The 2006 Sago, Darby, and Aracoma mine disasters in the United States (US) forced the US government to implement the 2006 MINER Act and additional regulations that require all US underground coal mines to install and maintain refuge chambers to manage entrapment emergencies, in particular, fires and explosions. However, there is a debate on whether barricading in refuge chambers is a good strategy to survive such emergencies. Australian coal mines are not required to use refuge chambers and, instead, have adopted a strategy that focuses on instructing and training miners to self-escape to the surface. This paper analyzes merits and problems of using refuge chambers and self-escape to the surface to manage emergencies in fires or explosions in an underground coal mine. The authors found that the use of refuge chambers may not be the best strategy during extensive fires or when multiple explosions happen. In these situations, mine rescuers are unlikely able to extract miners who are sheltered in chambers and conversely, self-escape may save more lives than sheltering. Chances for successful self-escape are further improved by regular, externally assessed training such as Level 1 Emergency Exercises required in the Australian State of Queensland. These exercises put pressure on mine operators to ensure and maintain the effectiveness of their emergency management system.

An advanced coal preparation plant has been built at Homer City, Pennsylvania, by Pennsylvania Electric Company, a subsidiary of General Public Utilities Corporation, and New York State Electric and Gas Corporation, as an alternative to utilizing flue gas desulfurization technology to meet the Federal Environmental Protection Agency and the Pennsylvania Department of Environmental Resources air quality emission regulations of 4.0 lb S02/106BTU for the two (2) existing coal-fired generating station Units No. 1 and No. 2, and a 1.2 lb S02/106BTU for the new Unit No. 3. The coal preparation plant is designed to process 5,200,000 tons of run of the mine coal annually and has a design capability to process 1,200 tons per hour via two (2) equal capacity 600 tons per hour preparation circuits.- The plant is designed to produce multi-product coal streams consisting of a middling product of medium ash and medium sulphur content, which is environmentally compatible to support operation of the two (2) existing generating Units I and 2, and a deep cleaned, low ash, low sulphur coal product capable of environmentally supporting the ambient air quality requirements of the new Unit 3 generating facility. The waste product from the process consists of high ash, high sulphur reject material. The process has the acronym MCCS (Multi-Stream Coal Cleaning System).

A review and comparison is made of the circuitry utilized for dc crane control systems. Anti-parallel three phase full wave thyristor bridges for dc motor reversing and speed control are compared with a single three phase full wave thyristor bridge for speed control and either contactor or static switching for reversing control to obtain complete four quadrant operation for crane material handling. In recent years the Harnischfeger Corporation has developed a solid state adjustable voltage control system to control the speed and direction of dc motors for crane applications and handling materia1.1 Shunt wound dc motors are utilized and speed is controlled in the motor base speed operating region at constant torque by a thyristor, silicon controlled rectifier (SCR), adjust- able armature voltage supply. The three phase thyristor bridge is the power controlling element of the dc adjustable voltage control. ELECTROTORQUE is the Harnischfeger Corporation registered trade name for this type of drive system. By controlling the gating signals or firing pulses to the thyristor bridge SCR's the dc output voltage can be varied over a wide range. This range is limited only by the magnitude of the ac applied voltage. To obtain operation of the motor in both directions two thristor bridges are connected in an anti-parallel arrangement. A typical schematic for two anti-parallel connected three phase SCR bridges is shown in Figure 1.

Modelling of industrial sulphide flotation based on data collected in several flotation plants is discussed. A mechanistic approach is used in which it is recognised that flotation is a two stage process with concentration occurring both in the pulp and in the froth. The important features of the model, which is a kinetic model, are – 1. for each particle species there is a range of flotation rates which corresponds to the range of particle sizes, 2. the flotation rates of the liberated gangue particles which have no hydrophobic properties are dependent on the flotation rate of water and are controlled by variables such as the air and frother addition rates, and the pulp level, 3. as an approximation the valuable sulphide particles may be regarded as being present in two groups with high and low flotation rate constants, 4. increase in the addition rate of collector tends to increase the proportion of sulphide particles which are in the high flotation rate constant group. The actual flotation rate of each group of particles is a combination of an "inherent" flotation rate and a flotation rate which is dependent on the flotation rate of water, at particular air and frother addition rates and pulp levels there is a physical limit to the rate at which particles can be transported into the concentrate and this is recognised in the

INTRODUCTION Following the world stock market debacle in October 1987, it would have been foolhardy to expect that securing equity funding in 1988 would be easy. Indeed, major equity financing's for gold mining companies have until recently been few and far between in the weeks and months following Black Monday. As a result, gold bullion loans have taken on an increasingly important role among producing firms in the industry. During 1988, the role of bullion loans has become increasingly complex and controversial. Some observers herald the emergence of a new breed of bullion loans - such as the 1,000,000 ounce loan to Newmont Mining, and the 400,000+ ounce facilities drawn down by Bond International Gold and Placer Pacific - as both increasing the public's awareness of the technique, and representing the dawn of a new age of gold financing. But are these recent loan facilities significantly different than those issued worldwide during the early to mid 19801s? Similarly, observers have voiced concerns regarding the role that gold loans play in the world's bullion markets, specifically in relation to their impact on prices. Have the new generation of mega-loans depressed current and future prices? Has the current surge of bullion loans irrevocably changed the nature of the gold market? Is there an upper limit on the number and size of gold loans?

With the exception of reports on commercial deposits of kaolin, fuller's earth, and other specialty type clays, there is little published information on the extent, properties, and potential uses of the clay resources of Florida. Recent studies by the Florida Bureau of Geology in cooperation with the University of Florida and the U.S. Bureau of Mines have proven the existence of two extensive Miocene clay deposits, one in peninsular Pinellas County and the other in southeastern Charlotte County. Drilling and subsequent testing of the clays from these deposits indicate their potential for economic development. Both deposits consist of montmorillonite type clays, have an average thickness of 25 to 35 feet, and are overlain by unconsolidated Pleistocene sediments. Preliminary firing tests indicate that the clays from Pinellas County are a potential raw material for lightweight aggregate production. The clay has good bloating characteristics across an acceptable temperature range with a resultant aggregate density of less than 1.00 specific gravity. The clays from Charlotte County have poorer natural bloating characteristics but might well be used after treatment or with additives. The economic potential and locations of both deposits emphasize the need for locating similar clay resources in the state that might have economic potential so that land use planning and subsequent urbanization will not prohibit their development.

Evaporite rocks, salts of the more soluble ions in seawater, are deposited when seawater becomes concentrated by excess evaporation in marginal basins having restricted circulation with the open sea. The simple conceptual model of an evaporite basin (Figure 1) has a single inlet connecting the basin to the open ocean, the restriction to open circulation being caused by a bar or reef near the mouth of the inlet. As the oceanic water flows from the inlet into the basin it tends to form a thin layer of brine that spreads out over the surface of the basin brine, and as it does so, the salt concentration In the surface layer gradually increases owing to continued evaporation of the water. When the solubility products of the salts in the surface layer are exceeded, the salts precipitate and settle to the bottom of the basin, The order of precipitation follows their order of least solubility. Normally the carbonates separate first, followed by the sulfates and chlorides and the more complex double salts. In nature there is considerable overlap in their ranges of precipitation. The water flow in the basin, also shown schematically in Figure 1, diverges from the inlet essentially perpendicular to the lines of' equal salinity in the surface brine. The distribution of salts deposited in such a model will parallel the isosalinity lines, being arcuate and concave toward the inlet (1)

Coal production in the Central Appalachian region has a long history, and it remains a major US coal-producing region. The coal industry consensus is that the region is in a state of decline as evidenced by the recent lower regional output. Are Central Appalachian coal reserves adequate for the region to continue as a major supplier of low sulfur coal? To answer that question, this paper focuses on the Central Appalachian coal reserve base estimates and production trends. Central Appalachian (CAPP) reserve evaluations face the difficulty that there are no publicly available databases that provide a thorough analysis of remaining CAPP reserves. Based on best available Energy Information Administration (EIA) data, a coal reserve estimate of 17.6 billion tons is developed. This estimate appears high according to industry perception. Recent United States Geological Survey (USGS), and other state agency coal reserve estimation projects are evaluated as alternative approaches to the re-serve estimation problem. Using the conclusions from these studies, the CAPP reserve base is estimated at 7.1 billion tons. Another perspective on the CAPP reserve base is provided by reserve holdings of major CAPP operating companies reported at 5.2 billion tons. A conceptual mining cost analysis indicates substantial price increases will be necessary to offset this deterioration in the economic viability of the reserve base.

Discussion by Dan Plazak The authors are to be congratulated for presenting a simple and practical tool for quick estimates of ground water flow rates. At the risk of detracting from the simplicity of the method, I would like to suggest a slight refinement to the equation as presented. As the authors noted, the Jacob-Lohman equation (1952) assumes confined-aquifer conditions. To use confined-aquifer equations in water-table aquifers, Jacob (1963) presented a correction to convert water-table aquifer drawdowns [Ahw] to equivalent confined aquifer drawdowns [Ah,: 2] [Ah Ah = Ah - w(1) Cw 2H where: Ah, = Drawdown in confined aquifer: Ahw = Drawdown in water-table aquifer and H = Original saturated thickness of aquifer] Substituting the above in equation ( I) of Hanna. Azrag and Atkinson [4nT Ah - 2H ) Qj2.25 T t(2) 1 nr2 S W] Since the above expression predicts lower pump rates, it causes the Jacob-Lohman equation to agree more closely with appropriate analytical and numerical models. Figure 1, adapted from Fig. 5 of Hanna. Azrag and Atkinson, illustrates the closer agreement of the modified equation to their numerical model, as reflected in Qm/QJL ratios closer to unity. The agreement improves particularly as drawdown [Ah] becomes large in relation to aquifer thickness H. An additional advantage of the modified equation is that Hanna, Azrag and Atkinson's correction factor C is much more stable as pit depth increases. Introduction The Utah Copper Division of Kennecott Copper Corporation will present its contribution to the A. M. Gaudin Flotation Symposium in four parts. The first two segments will discuss briefly the historical development of the Utah Copper Division and describe the ore body. The third segment will review the facilities and operating procedures for the Utah Copper Division's newest plant, the Bonneville Concentrator. The fourth segment describes flotation process circuitry, including molybdenite recovery procedures, at the Arthur and Magna concentrators. (The Bonneville concentrator is a crushing and grinding unit and does not have its own flotation plant). 1. Historical Development Progress through change has been the key to the successful operation of the Utah Copper Division for more than 70 years. As the original low-grade copper operation, the pressures to remain competitive and profitable have dictated the timing and extent of each change. Much of the change has occurred through technological and economic advancements in the area of ore concentration. The Utah Copper Division of Kennecott Copper Corporation had its origin June 4, 1903, when the Utah Copper Company was organized. The initial mill of 300 tpd (tons per day) capacity was built at Copperton a few miles below the present Bingham Canyon mine site. From 1904 to 1910, the Copperton mill was expanded to a capacity of 1,000 tpd, and all of the known apparatus for gravity concentration were evaluated.

No economic activity would take place without human ingenuity, driven by our needs and wants. Economic activity is made possible by the energy from fossil and other energy sources, our technological hardware, the buildings and infrastructure made from materials such as metals, plastics, wood, water, and numerous industrial minerals. Industrial minerals are difficult to define; however, they generally include utilitarian minerals other than metals and fuels. Some of the industrial minerals form an exception to this categorization and, as explained elsewhere in this book, belong to more than one category because of the manner in which they are used. Industrial minerals are so numerous, and their applications so ubiquitous that they often do not receive the attention given to metals or fuels. Nevertheless, without industrial minerals, many of our most fundamental economic activities such as construction of our cities and towns, control of floods, transportation of our people, the search for minerals, the smelting of metals, and the delivery of supplies of clean water would be impossible. How then do we assess the economic importance of such a variety of materials lumped together under the general designation of industrial minerals? The price per ton or the total amount consumed do not satisfactorily explain the relative value of these materials to the economy. For example, the current price of limestone is about $5/t and the price of fluorspar is about $190/t. However, nearly 1.1 Gt of limestone, valued at about $5.5 billion, are consumed in the United States annually, compared with 590 kt of fluorspar, valued at about $1 12 million. It would not, however, be accurate to conclude that the mineral with the higher total value is always more economically important. Many other questions must be answered before making judgments of this type. These questions include how many people are employed in the production, processing, and distribution of the mineral? How is the mineral used? Is it partly or entirely imported? Where do the imports come from? How is the mineral transported? Is the mineral considered critical to national security? Is there a substitute material available in case the mineral supply is interrupted? Where would the substitute be produced? What would be the basic material from which the substitute will be produced? Even when these questions have been answered satisfactorily, the economic importance of the mineral is not completely known until the consuming sectors are studied as well. For example, even though the manufacture of fighter aircraft is vital to the national security, it employs only a fraction of the number of people employed in the housing and construction industry or the automobile industry or the appliance industry. Mineral commodities consumed in these latter sectors of the economy are more significant than those consumed in the production of fighter aircraft, because nearly two-thirds of the Gross Domestic Product (GDP) depends on the purchasing power of individual consumers. In comparison, the entire defense budget accounts for only 6% of the GDP. There is no easy way to present the importance of industrial minerals to the US economy because most minerals have diverse applications and products made from industrial minerals often con- tribute to the production of other goods and services. One way of highlighting the value of a mineral would be to relate it to the GDP reported by categories such as construction, machinery, stone, clay and glass products, electrical and electronic equipment, paper and allied products, and chemicals and allied products. These GDP categories represent industries fundamental to the economy totaling $644 billion, or about 12% of the GDP in 1990. However, these categories are not convenient for discussion of the many minerals that are used in our complex economy. In a general way, minerals are the 5% of our economy that make the other 95% possible. This chapter, therefore, discusses a selected few industrial minerals to illustrate their importance to various sectors of the economy.

INTRODUCTION The development of nuclear industry in Taiwan requires an increasing supply of uranium. Uranium recovery from phosphate ores, becomes an important item of the R & D programs. Many countries have already started such a program. USA has set up an industrial-scale production plant; South Africa, Israel, Morocco and other countries have also engaged in the development of extraction technology of uranium from phosphate ores and started setting up the production plant. In Taiwan, a feasibility study of establishing the production plant was started in 1977. A pilot plant was completed, tested, and operated in 1979. The main source material. - phosphate ores is obtained from China Phosphate Company. The annual yield of the pilot plant has been planned to be one ton of ammonium diuranate (ADU). The Health Physics Division of Institute of Nuclear Energy Research (INER), Atomic Energy Council of Republic of China (ROC AEC), is responsible for the radiation safety control of the plant. The purpose of the radiation safety control is to collect radiation safety information of the plant of this type, to evaluate possible radiation hazards to the personnel, and to analyze the radiation safety of the immediate environment adjacent to the plant. Furthermore, the information and experience obtained are used as the basis for applying radiation safety control to the production plant. The main emphases of the radiation safety control are therefore the arrangement of radiation safety control areas and the collection and evaluation of the health physics data. This report includes the past one and half years' experiences of the radiation safety control of the pilot plant, the planning of the production plant with an annual yield of 10 ton ADU, and considerations given in improving the radiation safety control of the production plant. PILOT PLANT AND ITS OPERATION PROCESS The pilot plant occupies an area of 350 m2 and is a two-story rectangular building. Exits are provided by a front and a rear door. An additional small door at the central right side of the building is connected to the maintenance area located outside the main building. The interior of the building is divided into interconnected offices, laboratories and process area (Figs. 1 and 2). A stairway to the process area of the second floor is located in the central part of the first floor. The second floor offices are accessible by the additional front and rear stairways. The main process area of the first floor is furnished with plastic floor, and the second floor with poriferous iron-grid floor. The building is not furnished with centralized air-conditioning system. Individual air conditioners are, however, available to some laboratories. Because the back door of the building is frequently open, the product storage room is provided with a blower to maintain good ventilation. Natural uranium contents of phosphoric acid solution vary in the range from 0.07 to 0.11 kg/m3. The process consists mainly of the uranium concentration cycle and the purification cycle. A flow diagram of the process is shown in Fig. 3. CONSIDERATIONS GIVEN FOR RADIATION SAFETY CONTROL AND THE ESTABLISHMENT OF RADIATION CONTROLLED AREAS The radiation safety control of the pilot plant is carried out on the basis of the considerations listed below:1,2 1) Since the wet process is adopted, and the flow of the radioactive material is confined to closed pipes and containers, air contamination is therefore not too much of concern. 2) The concentrations of radioactive material of the whole process are mostly less than 10 ppm. An exception is the final ADU product after precipitation and centrifugal separation, which contains up to 50% natural uranium. It is therefore necessary to apply radiation safety control to the process area where

Bio-epigenetic sulphur deposits occur in Pecos, Reeves and Culberson counties of far West Texas. Sulfate reducing bacteria, utilizing hydrocarbons as energy, transformed gypsum into replacement limestone and hydrogen sulfide. Hydrogen sulfide, retained in the pores of the replacement limestone, was subsequently oxidized by highly oxygenated groundwaters, and native sulphur precipitated. West Texas sulphur was first recognized at surface exposures by William P. Blake, a geologist attached to the Captain Pope Military/ Scientific Expedition of 1854. Attempts were made in the early 1900's to mine these sulphur vent exposures by a retort method, but the ventures met with little success. In 1967, Duval discovered a large sulphur deposit near some of the old sulphur works in Culberson County. Duval also expanded reserves in a small sulphur deposit in Pecos County. The Frasch process, developed for producing sulphur from Gulf Coast salt domes, proved successful in West Texas type sulphur deposits also. However, modifications of the process were necessary to provide economical and efficient sulphur recovery from the varied ore occurrences. West Texas conditions and logistics require the ultimate in productivity to be competitive in the domestic and foreign sulphur markets. Several companies, in addition to Duval, are producing or have produced sulphur in West Texas. As of June 1, 1984, a total of 29.87 million mt (29.4 million long tons) of sulphur had been produced west of the Pecos River. Duval corporation has produced more than 88 percent of that total.

Early experiences The first double shield hard rock tunnel boring machine, manufactured in 1973, belonged to the generation of machines that were equipped with 12" dia. cutters. The experiences made with the 4.3 m diameter prototype ROBBINS mod 144-151 have been reported at the 1976 R.E.T.C. of Las Vegas (1): it might be worth recalling here that, with a specific cutter load not exceeding 10 to 12 metric ton and a 4.8 r.p.m. cutterhead speed, the average advance rate was of 350 meters per month of 21 working days with a peak production of 1,050 m of advance in 40 working days, in widely weathered and fractured granitic rocks of generally precarious stability, where a precast segmental lining was routinely installed as tunnel support. Over the 8.2 km of the Sila Tunnels, several badly crushed or sheared rock zones were bored through without major problems, even with water inflows of up to 30 1/sec. The same machine, with an improved design of the telescopic-and-floating shield area and equipped with flameproof drive motors, was taken to Colombia where, from September, 1979 to March, 1982 it drove 7.5 km of the Rio Negro-Chivor Tunnel in competent siliceous shales of up to 130 MPa at an average rate of 20 m/day.

INTRODUCTION This paper presents (1) modified slipform system which was employed for simultaneous concrete placement for permanent lining and Instruction of a partition wall in the execution of a ventilation shaft 620m deep, and (2) current shaft sinking techniques which have been applicable and efficient for the subsurface conditions in Japan. MODIFIED SLIPFORM SYSTEM FOR PERMANENT LINING OF VERTICAL SHAFT General Information This paragraph deals with rapid construction by using modified slipform system for the permanent concrete lining and a partition wall of ventilation shaft, which has inside diameter of 620m and depth of 620m, of Enasan Highway Tunnel. The general feature of the shaft is illustrated in Fig. 1 and standard section of the shaft is illustrated in Fig. 2. The geological condition surrounding the shaft is mainly of ryolite and surface is of talus, but as a whole, they are rather weak and weathered rocks with faults, fissures and clay seams. 220mm borehole for the geological investigation was used as a drainage hole, predicting the amount of water inflow into the shaft to be 10t/min. The shaft was executed mainly by means of the conventional short step sinking method of 1.2m lift, employing temporary headframe and hoists. For each lift, 40 to 50cm thick temporary concrete lining was used. About 28,600m3 of rocks were excavated and

An essential prerequisite to expanding the application of longwall mining techniques in the United States is the development of a better understanding of the mechanics of rock mass deformation near the mined seam, in the inter- burden and at the surface. The results of studies of this type will provide a basis for the development of empirical and/or numerical modeling techniques to predict the rock mass response to mining both near and far from the mined seam. This will lead to improved gate and panel design, resulting in maximum recovery, increased productivity, as well as provide a mechanism for assessing likely surface effects induced by long- wall mining. Presented here is the instrument plan to be used at Kitt Mine No. 1 in the study of rock mass response to two adjacent longwall panels.

This paper discusses design and construction aspects of the tunnel, shaft and station for the Weehawken Tunnel and Bergen line Avenue Station. The project consists of a 1,269 m (4,156 ft) long existing railroad tunnel, which will be enlarged and equipped with a two-track light rail system. The project also includes construction of a deep underground station, with a large shaft connecting the surface station to the below ground station for access and ventilation purposes. Vibration and noise from blasting is a critical community issue and blasting adjacent to two 230-kV duct banks located in the tunnel invert required special blasting procedures.

ITmk3®(Iron Technology Mark III) is an innovative new ironmaking technology whereby high quality iron nuggets are produced directly from iron ore fines and coal in a rotary hearthfurnace1). The reaction mechanism has been investigated in detail through fundamental laboratory research2)3), and the ITmk3 process has progressed from the laboratory to commercialization by the success of the pilot plant tests initiated at Midrex’ Technical Center and at the Kakogawa Bench Plant (KBP) located at Kobe Steel Ltd. Kakogawa Steel Works4)5). Pilot operations have demonstrated rapid production of the iron nuggets with complete metal/slag separation at a relatively low operating temperature. The Kakogawa Bench Plant (KBP) in Japan has logged 21 days continuous operation during which high quality iron nuggets were produced directly from fine ore and coal. The operation technology and the engineering data obtained from these pilot tests were instrumental for the scale-up of the ITmk3 process for the Mesabi Nugget Corp. pilot demonstration plant, which is located at Cleveland Cliffs Inc. Northshore Mining iron ore pellet plant in Silver Bay, MN. The ITmk3 process is an ideally suited technology for siting at the iron ore mine, as it allows the economical production of a value-added merchant iron product.

This paper presents a validation of C02 as a single surrogate measurement for other diesel-emitted pollutants in multi-diesel-machine operations typical of small underground mines. This means that the simple measurement of C02 alone can be used to estimate the concentrations of other components of diesel exhaust in the mine environment. The linear relationship of C02 concentration with other diesel-emitted pollutants was indicated by the results of simultaneous real-time monitoring of C02 with CO, NO, NO2, SO2, Respirable Combustible Dust (RCD), and Air Quality Index (AQI) in several small underground mines. The SO2 was not directly measured but calculated from the measured C02 concentration and diesel fuel analysis for carbon, hydrogen and sulphur. The measurements were made in the return air drift under various mining conditions involving a number of diesel LHDs and haulage trucks. The statistical analysis and mathematical representation of the several components of diesel pollutants with C02 are presented. Regression analysis shows that at the 1 percent level of significance there is a strong linear relationship of these diesel pollutants with C02. This relationship is discussed in detail, concluding that C02 measurement alone is a good indicator of overall mine air quality and can be used as a control parameter.

The first form of a surety bond was an honest handshake between two or more parties agreeing to a decision, and their personal guarantee of following through to completion. This has all changed. In 1895, the United States Treasury Department disclosed that $35 million worth of personal surety guarantees on file had become worthless. A law was then passed requiring all surety bonds, in favor of the United States, must be corporate surety bonds. Today, a surety bond is one of the nation's leading fi¬nancial instruments used to guarantee the completion of an obligation. One hundred-fifty years before cor¬porate surety bonds, outcrops near Richmond, VA, were being mined. These surface mines became under¬ground mines. Today, both are still being used to obtain a leading energy source, coal. Since that time, more than 5956 km2 (1.47 million acres) of coal mined lands have been reclaimed in the US (Coal News, August, 1987). More than 25,000 state and Federal mining permits cover¬ing 14,164 km2 (3.5 million acres) have been issued during the last 10 years. Coal production has exceeded 7.2 Gt (8 billion st). More than 5665 km2 (1.4 million acres) of mined land has been reclaimed by active coal mining opera¬tions and 267 km2 (66,000 acres) of abandoned mined lands have been re¬claimed by others. Reclamation bonds were freely writ¬ten in the 1970s. So why are they almost extinct today? Contract bond losses have been severe in the past several years, sureties reporting losses exceed¬ing 110%. But the same proof is not provided on coal reclamation bonds. A surety bond is generally required when one party has an agreement with another party, and that party wants a guarantee from a third party that a job will be completed according to the terms and conditions of a written contract. In the case of a reclamation bond, the surety company (surety) is the financial party. It extends the credit and a guarantee to the obligee (the State, Commonwealth, or Office of Surface Mining) that the principal (the coal operator/company) will complete the terms and conditions of the contract (the rules and regulations governing mining and reclamation). The Surety Association of America defines a surety bond as an agreement providing for monetary compensation should there be a failure to perform specified acts within a stated period. Webster's Dictionary defines surety in the following ways: "l: the state of being sure; 2a: a pledge or other formal engagement given for the fulfillment of an undertaking and; 3b: one who has become legally liable for the debt, de¬fault, or failure in duty of another." Banks never make accommodation loans. Either the loan is good or no loan is made. Surety companies feel the same way about surety bonds. In fact, the average person does not realize the dangers of becoming surety for another. How does a surety determine if a company is worthy of receiving surety credit? How is a coal account under¬written today for an obligation that may not be released for many years? When a surety company executes a reclama¬tion bond, it financially puts its name behind the coal company and its guaran¬tee that should the coal miner default on the obligation, the surety will fulfill the contract. How is the surety to determine if a coal company may still be in business five, 10, 20, or 40 years from today?
