurring in single slip was determined by shape-change mensurements and by a new method connected with the latent-hardening experiments. It is definitely less than 1/300 times the strain in the primary svstem. WORK hardening is due to dislocation interactions; this is a hypothesis, and possibly the only one, on which all present work-harden ing theories agree. About a dozen specific interactions have been considered, and it is unlikely that any essential one has been missed. Different work-hardening theories differ to a large extent in the specific interactions which are deemed most important. The presence or absence of any particular interaction, and its degree, depend on the geometrical relationships between the two dislocations interacting. Let us enumerate some examples. Two dislocations may react, with a varying reaction energy, to form a third dislocation, and this reaction product may be sessile or glissile. Two dislocations may intersect and a jog may be formed on both, on one of them, or on neither; this jog may be sessile17Z or glissile and it may, if moved nonconservatively, lead to the production of vacancies or interstitials. Finally, a dislocation may bypass another one and thus interact only with its stress field. All these interactions depend on the specific relation between the Burgers vectors and line directions of the two dislocations. Any dislocation generated during plastic deformation of fcc crystals belongs to one of twelve slip systems. Taking any one dislocation, its relationship to each of the other eleven can fall, by symmetry, into one of only five classes. These relationships are enumerated in Fig. 1 and Table I. Each slip system is represented in the stereo-graphic projection by two triangles, namely those in one of which the specimen axis would have to lie if the specimen were to deform in single slip on this slip system in a given sense, in a tension test. Let us represent the primary slip system by the shaded triangles. The other slip systems are classified only with respect to their relationship to this primary system. The code letters (initials of established names* in German) are explained in Table I. Three specific interactions are also listed in cases where they may be strong: the product of a reaction, the formation of jogs in either system, and the elastic bypass stress. The last column relates to the types of experiments reported in this paper and summarizes their results. To decide experimentally between the relative importance of the various interactions one would like to produce a group of dislocations in one slip system and then measure the stress necessary to force another group of dislocations of a specific second system through them. Hopefully, one can produce the first set of dislocations by plastically deforming the specimen in single slip. Then one can try to achieve single slip in a specific, previously latent system and measure its flow stress. If it is different from the virgin flow stress, there has been "latent hardening". Some types of latent-hardening experiments will be discussed in the next section. The strain-rate and temperature dependence of the flow stress is an indication of the importance of dislocation intersections. By extending an investigation of this dependence to the latent systems, one can determine how much more important forest contributions are here. seeger3 has used the as-

ALL of the matters so far taken up by the Institute Committee on Stabilization of the Coal Industry will be of help, but it seems to be that under present conditions not very much can be expected until the railroad situation has been improved. As an instance of this, I would cite the fact of our experience at our mines in West Virginia and Kentucky. During 1917 and 1918 at our West Virginia plants we produced for our own consumption, practically entirely in the Chicago district, about 4,750,000 net tons of coal. In 1919 our output was reduced to 3,500,000 tons, this being caused partly by the shortage of orders in the few months following the armistice, but more particularly by The car shortage which began last September and continued throughout the remainder of the year, with the exception of December. This car shortage has been more acute since the first of the year, and while we now have an actual capacity here of 20,000 tons daily and have the equipment to produce it, with the possible exception of a few houses, we are able to average only about 12,000 tons, and in consequence, about 30 per cent. of our by-product ovens in the Chicago district are idle, and a number of blast furnaces are down for the want of coke. These figures, of course, refer to conditions before the strike of switchmen in April was started.

Total crude fluorspar reserves in western Europe, containing more than 35 pct CaF*, are estimated at 12 million metric tons, while reserves in the USSR and Soviet sphere may exceed 5 million metric tons. The bulk of these reserves are concentrated in the USSR, Spain, United Kingdom, Western Germany, and Italy. Since published estimates of the tonnages of individual mines and explored deposits are not available for most countries in Europe, the estimates given in Table I for individual countries are necessarily approximate, as they have been compiled from various sources and modified and combined according to the author's judgment. The majority of fluorspar deposits in Europe belong to the late Paleozoic metallogenetic epochs and have been found within or along the borders of the Hercynian massifs. Deposits in the Central and Esterel massifs of France, those of Western and Eastern Germany, Sardinia, the Catalonian coastal range and the Sierra de 10s Santos in Spain, and those of Devonshire and Cornwall belong to the Hercynian metallogenetic epochs. The deposits in southern Norway and Sweden belong to the middle Paleozoic or later, those of northern England to the late Paleozoic or later, those of northern Spain and Greece to the late Mesozoic, and those of northern and probably central Italy and Switzerland to the early Tertiary. Fluorspar occurs typically in veins, lenses, and stringers, but also in bedded replacement deposits and pockets, and may be colorless to white, yellow, green, pink, brown, blue, or purple to almost black. Except for the colorless variety, the only kind which can be used for the optical industry, the color of the fluorspar does not affect its ultimate use,

All the mining machinery of the Penn Iron Mining Co. has been operated by electric power for several years and when another shovel for stockpile loading was required the advantages of an electric shovel were naturally considered. After considerable study, serious objections suggested themselves the use of a shovel operated directly by electrical apparatus by reason of the complicated control, severe service on the motors and the heavy surges of current required from the line. It was finally decided to construct an electro-hydraulic shovel using water under pressure to perform all the necessary operations except that of propelling, for which a separate motor was best suited. A car body with boom, dipper handle and dipper of late design, but without any of the steam machinery, was purchased. A motor-driven centrifugal pump, a pressure tank, an air tank, a small air compressor and water cylinders with plungers, pistons and valves, were installed in place of the steam equipment. E. A. HOLBROOK,*Urbana, Ill.-To those who have followed the development of powdered coal two questions often occur. First, as to the moisture in the coal. In Illinois we recognize that the bituminous coals contain about 12 to 15 per cent. of what we call "contained moisture," that is, the moisture is present in the coal although this may appear absolutely dry and dusty. In addition, the surface moisture may be present in any amount. I would like to ask what is the relative effect of these two forms of moisture upon the work of pulverizing. Does Mr. Collins refer to the contained moisture or to the surface moisture in estimating the degree to which the coal must be dried? H. R. COLLINS.-In the lignite coals, of which this country possesses a great deal and is beginning to develop them to considerable extent, the "contained" or "combined" moisture does not .trouble us; we have no difficulty in reducing lignites to a high degree of fineness. But when dealing with bituminous, sub-bituminous, or semi-bituminous, we, prefer to reduce the combined moisture as well as the hydroscopic moisture as far as possible. We have recently put into operation, at a plant, furnaces and boilers consuming the lignite from northern New Mexico, which contains between 4 and 5 per cent. moisture as we pulverize and burn it. The evaporating efficiencies under the boilers have been so remarkable that we wish to check the results half a dozen times before quoting them. We have also just started two boilers at the Garfield smelter, and have obtained the same high efficiencies.

require both time and money. Any attempt to secure a quick answer will yield a figure that very likely cannot be substantiated, and certainly will not yield information in the detailed form now desired. It will be about 10 years before a completely new estimate can be prepared for the coal reserves of the United States at our present rate of progress, though of course, much information will be available in the interim. We would like to present such information as we obtain in the form most acceptable to the industry, and to that end we are working closely with coal resource committees of the AIME, the National Bituminous Coal Advisory Council, and the Bureau of Mines. DISCUSSION G. H. Cady*—Mr. Averitt's description of the nature of the coal resources investigations of the United States Geological Survey and the progress of this work is very timely in view of the general interest in the subject of coal resources. The Federal Survey is obviously taking the "long view" with respect to the appraisal of the coal resources as part of the preparation of the general geological map of the country and the attendant determination of the quantity of all mineral and fuel resources. It is apparently for regional surveys of the conventional type that the detailed procedures employed by the Federal Survey are applicable. Even if so it is somewhat unexpected to find the same criteria for evaluation will be applied to the country as a whole. The work on coal resources appraisal has been proceeding at various rates in a number of coal producing states for various periods. Undoubtedly since there has been no common practice in the method of appraisal the states each have worked independently and independently of the Federal Survey, and each has adopted certain practices to meet local conditions. I do not know how much consideration has been given by the U. S. Geological Survey to these practices. It seems probable that such consideration might result in important modifications of the standards which apparently have been set up by the Federal group in line with local requirements. It is the practice in some state surveys to present the facts in regard to the occurrence and distribution of coal beds and their variations in thickness down to thicknesses of 1 to 1 1/2 ft in relatively narrow stages up to maximum thickness. It is then possible for any one using such figures to compile quantitative estimates of workable coal at various minimum thickness limits. This is a desirable objective where surveys are detailed and information correspondingIy good. However, vast quantities of coal lie in beds that are relatively thin about which little information is available and the quantity of such coal might affect the final appraisal to the extent of several thousand million, depending upon the minimum limitation observed. Thus in the case of Illinois a difference of 1 ft in average thickness of coal in the coal field would make a difference of approximately 35 billion tons in the estimated quantity present. One is dealing with a very large area and small differences in thicknesses are very irnportant in the overall picture. The estimate of 10 years to accomplish the sort of detailed appraisal outlined by Mr. Averitt is viewed somewhat skeptically and certainly would require many more trained geologists than seem to be available. The requisite detailed mapping and study are very time consuming not only because of the geological field work required, which is difficult in certain seasons, but also in order to assemble data from company and personal files, and to study drill records and cores, and to sample and analyze the coal. Unless the staff of geologists could be increased in the order of several hundred per cent the prospects are that the appraisal of the type suggested will require many decades not just one. The permanent value of such appraisal, however, is not questioned and it should be expedited as rapidly as means allow. Satisfactory appraisal is not easily achieved and will vary from time to time. The main function of a geological survey is to collect and present the facts that will make possible appraisal in terms of existing conditions by individuals, particularly engineers, qualified by training and expcrience for making such estimates. Thickness and character of the coal bed, nature of the overlying and underlying strata, position, thickness, and character of "partings," relationship to other coal beds, and a variety of other factors must be assembled by the geologist in order to present a complete picture of the geological setting. The economic and engineering factors are in general outside the field of geological experience. The geologist should see to it that the pertinent geological facts are available; much more information than simply thickness and depth of the coal beds is essential to meet all the requirements of appraisal in the future as well as at present. With respect to the present demand by engineers and coal mine operators and others for a rapid re-appraisal of the available coal resources, in the light of existing practices and those in immediate prospect, the Federal procedure of systematic mapping and appraisal is scarcely in line. It will be necessary for those particularly interested in having such an estimate made to establish standards with respect to the various factors involved so that the scope of the geological work can be definitely restricted for the various coal fields. There is little use in setting up general standards since no such standards will be applicable to all fields. Thus it is folly to establish a standard minimum thickness to be generally applicable which is one-half to one-third the minimum minable thickness in some fields. The greatest difficulty in appraisal of the presently actually workable coal bed lies in the variation in the importance placed on roof, floor, structural conditions, bedded impurities. sulphur content and other factors that affect judgment relative to the value of a coal bed. It is doubtful whether any appraisal will have universal approval in view of the variable factors involved. For this reason if none other, the facts should be carefully and painstakingly assembled after the manner of a systematic geological survey such as that advocated by Mr. Averitt. Only upon the basis of sucb information can reliable estimates be made in line with selected conditions. Paul AveRitt (author's repty)— In this paper I discussed, but did not define as such, two major phases of our activities on coal, which are closely related, and which normally we in the U. S. Geological Survey see as an integrated whole. It is understandable, therefore, that Dr. Cady should assume that my remarks applied only to the current work on coal reserves with which I am directly concerned. In view of Dr. Cady's discussion, however, I think a brief summary of the two phases of U. S. Geological Survey activities on coal will be appropriate. The long-term function of the U. S. Geological Survey on coal investigations is to make detailed geologic studies, involving the preparation of detailed geologic maps showing the outcrops and correlations of coal beds, direction and dip of coal-bearing rocks, nature and thickness of overburden, location of faults and fold axes, and similar features. Such studies also yield many measured sections of coal and associated strata, which show variations in the thickness of the beds, and the intervals between coal beds. Taken as a whole, detailed geologic studies provide much useful information for mine operators and engineers. As Dr. Cady points out, this type of geologic work is arduous and time consuming, but it provides the basic data that are necessary both in the development of our coal fields, and also in the preparation of coal-reserve estimates, which are discussed in the next paragraph. Data about production are very meager. In this county from the earliest days until after the Civil War, the amount of coal used locally greatly exceeded that shipped on account of the iron produced; for many years the furnaces used raw coal for melting the ore. In 1846 it was stated that in this county one ton of iron required three tons of iron ore and three tons of local coal used raw.1 In 1864, eleven furnaces in Pennsylvania using 102,230 tons of raw coal produced 44,671 tons of iron, or 2.3 tons raw coal per ton of pig iron .2 This was probably as good a record as was made, as nearly all furnaces changed to coke some years later. Neither of these figures include the coal used for steam and other purposes around an iron plant. The Beaver and Erie Canal was opened in 1845 and the shipments shown from then to 1865, inclusive, are of coal received by the canal at Erie, and do not include any used at local points along the canal. From the completion of the Erie and Pittsburgh Railroad in 1864 the tonnage shipped by canal decreased. rapidly, and, while the canal shipments after 1864 are supposed to be those received at Erie by canal only, they may include some rail tonnages. Tonnages on Erie and Pittsburgh Railroad may, and probably do, include some used locally; those on the Jamestown & Franklin Railroad do not. It is likely that both canal and Erie and Pittsburgh Railroad figures include some coal originating in Lawrence County, and possibly a little from Beaver County. These tonnages are not duplicated in the data for either of the other counties. Not all of the railroad reports can be found now.

Extensive coal and lignite deposits exist in Turkey. Bituminous coal is the nation's principal mineral resource; important not only as fuel for the industrial development of the country, but also as a means of obtaining foreign exchange. Of the electrical power generated during 1939, 82.8 per cent was derived from coal.' It is anticipated that the lignite deposits will be one of the major sources of power for the electrification of the country. Bituminous Coal The locations of the four principal bituminous-coal2 basins are indicated on Fig. 1. The Eregli-Zonguldak basin lies on the Black Sea northwest of Ankara; the Canakkale basin lies near the junction of the Dardannelles; the Trakya basin is in European Turkey northwest of the Bosphorus and the Erzurum basin lies far to the east. The Eregli-Zonguldak basin is the most important of the four. This coal basin was discovered in 1829 but did not arouse interest until 1848; up to 1865, its annual production had not exceeded 50,000 metric tons. In 1865, during the Sultanate, working of coal mines was started by the Navy department, and the annual production was 61,145 metric tons. In 1908, the Minister of Commerce and Agriculture was authorized to develop the whole coal basin. Production reached 264,397 metric tons in 1910, and during 1915-1922, preceding the revolution, the total produc- tion of the basin was' 2,676,043, or an average of 334,000 metric tons annually. The period of national revolution that followed was marked by a steady increase in coal production in Turkey, although world production decreased, because of the crisis of 1929-1932, about 52 per cent. ARea and Geology of the Coal Basin The geology of the Eregli-Zonguldak area is not yet completely known. The basin begins -at Gungazi, to the west of Eregli, and extends to Sogutozu, a distance of about 106 miles. The coal beds, however, appear only in places and the overlying Cretaceous strata hide them elsewhere. This area includes the most important centers, such as Kandilli, Alacaagzi, Teflenli, Kozlu, Gelik (see Fig. 2). The geological sequence of the district is correlated with the Cretaceous of the Balkans; which is, in turn, a prolongation of the Alpine zone. Geological surveys made by G. Ralli, R. Zeiller and P. Arni3 show that the Eregli-Zonguldak formations fall into three natural divisions. Series a, The Alacaagzi in the district of that name (Fig. 2), is of the Culm stage. The strata strike generally east-west and dip about 30" south. This series appears also around Kandilli and Camli, with a steeper angle of dip, but the deposits there lack regularity. The Alacaagzi stage appears also farther east, to the south of Kozlu and Gelik. The Alacaagzi series contains 15 seams of an average thickness of 2 ft. of good coal. AT the time this matter first came up in 1912, the National Malleable and Steel Castings Co. had seven basic-bottom open-hearth furnaces in its plant at Sharon, Pa., using fuel oil, then costing about 2 ½ ¢ per gallon. The fuel was satisfactory but its cost fluctuated widely, therefore the use of pulverized coal, which had been successful in the cement industry and in some metallurgical furnaces, was suggested. After a thorough investigation, and an actual trial on one of the open-hearth furnaces, to be certain that the siliceous ash in the coal would not seriously affect the basic slags, the management of this company approved its adoption and a complete installation was started. The conclusion had been reached that the success of the operation depended on pulveriz-ing the coal to greater fineness than had thus far been accomplished, and all equipment was chosen with this in mind. A coal drier was deemed essential, and one of ample capacity and efficiency was selected, which has done all that was expected of it, working without failure and with very small maintenance cost, and is still in operation.

PERHAPS the most important event f or exploration geophysics in 1940 was the publication of three textbooks : "Geophysical Prospecting for Oil," by L. L. Nettleton ; "Exploration Geophysics," by John J. Jakosky; and "Geophysical Exploration," by C. A. Heiland. The literature had grown so bulky, and such a long time had elapsed since the publication of the texts by Ambronn and Eve, that treatises covering exploration geophysics comprehensively in all its branches and giving literature and patent references were sorely needed. This need has been satisfied admirably in these textbooks, and geophysicists owe the authors a debt of gratitude. In 1940, geophysics came of age. A conference on applied nuclear physics was held at Massachusetts Institute of Technology from Oct. 28 to Nov. 2. Several papers on geophysical subjects were presented at this meeting. Geophysical activity has decreased in all parts of the world except perhaps in Canada where, under the stimulus of the war's increased demands, prospecting for oil has increased. However, even there the war has had a seriously adverse effect on prospecting for ores and upon the promotion of new properties, although activity in producing and near-producing mines has been stimulated.

Conventional methods of calculating the duty cycle of a mine hoist are awkward in that a number of items must be remembered or that they must be collected together in order to have all the calculated data in one place. A more convenient way is to tabulate all factors involved, permitting a ready evaluation of the problem. An example illustrates the convenience of such a table for either of two types of drums, cylindrical and conical. Assume the following conditions: The hoisting depth is 600 ft. Balanced hoisting is used. The weights of empty skip and ore are 6000 lbs and 12,000 lbs, respectively. Production is 3600 tons per shift. Net hoisting time per shift is six hours with a rest period of eight sec, top and bottom, per trip. Acceleration and retardation are each six sec. The diameter of the drum is seven ft; its face is four ft. The sheave has the same diameter. The equivalent effective weight of the drum reduced to rope center is 15,400 lbs. The weight of each sheave is 2100 lbs. 1 The rope is 1 1/4-in. improved plow steel weighing 2.50 lb per ft.

This paper presents results of an experimental investigation of factors that control the efficiency with which oil is displaced from porous media by a miscible fluid. The study was made to elucidate the relevant processes both on microscopic level (within individual or between neighboring pore spaces) and on macroscopic level (within a large sand body). Mixing of miscible fluids on the microscopic level was studied in sand-packed tubes. It was found that molecular diffusion is the dominant dispersion mechanism for reservoir conditions of rate, length and pore sizes. Macroscopic channeling was studied for various mobility ratios in reservoir mode1s scaled to relate viscous, gravitational, and diffusional forces. The formation of channels was due to viscous firzgering, gravity segregation and variations in permeability. With adverse mobility ratios, it was found for reservoirs of realistic widths that diffusion will not be effective in preventing the formation and growth of fingers, even in homogeneous sands. At sufficiently low rates channeling was eliminated by gravity segregation in tilted reservoirs. The dependence of recovery on mobility ratio, length-to-width ratio, flow rate and angle of dip is presented. INTRODUCTION Oil recovery by solvent flooding is finding increasing application in the field. While the process promises high recoveries from the region swept by solvent, under adverse conditions only a small fraction of the reservoir volume may be swept at the time solvent breaks through to the producing well. Further, the high cost of the solvent encourages its use only as a bank whose size must be kept at a minimum. Thus, two important questions arise: (1) what fraction of the reservoir can be swept, practically, by solvent? and (2) what is the minimum size solvent bank that can be used to carry out the displacement? The answers to these questions require knowledge of both macroscopic channeling processes and microscopic mixing processes. The studies described here were carried out to gain this knowledge. Microscopic mechanisms which cause mixing will be discussed first, because an understanding of these mechanisms is necessary for proper interpretation of the experimental work on channeling described later. INVESTIGATION OF MICROSCOPIC DISPLACEMENT PHENOMENA FOR MISCIBLE FLUIDS The questions to be resolved concerning microscopic displacement behavior are: (1) how much mixing occurs between oil and solvent in the direction of flow? and (2) does the solvent completely flush the oil from the pore spaces in the region invaded by solvent? The classic work of Sir Geoffrey Taylor' and its extension by Aris2 have shown that it is possible from theory to describe the amount of mixing in single straight capillaries when solvent displaces a fluid of equal viscosity and equal density. Aris showed that the lengths of the mixing zones, 81, corresponding to the 10 per cent and 90 per cent concentration levels of the solvent can be calculated from the formula, 81 = 3.62 \/Kt, .........(1) where 8l is the length of the mixing zone, cm; t is the time, sec; and K is the effective dispersion coefficient, cm2/sec, given by K/D = 1 + (1/48) (au/D)2......(2) where a is the radius of the capillary, cm; D is the molecular diffusivity, cm2/sec; u is the average velocity

I fear most of the Institute members are already weary of the perennial controversy about the apex law. I feel that way about it myself now, though I have been guilty of considerable contribution- to the discussion in the past. The discussion does not seem to perceptibly influence previously held views and I would not again break into print on the subject but for the urgent invitation of the Chairman of our Law Committee. This energetic and able member has firmly determined to secure a revision of the mining law and among other things to eliminate the so-called apex provision from the U. S. mining statutes. He is, however, fair about it and has invited me to make ((the strongest possible argument in its favor." I am suspicious that he is acting on the psychological principle that it is usually easier to convince an audience against a cause vigorously but unsuccessfully defended than against one wholly mute. Nevertheless, I realize that personally he wishes me no harm, much as he hates the apex law, and so am willing that the Institute have whatever benefit may accrue from my taking up again the unpopular side of the discussion. I say this because the attitude of a large part of our "articulate" membership seems irreconcilably hostile; their minds are made up; favorable consideration is foreclosed; and they become impatient and even sarcastic at any attempt to elucidate a favorable view of the apex law. The exact question for discussion at the present time is not whether on abstract, or any other considerations, the apex law is the best possible rule, but the very different proposition whether, after nearly 50 years of statutory life and much longer as a practically universal miners' custom, it is now just and expedient to repeal the apex law. At this point it seems to me that we may profitably devote a paragraph or two to the subject of the origin of law in general, as we are presumed to be considering the subject from the high viewpoint of the general welfare of the nation. The most comprehensive and accurate definition of law in the legal sense is, that it is the body of rules for the regulation of human conduct which is enforced by the State, that is, by the nation.l Legal
