With the expansion of copper leaching of the various mine wastes at the Kennecott properties, additional copper recovery facilities have been required. A research and development program has been pursued to determine a suitable economic approach to the processing of the additional leach solutions contemplated. lnvestigations on laboratory and pilot plant scales covered electrowinning, solvent extraction, launder and vat type cells, activated launders, precipitation drums, and precipitation cones. This paper contains information on the development and use of a new precipitation-cone-type copper recovery plant, which provides many advantages over older systems. The application of research findings to the old art of leaching copper from copper-bearing mine waste has resulted in a significant contribution of copper to over-all copper production. For example, at the completion of the current expansion program at the Kennecott properties in the United States, copper produced from waste dump leaching will amount to about 25% of the total production. Formerly only 2% was derived from this source. This planned expansion of copper leaching focused attention on the problem of developing more efficient methods for the recovery of copper from greatly increased volumes of copper-bearing solutions.1 The detailed investigations which have been made in laboratory pilot plant and plant tests for the recovery of copper from copper-bearing solutions have included electrowinning, solvent extraction, ion exchange and cementation with iron in launders, precipitation drums, activated launders, and precipitation cones. The results of these investigations have led to the development of a new precipitation cone-type copper recovery system providing many advantages over older methods. ELECTROWINNING OF COPPER FROM COPPER-BEARING SOLUTIONS The direct electrowinning of copper from relatively dilute solutions of copper-bearing mine water, namely solutions containing 10 to 20 lbs of copper per 1000 gal, has always been an attractive possibility.2,3 By this method, high-purity copper powder can be recovered with a power consumption of 3.5 kwh per Ib of copper. The Bafokeng Rasimone Platinum Mine (BRPM) is a joint venture between Rustenburg Platinum Mines Limited and Royal Bafokeng Resources (Pty) Ltd (Bafokeng). The mining lease has been granted over Boschkoppie 104JQ and is located approximately 10km south of the Pilanesberg Alkaline Complex. The Merensky Reef, which constitutes the principal ore body, is geologically complex. A relationship between its geological variability and the associated mineralisation has been established by defining a number of facies types. The Merensky Reef has been sub-divided into seven distinct facies types: the pegmatoidal facies, contact facies, FW1 pothole facies, FW3pothole facies, FW6 pothole facies, and FW7 pothole facies. The Merensky Reef, which does not form part of the potholed reef, has a large component of footwall mineralisation. The pothole facies, in contrast, has mineralisation located in the hangingwall. Statistical analysis of the facies types indicates that they are unique populations and hence need to be evaluated independently. The mining lease has distinct structural domains that have added additional complications to evaluation of the Merensky Reef. The Merensky facies on BRPM exhibit unique geological and statistical characteristics within well-defined structural blocks. Due to the extreme variability of the Merensky Reef on BRPM a unique approach has been developed, within Anglo Platinum, to evaluate the deposit. Mining cuts are defined and composited for the individual facies types, and then modelled individually by applying known geological controls. The resultant grade models are weighted based on statistical and local geological knowledge. The object of weighting the facies is to replicate the variability observed in the ore body. The introduction of stringent geological controls to the evaluation process has resulted in increased confidence in the in situgrades estimated as an input to the mine planning process

The use of compressed air or gas in oil wells for raising crude oil to the surface has, within the last year, become a dominant factor In production engineering. Previous application of this principle was largely confined to oil wells that had been pumping for a considerable length of time. In the Seminole area, the gas-air lift has been applied to wells imniediately after natural flow has ceased and in some cases while the wells were still flowing. This early application of the gas-air lift has been watchcd with intense interest by the petroleum industry, both with respect to methods of application and mechanical installations and to the effects on immediate and ultimate production. Methods of Application The Seminole pool at its inception contained sufficient gas associated with the oil to cause natural flow. As no frce gas was found in the main productive horizon, the Wilcox sand, all the gas present was dissolved in the oil, hence the natural flowing life was short, rarely lasting over 45 days. When natural flow ceased, high fluid levels were common, and as depth and crookedness of holes were obstacles to efficient pumping, the gas-air lift was used almost exclusively in raising the oil to the surface. Because of the high gravity of the oil, 41" A. P. I., and its high gasoline content, and also because of the desire to obtain production before offset wells became productive, quantity of production was the aim of the operators and a method of flow was used whereby this aim could be fulfilled. One of the outstanding features of this method consisted in flowing the wells through the annular space between the tubing and rasing. By this means a greater quantity of fluid could be handled than by flowing through the tubing of the size in ordinary use. Wells that would produce only a few hundred barrels on the pump were by this rnethod made to produce as high as 7000 bbl. on the lift. A few days or wreks of production at that rate meant a large recovery of oil. Casing of 636 in. diameter was commonly used as a production string with a 5 3/16-in. liner set on top of the oil sand. THE 650-ton underground mill of The Empire Zinc Company of Colorado (a subsidiary of The New Jersey Zinc Co.) serves the Eagle mine at Gilman in the Battle Mountain mining district of Colorado. The topography is rough, the mine and mill being under Battle Mountain and the alit entrance in the north wall of the canyon of the Eagle River, which is here a steel) gorge. The town of Gilman stands on a shoulder of the mountain at altitude 8975 ft., above sea level, along the Pike's Peak ocean to ocean highway and contains the company office and the usual facilities of a modern mining town. The railway contact is at Belden, altitude 8370 ft., at the bottom of the gorge directly below Gilman, where the westbound track of the Denver and Rio Grande Western Railroad is cut along the north bank and the eastbound track along the south bank of the river. A general description of the mine, mill and service facilities, with an account of the geology, character of the ore and methods of mining and milling having previously been published in a series of articles1, this paper will discuss with as little repetition as practicable the reasons for building the mill underground rather than as a conventional structure, the methods of construction employed and the experiences gained in what is apparently the pioneer plant of this type and extent.

The 1943 designation of districts for the Transactions† has caused some confusion because of the elimination of the West Central Texas district and the allocation of the counties of this district to the North Texas district and the North Central Texas district. The North Central Texas district as herein defined includes the counties of Brown, Callahan, Cole-man, Comanche, Coryell, Eastland, Erath, Fisher, Hamilton, Hood, Jones, Lampasas, Mills, Nolan, Palo Pinto, Parker, San Saba, Shackelford, Stephens, Stonewall, Summerville, Taylor, Throckmorton and Wise. These counties as listed are the counties of District 7B, State Railroad Commission. This district covers the south central crest and the west flank of the Bend flexure north of the Llano uplift. The west flank of the Bend flexure is on the east boundary of the Permian Basin of West Texas. The North Texas district, District No. 9, State Railroad Commission, includes the counties of Archer, Clay, Cooke, Foard, Hardeman, Jack, Knox, Montague, Wichita, Wilbarger and Young. The area of this district covers the crest and south flank of the Red River uplift and the north central crest of the Bend flexure. The greater part of the oil and gas produced in the past from the North Central Texas district has been from Pennsyl-vanian strata. Some oil and gas has been produced from the lower Permian (by the latest selection of the Pennsylvanian-Permian boundary') and minor amounts from the Mississippian and Ordovician sediments. Increasingly important quantities of oil and gas are to be expected from the older sediments by deeper development in proven fields and by new discoveries. Most of the oil and gas in the district has accumulated in localized, well-defined structural traps in limestone and sandstone reservoirs and in traps due to stratigraphic changes in sedimentation, mainly porosity traps in limestone and sandstone lenses, both usually associated with some structural feature. The Stripper Well Premium Plan as adopted by the office of the Federal Price Administrator has been an aid to the producers of stripper wells. The producers are pleased to receive the subsidy to prolong the plugging of wells, but they are not too pleased with the subsidy plan in principle. Most independent operators are in favor of, and think they are entitled to, an increase in the market price for oil. The price is not adequate to meet the requirements of the average independent operator with the continued advance in production, development and wildcatting costs. Old and new pipe lines for oil and gas leading out of the state are removing reserves at an alarming rate. Curves showing the rate of discovery versus production and pipe-line deliveries in and out of the state make a cross that sooner or later will be fatal to the state. Wildcatting not only needs a price increase but every other available incentive and encouragement.

THERE are two general approaches to the problem of increasing profits from an operation. One is to lower expense; the other is to raise income. Mechanical preparation of coal may be used for either purpose but a prudent consideration of many details must precede any decision lest the results be negative instead of positive. It is quite possible that any net gain will result from a combination of the two. Since mechanically prepared coal invariably is a better product qualitatively than a hand-picked coal from the same mine, it is a reason- able expectation that the customer will be willing to increase the producer's income by paying a higher price. Or there may be the possibility that a combination of mechanical mining plus mechanical cleaning will give a lower over-all production cost for the coal in the railroad car. More likely, there will be found a combination of these two factors. From the customer's point of view, the competitive delivered cost per B.t.u. considered in relation to such incidental factors as dust nuisance, handling properties, ash disposal, and ash fusibility determines what he will pay. In a bulk tonnage product such as coal, freight is a very considerable part of the delivered fuel cost, and obviously freight paid on incombustible ash has no economic attractions. INCENTIVE FOR CLEANING Coal is prepared in four major ways: 1 (I) by screening or sizing, (a) by mixing or blending, (3) by cleaning, including hand picking and mechanical cleaning, (4) by dustless treatment. By a combination of any or all of these methods, coal can be prepared to standard specifications. It is easily possible to have good cleaning and still get a poor final product because of faulty screening or mixing,

I am deeply honored and grateful to receive the prestigious Gaudin Award. Frankly, I find myself amazed to be included in the company of those outstanding individuals who have previously received this recognition. I am humbly honored to receive this award from an industrial research group. Gaudin was an internationally respected leader of mineral processing. His research contributions widely covered the whole spectrum of mineral processing science and technology, including comminution, size distribution, electrostatics, magnetics, thickening and, especially, the development of flotation theory and application. In his later career, he increased his emphasis on hydrometallurgical technology. In fact, one of his most notable practical contributions was in the development of leaching and ion exchange purification of uranium from low-grade ores. Gaudin catalyzed the trend in mineral processing toward engineering science for a better understanding of process mechanisms and kinetics. He said that those working in academic fields should have an underlying responsibility to the industry they represent. This imposed on him the objective of seeking out research areas that had some relevance to industry's problems. He said, "research without an audience cannot survive." Gaudin performed a most vital service, both in the areas of research in which he was actively involved and through his less-direct influence on current research by his many former students and their students in turn. Interestingly, Gaudin's strength has influenced Newmont Mining Corp. His favorite student was Plato Malozemoff. He had a long and distinguished career with Newmont, beginning as staff engineer in 1945, serving as Newmont's president for more than 30 years and as chairman of the company for 20 years. Newmont's greatest growth occurred during his leadership. Another one of Gaudin's graduate students from Montana School of Mines, Oscar F. Tangel, joined Newmont in 1967. He was a vice president of research and development until 1986. In their efforts, Newmont built a research group, developing the technologies of exploration, geophysics and metallurgy. The Newmont technical facility is named in honor of Malozamoff as "a leader in the development and implementation of new technologies." The mining industry is facing very difficult times, especially in the metals industry. Most metal prices have declined and are still not stable. Most domestic mining companies have largely done away with in-house research and development. Many are reluctant to invest in technology development for which there is not an immediate need. The metal mining industries are focusing on reducing operating costs to survive. Newmont is in the same situation. I appreciate that Newmont's management believes in the importance of research and technology and the impact technology has on the company's value. At Newmont, technology development involves working in the area of applied research. The connections from academic fundamental research to applied research and finally to process development and implementation are very important to develop a new technology. Fundamental research is our foundation, our guidance, giving us direction, providing the principal and mechanism and understanding why it works. Understanding the why will lead to further innovative development. Applied research needs to find the approach to reality, how it works, how to make it better and how to commercialize it. Process development and implementation needs a strong leadership, requires long-term commitment, makes improvements in practical engineering and finally develops an economically favorable process. Implementation is the most important stage in making research a reality. Each stage needs to give feedback to the other stages. Problems need to be understood and solved. Otherwise, the new technology will go nowhere. Simplicity of operation is a key of success in any plant. Necessity is the

The: mysterious Lake Erie price for iron ore, established each spring, determines the maximum price that will be paid during the following season for ore of Mesabi Non-Bessemer base grade. This price is important to the ore producers, hut since most of the ore in the Lake Superior district is owned or controlled by consuming interests, the really important question to them is not the price of ore but how much it will cost them to mine and transport their season's requirements to their furnace plants. However, a few million tons are actually sold each year, and considerable quantities are traded for mixing purposes, and the negotiations lor these sales and trades usually begin with some reference to the Lake Erie price. There is no difficulty with the Lake Erie price itself or with the manner in which it is established, but the system prescribed for determining the values of ores that are not exactly base grade is incomplete. The Lake Erie price takes into consideration only the iron and phosphorus contained in the ore, but when the ore producer is negotiating a sale or trade, he is confronted by the fact that his ore must he studied and the price adjusted, not only on the basis of the iron and phosphorus analyses, as specified by the Lake Erie price, but also on the basis of silica! alumina, manganese, structure, etc. The vague and unsatisfactory methods used in making these adjustments bear some relation to the manner in which the ore is supposed to act in the blast furnace. The ore producer may not understand all of the idiosyncrasies of the blast furnace, but if the smelting-plant operators have a system more accurate than the Lake Erie price method for determining the relative values of different ores, why not pass this information on to the ore producers, so that they can make use of it and perhaps modify their practice in such a manner as to benefit both themselves and their customers? There is a lack of understanding and appreciation between these two groups that may, to some extent, be unavoidable, but in the interests of efficiency and conservation rules that are more accurate and complete than the Lake Erie price method in use at the present time should be established for the guidance of the ore producers. Recently a paper was read before the Eastern States Blast Furnace and Coke Oven Association, by Mr. G. W. Hewitt, Manager Production, Blast Furnace and Coke Oven Department, Wheeling Steel Corporation, in which he explained how his company determines the relative values of different grades of Non-Bessemer ore. This is a very important paper, perhaps not so much on account of the actual calculation methods described as because of the fact that premiums and penalties are shown on Non-Bessemer ores for silica, alumina, phosphorus, and manganese. Draglines 8.2-1 Introduction. The nature and characteristics of rock and rock derivatives forming the crust of the earth vary so greatly from place to place that it is impossible to use the same numerical factors to show the, productive ability of excavating equipment on different jobs or projects. Factors for each project must be developed individually and applied as the conditions and requirements dictate. TYPES' OF DRAGLINES. Types of draglines are differentiated by the propelling method used and are generally divided into four classes, as follows: 1. Wagon mounted 3. Crawler mounted 2. Truck mounted 4. Walking Figure 8.2-1 shows a truck-mounted dragline. This type is considered to be the most mobile unit. In order to increase stability over the side, outriggers are installed as part of the truck chassis. This feature is not shown in .this figure. Figure 8.2-2 shows a crawler-mounted dragline. The long, wide crawlers are used to increase the stability and reduce the bearing pressure of this unit. These features allow for use of these units on surfaces too soft for the wagon- or truck-mounted types. Figure 8.2-3 shows a walking-type dragline. The large diameter tub and the well-supported boom through the gantry gives high stability for rugged works over a long life. BASIC PARTS OF A DRAGLINE. "The concept of risk is well established in the mining industry. It is acknowledged when estimates of reserves are expressed as proven or probable, when mining and metallurgical recoveries are applied to the ore, and when contingencies are added to costs. However, it is difficult to provide a quantitative assessment of risk. The significant sources of risk in a mineral project and how these are addressed in project evaluations are discussed.The discount rate is examined as a fundamental means of reflecting risk in discounted cash flow evaluations. Current industry practice is discussed, and a methodology for the analysis of risk levels is proposed that assesses the constituent components of the discount rate: real interest, mineral project risks, and country risk.IntroductionThis paper examines the components of the discounted cash flow discount rate and proposes a method of estimating project-specific discount rates. The motivation for this work comes from experience of project evaluations in which owners and purchasers had agreed on virtually every aspect of the evaluation except how much the project was worth. Agreement was reached on reserves, grade, recovery, capital costs, operating costs, taxes, and, by combining these components, even on the final cash flow values. The only difference in opinion concerned the discount rate to be used in the calculation of the net present value. Depending on the life of the project, such differences of opinion can cause a variation of more than 50% in the value placed on a project! This is illustrated in Figure I."

"Existing environmental, health and safety regulations have forced pyrometallurgical facilities worldwide to drastically change some of their traditional methods of operation. In extreme cases, a number of facilities have been closed due to their inability to conform to these existing regulations. Tougher future legislation and government policy will lead to more stringent regulations and enforcement policies. The efficient control of smelter secondary emissions will, therefore, become critical to successful smelter operation.Much attention has been paid to the smelter primary process off-gas systems, including the development of new process designs to reduce the number of uncontrolled transfer operations. However, even the most modem smelter design requires control of its secondary contaminant sources, which mayor may not be directly related to the process operation.This paper discusses some of the potential secondary emissions encountered in many of the present process technologies. A few of the emission sources presented are only periodic in nature, such as those caused by maintenance procedures, but which have the capability of forcing smelter shut-down because of their direct impact on worker health and safety. The paper deals with a variety of topics relating to the efficient control, maintenance and monitoring of secondary emissions in copper, nickel, aluminum, magnesium and lead smelters, as well as in iron foundries and steel making facilities. Examples of the typical problems encountered in each of the above process operations are presented, including fume control at furnace tapping and slagging locations, metal transfer stations, tapping launders, and ladle transfer operations. The parameters for the most efficient design of fume capture systems, problems encountered with the handling and clean-up of certain collected emissions, and examples of successful solutions in particular operations are discussed."

THROUGHOUT northeastern Texas we have an extensive series of iron-ore deposits, occupying portions of nineteen counties and having approximately an actual ore-covered area of 1000 square miles. The existence of these ores has long been known. Kennedy* says: "Iron-ore is distributed in profusion throughout Texas, being found almost everywhere except in the level region of the coast." Before this, C. Newell† had mentioned the existence of these ores thus: " Iron is found in abundance in the eastern, northern and middle portions of Texas;" and in 1849 Edward Smith‡ said: " We met with immense hills of iron which were said to be, and appeared to be, of excellent quality, in Cass and Titus counties.. . .. It is well known that Texas abounds with iron of first-rate quality." In 1859, Dr. Shumard? reports that detailed surveys had been made in several counties, and says: " Our labors have demonstrated the important fact that we have a vast iron-region in the eastern part of the state, embracing considerable areas in Cass, Harrison, Rusk, Panola, Smith, San Augustine and Shelby counties. The ore-deposits belong to the Tertiary era and consist chiefly of hematites and limonites, of which there are several varieties. We have also found in this district extensive beds of carbonate of iron." Dr. Shumard gives no very exaggerated description of Cass county§ as it then existed when he says : " Cass county alone is capable of supplying a number of furnaces with an abundance of excellent iron-ore for many years." The solubility of methane, carbon dioxide, and oxygen was measured in brines at temperatures from 0° to 300° as part of Federal Bureau of Mines research on the corrosion of metals in high-temperature geothermal and mineral processing environments. Solubilities were measured by the technique of extracting pure gas, dissolved at pressures where Henry's law was applicable, from known volumes of brine. The results were smoothed with respect to temperature. The solubility, expressed in terms of the Henry's law constant, reaches a maximum at temperatures ranging from 60° to 100° C for methane and oxygen, and from 160° to 170° C for carbon dioxide. The Henry's law constant increases, that is, gases are salted out of the brines, in the presence of dissolved salts. Salting-out coefficients are strongly dependent upon temperature. The temperature dependence of the Henry's law constant for geothermal brines is different from that for sodium chloride brines owing to the more complex chemistry of the geothermal brines. The solubility of oxygen and carbon dioxide in brines exposed to air saturated with water vapor and at a total pressure of 760 mm Hg is reported for temperatures from 0° C to the normal boiling point.

Hydraulic fracturing technology is presented as a solution to improve permeability and thus solve the extraction problem of coal seam gas in low-permeability gas-bearing coal seams. Given an existing group of original cracks, the propagation of main hydraulic cracks and hydraulic wing cracks was simulated using realistic failure process analysis software. The process represents the structural transformation of hydraulic fracturing and permeability improvements caused by it. In addition, a field test for improving the permeability of gassy coal seams by hydraulic fracturing was also conducted. The propagation of the main cracks and wing cracks by hydraulic fracturing forms a network of original joint cracks, hydraulic wing cracks, and main hydraulic cracks, which improve the permeability of the coal seam. High-pressure water in the drill hole and in the main hydraulic cracks permeates the two flanks of the hole, forming the permeating water pressure. With an increase in drill water pressure and an extension of the main hydraulic cracks, the permeating water pressure on both sides of the main hydraulic cracks in the coal mass also increases. Hydraulic cracks tend to form connections through rock bridges. The extension of hydraulic wing cracks through connections in the rock bridges between the cracks transforms the rock mass to a fractured structure and improves its permeability. Hydraulic fracturing technology for improving permeability in underground conditions can increase the amount of gas drainage by a factor of 15. A stress relief area develops at a radial distance of 10-2.0 m from the hydraulic fracturing drill hole, while an area of rising stresses, called the pressurized area, develops a further 15 m away from the pressurized hole. Practice has proved the existence of the stress transfer phenomenon and the high stress area after fracturing. This kind of hydraulic fracturing technology is more effective in holes drilled from underground than in surface drill holes, with respect to costs and controllability, and is therefore the major trend in gas drainage development in coal mines.

Processing of copper-cobalt orebodies in Africa?s Copper Belt has received much recent attention with various flowsheet options being developed specifically for the refining of cobalt. The upfront leach and copper refining routes are well understood whereas the refining of cobalt is more complex, requiring numerous impurity removal steps to produce high purity metal. This paper describes an investigation into one of the possible processing steps in the refining of cobalt, namely, cobalt solvent extraction. The paper emphasizes the importance of upstream impurity removal to achieve the required cobalt solvent extraction feed composition. 18% (v/v) Cyanex 272 in an aliphatic diluents is used as the organic phase. The pH profiles in the various stages are evaluated in order to obtain a raffinate containing <10mg/l cobalt and with a low magnesium content reporting to the stripping section. The pH profile is also used to minimize the impurity deportment to the cobalt electrolyte. The effect of adding a pre-neutralization stage before feeding the organic phase to the extraction circuit is investigated. Zinc build-up in the stripping stages is also looked at. It is recommended for the purpose of this study that four extraction stages at an O:A ratio of 1 with a pH profile from 4.9 to 5.7 be employed. The pH is controlled with 40g/l NaOH. A pre-neutralization stage is required, where the organic phase is contacted with 10 M NaOH. Two scrubbing stages are recommended at an O:A ratio of 40, using the cobalt electrowinning advance electrolyte as the scrub liquor. Three strip stages are to be employed at an O:A ratio of 0.67.

For the purposes of underground mine design, twelve cores of the Springfield (V) Coal (Pennsylvanian) roof and floor were retrieved. Each core was photographed, described fresh in the barrel, and the rock quality designation (RQD) was measured. Cores were wrapped in plastic and delivered to the rock mechanics lab. At the lab RQD was remeasured and new photographs were taken before running geotechnical tests including weatherability. Significant differences in barrel RQD&apos;s vs. lab RQD&apos;s have been noticed in spite of careful handling. The drill site RQD is generally used to calculate geotechnical results, but in some types of coal measure rocks, further fragmentation of core takes place with slight changes of moisture content, which occur even in well wrapped core. This creates a dilemma which RQD should be used for support design. Rocks around excavations are exposed to the significant changes in moisture content due to the seasonal weather changes and related fluctuation of humidity of air ventilating a mine. Therefore, it appears to be more realistic using laboratory RQD which corresponds closer to the actual rock condition around the excavation. Weatherability test, developed for characterization of time dependent behavior of rock exposed to fluctuations in moisture content, is thought to be related to the above-mentioned changes of RQD. In weak shales, mudstones and claystones which weather rapidly, it is essential to characterize their future behavior in the pre-mining stage. This can allow for a realistic design of primary, and particularly secondary support in coal mines, especially in coal fields where such geologic conditions exist.

The purpose of the project was to conduct a feasibility study to determine if the current operating bottom dump trucks that haul coal should be replaced with rear dump trucks. The engineering availability of the bottom dump trucks was lower than targeted while the operating costs are the highest of all coal haulers within the Anglo Coal opencasts. To determine if it is feasible to replace the current bottom dump trucks with rear dump trucks, a production profile simulation was conducted to determine the number of rear dump trucks that would be required to meet the annual coal hauling requirements. The total capital and operating costs of these rear dump trucks were also determined using a total cost of ownership model. These were compared with the current costs of the bottom dump trucks to determine if it is financially feasible to replace the bottom dump trucks with rear dump trucks. Having considered the capital outlay that would be required to replace the bottom dump trucks with rear dump trucks as well as their respective operating costs, it was concluded that the current bottom dump trucks should be replaced with rear dump trucks. Other factors were considered in coming to this conclusion.
