The mining industry appears to be slowly rebounding. But many individuals and company officials are still smarting from the beating they received during the recent recession. As a result, companies have taken the "lean and mean" approach. As pointed out at the Oct. 24-26, 1984 SME-AIME Fall Meeting in Denver, CO, companies are placing more emphasis on optimizing their operations through more efficient mining and processing technologies and equipment. Empathizing with the mining industry's woes was the meeting's welcoming luncheon speaker, John D. Withrow, Jr., executive vice president product development for Chrysler Corp. Withrow paralleled Chrysler's problems of a few years ago with the current problems facing the US mining industry. He said Chrysler's come-back centered around its engineering and technical personnel, who regained "their seat at the head table." "In short," Withrow said, "we had lost the competitive edge. By cutting costs and people and improving our products we got everybody to believe we could." The 2700 participants at the Fall Meeting attended technical sessions geared toward turning mining back into a productive and profitable industry. Sessions and symposia included papers on precious metals extraction, crushing and grinding innovations, geomechanics, environmental control, health and safety, and various commodities. This article briefly highlights some of the papers presented. To order preprints of these technical papers, see ME, December 1984, pages 1620 and 1621. Computers Gain Mining Acceptance High tech has reached mining. As evidenced by many papers, computers have become valuable tools in many applications. These include tailings ponds operation and waste management; truck dispatching; mine design, simulation, and scheduling; monitoring; and reclamation. Mine planning is generally labor intensive and requires a considerable amount of the planner's time. P. K. Chatterjee, X. Chung, and Y. Jianjy described a computer-generated interactive graphics approach to under-ground coal mine planning that lessens the manhours involved in producing plans. The computer program examined exploratory borehole information. This included coal seam thickness, tonnage, quality constraints, and the nature of their distribution. Layout designs were then initiated and a probabilistic simulation performed to determine production levels of different extraction strategies. The interactive graphics approach gives planners the ability to quickly evaluate several layout alternatives and select the best one. For surface coal mines, M. A. White, of Arch Minerals Corp., explained several computer programs that aided in his company's surface mine plans. Several drill hole database and modeling pack¬ages are available. But Arch tech¬nicians developed specific pro¬grams for model strip areas. They were used to form long-term pro¬jections for various area and semi¬area stripping operations. They also generated reports on yard¬age, tonnage, quality, and ratio in¬formation. The information is used in budgeting, to compare mine plans, and to analyze acqui¬sition candidates. While computer-based truck dispatching systems have been used in mining for some time, earlier systems were run on ex¬pensive mainframe or high per¬formance minicomputers. As such, computer-based truck dis¬patching systems have been too expensive for all but the largest mines. Recently, however, a microcomputer-based system, af¬fordable to smaller mine opera¬tors, has become technologically feasible. Y. C. Kim and W. E. Kolb re¬ported on a simulated microcom¬puter system that uses strategi¬cally placed signposts in the pit area to automatically detect truck movements. A microprocessor in the signpost sends information to the microcomputer. The computer determines the truck's assign¬ment and alerts the dispatcher. He radios the driver his assign¬ment. In addition to the technical pa¬pers, an introductory short course on microcomputers was offered at the meeting. L. M. Kass and J. P. Editor&apos;s note: Minerals concentration is a disparate area, one involving many disciplines. Flotation, flocculation, reagents, microbial processes, gravity and magnetic separation, and the areas of coal and oil shale - concentration is relevant to all of these. In his article, Nagaraj reviews the latest developments and findings in concentration that have ocurred during the past year. Flotation The Monograph Series "Development in Mineral Processing," (Elsevier, 1985) was devoted to "Flotation of Sulfide Minerals." This volume has 26 articles covering the aspects of flotation chemistry, process development, plant design and equipment, and modeling and process control. The numerous articles on sulfide flotation had one recurring theme - the role of electrochemical processes and redox potentials in flotation and depression. Significant advances have been made in this area. A differential desorption-reflotation process was developed for the beneficiation of calcitic phosphate pebble (Hsieh and Lehr, Industrial Engineering and Chemistry, 1985). The carbonate and phosphate minerals were first separated from silica using fatty acid and the modifiers diphosphonic acid and HF. The collector on phosphate was then desorbed using sulfuric acid, and calcite was selectively floated without additional collector. A two-stage conditioning - initially at pH 10, followed by that at pH < 4.5 - with sodium oleate was developed to improve the separation between apatite and dolomite (Moudgil and Chanchani, Minerals and Metallurgical Processing, MMP, 1985). Separation of Mussorie rock phosphate in India from gangue calcite, dolomite, silicates, pyrite, and carbonaceous impurities was achieved with a three-stage flotation only on -75 µm (-200 mesh) fraction (Vaman Rao et al., International Journal of Mineral Processing, IJMP, 1985). The separation of fine SiC whiskers from other products of coked rice hulls by immiscible liquid and froth flotation was achieved using M1BC, pine oil, and mineral spirits (Parekh and Goldberger, MMP, 1985). Flotation was more economical. The carrier flotation separation of hematite fines from quartz fines was effected using coarse hematite as a carrier and oleic acid and ferric chloride (Cristoveanu and Meech, CIM Bulletin, 1985). Potash recovery from brines by laboratory-pan solar evaporation and amine flotation was discussed by Foot and Juiatt (Salts and Brines &apos;85, Proceedings, 1985). Flotation in a 45-kg/h (99-lb per hour) unit recovered more than 95% of the potash in schoenite and sylvite concentrates containing 28% and 62% K2O, respectively. The effects of fresh concrete into cement and aggregate by a single-step flotation process in aqueous suspension was described (Naegle, Chemical Engineering Science, 1985). The physico-chemical principles for the selective separation of proteins from mixtures using flotation were discussed by Ostermaier and Dobias (Colloids & Surfactants, 1985). Selective flocculation of hematite from silica was studied by Bagster and Mcllvenny (IJMP, 1985). Selective flocculation was more favorable with more highly charged anionic polyacrylamides and with high molecular weight. The cationic and non-ionic polymers flocculated both minerals. In minerals mixtures, there appeared to be very little selectivity unless a combination of dispersant and electrolyte was used. The effect of dissolved minerals species, such as Cu, Fe, and Ni on flocculation of chalcopyrite, pentlandite, millerite, pyrrhotite, and covellite was studied by Acar and Somasundaran (SME-AIME, 1985). Reagents There were some major advances made in reagent development for the minerals processing industry. Cyanamid introduced several classes of collectors, one of which - the diaryl monothiophosphates as acid circuit col¬lectors of sulfides and oxidesulfide ores - was commercialized in 1985. The monothiophosphates are more stable and powerful collectors than the xanthates and dithiophosphates. Hydrolyzed dithiophosphate containing 80% monothio and 20% dithiophosphate was found to give optimum recovery of copper from crude cementation precipitate and separation of Cu and Ni sulfides from matte (Akimova et al., Obogashch, Tonkov, Rud, OTR, 1985). INTRODUCTION An innovative Ø.1-MGD (378.5-m3/day) biological and phyicochemical wastewater treatment system at Hancock, Massachusetts, USA, has been treating the domestic sewage generated from the four-season Jiminy Peak timeshare resort since 1985. The influent raw sewage is collected and equalized in an equalization tank, then biologically treated by two rotating biological contactors (RBC). A portion of the RBC effluent is discharged to a secondary sedimentation tank to simulate conventional waste treatment by a conventional RBC system. For parallel treatment the remaining portion of the RBC effluent is discharged to an innovative Sandfloat (SASF-8) clarifier to simulate a two-stage biological and physicochemical treatment by RBC-Sandfloat. Both secondary sedimentation effluent and Saandfloat effluent are later combined together and discharged to a tertiary sand filter and two UV disinfection&apos;units for final polishing. The operation and performance data of Jiminy Peak plant in the period of May 1985 to March 1988 was fully documented in the Lenox Institute technical report No. LIR/Ø3-88/292 (391 pages, March 1988). This report presents only background information and complete plant data in the period of April 1988 to January 1989. Dr. Lawrence K. Wang and Mr. James P. Van Dyke have been the Consulting Engineer and Director of Special Projects, respectively, for the Jiminy Peak Project since 1985. BACKGROUND INFORMATION Jimmy Peak, Inc., Hancock, Massachusetts, has designed and constructed a secondary wastewater treatment system consisting of preliminary/primary treatment facilities, two rotating biological contactors, a dissolved air flotation clarifier, a secondary sedimentation clarifier, a sand filter and two ultraviolet (UV) disinfection units. Total average wastewater flow is approximately Ø.1 ) (378.5 cubic meters per day). In accordance with the Consulting Engineer&apos;s preliminary design, the total wastewater stream is initially collected and equalized by an equalization tank, and then biologically treated by rotating biological contactors (RBC). Part of the RBC effluent is diverted to a Krofta Sandfloat (SASF-8) for physicochemical clarification in order to simulate an innovative RBC-Sandfloat two-stage waste treatment system. The remaining part of the RBC effluent is diverted to a sedimentation tank for secondary clarification in order to siumulate a conventional secondary RBC-sedimentation waste treatment system for the purpose of parallel comparison. Both Sandfloat effluent and sedimentation effluent are later combined together and discharged to the subsequent sand filter and UV disinfection unit for final polishing. Figure 1 shows the flow diagram of Jiminy Peak Plant. The Massachusetts Clean Waters Act (M.G.L.c.2l,s.26-53) was amended by Chapter 246 of the Acts of 1973 to authorize the Massachusetts Department of Environmental Quality Engineering (DEQE), Division of water Pollution Control, Boston, Massachusetts, to regulate discharges into all waters of the Commonwealth of Massachusetts, including groundwaters. The DEQE regulates discharges through the issuance of discharge permits which impose limitations on the amount of pollutants which may be discharged in the effluent, together with monitoring and reporting requirements and other conditions to insure adequate treatment of all liquid wastes prior to discharge. The DEQE reviewed the application submitted on behalf of Jiminy Peak, Inc. for a permit to discharge sanitary wastes from the Jiminy Peak secondary wastewater treatment system located off Brodie Mountain Road, Hancock, Massachusetts, and subsequently developed the conditions contained in the Groundwater Discharge Permit No. Ø-188. More specifically, Jiminy Peak, Inc. (i.e. the permittee) has been authorized to discharge into the ground from the Jimmy Peak secondary wastewater treatment facilities for which the Permit No. Ø-188 was issued, a treated effluent

The Schaffer linear kimberlite complex and Aultman kimberlite diatremes comprise a major part of the State Line kimberlite district of Colorado and Wyoming, which encompasses approximately 200 sq mi (500 km2). The district is located along the eastern flank of the northern Front Range and is underlain prin- cipally by Precambrian granites (approx. 1.4 b.y.) which have been intruded into an older (approx. 1.75 b.y.) metamorphic complex. The kimberlite occurrences are Devonian in age and are related to older Precambrian linear structures. The Schaffer kimberlite complex is a dike or fissure system with enlargements or blows developed at the intersections of cross faults; the two Aultman occurrences are diatremes. Kimberlite within the Schaffer complex is predominately grey to green phlogopite-calcite kimberlite breccia and tuffisitic breccia. Carbonate is abundant in some phases. Inclusions of host granite are common and locally abundant. Upper mantle peridotite, pyroxenite, and eclogite and lower crustal granulite xenoliths are present at many localities. Four phases of tuffisitic kimberlite breccia occur in the Aultman diatremes. These breccias are characterized by high carbonate and serpentine contents. Xenoliths of upper crustal granite, lower crustal granulite, and upper mantle assemblages are abundant locally. Lower Paleozoic sedimentary rock xenoliths are also abundant in the Aultman diatremes but are absent in kimberlite of the Schaffer complex. From 1979 through September 1982, Cominco American, Inc., conducted geologic mapping, petrographic studies, geophysical surveys, geochemical surveys, and auger drilling in the Schaffer-Aultman project area as part of an extensive evaluation program of kimberlite occurrences. Forty bulk samples (approx. 8,000 metric tons) were excavated from the occurrences and then were processed for diamonds at Cominco American&apos;s heavy media separation and diamond recovery test plant at Fort Collins, Colorado. Indicated grades from the Schaffer and Aultman kimberlites range from approximately 0.5-1.0 carat per 100 metric tons and as such, the occurrences do not appear to approach economic viability at this time.

The Parallel Thimble Shoal Tunnel project involves the construction of a bored tunnel under Thimble Shoal Channel in Chesapeake Bay (VA), between two artificial islands and parallel to the existing tube tunnel, built in the sixties. It will be the first transportation tunnel constructed in the Mid-Atlantic region using a Tunnel Boring Machine (TBM), a 44-foot-diameter Earth Pressure Balance (EPB) named "Chessie," manufactured by Herrenknecht, and which was assembled at the CBBT's southernmost island, with extremely limited room, live adjacent traffic, and difficult access. "Chessie" was successfully launched in February 2023 and this paper describes this complex and challenging process.

In recent years, metal-producing companies have increased their investment in automation and technological innovation, embracing new opportunities to enable transformational change. Transformation to a digital plant can fundamentally revolutionize how industrial complexes operate. The abundant and growing quantity of real-time data and events collected in the grinding and flotation circuits in a mineral processing plant can be used to solve operational issues and optimize plant performance. A grade recovery model is used to identify the best operating conditions in real time. The strategy for increasing the value of instrumentation in current plants is reviewed. An optimal Gaudin size distribution model provides augmented information from traditional sensors to find the optimal grind cut size to reduce metal losses in the flotation circuits. Sensors in flotation circuits enable an estimate of the recovery and determination of the optimal froth depth and aeration using an air hold up flotation model. A strategy of classifying data for on-line generation of insights to using operational intelligence tools is described. The implementation of a recovery/grind strategy with industrial examples in non-ferrous mineral processing is presented.

In this study, FLAC3D modeling was conducted for ground-structure stability assessment for a pilot tunnel passing under a large shaft excavated in the vicinity of existing structures at Karangahape Station for the City Rail Link Project in Auckland, New Zealand. The analysis involved generation of the geometries and construction sequences in Rhinoceros®, modeling the existing ground condition, calibration of the simulated in situ conditions with the observed behavior of the ground, and excavation of the shaft and the pilot tunnel. A comprehensive interpretation of the results was then performed accompanied by comparison of the predicted behavior with the observed response of the ground during construction.

The European climate and energy framework for 2030 is highlighting the reduction of man-made CO2 by increasing the use of renewable energy to mitigate climate change. In this spirit, Germany has decided to erase the coal use as an energy source by 2038 completely. Inevitably, this strategy promises a feasible, responsible, and sustainable post-mining management, because 200 years of coal mining have created numerous challenges necessary to tend to once the mining ends. Thus, the Research Institute for Post- Mining (FZN) at the TH Georg Agricola University in Bochum, Germany, has developed a holistic approach to meet these postmining challenges including further expertise present at our university. Here, the four strategic research pillars are (1) technical geoecology and hydrogeology to avoid and mitigate risks underground, (2) geomonitoring to evaluate and protect the surface, (3) industrial heritage preservation and engineering to secure and reuse brownfields such as mine sites, and (4) economic transformation planning of mining regions to enable a prosper future for generations to come. In all efforts, we aim to achieve the fundamental goals of the UN to deal with the resources of our planet responsibly and sustainably. Furthermore, we are synergizing increasingly with national and international networks in the interest of social, economic, and environmental stakeholders.

The West Gates Deicing Industrial Waste Pond Expansion project at Denver International Airport seeks to expand utilities to accommodate additional terminal gates. The project includes six tunnel crossings beneath taxiways and runways with lengths ranging from 239 to 2,025 linear feet. Excavation methods include shielded tunnel boring machines and steerable auger boring. Designed initial support includes liner plate, steel ribs and lagging, steel casing, and Fiberglass Reinforced Pipe and ranges in size from 24" to 132". This paper will discuss challenges associated with the overall layout and design of the project, including contingencies to protect critical infrastructure. In addition, a construction update is provided.

In response to the mandates in the MINER Act of 2006, the National Institute for Occupational Safety and Health (NIOSH) conducted refuge alternatives research that included characterizing the utility, practicality and survivability of refuge chambers and outby safe havens. NIOSH also prepared and delivered a report to Congress in late December 2007 that summarized the findings of the re-search, included recommendations concerning the design and performance specifications for refuge alternatives, and focused on specific information that could inform the regulatory process on refuge alternatives. This paper highlights NIOSH?s research and recommendations concerning refuge alternatives, survivability evaluations of refuge chambers and presents a brief review of the current deployment of refuge chambers in underground coal mines in the U.S. The research has lead to the conclusion that refuge alternatives have the potential for saving the lives of mine workers if they are part of a comprehensive escape and rescue plan and if appropriate training is provided.

This paper describes the Darwin Silver Recovery project, located 66 km (40 miles) outside of Lone Pine, near Darwin, Inyo County, California. A lead-zinc mine and a flotation concentrator were operated there from 1945 to 1957. By the time the mine was shut down, 1.53 Tg (1.69 million short tons) of tailings had been stored in ponds. An average silver assay of 47 mg/kg (1.38 troy oz/st) of tailings stimulated interest for commercial silver recovery. A heap leach process was developed in 1981 at the Tucson Research Center of Anaconda Minerals Company, a division of Atlantic Richfield Company. Agglomeration techniques were used on the ore since the fine grind did not allow direct heap leaching. Lime and cement were required as binders, Early laboratory tests showed that recoveries equal to those from an agitated leach could be achieved at lower capital and operating costs. Laboratory tests determined cyanide requirements, lime and cement usages, and percolation or leach rates, as well as confirming that a zinc precipitation step could recover the silver from the leach solution.

[The two types of sulfide deposits in the Bathhurst Newcastle area are; (a) epignetic fissure deposits, and (b) massive sulfide deposits. Geological evidence has been variously interpreted to suggest a syngenetic origin, a source bed&apos; origin, or a magmatic hydrothermal origin for the massive sulfide deposits. Sulfides disseminated through the black shales and argillites of the host rocks are enriched in S32 (mean value 22.34, S34. = 5.8 per mil) relative to the meteoritic standard of 22.21, and have a broad spread in range of values. S32/S34 ratios of sulfide minerals from the deposits occur in two distinct groups. The massive sulfide deposits exhibit ratios between 21.88 to 22.05, while the fissure deposits exhibit ratios between 22.18 and 22.21. These results suggest two separate sources for the sulfur, each, however, resulting in magmatic hydrthermal deposition because of the narrow spread of ratios in each group. Granite intrusive into the host rocks of the sulfide deposits have a mean K/A age of 386 ± 10 M.Y. Lead minerals in the sulfide deposits have a mean nodel lead age of 370±20 M. Y. Thus the lead minerals and the granite bodies were emplaced during the same major orogenic event. Sulfide minerals from magmatic hydrothermal deposit have a very narrow range of S32/S34 values, as do those of the Bathurst area. It seems reasonable, therefore, that well homogenized magmatic hydrothermal solutions are the most logical source of the sulfide deposits. Furthermore, the homogeneity of the lead isotopic abundance data gives strong independent evidence that the ores are of a magmatic hydrothermal origin.]

Perlite is a hydrated acid volcanic glass that has been derived from the alteration of obsidians through incorporation of water into the silica structure. It is distinguished from other members of the water-bearing natural glass family by total water content, characteristic fracture and luster. The distribution of major occurrences worldwide is associated with silicic Tertiary through early-mid Quaternary volcanics related to plate movement. The No Agua dome and flow complex is one of the most highly studied perlite occurrences in the world. It clearly exhibits lithologic and textural zonations that reflect simple cooling history. Similar features are commonly observed within other perlitized, extrusive glass selvages. This paper briefly discusses current thought regarding geologic occurrence, the hydration process and the modes of origin with special emphasis on No Agua.

I truly free enterprise system requires free and unrestricted competition among a diversity of suppliers, in order to function properly. The natural attrition of the marketplace tends on the one hand to narrow the competitive field ... but the flow of new competitors entering the arena provides a "diluting" effect, and a "balanced" market place. Without the ready flow of new business entrants, the market becomes increasingly concentrated in the hands of fewer and. fewer firms. Competition among suppliers is diminished and the "free" marketplace suffers accordingly. A number of organizations, both governmental and private, have recently expressed grave con¬cern over the competitive future of the Western coal market. While most have noted that there is currently adequate competition within the Western market, some have cited the growing con¬centration of coal ownership ... particularly federal lease ownership ... in the hands of a relatively few firms. They suggest that unless this apparent trend is reversed or at least stemmed, the number of new firms entering the federally-dominated West may become reduced to the point where competition will suffer.

Three different refractory carbonaceous gold ores from the Carlin operation in northeastern Nevada were investigated to characterize the effect of passivation treatments on the nature of the carbonaceous material. The carbonaceous material was chemically isolated from the ores and passivated residues, and examined by FTIR spectroscopy, elemental analysis, and gold adsorption capacity. The main component of the carbonaceous material in these ores was found to be a naturally occurring activated carbon-type compound. Hydro-carbons were detected on rare occasions, but no evidence was seen for humic acids. Ore samples were passivated by autoclaving, or by treatment with sodium hypochlorite or gaseous Chlorine. In some of the passivation tests, a new peak was observed in the IR spectra of the isolated carbonaceous material, that was due to carbonyl functionalities. However, all of the passivation treatments tested decreased preg robbing significantly. This suggested that the appearance of the carbonyl peak was due to the severity of the conditions during passivation, rather than the method used.

In the United States, about one-quarter of the fuel oil and natural gas consumption is associated with power production in utility and industrial boilers and process heat needs in industrial furnaces. Coal has been an attractive candidate for replacement of these premium fuels because of its low cost, but there are penalties associated with the solid fuel form. In many cases pulverized coal is unacceptable as a premium fuel replacement because of the extensive cost of retrofitting an existing boiler designed to burn oil or gas. In the cases of synthetic fuels from coal, research and development still has a long way to go and the costs of research and development are very high. Another option which appears very attractive is the use of solid coal in a liquid fuel form, coal slurry fuels. Occidental Research Corporation (ORC) has been developing coal slurry fuels in conjunction with Island Creek Coal (ICC,) Occidental Petroleum&apos;s wholly-owned subsidiary. Both Coal-Oil Mixtures and Coal -Water Mixtures are under development. ICC is a large eastern coal producer, engaged in the production and marketing of bituminous coal, both utility steam and high quality/low volatile metallurgical coals. A sister division, Sheridan Enterprises is engaged in the development of western coals.

Disseminated epithermal gold metallization occurs within a breccia unit interpreted to be a submarine debris flow. Cold is associated with oxidized pyrite, fluorite, and jasperoidal silica. A minimum of 9 million tons of open-pittable mining reserves will be cyanide heap leached as run-of-mine ore at a rate of 1.0 million tons per year. Careful evaluation of the combined results of successive sampling projects has established the pit plan, mineable reserves, and process metallurgy of the operation. The sampling procedure utilized for a given test depended upon geological interpretation as well as the procedures, successes, and failures of previous tests. This paper summarizes the sampling and testing procedures of the development effort in light of the project goals and attendant problems in achieving them.

Research methods to develop an economic model for the determination of regional mineral advantage are discussed. An industrial complex conceptual framework is used to study potential mineral resource outputs of Kansas. A procedure for making a comparative cost analysis of potential outputs for a Kansas-based industrial complex is outlined and illustrated. Methods for estimating aggregate demand and for developing an input-output matrix for a hypothetical limestone complex are explained. The input-output matrix is expressed in physical units. A computer algorithm for converting physical production data and input cost data into total cost per unit of output information is briefly explained and flowcharted. Limitations and usefulness of this procedure in determining regional advantages are surveyed.

[Many factors impact the selection of one mining method over another for deep seated, thick seam coat deposits. Generally if an operating mine is recovering coal at high volumes from thick seams then a truck/shovel fleet is required for coal loading. The next consideration is how to remove the associated burden. If an operation has relatively small amounts of burden associated with the coal then a truck/shovel fleet may be employed for burden removal simply to standardized the entire mine equipment concept. On the other hand large amounts of burden associated with the coal can justify employment of draglines for burden removal. Specific economic, productive, and physical factors contribute to the final decision.]

Mineral property appraisers engaged in eminent domain actions on properties for which mining is the highest and best use must be fully competent in all phases of mineral resource estimation, mine project development, and mine operations (or retain the requisite competent assistance), as well as educated in eminent domain appraisal (USPAP Competency Rule). Failure to ensure such triggers the issue of appraisal competence and demonstrates a flagrant disregard of the myriad code(s) and guidelines to which the appraiser is subject. The cavalier assertion of some vague, undefined “latitude” in the valuation process does not exonerate the appraiser from a disregard of the USPAP Competency Rule. Lack of independence (i.e., “advocacy”) in mineral property appraisal is the usual result of a weak background in mining and/or appraisal theory. While it is readily apparent to those able to recognize it in reports and testimony, judges and juries cannot be expected to detect or recognize purposefully misleading (or even fraudulent) valuation concepts or testimony. Purposeful deception by the appraiser can lead to specious over-compensation of the property owner (thus victimizing the taxpayer); or, a failure to provide appropriate and just compensation to the property owner – yet, the purpose of an eminent domain proceeding is to leave the property owner no richer or poorer as a result of the taking. This paper highlights some of the deceptive practices encountered in litigation settings and raises issues of competency, professional ethics, and the effectiveness of the inherent enforcement capabilities within those institutions awarding professional certifications. INTRODUCTION The practice of eminent domain mineral property appraisal requires (particularly with respect to undeveloped mineral properties) that the appraiser possess the requisite level of competence in all phases of mineral resource estimation, mine project evaluation, mine development, and mine operation (through closure). To the extent the appraiser lacks such competence, it is incumbent on the appraiser not only to divulge this lack of expertise but also to seek competent assistance in the performance of the appraisal. This competence or expertise can only be obtained through a combination of appropriate and relevant technical education and direct mining industry experience. There exist a number of professional certification and/or credentialing authorities that speak to such competency. In a similar manner, eminent domain mineral property appraisal (as the term implies) also requires that the appraiser possess the requisite level of competence in the practice of eminent domain appraisal. This competence or expertise can only be obtained through appropriate and relevant education, direct knowledge of appraisal theory, particularly as it relates to the concept of eminent domain, and licensure.
