Stress -induced ordering of carbon atoms is studied in a series of Fe-Mn-C alloys. A prominent peak is found in the vicinity of 280°C at frequencies of the order of 1.0 cps, with an associated activation energy of 37 kcal per mole. The height of the peak is linearly rekzted to the concentration of carbon in solution. The distortion of octahedral holes by manganese atoms appears to be predominant over carbon-carbon pair interactions. RELAXATION by stress-induced ordering of point defects is expected whenever the introduction of these point defects produces distortions which have a lower symmetry than that of the lattice. Under zero stress, the isolated point defects occupy the crystallographic-ally equivalent positions in the lattice, as these represent states of equal energy. However, if the defect sites are asymmetric, application of an uniaxial stress will split the energy states, and a redistribution of the defects among various states will take place. This is the case of the internal friction peak called the Snoek peak,1 resulting from isolated interstitials in bcc metals. The interstitial sites in this case have tetragonal symmetry. In the case of fcc and hcp lattices, such an effect is not expected from isolated point defects because of the symmetrical nature of the interstitial sites. However, internal friction peaks arising from interstitial diffusion have been reported both in hcp2,3 and fcc4-8 lattices. These peaks are often explained on the basis of stress-induced ordering of interstitial solutes, caused by the deviation of interstitial sites from their cubic symmetry through the presence of nearby defects. In the case of fcc lattices, evidence for interactions of both the substitutional-interstitial4,6,13 and interstitial-interstitial types5'798'14 have been presented by various investigators. The purpose of the present investigation was to study the internal friction peak attributed to the diffusion of interstitial carbon atoms in high purity austenitic manganese steels and to account for the peak in the light of the existing models. MATERIALS The Fe-Mn-C alloys used in the present investigation were made in two different ways, designated as Type I and Type 11. Type I alloys were made from high purity Fe-Mn alloys obtained in the form of 0.04- in.-diam wires from Materials Research Corporation, Orangeburg, N.Y. These alloys were carburized to different levels using gas mixtures of H2 and CH4 at 1000°C. Type I1 alloys were made in this laboratory starting with zone refined iron, spectrographically pure manganese, and spectrographically pure carbon. They were melted in an argon arc melting furnace and drawn into 0.04-in.-diam wires. All the wires were annealed at about 900°C for 3 hr prior to the internal friction experiments. After the measurements of internal friction, the phases in the samples were identified by X-ray diffraction and the carbon determined by the combustion method. EXPERIMENTAL PROCEDURE In the present work, a classical Ke-type pendulum was used. The details of the equipment were described previously by D. T. Peters.9 Dry helium at 40 torr was used in all the experiments. The internal friction, measured as the logarithmic decrement of the torsion amplitude of vibration was determined as a function of temperature, from ambient to about 500°C. The background internal friction was assumed to have the form of the exponential of the inverse temperature and was subtracted from the raw data. The height of the peak was measured at the position of the maximum in the plot of the internal friction versus temperature. The activation energies of the peaks were measured by the peak shift method. The internal friction values for an alloy were obtained as a function of temperature at different frequencies of vibration. The position of the peak changes with frequency, the higher the frequency the higher the peak temperature. The activation energy of the process associated with the peak is obtained using the formula

The preferred orientation and earing characteristics of ZS aluminum were studied. An empirical correlation was obtained relating earing behavior and variation of mechanical properties for face-centered cubic metals. Strain-ratio mecsurements for ZS were found to be in good agreement with Hill's theory of plastic anisotropy. DIRECTIONALITY in sheet metals may be revealed by earing in a cupping test, or by the variation of mechanical properties of tensile specimens taken at different angles to the rolling direction. However, no simple correlation appears to exist between earing and variation in mechanical properties in metals and alloys studied.1-5 Aluminum of commercial purity (known as 2S, with a specified minimum of 99.0 pct Al) cast by the direct casting process was chosen in the present investigation since ears at 45° or 0°, 90° can readily be obtained. Preferred orientation is often the principal cause of uneven metal flow, such as earing, and variation in mechanical properties. Consequently, the preferred orientation characteristics of 2s aluminum were initially studied using both X-ray diffraction and micrographic techniques. The variation of mechanical properties with angle to the rolling direction was next determined in an effort to clarify the apparent lack of correlation of earing behavior with mechanical properties for face-centered cubic metals. Strain-ratio*5,8 measurements were finally conducted to determine first, if the maximum values of the strain ratio occurred at the earing positions, and second, if Hill's theory of plastic anisotropy7 is applicable to other face-centered cubic metals such as aluminum. Detailed treatments, working, and heat treating are not given in this paper since this study is not concerned with the methods to produce earing, but to correlate earing with other properties and characteristics of the material. The percentage of earing was measured using the formula specified by the x—Y Aluminum Association, -------- X 100 = pct earing, where x is the height of the ear and y is the height of the valley from the bottom of the cup. Preferred Orientation Characteristics of 2S X-ray Studies: Beck and coworkers8 have determined that the rolling texture of 2s after 95 pct cold reduction may be approximately described by four equivalent ideal orientations near (123) [121]. Also, the recrystallization or annealing texture of 2s aluminum consists of four components of the (123) [l21] type, retained from the rolling texture, and of a (100) [001] or cube texture component." Fig. 1 illustrates the typical appearance of deep drawn earing cups with the corresponding X-ray diffraction patterns. The X-ray patterns were taken with copper radiation using the structure-integrating method'" in which the specimen is scanned during the X-ray exposure. The rolling direction was vertical and the rolling plane was perpendicular to the horizontal X-ray beam. It was found that an increase in the retained rolling texture component resulted in a greater 45" ear height, while an increase in the recrystallization texture component (i.e., cube texture) caused greater 0°, 90° earing. X-ray diffraction studies of 2s cold rolled to final thickness followed by a final anneal have shown that the rolling texture, and also the retained component of the rolling texture after annealing, are increased with greater cold-rolling reduction. The preferred orientation characteristics of 2s sheets given an intermediate anneal between cold rolling followed by a final anneal were found to depend on the position of the intermediate anneal during cold rolling. For instance, three identical samples of 2s homogenized ingot, each 1 in. thick, were given the following cold-rolling and annealing treatments: 1—50 pct reduction, intermediate anneal, 96 pct reduction to 0.020 in. and a final anneal; 2—75 pct reduction, intermediate anneal, 92 pct reduction to 0.020 in. and a final anneal; and 3—90 pct reduction, intermediate anneal, 80 pct reduction to 0.020 in. and a final anneal. The intermediate and final annealing treatments consisted of a 70°F per hr heating rate, held 6 hr at 800°F and air cooled. Typical X-ray patterns after each of these treatments are shown in Fig. 2. I HAVE already referred to this interesting locality in the opening address, but at the request of some of the members of the Institute, brought before them specimens of the ore and the accompanying rock. The ore, which is cassiterite, is also met with elsewhere in Maine, at Paris and Hebron, but it there occurs associated with orthoclase, quartz, tourmaline, and beryl, in concretionary granite veins, which cut the micaceous gneisses of the White Mountain series. At Winslow the veins traverse an impure gray micaceous limestone, which is found in many parts of this region, and is subordinate to the same gneissic series. The veins, which are seldom more than an inch or two in thickness, are abundant through a considerable breadth of the rock, and are interlaminated with it, occupying places between the sedimentary layers, which are distinctly marked by different shades of color. Occasionally, however, they cut across the stratification for a little distance, showing that the disrupting action was not always confined to tearing the layers apart. The vein-stone consists of purple fluor-spar, and silvery white mica with quartz. In this gangue the cassiterite, nearly black in color, is disseminated in small crystalline masses, sometimes one-half an inch in diameter, and is associated with a little mispickel. I have only seen the veins as exposed at a single point, but was informed that similar veins holding the ore are met with at a distance of several thousand feet

NORMAN B. PILLING (author's reply to discussion *).-The discussion by Mr, Bassett raised one or two points that deserve further discussion. The printed figure for the lead content of the copper used was 0.015 per cent. and not 0.15 per cent., upon which his comment was based. A copper having the latter figure would, of course, be quite unusual. Mr. Bassett takes exception to the writer's statement regarding the distribution of cuprous oxide in wrought copper and states that "the FIG. 1.--ROLLED AND ANNEALED SHEET. ETCHED WITH AMMONIA AND HYDROGEN PEROXIDE. X 75. eutectic of copper with cuprous oxide is usually found between the crystals of pure copper, whether in the cast or the wrought form." While it is very well known that during the solidification of cast copper the cuprous oxide is segregated completely as an envelope of cuprous oxide-copper eutectic around the crystals of copper free from oxide, it is the writer's opinion that, as a result of repeated rolling, this eutectic structure is quite destroyed and the small particles of cuprous oxide become widely scattered, and in the recrystallization following, during annealing, the rearrangement of the grain boundaries takes place with much indifference to the actual distribution of these particles. In the accompanying micrograph, taken from a rolled and annealed sheet, the random distribution of the small cuprous-oxide particles with reference to the location of the grain boundaries may be seen.

The phenomenon called "water-coning" is that, observed in many oil wells, in which bottom water gradually and frequently sudderlly displaces a part or all of the oil production when a certain rather critical production rate from the well is exceeded. To follow in detail the process of the formation of a water cone as it breaks through the oil zone and enters the well bore is a problem so complex as to make a theoretical analysis practically impossible. However, an analytical treatment of the flow system before the water has broken through and during the time that it lies statically beneath the oil zone with an elevated or "coned" surface can be carried through under certain approximations. To present an analysis which shows the essential characteristics of the coning mechanism is the purpose of the present discussion. Physical Basis of Theory and Meaning of Approximations As will always be true for flow systems where true water-coning is at all possible, the water will be supposed to lie beneath the oil zone because of its density contrast with respect to the oil. In fact, tinder the usual field conditions, when the pay horizon is reasonably homogeneous, the water most frequently enters the well through the lower zones, but even when it enters from intermediate zones it may, in the later life of the well, displace the bottom layers of oil, thus resulting in a system wherein the oil is effectively floating on the water.

EVERY mathematical statement of a measure of anything (as distin-guished from a count) is followed by a qualification always implied if not explicity stated--that the statement is only an estimate, which may vary from absolute accuracy within certain limits, according to the accu-racy of the measuring instrument. This basic fact, so obvious to engineers, is not so well understood by many that make use of laboratory coal tests. The tolerances that must be allowed in measurements of coal quality are very important in both their commercial and engineering applica-tions-and the significance of these tolerances depends upon the use made of the laboratory coal test. Only in recent years has there been any intensive study of this ques-tion of tolerances as applied to measurements of coal quality. There is very little in our published literature on the subject, and what has been published is not, readily comprehended by those who sell coal, or buy coal and use it, unless they happen to have made a study of the subject them-selves. There is great need for more widespread understanding of what has been discovered and how it applies to the use of laboratory coal tests. What follows is an attempt to condense into a few pages the results of the major investigations so far reported, and to explain their meaning in simple nontechnical language, with the addition of some recent illustrative experiments.

(Butte Meeting, August, 1913.) THE valuable results that have followed the application in recent years of microscopic methods of research to problems of ore genesis have been significant, but possibly the recognition of their practical importance is not as general as might be, and while, as a scientific method of investigating ores and rocks, the advantage derived through the use of the microscope is unquestioned, its utility as an aid in solving shining problems arising during actual every-day mine examination and operation may not be fully appreciated. Perhaps the roost logical method of showing some of these practical applications of the microscope will be to consider first the prospect stage of a mining venture, then the uses to which the instrument may be put during the operation of a working and developed mine, and, finally, to discuss some of the problems of a metallurgical nature that ii-my arise during milling and smelting the ore. The valuation of mining property as a preliminary to acquiring ownership or determining the advisability of investing time and money in an enterprise is one of the most important and delicate problems that come before the mining engineer. The many and variable factors that have to be taken into account, as, for example, the geology of the district, availability of supplies, probable mining costs, transportation facilities, and the quality of ore, require a careful balancing of costs against recoverable values.

Although mechanical appliances for the ventilation of mines have been known siuce very early times (one being mentioned in Agricola's De Re Metnllica, 1657), it is only within the last forty years that such appliances have been generally used. A great number of different ventilators have been invented and used, but the varions forms of centrifugal machines having proved their efficiency, have now almost conlpletely replaced all others. Most if not all of the machines in use in this country are of this class, being either open-periphery fans, or closed, with chimney and spiral casing, of a more or less modified Guibal type. The theory of such machines has been demonstrated by Mr. Daniel Murgue in Theories and Practice of Centrifugal Ventilating Machines, translated by A. L. Steavenson. His statement may be condensed thus : Let a = orifice in a thin plate, of such area that its resistance to the passage of a given quantity of air equals the resist ance of the mine. MANY existing ore deposits of valuable metals have been worked out in their upper surface levels and the continued productivity of these mines is dependent on their extension to greater depths in the earth. The maximum depths at present reached are about 6000 to 8000 ft. below the surface, with no evidence of an impoverished ore vein. These mines are widely distributed; some of the best known are in South Africa, Brazil, India and in the western sections of the United States. Among the factors which increase the difficulty of working these mines at increasing depths are hoisting, rock pressure and temperature. The manner and effectiveness with which these problems are met will, no doubt, determine in a large measure the ultimate depths to which any mine can be profitably worked. The most critical of these three factors at present is the increase in temperature with depth. The high temperature and humidity in many of these mines at present is severely detrimental to the health of the workers and greatly hampers their efficiency. Some have almost reached a condition in which the human system cannot survive. The problems involved in the cooling and ventilation of mines have all been ably analyzed and presented in previous articles. For this reason, only a resume of conditions affecting the cooling and conditioning of deep and hot mines will be given in this paper before attention is directed to possible methods of improving atmospheric conditions in the working levels.

DISCUSSION L. E. Djingheuzian (Canadian Dept. of Mines and Technical Surveys, Ottawa)—In their Summary the authors say: "Reconciling the grinding efficiency with good metallurgy is still a problem." In the discussion of the first paper8 in his reply to W. I. Garms, Mr. Myers states: "Our grinding process with smooth I-in. balls has reduced by nearly one half the metallic losses in the fine micron sizes of the tailing. This is simply because less of the fine micron sizes are produced. Since the + 65 mesh size is the same as formerly, a higher percentage of the intermediate sizes are developed. These sizes have the highest floatability, require the least reagents, and use less floating time. "These factors contribute so heavily to the overall economies that dropping our power grinding gain from 28 pct back to 19 pct is a small detail. However, we feel that this is only a momentary situation and that eventually the best features of the grinding and flotation processes can be brought together, which is as it should be." Italics are mine. The above statements, to me, appear to be the answer to the opening statement in the Summary. Denoting the costs at different power grinding gains as: Power Grinding Power Grinding Gain, 28 Pct Gala, 19 Pct Cost of grinding G G1 Cost of flotation F F1 Value of metallic losses T T1 where G1 > G2 F3 < F, and T1 < T, we have: G1+Fl+T1<G +F+T. Since the authors accept the idea that "grinding in flotation plants becomes part of the &apos;conditioning&apos; of the feed to flotation",4 i.e., that in flotation the ball mill is primarily a conditioning machine, it can be postulated that Tennessee Copper grinding at cost G1 is more efficient than grinding at lower cost G. This can be directly inferred from the Conclusion of the paper. Mr. Myers also emphasizes this at the end of his reply to Mr. Garms: "that grinding is for the purpose of preparing flotation feed and not grinding per se." This, to me, in the final analysis means that when the efficiency of grinding is weighted against the conditioning factor, the former becomes a function of efficient conditioning, hence, within the system in which proper conditioning is the dominant factor, the best grinding efficiency is provided by grinding which will contribute towards the optimum conditioning. This brings us again to the statement: "that if every grinding unit were considered as a conditioner for each following step, efficient grinding plants would become much easier to design."&apos; In other words, grinding equipment should be balanced against the flotation equipment and against chemical reactions taking place in the system. F. C. Bond (Allis-Chalmers Mfg. Co., Milwaukee)— The authors&apos; discussion of the probable ball motion in a slow speed high dilution mill is very interesting. When the 1-in. balls have worn down to about one fourth of their original weight they apparently first develop a flat surface; as wear progresses this flat face becomes concave, and other concave faces appear. It seems more probable that the first flat face may form at the softest part of the ball surface, and that each succeeding contact tends to force this flat face into sliding contact with a larger round ball; than that the flat faced ball tends to pair off with a particular round ball and to travel with it continuously. When the small worn ball has a flat face and is in sliding contact with a large round ball, the surrounding large balls will assume a more or less definite pattern, and slide against the worn ball, thus producing secondary concave faces. The primary concave face seems to be larger and better developed than the secondary faces. The ball charge can be divided into "concaves" which show at least one concave surface, "intermediates" which have developed flats or incipient concaves, and "rounds." Ball slippage is always present in a tumbling mill, and the mutual ball movement is necessarily a combination of rolling and sliding. The sliding motion is apparently concentrated upon the smaller worn balls which nest between the surrounding larger round balls. When each worn ball starts its upward path in the mill its primary flat or concave surface fits against a larger round ball, and the round ball slides upon it. The action may be something like that of the ball separator in a ball bearing, except that the worn sliding balls are always under considerable pressure. The material is ground under the combined influence of breakage 1—by impacts between falling balls and between falling and supported balls, 2—by being nipped between rolling balls, and 3—by being rubbed between the sliding balls. The rubbing action will be increased in the presence of worn balls with concave surfaces. The rubbing action probably produces a considerable portion of the finely ground slimes in the product. The worn balls commonly approach tetrahedrons in shape, and are very different from concavex, each of which has two equal opposed concave surfaces. Concavex were designed only to grind upon themselves, and not for use in combination with grinding balls. Their action in a grinding charge is very different from

ThE formation of the (100) [001) texture in 3-1/4 pct Si-Fe strip was first reported by Assmus ef a1.l in 1957. Since then much experimental work has been carried out with a view to establishing the mechanism involved. The papers cited above state that the (100) [001] texture was developed in strip rolled from material melted and cast in vacuum. (The impurity content of the ingot is reported as 0.005 pct.) The present note records that similar results can be obtained in material processed by powder metallurgy. A processing schedule is described.which enables the texture to be formed in strip up to 0.010 in. thick, but there seems no reason why this should not be achieved in thicker strip, provided that large grains are developed after sintering. The materials were prepared from Carbonyl Iron Powder Grade MCP (particle size 5 to 30 p) of the International Nickel Co. (Mond) Ltd. The powder contains about 0.15 pct 0, 0.01 pct C, 0.004 pct N, <0.002 pct S, $0.005 pct Mg and Si, and 0.4 pct Ni— that is, it is substantially free from metallic impurities other than nickel, which is thought to be unimportant in the present work. The silicon powder was 99.9 pct purity, or material of transistor quality (ground in pestle and mortar). The mixed powders (3-1/4 pct Si to 96-3/4 pct Fe) are heated in hydrogen at 350" and 650°C to deoxidize the iron before sintering loose at temperatures between 1350" and 1460°C (depending upon the ultimate thickness of strip required) for up to 24 hr. The object of the high-temperature sinter is to develop a large grain size at this stage. Alternatively, the loose sintering can be done at a lower temperature followed by rolling or pressing and then annealing at temperatures between 1350" and 1460°C. Both methods produce large grains, which remain large throughout the process. The compact is then hot-rolled to approximately 1/8 in. with high-temperature interstage anneals if necessary. This step is taken to avoid intercrystalline cracking which would occur if the material of such large grain size were cold-worked. The bar is then annealed at 1050°C and reduced to its final thickness by approximately 50-pct reductions and 1050°C interstage anneals. Throughout the process the dew point of the hydrogen furnace atmosphere is maintained at about -40°C. Samples were annealed in hydrogen at various temperatures and times. Secondary recrystalliza-tion to (100) [001] was developed on the thinner material (i.e., up to 0.002 in.) by annealing in hydrogen at 1050" to 1200°C with a dew point of - 40°C or in vacuum (10-5 Torr) at 1050°C. With the thicker materials (i.e., up to 0.010 in.) the best results were obtained by annealing in hydrogen at 1200°C with a dew point of - 55°C. Complete secondary recrystal-lization to (100) [001] textures was obtained. Above these temperatures secondary recrystallization to (110) [001] tended to develop. The final annealing of samples was normally carried out with the samples placed between recrystal-lized alumina plates, but some experiments were performed with the samples suspended so that their surfaces were not in contact with anything except hydrogen, and these were equally successful in developing secondary crystals. An approximate determination of the proportion of material (before secondary recrystallization took place) having crystals with the (100) or (110) planes in or near the rolling plane showed that 11 pct of the sample had (100) and 16 pct (110). The method used for the determination is described below. A sample was annealed at a temperature just below the secondary recrystallization temperature and etched to reveal the (100) planes. The approximate area covered by crystals having (100) or (110) in or very near the surface was measured on the screen of a Vickers projection microscope. This was repeated for twenty positions chosen at random and a mean of the results calculated. The main hindrance to developing the secondary crystals in the thicker materials was the difficulty of obtaining a large enough initial primary grain size before secondary recrystallization. This was overcome by increasing the particle size of the silicon powder used. During the course of the work, it had been observed that the larger the grain size after sintering the more likely it was that the material would be successful in developing secondary crystals at a later stage. An experiment was therefore carried out to determine whether the material with the larger grain was more successful in developing secondary crystals due to the large grain produced at the sintering state per se or whether it was due to the greater reduction of silica brought about when the sintering temperature was raised in order to increase the grain size. A comparison was made between two compacts, one of which was made with silicon powder of 60 to 100 mesh, the other with silicon powder which was finer than 200 mesh. F?r this experiment, use was made of a phenomenon previously observed that the larger the particle size of the silicon powder employed in making a compact, the larger is the grain size of the compact. INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty&apos;s pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation. The following communication was recently sent President Wilson by J. Parke Channing, Chairman of the Engineering Council: The transportation systems of our country are largely the creations of its professional Engineers. This statement can be made without disparagement to the statesmen, the financiers, the manufacturers, the lawers, the educators, the mechanics, the laborers and many others, who, with the Engineers, have contributed to the development of transportation. Through all stages of preliminary exploration, final survey, construction, upkeep and operation, in financial management, and in adjustment of the relations of transportation to the public, the genius and knowledge of the Engineer are essential. Not only in technical physical matters, but also in determinations of policy, his contributions have supplemented and must ever supplement those of other men. These declarations hold good for all the carriers of commerce, by rail, by highway, by water, by pipe-line, by wire, or by air. Hence, it follows that the body established by Government to regulate the commerce, the carriers and the ways of communication, embracing so many engineering features, should number among its nine members, men of engineering training and experience. Engineering Council, being aware of a vacancy on the Interstate Commerce Commission, begs leave to request the Chief Executive that in filling this vacancy, he give earnest thought to the selection of a man who, to his other qualifications, adds the training and experience of an engineer familiar with transportation problems.

(communication to the Secretary.) +-Mr. Johnson&apos;s explanation, that the rounding of the graphite masses in oxygen-bearing cast iron is clue to their being in part re-precipitated after re-solution in forming carbonic oxide temporarily with that oxygen, is certainly most attractive and suggestive. It remains to be shown whether this rounding occurs also when &apos;the solidiification is too rapid to permit this process to goon. J. E. Johnson Might easily test this by casting a single ladleful of his oxygenated iron in masses of varying size. If&apos; this present hypothesis is true, then the rounding ought to increase progressively with the size of the casting, and with the distance from the outside, that is to say with the time available for re-solution and re-precipitation. I question whether a like benefit is to be expected even on this hypothesis, from the oxygenation of steel. The spheroidizing of graphite does good because graphite itself is so weak. But the constituent which can be spheroidized in steel is its cementite, which is a source of strength. Lamellar pearlite, in which this cementite in effect forms long dendrites, is far stronger than divorced pearlite, in which these dendrites have been broken up into spheroids. Even the surfaces of contact between ferrite and cementite are probably sources of strength because of the amorphous iron which probably fills them.

THE first press was installed in June, 1910, and the second in March,1911. They produce 1,000 briquettes per hour, weighing 5 kg. (11.05 1b.) each, under a pressure of about 400 kg. per square centimeter (5,689.2 lb. per square inch). The chloride of magnesium is received from the potash mines at Hanover in tank cars in approximately a 35 per cent. solution. The quantity of solution added to the flue dust varies between 2 and 3 per cent., so that the briquettes contain about 1 per cent of MgCl2. To fresh dust as much as 10 per cent. of coke breeze may be added and bri¬quettes made that still have a crushing strength of from 25 to 30 kg. (377 to 426.6 lb. per square inch) after 36 hr., and 45 kg. (639.9 lb. per square inch) after six days. After having treated 140,000 tons of the material, the reports of the blast furnaces show that the briquettes improved the action of a furnace and produced less dust than did Minette ore. As much as 35 per cent. of briquettes is added to the furnace charge without bad effects on operations. The presence of chlorine did not produce any corrosion in the furnace, downtakes or other piping. The presence of a certain amount of chlorine in the dust reduces the amount of chloride of magnesium which it is necessary to add for briquetting.

FRANCIS B. SILSBE,* Washington, D. C. (written discussion?). ?This paper is an interesting example of the -solution by the methods of metallography of what seemed at first a purely chemical problem. The authors have shown: in detail, how the well-known corrosion of spark-plug terminals is due to the dropping out of the individual crystals of the metal as it becomes surrounded by an oxide film. This corrosion is usually quite slow but in special cases may become a serious factor in limiting the life of spark plugs. There still remains the problem for the metallurgist to produce a material that will be entirely free from, this trouble. One of the most startling results of the work is. the demonstration that it affords of the deleterious effect of a mechanical stress continuously applied to material that is at the same time subject to adverse chemical or thermal conditions. The particular style of spark plug shown in the illustration, and in which serious trouble was caused by this corrosion, has the side terminals fastened at both ends and the method of assem-bling is such that a considerable initial tension is applied to the wire. It is without doubt this superimposed tension that causes the inter-crystal-line network to line up, as it were, into a few continuous and deeply penetrating transverse fissures instead of forming a great number of shallow surface cracks. Human progress has a visible material phase, easily discernible, that is expressed in the standard of living. This material phase, however, is only the outward expression of a spiritual or mental phase that acts as a driving force in making humanity improve both its outlook and its mode of living. The instrument of progress is the human brain. Under the urge of spiritual drive, the brain acts as a focal point to utilize the forces of nature and put them to work for the benefit of mankind. Besides intelligence, which is an innate quality, the tools of the human brain are knowledge, experience, training, initiative, and skill. Given sufficient intelligence, the human brain can make an amazing amount of progress, provided it is supplied with an adequate spiritual and moral urge and a good technical background. It is the role of education to sup- ply such a background. The material phase of human progress proceeds on a series of parallel fronts, all of them interdependent to some extent (Fig. 7). The rise of the standard of living, dependent as it is upon the manufacture and mass distribution of goods, is based essentially upon the development and utilization of the material resources of a country or land area. THE preliminary study of electrochemical desul-furization performed by Ohtani and Gokcen1 left a number of points concerning the process to be investigated. Two of these were i) the determination of the effect of greater current and voltage on the desulfurizing Flower of acid slags (% CaO/% SiO2- 1) and ii) the possibility of the loss of silica in slag by the reactions 2C (in metal) + SiO2 (slag) = Si (in metal) + 2CO(g) and C + SiO2 (in slag) = SiO(g) + cO(g) proceeding to a point at which the composition of the slag was sufficiently altered toward the basic side so a1.s to noticeably affect the rate of de-sulfurization. The apparatus and the procedure used in the present investigation were the same as those used by Ohtani and Gokcen, except the control circuit was connected to 120 v dc instead of 24 v dc and thereby allowed greater freedom in choosing the values of both current and voltage. The graphite crucible containing the melt and serving as the cathode was 3-in. high, and was of 1 1/2-in. ID with a graphite bar of 3/8-in. diam and 8-in. length threaded into the bottom for electrical connection.
