R. L. LOOFBOUROW 26.1-WATER FLOW, USE, EFFECTS, CONTROL Sec. 4 discusses ground water as a mineral resource. This section deals wits its control. 26.1.1-IMPORTANCE Flows of water have an important effect on the cost and progress of many deep excavations. The existence of water limits the methods which can be used in some and presents hazards in others. Lowering the water table may reduce the flow of springs and wells, with legal liability. Some mine water is used directly, some must he treated before discharge, and some contains dissolved solids which can be recovered profitably. Loss of life, property and production from flooding is grim, yet scores of mines have worked safely for generations under ground-water reservoirs, lakes and even the sea. The need for better control of mine water is measured by the severity of recent floodings, concern with the quality of the effluent, and direct and indirect costs of working wet ground. There are improvements in freezing in shaft sinking. pumps and their controls, treatment of mine water before it is pumped, bulkhead construction and certain efforts to reduce inflow. 26.1.2-PUMPING COST VS. COST OF WET WORK Direct operating and capital costs of pumping are more evident than indirect items, such as provision of extra standby power and maintenance facilities, The total of all these items is the cost of pumping water from an excavation. This is only a part of the extra cost of working wet as compared to dry ground. Less productive methods, less efficient equipment and more expensive explosives may have to he used in wet work. Wet rock plugs certain equipment. Maintenance is higher and labor less efficient. The cost of any means of keeping work drier should he weighed against the higher cost of working wet. The true difference in the cost of working wet ground, compared with dry, probably is known at only a few places (see checklist of cost items. Sec. 26.4.13). An extreme comparison of mining wet and dry ore is available from Ambrosia Lake, N.M. (Fig. 26-1). Between 1963 and 1967, a wet and a dry mine were worked by the same company under conditions otherwise comparable. Average operating cost at the wet mine, pumping 1,600 to 1,800 gpm. was $16.06 per ton of ore. The comparable figure for the dry mine was $7.50. Principal differences included the fact that the wet mine was worked from drainage levels below the, ore with rail haulage, the dry mine in the ore with off-track equipment loading and hauling to the shaft. In the wet mine, ore packed in chutes, cars and skips and froze in surface bins, stockpiles and trucks. Wet-mine costs included drilling drain holes, building and maintaining ditches and pumping water containing abrasive solids.

This is the seventh annual tabulation of royalty information. It is also the first year in which some data have been deleted to make room for new data. The concept of royalties evolved from a time when the government owned all of the land, including mines, to the situation where free miners won the right to claim minerals but paid a portion of their production to the royal treasury. Today, a mineral royalty is a payment to the owner of the mineral rights for the privilege of producing the mineral commodity. However, some people incorrectly believe that the selling price and the royalty are the same thing. The contract between the owner (lessor) and the mining company (lessee) is the mineral lease. Some clauses that are common to mineral leases include: identification of property, granting clause, reservations, definitions, royalty rate, taxes and title, indemnity, termination, inspection, assignability, successors, and reclamation. There often are variations in royalty rates for a given commodity that reflect differences in location, quality, market conditions or public versus private ownership. History In the time of ancient Rome, the government owned the mining properties by virtue of conquest. It would lease the mines to favored citizens who would pay rent to the State. Various conditions of sovereign ownership of both land and mineral rights continued in Europe until the Renaissance. As the laws evolved for land ownership by private citizens, the concept that minerals belonged to the State (King, Crown, sovereign) continued until about the 15th century. Free miners challenged the notion of sovereign ownership and won the right to discover and claim minerals. But a portion of their production had to be paid to the sovereign - a royalty. So, the original concept of a mineral royalty was a tax on production that was due to the Crown or Church. The term mineral royalty, as it is known today, is a payment to the owner of the mineral rights (formerly the royal owner) for the privilege of mining and producing the mineral commodity. The owner of the mineral rights, the lessor, and the mine operator, the lessee, enter into an agreement to mine the property. The agreement is the lease. While this concept is common, there are some who do not understand that the royalty is a portion of production paid to the owner as agreed on in the lease document. This author has seen reports where the selling price of a commodity has been quoted as the royalty. ("They get 70 cents a ton royalty at their pit and the guy down the road only has a 65 cent royalty.") These reports have been authored by people not familiar with the mining industry. Lease clauses In addition to the amount to be paid the lessor, there are several other items to be addressed in the lease agreement. The following list may not be all inclusive, but briefly describes most of the common clauses any good mining lease should contain. Identification: This opening clause names the owner (lessor) and the operator (lessee), the address of each, and gives the legal description of the property. Granting clause: This part of the lease gives the time period or duration of the agreement and information about renewal periods. It also has language about the exclusive right of the lessee to mine the property. Reservations: If the owner wants to exclude any portion of the property or set some specific conditions about the operation, there needs to be a clause that describes these reservations. Definitions: This section should address some of the technical terms that the lessor may find confusing - short tons versus cubic yards, dollars versus percentage of average selling price, any escalator indices such as consumer price index or producer price index, and material mined versus material sold. Royalty: This section spells out what the royalty rate will be, how often it will be paid, if there is an annual minimum, the pay dates, and how the records will be kept. This section also describes the conditions under which the lessee is exempt from the annual minimum - natural disasters, strikes, governmental actions, or other causes referred to as force majeure. Taxes and title: The lease needs to identify who is responsible for the property taxes, severance taxes (if applicable), and other taxes that relate to the mining activity - taxes on equipment, improvements, or stockpiles. This is a good place in the lease for the owner to certify his ownership of the property and its mineral rights and also certify that no other leases are in effect. The lessees may want language that allows them to pay mortgages or other debts on the property to keep their lease in effect. Indemnity: This portion of the lease identifies that the lessee assumes the risks for lessee's mining operation. Lessor should expect indemnification by the lessee through standard insur¬ance policies - workers compensation, liability and property damage. Termination: Both the lessor and lessee want language that will allow them to terminate the lease. METAFORA is a simulation model for determination and evaluation of strategies for operating loader/truck systems in mining. A specific version of METAFORA was used to evaluate the haulage system at Solider Mineral's Aitik mine in northern Sweden, one of the largest open pit mines in Europe with a production of about 11.5 Mtpy (about 34000 tpd) of copper are. A production level of 34065 tpd was estimated by simulation runs with METAFORA. Using METAFORA's dispatch rules (Fixed Dispatch, Maximize Trucks, and Maximize Loaders), the truck/shovel system in the Aitik mine was simulated for evaluating alternative dispatch control strategies. The Maximize Trucks rule gave about the same total production (ore + waste) as the Fixed Dispatch rule but a 9% higher ore production. The Maximize Loaders rule gave the lowest production. The marginal truck capacity decreases with increasing number of trucks serving the same loader due to increasing waiting times. In Aitik mine the low crusher capacity results in long dumping times. If the dumping time at the crusher could be halved, the ore production would increase by 14%. The paper indicates that the use of software like METAFORA can result in a substantial reduction of time, effort and cost in shovel/truck system design and evaluation.

Analytical procedures to determine the amounts of trace elements will be discussed. Other papers will deal with trace elements in streams downstream from coal mines, potential pollution from wastes from coal preparation plants, potential recovery of trace elements, and potential pollution from trace elements as a result of the combustion of coal.

The Galena mine is located astride the Polaris fault in the Coeur d'Alene district of northern Idaho. The surface installations are about a mile up Lake Gulch, the mouth of which is about 2.4 km (1 112 miles) west of the old town of Wallace. The mine had its beginnings when the first claims were located in the early boom days of the district in the 1880s and when the first underground ore bodies were opened up in 1917. During the ensuing 14 years, ore was mined from which were recovered 5.4 Mkg (12 million lb) of lead and almost 14.2 Mg (112 million oz) of silver. Workings consisted principally of a vertical shaft from surface to the 800 level and an offset underground shaft to the 1600 level, together with extensive lateral openings. High-grade silver-copper ore was discovered near the Silver Standard fault in the Sunshine mine, a few miles to the west, on the 1700 level in 1930. By 1937, the Sunshine and adjacent mines were producing silver-copper ore on a regular basis. In 1943 additional ore of a similar type was found along the Chester fault, to the east of the principal Sunshine workings. The interest of American Smelting and Refining Co. (renamed ASARCO in 1975) was aroused and the company's geologists determined that the Galena mine, idle since 1931, provided a geological environment in which similar ore might be found. After negotiations were initiated with the owners of the property, Callahan Zinc-Lead Co., the property in question was deeded to Callahan's wholly owned subsidiary, Vulcan Silver-Lead.

Our subject, "Safety, Legal, and Contracting," is a range of topics which covers a broad spectrum, but is obviously Intended to focus our attention upon certain particular aspects of tunnel problems. These are all fascinating and complex subjects, and others are much more qualified to discuss to discuss the fine points involved. Put after some 45 years' involvement as an inspector, engineer, contracting officer, and especially for the last 22 years as a contractor's estimator and manager, I have developed some strong and definite convictions to share with you. I hope it will serve to get you started thinking. My first tunnel experience was in a soft ground tunnel which was dug by hand, literally. The crown or arch back was taken out, a pebble at a time, by bare hand. The face was constantly breast-boarded, and the mucking was all done by hand shovel. My first rock tunnel was drilled by hand held drifters from the muck pile. Since then, most tunneling techniques have improved greatly. The jumbos, booms, muckers, and moles have taken over many of the back-breaking chores, and reduced the manpower requirements.

The Canadian concept for nuclear fuel waste disposal is being assessed by AECL Research in a series of experiments at its Underground Research Laboratory (URL) near Lac du Bonnet. Manitoba, Canada. As pan of this research, the Mine-by Experiment has been designed to obtain information on rock mass behavior, the development of an excavation-induced damage zone and failure mechanisms around a circular bored tunnel. An iterative design approach was used to effectively reconcile the experiment objectives and construction logistics. This paper discusses the design considerations and construction methodology adopted on the project.

When addressing Germany’s resource supplies, we need to distinguish between those domestically available and imported ones. Resource extraction ostensibly competes with the designation of protection areas. However, the parallel existence of wildlife and plant life, and operations in the areas used for resource extractions is continually underestimated. The European Commission has compiled guidance documents facilitating the extraction of resources from protected areas. With regard to resource productivity, the market appears to be the appropriate instrument for minimising resource consumption. Policy makers are now called upon to create a legal framework leading to a consensus accepted by society.

"The Vietnamese economic growth of more than 5% per year leads this country to an enormous demand for raw materials. In the duration of ongoing expansion, the big challenge in the coming decades will be to make this process as sustainable as possible when it comes to economic, environmental and social objectives. Risk management especially in occupational safety and health (OSH) in enterprises is one of the most important tools to achieve this aim. But until now, this has not been taken into priority by Vietnamese coal mining enterprises. Main reasons for this situation can be found in deficient legislative conditions and in non-synchronized risk management systems. In contrast, Germany has implemented an adequate legal system and the German mining industry has gained lots of experiences in risk management, especially in occupational safety and health. This paper seeks to point out specific challenges how to improve occupational safety and health in Vietnam by transferring and applying German methods and standards."

Management for mine construction and development differs from that needed for routine mine production and maintenance. An integrated approach to managing mine development projects must consider contract documents; management organization of a project; the project manager's role and the field supervisor's responsibility; and the use of scientific techniques for planning, scheduling, executing, and controlling projects. Professional project management encompasses the following: • Preparing contract documents that establish technical and financial schedules, and detail the responsibility for the physical work commitment. • Developing a project's organizational structure, to clearly define the roles of the project manager and the field supervisors. • Establishing project management and field supervisor relationships, to avoid ambiguity in assigning responsibility and to ensure desired project progress. • Using management science techniques, particularly networking techniques such as the critical path method for planning scheduling, executing, and controlling projects. Project Versus Production Management Project management differs from routine production management in the following ways: • Uniqueness: A project is unique. Production operations tend to be repetitive. The magnitude of one-time capital expenditures for many facets of mine development warrant special skills and attention. These professional project development skills must already be available by prior experience in the management team. • Personnel: In projects, personnel are usually assigned on a specialty basis and frequently change with the project activity. On the other hand, production personnel work together, more or less permanently. • Management Structure: In a project there may be several staff-line relationships that are not clearly defined and change with changing project activities. In a production situation, the lines of communication and authority are usually well defined. • Time Frame: A difference between project and routine production management is that project activities have comparatively less well defined durations and often tend to be relatively short-term. Production usually has both long-term and short-term plans and well defined long-term and shor-term goals. In project management, formal, critical, short-term reviews are frequently required. In production management, five year plans can be formally adjusted quarterly and annually. Short-term weekly or daily reviews can be informal. • Response to Delays: Delays in a development project may occur without anyone being immediately aware of their existence or suspecting the magnitude of consequence. In contrast, any delays in the production process can be easily identified from prior results comparison. Additionally, the response is quick, usually in a set routine. This can be traced back to the management structure and personnel. • Control Techniques: Measurements of project progress for control are not easily made due to the variety of activities that are carried on at the same time by different work groups. The yard-sticks of performance measurement for individual activities, let alone for the total project, are not easily established. However, due to the difficulty in detecting project delays, a workable control system is vitally important to a project manager. To apply a scientific project control technique such as "management by exception" requires specific planning and monitoring from the project manager for each activity in the project. Production and productivity are quick and effective yard-sticks of measuring performance in a routine operation. Control techniques required in production management usually revolve around these measures. Construction Contracts The construction contract is an important document that establishes contract scope, technical and financial details of the work, and achievement deadlines. It may also serve as the contract document to pay for work done and to verify field progress with planned progress. In practice, it is a good idea to develop a job-specific contract. This whole area is replete with legal precedence and procedures, and it is not the intent here to deal with the intricacies of establishing a contract document. But it is necessary to have an understanding of major contract types. Construction contracts are extremely important legal documents. They may vary in work specifications and enforcement of the provisions. Due to their nature, they must be composed with legal help and will take some time to compile. Even with all the precautions and provisions, it is not uncommon to find owner and contractor disagreeing. Therefore, it is important to include a way to resolve any difference quickly and to incorporate aspects of the contract as part of an overall management control tool for efficient project management.

We look at the empirical evidence of coal block auctions in India to understand how competitive intensity affects the bid amounts in common value auctions. The results suggest that competitive intensity measured through the number of bidders for a coal block is instrumental in determining the bidding outcomes. The presence of higher numbers of bidders in the auction leads to higher bids - every additional bidder causes the bid amount to rise by INR 142.67 per tonne of coal for auctions studied for 127 coal blocks from 2014 to 2023. The paper also examines the moderating and mediating effect of competition on bids and on excess of bids from the comparative market price of coal from alternative source of Coal India Limited. The results indicate that competitive intensity does not have statistically significant impact on the relationship between common value of coal blocks and bids, neither as a moderator nor as a mediator. The strategic behavior of the bidders has also been observed as bidders have been seen to bid in a higher than market price in order to outbid the competitors.

The paper summarises the results of a recent study of minerals planning policies of the Member States of the EU. The study has shown that contrary to the public opinion the production of industrial minerals and construction minerals is significant the former accounting for about 20 percent of global production, the latter amounting to about 3 billion tonnes per annum. In contrast the importance of metal ores has diminished although metal production in some European countries can still be significant. The study revealed that very few Member States have clearly defined mineral policies. Common to most mineral policies is the emphasis on reducing minerals consumption and recycling whereas the important aspect protecting access to minerals resources is not adequately addressed by most policies. Access to mineral deposits is regulated in most Member States by land use legislation and administration. Information on mineral deposits in land use planning data bases tends to be scarce. This together with the absence of formal mineral policies places minerals at a disadvantage in land use decision making. The emergence in the recent past of environmental legislation and in particular environmental impact assessments has had a crucial effect on the duration of the authorization process for new mineral projects. Examples are given how minerals planning is handled in some of the Member States.

Industrial minerals are receiving increased attention by metals, coal and other companies seeking to diversify and stabilize earnings. Each industrial mineral has a unique set (and sub-sets) of business dynamics, however, and the diversity can present a bewildering maze to the corporate planner. Shrugging off this complexity and relying on serendipity for entry opportunities often results in unsuitable acquisitions. An effective alternative used in exploration can also be applied to strategic planning. By providing focus and direction, this flexible methodology can prevent wasting corporate resources on random pursuits and result in a quicker, more satisfactory achievement of diversification goals.

A study was conducted for the AEC to determine the feasibility of constructing an unsupported 315 foot diameter spherical cavity at a depth of 2,700 feet in a salt dome. A cavity of this size and shape has never been attempted. It was determined that the three basic essentials for solution mining; adequate salt, fresh water, and a means of brine disposal were available at the Tatum Salt Dome in Lamar County, Mississippi. Assuming a large, unsupported mined opening of the size and at the depth required would remain stable, the most practical method of providing the cavity using solution mining techniques is by use of a movable blanket of air to control the water level to properly shape the cavity while removing the insolubles either with jetting or by conventional mining methods. It is estimated that, using the jetting method of insolubles removal, the cavity can be constructed in 24 months for approximately $7 million. Using conventional mining techniques to remove the insolubles and shape the final cavity, it is estimated that the cavity can be constructed in 36 months for approximately $12.6 million.

The last two decades have witnessed the resurgence in popularity of a century old tool for shaping laws and public policy – the ballot initiative. In recent years, anti-mining special interests have used the initiative process to secure voter approval of measures to ban modern surface mining for gold and silver. In November 1998, voters in Montana approved such a measure1 – the effects of which have been devastating to the mining industry in that state. In November 1999, anti-mining groups sought to place a nearly identical provision on the general election ballot in Colorado. They did not succeed, but the battle over mining’s future continues in the most important forum of all – the court of public opinion. The Colorado measure failed, in large part, because its proponents failed to convey a positive environmental theme. The mining industry also exercised early-on the rights available under state law for administrative and judicial review of the initiative, instead of relying upon the limited relief that would have been available had it waited until after the secretary of state approved the measure for the November election ballot. This article will summarize the ballot initiative process in Colorado and the proceedings that took place over Initiative No. 215.

Underground mine development begins with the positive investment decision to mine and ends with the inception of full-scale exploitation. It incorporates all activities, personnel, and equipment required for creation of underground access to a mineral deposit. Because of the depletion of near-surface mineral resources, the reduced mobility of large surface mining equipment, increasingly stringent environmental constraints, and the introduction of promising innovations to rock penetration and rock excavating equipment (e.g., continuous miners, rock borers), under-ground mining is projected to account for an increased share of worldwide mineral production in the foreseeable future. Without proper engineering during the mine development phase, failure of the underground mining project is axiomatic. A frustration attendant to coverage of the complex area of underground mine development lies not only with the need for treatment of the many disparate specialties within the area but even with the lack of systematization of these specialties in what is recognized as a vital precursor to successful mining. A.C. Noble presents a clear and concise summary of the factors pertinent to a competent reserve evaluation of a mineral occurrence. However, I believe that he confuses the difference between a resource and a reserve. By definition, a reserve estimate includes all known economic, legal, mining, metallurgical and environmental factors impacting the recovery of the product(s) found in the deposit. A resource estimate, however, is an estimate of what is there - what is available for exploitation and should not include economic and other considerations. Only after defining the resource, its extent, location, physical and chemical properties, can an intelligent selection process begin of the extraction and processing technologies most appropriate to the circumstances encountered. The early and almost certainly inappropriate application of these often cookbook choices has probably lead many companies to walk away from good properties. (How many mines have been found in others rejects?) An example of the process is the early selection of metallurgical samples, after encouraging values are found in a few holes or surface samples, in an attempt to determine the economics of the prospect. Unfortunately, the sampler does not know how representative of the occurrence the sample is because he does not know what the deposit looks like. As a consequence, the property becomes saddled with a bad metallurgical sample that is often inappropriately used in evaluating the deposit which it does not represent.

Crocidolite is a well-known causative agent for mesothelioma. However, studies have shown that the pathogenicity of the fiber from different mines varies considerably and it has been postulated the parameter that appears most likely to account for this variation is fiber width although this has never been formally confirmed. To date, crocidolite appears to be the only asbestos mineral for which an epidemiological study comparing the risk of mesothelioma in a population exposed to ‘thin’ fibers with another exposed to ‘thick’ fibers of the same species may be carried out. Finnish anthophyllite, South African amosite, and African Transvaal crocidolite can also be classified as thick fibers, and there is a paucity of mesotheliomas in populations exposed to them compared to those exposed to thin Cape crocidolite. No thin occurrences of these minerals are known. Our previous study looked at crocidolite from several sources. The present study considers the amphibole anthophyllite found in many places in the world. This mineral, regardless of source, does not show the same variation in fiber width found with crocidolite from different areas. All anthophyllite fibers that have been mined may be classified as thick and populations exposed show very low levels of mesothelioma. We suggest the most likely explanation is related to the fiber width distribution and a concomitant reduction in the ‘Stanton fiber size’ fraction.
