Eminent domain overview Eminent domain is the power of the Government or a municipality to take property for public use without the consent or acceptance of the owner. Typically, the agency taking the prop¬erty will make an offer, hoping the owner will immediately accept and allow work to begin. If a mutual resolution regard¬ing its value cannot be reached, how¬ever, the municipality will institute a condemnation action in court seeking possion of the property. This is when the problems begin. The power of the Government to take the subject property is limited by Federal and state constitu¬tional requirements to pay "just com¬pensation" for the property. The exact nature of an owner's prop¬erty has been the subject of much debate and discussion. It is generally under¬stood, though, that property is consid¬ered to be "every kind of right or inter¬est, capable of being enjoyed and recog¬nized as such, upon which it is practi¬cable to place a money value" (US vs. 53 114 Acres of Land). A taking, for condemnation purposes, is considered to occur whenever there is a substantial interference with the free use and enjoyment of the property. Rarely is the necessity for the taking ever challenged and more rarely is the taking ever successfully challenged. When a taking occurs, it is not only the fee owner who is entitled to compen¬sation. Every person holding an interest in the subject property will be recog¬nized. Thus, all persons who at the time of taking have a compensable interest in the property will be made parties to the case (Swanson vs. US). Minerals, like all other interests in land, are recognized as property rights, giving the owner the power to dispose of them as he or she sees fit. Thus, the only remaining considera¬tion is only "just compensation." Ex¬actly what "just compensation" is has been difficult to define. Generally, it is that amount of money that will "put the person in as good a position as the per¬son would have been in had the taking not occurred." The owner must not be forced to sacrifice or suffer by receiving less than full and fair value for the prop¬erty. Every element that effects the value of the land and that would influence a purchaser must be evaluated. Courts have employed a variety of techniques to determine just compensa¬tion but have generally relied on market value as the standard for measuring compensation to the owner. The deter¬mination of market value is based on sales, income, costs, and use. These factors have been employed in various ways but can be summed up as: -The highest estimated monetary price the property will bring if exposed for sale in the open market with a reason¬able amount of time allowed to find a purchaser who is buying with knowl¬edge of all the uses and purposes to which it is adapted and for which it is capable of being used. • The amount the property would bring if it were offered for sale by one who desired, but was not obliged, to sell, and was bought by one who was willing, but not obliged to buy. • What the property would bring in the hands of a prudent seller, at liberty to fix the time and conditions of sale. • What the property would sell for in negotiations resulting in sale between an owner willing, but not obliged to sell, and a buyer willing, but not obliged to buy. • What the property would be rea¬sonably worth on the market for a cash price, allowing a reasonable time to affect a sale. (Michigan Standard Jury Instructions). Special consideration regarding mar¬ket value is given when the taking is only partial, rather than complete. An example of this partial taking is when a state highway cuts across the northern half of a parcel of property, leaving the rest behind for the owner. A variety of problems can be immediately seen. In a partial taking, the owner is permitted to recover not only for the property taken, but also for any loss in the value of the remaining property. The measure of compensation for partial taking purposes is generally the difference between the market value of the entire parcel before the taking, and the market value of what is left of the parcel after the taking (Michigan Stan¬dard Jury Instructions). Determining the partial taking value for mineral bear¬ing lands is the difficult issue.

Spontaneous combustion of coal has been studied by laboratory techniques using an apparatus in a small-scale laboratory testing. Coal?s inherent characteristics can be measured using Differential Thermal Analysis (DTA) and Crossing Point Temperature (CPT) methods. The DTA curve obtained after testing is compared with actual inherent moisture and its effect on spontaneous combustion has been investigated. It has been found that the Wits-Ehac Index increases as the inherent moisture of the sample increases. Therefore it can be deduced that liability to spontaneous combustion increases with increased inherent moisture. In addition, volatiles have a catalytic affect on self heating immediately after the inherent moisture is reduced. This is identified as stage two in the thermogram. The inherent moisture has a cooling effect during the initial stages of testing and is visible in the DTA thermogram. In addition, while an increase in carbon content means an increase in Wits-Ehac Index value, an ash content decreases the likelihood of on spontaneous combustion. This paper 3/gives the results of a reconnaissance of mining districts in Clark County, Nev., made from November 18 to December 22, 1936, and from February 9 to March 8, 1937-in all, 63 days. While the field work Was being done, virtually all of the mining districts in the county were visited and many data on active and inactive properties were obtained. The report covers the locations of the various mining districts, the nature of the deposits, information on past operations, current activity, and general data likely to be useful to operators, investors, and others interested in mining. The geology of the deposits is discussed only briefly. The principal metal-mining districts in the county are Goodsprings, Eldorado, and Searchlight. The zinc-lead ores of Goodsprings have been the most important economically, followed by the gold-silver ores of Eldorado and Searchlight. In the industrial-mineral field, gypsum, limestone, silica sand, and borates are the principal products. Metal mining in the county is characterized by numerous small operations and the ores are either milled locally or shipped to distant smelters.

FABRICATION of semiconductor devices.requires the formation of electrical contacts, often involving the use of lead, tin, and lead-tin solders. In several recent instances when germanium had been bonded to nickel with lead, a new metallic phase appeared, unattached to either germanium or nickel, but rather suspended as a continuous foil wholly contained within the lead matrix. Since such metallic structures do not form in nickel-lead or lead-germanium systems under identical conditions, a brief study was made of the characteristics and possible formation mechanisms of this material. The Plumduff sinter occurs at Whenuaroa, near Puhipuhi, approximately 30 km north of Whangarei. It is one of three residual sinters in the southern portion of a mid- to late-Pliocene geothermal system. The deposit consists of many large sinter breccia boulders, including rudrocks (coarse breccias), scattered around the flanks and summit of the small conical hill of Plumduff. Three types of sinter breccia occur: (i) rudrocks consisting of large, angular to sub-angular clasts of layered sinter up to 0.8 m across, as well as smaller clasts of sinter (20 - 100 mm dia), and fragments of stromatolitic structures; all clasts are supported in a matrix of microcrystalline, transparent to translucent to milky quartz; (ii) fragments of layered angular to irregularly mottled sinter of white to grey or bluish hue supported in a translucent to opaque silica matrix; (iii) smaller, matrix-supported breccias with clasts both partially surrounded and/or penetrated, by a clay-like weathering rind, and sinter conglomerates with rounded to oblate clasts. Three principal types of fabrics constitute the bulk of the sinter: (i) stromatolites, including columnar, palisade and filamentous networks, showing progressive silicification, in fenestral, tufted to clotted fabrics; (ii) peloids and pisoids; (iii) plant-rich facies in which various silicified plant species occur in a silica matrix. All fabrics have counterparts in hot spring deposits in the Taupo Volcanic Zone formed at temperatures from 75¦C to 35¦C. Also present is steam-condensate-produced alteration: kaolinite and alunite as well as boulders of quartz lattice texture. Cinnabar only occurs in sinter on the north and south central slopes of the hillside. No quartz veins or geyserite were recognised.

To maximize productivity and improve minerals processing technology, the U. S. Department of the Interior, Bureau of Mines, is investigating a particle agglomeration technique as a means of increasing the percolation rate of leaching solutions through heaps of clayey or finely crushed, low- grade, gold-silver ores. Bench-scale and pilot-scale experiments conducted on different ores indicated that the percolation rate of cyanide leaching solution was enhanced markedly by mixing the ore with a binder, such as lime or portland cement, moistening the mixture, then mechanically agglomerating and aging the feed prior to heap building and leaching. In addition, the rate of silver and gold extraction markedly increased without sacrificing total recovery of values. The use of concentrated cyanide solution instead of water during the agglomeration procedure substantially decreased the leaching time required to obtain maximum recovery. Results from bench-scale and pilot-scale experiments using the particle agglomeration technique are discussed.

Maori economic development still remains an enigma to many people some 157 years after the signing of the Treaty of Waitangi. It has only been in the last decade as a result of increasing pressures from Maori to recognize and settle grievances arising from the Treaty and the resulting compensation issues that "mainstream" has begun to sit up and take notice. While Treaty settlements such as the Tainui, Ngai Tahu and Fisheries settlements have gained prominence as a source of economic potential for Maori, there are significant existing assets owned by Maori worth an estimated $4.6 billion that add an exciting new dimension to Maori contribution to New Zealand's enterprise economy.   Despite the fact that many claims have yet to be resolved, Maori are clearly shifting from grievance to development mode as evidenced by their focus on capacity building through education, strategic alliances nationally and internationally and the significant growth of nett asset worth of Maori interests in a number of industry sectors.   In essence, Maori provide a large un-tapped economic potential in New Zealand. The years of relative economic obscurity appear to have wetted their appetite for positive growth and economic independence. Given current trends, it would not be unrealistic to expect the asset base of Maori to double in value over the next decade and to see the emergence of Maori owned Corporates not only within the New Zealand economy but also trading actively in the global market place.

In this paper a genetic algorithm is used in a heavily jointed rock mass in order to investigate the critical circular slip surface and modification of slope surface. This method was applied to the southern wall of the 6th Golbini Jajarm bauxite mine. The mine is the largest bauxite deposit in Iran, located to the northeast of the town of Jajarm in the Khorasan province. Estimated reserve of bauxite in this deposit is about 160 million tonnes. Field and laboratory investigations were conducted in order to determine rock mass behaviour. A genetic algorithm code that uses the Simplified Bishop method as an objective function was developed for findingt he safety factor of circular slip surfaces. Sensitivity analysis was applied to determine the optimum values of the genetic algorithm variables, such as population size, selection method, crossover and mutation rates. After finding the critical circular slip surface, slope modification is carried out by removing unstable sections from marked critical slip surfaces, and this process is repeated until the last unsafe section is removed. Based on this code, modification occurred during 7 steps, by reaching a safety factor of 1.3 in the last step. Finally, the modified slope angle of the southern wall of the 6th Golbini Jajarm bauxite mine was determined to be 48.44 degrees. The principal objectives of this study are to: (1) survey electrical practices in metal and non-metal mines, (2) survey electrical practices in metal and non-metal mills, (3) clarify the federal regulations governing electrical practices in metal and non-metal mines/mills, (4) analyze electrical accidents, and (5) make recommendations aimed at improvement of the safety of electrical practices in metal and non-metal mines. Information was obtained from literature searches, accident reports, visits to 27 mines and 12 mills, and discussions with knowledgeable industry and government people. The various electrical power systems and practices at the mines and mills visited are described. Similarities and differences based on the type of mining and the minerals being mined or milled are presented. The federal regulations governing metal/non-metal mine/mill electrical practices (Code of Federal Regulations, Title 30, Sections 55.12, 56.12, and 57.12) are presented and discussed. Explanations of each regulation are provided in an appendix. The attitudes of mine/mill operators towards the federal regulations are described. An analysis of the electrical accidents in metal/non-metal mines and mills during the period 1972-1978 is presented. Recommendations, including specific research and development activities, aimed at improvement of electrical safety in metal/non-metal mines are submitted.

In September, 1930, H. N. Eavenson, then Chairman of the Coal Division, appointed a Committee on Methods of valuing Coal Propelvties, with John B. Dilworth as chairman. The latter prepared a schedule' of features for consideration under the general headings of Undeveloped and Developed Coal Properties. These subjects were divided among the members of the committee and during the next year written discussions of his allotted subjects were received from each member. Mr. Grimes and Mr. Eavenson discussed the entire list,. These discussions were mimeographed and a set sent to each member before the meeting of the Institute in February, 1932. There was a general discussion at that meeting. At the meeting in February, 1934, Mr. Dilworth submitted a report12 which summarized the accumulated opinions and data and presented the conclusions of the committee as a whole on the subjects embraced in it's schedule. Members of the committee expressed the desire that some of the individual opinions be published for reference. Mr. R. THE metallurgical industry has purchased more than sixty per cent of the industrial gas cleaning equipment installed in Canada. This includes cyclonic collectors, scrubbers, cloth filters and Cottrell Precipitators. These are the principal types of equipment which are used commercially for the cleaning of gases which result from the processing of iron, nickel, copper, lead, zinc, gold, gypsum and aluminum ores. The recovered dust, which usually contains metal values, is returned to the process. The cost of the equipment is thus economically justified. This is in contrast to other industries, such as those involving steam power generation, asbestos, cement and lime production, where, though dust collection equipment is extensively used, it is installed primarily for nuisance abatement. Communities are becoming more and more conscious of air pollution, new and more stringent legislation is being enacted, and, for other than economic reasons the smelting industry will eventually be required to install more efficient gas cleaning equipment. Keywords: Pyrometallurgy, furnace, Bindura, nickel The smelter at Bindura Nickel Corporation processes concentrates from its own mines and other external sources. Concentrates are dried, smelted, and converted to a desulphurised matte (leach alloy) for further processing at the refinery. The smelter comprises a drying plant, submerged arc electric furnace, electrostatic precipitator, and three Peirce-Smith type converters capable of treating 150 000 tonnes of concentrates per year. Concentrates are dried in a rotary coal-fired kiln, blended with fluxes, and smelted in a six-in-line submerged-arc 15MW electric furnace. Slag is tapped and granulated for disposal, and matte is tapped at regular intervals for blowing in Peirce-Smith converters. The paper details the 37-year history of the smelter, including furnace rebuilds and operating parameters as they have evolved in response to changing feed compositions. Special challenges, particularly relating to the treatment of high talc concentrates, are also described.

THE Lehigh Valley Section is planning with a num-ber of other organizations a three-day conference, April 25, 26 and 27, with field visits to cement, slate and steel plants in the vicinity of Easton, Pa. W. B. Plank is chairman and D. Knickerbocker Boyd is sec-retary. Headquarters will be at Hotel Easton. Wednesday' will be cement day. In the forenoon A. S. T. M. Committee D-16 will meet and after luncheon the delegates will visit the Martin Creek plants of the Alpha Portland Cement Co. An evening dinner and general session on cement is being arranged. Thursday morning will be devoted to a technical ses-sion on slate, and the breaking of ground for the new John Markel mining building at Lafayette College. After luncheon various slate quarries will be inspected, the visitors being guests of the companies. In the eve-ning there will be a conference dinner at Hotel Easton with a number of distinguished visitors. Friday will be given over to steel and will include a visit to Lehigh University, an inspection of the plant of the Bethlehem Steel Corp., and a luncheon as guests of the latter.

Following the 1989 Loma Prieta earthquake, California Department of Transportation (Caltrans) expedited an effort to evaluate and retrofit important state-owned toll bridges to en­hance performance of the state's transportation systems during and after major (credible) earthquake events. Imbsen and Associates, Inc. (IAI) along with their sub-consultants, were awarded a contract to conduct seismic evaluation and to develop retrofit design for Benicia-Martinez Toll structure, to meet a "Serviceable" performance requirement after the event of a "Safety Evaluation Earthquake." This paper describes the design and construction specifications for the deep foundations supporting the main spans of the Benicia-Martinez Bridge. Benicia-Martinez Toll Structure (George Miller Bridge), a high-level deck-type welded truss bridge with welded girder approach spans, carries Interstate Route I-680 over the easterly end of Carquinez Strait near San Francisco, CA. The nearly 5000 ft long main truss structure consists of ten spans, ranging from 330' to 528' in length, supported on cellular reinforced con­crete pier structures. Foundation systems across the waterway, consist of cellular reinforced concrete footings, supported by groups of 6' diameter, concrete filled, steel caissons, resting on 5' deep rock sockets, at depths of 50' to 150' below the water level. Seismic evaluation of the existing foundation systems accounted for spatially varying ground motion along the length of the structure, variability of foundation material strength (i.e. at bed-rock), variation and effects of scour depth on the performance of the foundations, and dy­namic soil-structure interaction. Performance of caissons beyond their elastic strength, as well as their effects on the behavior of the foundations and substructures were evaluated and considered in establishing foundation vulnerabilities. Several retrofit strategies were considered leading to a final retrofit strategy to strengthen end connections of existing caissons, as well addition of new caissons to provide adequate lateral force resistance for the foundations. Final design package includes specifications as well as construction methods and requirements for existing and new caissons, under traffic, and pile load testing procedures for design loads of up to 12500 kips per caisson.

This paper presents various design and construction considerations involved in developing an underwater installation of lined, large diameter shafts not known to have been previously accomplished for the diameter size, depth or ground conditions identified with the Seabrook Power Station. Outlined approach provides for driving tunnels independent of shaft sinking operation, permits the use of prefabricated shaft lining and incorporates a safe dry tap method for connecting the shafts to the tunnels. INTRODUCTION The Seabrook Power Station, located two miles inland from the Atlantic Ocean, at Seabrook, New Hampshire, is a two unit, nuclear powered, electric generating plant, each unit having a capacity of 1150 megawatts (electric). Typical to all steam driven generators is the requirement for large quantities of water. Requirements for the Seabrook Plant will be met by intaking and discharging approximately 850,000 gpm of ocean water at a considerable distance from the shore line in water depths that render the environmental impact inconsequential. Obtaining, conveying and discharging such large quantities of water represents a major undertaking, particularly under today's environmental controls. Tunnels are well suited to reducing the environmental impact at the Seabrook site by conveying the water about 250 feet deep under the salt marsh (a valuable ecological feature) and under the beach well out into the ocean without any noticeable ground surface disturbance. An alternate approach utilizing trenched piping would have created some disturbances and was environmentally less desirable. The tunnels connect to intake and discharge

"The technologies used in the mineral processing of ores are being increasingly applied to the identification and remediation of metal contaminated industrial, military and landfill sites. The objective of mineral processing treatment of contaminated site material is to restore the value of the land and to concentrate the contaminants into a very small volume of separated material which, depending upon its nature, can be further processed, marketed, or sent to a landfill. A systematic characterisation of the site material is first undertaken. Bench and pilot testing follows to evaluate criteria for metal separation. The testing may examine one or more physical or physico-chemical reprocessing methods, singly or in combination, for the remediation of the test samples. These mineral processing tests determine the % metal removal fiom the soil and the contaminants concentrated from the medium. The usefulness of mineral processing testing for site remediation flowsheet design and execution is illustrated by the case studies presented. This paper will present the test results of three case studies: an industrial site decontamination, the cleanup of a small arms firing range, and the reclamation of property within a landfill.INTRODUCTIONEnvironmental legislation and our society’s quest for a cleaner environment has led to the application of mineral processing expertise and technology for industrial site decontamination, military site cleanup and landfill reclamation. Although the required level of decontamination varies between jurisdictions, a site becomes a candidate for decontamination once the contaminant concentrations are found to exceed the Canadian Council of Ministers of the Environment (CCME) Interim Remediation Criteria for soil (decommissioning guidelines) or applicable provincial guidelines. 1967 will be remembered as the year the world realized it was running out of silver. In May of this year a new era in tin the history of the white metal was begun as the power of the U.S. Treasury to regulate world .silver markets was staggered by one of the most intense speculative flurries in recent times. In the past few months the price of silver has risen from $1, 29 to over $1.80 per troy ounce and with it have spiraled the prices of a host of silver-bearing consumer items. Legislation has, been enacted to conserve our coinage and meager silver stocks and today large quantities of non-existent silver are trading hands at a fast pace on the commodity exchanges throughout the world. Now that the price of silver has been set loose, forces are in motion to dull the world's appetite for silver. At the same time there is strong incentive to provide greater quantities of silver to satisfy the world's hunger' for the metal.

Australian coals tend to be young in geological age and high in ash by world standards; preparation of the coal before marketing is almost universal. On the basis of float and sink data from 39 locations in the Eastern Australian coalfields, the coals are placed in four categories representing increasing difliculty in their washability characteristics. These seem to be related neither to the geological age nor the geographical position of the deposit and Hunter Valley coals, for example, span all categories. The influence of crushing on the washability of Australian coals is briefly considered and from limited data it is concluded to be appreciably smaller than for British or North American coals. A strategy for the float and sink analysis of Australian coals is proposed and the influence of washability characteristics on current trends in the selection of separating processes for coking and steaming products is discussed.
