CINNABAR was discovered in southwestern Arkansas on Little Missouri River in sec. 1, T.7S., R.26W., in April, 1930, and near Antoine Creek in sec. 28, T.6S., R.23W., some 15 miles farther east in May of the same year. It was not, however, until June, 1931, that cinnabar was identified as such in a specimen from the original discovery area sent to W. M. Weigel1 by Walter F. Hintze of Murfreesboro. Almost simultaneously2, in July, 1931, Moritz Norden of Hot Springs identified specimens from the Antoine Creek area as cinnabar. Immediate interest in the district followed the identification of cinnabar and by January, 1932, the district was known to extend as a mineralized belt about one mile wide trending east-northeast from sec. 13, T.7S., R.27W., in Howard County-across central Pike County and into Clark County to sec. 19, T.6S., R.23W., thence extending southeast into sections 33 and 34 of the same township. Since then, cinnabar has been found in sec. 6, T.7S., R.22W., thus giving a total east-west length to the district of approximately 30 miles. Interest focused mainly on the two discovery areas, with the result that mining development has progressed most rapidly in those localities. In the Antoine Creek area the Arkansas Quicksilver Co. has done con-siderable exploration work and has retorted the high-grade ore so .obtained. In the Little Missouri area the Southwestern Quicksilver Co. has had a 12-ton rotary furnace in more or less continuous operation since April, 1932, and has been the largest producer in the district.

ALTHOUGH the present economic depression is felt in the petroleum industry, probably as much as in any other branch of American industry, the Petroleum Section of the Institute was well represented at the general sessions on Monday and at all of the seven division sessions on Tuesday, Wednesday and Thursday. The seven sessions of the Division were so arranged as not to conflict and thus permitted members to hear the programs of all sessions.* The first meeting of the Petroleum Division was held on Tuesday afternoon; a joint session on engineering research and production engineering. Mineral aggregates are those natural and manufactured industrial mineral and rock materials that provide bulk and strength in port- land cement concrete, bituminous concrete mixes, and plaster or stucco surfaces. They may also provide special characteristics such as thermal and acoustical insulation, weight, surface textures, abrasion resistance, and impermeability to various concrete products and mixes. Most aggregates are relatively inexpensive materials, but despite their low unit value, the tonnages consumed each year in the United States and throughout the world make mineral aggregates by far the leading industrial mineral and rock materials both in terms of volume (tonnage) produced and value consumed. The major use of mineral aggregates is in concrete. The low cost, high bulk aggregates tend to keep concrete construction costs at levels competitive with other building materials. Other major uses of aggregates include highway and railroad base or ballast materials, graded fill, and various industrial uses such as metallurgical and chemical fluxes and raw materials-these latter uses are often considered nonaggregate uses of mineral aggre- gate materials. The value of mineral aggregate materials at the production plant varies from less than a dollar per ton to several dollars per ton for most crushed stone and sand and gravel, $2 to $15 per ton for slag and expanded clay or shale aggregate, to as much as $60 to $100 per ton for expanded perlite or vermicu- lite. The more specialized the use, the higher the price-although there are naturally some exceptions to this rule of thumb. The first four parts of "Construction Materials" deal with the utilization of four major mineral aggregate types: Crushed Stone, Light- weight Aggregates, Sand and Gravel, and Slag. While the focus will be on the use of these industrial minerals and rocks there will also be some coverage of sources, mining and production, especially in those cases where they are

This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a forthcoming publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World." (Information Circular, 1959.) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then brass, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. Drilling activity in the South Texas area, which includes the South Corpus Christi and Laredo districts, showed a marked decline during 1941 from that of the preceding year. The rate of new discoveries, however, 'compared favorably with exploratory results of 1940 because of the many new productive sands opened in existing fields. South Texas completions for 1941 were about 12.3 per cent below the 1940 figure, compared with an increase of approximately 5.5 per cent in the total number of completions in the United States during 1941 over the 1940 total. During the year, 1452 wells were drilled in this area; of these, 1205 were drilled in or as extensions to the proven fields, and 247 were rank wildcats drilled in search of new producing pools. The comparable 1940 figures were: 1320 field or extension wells and 336 rank wildcats, a total of 1656 completions. This represents a decline in 1941 of approximately 8.7 per cent in proven-area wells, and of about 26.5 per cent in rank wildcats. It must be stressed that wells that were considered rank wildcats at the beginning of operations, but which opened production later classified as additions to existing fields, are not regarded as rank wildcats in this and previous annual reports on this same area. These wells are classified as semiwildcats (Table 2). There were 13 new oil or distillate fields and 4 new gas areas opened during the year, as listed in the next column. This listing represents a decline of 32 per cent from the 25 new areas found during the previous year, and to a great extent can be attributed to the 26.5 per cent decline in wildcatting. The rate of new discoveries based on the 247 wildcats was 14.5 to I, which compares somewhat unfavorably with the 13.4 to I ratio obtained in 1940 (Table 5). Dry wildcats totaled 230. The proof of the prolific character of the South Texas area as a source of petroleum reservoirs is to be found in the fact that of the 1205 field or extension (semiwildcat) wells completed during the past year 61 opened production from new sands or found crude in formerly distillate-producing sands. The 1940 total of 1320 such wells accounted for 50 horizons that provided either new production or crude in distillate sands, and in this respect the 1941 rate of discovery shows to greater advantage, the ratios for new sands being 19.7 to I for 1941 and 26.4 to I for 1940. A copper alloy containing- 25.5 at, pct Zn and 19.0 at. pct Ni, which was previously found to show an anoma1old.s hardening effect on quenching- from 600 "C and aging- at 400oc, has now been examined by neutron diffraction. No evidence of long-range order was found. The aged sample showed diffuse scattering- consistent with clustering. The anomalous hardening effect is now attributed to lattice strains caused by clustering rather than (long-range) order hardening. SOLID-solution Cu-Ni-Zn alloys (the commercial 'nickel silvers") have been reported to show anomalies in: change of resistivity on cold working,1-6 temperature coefficient of resistance,2-12 resistivity at low temperatures,13,14 parameter (vs temperature),2"4 calorimetric data,2,4 specific heat,15,16 dilation,2-4 and elastic modulus.17 The structure responsible for the anomalies is produced by annealing typically near 400°C and is rather loosely referred to as the ('K-Zustands" (K state), a term coined by Thomas1' who apparently meant simply that the arrangement of atoms on the sites deviated from that expected statistically. Thomas proposed that the K state occurred in a variety of (solid-solution) alloys such as Cu-Ni-Zn, Ni-Cr, Ni-A1, Ni-Cu, Fe-A1, and Fe-Si and is recognized because its formation is strongly temperature-dependent and results in an increase in electrical resistance which can then be decreased by cold working. Later workers on ('nickel silver" have interpreted the K state variously as short-range order, long-range order. or a combination. The present work was prompted by the discovery by Phillips and Jones19 of a substantial hardening effect when an 18 pct "nickel silver" alloy which is fairly close to the Cu2NiZn composition, was reheated in the range 150" to 450 C after previously quenching from 600°C or, alternatively. was slow-cooled from 600°C or above. The phenomenon was attributed to (long-range) order hardening. Due to the similarity in the atomic scattering factors of copper. nickel, and zinc atoms, the ''nickel silvers" are unfavorable for X-ray diffraction studies aimed at detecting ordering. Nevertheless Bialas et a1.,20 using a powder sample containing 47.96 wt pct Cu, 24.03 wt pct Ni, and 27.98 wt pct Zn, slow-cooled from 400" to 200°C taking 500 hr, observed weak super lattice lines. Further unpublished work" using an anomalous dispersion X-ray technique indicates that zinc atoms are regularly ordered at the corner points of the lattice cell, while the nickel and copper atoms are statistically distributed on the remaining sites. Köster 17 also observed X-ray superlattice lines, for example, in an alloy containing 43.5 wt pct Cu, 28.6 wt pct Ni, and 27.9 wt pct Zn superimposed on the basic fcc cell with a = 3.62 kX. He proposed a Cu3Au-type superlattice with the Ll2 structure in which the A sites were statistically occupied by copper and nickel atoms and the B sites by zinc. He adds that substitution must be possible so that zinc atoms partly occupy A sites. Below about 35 pct Cu, Koster had some evidence for a CuAu-type superlattice with the Llo tetragonal fcc structure with a = 3.82 kX, c/a = 0.88 which could be preserved by quenching. This is suggested17722 to correspond to CuNiZn. While the present work was in progress Hirabaya-shi et a1.23 made an independent comprehensive neutron-diffraction study of a single crystal containing 50.05 at. pct Cu, 26.57 at. pct Ni, 0.25 at. pct Mn, 0.13 at. pct Fe, balance zinc. The presence of manganese and iron is surprising since the crystal was supposedly grown from high-purity metals. The homogenized crystal showed evidence of long-range ordering after an anneal of 5 months at about 300°C. Three possible crystal models were proposed. A curious feature of their results23 is that they could not find any neutron-diffraction evidence of ordering in a powdered polycrystalline near-stoichiometric Cu2NiZn alloy. There appears to be some essential difference between a near-stoichiometric Cu2NiZn alloy and one somewhat further off stoichiometry as used by the present authors. Thus Sato14 was able to reproduce the low-temperature resistivity anomaly reported by one of the authors13 on the present alloy if he used a similar composition, but found the normal behavior of the residual resistivity in a near-stoichiometric alloy. satol2 found that the resistivity of a cold-drawn slightly off-stoichiometric alloy increased to a maximum on isothermally annealing at 300°C and then decreased ("over-aged"). Since he could not explain this on the basis of ordering phenomenon, he proposed that zinc atoms were segregating to stacking faults (Suzuki effect) and found etching bands on the surface by replication which were attributed to the widening of faults. Sato suggested14 that the hardening effect observed by Phillips and Jones19 is partly due to the Suzuki effect. ONLY the acute phase of the smelter fume problem is new. The problem itself is older than the Christian era. While both lead and copper were mined and crudely smelted ; on: 3,000 years ago, it was not until the Roman occupation of the Iberian Peninsula and the British Isles, which occurred but shortly before the beginning of the Christian era, that there was any evidence of smelting operations on a scale sufficiently large to permit a fume problem. Around Huelva, Spain, are found more than 30 million tons of slag from lead smelting conducted there by the Romans. Pliny tells us that more than 20,000 slaves were employed in the Iberian mines. Extensive mining and smelting by the Romans in England and Wales were coincident with the Iberian proceedings. These metallurgical operations were upon a sufficiently large scale to produce marked results both upon the surrounding country and the smelter workers, but, as they were those of a conqueror upon conquered soil, conducted by slaves, imperial Rome failed to recognize that such a thing as a smoke problem did or could arise, and whatever fume question there may have been at that .time remained a question only to those who had no chance to answer any phase of it. The smelting operations of the Romans extended over about 400 years, and little is "recorded of lead and copper smelting from that time until the 16th century. From the revival beginning at this period up to the present century, the growth of smelting has been comparatively gradual. In Great Britain, smelting was conducted almost wholly in localities where metallurgical operations were of paramount importance, and the communities that grew up in smelter localities were due to and dependent upon the mines and smelters. This fact had much to do with the comparative freedom of British smelting from burdensome fume litigation and legislation. To a lesser degree these conditions applied to the German operations which, when coupled with the further fact that most of the early German operations were to a greater or less degree fiscal workings of Prussia, Saxony and Brunswick-Hanover; accounts for

Industry Adopts Research: Seventy-Ave years ago Thomas A. Edison began in a modest way and with limited funds to gather about him men of various talents to form the first industrial research laboratory. His laboratory at Menlo Park, N. J., became famous for many discoveries and inventions, but possibly the most important of all may yet be the industrial research laboratory itself. Today, private industry operates 2500 research laboratories in which 135,000 persons' are directly and indirectly creating new processes and products and improving old ones, as well as developing new information to help keep the fountain of knowledge from running dry. In this change-making function, the scientific personnel comprises 41 pct; the technical personnel 26 pct; and the balance, 33 pct, nontechnical. The term "industrial research" has become so broad as to include almost everything beginning with the search for and discovery of the laws governing the properties of matter and energy to the development and testing of processes, methods, and equipment. These classes of investigation commonly merge so that no sharp boundary can be traced between them. The National Research Council therefore defines industrial research as "the endeavor to learn how to apply scientific facts to the service of mankind."' Currently, expenditures for research by industry are variously estimated at between $450,000,000 to $700,000,000 a year,' or about twice the expenditure for 1940. The President's Scientific Research Board" estimated that the national research and development for 1947 (excluding atomic energy) was as follows: A few companies spend as much as 5 pct of their gross receipts for research, but 1% to 2 pct is considered a good proportion by many." Shortages: Commendable as is the record of growth and accomplishment of science in industry, it is only a beginning. America and the rest of the world have merely sampled the fruits of industrial research; most industries have yet to make research the key to their future. A top research consultant, T. A. Boyd, of General Motors, states ". . . perhaps 90 per cent of all companies still have no research laboratories."Y or example, of more than 17,000 manufacturing concerns whose gross sales exceed $500,000 a year, less than 2500 have research laboratories. A still smaller proportion of the 184,230 manufacturing establishments in 161 industriese have or could afford their own research facilities. Yet, the small and mediurn-sized com,panies with less than 250 employees each, produce one half of the dollar volume of manufactured products.' How are these companies to participate in and share the benefits of research?
