The theory of reliability is a powerful mathematical tool for determining optimum selection of components and application of electrical power to coal mines. In order to make this tool useful, statistical material on equipment life must be gathered and all failures carefully recorded. Statistical data can be applied to new apparatus design and can be used to determine optimum configuration of network and maintenance to reduce costs. Reference is made to underground power systems in the USSR. Technical progress in the last few years has occurred in the design and application of highly productive coal mining and transporting machinery. One of the most important problems facing mining engineers is to increase the availability of the machine to obtain higher productivity. However, machine failures and breakdowns of electrical power supply components cause serious delays in the coal-winning processes. In spite of the fact that electrical equipment and the power supply contribute only a small percentage of direct mine costs, electrical failures as well as power supply delays can result in severe indirect losses. It is necessary, therefore, to consider reliability and safety in the application of electrical equipment underground. To obtain the best results, it is necessary to investigate and evaluate the reliability of the electrical mining components (starters, breakers, motors, cables, etc.) and optimal methods for minimizing maintenance, the desired result being equipment which is efficient and safe. Electrical equipment reliability directly influences economics: the lower the reliability the more frequently failures occur, causing serious working delays and possibly huge economic losses. By the same token, while increasing the number of preventive maintenance calls per unit time might result in fewer failures, thus reducing delays, the cost of making more frequent maintenance inspections will increase; this is one aspect to be discussed in detail. Obviously, failures of identical types of electrical equipment (starters with the same current and voltage, etc.) are influenced variably by different working conditions, environments, quality of the apparatus, maintenance procedures (personnel, frequency, quality), load, and other factors. Hence, the lifetime of identical types of equipment will vary depending upon usage in terms of the foregoing factors. Thus for a given type of electrical component, these factors must be considered quantitatively; the interaction of all these factors are evaluated quantitatively by a statistical method using probability theory. Equipment reliability must be quantitatively determined from a study of equipment life, since no one laboratory test can reproduce all working conditions and environmental effects. Nevertheless, reliability theory applied to electrical mining equipment is a very powerful mathematical tool for selecting as well as evaluating certain parameters. It is necessary to select several reliability parameters so that one can obtain an expression for the total overall economic situation in terms of cost, taking into consideration damage caused by electrical equipment failure and cost of maintenance. To accomplish this result, such characteristics as apparatus lifetime, breakdown idle time, and losses (damages) can be determined quantitatively on a statistical basis. For identical electrical equipment working under similar conditions, the previously mentioned reliability factors are random variables and therefore can be characterized readily by a probability density function. Investigations carried out by the authors in the Kuznetsk Basin (Kuzbas) in West Siberia, USSR, show that the reliability factors of electrical mining equipment are well described by the exponential, normal, or Erlang's distribution in most cases. NEARLY all of the present schemes for treating complex (i. e. lead¬silver-zinc-copper) ores are based on the idea that lead holds, and will hold for some time, the strongest economic place from the viewpoint of supply and demand of all the non-ferrous metals. Copper, it is thought, will come back to its own when European affairs are stabilized, although at that time competition from Chile, Peru, and Katanga, in particular, will be more severe than in pre-war days. The future for silver and for zinc is uncertain. New uses are developing for zinc, and the market has remained better than many expected, but the stabilization of world markets will bring in foreign competition instead of relief. The cost of producing zinc from simple zinc ores, by the retort process, will, from the nature of the labor required and the increasing cost of fuel, increase steadily. As a result, the small producers of purely zinc ores around Joplin are shutting down their mines, even with a good market price for zinc; on the other hand, the producer of lead from complex ores, in the Rocky Mountain states, is confident of a profit from the sale of his lead, and is seeking means to make the zinc in his ore pay some part of the cost of treatment. However, the tonnage costs for mining and ore dressing are much higher in the Rocky Mountain states, as may be seen by comparing tax-return statements from the various states. Even before the recent drop in the price of silver, many mines were operating on a very slender margin of profit; labor and supplies cost more. Mining at greater depth has shown most orebodies to grow increasingly more complex, so that improvements in mining and ore-dressing practice have not been sufficient too compensate for the additional expense involved in beneficiating these ores. Geologic Interpretation of Magnetic Exploration on the Mesabi Range, Minnesota ROBERT B. SOSMAN*-When artificial precipitated magnetite is oxidized at a temperature in the vicinity of 100°C, the oxide is converted into a chocolate brown ferric oxide of the formula Fe2O3, free from ferrous iron, yet possessing the same magnetic susceptibility as the original Fe3O4. This form of Fe2O3 is variously called "ferromagnetic ferric oxide," " maghemite," or "gamma ferric oxide," and has been found as a natural mineral. If a body of magnetite in the Biwabik were to oxidize to this form, the oxidized and leached ore body might successfully conceal itself from Mr. Jones' survey by this ferromagnetic pretense. So far, gamma ferric oxide has not been found on the Minnesota iron ranges. INTRODUCTION The Philippines is endowed with mineral resources, much of which still remains unexploited. The country's known reserves, at least for the major mineral commodities, have increased every decade since the first major discoveries more than 80 years ago. Mining, therefore, naturally evolved as one of the pioneer industries and has ever since been a major factor in economic development. The Philippines has entered a new era in mineral resources development and management. One significant feature of this era is the degree to which the government is involved with the industry. In recent years, the state has increasingly encouraged the private sector to carry out detailed exploration aided by governmental contributions through extensive geological and geophysical surveys, fundamental researches and even indirect financial assistance in some specific areas. Significant changes in mineral resources development policies were brought about with the promulgation of Presidential Decree 463 or the Mineral Resources Development Decree of 1974. The Decree provides for a more rational system of administration and disposition of mineral lands to promote mineral resource exploration and exploitation. Various forms of incentives are provided. Foreign entities are allowed to participate in development through service contracts with leaseholders or with the government in the case of reserved areas. The thrust in mineral resources development has been focused on the base metals which as envisioned would provide the foundation for sound economic development. In recent years, however, major strides have been made to promote the exploitation of the non-traditionally produced commodities especially the non-metals. Development likewise point to the growing determination of the government and the private sector to expand benefits from mining. This is evident in efforts to promote downstream processing operations and to encourage investments in exploration, exploitation and mineral processing ventures. The integrated mineral resources development plan, therefore, proposes the vertical integration of mining extraction activities with the processing requirements of the metal-based manufacturing industries. While mining activities shall continue to be carved out by the private sector, the government shall influence the industry's direction by establishing legitimate goals to maximize benefits through an integrated approach giving due consideration to environmental protection and resource needs of future generations. STATUS OF MINERAL RESOURCES DEVELOPMENT Extent of Exploration Application of modem exploration tools and concepts complemented by intense infusion of foreign technology and rapid development of indigenous expertise have enabled the government jointly with the private sector to geologically explore vast grounds and to expand the country's known mineral resources. Approximately 93% of the country's total land area of 30 million hectares have been geologically mapped on at least 1:250,000 scale. Of the 93% total coverage, roughly 37.54% or 11.07 million hectares have been done on scales of 1:10,000 to 1:50,000 as shown in Figure I. Only 3.07% of the total coverage have been surveyed in detail. Land gravity surveys have been undertaken on over 45% of the total, while some 77,300 line km. of aeromagnetic surveys have been flown over 110,000 sq. km. of land area. Processing of data is almost complete. Total magnetic intensity and IGRF-corrected maps are available. Geological interpretation utilizing Landsat MSS imagery and low altitude aerial photography augmented by ground truthing have been undertaken in several large areas with very encouraging results. Beach and offshore mineral surveys were initiated in 1977 and have covered substantial areas in northwest and southeast Luzon and northeastern Mindanao. Highly promising areas for detrital magnetite, chromite, gold and some heavy minerals including ilmenite and titanium have been identified. In the petroleum sector, two offshore oilfields are currently producing from Miocene limestone reefs in Northwestern Palawan. Another field from the same area will be on stream in mid-1982.

Mr. Campbell, who has been a member of the National's Board of Directors and Executive Committee for many years, is vice-president of the Coal Div. of the Eastern Gas & Fuel Associates and in charge of their extensive mining operations in West Virginia, Pennsylvania and Kentucky. Vern H. Christoph has been transferred to Panama Canal Co., Marine Bureau, Navigation Division, Port Captains Office, as an admeasurer at Cristobal, Canal Zone. Eugene Cline, recently graduated from the University of Kentucky, has been employed by Pond Creek Pocahontas Coal Co., at Evanston, Ky. Sanford S. Cole, assistant manager of research at the Titanium div. of National Lead Co., received the Alumni Citation from his alma mater, Alfred University, Alfred, N. Y. This was in recognition of outstanding achievements and services in the field of ceramics which have brought honor to the institution. U. K. Custred, recently graduated from University of Kentucky, and may be reached now at Box 87, Monterey, Tenn. Robert E. Dwyer, executive vice-president of Anaconda since 1940, was recently elected president of this company and its subsidiaries, Chile Copper Co., Chile Exploration Co., and Andes Copper Mining Co. As president, Mr. Dwyer succeeds the late William H. Hoover who died in Butte, Mont.

From the more distant members and some not so distant, the plaint is often heard that they cannot justify the expense and time required to attend the AIME Annual Meeting. Almost invariably, the reason given takes this form: "I just don't see that I would get enough out of it." Often the would-be clincher is added: "Besides, the meat of it all comes out in print anyway." Not long ago, a group of us who have seldom missed a meeting in recent years fell to discussing this phenomenon, and found ourselves in emphatic agreement that anyone holding such a belief indicates by his first remark that he does not know how to attend a convention, and by his second, proves it. He is, by and large, the man who has never been there, and of him, there are many.

Recently there has been a considerable revival of interest in the effects of the various elements commonly added to brass for the purpose of increasing its strength. For many years the work of Guillet2 alone gave reliable information in this regard. Even today his determinations of the coefficients of equivalence of the various elements relative to zinc in brass are those universally employed in industry. This is so because these coefficients have stood the test of time—their substantial correctness has been proved in almost universal practice. It is not our intention to discuss here these coefficients or their use. Rather do we wish to emphasize the need for further systernatic studies of the mechanical properties of the ternary systems of copper, zinc, and other individual elements. Since Guillet published the results of his first investigations Millington, 16 Smalley33 and Thiband 45 have added somewhat to our information. In general they have confirmed the findings of Guillet, which may be stated in the following rather general terms: 1. The addition of aluminum to the 70:30 and 60:40 brasses progressively increases their hardness and strength and reduces their ductility and resistance to shock. 2. The addition of small amounts of iron to a 60:40 brass improves its strength without affecting its ductility. 3. The addition of small amounts of manganese to a 60:40 brass causes a progressive increase in its strength and reduction in its ductility. A considerable amount of information has been amassed in regard to the effect of nickel on brass (9, 22, 41) which it is unnecessary to refer to here, in view of the scope of this paper. The situation in regard to these alloys in 1926 was very clearly stated by an anonymous writer,47 in The Metallurgist of February of that year, whose remarks were so to the point that they are well worth quoting: It will he seen that there are still large fields remaining to be studied in each of these systems (those of the aluminum, iron, nickel and manganese brasses) before our knowledge is adequate. ThiS investigation was undertaken primarily to establish the relations existing between temperature and mechanical properties in molybdenum, nickel, and an aluminum-copper alloy. Mlolybdenutn (m.p. 2500" C.) was chosen because it is partly similar to tungsten and partly similar to the common ductile metals. Also it is known to furnish, by proper treatment, a desirable material to use in studying relation of grain size and physical properties. The molybdenum used was of the quality that is drawn into wire 0.003 in. in diameter for use as filament supports in incandescent lamps; Chemical analysis shows less than 0.1 per cent. of impurities. Nickel belongs to the same class as iron. Its melting point is 1450" C. and an allotropic change at about 370" C. results in a loss of magnetism above that temperature. This feature made nickel doubly valuable for the purposes of these tests. The nickel used was obtained from the Driver-Harris Co. as 0.090 in. (2.3-mm.) wire, annealed; analysis showed 99.8 per cent. nickel and 0.150 per ccnt. iron. Aluminum is one of the low melting-point metals. Some tensile tests at clevated temperatures have been reported by Bengough but the possibility of learning more with the low temperature and sensitive apparatus available rccommendcd this metal. The samples marked A1 arc an aluminum-copper alloy that contains 3 per cent. copper, 0.42 per cent. iron, and 0.21 per cent. silicon. The presence of the copper somewhat coniplicates the analysis of the results; but the action of copper in aluminum has been studied so that its influence might have been foretold, in part at least. The material and analyses were furnished by the Aluminum Castings Co. The nickel wire, which was deformed at 400" C., was drawn under a bath of molten lead and through a die, which also was immersed in the bath. A surface expansion was found to occur sometime after etching in Ti-A1 alloys containing 9.5 to 12.5 wt pct Al. The structure formed, grew, and disappeared with tzrrze. The surface expansion was followed by microscope observations and interferometric and lattice parameter measurements. Activation energy measurements for the growth of the "expansion structure" and chemical analysis indicated that the phenomenon occurred as a result of hydrogen pzckup during etching. It is proposed that hydrogen initially enters octahedral sites of Ti3Al coherent with a Ti and later shifts to the tetrahedral sites. It is postulated that expansion occurs when hydrogen enters the tetrahedral sites. The expansion structure disappeared, it is proposed, because of diffusion of hydrogen from the surface into the body of the alloy and because of loss of coherency of Ti3Al. In examining Ti-A1 alloys, Ence and arolinl observed markings on the surface of specimens. These markings did not appear after electropolishing only, but rather appeared only after etching. The markings appeared to grow as a function of time after etching and later seemed to disappear. Although the markings had some similarity to precipitates, showing, frequently, a Widmanstatten type of arrangement, the observation that other microstructural markings continue to be seen within the new structure suggested that it was actually not a precipitate. The source of this structure was unknown and an attempt was made in the present investigation to develop some understanding of its nature. It has been labeled expansion structure. 1) EXPERIMENTAL PROCEDURE A) Alloys. Alloys in the range 6.5 to 14.5 wt. pct A1 were studied. Bars, 4 in. sq, forged from Bureau of Mines (73 Bhn) titanium consumably arc-melted 4-lb ingots,' as well as 50-g arc-melted buttons of desired aluminum contents were used. The 50-g buttons also used Bureau of Mines titanium (73 Bhn) and aluminum of 99.99 pct purity. Buttons containing up to 8.5 wt pct A1 were hot-rolled from a furnace at 900' . Those with higher aluminum contents were hand-forged on a titanium anvil, and heated with an oxygen-hydrogen torch in the region of 1200" to 1300°c. Frequent reheating kept the samples at the desired temperature range. After a reduction of about 30 pct, the samples were water-quenched. To eliminate any contamination picked up either during hot rolling or forging, at least 1 mil of the surface of the sample was taken off. B) Heat Treatment. Prior to heat treatment all alloys were vacuum-annealed to remove hydrogen. Samples were annealed at 900' until a vacuum of 10'5 mm Hg was established. After this treatment, the samples were wrapped in molybdenum sheet and heat-treated in argon-filled quartz capsules, which were broken under water or iced brine at the conclusion of the heat treatment. All heat treatments under dynamic vacuum were performed in a rapid-quench furnace. This consisted of a molybdenum-lined quartz tube attached to a vacuum system and through a stopcock to a beaker of water. At the completion of the heat treatment the vacuum stopcock was closed, the furnace shut off, and dropped below the quartz tube. Then immediately the inlet stopcock was opened and water admitted until the tube was filled. The steam formed was allowed to escape through the inlet stopcock. This method was used in heat treatments up to llOO°C. C) Metallography. Specimens for metallographic examination were ground, then electropolished using a Disa Electropol machine with a perchloric acid electr01te. Specimens were etched with R-etch.3 A standard etching time of 3 min was used, with the specimen being agitated during immersion. D) Sample Preparation for X-ray Analysis. Samples 0.2 to 0.5 mm in diam were produced from heat-treated rods which were turned to 2 mm diam on a lathe and then rotation-etched. An etchant consisting of 1 pt HF, 7 pt HN03, and 12 pt HzO was satisfactory. With the rod rotating in a vertical position at 50 to 100 rpm, a needle with uniform dimensions could be obtained. Care had to be taken to insure that the rod was at the center of rotation, otherwise cavitation developed. If a small unevenness developed, it was possible to grind it off with a fine emery paper. E) X-ray Diffraction. All X-ray work was done on a North American Phillips X-ray diffraction apparatus and a Jarrell Ash microfocus X-ray unit. The Phillips unit was used with a copper target and nickel filter. The Jarrell Ash unit was fitted with a cobalt target and iron filter. For the Phillips unit 35 kva and 20 ma were used, whereas for the microfocus unit with the 100-p fixed-focus gun 40 kv and 1.5 ma were used. It was found that alignment of cameras on the Jarre11 Ash unit was very critical. The X-ray beam contains an intense area which is not the beam center. The cameras were aligned with the intense region by monitoring the beam coming out of the camera with a Geiger counter. Adjustments were made until a maximum intensity was obtained. A Phillips diffractometer with a Brown chart recorder furnished some of the lattice parameter data. The divergence slit up to 80 deg 28 was I deg; above 80 deg, a 4-deg opening was used, while the scatter slit was1 deg and the receiving slit had a 0.003-in. opening. The general scanning rate was 1 deg per min, while peaks of special interest were rescanned at -j deg per min. Forty-six alloys covering the complete concentration range of the Nb-Rh system were examined by metallographic and X-ray methods; solubility limits of terminal ad intermediate phases and transformation and solidus temperatures were determined. There are nine intermediate phases; two eutectic, five peritectic, two eutectoid, and three peritectnid reactions were encountered. The experimental methods and the constitution diagram are described in Part I. Part 11 deals with the crys -tallography and relation of the intermediate phases. The Nb-Rh system was selected for study for three reasons: first, it was hoped that the anticipated similarity of the Nb-Rh phase diagram to the Ta-Rh1 and Ta-Ir2 diagrams treated earlier (see also Ref. 3) and to the Nb-1r4 diagram treated simultaneously would allow a crystallographic and comparative evaluation of the intermediate phases in these related systems; second, it was likely that the previous experimental methods could be carried over without significant change; and third, it was expected that the interesting mechanical properties of the a1 phase of the Ta-Rh and Ta-Ir systems would also be encountered in similar phases of the new systems, and that these phases could be investigated more closely. The phase diagram had not been treated fully in the literature; only brief surveys of some intermediate phases were found.5-7 It was attempted to cover the details of the phase boundaries, Part I, as well as to present the crystallography of the intermediate phases, Part 11. EXPERIMENTAL METHODS Specimen Preparation and Treatment. The following high-purity starting materials were used. 1) Niobium powder, 99.8 pct pure, mesh size -60 +200, from Wah Chang Corp., Albany, Ore. The analysis furnished by the supplier showed the following major impurities: Ta, <500 ppm; Zr, <500 ppm; 0, 300 ppm; Fe, 280 ppm; Ti, <I50 ppm; W, Si, <100 ppm; C, N, 30 ppm; all other impurities, <30 ppm. 2) Rhodium powder, ground sponge, 99.9+ pct pure, mesh size -80, from J. The work described in this paper was carried out under the sponsorship of the Foreign Economics Administration and in cooperation with the Departamento Nacional da Produggo Mineral, Rio de Janeiro. The project was undertaken to obtain complete data on the variations in washability of coal to be used for coke manufacture in the steel industry and to determine the economy of preliminary hand-sorting operations. The coal-producing industry of Brazil is in that pioneering stage in which operating practices and methods are just being developed. Increased wartime demand for fuel, coincident with a drastic curtailment of foreign supplies due to lack of shipping facilities, has put a tremendous pressure on the national industry to furnish more coal. Under this incentive, production facilities are being -expanded- and new methods of operation are being tested. Such changes are being developed both by improvement of existing methods that originated in the field and by adaptation and modification of methods introduced from the United States and Europe. These mining conditions and mining practices in Brazil are typical of what the American mining engineer will find in many instances when he goes pioneering into the developing coal fields of the Southern Hemisphere. The producing coal fields of Brazil are all in the southern states of that country. The coal measures are in a band roughly paralleling the coast and extending in a generally southwesterly direction from northern Sao Paulo through the states of Paraná, Santa Catarina and Rio Grande do Sul to near the Uruguayan border in the vicinity of Bajé. The accompanying map1 (Fig. I) shows the general location of these fields and also the principal routes of movement of both national and imported coal in a late pre-war year (1940). Cubic zinc sulfide has been grown from molten salt solutions substantially below the hexagonal-cubic phase transition of 1020°C. Crystals free of birefringence have been grown from molten lead chloride at temperatures from 500° to 800°C. Factors affecting the optical transmission and the birefringence are discussed. CUBIC zinc sulfide is of interest for electrooptic devices and as an optical coating material. However, it cannot readily be produced as large crystals which are free of birefringence. The birefringence arises from the fact that the cubic ZnS is usually grown as the high-temperature hexagonal phase and is transformed to the lower cubic phase by annealing.&apos; This results in stacking faults, stress, and birefringence. A requirement for the growth of cubic ZnS is that it be grown below the phase transition of 1020°C.2 Crystals of cubic ZnS have been grown below 1020°C by the hydrothermal,3 flux,4 and vapor transport5 techniques. However, these all appear to have limitations in size or quality of material produced. It was felt that a new flux method might have a good chance of overcoming some of the previous problems. Mita6 reported the growth of hexagonal ZnS from molten NaCl and wilke7 reported the growth of iron sulfides from molten lead chloride solution, indicating that molten chlorides make good solvents for sulfides. An investigation of a number of possible molten chlorides as solvents showed that molten PbCl2 has an appreciable solubility for zinc sulfide and that crystals can be grown at temperatures from 500° to 800°C. EXPERIMENTAL Crystal growth was performed in open or sealed Vycor or fused silica tubes, in an argon atmosphere or vacuum. There were no deleterious effects due to using vacuum; however, a sealed essentially isothermal system must be used to prevent vapor transport mechanisms from dominating. This will be discussed later in detail. Noble metal containers were not usable as they were severely attacked by these melts. The materials used were: reagent-grade PbC12, reagent-grade ZnS, optical-coating-grade ZnS, and Irtran 2 (ZnS). Crystal growth was accomplished by both slow cooling techniques and gradient growth techniques. In the slow cooling techniques, 15 g of ZnS and 100 g of PbCl2 were used. The components were placed in the silica tube, heated at 800°C for 2 hr, and then slowly cooled (l° to 10° C per hr) to 500°C. The furnace was constructed so that the tube could be inverted, thus allowing the liquid to drain off the crystals at the end of the run. The gradient runs were made by placing the above mixtures in a silica tube at 550° to 600°c, Fig. 1. A temperature gradient was maintained such that the floating mass of undissolved sulfide was 10° to 50°C warmer than the bottom of the tube. Growth occurred on spontaneously nucleated sites at the cooler bottom. RESULTS When using high cooling rates (5° to 10°C per hr), crystals form in thin sheets perpendicular to the {111} face. It is convenient to have a consistent system of notation that will allow the representation of the entire range of complex stresses from hydrostatic compression to hydrostatic tension on plastic flow in a single diagram. Such a system is provided by making use of the fact that any complex stress system can be resolved into a hydrostatic tension or compression and a pure shear. Consider a stress system having the principal stresses This system can be resolved into a new system consisting of the three components and three pure shears. If Sm is positive, the net stress effect is hydrostatic tension; if it is negative, the effect is hydrostatic compression. In order to produce a systematic notation, a quantity that will be referred to as the "triaxial ratio" will be defined by the equation _ Sm Tr = Sm - Sm is given by Eq. The cement industry is on the horns of an economic dilemma. Within the last ten years, its over- capacity in the United States has varied from 139- 127% of demand (Fig. 1). The most direct effect of this is seen in cement prices, which reached a peak in 1960, retreated steadily through 1966 and only recently climbed back to the 1960 level again. With prices in a slump and production costs estimated to be up almost 30%, there has been a steady drain on cement profits. Since 1960, labor costs have increased 86% while fuel costs have risen 18%. Meanwhile, customer service costs have also soared owing to the competition for cement customers and the wider variety of available cement products. This search for sales advantage has in turn led to a higher Blaine number, which means more grinding and hence bigger mills, more power, and, once again, higher costs. New plants as well as expansions and revisions to existing plants are also costing more owing to higher

Water laws important to the mining industry are those which govern or affect the right to use water, to dispose of water after using it in mining or milling, and to discharge waste material into watercourses. They include statutes and court decisions having general applicability, as well as others that pertain specifically to mining. THE INDUSTRY&apos;S CONTRIBUTION TO WESTERN WATER LAW Despite sharp differences of opinion, the water law the Spaniards brought to the Southwest appears to have included some form of appropriation of water. The Mormons, who settled in Utah in the mid-nineteenth century, also developed a system of appro-priative water titles. But by far the most profound impact on western water law was made by the gold-seekers who flocked to the Sierra Nevada foothills of California after the discovery of gold in 1848. Much of the gold was extracted from the ground by hydraulic or placer mining, and so the miners&apos; rights to the use of water became fundamentally important. Since there was no organized government in the foothills and no laws other than those made by the miners, they helped themselves to the land, the gold, and the water needed to work their claims.1 They established and enforced regulations governing the acquirement and holding of mining claims and their rights to the water they needed.&apos; In 1879 Justice Field, former Chief Justice of the California Supreme Court, spoke for the U. S. Supreme Court in saying that the miners were "emphatically the law-makers, as respects mining, upon the public lands in the State."" Rules of the California mining camps were based on two essential principles: 1) priority in discovering claims and appropriating water by diverting it from streams and putting it to use, and 2) diligence in working claims and applying water in mining. The customs so developed, which were copied in mining areas of other states and territories, were enacted into law in one western jurisdiction after another. They form the basis of what is called the arid-region doctrine of prior appropriation of water, which received the attention of Congress in legislation recognizing and protecting appropriations of water for mining, agriculture, and other purposes on the public domain.&apos; In several western states a great number of water cases decided in the early years involved relative rights to the use of water for mining purposes or for milling connected with mining." The miner&apos;s inch, the customary unit for measuring water in the mining camps, is still used in various western communities, although its relation to the cubic foot per second varies from one area to another. Undoubtedly, the miners of a century ago made the major contribution to the appropriation doctrine as it is now recognized and applied throughout the West. What inspired the California gold-seekers to develop these principles? Thoughtful writers have pointed out that their regulations and customs were strikingly characteristic of much earlier mining enterprises in the Old World.D It is said that the right of free mining and free use of flowing water therefor —so similar to the California conditions and practices—-was a part of the customs of Germanic miners in the Middle Ages, that it spread from middle Europe to other countries and colonies, and that the doctrine of prior appropriation was widespread in the important mining regions of the world. Certainly the Forty-niners came to California from many countries. It does not tax the imagination to consider that they may have brought with them some knowledge of the old Germanic customs and applied this knowledge in their new environment. RIGHTS TO USE OF WATER IN GENERAL In the West, rights to the use of water of watercourses fall into two categories—appropriative and riparian. The doctrine of prior appropriation is recognized in each of the 17 western states. The riparian doctrine is recognized concurrently with the appropriation doctrine in some of these states but has been abrogated in the others. The riparian doctrine prevails generally throughout the East, although there is now considerable interest in developing something else. Generally speaking, the appropriation doctrine has been highly developed in the West, whereas the principles of riparian doctrine have been comprehensively established in only a few states throughout the country. The subject of water rights is a big one. Space permits no more than a brief discussion of aspects that bear upon the title of this article. RIGHTS OF PRIOR APPROPRIATION Fundamental to the doctrine of prior appropriation is the principle first in time, first in right. Although in some states there are statutory exceptions. the original and still generally prevailing rule is that the first one who initiates a right to divert and use water of a stream, and who completes his undertaking with reasonable diligence, acquires thereby the first right of appropriation of the specific quantity of water involved. Each succeeding right in point of time is junior to all earlier rights but senior to all later ones. The practical effect of this priority system is that when the water supply is not enough for all, the earliest rights must be fully satisfied before any water may be taken by those later in time. Acquirement of Appropriative Rights: Each of the 17 western states has a statute under which water may be appropriated pursuant to a prescribed procedure. Generally, the first step to be taken by the intending appropriator is to file application in the office of the State Engineer for a permit to make the appropriation. Unlike the bituminous part of the coal industry, the production of anthracite has been fairly well publicized; in fact until about 1845 whenever the coal industry of Pennsylvania was mentioned in papers, magazines or books, anthracite only was meant. Beginning with shipments by river in 1820 fairly complete records of shipments were published each year, and as this variety of coal was the only one used for domestic purposes east of the mountains and north of the Potomac, there was considerable interest in the producing fields on the part of the public. Transportation of anthracite was the cause of the building of the early canals in the state, and later, of some of the earliest railroads. In most publications it has been assumed that commencement of shipments in 1820 was the beginning of the industry; this is far from being so, and it is with the earlier developments this chapter will deal, leaving the later and better known records to existing publications. (See Table No. 53.) The first reference to coal in Pennsylvania by Gabriel Thomas in 1698 has already been mentioned,1 it could only have been anthracite in that section; although of course, he never saw any coal there. Little coal was used excepting by smiths for many years after that. In 1728 the Coventry Forge paid the expenses of a man "to town for Sea Coall and Steell for ye hammer;”2 in 1729 New Castle coal was sold in Philadelphia;3 in 1740 an advertisement mentioned, "very good Pitt and Sea Coal at 18 pence a bushel; at which price &apos;tis allowed to be cheaper Fewel for Hearth Fireing than Wood at the present Rates,"4 a view not shared by most of the people there for about eighty years; in 1752 Newcastle coal was again mentioned.5 There are no references to coal in the writings of any of the Moravian missionaries, although some who settled near Mauch Chunk in 1746 said that the Indians there made their pipe heads of a soft black stone, which was much more apt to have been slate than anthracite."
