INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation. An autobiography, the story of a Hoosier boy who fought his way to manhood and power through early misfortune and poverty, from street urchin and newsboy, to editor and author; from lumberjack and dock walloper to statesman and Governor of Michigan. The reader has the measure of the man in the first chapter, a dramatic recital of how the fighting boy editor cleaned up a lawless mining camp of 40 years ago. The thread of the narrative is the author's life-long devotion to outdoor living, ex-ploration and travel. Residing in Sault de Sainte Marie, Mich., in the heart of the Lake Superior country, he took his delight and, incidentally, found his fortune in prospecting the north woods for iron ore; eventually, extending his travels to the continents and many of the islands of the world, he discovered what, he believes-to be a great iron range in Madagascar. In this book there is plenty of anecdote, a great deal of wholesome social and po¬litical philosophy and some interesting sidelights on the characters of some of the author's prominent contemporaries in the political life of Michigan. The style is direct and animated, flavored and illuminated with the vernacular of Hoosierdom and the woods country of the North. The author levies on the vocabulary of the sciences and the classics for many a noun and adjective and, with Rooseveltian license, now and then coins a word. The design of deep foundations supporting heavy buildings, bridges, transmission lines, and highway structures, is governed by lateral loads in many cases. However, due to the use of empirical or semiempirical approaches to develop the soil force-displacement relationships (i.e., p-y curves), a wide range of recommendations are presented in the literature. Recent efforts by the author and co-workers enabled simultaneous direct measurements of soil-pile interaction pressure and lateral movement along the pile length, resulting in p-y curves based on direct measurement. Advanced sensors including sheet pressure sensors and shape acceleration arrays were used in these experiments. The experiments were conducted at the Soil-Structure Interaction (SSI) facility funded by the Major Research Instrumentation Program at the National Science Foundation. This paper focuses on the SSI of single laterally loaded piles. The test pile was 101.6 mm in diameter and 1.42 m long, which were installed in well-graded loose sand. This paper provides a summary of the installation and testing procedures, soil properties, pile instrumentation, measured lateral load-displacement response, strain profile along the pile length, lateral movement along the pile length and the pressures measured at the soil-pile interface. Furthermore, the paper presents measured p-y curves compared to estimated p-y curves using empirical methods available in the literature.

The following is a case study of how LuckStone Corporation improved their blast monitoring and documentation program. A number of resources already at their disposal have been utilized to improve the body of data collected from each blast. The tools being used include GPS, aerial photos, and a user-friendly push button format excel spreadsheet. The data collected include product by product records of materials used, distances to all concerned neighbors, seismograph data, etc: The spreadsheet has been designed to perform an ongoing analysis of blasting trends. The program has been carried out at a corporate level and is in use by blasters at each location. This paper addresses the advantages and drawbacks of this program. It also addresses the ways in which the various tools were integrated, Discussed as well is the need for simplicity when bringing “new” technology to the field and the steps taken in familiarizing the end user to changes.

The long-term production schedule of open pit mines that maximises the net present value (NPV) of a given project relies on the proper design of phases (pushbacks) within the ultimate pit limits. There is not a phase design algorithm applied in the mining industry today that gives yearly production schedules that are optimum.The majority of phase design algorithms currently in use by the mining industry aims at grouping the blocks that fall within the ultimate pit limits into phases such that the average value of the blocks within each phase decrease as the size of the phases increase. Current phase design methods are typically based on a pit limit optimisation algorithm, originally introduced by Lerchs and Grossmann (LG) in 1965. To obtain multiple pit shells to be used for the phase design, the LG pit limit algorithm successively applied to economic block models by changing the price of the commodity or some other factor that properly parameterises the size of the pit. These modified economic block models are developed by predetermining the destination for each block in the model based on a breakeven analysis and highest economic outcome between alternative destinations. Phase designs determined by these existing algorithms may be suboptimal if a given project utilises multiple processing facilities for metal recovery and particularly if these facilities have restrictions (constraints) that require blending of attributes in the feed. To overcome these problems in obtaining phases that optimise overall production schedules, a new algorithm is developed at the Colorado School of Mines. The algorithm determines the phases of an open pit mine by taking into account multiple process options for the blocks and period by period blending requirements. This algorithm has been implemented within a software program (the software) and is being prototyped successfully in the design of improved pushbacks at a copper mine in South America and on a gold mine in Nevada. This presentation will demonstrate the shortcomings of the traditional phase design methodologies based on comparison of results coming from the new approach versus the traditional.

During exothermic gas-solid reactions, heat generation makes temperature rise and modifies the rate of the various mass transfer processes, namely the chemical reaction itself, the pore diffusion and the external transfer. We have investigated this thermal effect during the oxidation of zinc sulfide porous pellets in a thermo balance furnace, between 550 and 900°C-and under O2-N2 atmosphere. The results have been' analyzed by using, firstly, the law of additive reaction times derived from the isothermal Grainy Pellet Model, and, secondly, a new numerical model taking into account non-isothermal conditions. Both the models can satisfactorily simulate conversion versus time, but the numerical model also depicts the temperature evolution within the pellet. Finally it is shown that owing to the heat generation the zinc sulfide oxidation takes place under diffusion control (3/4 internal, 114 external) in all the cases studied. During the course of reaction, the. pellet undergoes strong temperature variations, with thermal gradients confined to a shell oxide layer.

A conviction is growing that depressions and other adverse conditions are not entirely unavoidable if a knowledge of past achievements and shortcomings is intelligently, applied in shaping the course of industry. Mineral producers have available a source of such knowledge concerning; their industry in the statistical records of the United States Bureau of Mines, and by scanning, this increasingly exact history can obtain information on which to found a more stable future. This paper contains a brief history, covering more than 50 years, of the activities of the nonmetallic mineral industries as a group, followed by short histories of each of the more important commodities in which are noted the circumstances that lave influenced their development.

The potash mine and refinery of AMAX Chemical Corporation is located 26 miles east of Carlsbad on the north end of the potash producing areas. This property was developed between 1949-1952 and production of muriate began in August 1952. Two shafts, located 400 feet apart, were sunk to the ore zone 900 feet below the surface. A 15-foot diameter ore hoisting shaft equipped with a 1000-ton ore pocket, crusher and automatic skip loading equipment plus a 20-foot diameter service shaft with a curtain wall for exhausting air were provided. Sylvinite production to date has been from the first ore zone, stratigraphically, the lowest of ten identified mineralized zones in the salt section. This first ore zone has been the top producer of Muriate of Potash over the years. In our area we do have some very marginal mineralization in the third ore zone some 35 feet above the first. We have not mined from this seam as yet but we are investigating the economics very closely with access slopes and an experimental mining panel. Our ore seam is generally flat lying but does have local gentle rolling with grades from 2% to 5%. The mine was designed and developed from the beginning with conventional mining practices and rail haulage from the mining section to the ore pocket. As mining progressed in the early years, production increased from less than one million tons annually to a maximum of 3,935,000 tons in 1964. Efficiency also kept pace with the increasing production and continually improved until the efficiency of the production crews reached an average of 100.3 tons per manshift in 1964.

Hydraulic coal mining is being successfully practiced in China, U.S.S.R., Japan and Canada and in each country, excepting Japan where suitable sites are not available, the system is being expanded to either existing conventional mines or new mines. Productivity levels and economics at these mines are in all cases better than the productivities achieved in conventional mines in the same general localities. In the U.S.S.R. face productivities approaching 50 tons per man shift have been reported while in Canada the latest statistics show average face area productivity levels are in the region of 200 tons per man shift production monitor. In the United States hydraulic mining has not been actively pursued to the same degree and consequently there are no full scale hydraulic coal mines in operation or construction. Because many of the coal measures in the Western U.S.A. are generally somewhat similar to those being successfully hydraulic mined in Western Canada and parts of Siberia it is realistic to believe that successful hydraulic mines can be designed and developed in the Western U.S.A. Particularly if the vast technological base that already exists is used to improve on other people's ideas, systems, methods and equipment.

The chloridizing mill of the Standard Reduction Co. is located about 75 miles south of Salt Lake City on the Tintic branch of the Denver & Rio Grande Western R. R. and 12 miles from the Tintic Standard mine. The daily capacity is 200 toss of a siliceous, low-grade, silver-lead ore from this property. It has operated continuously since it was started in January, 1921. The process consists essentially of a chloridizing roast followed by a percolating leach with a nearly saturated solution of common salt, acidified with sulfuric acid, the precipitation of silver on sponge copper and of copper and lead on tin-plate cuttings. The precipitates are shipped to a smelter. Some of the general ideas involved are said to have been used by Augustin in England, in 1840. A number of textbooks treat of the subject, especially the chloridizing roast followed by a leach with sodium hyposulfite or amalgamation. The process was revived in this district by Theo. P. Holt, N. C. Christensen, the Bureau of Mines, and others. The Bureau of Mines developed equations to determine the relationship of yields and products obtained from BM-AGA carbonization in 13-and l8-inch-diameter retorts. The developed equations indicate that results of carbonization in l8-inch-diameter retorts can be predicted from results obtained with l3-inch-diameter retorts.

A reciclagem de resíduos eletroeletrônicos (REEs) é importante tanto no aspecto ambiental quanto econômico, uma vez que através do reaproveitamento do REE há diminuição da quantidade de resíduos a ser destinados, além disso, contribui para a sustentabilidade do setor minero metalúrgico, pois é possível a recuperação dos metais provenientes de REEs. Presentes na maioria dos equipamentos eletroeletrônicos, as Placas de Circuito Impresso (PCIs) são compostas por materiais cerâmicos, metálicos e poliméricos. Além disso, a heterogeneidade do material influi diretamente no tipo de processamento/tratamento a ser utilizado, desta forma a caracterização prévia do resíduo é uma etapa fundamental para determinação da rota de processamento a ser utilizada. Assim, no presente estudo é apresentado o processo de caracterização de PCIs proveniente de computadores obsoletos objetivando a determinação e quantificação dos metais presentes, de forma a estudar a influência dos mesmos em processos de biolixiviação futuros. A rota de processamento físico incluiu inicialmente processo manual utilizando guilhotina e, posteriormente, moinho de martelos com grelhas de aberturas de 6 mm e 2 mm. A caracterização foi realizada através de ensaios de perda ao fogo, lixiviação ácida e MEV/EDS e a concentração dos metais foi determinada por ICP-OES. Os resultados mostraram que 50% do material particulado tem granulometria maior que 0,25 mm; as PCIs estudadas possuem 35,6% de metais, 27,2% de polímeros e 37,2% de cerâmicos. Dos metais presentes nas placas o mais representativo foi o cobre com 21,4% em massa enquanto que metais como Fe e Al apresentaram 1,1% e 1,9% em massa.

IN the investigation of metallurgical transformations and the relationships between microstructure and properties of metals, it frequently is desirable to obtain a measurement of the relative amounts of the various phases present and of the mean size of particles into which each phase is dispersed. The relative amounts of the phases can be measured by the classical methods of area, lineal, and point analysis,1-5 in accordance with the principle that the volume fraction of a phase, the fraction of a polished cross section occupied by the phase, the fraction of a random line occupied by the phase, and the fraction of randomly arrayed points occupied by the phase are all equal. The validity of this relationship depends only on the attainment of a truly random sample of area, length, or points, and not on the size, shape, or distribution of the particles constituting the phase. Smith and Guttman8 have derived a relationship between the interface area per unit volume S, and the measurable quantities L., the interface length per unit area on a cross section, and NL, the number of interfaces per unit length intersected by a random line. Their equation, Sv = — L8 = 2NL is also valid regardless of the distribution of particle sizes and shapes. In contrast to the situation concerning measurement of relative fractions of phases and of interface area, the measurement of particle sizes in opaque samples has not been subjected to a complete analysis. It has been common to measure some lineal or area dimension of particles on a polished cross section and to use the mean value as a qualitative measure of particle size. In the present paper, quantitative relationships are established among the various mean dimensions on a polished cross section and the actual dimensions of the particles present. Particles of Uniform Size Spheres: If a metal sample contains particles of a phase a dispersed in the form of spheres of uniform size, a polished cross section through the sample will reveal circular areas of phase a with radii from 0 to ?, the radius of the spheres. Consider a cube of unit dimensions to be cut from the sample. If a cross section parallel to one of the cube faces is examined, the average number of particles per unit area (N,) equals the number of particles per unit volume (Nv) times the probability p1 that the plane would intersect a single sphere positioned at random within the unit cube. Since, of the various possible positions for the cross-sectional plane over the unit length from top to bottom of the cube, only those positions existing over the length 2r would lead to the plane intersecting the sphere, the probability of intersecting a single sphere is just 2r. Since possible positions of the line occupy unit area, and possible positions for which it will pass through the sphere occupy an area of pr2, the probability of the line hitting a randomly placed single sphere is pr2. If the plates are randomly oriented, as in a sufficiently large sample of a fine grained polycrystalline material, area and lineal analysis may be carried out with parallel cross-sectional planes and lineal traverses. If the plates are not randomly oriented, it is necessary to randomize the orientation of the cross-sectional planes and traverse directions. Let a unit cube be cut from the sample, and a cross-section plane be passed through the cube parallel to one of the cube faces. The number of plates cut by the cross-sectional plane per unit area is equal to the number of plates per unit volume times the probability of a plate intersecting a single randomly positioned and randomly oriented plate in the cube. If J is the component of the plate diameter in the direction normal to the cross-sectional planes, the probability of a plane cutting a single randomly oriented plate is equal to J, the mean value of J for all possible orientations of the plate. Since the term "abandoned hazardous sites" was first coined in the 1978 environmental report of the Council of Environmental Specialists, a number of different types of technology has been developed in the Federal Republic of Germany for the remediation of contaminated soils /l/. At former sites of the mining industry, such as metallurgical and coking plants whose soil has been contaminated by organic and inorganic pollutants over decades of industrial activity, there is an exceeding necessity for soil remediation. Also, many former locations of metal processing works, battery factories or scrap yards have been contaminated in particular by heavy metals. Wet mechanical soil decontamination has proven successful over the past 10-15 years in the purification of these soils The process goal is the enrichment of the pollutants in certain plant products and the separation of a pollutant concentrate from the decontaminated soil. Table 1 lists the steps of the highly advanced wet mechanical soil decontamination process to achieve this process goal. Table 1 lists both the name of each process step and its goal in terms of a direct separation of the pollutant or the preparation of the soil for subsequent separation steps. For the separation of heavy metals, density sorting and separation techniques utilising flotation were specifically used. The use of chemical auxiliaries such as acids and lye is limited to special cases because these in themselves produce additional environmental impact and the economical effficiency of these techniques compared to conventional methods is lowered by supplementary process steps for water purification. The subject of this presentation is to consider how soil decontamination processes can be effectively improved through a description of the material properties of soils contaminated by heavy metals, and through carrying out basic investigations about the adsorption of heavy metals. Soils of different origins, especially those from former mining and metallurgical sites, were used for the experiments.

To determine the availability of manganese for metallurgical purposes from selected world resources, the Bureau of Mines evaluated the potential production of contained manganese in concentrates based on the demonstrated resources of 23 foreign and 8 domestic mines and deposits in 9 market economy countries. All but 2 of the 23 foreign deposits are operating mines; none of the domestic deposits are in operation. The demonstrated resources of the mines and deposits used in this study represent an in situ ore resource of approximately 2.2 billion tons," containing 780 million tons of manganese with a total recoverable production potential of 514 million tons of contained manganese in concentrates. The analyses of mines and deposits in this study indicate that about 213 million tons of the contained manganese (41 pct) is potentially available at a January 1981 constant dollar long-run total cost of up to $1.50 per long ton unit (22.4 lb, or 10.15 kg contained Mn), approximately 428 million tons (83 pet) is potentially available at a cost of about $1.75 or less, and 491 million tons (95 pet) is available at less than $3.30. The remaining 23 million tons, which is potentially available at much higher costs (about $8 to $35 per unit), represents the U.S. deposits. On an annual basis, with a cost range of up to $1.75 per long ton unit, the availability from currently operating mines would last at least 80 years based on 1980 world production data. Total manganese production costs are estimated to comprise mining-8 pet, beneficiation-3 pet, transportation-26 pet, and smelting-63 pet.

The iron ore industry presently utilizes two types of de-posits. The first are the high grade deposits generally located in remote areas and, secondly, the low grade de-posits which are normally found nearer to the steel-making centers. The high grade deposits produce a direct shipping ore which has an iron content which may be close to the maxi-mum 70% of Fe. These deposits have reserves which are ex-pressed in billions of tons. The ore needs little or no up-grading and where this is performed is restricted to ore washing. With the large demand for iron ore pellets, plus a national drive to perform as much of the upgrading as possible in the native country, there is a trend to erecting pellet plants at the mine location~ Large iron ore suppliers such as Australia, Brazil, Venezuela and Liberia already have pellet plants in operation, and there are new plants projected or expansion projects under study. The low grade ores are mined at locations closer to steel mills such as in Minnesota, Michigan and Canada. These low grade ores require methods of beneficiation to obtain a commercially accept-able product with the modern beneficiation techniques it is no~, possible to produce iron ore pellets of 68% Fe and 4.5% silica from ores containing as low as 26% Fe. Figure 1 gives a general picture of the types of iron ores and their beneficiation. The final product of the high grade ore is a coarse concentrate, sinter product or pellets. The final product of the low grade ores is pellets and, in some cases, coarse concentrates.

A multiyear program involving online, in-vessel exposures at Barrick Goldstrike Mines Inc. (BGMI) has provided information and experience about the materials and designs for brickwork linings in pressure oxidation autoclaves. A variety of brick and mortar products was evaluated. Properties before and after exposure were used to document the performance. Some benefits include the development of a new silicate mortar, a better understanding of brick requirements and increased autoclave operating time between maintenance shutdowns. BGMI operates six pressure oxidation autoclaves at its Eureka County, NV gold operation. These autoclave process 15.8 k/ld (17,500 stpd) of gold ore. Figure 1 is a flowsheet of the six autoclave circuits. The gold ore is refractory, in which the gold particles are mineralogically encapsulated on a micro- and submicroscopic level. The autoclaves are 4.4- m- (14-ft-) diam and 26 m (85 ft) long (tip-to-tip). Inside of each is a full brickwork (brick plus mortar) lining that divides the vessel into five compartments. Each compartment has a motor-driven agitator that keeps the slurry suspended and disperses the oxygen to enhance reaction. During autoclave operation, the conditions are steady state at 210° to 232° C (410° to 450° F) and 61 to 62 kPa (420-430 psi). As shown in Fig. 1, there are other accessory vessels (splash and flash towers) in the autoclave circuits that are also brickwork-lined. The linings used to date, other than small test sections, have all been acid-resistant fireclay bricks, bonded with alkali silicate mortar, PbO- based mortar and/or vinyl ester mortar, but mainly alkali silicate mortar.

In 1991 the problems of water inflow at the mine were addressed by a three-phase study. A three-dimensional finite-element computer code, CFEST (Coupled Fluid, Energy and Solute Transport), was used to model the system of groundwater flow around the mine, allowing assessment of the nature of the hydrological regime and of the various recharge mechanisms and sources of inflow. A regional (111 km2) model was used to simulate conditions of low to average mine inflow and provide boundary conditions for the subsequent local (16.8 km2) model. The regional model produced inflows of 0.26 m3/s and the local model 0.25 m3/s. With the use of constant head conditions to simulate a saturated flood plain along the Gays River and on doubling the rate of surface recharge, the local model produced a maximum mine inflow of 0.255 m3/s, in contrast to a measured peak mine inflow of 0.37 m3/s. The discrepancy suggests that during periods of high river level surface water gains access to features with high permeability, such as sinkholes, that may be connected directly or indirectly to the mine workings. Improved simulation of high inflow conditions can probably be achieved by determining the hydraulic conductivity of the river-bed and flood-plain sediments and modelling known sinkholes as discrete units. Possibilities for controlling the amount of inflow to the mine include sealing the flood plain with dykes, checking regularly for new sinkholes, which should be filled and capped, maintaining adequate mine drainage, and monitoring well levels and pressures on a continuous basis.

This Bureau of Mines open file report is one in a series of reports written about the Valdez Creek Mining District (VCM D) as a result of the continuing Bureau of Mines mining district evaluation program. This report presents the results of order-of-magnitude mining feasibility studies. The mining feasibility studies were conducted for mineral deposit models that were based on real and hypothetical deposits that occur in the VCMD. A total of 6b mine models were developed for application to the mineral deposit models. The goal of the feasibility study was to determine the monetary value per unit of minable ore that would cause the simulated cash flow for each of 66 mine models to achieve certain pre-defined rates of return for the invested capital.
