Eminent Domain is the power of the government or municipality to take property for public use without the consent or acceptance of the owner. Typically the agency taking the property will make an offer on the property, hoping that the owner will immediately accept and allow work to begin. If a mutual resolution regarding the property value cannot be reached, however, the municipality will condemn the premises and institute a condemnation action in a court of law, which is when the problems begin. The power of the government to take the subject property is limited by the Federal and State constitutional duty to pay "just compensation" for the property.

As productivity improvements reduced the number of continuous miner sections from seven to three while maintaining full productive capacity, a decision was made to test an advancing tailgate ventilation system on the shortwall mining section. Having the shortwall mine its own return air system has freed the third mining section for more productive, less costly mining. The advancing tailgate has provided effective ventilation across the face and gob with acceptable pressure losses. The tailgate development continuous miner section has been since transformed from a low productivity part-time function to a high productivity development/retreat panel and is available for long term mine development duties also.

To assess the future markets for a mineral from a producing district, the following three aspects must be considered: the future growth of the markets, the competitiveness of the district in terms of production costs and reserve adequacy, and the competition from alternative sources of supply. This paper focuses on the first issue by developing a method for predicting the demand for phosphate from trends in the major market for phosphate products, the fertilizer and agricultural market. The paper shows how broad changes in this end-use market for phosphate has evolved over time. These trends are then projected into the future to make an assessment of future phosphate requirements.

The WEMCO® SmartCell™ flotation machine is a continuously-stirred tank reactor in which solids are suspended in water and are contacted with air. The reaction is particle flotation resulting in the separation of valuable material from gangue. The effects of several operating variables on the flows of water and air and on motor power were measured. A miniature magnetic flowmeter was installed in the draft tube that allowed measurement of the water flows into the rotor. This work has led to a better understanding of machine function which will lead to improved performance and better operation. General equations for optimization, design, and scale-up were inferred.

One critical element of the US Bureau of Mimes computer- assisted mining research program is the development of a reliable coal interface detection (CID) system. Several promising CID concepts currently being investigated by the Bureau include natural gamma radiation (NGR), vibration and passive infrared. To help establish which CID sensor technologies need to be developed for a given seam, coal and adjacent rock samples (immediate roof and floor) are being collected from selected major coal seams in the US and are being analyzed in terms of NGR and other geophysical measurements. This paper provides a brief overview of the Bureau's work in these CID areas.

The hydrometallurgy review did not arrive in time for publication in the May issue. 1992 was not a banner year for hydrometallurgical installations or new hydrometallurgical developments. Installation of copper solvent extraction/electrowinning circuits were under construction or began operation in Nevada (Yerrington ), Arizona (SilverBell), Chile (Copiapo and Escondida), Peru (Toquepala and Cuayone) and Australia (Girilambone). These installations will produce more than 100 kt/a (110,000 stpy) of cathode copper. Several new heap leach gold facilities using conventional technologies were announced or were put into operation. New technologies undergoing widespread testing include biological oxidation of low-grade ores in a heap leach mode and evaluation of new agglomerating agents.

Over the last eighteen months, there has been a dramatic r decrease in the gold price fom US$450/oz to a low of US$275/oz. The prospect of low gold prices, around US$300/oz, appears to be a reality the gold mining industry will have to face over the next couple of years. Already some high cost operations have closed and at others, cost cutting measures and rationalisation have been or are being undertaken. This paper reviews the operating cost of some Australian mines and highlights the potential for cost cutting and demon­strates individual impacts on the dollar's reduction in the cost per ounce of gold.

Sluiceboxes which are designed and operated as recommended from our recent research can provide much higher concentration ratios than most other gravity concentrators (up to 50,000: 1) at very high overall placer gold recoveries (95-99%). They are also very reliable, inexpensive and simple to operate. A sluice­box is a rectangular flume containing riffles on matting, through which a dilute slurry of water and gravel flows. However, sluiceboxes operating under ideal conditions are actually cen­trifugal concentrators whose riffles overturn ribbons of slurry to form vortices. At the bottom of these vortices, centrifugal and gravitational forces combine to drive gold particles into matting (figure 1).

This paper examines the issue of heap leach cash flow based on some recent operational examples. After the first six months of operation, single-lift continuous heaps produce into salable bullion only 70% of the total recoverable gold stacked. This compares with "batch" heaps and lab columns which achieve 100% in two to three months. Multiple-lift heaps often experience a second cash flow depression as a result of the holdup of gold in the heap. Heap leach projects seldom fail based Oil technical pe1for111ance, but they often fail in the sense that they gmerate cash flow at a much slower rate than expected.

A pollution control equipment exemption which reduces the fair and equitable taxable value of a mine property is allowed under Nevada Revised Statute (NRS) 361.077 and must be filed in accordance with the filing requirements of NRS 361.155. USMX Nevada Operations annually saves a substantial amount of State property tax dollars by taking advantage of this tax exemption. The State documents received by USMX and the documents filed by USMX are reviewed in this paper. The application filed by USMX exhibits the format and detail used to obtain this tax exemption and the extent to which environmental control equipment may be claimed.

Smectite is a common impurity in the kaolins of Georgia.This impurity is harmful to the low-shear rheology of kaolin slurries in concentrations as low as a few weight percent. The deleterious effect of smectite on the low-shear rheology is due to the swelling of the mineral. Montmorillonite containing clays were treated to precipitate a compact brucite layer {Mg(OH)2} in the interlayer region of the expandable layer silicate mineral. This treatment forms ahydroxy-Mg-montmorillonite with characteristics similar to chlorite. This treatment effectively reduces the swelling capacity of the mineral and improves the rheological properties of kaolin slurries contaminated with smectite impurities.

The objectives for closure of a hard rock mine include minimizing long term environmental liability, attaining regulatory compliance, and maintaining geotechnical stability, while closing as cost-effectively as possible. Proper planning for closure should come during the feasibility study, design and permitting phases, and during operations as updates. The lack of a proper or updated closure plan can result in severe environmental and economic consequences. Effective mine closure is the result of a combination of innovative concepts, long-term commitments, and multi-party cooperation. The purpose of this paper is to discuss concepts, commitments, and cooperation as they relate to an effective closure plan.

This paper presents a strategy for addressing the hazards of construction of tunnels in ground containing methane. A discussion of the nature of methane includes occurrence underground, and manner of entry into excavations. Means of methane control for underground operations are discussed, including ventilation, monitoring, equipment selection, and personnel training. Principles of ventilation for gas dispersion and removal are addressed. The use of continuous gas monitors, automatic power shutdown systems, and hand-held detectors is discussed. The paper addresses integration of permissible equipment to provide a safe system. Aspects of personnel training are discussed, including maintaining hazard awareness, and evacuation and re-entry procedures.

The United States produces approximately 40 mil- lion tons of phosphate rock per year. Most of this rock is converted to diammonium phosphate and used as a fertilizer component for the domestic and international agricultural market. Much of this phosphate rock production is concentrated in the southeastern United States, with about half coming from washing and screening operations and half from flotation separation from sand and clay. This paper summarizes current operating practice in the industry and touches on some of the emerging technologies required to solve the problems associated with a diminishing high- grade reserve and the need to implement dolomite/francolite separations on a commercial scale.

In the paper presented by F.W. Brackebusch on the "Basics of paste backfill systems," paste fill was presented as a backfill process that offers many advantages over other alternatives such as hydraulic fill and rock fill. It was observed, however, that the mechanics of paste-fill transportation in pipelines is not fully understood and that the success of its implementation in practice depends on the precise control of the proportions of fines, aggregates and water in the mixture. The author emphasized the necessity for laboratory and full-scale testing to determine the suitability of a material to be used as paste fill. Although experimental testing is definitely an important operation in the design of a reliable paste fill, advances in the understanding of the fundamental laws that govern paste flow in pipelines are equally relevant. Ideally, the results of such efforts would provide predictive models for the rheology of the paste and the corresponding pumping-energy requirements. In an attempt to achieve this objective, an ongoing research program has been active at McGill University's Department of Mining and Metallurgical Engineering. Preliminary results showed that the underlying mechanics of paste-fill flow in pipelines may be described in terms of what is known as "plug flow," as depicted in Fig. 1. Although this flow mechanism has been known qualitatively for many years, few attempts managed to offer a comprehensive model (Gandhi, 1987; Duckworth, 1986). In our model, it is assumed that coarse aggregates present in the mixture form a porous core, which is filled with paste (fines and water) and is surrounded by an annular non-Newtonian (Bingham-plastic) lubrication layer, which enables the mixture to flow with pressure losses that are easily overcome by common positive-displacement pumps. In summary, our model predicts the thickness of the annular lubricating layer, which controls the magnitude of the pressure losses. This is done either by collecting data on the apparent viscosity of the Theologically-active fine fraction and using an analytical equation (Bouzaiene, 1994), or is done by measuring the void content of the coarse aggregates and deducing the thickness as a function of the fine- to coarse (weight or volume) fraction ratio in the mixture for a given pipe diameter and solids concentration. Our model predictions showed good agreement with data from Duckworth et al. (1986), as shown in Fig. 2.? Introduction Opencast surface mining requires blasthole drilling to achieve mine planning. No single method of mining is right for all conditions. Occasionally, mine planners introduce a project with little regard to drilling and blasting. These costs are usually a significant percentage of total mine overhead. One drilling and blasting method that can be used to reduce overall mine expense is inclined or angle hole drilling. But inclined-hole drilling will not cut costs unless a set of required circumstances is met. Several conditions of mine design indicate the use of angle drilling. Geotechnical problems must first be analyzed. Primary considerations are safety, fragmentation, production, and maintenance. Secondary considerations are, in some instances, reduction in amount of explosives, which lowers blasting costs; reduction of practical fragmentation beyond blasting pattern limits; and reductions in overall costs due to reduced volume of excavation. Future trends in blasthole drilling may include incorporation of drill equipment designed to allow rapid change from vertical to inclined drilling. This will allow the operator to adapt to changing hole requirements with minimal production loss. Another improvement may be the ability to chamber holes at any elevation throughout the hole depth. This will allow more charge to be placed at strategic locations to improve fragmentation. Merits of Drilling Inclined Holes Drilling is performed to create voids for explosives. It is done either to recover minerals or to excavate a volume of earth. The manner of mining or excavation can greatly affect the economics of the overall project. Many innovations and methods have been tried, but the most practical and economical is still drilling holes and using explosives to fragment the material. To break up the material, the practice has been to place charges within the mass. This is done by drilling holes of a specific diameter and depth into the material. The holes are of such magnitude as to develop sufficient energy to break or loosen this material, providing for easier removal. In general, more open or exposed faces must exist to aid material breakage when blasting. Inclined drilling can be advantageous in open-cut mining with highwall depths of at least 24 m (80 ft). A minimum of two faces are open in open-cut mining and the material can be thrown outward to cover pre-mined volume. This cuts cost by eliminating the need to remove or relocate a large portion of material. Sometimes the material is of such a mass that more energy per unit is required to loosen it than can easily be done by blasting vertically. Inclined holes allow a more uniform loading of drilled holes. The unit of energy is raised, so little or no secondary blasting is required. This usually comes about only if the main plan calls for drilling holes deeper than 24 m (80 ft). For shallow holes, spacing and burden can be made closer to allow sufficient energy to blast the toe. The recent increase in size of open-pit mining operations has resulted in major improvements in efficiency that are beneficial to the mining industry. Higher bench heights, larger diameter blast-holes, and more powerful explosives have played an important part in reducing mining costs. These measures have, however, resulted in increased energy concentrations in the blast area, which can result in severe backbreak problems for final pit walls. If backbreak is not controlled, a decrease in the overall pit slope angle will ultimately be necessary, and consequences, such as decreased recoverable ore reserves and increased waste-to-ore ratios, will result. Greater amounts of loose face rock will be produced, and planned safety berms will be less effective or nonexistent. Hazardous working conditions can also result. Remedial measures, such as scaling large areas and using wire mesh or other artificial support, are very expensive and difficult to implement. There must be a trade-off between the money saved by using larger blasts, and the time spent to maintain pit wall quality. The best approach is to control blasting effects so the inherent strength of pit walls is not destroyed. Presplit and trim blasting are two control blasting techniques used to accomplish this. Both techniques are designed to create a low explosive energy concentration per unit of wall area at the perimeter of the pit. Energy concentration of the main production blast must also be controlled to avoid damaging the final pit wall. A low-energy concentration at the final wall can be obtained by decoupling charges, decking charges, using less powerful explosives, decreasing blasthole diameters, and changing the burden and spacing. Rock properties-fragmentation and the final state of the pit wall-influence the success of a blast. The most important properties to consider are: in situ rock strength, and the nature, frequency, and orientation of structural features. Since these variables cannot be controlled, they must be evaluated by suitable field tests, and then a control blast can be designed using controllable variables, such as spacing, burden, and hole diameter, so the blast will be successful for appropriate rock conditions. One main thrust of this article is to show how control blasts can be successfully designed for larger hole sizes, up to 381-mm-diam. While efforts to produce a good control blast in shovel/truck pits have been ongoing for some time, recent use of a modified presplit technique in dragline operations has helped reduce water problems, improve safety, and increase dragline productivity in a number of surface coal mines. This article presents examples on designing and using presplit and trim blasting for large hole operations in both shovel/truck and dragline mines. Presplit Blasting As introduction to presplit blasting, Fig. 1 illustrates a typical presplit blast layout using 102 mm-diam presplit holes for 381¬mm-diam production holes. For this type of blast, presplit holes would normally be drilled first, ahead of main production holes. The choice can then be made between loading and firing the presplit line or infilling the main blast. Charles Morris Minerals engineers have a new opportunity to shape their industry's future. They can help secondary school teachers in their own communities improve their scientific knowledge and thus be better prepared to teach their students. Local sections of AIME and other groups are being asked to sponsor expense-aid scholarships for teachers who complete the summer field course A Total Concept of the Mining Industry. Now in its 18th year, the six-week summer course is presented by the Colorado Mining Association Education Foundation Inc., in cooperation with the Colorado School of Mines Office of Special Programs Continuing Education. The course will be held June 9 through July 18. "In the past, we have been successful in soliciting support for teacher-scholars from many organizations, corporations, and individuals within the industry," said John Robertson, Jr., Foundation chairman. "Now we hope to enlist the help of engineers at the grass roots level in identifying qualified local teachers and giving them what it takes to participate in this continuing education program." Robertson said the course provides secondary school teachers, counselors, and administrators with a working knowledge of the mining and metallurgical industries. It also helps teachers recognize career opportunities for their students. "With the industry facing a challenging new era, we must have teachers who can relate the excitement of this challenge to their students. They will inspire future generations of resource finders, developers, and managers," he said. More than 670 teachers in 27 states, including 45 graduates of the "class of '85" have completed the course and gained six semester hours of graduate credit. The Foundation's Planning and Curriculum Committee meets regularly to develop the course outline and recruit the faculty. Lecturers are selected on their ability to communicate with people not familiar with the industry. Last year, 67 faculty members came at their own time and expense to discuss their specialties, ranging from exploration to marketing. Normally, teachers receive scholarship aid in the form of tuition and fees, and transportation and meals while on field trips. Expense-aid scholarships cover room and board on campus for those beyond the Denver-Metro area, and travel to and from Golden. "We hope to broaden the appeal and the geographical range of the program," Robertson said. Inspiration for the field summer program for teachers came in 1967 from a mining engineer, the late C.L. (Lindy) Barker, a 1931 graduate of the Colorado School of Mines. Barker and a group of concerned individuals convinced the Colorado Mining Association to accept sponsorship of the course in 1968. The Colorado School of Mines and its Office of Special Programs and Continuing Education agreed to be a co-sponsor to give it accreditation and provide physical facilities and coordination. The first course was held in 1969. Operating funds were solicited from industry to pay tuition, course material, the cost of a course coordinator, field trips, and overhead. Through the years, personal contact by an industry representative has been the most effective teacher recruiting tool. Through expense-aid scholarships provided by local sections of professional organizations, such as AIME, as well as CSM alumni and other friends, there will now be a greater incentive for more teachers to get to know the minerals industry and pass that knowledge on in the classroom.

A total transportation system providing for delivery of finished products to customers and raw materials to the plant is one of the key elements contributing to Dravo Lime Co.'s success. Dravo Lime operates one of the largest noncaptive lime and limestone plants in the US at Maysville, KY, where products produced can cost as much to deliver as they do to manufacture, depending on the product itself, its destination, and mode of transportation. With delivery costs comprising a significant portion of total costs for its products, Dravo Lime has made total transportation services an integral part of its business strategy. Prices for most products produced at Maysville are quoted f.o.b. destination. In short, Dravo Lime's Distribution Department relies on the approach that says to customers: "Leave the delivery to us." The 0.9-Mt/a (1-million stpy) Maysville facility, located about 121 km (75 miles) east of Cincinnati, OH, on the Ohio River, primarily produces sulfur-absorbing Thiosorbic lime used by coal-fired electric utilities as a scrubber reagent to remove SO2 from stack gases. The product is currently supplied to eight power plants in the Ohio River valley region which extends through portions of Kentucky, Indiana, Ohio, West Virginia, and Pennsylvania. The plant ships approximately 907 kt (1 million st) of lime and a comparable amount of limestone fines each year. In addition, it arranges for delivery of about 181 kt (200,000 st) of coal to the plant. Lime is transported by covered hopper barges, covered rail cars, covered dump trucks, and pneumatic trucks. It is transferred from barges to storage silos and trucks at a terminal on the Ohio River near Marietta, OH. At another terminal near Aliquippa, PA, lime is transferred from barges to silos, trucks, and rail cars. Future plans call for rail-truck transfer terminals. To produce lime from limestone at the Maysville plant, about 181 kt (200,000 st) of coal is burned annually in three coal-fired kilns. In transporting this coal from the mine to Maysville, Dravo takes maximum advantage of opportunities for reloading carriers with limestone for outbound backhaul movement. Coal, shipped from southeastern Kentucky mines in rail cars, is transferred to barges at a river terminal in West Virginia. After it is unloaded at Maysville, the barges are cleaned with a front-end loader and then reloaded with limestone. Limestone also is backhauled in connection with truck deliveries of coal. The economics of using backhaul shipments has permitted Dravo to enter into markets in which Maysville limestone otherwise would not be competitive. The company plans to backhaul limestone in empty open hopper cars in the future. As part of its ongoing assessment of the distribution system that supports the Maysville operation, Dravo Lime recognizes that a new environment has developed between shippers and carriers because of regulatory changes in the railroad and trucking industries. Although dry bulk shipments by barge to and from Maysville have always been unregulated, other forms of transportation have not. With railroads and motor carriers now approaching varying degrees of deregulation, contracts and agreements are replacing tariffs, and rate negotiations are becoming a daily activity. Dravo Lime plans to take advantage of these transportation changes, all of which may be beneficial to both its plant and its customers.

II. Real Estate A. The new Accelerated Cost Recovery System of depreciation (ACRS). 1. Mandatory for assets placed in service after 1980. ACRS will eliminate most if not all controversies with the IRS over depreciation. 2. Real property now depreciated over 15 years. Component depreciation is not available. 3. Accelerated depreciation is available - a 175% declining balance method with an automatic shift to straight line method at the optimum point in the asset's life. Alternatively, a taxpayer can elect to use the straight line method.
