Non-ferrous slags are granulated and stockpiled as an alternative to pit cooling or transporting molten slag to a dump. The chemical composition of such slag is determined by the pyrometallurgical process in which it is produced, while the size distribution is set by safety concerns or a desire to reduce wear of pumps, pipelines and other equipment. Relatively few operations give consideration to the effect of granulation conditions on other properties of the granulate as the material is typically accumulated on the smelter site. It is becoming recognized that slag has many potential commercial uses and carries much of the energy applied to the smelting operation. This paper outlines the findings of extensive work to identify uses for granulated non-ferrous slag, the importance of preparation conditions on the properties, impediments to more extensive use of granulated slag, the real costs of slag stockpiling and the opportunities for further productive research.

The value of mineral production in Alabama reached a new high of more than $246 million. 4 percent above the previous record established in 1964. New high values were reported for bentonite, portland cement, fire day, kaolin, miscellaneous clay, lime, crushed limestone, crushed marble, mica. salt, and sand and gravel. Among the States, Alabama ranked second in the production of bauxite and scrap mica and third in the production of native asphalt. The mineral industry of Alabama was dominated by the mining and processing of coal and Slone, the manufacturing of cement, and the production of crude petroleum, which together comprised 85 percent of the total value of mineral output, compared with 84 percent in 1964. The iron ore industry continued to decline. Coal production continued to increase, resulting in the State's coal-mining best year since 1948.

Strain-type rockbursts, or strainbursts, are characterised by a localised violent failure. Their cause is attributed primarily to the sudden release of strain energy, which accumulates in a volume of highly stressed rock as a result of mining activities. Examples of such phenomena are crown/sill pillar bursts created in the mining process, pillar crush in room-and-pillar mining, face ejection in drift development headings at depth, and floor bursts associated with deep shaft sinking. The paper describes a simple method for the assessment of crown pillar bursts in steeply dipping ore deposits which are extracted by the overhand cut-and-fill method. The method is based on a theory previously established by the author to help assess the need for a remedial solution such as pillar destress blasting. Basically, the mining-induced energy storage rate (ESR) in the pillar is compared with the critical strain energy to come up with the so-called burst potential index (BPI).

[Recent investigations at the Intermountain Experiment Station of the Bureau of Mines at Salt Lake City indicate that metallurgists have given little attention to the occurrence of jarosite minerals in the oxidized ores of lead and silver. These investigations have also emphasized the importance of lowing when these minerals occur in the oxidized ores, especially those containing lead, silver, and gold, as their presence is a material factor in selecting a suitable kind of treatment. Since the question of the occurrence of jarosites in oxidized ores has come to the attention of the Bureau of Mines, investigation has indicated that plumbojarosite and argentojarosite are quite common. These two minerals appear to be widely distributed and probably escaped recognition by persons who had attempted to treat certain oxidized lead ores in which the jarosite minerals represented a material portion of the metal content. Consideration of the physical characteristics of the jarosites also indicates that in many cases failure to treat some of the oxidized lead ores with success has been directly due to the fact that the greater portion of their lead and silver content was present as plumbojarosite and argentojarosite. The data and the description of these minerals given in the body of this paper indicate that attempts to recover lead and silver from ores in which appreciable amounts of too metals occur is plumbojarosite and. argentojarosite would be unsuccessful if confined to gravity methods of concentration. There are undoubtedly considerable tonnage of oxidize lead ores in the various mining regions of this and other countries, and it is quite probable tat in some of these ores the metal content of lead and silver may be largely anglesite (lead sulphate) and cerussite (lead carbonate) but that they will also contain cerargyrite (silver chloride), argentojarosite, and plumbojarosite. The flotation froth structure and motion determines the amount of entrained gangue that is collected to the concentrate. Despite this important role in the overall performance, the behaviour of the froth is still ill understood. To date, predominantly empirical models have been developed to describe entrainment. A fundamentally based model is described and used here in an attempt to improve the understanding of entrainment. This general froth simulator (UMIST FrothSim) allows the modelling of a wide range of flotation conditions, as it takes account of a large number of the physical phenomena that occur within flotation froths. The model firstly describes gas motion and bubble coalescence, and the water motion based on gravitational, viscous and capillary effects. The motion of the solids distinguishes between various solids classes based on hydrophobicity, particle size and density and models them by including the effects of Geometric and Plateau border dispersion, particle settling and the motion of the water. The aim of this paper is to show the applicability of this model to explain the observed entrainment and collection of gangue. This is done by comparing model predictions with the experimentally observed relationship between the gangue and water recoveries. The model predicts the identical trends, which are explained in terms of the interaction between the linear effects of water motion and hindered settling and the non-linear effect of particle dispersion.

Under a DOE-funded project, four advanced flotation technologies (the Jameson cell, the Outokumpu HG Tank Cell, an open column and a packed column) were evaluated at the benchscale to identify the technology or combination of technologies that best improved fine coal recovery and reduced processing costs. The results indicated that two-stage application of the Jameson and packed column cells provided the optimal performance. Subsequently, proof-of-concept scale testing was conducted at the Cyprus Emerald Coal Preparation Plant. The results confirmed that levelized production costs were lower using two-stage cleaning with the Jameson cell followed by the packed column.

A RATHER detailed description of the entire plant and leaching process was given in a paper recently presented to the Institute,1 so this paper will cover briefly only the crushing practice of the New Cornelia Copper Co. for the year, 1918. The ore, which is mined by steam shovels and loaded in side-dump cars, passes through two crushing plants. These crushing plants were constructed to crush the ore required by a leaching plant of 5000 tons daily, capacity, during a crushing period of 16 hours. The primary plant reduces to less than 3 in. (76 mm.) and the secondary plant, to ¼ in. (6.35 mm.), which is sufficiently fine for satisfactory percolation of solution through the ore in the leaching tanks, and to give good extraction. The ore is then conveyed to the leaching tanks by a system of 28-in.. (71-cm.) belt conveyors. On the way to the leaching tanks, it passes through an automatic sampling plant, where a 1-per cent. sample is taken. From the primary crushing plant, the ore is conveyed by two 36-in. (91-cm.) belt conveyors to a 10,000-ton steel storage bin, with a reinforced-concrete flat bottom. The ore discharges from the bottom of this bin onto four 20-in. belt conveyors, which deliver it to the four units of crushers in the secondary crushing plant. There is no storage bin between the mine and the primary crushing plant. The ore breaks very coarse, is very hard, and contains a great many boulders, some as large as 4 ½ by 4 1/2 by 10 ft. (1.3 by 1.3 by 3 m.). Jams form in the bowl of the coarse crusher in the primary crushing plant, as a consequence, and are freed by means of an immense steel hook operated from a 40-ton electric traveling crane.

A maximum acceptable level of 2 mg/m3 of respirable coal mine dust in active mine workings was established, effective January 1, 1973, under the Federal Coal Mine Health and Safety Act of 1969. It is generally agreed that, as a result, coal mines in the United States are significantly less dusty than they were a decade ago. For example, operators of underground mining machines were exposed to between 3.9 and 6.5 mg/m3 of respirable coal mine dust during 1968-69; now they are exposed to between 1.3 and 1.8 mg/m3. Also, the incidence of underground sections cited for exceeding acceptable levels of respirable coal mine dust decreased during 1976-78, and the vast majority of all working sections are now in compliance. This improvement is very substantial by world standards. It must be regarded as a creditable accomplishment by the coal mine operators, federal agencies, and mine workers involved. Most of the improvement has been brought about by the use of existing technology to control, suppress, and collect respirable coal mine dust. Research and development by the Bureau of Mines has contributed significantly to the accomplishment by improving the methods for sampling, control, suppression, and collection.

Nevsun Resources Ltd. Bisha Mine Project is a gold and base metal development project in the Gash Barka region of west-central Eritrea. The project has the potential to be one of the largest industrial developments in the country, and Eritreans have no experience in modern mining. Nevsun recognized early that the success of the Bisha Project would require meaningful consultation and engagement with all levels of Eritrean society. Meaningful engagement required not only full disclosure, but also capacity building from government officials at all levels to other stakeholders who live in the nearby communities. This paper describes the approach used to develop capacity and to help introduce a modern mining culture in a country without previous experience in mining.

The Silver Line Phase III Project is the final one mile underground segment of the new Bus Rapid Transit in downtown Boston. The project is expected to significantly reduce existing and anticipated traffic congestion. The twin one-lane tunnels and two station platforms will be built by NATM in Boston saturated soft clay, sand and till layers in proximity to several historical buildings, underpinning two existing cut and cover subway stations and several major utilities in densely built urban area. This paper presents the analysis and design of the NATM tunnels and stations detailing the excavation sequence and support system and various ground improvement and pre-support techniques used in the preliminary and final design of the project

Some Otago quartz veins display spectacular open-space filling textures indicative of shallow formation. Fluid inclusions in some such veins show that fluid immiscibility occured before or during mineral deposition. This immiscibility or 'boiling' occured at depths ranging from about 3 km to within as little as about 100 metres of the paleo-surface. Temperatures of mineralization range from 190 - 250¦C. Metals deposited in these veins include: Au(+Ag), Hg, Sb and As. Hydrothermal alteration is confined to minor silicifation of immediate wall-rock schist, less than about two metres from the veins. These veins have some similarities to classical epithermal systems elsewhere in the world, although wall-rock alteration is much less developed in Otago. From analogy to these classical epithermal systems, it is speculated that gold mineralisation may be found beneath Otago stibnite and cinnabar localities.

En février 2000, l?industrie minière a indiqué le besoin d?établir des lignes directives plus spécifiques pour l?opération sécuritaire des parcs à résidus. Dans cette optique, l?Association Minière Canadienne a publié, en septembre 2002, un Guide pour l?exploitation, l?entretien et la surveillance (EES) des parcs à résidus miniers. Suite au développement du Guide et à son application sur plusieurs sites miniers, il apparaît que la mise en oeuvre d?un Manuel ESS des parcs à résidus miniers permet : ? d?établir les responsabilités des intervenants; ? de s?assurer que les critères d?opération sont appliqués; ? de mettre en oeuvre le plan de déposition des résidus et de gestion de l?eau; ? de rencontrer les normes et exigences environnementales; ? de définir un programme d?entretien et de surveillance des ouvrages; ? d?identifier les risques et de mettre en oeuvre un plan d?intervention d?urgence; de démontrer une opération diligente.

Ceremonies for the induction of four mining industry pioneers into the National Mining Hall of Fame will be held Saturday, Sept. 22, 2007 at the Charles F. Barber Pavilion (Museum Convention Center) in Leadville, CO. The four inductees are James Harold Courtright (1908-1986), Dr. Howard L. Hartman (1924-2002), Charles Washington Merrill (1869-1956) and Kenyon E. Richard (1915-1993). The inductions will bring to 197 the number of mining “greats” whose engraved photographs and biographical sketches are installed in the National Mining Hall of Fame.

As mechanical shock and vibration environments evolve, it is important to understand their potential effect on human operators. Human beings are sophisticated mechanisms comprised not only of passive components with mass, damping, and stiffness characteristics, but also of components that can actively affect apparent mass, stiffness, and damping. Because the lumbar spine can exhibit local, short-column buckling, stability of the human trunk depends on the responsiveness of the neuromuscular control system.1-2 We have been evaluating the ability of patients with back pain to respond to a series of sudden loads. We believe the results have implications for isolation design and standards development. Methods 153 patients, aged 21 to 55, presenting with back pain agreed to enroll in a research study that randomly assigned them to one of three treatment arms: high velocity low amplitude spinal manipulation, low velocity variable amplitude spinal manipulation, or wait for 2 weeks and then be randomized to one of the above groups. Response to sudden load testing was one of a battery of baseline evaluations performed upon entry into the study and prior to treatment. EMG electrodes were attached to the skin over the paraspinal muscles of the standing participant bilaterally 3 cm from midline at the L3 level. While standing upright on a force plate (Bertec), participants were fitted with a strap around their back and hooked to a load cell in front of their chest. An accelerometer was rigidly attached to the load cell. Impact was applied to the chest using a cord attached to a falling weight. The weight’s fall distance was varied between 9 and 13 inches to account for the size of the subject. The subject was blindfolded and wore headphones playing white noise to prevent cueing of when the weight was dropped to apply the load. Hence, although the participant knew a load was about to be applied, he or she did not know the instant it would occur. Just before the weight was dropped, a 4 second data collection process was started for the two EMG electrodes, load cell, accelerometer, and force plate. The load drop was repeated 6 times, at irregular intervals, over a period of 2 minutes. The raw data thus collected was reduced to obtain several values: 1) length of time from the pull on the harness to the beginning of the response of the left and right paraspinal muscles (LES, RES), 2) time and magnitude of the maximum response, 3) force and acceleration experienced at the chest, and 4) the time and magnitude of the center of pressure location (COP). A general linear model was used to evaluate the results. Results For the EMG data, of the 1,824 observations made, 90% of them indicated a response. Prior to the sudden load, resting muscle activity was different between left and right sides (p=0.0001) and between males and females (p=0.0001). Female subjects began to respond to the sudden load within 92 to 110 ms and males from 101 to 109 ms. Females exhibited more variation in starting

Until now there has been controversy about which tests should be performed to diagnose early Hand-Arm Vibration Syndrome (HAVS). Initial screening questions, especially about tingling and numbness, routinely given to patients prior to examinations proved to be a very important tool in the diagnostic process1, 4. However, standardized tests that are simple, quick, valid and reliable are needed to support a diagnosis of HAVS. Purpose: To find the most valid and reliable tests to diagnose HAVS. Material and Methods Five major tests were performed on Group I and Group II. Group I: Control group of 12 volunteers including students, nurses, secretaries and physicians with no history of using vibrating tools (age 20 to 50y, mean age 38.5y; 5male, 5 female.) Group II: 12 workers (age 17 to 65y, mean age 39y; 9 male, 3 female) were sent by a local trade union with a history of using vibrating power tools on their jobs for varying amounts of time (mean 12.2y, from 0.5 to 35y.) Pre-enrollment survey showed that each had more than 4 complaints commonly associated with use of vibrating tools (including numbness, tingling, weakness, pain, finger color or nail changes, temperature change, and difficulty moving.) 1. Sensory nerve conductive tests: Amplitude and nerve conductive velocity (NCV) were evaluated. 2. Cold Stress-Temperature recovery time tests were done on the index finger of the dominant hand following these steps: Confirm water bath is within 4-5º C. Place the finger temperature probe on pad of the index finger of the dominant hand. Record temperature every 15 seconds. Place subject’s hand in the cold- water bath for exactly five minutes. Record temperature every 15 seconds for ten minutes. 3. Blood test: Venous blood was taken by a 21-gauge needle with the yellow collection tube adapter. S-ICAM, Sera Thrombomodulin, Norepinephrine levels were evaluated by Henderson Research Centre, Canada. 4. Finger Sensory Evaluation: Semmes-Weinstein monofilament test and 2-point discrimination tests were performed on bilateral fingers. 5. Digital blood pressure test: blood pressure was measured in bilateral index fingers. Results 1. Median nerve sensory conductive amplitude from palm to wrist : GI: mean 96 ± 31µm; GII: mean 43± 30µm; for dominant hands. GI vs GII: P<0.001

Several Rockmass classification systems have been developed and used in Civil Engineering design and for underground mining operations. Some of these rockmass classification systems have been modified and used in the South African coal mining industry to quantify descriptive geological information for use in coal mine design and roof support selection. The Coal Mine Roof Rating (CMRR) system developed in the USA has been investigated in detail as part of the study. Advantages and disadvantages of the system have been identified by means of underground and surface borehole testing. Investigations into the rating systems in South Africa found that most of the rating systems used in the South African coal mining industry are for planning purposes, and are conducted on borehole cores. This study also highlighted that the rating systems being used are based on geology, and that the human factor plays a major role in the rating systems. To overcome these problems, all the classification systems used in South African coal mines have been benchmarked against impact splitting technique and documented. The best elements of these systems are combined into a new standard system that will be easily used by all mine geologists and rock mechanics engineers. Certains de ces systèmes de classification de la masse rocheuse ont été modifiés et utilisés dans l&apos;industrie minière sud-africaine pour quantifier l&apos;information géologique descriptive utilisée dans la conception de mines de charbon et la sélection de soutènement du toit. Le système d&apos;Evaluation de Toit de Mine de Charbon (CMRR) développé aux USA a été examiné en détail, comme part de l&apos;étude présente. Tests en surface de trous de mine ont permis d&apos;identifier les avantages et inconvénients du système. Une étude des systèmes d&apos;évaluation en Afrique du Sud a révélé que la plupart des systèmes d&apos;évaluation utilisés dans l&apos;industrie minière sud-africaine sont utilisés pour la planification, et sont menés sur les carottes de trous de mine. L&apos;étude présente a aussi souligné que les systèmes d&apos;évaluation utilisés sont basés sur la géologie, et que le facteur humain joue un rôle majeur dans les systèmes d&apos;évaluation. Pour surmonter ces problèmes, tous les systèmes de classification utilisés en Afrique du Sud ont été référencés en termes de technique de fissuration sur choc, et documentés. Prüfungen der Bewertungssysteme in Südafrika ergaben, daß die meisten Bewertungssysteme die in der südafrikanischen Kohlebergbauindustrie benutzt werden, Planungszwecken dienen und werden anhand von Bohrlochkernen durchgeführt. Diese Studie hob auch hervor, daß die verwendeten Bewertungssysteme auf Geologie basieren und daß der menschliche Faktor eine Hauptrolle in den Bewertungssystemen spielt. Um diese Probleme zu überwinden, wurden alle in südafrikanischen Kohlengruben benutzte Klassifizierungssysteme vergleichsweise in Hinblick auf Spaltschlagtechnik überprüft und dokumentiert. Die besten Elemente dieser Systeme werden in ein neues Standardsystem kombiniert, das leicht von allen Grubengeologen und von Gebirgsmechanikingenieuren benutzt werden kann.

The transition from exploration to feasibility is a stage in the development of mineral resource projects that is frequently not handled well. The transition marks a point in the project development process where resource evaluation priorities change significantly from the discovery of mineralisation and the rapid assessment of the potential tenor of the mineralised system, to the detailed assessment of the deposit. &nbsp; Information used in the exploration process tends to be of a qualitative or theoretical nature initially, but gradually becomes more quantitative in character as geological knowledge relating to individual prospects grows. &nbsp; The transition from discovery and rapid exploration of a new deposit occurs at a relatively early stage in project development, coinciding with the first attempt to prepare a resource estimate for the deposit. Fundamental assumptions regarding both structural and grade continuity and uncertainty inherent in existing information need to be made so that they themselves may be addressed during the collection of additional data. &nbsp; The effective commencement of feasibility studies involve the introduction of new accountabilities either as a result of appointment of a project manager, and through needing to be able to quantify: ò&nbsp;&nbsp;&nbsp;&nbsp; the quality of data being collected for resource evaluation purposes; ò &nbsp;&nbsp;&nbsp; confidence associated with resource estimates; and ò &nbsp;&nbsp;&nbsp; the need to develop an audit trail for the project, required to make the resource evaluation decision-making process as transparent as possible. &nbsp; Quality assurance is a concept to which exploration geologists have frequently had little exposure. Being able to demonstrate the quality of data used in feasibility studies is, however, a crucial component of the overall risk management and reduction. &nbsp; Development of a transparent audit trail for data assists in demonstrating the quality of data which is frequently perceived to translate directly to confidence inherent in resource estimates. &nbsp; Establishing procedures for geological data collection and management also provides a more reliable framework for making decisions that impact on project execution, again resulting in improved confidence in resource estimates and associated geoscientific data. &nbsp; Regular, independent technical audits, in principle similar to audits conducted for the ongoing certification of standards compliant quality assurance systems, are a major, positive factor in effective project management and execution. &nbsp; Information used in project evaluation, feasibility and development must be based on facts. Facts are effectively observations that are ideally made systematically, recorded in a systematic manner, and by being collected effectively are not subject to change. &nbsp; Effectively managing the transition from exploration to resource evaluation, feasibility and project development involves recognising the nature of changes in the nature, detail and scope of geoscientific data required at each stage of project development. In doing so it is essential to: ò &nbsp;&nbsp;&nbsp; recognise when the change occurs (as early as preparation of the initial resource estimate for a project); ò &nbsp;&nbsp;&nbsp; accept that the change may not be gradual; and, ò &nbsp;&nbsp;&nbsp; ensure that the project evaluation team is adequately resourced. &nbsp; These objectives require recognition of the value of previous experience and the need to instill a true team approach amongst both staff and contractors associated with the project. Regular formal and informal communications between staff, contractors and other stakeholders in the project are an essential tool in ensuring personnel are aware of factors affecting their role in the project.

"Thermodynamic investigations on fcc solid ternary Fe-Ni-Cr alloys have been performed by means of the computer-aided Knudsen cell mass spectrometry. Ternary T.AP.-series (Thermodynamically adapted power series) are used for the algebraic representation of the thermodynamic excess properties. At 1650 K the molar excess Gibbs energy GE is negative over the whole field of stable fcc phase. The molar heat of mixing HE is exothermic in the predominant part of the fcc phase field. Only between the section with a constant ratio of mole fraction Xcr/XNi = 0.64 and the fcc phase field boundary the HE values are slightly endothermic. The results of this work can be used successfully for phase diagram calculations.IntroductionThermodynamic investigations on multicomponent alloy systems such as the Fe-Ni-Cr ternary system including the three binary boundary systems are very time-wasting and usually beset with considerable experimental difficulties. Additionally, the required experimental equipment is very expansive and the obtained results are not always satistying. Therefore it is understandable that many phase diagram calculations are based only on few experimental values of the molar excess free Gibbs energy GE. Consequently, Kundrat and Elliott [1] as well as Hillert and Qiu [2] used in their reassessments of the phase diagram of the Fe-Ni-Cr system thermodynamic data mainly assumed and/or optimized by means of various reasoning.Lee [3] reported recently, a revision of the used thermodynamic description of the Fe-Ni liquid phase is necessary to obtain a better agreement with the experimental data on the bcc/liquid or fcc/liquid tie lines and liquidus temperatures in the Fe-rich region of the Fe-Ni-Cr ternary system than in the previous assessments. This is 'in full agreement with mass spectrometric investigations of Fe-Ni alloys in the liquid and in the fcc solid phase, published earlier [4,5]. Indeed, phase diagram calculations based upon the molar excess free Gibbs energies GE obtained in these studies yield liquidus and solidus lines in excellent agreement with experimental phase diagram data [5]. Nevertheless, these experimental data have not been considered later on any more, not even in the revision by Lee [3]."

This is the seventh annual tabulation of royalty information. It is also the first year in which some data have been deleted to make room for new data. The concept of royalties evolved from a time when the government owned all of the land, including mines, to the situation where free miners won the right to claim minerals but paid a portion of their production to the royal treasury. Today, a mineral royalty is a payment to the owner of the mineral rights for the privilege of producing the mineral commodity. However, some people incorrectly believe that the selling price and the royalty are the same thing. The contract between the owner (lessor) and the mining company (lessee) is the mineral lease. Some clauses that are common to mineral leases include: identification of property, granting clause, reservations, definitions, royalty rate, taxes and title, indemnity, termination, inspection, assignability, successors, and reclamation. There often are variations in royalty rates for a given commodity that reflect differences in location, quality, market conditions or public versus private ownership. History In the time of ancient Rome, the government owned the mining properties by virtue of conquest. It would lease the mines to favored citizens who would pay rent to the State. Various conditions of sovereign ownership of both land and mineral rights continued in Europe until the Renaissance. As the laws evolved for land ownership by private citizens, the concept that minerals belonged to the State (King, Crown, sovereign) continued until about the 15th century. Free miners challenged the notion of sovereign ownership and won the right to discover and claim minerals. But a portion of their production had to be paid to the sovereign - a royalty. So, the original concept of a mineral royalty was a tax on production that was due to the Crown or Church. The term mineral royalty, as it is known today, is a payment to the owner of the mineral rights (formerly the royal owner) for the privilege of mining and producing the mineral commodity. The owner of the mineral rights, the lessor, and the mine operator, the lessee, enter into an agreement to mine the property. The agreement is the lease. While this concept is common, there are some who do not understand that the royalty is a portion of production paid to the owner as agreed on in the lease document. This author has seen reports where the selling price of a commodity has been quoted as the royalty. ("They get 70 cents a ton royalty at their pit and the guy down the road only has a 65 cent royalty.") These reports have been authored by people not familiar with the mining industry. Lease clauses In addition to the amount to be paid the lessor, there are several other items to be addressed in the lease agreement. The following list may not be all inclusive, but briefly describes most of the common clauses any good mining lease should contain. Identification: This opening clause names the owner (lessor) and the operator (lessee), the address of each, and gives the legal description of the property. Granting clause: This part of the lease gives the time period or duration of the agreement and information about renewal periods. It also has language about the exclusive right of the lessee to mine the property. Reservations: If the owner wants to exclude any portion of the property or set some specific conditions about the operation, there needs to be a clause that describes these reservations. Definitions: This section should address some of the technical terms that the lessor may find confusing - short tons versus cubic yards, dollars versus percentage of average selling price, any escalator indices such as consumer price index or producer price index, and material mined versus material sold. Royalty: This section spells out what the royalty rate will be, how often it will be paid, if there is an annual minimum, the pay dates, and how the records will be kept. This section also describes the conditions under which the lessee is exempt from the annual minimum - natural disasters, strikes, governmental actions, or other causes referred to as force majeure. Taxes and title: The lease needs to identify who is responsible for the property taxes, severance taxes (if applicable), and other taxes that relate to the mining activity - taxes on equipment, improvements, or stockpiles. This is a good place in the lease for the owner to certify his ownership of the property and its mineral rights and also certify that no other leases are in effect. The lessees may want language that allows them to pay mortgages or other debts on the property to keep their lease in effect. Indemnity: This portion of the lease identifies that the lessee assumes the risks for lessee&apos;s mining operation. Lessor should expect indemnification by the lessee through standard insur¬ance policies - workers compensation, liability and property damage. Termination: Both the lessor and lessee want language that will allow them to terminate the lease.
