Discussion held at the sessions of the Canal Zone meeting, November, 1910. [SECRETARY'S NOTE.-As a result of this discussion, an expression of opinion covering all points of unanimous agreement was adopted and signed by members of the Institute party as individuals. This statement, which was printed in the Bulletin of December, 1910, is reprinted below, as an introduction to ,the detailed report of the discussion. It should be clearly understood that it does not constitute an official declaration by the Institute, the rules of which forbid any such action. At the New Haven meeting of February, 1909, a free discussion of the plan of the canal took place, in which the critics of the present scheme had full opportunity to state their views. That discussion was continued at considerable length in the newspapers ; but the Institute was never committed to either side. In this latter instance, the situation is precisely similar. Certain members and guests of the Institute, having had the advantage of later developments and of personal inspection, have expressed the conclusions at which they have arrived on their own responsibility ; and these conclusions are published by the Institute, subject to further discussion, like any other part of its proceedings. The general statement referred to contained a promise that the full discussion, of which it was a result, would be subsequently printed ; and this promise is fulfilled, so far as practicable, in the subjoined report, concerning which I beg to offer the following explanations: 1. It is made up of the remarks of the members of our party, as subsequently written out and mailed to the Secretary. 2. In editing these contributions, I have condensed the material considerably by cutting out much repetition of opinions and phrases ; and in such excision, I, frankly confess, the authors whose communications were delayed, have been the sufferers. Nevertheless, there is a good deal of repetition left, as there must be, when so many persons had talked so much, and come to agreement upon so many points. 3. It has been found impossible to preserve in this report the actual order of the free and informal oral discussion represented. Consequently the several contributions have been arranged in alphabetical order under the names of their authors. This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World," (Information Circular 80 1 7, 196 1. ) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then bronze, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. The commercial availability of electrolytic manganese has greatly changed the position of manganese as a nonferrous alloying metal. Manganese metal commercially available up to about ten years ago was reduced with either silicon or aluminum and contained substantial amounts of the oxides of these metals and other impurities. Manganese was accordingly not available as an alloy base and its addition to copper-base and nickel-base alloys was generally limited to a manganese content of a few per cent. Several special alloys like manganin contained up to 12 pct of manganese.

IT is a great honor to be asked by. the Board of Directors of this Institute to deliver the Henry Marion Howe lecture. The invitation carries with it a great responsibility, which I accept with considerable hesitation and with a feeling of unworthiness to perform the duties expected of me in this hour devoted to the memory of the life, character, and work of the late Professor Howe. Many of you recall the scholarly address delivered here a year ago by Prof. Albert Sauveur, and the beautiful tribute he paid-to his friend and colleague of many years in the great work of changing the art of iron making into the science of iron. My association with Professor Howe, was of brief duration-only one year-and the relation was that of pupil to teacher. My feeling toward him in later years was always that of a humble disciple at the feet of a master. He attained his third academic degree in the year that I was born. I recall the pride I felt when, after entering the, steel industry, I received from him, from time to time, letters asking for information or, perchance, asking my opinion, and he was always most punctilious in acknowledging the source of such bits of information in his writings. It was also my good fortune to sit at the feet of another great teacher-Sir William Roberts-Austen, at the Royal School of Mines. I mention him because his name was used by Osmond in coining the word "austenite," which is the subject of this address, and Osmond's suggestion was heartily approved by Howe. These three international metallurgists were the best of friends and delighted to honor the achievements of one another. There are other reasons for mentioning Roberts-Austen at this time. It was an introduction from Howe that opened to me the door of his -laboratory as well as of his heart. It was while at Roberts-Austen's laboratory that I .worked side by side with William Campbell

HAVING had occasion while in Europe during the past summer to visit some of the foreign mints and assay offices connected with the same, I thought a brief description of the general process of coining employed, and such items connected with assaying as were new, might prove interesting to the Institute. The principal foreign mints are: the Royal Mint, London; and the mints in Paris, Brussels, Utrecht, Berlin, Vienna, Copenhagen, St. Petersburg, Stockholm, Madrid, Milan, Rome, and Constantinople. My time only permitted my visiting a few of the principal and largest given in the list, and for a description of the remainder I am indebted to the kindness of Mr. James M. Napier, who in company with the deputy master, and chemist of the Royal Mint, made a complete inspection of all the European Mints in 1870.

AFTER the completion, in 1905, of the Hammond Mining and Metallurgical Laboratory of the Sheffield Scientific School, Yale University, it became necessary to secure and assay a large assortment of ore-samples, and to arrange the results in such a manner as to admit of use with the least amount of work on the part of the instructor. At first, pulp-samples, together with their respective assays, were secured from the mines, smelters, and public assayers, but this practice did not prove satisfactory. It was not only difficult to secure a sufficiently large supply of material, but it was also impossible to secure the proper assortment required for instructing students. It involved considerable work for the donors to select the samples and furnish a record of the assays, and also for the instructors to examine each pulp and determine its character. Some of the samples did not contain a sufficient quantity of pulp for the student to check his work in case his first assay did not correspond to the record. In order to increase the number of samples and to vary the character of the material, pulp-samples were later mixed with barren rock and with sulphides, but this method also was unsatisfactory and has been discontinued. At present., small lots of ore are secured by gift or purchase from engineers, public assayers, and the managers of mines, mills, and smelters. These lots weigh from 10 to 100 lb. each, and are rarely finer than 0.25 in. in size. The larger samples permit of a careful study by the instructor in order to determine the best method of assaying to be followed. The first indication of tungsten in the Bishop area was the discovery of scheelite concentrations in a gold placer operation in the ( since named) Tungsten Hills in 1913. After early intermittent production, the deposits of the district were slowly discovered and developed. The Pine Creek mine, located in 1916 and under the direction of Union Carbide Corporation since 1935, became the principal producer in the district. By the end of 1965, the total production of the district had reached 3,450,932 units of WO3, 17,071,242 pounds of molybdenum, and 19,599,110 pounds of copper. The topography of the district is characterized by its extreme relief, ranging in elevation from 13,986 feet to about 4400 feet in the Mount Tom quadrangle. The present topography is the result of the uplift and erosion of the Sierra Nevada and the great subsidence of the Owens Valley with its related deposition and volcanism. The general structure of the pre-Tertiary rocks consists of a series of tightly-folded metasedimentary and metavolcanic rock remnants surrounded by exposed plutons ranging in composition from hornblende gabbro to alaskite. The metasedimentary rocks consist of low- to intermediate-grade metamorphic equivalents of fine-grained sediments deposited during the Paleozoic era in a miogeosynclinal environment. Later volcanics were deposited in a eugeosyncline. The ore bodies in the Bishop district consist of scheelite-bearing tactite formed by the pyrometasomatic replacement* of calcareous sediments along the contact with an acidic granitic intrusive. A number of the metasedimentary remnants have had tungsten deposited along their edges.

A LARGE proportion of the coke used is made in the by-product oven from the high-volatile coals mined in the adjacent district. At the beginning it was feared good by-product blast-furnace coke could not be made with our coals. By experimenting with various mixtures of coals, coking time, oven design, and coking temperatures, much has already been accomplished. The results show that a hard, dense coke, not easily broken by handling, can be produced. In its present state it is not all that could be desired, but it is being constantly improved. Such coke has been used alone as the fuel on several of the blast furnaces producing the highest daily production in the Pittsburgh district. Many of the coals in the Pittsburgh district when coked in the by-product oven yield a gas which contains a high percentage of sulfur, which is objection- able for many metallurgical operations. As this fuel is gradually replacing the ideal fuel, natural gas, which is becoming less plentiful, studies are being made of the best methods for purification. Some metallurgists believe sulfur to be a very injurious element in steel. Recent investigations by Government bureaus, scientific bodies and private firms, seem to indicate that a reasonable amount of sulfur may exist in steel without detriment. WHEN dry chlorine gas is made to act in the cold upon finely¬divided gold,' it converts the latter with evolution of heat into auro-auric chloride, Au2CI4, a hard, dark-red, hygroscopic salt. Moisture splits this salt into aurous and aerie chloride, Au2C14 = AuCI + AuCI3; treatment with water converts it into auric chloride and gold, 3 Au2CI4 = 4 AuC13 + Au,. Aurous chloride, when stirred with water, undergoes a similar decomposition, 3 AuCI = AuCI3 + Au,. These decompositions of auro-auric chloride and of aurous chloride furnish the explanation for the practice of moistening an ore before it is treated by the Plattner chlorination-process; practical experience having shown that gaseous chlorine gave an unsatisfactory extraction with dry ore. According to Rose,' fine gold is acted upon more slowly by chlorine than gold containing some base metal, e.g., copper. He also states that small quantities of silver increase the rate of solution, but adds that the coating of silver chloride formed checks, and finally stops, further action, if the percentage of silver be increased beyond a certain undetermined amount. Bromine' acts upon finely-divided gold in a manner similar to chlorine; the auro-auric bromide, Au2Br4, however, is not hygroscopic. Upon treatment with water it is decomposed as is the corresponding chlorine salt. It is generally believed that bromine does not act as energetically upon gold as does chlorine. A record $19.7 billion in minerals was produced by United States industries in 1963. This was some $800 million above the previous high established in 1962. Preliminary statistics compiled by the U.S. Bureau of Mines show that most metals, nonmetals, and fuels gained both in value and volume of production. The 1963 total represents the largest value increase since 1956 and continues an upward trend begun in 1959. Product.ion and value of all mineral fuels rose, with anthracite registering a remarkable 20% value increase. Nonmetals advanced 591 in value, gains exceeding losses by 213 to 1 among individual commodities. Heavier industrial demand and the settling of labor difficulties were among the factors contributing to increased output of such materials as iron ore, bauxite, molybdenum, lead, and zinc, which accounted for most in€ the growth in metal output. Silver prices continued to rise and, as a result, production value of that metal gained 132,.

Discussion of the paper of R. J. COLONY, presented at the New York Meeting, February, 1921, and issued With MINING AND METALLURGY No. 169, January, 1921. R. J. COLONY (author's reply to discussion).-The work of Sosman and Merwin on the system lime-ferric oxide, mentioned by Mr. Rankin, was not overlooked. When studying portland cements and portland-cement clinkers petrographically, however, the lime-iron compound was difficult to correlate with the very definite dicalcium ferrite described by those investigators, which possesses such well-defined optical properties. In portland cements, the calcium ferrite (or ferrate?) is an indefinite, fuzzy, and generally amorphous, or apparently amorphous substance that is distributed interstitially with respect to the other grains, from which it was very difficult to derive any satisfactory results. For this reason, the writer, tentatively, chose to regard it as related to the aluminate, and assigned to it the composition 3CaO.Fe203, which may be incorrect, however, as Mr. Rankin suggests.

The first Diesel-electric locomotives for the Mesabi iron range of the Lake Superior district were put into service last summer by the Oliver Iron Mining Co., U. S. Steel subsidiary. There were ten of these locomotives, rated 1000 hp. and weighing 125 tons each. They are designed for service from 16 to 24 hours per day to haul trains of loaded ore cars from open-pit mines, 200 to 400 ft. deep, on a two to eight-mile haul to the top of the pit. The locomotives push or pull the trains over switchbacks and up heavy grades with 5 per cent maximum against the load. High tractive effort, less smoke, and ability to negotiate sharp curves were among the reasons for the selection of Diesel-electric locomotives.

MINING geology does not lend itself - very readily to a review embracing "improvements in methods," as perhaps do shop practices or laboratory procedures. The "methods" used in mining geology are simply the application of geology to mining; winning the ore, the handling of material, mechanical appliances, all belong strictly to mining proper, and have no place in a review of geology as applied to mining. A comprehensive review would necessarily cover a .very broad field, which could be subdivided into many -parts. Q: It is May 1961 at Bill Wrather's Washington house. Bill, think back to your first job after college. Wrather: Perhaps I ought to go back a little bit further than my first job. I entered the University of Chicago with the idea of studying law. My intention was to take a 4-yr liberal arts course and superimpose a law degree on that. But during my undergraduate work I fell under the influence of R. D. Salsbury. He decided I had some talent as a geologist and influenced me to take a geological course. Nevertheless, I did not give up the idea of law. While in school I took a spell of typhoid fever and almost died. The doctor recommended outdoor exercise, so a geological job seemed logical. W. H. Emmons was a graduate student in the University and he interceded with Dr. Hayes of the USGS. I went on the payroll as assistant packer at $60 a month. I had one of the most glorious summers I ever spent in my life. That fall and the following year I took law courses and became thoroughly convinced that I was cut out for a geologist rather than a lawyer. I finished up my law work in 1908 while waiting for a job with Bill Emmons, who was doing a careful study of Goldfield and Tonopah.

RECENTLY it has become the custom of retiring presidents to talk of the relations of the Institute to its membership and its constituency- and it seems a good precedent to follow. Past-president Smith reviewed our relations to materials and to society in general. Mr. Bradley spoke of the value and use of our publications and of our educational duties. My message will be in regard to the coordination of our various groups of member interests and of service to industry. This Institute has, within its organization, four divisions and fourteen technical committees--each interested in a separate put very definite subject, and each covering a phase of mining engineering interest. These vary from geology and the geophysical methods of prospecting, to the physics of the structure of metals, truly "from the mine to the consumer"-from the preparation for mining to the final use of that which has been mined.

THE purpose of this communication is to present activity data of nickel in the Ni-A1 binary system that was obtained for oxidation studies in this system. This data has been calculated from previous aluminum activity data at 1000°C1,2 by two types of Gibbs-Duhem integrations. These results should be of particular current interest to oxidation studies of aluminide coated nickel-base superalloys3 as well as other problems. The aluminum activity of Steiner and Komarek1 is plotted in Fig. 1 as a function of composition in Ni-A1 alloys at 1000°C. The dashed parts of the aluminum curves represent our approximate extrapolations from the directly measured regions. In the terminal solution regions (a and L phases) standard parabolic solution functions of the following form are assumed: where i is the component subscript, Ki is a constant at a fixed temperature, and xi is the atom fraction. The resultant nickel activity curve at 1000° C from the Gibbs-Duhem integration4 of the aluminum data is shown in Fig. 1. The solubility ranges of the phases present in the Ni-A1 binary at 1000°C are also denoted at the bottom of Fig. 1. Corresponding values of the nickel activity, aNi and yNi, are listed in Table I at useful compositional intervals. including phase boundary values. The aNi and yNi data listed in Table I are subject to the uncertainties present in the experimental aluminum activity data1 and to deviations from parabolic solution behavior in the terminal solutions. The errors introduced into aNi and yNi due to the parabolic solution assumption are expected to be relatively small (<20 pct of the values given) in all the phases except the liquid phase. Some deviation from parabolic solution behavior in the liquid phase is indicated

A GLANCE through the Bibliography appended to this paper will show that the Transactions of this Institute contain what virtually contitutes a history of the development of the manu¬facture of steel rails in this country and abroad. It is, therefore, fitting that this paper, bringing one branch of this important subject down to date, should be here presented, and it is also appropriate to select this joint meeting of our Society with the Iron and Steel Institute to compare the specifications covering the rails produced in these two countries, and to propose a standard specification to govern the manufacture of American rails for export. During the last ten years the production of Bessemer steel rails in the United States and Great Britain has amounted to 32,128,720 gross tons. Nearly 19,000,000 tons have been rolled in the past five years. The next five years will see an even larger output, owing partly to the extension of railway projects in the Orient, in South and Central America, in Mexico, and in Australia and the other British Colonies. Of late years, the American rail-mills have so largely increased their daily output, that trade conditions have often made possible the delivery of American rails to foreign ports. The tenders submitted by American mills, however, have always been accompanied by requests for changes in the foreign specifications, chiefly in the reduction of the amount of testing required; and it has only been natural, especially at first, that the engineer, whose specification had always been accepted without question by British mills, should interpret American tenders &apos;as an evidence that an inferior rail would be furnished

THE method of electrical mapping of oil structures to be described possesses certain limitations, as well as certain definite advantages. It, in common with other geophysical methods, is not a panacea for the solution of all subsurface geological problems. It operates on differences in electrical conductivity of the geological strata, whereas the other most-used methods operate on (1) differences in magnetic properties, (2) differences in gravimetric properties, or (3) differences in seismic properties. This modification of the resistivity method is therefore able to obtain subsurface information under conditions not favorable to the other methods mentioned. Where the other methods have been employed with ambiguous results it may act as a complementary method.
