This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a forthcoming publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World." (Information Circular, 1959.) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then brass, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. ESTIMATED United States crude-oil production during 1943 established a new annual peak of 1,500,000,000 barrels, a daily average of 4,118,000 barrels. This would be an increase of 315,000 barrels per day, or 8 per cent over 1942 and 7 per cent over 1941, the previous peak. During the first ten months of the year, production jumped from 3,782,000 barrels per day in January to 4,400,000 in October. Available data for the last two months of the year indicate a leveling off of this trend, with daily rates slightly above 4,400,000 barrels.

THE recently developed potash industry in southeastern New Mexico, though based on a relatively new discovery, marks the latest and perhaps culminating phase of the effort to obtain a domestic source of potash that began with the leaching of wood ashes more than 300 years ago. In the search for mineral potash in America, the Geological Survey has played a conspicuous part and has paved the way for much of the private activity that now bids fair to free the nation of foreign domina¬tion in supplying the nation's potash requirements. HISTORICAL REVIEW A pamphlet published by Thomas Stephen in 1758 pictures the industry in its early struggling condition.1 Just before the Civil War, a deposit of mineral potash had been found in Germany and its value as a fertilizer had been discovered. On this account and because the supply of wood ashes had decreased, the Ameri-can potash industry gradually lost its importance. During the next 50 years, with European potash available with little effort and with satisfactory substitutes on the market for the manufacture of soap, the interest of the American people in American potash declined. In 1910 this interest was suddenly revived by the abrogation of American potash contracts in Europe. Congress passed an act, approved by President Taft March 4, 1911, providing for "researches with a view to determining geological conditions favorable to the presence of deposits of potash salts." Appropriations were made to the Geological Survey and the Bureau of Soils to carry out the provisions of this act. The work of the Survey was directed toward the finding of commercial bodies of natural soluble potash salts; the Bureau of Soils was more concerned with the processes of extracting potash from industrial wastes and organic sources. Private agencies also became interested in the program. The Geological Survey has continued its search throughout the ensuing period of more than 20 years and has studied many types of deposits in many parts of the country.

The Kunigin-Marien-Hiitte is the only works in Germany where the Bessemer process is carried on by the direct method. The Besserner plant there, is arranged after the true English type, and the only resemblance to the Swedish mode of 'procedure is the dispensing with the use of spiegeleisen at the end of the "blow." In a new department of the establishment, started within three years, each of the converters is turned by means of a very neat and compact reversible engine, the steel shaft of which is an endless screw, which turns against the oblique cogs of a large wheel attached to the shaft of the vessel. An advantage which this arrangement possesses over the ordinary English hydraulic arrangement, is the fact that the endless screw suffices to turn the vessel, in either direction, any number of complete revolutions; while even the latest American improvements, so clearly explained to us by Mr. Holley at the opening session of this meeting, do not secure even one complete revolution without changing the angle of inclination of the hydraulic piston. In the endless screw arrangement, there being no limit to the working of the motor in either direction (no return-stroke necessary), the vessel can always, unless outside reasons demand the contrary, be turned around to any desired position by the shortest cut, whether backwards or forwards. Also, the diameter of the cogwheel attached to the vessel can be made sufficiently great to avoid all unevenness of motion. In the old department the motive-power still continues to be hydraulic. If reports be true, the new department produces spiegelized steel, for the manufacture of all-steel rails. But the old department is still, as from the beginning, devoted to the production by the direct method of steel for steel-headed rails. The most remarkable fact connected with this direct steel is the ease with which it welds to the iron 'of the rail-packets, although no borax or other fluxing agent is used to facilitate the welding. It is very rarely that an exception occurs, and an ingot or a charge is discarded by the rail-mill. IN his highly interesting paper on "Piping and Segregation in Steel Ingots,"1 Prof. Howe emphasizes the effect of successive phases of internal pressure in the ingot in the evolution of gas, and the consequent formation of blow-holes. From his statements in other places, it may be inferred that he does not here intend to ignore the other variable factor, temperature, but rather to discuss this one more particularly. At all events, it is my purpose not to engage in controversy with Prof. Howe, but rather to contribute, towards the complete elucidation of this important subject which we all desire, my own views and experience. If, in doing so, I specially emphasize other factors than pressure, I need not be understood as denying what I do not think it necessary to discuss fully. Nor, in presenting my own original conclusions, need I be understood as claiming to be the first who ever reached or announced them. Many things are asserted or suggested upon inconclusive evidence; and to confirm such tentative propositions may be as valuable a service as to overthrow them. In the following passage, Prof. Howe adduces analogies, based upon the behavior of charcoal and of water, respectively, which seem to me questionable "In general, the. solvent power falls as the pressure falls ; and in general it rises as the temperature falls. Thus, to heat a solid, for instance charcoal, may expel part of its dissolved gas ; and a tumbler of water drawn cold from the faucet gradually evolves gas, as it stands and warms up on the sideboard." (p. 238.) Charcoal is a solid body, which has the property not only of absorbing gases in large quantities, but also of expelling the thus absorbed gases upon heating. The regular, bottom-blown Bessemer converter of the present day is a modification of previous forms, and most of the latest proposed modifications of it are merely returns to former types which Ressemer discarded. That he tried almost every conceivable method of blowing iron, with tuyeres at almost every possible position or angle, is well known; and it is to be supposed that he was familiar with the advantages of each type, since he finally settled on that form which has not been improved upon hitherto, for the purposes for which converters will generally be used. Modifications have been tried along two lines: In the arrangement of tuyeres, and in the manner of carrying out the process with tuyeres still blowing vertically upward through the bath. While they have all failed in general competition with the regular modern type of vessel, some of them have found special fields in which they have held their own. The most notable example is in the steel-casting industry, and especially in that part of it concerned with the manufacture of castings which require very hot or very fluid metal, or supply a demand of constantly varying physical or chemical requirements. In this industry the small converters occupy a field between that of the crucible-process and that of the open-hearth process, arid have won a place for themselves in France, England, America, Russia and other countries, which they bid fair to retain until either a new method is discovered of producing cheaply very hot, fluid steel, or the open-hearth process is so improved that very hot steel may be made with it at lower cost of repairs to lining arid roof.

L. D. RICKETTS, New York, N. Y.-The advance which has been made in Smelting has been in the line of cheaper cost of handling, due to larger units and decrease in losses. At the International smelter, Mr. McGregor designed everything to handle the ore under cover. But we do find an unaccounted for loss of 0.7 per cent. of our copper, which is serious. Mr. Wallace has made a suggestion that I think metallurgists ought to know of and think about. He made it years ago-and that is that one of the chief losses is undoubtedly in the charging and discharging of the calcine cars. His idea is that possibly the dryers and heaters might be put immediately over the reverberatories So that they could discharge in conveyors. They could feed on both sides, and thereby the dust raised by discharging in the cars from the hoppers could be overcome. E. P. MATHEWSON, Anaconda, Mont.-I might Say a few words on the plants we have visited So far. I was particularly struck with the cleanliness of the plants, which is next to Godliness. I noticed also that the skull-cracker arrangement they have for handling their converter slag is very good. And they have paid considerable attention to ventilation, and are taking steps to take care of the health of the men. "Safety first" has been well looked after in all the plants we have visited so far. The steel structures are right up to date, and the buildings are of the most modern type, and everything is conveniently arranged. I think the designers of the plants in the Southwest are to be congratulated on what they have done.

Production of crude oil for 1940 in southwestern Pennsylvania was off nearly 70,000 bbl., largely as a result of the great number oi abandonments, together with the lack of extension of the Washington and Green County pools. Oil wells completed numbered 51, which is 26 more than last year, but the total initial production of 259 bbl. is only 18 bbl. greater than in 1939. There was an increase of 72 over last year for a total of 209f gas wells. However, 68 7 dry holes were drilled, which is 40 more than a year ago. Thus, 328f wells were drilled during the year, and rigs are erected or drilling is progressing on 59 t more. Shallow Development Oil.—Butler County led in number of oil wells completed, with a total of 27 for an initial production of only 69 bbl. Washington County, with 12 new oil wells, one of which made 40 bbl. from the Fifth sand in S. Franklin township, has 95 bbl., while in Allegheny County 9 wells gave an initial of 86 bbl. for the highest Per well average in the area. This initial was given a considerable boost by one 35-bbl and another 2;-bbl. well in West Deer township, where the Fourth sand produced at 1840 feet. Greene County had only one oil well completed during 1940, and Washington County had 12. The subnormal totals for these counties may be explained by the higher cost of completions and the declining price of crude. The first price change in crude during the year occurred on May 22, when a 25 cut was made. A second 25 cut was made July 12, and was followed by a 156 cut on .Aug. 28. This price held until Nov. 12, when there was a restoration of 156. On Dec. 17 a second 156 increase was put into effect, bringing the price to $I.So per barrel. Gas The large increase in the number of gas wells completed may be attributed to three factors; namely, the recently discovered production possibilities of moderately deep, hitherto little tested horizons, together with increased demand and price. The latter has been made possible by a recent decision of the court, which ruled restraining the public service Commision's prohibition of a raise in the minimum monthly charge to small consumers by one of the major gas companies. A portion of the revenue derived in this manner is being passed along to the producer in the form of higher prices in the field. This higher field rate will remain in effect until a new ruling is made, when it will be reduced in proportion to the reduction of the monthly minimum charge. In an effort to extend the chambers Dam Fifth sand oil pool southwest from Amwell township, Washington County, several wells have been drilled. One of these, in Morris township, washington County, had an initial of 3.2 million cu. ft. open flow from the Big Injun sand. This indicates an entirely new productive area for the latter horizon. Allegheny County had one spectacular well in South Fayette township-—at a depth of about 2500 ft. a 4-million-CU. ft.

JANUARY saw the completion of the 237-ft. Upper-Narrows hydraulic debris dam on the main Yuba River in northern California. This project which is the key unit in a series of four similar structures on the Bear, American, and Yuba Rivers, removes the last obstacle to the revival of California's vast hydraulic gold-mining industry. The Upper-Narrows dam is a single-arch type of structure, and embodies the latest developments in that type of construction. One of the principal innovations used is the series of air vents in the crown (that part over which the water spills) which serve to break the vacuum caused by the spilling water, thus reducing vibration to a minimum. Electric strain gages were also embedded in the concrete of the dam, and it is hoped that by careful study of these instruments true stresses can he determined.

DUPING the last two years, and especially during the last six months, a number of important articles upon the new methods for the desulphurization of galena have been published in the technical periodicals, particularly in the Engineering and Mining Journal and in Metallurgie. I proposed for these methods the type-name of "lime-roasting" of galena as a convenient metallurgical classification,' and this term has found some acceptance. The articles referred to have shown the great practical importance of these new processes, and the general recognition of their metallurgical and commercial value which has already been accorded to them. It is my present purpose to review broadly the changes developed by them in the metallurgy of lead, in which connection it is necessary to refer briefly to the previous state of the art. The elimination of the sulphur-content of galena has been always the most troublesome part of the smelting-process, being both costly in the operation and wasteful of silver and lead. Previous to the introduction of the Huntington-Heberlein process at Pertusola, Italy, it was effected by a variety of methods. In the treatment of non-argentiferous galena concentrate, the smelting was done by the roast-reduction method (roasting in reverberatory furnace and smelting in blast-furnace); the roast-reaction method, applied in reverberatory furnaces; and the roast-reaction method, applied in Scotch hearths 2 Precipitation-smelting, simple, had practically gone out of use, although its reactions enter into the modern blast-furnace practice, as do also those of the roast-reaction method.

The application of the law of supply and demand to the sale of crude oil is generally conceded, but the motives underlying the buyer's (refiner's) demands are not always obvious to the seller (producer). In some cases this obscurity has led to the conclusion that the refiner may be unnecessarily particular when he selects one crude and rejects another. This preference, however, is very largely the reflection of the refiner's product demands and the quality of the stocks obtainable from the selected crude. The purpose of this paper is to point out critical characteristics of the major classes of refined products and to show how crudes vary in their suitability for such products. With relatively few exceptions, available processing methods and addition agents make it theoretically possible to produce any type of refined product from any crude source, although it may not be economi-cally sound to do so. The widespread application of thermal cracking for converting higher boiling stocks into gasoline is well known. More recently cracking and refining in the presence of catalysts9 have been developed, as well as various processes for polymerizing lighter hydro-carbons into gasolines having desirable characteristics.6 For several years, selective solvents have been applied commercially to refining inferior quality kerosene, Diesel fuel and lubricating oil distillates .3 Improved methods for refining lubricating oils from crude residua,4 formerly suitable only for fuel, are now in use and a number of special solvent processes are available for dewaxing lubricating oils to low pour point.5 These improved refining methods have been developed not only to meet the demand for improved product quality but also to enable the refiner to obtain quality products from crude sources that would not yield such products by the older refining methods. In many cases, the utilization of these modern refining tools necessi-tates an appreciable expenditure for equipment as well as added manufac-turing costs, and their application therefore must be justified economically. Despite the availability of such tools, the added processing costs involved and yields obtainable may render their application entirely impractical. The purpose of the following research, as originally planned, was to investigate the influence of temperature upon the plate¬amalgamation process. In order to consider the amalgamation process intelligently, it was first necessary to learn the nature of an amalgam. In the performance of this task it was found necessary to consult a large volume of literature and to perform experimental investigations. The conceptions of the nature of amalgams thus obtained have so important a bearing on the amalgamation-process as a whole, as well as upon the possible influences of temperature, that it was advisable to include them in the treatment of the subject. The broader title is therefore used, even though some features of the amalgamation process have been treated very briefly and others entirely omitted, there being nothing new to present regarding them and their development not required for a clear presentation of the matter in hand. I. HISTORICAL INTRODUCTION. Gold was one of the earliest metals known to man. Occurring in the metallic state, it could be picked up in nuggets or washed, as gold dust, front the sand and gravel of streams. Interesting descriptions of the processes employed in early times for the recovery of gold may be found in Pliny's Natural History and in the treatise by Agricola on ores and minerals. But little progress in the treatment of the ores of gold was possible until efficient -crushing machines were devised. This want was supplied by the introduction, about the beginning of the sixteenth century, of the stamp mill to treat the ores of Saxony. Blanket strikes, or similar devices, were used to catch the

PHOSPHATE ROCK is a low- priced commodity. This fact has influenced the choice of mining and beneficiating methods to a greater degree, perhaps, than in most other low-grade mining operations. The fact that many yards of everburden and matrix must be stripped and mined per ton of salable "rock" produced and sold has necessitated he development of relatively simple btneficiating plants having high capacity and low capital and operating costs. The law of diminishing returns must always be reckoned with in phosphate mining and washing, and often recovery must be sacrificed in favor of costs in order to achieve the highest over-all economic efficiency. The phosphate-bearing formation, known as "matrix," is composed of (1) phosphate pebbles, which are somewhat rounded in shape and which vary in size from 1-in, to micron sizes, (2) rounded quartz grains usually smaller than 10 mesh, and (3) clay, of varying "stiffness," which is the binder of the matrix. The phosphate pebbles vary in hardness. Their color, which varies from white to black, is not a reliable indicator of the Bone Phosphate of Lime (B.P.L.) content of the

An investigation of the factors af-fec.ting the inter-zonal flow of fluids in the casing-wellbore annrc1rt.s of an oil or gas ivell is presented Laborntory tests revealed that failure of the caring-cement bond allows communi-cation of fluid at pressure differentials near 1.000 psi. Perforating with a 11011011: carrier gun does not shatter or crack the cement sufficiently to allow communication through these cracks and does not seriously affect the casing-cement bond failure pressure. The pressure to cause communication at the casing-cement bond can he increared to 3,000 psi by. limiting pipe deformation during cementing and subsequent operations. Communication can be prevented, however. up to pressures sufficient to cause the cement to fail or the casing to col-lapse, by attaching to the casing a seal ring of deformable ruhber molded between two steel flanges. When installed, one flange is attached rigidlv to the casing to serve as back-up for the gasket While tile other flange is movable. To date, these gasket seal rings have been field-tested in 27 Wells. Althotrgh communication has been noted in two wells, inter-zonal flow has been prevented in other wells in the same area by installing more seal rings between the communicaring zones. INTRODUCTION The inter-zonal flow of fluids behind casing cemented in oil wells during normal production or stimulation operations is a major operating problem. If it cccurs during production operations. it can seriously limit the pressure to which a reservoir may be depleted without harmful invasion of unwanted fluids. If it occurs during stimulation operations, it may preclude the possibility of stimulating the desired zone. This communication can be caused by failure of the bond between the casing and cement, failure of the bond between the cement and formation, or failure of the cement itself. This paper presents the results of an investigation of factors affecting com-munication at the casing-cement bond and methods which aid in preventing it. LABORATORY INVESTIGATIONS The laboratory tests performed in this study were divided into three phases. The first phase consisted of tests to determine if perforating would shatter and crack the cement sheath so severely that communication would occur through the cement itself. The second phase consisted of tests to determine more precisely the cause for the casing-cement bond failure. The third phase consisted of tests to evaluate the effectiveness of various de-formable seals attached to the casing in preventing communication. EFFECT OF PERFORATING, The effect of perforating was invest~gated in tests performed with apparatus shown on Fig. 1. Cement was poured into the annulur space hetween 5%-in. casing and 8%-in. casing and allowed to cure for 72 hours. The apparatus was then perforated with a hollow carrier gun containing eight duPont 26-A shaped charges. Bull plugs were placed over the perforations in the 8 5/8-in. casing and hydraulic pressure was applied inside the 5 1/2i-in. casing. The pressure to cause fluid communication past the cement sheath was observed and termed the "bond failure pressure". Several different cement compositions were included in these tests, the results of which are shown in Table 1. In Tests 1 through 4 of Table 1, bond failure occurred at- the inter- .

The winning of zinc and lead ores from the comparatively shallow deposits of the Joplin district presents few such problems for the mining engineer as are encountered in deep ore mining and in the handling of complex ores. However, for those who are interested in the origin and nature of ore deposits in general, there is much here to investigate, and upon studies in this direction will depend, in no small measure, the future of an industry that has produced during the year 1916, in southwest Missouri, lead and zinc ores to the value of $26,319,383; adding $46,022,164 to the metallic wealth of the nation. Including the adjacent mines in Ottawa County, Oklahoma, and Cherokee County, Kansas, which are really continuations of the Joplin district, the total value of ores produced reached the sum of $34,089,503, and that of the metals, $58,927,941.l The ores produced in the Joplin district are remarkable on account of their almost uniformly high metal content in both lead and zinc. Their superiority in this regard is unparalleled, and is doubtless due to certain geological conditions that are now possibly explicable, provided that the artesian circulation = ascension hypothesis of the origin of the ore deposits is proved beyond question to be the only tenable explanation of the facts. These, as well as other valuable zinc-ore deposits, are bound to be exhausted in time, for ordinary mining purposes, and it concerns the mining engineer that the conditions under which ores of this character were actually deposited in the form in which they occur, may, if possible, be ascertained, in order that he may learn where to look for similar deposits in other regions, or even how to reproduce artificially such condi-

William Clinton Brown, Brooklyn, N. Y.: The demand for an apparatus for cooling water for condensers, refrigeratingmachinery and air-compressors, as well as water-jacketed furnaces, has led manufacturers to put such an apparatus on the market, so that it is now possible to purchase a cooling-tower, properly designed and constructed, by simply stating the amount of water to be cooled and the temperatures of the hot and the cold water. The principle is similar to that described by Mr. Henrich, but wood is not used in the best apparatus. There are two great objections to wood: First, it cannot last long under the very trying conditions to which it is subjected; and second, it absorbs the organic matter with which water in constant use becomes impregnated, and the resulting odor is very disagreeable. A few days ago I saw a cooling-tower and condenser, built by the Henry R. Worthington Co., in operation at the Edison electric-lighting station in Brooklyn, N. Y., cooling the water for a 700 horse-power condenser. It consisted of a large stack of iron, about 15 feet in diameter by about 30 feet high. This stack was filled with tiling through which the water falls. A whirligig distributes the water evenly over the top, and a large fan, about 6 feet in diameter, driven by a 10 horse-power electric motor, blows air into the bottom, thus giving a positive circulation. The water, in running down the sides of the tiling, is met by the blast of air, and enough is evaporated to cool the rest. The vacuum-gauge on the condenser showed 26 inches; so the condenser was undoubtedly getting sufficient cool water.

Introduction THE winning of zinc and lead ores from the comparatively shallow deposits of the Joplin district, presents, few such problems for the mining engineer as are encountered in deep ore mining and in the handling of complex ores. However, for those who are interested in the origin and nature of ore deposits in general, there is much here to investigate, and upon studies in this direction will depend in no small measure the future of an industry that has produced during the year 1916, in southwest Missouri, lead and zinc ores to the value of $26,319,383; adding $46,022,164 to the metallic wealth of the nation. Including the adjacent mines in Ottawa County, Oklahoma, and Cherokee County, Kansas, which are, really continuations of the Joplin district, the total value of ores produced reached the sums of $34,089,503, and that of the metals, $58,927,941.1 The ores produced in the Joplin district are remarkable on account of their almost uniformly high" metal content in both lead and zinc. Their superiority in this regard is unparalleled, and is doubtless clue to certain geological conditions that are now possibly explicable, provided that the artesian circulation = ascension hypothesis of the origin of the ore deposits is proven beyond question to be the only tenable explanation of the facts. These, as well as other valuable zinc-ore deposits, are bound to he exhausted in time, for ordinary mining purposes, acid it concerns the mining engineer that the conditions under which ores of this character were actually deposited in the form in which they occur, may, if possible, be ascertained, in order that he may learn where to look for similar deposits in other regions, or even how to reproduce artificially such condi-

The effects of using surfactant solutions while diamond drilling in amygdaloidal basalt of the Upper Michigan copper mining district were investigated. Nonionic, anionic, and cationic surfactant solutions, all biodegradable, were tested with size AX surface-set bits mounted on a drill instrumented for continuous recording of thrust, rotational speed, and torque levels. Water flow and penetrations rates were also recorded. A drilling study was carried out, testing two rotational speed levels, two diamond bit grade levels, and four flushing agents (including water as a control). Comparison of all low-speed/high-thrust groups of tests shows that the non-ionic surfactant produced a 35% overall average increase in penetration rate over water, the anionic a 29% increase, and the cationic a 28% increase. These increases in, penetration rates resulted in a 22 to 26% reduction in cost over flushing with water alone. With the high-speed/low-thrust combination, the surfactants produced less benefits in penetration rate increases over water (14% increase for nonionic, 14% decrease for anionic, and 2% decrease for cationic type). Particle size analyses were run on drill cuttings produced by the three surfactant solutions and by water. All surfactant solutions showed a 20 to 50% increase in solids content over that of water alone. Since flushing rates were constant, these increases in solids content agree well with the penetration rate changes. The diamonds were recovered from each bit by matrix dissolution, and bit wear was measured in terms of total loss of weight. Flushing with surfactant solutions showed a savings in bit wear in most cases. The drill team noted also that surfactant flushing improved recovery of drill core by allowing easier removal of the core from the barrel.
