The " law of the apex," with its vague and impracticable " extra-lateral rights," is defended—if it is defended at all— on the ground that it is required by the peculiar conditions of the mineral deposits or of the mining industry in those States and Territories in which it is operative. As I have repeatedly attempted to show, in papers read before the Institute, and most recently in an article on " The Relation of the Mining Law of the United States to the Davelopment of its Mineral Resources," published in Mr. Rothwell's Mineral Industry for 1894, there is now (whatever may have been the case formerly) no peculiarity of conditions in the regions referred to which warrants the subjection of their mining industry to a burden so vexatious and injurious as this law imposes. I have called attention to the absolute freedom from expensive litigations over mining titles enjoyed by all other States in the Union and all other regions in the world where the absurd extra-lateral right does not exist.

The requirements of the standard specifications under which Portland cement is sold have materially increased within the past 10 years, but practically all companies are now furnishing cement better than these requirements; in some cases exceeding them by nearly 100 per cent. From a sales standpoint, it is desirable to have a product that is uniform to a high degree and free from occasional quality troubles. A failure in quality, even if it affects only a few hundred barrels out of a yearly output of a million or more, is apt to be talked about in the trade and to affect the salability of the entire output. For these reasons, there has recently been great activity along the lines of quality control and improvement; and some of the most interesting problems of the industry are in this field. From the manufacturing standpoint, the quality of cement is chiefly a matter of uniform and proper chemical composition of the raw mix fed to the kilns plus proper burning in the kilns; the fineness to which the cement is ground, the proportions of gypsum, the method of seasoning, and the like are contributory factors. Uniform chemical composition of the raw mix has been one of the most difficult problems to solve. Most plants will use from 1000 to 3000 tons of rock per day and in but few cases is this material as it lies in the quarry even approximately uniform in composition. The problem, then, is to quarry and mix this raw material in such a manner that every handful passing through the kilns will have practically the same analysis as every other handful. To accomplish this purpose there are two methods of preparation: the wet and the dry. In each process, a stone storage is the first requisite of a successful plant. This storage place may handle the stone before or after crushing; its capacity may vary from two to three days' up to several months' supply, but it should be so designed that it can be filled as desired by the chemist and drawn at such points as will give a mixture of the various kinds of stone coming from the quarry and a reasonably uniform material going to the mill. The size of the storage place and the method of handling should be varied according to the nature of the material.

(written discussion).-There is no reason to doubt that the relationship between the rate of flow and the impelling force of all fluids can be expressed by a general typical equation . that takes cognizance of all relevant factors such as density, viscosity (or its reciprocal mobility) and nature of channel-walls. Most fluids that are commonly conveyed by flow in confined channels are so highly mobile that they may be considered non-viscous, hence for these fluids the factor of viscosity does not need to appear in the equation. Water is the outstanding example of this class of fluids and its dynamic behavior has been so thoroughly investigated that proven formulas pertaining thereto, be they rational or empirical, would naturally serve as prototypes for the other non-viscous fluids. As non-viscous fluids can be classed all gases and vapors, most unsaturated aqueous solutions, gasoline, alcohol, etc. Viscous fluids comprise those that have a sluggish flow such as most. oils, tar, molasses, etc., the high viscosity of which is due to shearing resistance between molecules; a force that must be taken into account in figuring the flow of fluids of this class.

This paper deals principally with investigations undertaken by the Welding Research Sub-committee of the Welding Committee of the Emergency Fleet Corporation. The general object of the investigations has been to extend the use of welding in the construction of merchant ships and, specifically, to provide a definite basis for obtaining the greatest economy and efficiency in employing welding in place of riveting in the construction of the hulls of such ships. Composition of_ Ship-plate Steel The chemical composition of the steel employed in such hull construction varies with the thickness of the plates. Through the courtesy of Mr. H. Jasper Cox, of Lloyd's Register of Shipping, the following information may be given concerning the kind of steel plate employed in American shipyards in 1918 for the hull construction of merchant ships. Lloyd's requirements do not relate to the chemical composition. They require a tensile strength of 58,000 lb. per sq. in. (40.75 kg. per sq. mm.) for their lower limit and 72,000 lb. per sq. in. (50.59 kg. per sq. mm.) for their upper limit. EMPLOYERS of engineers have not always been satisfied with the training that young graduates have received in the conventional four-year course. Specifically, employers of petroleum engineers for a number of years have believed that a four-year course does not allow sufficient time for the student to secure a fundamental engineering background plus the fundamentals of petroleum engineering. A group of California employers went so far as to set up a type of curriculum for a petroleum-engineering course, which was based on four years of undergraduate work and one year of graduate work, with most of the petroleum-engineering courses included in the graduate year.

IN his recent article, Stanley C. Herold described some of the principles involved in oil-field rejuvenation. The purpose of this paper is to present certain facts, based upon observations of systematic water flooding of oil sands in the Bradford and Allegany fields of northwestern Pennsylvania and southwestern New York, which, it is believed, will partially substantiate Mr. Herold's opinions. The writer gratefully acknowledges his obligation to the Forest Oil Corpn., the Kendall Refining Co., the Petroleum Reclamation Co., W. J. Healey, of Bradford, Pa., and the Producers Oil Corpn., of Olean, N. Y., for information included in this article; and he is especially indebted to Jerry B. It is obvious that, in the calculation of mathematical formulas for the prediction of oil recovery, uniform conditions must be assumed; otherwise, the applicability of the results of such work will be, by necessity, restricted to the area or individual property for which they were designed. Geologic and physical conditions are so variable throughout the fields where water flooding is practiced that it is difficult to devise methods that can be universally applicable. However, it is believed that there are certain fundamental principles which, when applied with specific modifications designed to meet the conditions existing in local areas or individual properties, may yield considerably greater recoveries of oil.

THE patent system, through which an inventor is given exclusive right to his invention for a limited period as a reward for his industry and in reimbursement of his expenditures, originated in England in the famous "Statute of Monopolies," enacted in 1623. The first patent granted in America was to Samuel Winslow, in Massachusetts, in 1641. The basis of the patent system of the United States is a provision in the Constitution giving Congress the power to secure to inventors for a limited time the exclusive use of their discoveries. The first legislative enactment was the law of 1790, which was placed on the statute book after Washington had addressed Congress in its favor. Under this law, the Secretary of State, the Secretary of War, and the Attorney General constituted the board for the examination of patent applications and the granting of patents. The first Secretary of State, Thomas Jefferson, became the first administrator of the patent sys- tem in this country. He personally examined every application filed during his term of office.

The cost of maintaining the production of an operating oil company is one of the most important, as well as one of the most difficult to estimate, of the various items which go to make up the total cost of producing oil. In the opinion of many operators the cost of drilling and developing new wells, whose, production takes the place of the loss in production through decreased yield of the old wells, is considered an operating expense, for the reason that the total income-producing power of the property is not increased. The cost of these new wells may be added directly to production expense, or it may be charged to capital account, and this account depreciated to the same extent. In either case, after an oil company is on a satisfactory income-producing basis, the money for drilling new wells to maintain production must be taken from the income of the company. Three factors determine the cost of maintaining production: First, the rate of decline in yield of the wells; second, the cost of drilling and equipping new wells in terms of their production; third, the decrease in initial production of new wells as the property is drilled and gas pressure taken off the sands, etc. In order to check theoretical figures for the cost of maintaining production the writer, with the assistance of Reed Bush and Fred Tough, has compiled the following figures. It is necessary first of all to choose a' period of time during which production for the field or territory studied remains fairly constant. The longer the period of time over which this condition prevails, the better. It is also necessary to eliminate or allow for any extraneous condition which may have affected the production returns, such as the shutting down of a large number of wells, the bringing in of a well of exceptionally large yield, the opening up of virgin territory where the flush yield is greater than will be had from new wells in after years, etc. All these conditions are exemplified most simply in the case of the Coalinga field, and perhaps these figures are more truly prophetic than the two other cases given. The electrical resistivity and the temperature coefficient of resistivity were measured with a potentiometric method using pure mercury as a reference material. Measurements were made nea,v roorn temperature. A detailed study was made of Hg,TI, near its melting temperature. THE work to be described was originally undertaken to provide the necessary data for interpreting the results of some optical experiments,' but because of the growing importance of liquid metals,273 it appeared that the results of the resistivity measurements should be published separately. For convenience the alloys selected were those which are liquid at room temperature. Special consideration was given to the Hg-T1 alloy closely corresponding to Hg,Tl, because recent X-ray diffraction results of Smallman and Frost seemed to show that the solid structure may persist to some extent into the 1iquid. EXPERIMENTAL PROCEDURE A potentiometric method was employed in which the resistivity of mercury was used as a reference. The essential features of the samples are shown in Fig. 1. A capillary tube CT with a bore of approximately 1.5 mm was fitted into two end cups, T, which were made of Teflon. A pair of current electrodes CE were immersed into the excess liquid metal which partly filled the end cups. The potential electrodes PE were inserted into CT through short pieces N of a no. 18 hypodermic needle held in place with Saureisen cement SC. As shown, the lower ends of the PE7s were reduced in diameter to 0.25 mm to minimize the distortion of the liquid metal cross section. Several methods were used to insert an alloy into the sample, but the usual one with mercury alloys was to fill the sample container with a weighed quantity of pure mercury* and then add weighed the sample tube in a vacuum. Because of rapid corrosion, samples containing gallium were of necessity prepared in a vacuum. To obtain the specific resistivity of an alloy the resistance of the sample containing the alloy was measured and compared with the resistance when the container was filled with mercury. Resistances were measured in the temperature range of 20" to 60°C to obtain the temperature coefficient of resistance. The electrical measurements were made by connecting the sample in series with the standard one-ohm resistance, and the potential drop measured alternately over the sample and the standard resistance. To correct for stray thermoelectric effects provision was made for reversing the direction of the current, and the true potential drop was taken to be the average of that obtained for the two directions of current flow. Various materials were used for the electrodes, the most uniform results being obtained with nickel. EXPERIMENTAL RESULTS The numerical results are presented graphically in Figs. 2 and 3 and in tabular form in Tables I and 11. ANY discussion of State-supported schools of mining and metallurgy needs to be prefaced by a definition, since the first school to offer a mining curriculum, the Pennsylvania. Polytechnic College, was established by a grant from the State. But, so far as can be determined, it received no further State support. It would be tiresome to go into precise details, and it will be enough to stipulate that by State schools are meant those which derive their main financial support from regular appropriations made by a State legislature. The University of Michigan was the first of these to. offer a mineral industry curriculum; its story, as well as those of Wisconsin and Illinois, has been related in the preceding chapter.* Arranging the others in chronological order involves making a decision as to what weight to attach to plans for giving instruction, as contrasted with its effective initiation. This may appropriately be illustrated by the history of mineral industry education in California. CALIFORNIA Among those who came to California in 1849 and the following years were many New Englanders who had a keen interest in education. Some of them, mostly Congregationalists and Presbyterians, sought to establish a school of higher education around San Francisco Bay and eventually succeeded in opening the "Scientific and Classical School at Contra Costa" in Oakland, at Broadway and 5th St., on June 90, 1853. This prospered so well that it was chartered by the State as the College of California" on April, 13, 1855. INTRODUCTION THE Wisconsin zinc district, or the Upper Mississippi lead. and zinc district as it is also termed, lies in the southwestern corner of Wisconsin, and embraces adjacent portions of Illinois and Iowa. It includes Iowa, Grant, and Lafayette counties in Wisconsin, and Jo Davies county in Illinois. In Iowa, Dubuque formerly produced considerable lead, but there has been little mining there in recent years. The map, Fig. 1, shows the entire district, with roads, railways, streams, and the various towns, or "camps," around Which the mines. are clustered. The hatchwork indicates the areas iii which lead and zinc have been mined. The district is about 60 mi. (96 km.) north and south and about 40 mi. (64 km.) east and west. Not all of the territory is mineral bearing, and there are considerable areas that are believed to be barren. The grouping of the mines is patchy and irregular, though certain broad zones of mineralization extend almost the full width of the district, as from Mineral Point west through Mifflin and Livingston, and from Shullsburg west through New Diggings and Hazel Green. It is worth noting that the best mines of the district have, to date, been found within 10 mi. east or west of the fourth principal meridian line, thus lying within a long, narrow, north-and-south belt extending the length of the district. In a field as large as the Wisconsin, which has only within com-paratively recent time been worked intensively for zinc, the. chances are good for, opening new and important orebodies in parts of the district not yet, or insufficiently, prospected. However, the prospecting has been most successful around, or adjacent to, the old lead diggings of nearly a century ago, and the camps that were well known then are still centers of activity. In their order of importance they are: New Diggings, Benton, Mifflin-Livingston, Galena, Linden, Hazel Green, Shullsburg, and Highland.

Computations and allowances for mine depletion for Federal income tax purposes depend upon the meaning of certain terms in the pertinent provisions of section 114(b) 4 of the Internal Revenue Code. Unfortunately, but one of these terms is defined in the Code. Congress left it to the Commissioner to define the other terms in the Regulations. Even though the Commissioner, through his staff, labored long and earnestly to draft these definitions they have not been satisfactory to the mining industry, because the definitions in the Regulations and the interpretation placed thereon by the Commissioner do not state what the industry believes to be the clear and obvious intent of Congress. Consequently serious and prolonged disputes, unduly delaying the settlement of Federal tax returns involving percentage depletion deductions are continually arising between taxpayers and the Commissioner.

DETAILED knowledge of purchase specifications established by coal consumers is essential to the successful design and operation of a coal-preparation plant. ANTHRACITE Specifications should be considered by both the consumer and the producer as guide posts outlining a certain path for both to follow. Plants differ, therefore specifications must differ to meet the varied requirements. Specifications are not of themselves a "cure all" or an assurance of complete satisfaction in fuel utilization. Specifications should not be regarded as a license to engage in an orgy of buying any and all coals that may happen to fall within their limits. This would lead to the indiscriminate mixing of coals which may vary in their burning characteristics. Different coals of equal grade tend to be individualistic in their burning characteristics. Rather, specifications should be used to help simplify coal selection, to reduce the actual number of coals used over a given period; in other words, to have a stabilizing influence on coal or customer turnover. In the final analysis, the use of too many coals per year in a plant is costly to both the consumer and the producer. Too many sources usually result in higher operating and maintenance costs for the consumer and higher sales costs for the producer. Finally, the statement included in the report accompanying the com¬prehensive Coal Selection Charts prepared by the Coal Committee of the National Association of Purchasing Agents, and released in 1938, is significant. This Committee worked diligently for a period of 15 years seeking to find a scientific and reliable method for selecting coals. The two following paragraphs are quoted from its report: More important is the fact that no ready-made classification or set of specifications can possibly replace the judgment and resourcefulness of an experienced combustion engineer or fuel technologist, nor the usual need for full scale plant tests under the exact conditions of use before a final decision is made ...

The latter method corresponds with the direct effect. of low and high finishing-temperatures ; that is, a plus difference indicates low, and a minus difference high, finishing-temperature. I make this explanation to prevent confusion in comparing the two papers. Mr. Sauveur has shown that there is a close relation between the size of the grain and the ultimate strength, and also that the size of the grain depends on the temperature at which the material is finished in rolling, and on the chemical composition of the steel. Studies of the effect of size of the specimen on the change of slopes of Stages I and 11 by surface removal showed that the change of Stage I was independent of size with respect to the polishing rate; however, the change in the slope of Stage 11 with polishing rate increased directly in proportion to the surface area. The removal of the surface during the test affected the plastic deformation characteristics of gold, aluminum, and zinc single crystals and polycrystalline aluminum. The apparent activation energy of aluminum was found to be decreased markedly by removing the surface during the deformation process. In previous papers1-3 it was shown that the surface played an important role in the plastic deformation of metals. By removing the surface layers of a crystal of aluminum by electrolytic polishing during tensile deformation, it was found that the slopes of Stages I, II, and III were decreased and the extents of Stages I and II were increased when the rate of metal removal was increased. By removing a sufficient amount of the surface layer after a specimen had been deformed into the Stage I region, upon reloading, the flow stress was the same as the original critical resolved shear stress and the extent of Stage I was the same as if the specimen had not been deformed previously. The slope of Stage I was decreased 50 pct and that of Stage 11 decreased 25 pct when the rate of metal removal was 50 X 10"5 ipm. These data show that in Stage I the work hardening is controlled almost entirely by the surface conditions, while in Stages 11 and III both surface conditions and internal obstacles to dislocation motion are important. It appears that during the egress of dislocations from the crystal, a fraction of them becomes stuck or trapped in the surface regions and a layer of a high dislocation concentration is formed. This layer would not only impede the motion of dislocations, but would provide a barrier against which dislocations may pile up. In this case, there will be a stress, opposite to that of the applied stress, imposed on the dislocation source and dislocations moving in the region beyond this layer. It has been found convenient to refer to this layer as a "debris" layer. The "debris" layer may be similar to the dislocation tangle observed by thin-film electron microscope techniques.4 Reported in this paper are the results of studies on the effects of removing the surface during plastic deformation on aluminum crystals of various sizes. The effects of the surface on the yield point behavior of gold and high-purity aluminum crystals as well as the creep behavior were also determined. The effects of surface removal on polycrystalline aluminum (1100-0 and 7075-T6) are also reported. EXPERIMENTAL PROCEDURE For those portions of the investigation involving creep and tensile specimens, single crystals, having a 3-in. gage length and a nominal 1/8-in. sq cross section, were prepared by a modified Bridgman technique using a multiple-cavity graphite mold. The single crystals were prepared from materials which had initial purities of 99.997, 99.999, 99.999, and 99.999 pct for Al, Cu, Zn, and Au, respectively. The aluminum specimens for the size effect studies were prepared through the use of a three-tier mold in which crystals having a cross section of 1/8, 1/4, and 1/2 in. were grown from a common seed. The mold design was arranged so that one 1/2-in. crystal, two 1/4-in. crystals, and four 1/8-in, crystals of the same orientation could be cast. With this technique, it was possible to obtain only one set of crystals with the same orientation. Because of this limitation, it was not possible to determine both the changes of extent and slope of the various stages since a large number of crystals of the same orientation would have been required. Instead, only the change of slope as a function of the rate of metal removal was studied by abruptly altering the current density of the electrolytic polishing bath at various strains within the regions of Stages I and 11. The experimental techniques used for the tensile studies were essentially the same as those used previously.1,3 The specimens were deformed in a 200-lb Instron tensile machine, usually at a rate of 10-5 sec-5. A methyl alcohol-nitric acid solution was used as the polishing bath for aluminum. The temperature was maintained constant within ±0.l°C by means of a water bath. The tensile machine was
