Water laws important to the mining industry are those which govern or affect the right to use water, to dispose of water after using it in mining or milling, and to discharge waste material into water-courses. They include statutes and court decisions having general applicability, as well as others that pertain specifically to mining. THE INDUSTRY'S CONTRIBUTION TO WESTERN WATER LAW Despite sharp differences of opinion, the water law the Spaniards brought to the Southwest appears to have included some form of appropriation of water. The Mormons, who settled in Utah in the mid-nineteenth century, also developed a system of appropriative water titles. But by far the most profound impact on western water law was made by the gold- seekers who flocked to the Sierra Nevada foothills of California after the discovery of gold in 1848. Much of the gold was extracted from the ground by hydraulic or placer mining, and so the-miners' rights to the use of water became fundamentally important. Since there was no organized government in the foothills and no laws other than those made by the miners, they helped themselves to the land, the gold, and the water needed to work their claims.' They established and enforced regulations governing the acquirement and holding of mining claims and their rights to the water they needed.'In 1879 Justice Field, former Chief Justice of the California Supreme Court, spoke for the U. S. Supreme Court in saying that the miners were "emphatically the law-makers, as respects mining, upon the public lands in the State.""

A circular shaft with a diameter of 6m was excavated by the conventional drilling and blasting method to a depth of 235m through 60m of glacial till, 1 Om of water bearing basal sand, 1 1 Om of clay shale (Bearpaw Formation) and finally a strata of coal, mudstone, siltstone and sandstone (Oldman Formation). The lined shaft was instrumented at three levels by multipoint extensometers to determine the displacement field near the shaft bottom, embedment strain gauges to measure the strains in the liner and IRAD-stress change gauges to observe the radial and tangential stress changes in the rock mass. The data from these gauges were used to determine the in situ stress field. An attempt to measure in situ stresses by overcoring was also made at a higher elevation. The performance of the shaft and its support was then evaluated by use of the "Convergence-Confinement Method". For this purpose the measurements of stress changes and displacements were combined to determine by extrapolation the displacements ahead of the shaft and after the liner installation. The convergence curves calculated in this fashion were then used to evaluate the performance of the cast-in-place concrete liner and of an alternate shotcrete shaft support system.

In an earlier paper1 the composition-temperature limits of the gamma iron phase in the iron-tungsten system were reported as approximated by thermal analyses. At that time no attempt was made to develop metallographic evidence of the coexistence of two phases in the iron-rich solid solution at temperatures between 900" C. and 1400" C.

FOR several years, the Bureau of Standards has been working in cooperation with an Advisory Committee on non-ferrous metals on various phases of the production and testing of zinc bronzes. The work has dealt, especially with the type of metal known as "Admiralty bronze" in England and as "Government bronze" in this country and consisting of 88 copper, 10 tin, and 2 zinc. Several reports have been made on this subject and these should be considered in connection with this paper.1 FIRST SERIES OF FIVE FOUNDRY TESTS A very brief summary of the first series of five foundry tests has been made,2 but for the sake of clearness the results are given here in different form. The five foundries cooperating in this investigation were: Ohio Brass Co., Mansfield, Ohio; Titanium Alloy Mfg. Co., Niagara Falls, N. Y.; Packard Motor Car Co., Syracuse, N. Y.; National Cash Register Co., Dayton, Ohio; Bureau of Standards, Washington, D. C. The object of the work was to determine whether uniform results could be obtained with this alloy in different foundries working under definite instructions. One of the participating foundries prepared, from virgin metal, a stock of ingots of the composition 88 copper, 10 tin, 2 zinc, and at the same time poured nine test bars from this melt of virgin metal. The results of the physical tests of these bars are shown in Table 1. Examination of this table shows that the highest and most nearly uniform results were obtained when the virgin metal was cast flat in chill molds and the lowest and most variable results were encountered when it was cast vertical in green-sand molds. Prof. Mathesius analyzes the running of Howland's furnace No. 19, according to the method described by him in Stahl and Eisen, 1916, Nos. 30 and, 31, and in his work "Die physikalischen und chemischen Grundlagen den Eisenhüttenwesens" (Spamer, Leipzig). By assuming 500 Cal. lost from the hearth by radiation and cooling water per kilogram of pig iron made, a throat-gas temperature of 600° C., and taking the ratio of C02/CO as 0.64, he finds that his diagram would show 0.68 kg. of carbon oxidized per kilogram of pig iron, while Howland gives 0.66 kg. THE Province of Ontario in recent years has come strongly to the front as a producer of metals, especially nickel, copper, silver, and now gold. Of the last named, the output for 1922 was in the neighborhood of $20,000,000. The law governing the mining industry in a community where such develop-ments are taking place will be of interest, therefore, in other places where mining laws are up for revision The first mining of importance done in this province was for copper on the north shore of Lake Huron, where the Bruce mines were opened in 1846. These deposits of copper sulfides, notwithstanding the remoteness from markets and the cost of transportation, were vigorously worked for 12 or 15 years and also intermittently later, but the active career of the mines came to an end in 1875. From first to last, a little less than 10,000 tons of copper was produced, valued at $3,300,000. All the product was shipped to England as dressed ore, contain-ing up to 13 per cent. of the metal. In. 1866, a rich pocket of gold was found on the Richardson farm near Madoc, Hastings County, but was not followed by further discoveries of a like kind and in time the excitement it caused died away. Rich silver ore was found in 1868 on Silver Islet in Lake Superior, a speck of land not larger than a good-sized ball-room. The assemblage of minerals here was practically the same as that at Cobalt, discovered 35 years later, namely, native silver, cobalt, nickel and arsenic; in addition, there was considerable argentite, which has always been scarce at Cobalt. In all, the silver produced amounted to about $3,500,000. The belief persisted that the deposit was not mined out, and in the summer of 1922, some rich ore was extracted from the roof, perilously near the bottom of Lake Superior.

INTRODUCTION A Workshop on Hydraulic Fracturing Stress Measurements was convened by the authors in December 1981 in Monterey, California under the auspices of the U.S. Geological Survey and the U.S. National Committee on Rock Mechanics. There are now over a dozen groups of investigators around the world who are actively using the hydraulic fracturing method for making in-situ stress measurements. Because of the extensive recent experience of these different groups, the Workshop enabled forty investigators from eight countries to comprehensively assess the status of the method. Based on the presentations and discussions at the Workshop, in this paper we briefly discuss the current status of the hydraulic fracturing stress measurement method concentrating on problem areas where further research needs to be done. A complete account of the presentations at the Workshop will be available through the Proceedings of the Workshop which will be published by the U.S. National Committee on Rock Mechanics in early 1983. The most exciting aspect of the Workshop was the discovery by the various groups of investigators that others were having very similar experiences with the method. The consensus among the different groups of investigators at the Workshop was that they were recording very similar pressure-time data in the field, they were able to interpret them in similar ways, and they were achieving results that were quite encouraging because of several factors. First, the results at various locales were found to be internally quite consistent. This was reported by investigators from Germany (Rummel, Baumgartner, and Alheid, 1982), Japan (Tsukahara, 1982), Australia (Enever, 1982), and the U.S. (see, for example, Haimson, 1978, 1982a; Zoback

IN THE literature on the elimination of metalloids in basic open-hearth practice, there are a great many heats recorded in which excellent data on changes in slag and metal composition during refining are given, but in almost all of these heats either temperature data or weights and analysis of charge are unrecorded and observations on the physical characteristics of the slag are almost always lacking. With these points in mind, a test heat was made in which as complete as data possible on all the factors that affect the elimination of metalloids were obtained. THE TEST HEAT The test heat was made in a standard 100 ton stationary furnace at the Lackawanna Steel Co., Lackawanna, N. Y. on January 17, 1922. The Charge-Scrap.-The scrap consisted entirely of rail-heat butts, selected from a number of heats made, the week before the test. The average analysis of the scrap was calculated from the analysis of these heats-and from the weight of scrap from each heat. Pig Iron.-Two ladles of pig iron were used in the charge and two samples were taken from each ladle as it was poured into the furnace. These four samples were composited for the average pig-iron sample.

The sudden death of Captain Jones, September 28,1889, became known to his fellow-members on the eve of the Ottawa meeting of the Institute; and at that meeting, Mr. Charles Albert Ashburner, of Pittsburgh, expressed with unaffected feeling and unpremeditated eloquence the sorrow of all. Mr. Ashburner subsequently undertook to revise and extend, for in in the Transactions, the remarks he had made at Ottawa; but death surprised him also, in the midst of his labors; and it has become my duty and privilege to prepare from the memoranda he left behind, the present brief and inadequate notice. To me, who knew and loved them both, this task of double sorrow recalls them both, with a peculiar sense of presence and of absence. They seem to speak from another land, not far away, yet not with human voices—like an echo and its echo. William Richard Jones was born in Luzerne county, Pennsylvania, February 23, 1839. His father was Rev. John G. Jones, a Welsh minister, who had immigrated to the United States in 1832. William was the eldest son, and his father's failing health made it necessary for him to begin early the work of self-support. At the age of ten, he was apprenticed to the Crane Iron company, of Catasauqua, and in this humble capacity entered upon the profession in which he was to become famous. Unquestionably, the thorough acquaintance with all details, acquired by working his way from the bottom to the top, was one secret of the conspicuous executive ability which characterized him in the height of his career. According to a letter from Mr. J. H. Geer, Assistant Chief Engineer of the Cambria Iron Company, Mr. Jones entered the service of that company in 1858 or 1859 as a machinist, and continued to work in that capacity until July, 1862, when he enlisted as a private in the 133d Regiment of Pennsylvania Volunteers, in which he afterwards commanded a company. The perusal of Mr. Willard P. Ward's " Notes on the Behavior of Manganese to Carbon," presented at the Washington meeting of the Institute in February, 1882, has suggested further reflections on the same general topic, and has led to the preparation of the present paper. The same observation that Mr. Ward has put on record in his "Notes" was also made by myself at about the same time (in August, 1875), and under almost the same conditions. From a blast-furnace that was very hot, as was the furnace mentioned by Mr. Ward, I obtained a pig-iron containing about fifteen per cent. of manganese, gray in color, and very tough. It could be pulverized, but could not be cut with the chisel. I analyzed this iron and found that it contained, as I had suspected,a large amount of silicon. From this fact I drew the conclusion that the silicon had deprived the manganese of its power of dissolving carbon, since the latter, instead of occurring in the pig in combillation, appeared as graphitic carbon. I thus saw reproduced on a large scale, and demonstrated in a visible way, the property that Colonel Caron, a French scientist, had discovered in silicon,—the property of obstructing the process of hardening in steels by keeping the carbon in the graphitic condition. An attentive study of the conditions under which the phenomenon observed by Mr. Ward takes place led me to go back to operations of synthesis, and to make as I wanted them pig-irons containing varying quantities of silicon, manganese, and carbon. An iron, thus prepared, was intended to serve me as a chemical reagent in the production of steels cast without blow-holes, such as my lamented friend, Mr. A. L. Holley, has introduced and made known to the United States. Legal and legislative matters constituted the outstanding features of proration in Texas in 1932. From East Texas emanated most of the political, legal, technical and industrial activity. Conroe and Thompson developed into fields of major importance. Proration orders were issued by the Railroad Commission on many of the producing fields of the Gulf Coast and West Texas not covered in previous years. In Yates, Penn Pool, Winkler, Van, the Panhandle, North Texas and West Central Texas there were 110 changes of importance, except in allowables. New proration schemes were introduced in East Texas, Conroe, Thompson, Saranosa, Government Wells, Tuleta and Howard-Glasscock. Little progress was made in administration or technical development. Legal and Legislative Matters Proration first began in Texas in 1927 as a voluntary attempt to divide the market outlet of a field on an equitable basis. The statutes then in existence were considered somewhat archaic and the Railroad Commission's authority was limited. Subsequent efforts to strengthen the laws were not wholly successful. The 1929 Conservation Act made no mention of market demand but declared that the term "waste" did not mean " economic waste." With the passage of the Pipc Line Act of 1930, providing for ratable purchasing, it was the opinion of many lawyere that a legal means of proration had been found. The 1931 law had ths same provision as that of 1929 with respect to economic waste but specifically prohibited limiting of production to market demand. The law passed Nov. 12, 1932, omitted reference to economic waste and specifically provided for limitation of production to reasonable market demand. Vigorous attacks were being made in State and Federal Courts on the constitutionality of the laws and the validity of the Commission's orders. In Peoples Petroleum Producers, Inc. et al. vs. Lon A. Smith et al., which had been heard before a three-judge U. S. District Court in Houston on May 28, 1932 and again on Sept. 19, the Court's decision for plaintiffs, released Oct. 2, influenced in a large measure the calling of the Legislature and the passage of the Market Demand Law on Nov. 12.

IN the course of the experimental and development work of Henry L. Doherty in an endeavor to obtain an increased yield of oil from oil-bearing sands, it was Mr. Doherty's claim and contention that oil in an undisturbed pool was different in character and behavior than, the same oil when raised to the surface of the earth, and that the gas dissolved in the oil caused a marked reduction in its viscosity and surface tension. Prior to 1924 no information to support this contention could be found in the literature or by a discussion of the subject with technical men in Government and private laboratories. So far as could be ascertained no experimental work had been carried on to indicate that Mr. Doherty's claim was either right or wrong. All parties consulted agreed that the viscosity of the oil would be affected by gas dissolved therein to the extent that natural gasoline was present in the gas, but so far as could be determined any additional effect of the natural gas was unknown. Accordingly, it was necessary to devise equipment and carry on experiments which would either prove or disprove Mr. Doherty's contention or claim. Such apparatus was built under Mr. Doherty's direction and experiments were carried on to determine definitely the viscosity and the surface tension of the crude oils which contain dissolved gases under different pressures. The results of the experimental work carried on have proved that the claim and contention of Mr. Doherty were correct in every particular, as will be seen from the discussion of the subject and the data contained in this paper.

AT THE end of the year 1914, the main North Star incline shaft had reached the 6300-ft. level, and encountered a vein dipping Southwest, or, exactly opposite to the North Star. Subsequent development failed to find the North Star vein continuing beyond this intersection, so the 6300-ft. level proved to be the bottom level of the North. Star vein, and very little ore was found below the 5300-ft. level. The new vein was called No. 1 vein. Development work carried on for the next 10 years discovered a third vein, called No. 2, branching off about 1200-ft. to the east, with a North-south strike and a west dip. No. 1 vein had about 900 ft. of backs above the 6300-ft. level before reaching the boundary line of the property, and No. 2 vein died out about 800 ft. above. During these 10 years, the money spent on development was increased from $54,000 in 1914 to $184,000 in 1924; the ore reserves steadily diminished until it was evident that the mine must close down unless by some means a large tonnage of ore could be developed quickly.

In the course of some experiments conducted in the Metallographical Laboratory of Harvard University, some interesting facts were brought to light which appear to be worth recording in advance of a more elaborate and exhaustive paper which the authors hope to present to the Institute in the near future. Fig. 1 shows, under a magnification of 100 diameters, the microstructure of the cross-section of a steel bar 1/2-inch square, containing 0.52 per cent. carbon, heated to 1100 degrees C. and cooled slowly with the furnace. Fig. 2 illustrates the structure of the same steel, heated to the same temperature but cooled more rapidly in the air. Both samples were cut from the same bar and heated side by side in the furnace. When a temperature of 1100 degrees C. had been reached, one sample was taken out of the furnace and allowed to cool in the air, while the other was cooled with the furnace. The only difference, therefore, in the treatment of both samples will be found in their respective rate of cooling. This variation in the rate of cooling resulted, as shown

For more than 200 years zeolites have been familiar minerals to geologists and mining engineers as minor, but ubiquitous constituents in vugs and fractures of most basalt and traprock formations. More than 35 different species have been recognized including several, such as chabazite, erionite, mordenite, and faujasite, whose adsorption properties rival those of many synthetic molecular sieves. Igneous occurrences of this type have never been mined on a commercial scale; they are generally small and low grade, and they commonly contain as many as four zeolite minerals, along with small quantities of calcite, quartz, and other silicate minerals. Their economic beneficiation to monomineralic zeolite products has also not been achieved and, for the most part, industrial applications of zeolites have relied primarily on synthetic molecular sieves that were crystallized from hydrous aluminosilicate gels. No review of underground mining should begin with anything but the new world safety record set at the Grace underground iron mine of Bethlehem Steel at Morgantown, Pa., on Friday, November 12. There had not been a disabling injury (an injury which keeps an employee away from his next scheduled shift) for 550 working days. In all, 2,660,080 man-hours had been worked by nearly 950 employees without a disabling injury. The record was wrested from Johns-Manville's Jeffrey mine at Asbestos, Que. At 3 p.m. Friday, December 3, miner Stanton E. Friend was completely buried under several feet of coarse rock, fortunately sustaining only cuts and multiple abrasions. But with his fall, the accident- free period came to an end at 2,778,600 man-hrs worked without a disabling injury-the new record!

This paper contains a review and discussion of the major design parameters of a block caving mine, with special attention given to access, development, and operational methods. Information will be provided on the economics and costs of various design alternatives, and how they can influence financial results of a particular project. Technical and economic factors that pertain to an actual operation, Freeport Indonesia, Incorporated's block caving mine in Indonesia, will be provided, and highlights of the planning, development and operation of this mine will be presented. The major thrust of the paper will be to emphasize the importance of good planning and to encourage economic analysis of various methods of layout and design.
