It is possible to hold a very optimistic view of the future of the U.S. coal industry, and there are those in the coal industry who generally choose to do so. For example, a major coal company stated recently in its annual report, "Coal's prospects appear brighter today than at any period in the past." In order to continue in this state of euphoria, it is only necessary to remind oneself of the following "facts":

require both time and money. Any attempt to secure a quick answer will yield a figure that very likely cannot be substantiated, and certainly will not yield information in the detailed form now desired. It will be about 10 years before a completely new estimate can be prepared for the coal reserves of the United States at our present rate of progress, though of course, much information will be available in the interim. We would like to present such information as we obtain in the form most acceptable to the industry, and to that end we are working closely with coal resource committees of the AIME, the National Bituminous Coal Advisory Council, and the Bureau of Mines. DISCUSSION G. H. Cady*—Mr. Averitt's description of the nature of the coal resources investigations of the United States Geological Survey and the progress of this work is very timely in view of the general interest in the subject of coal resources. The Federal Survey is obviously taking the "long view" with respect to the appraisal of the coal resources as part of the preparation of the general geological map of the country and the attendant determination of the quantity of all mineral and fuel resources. It is apparently for regional surveys of the conventional type that the detailed procedures employed by the Federal Survey are applicable. Even if so it is somewhat unexpected to find the same criteria for evaluation will be applied to the country as a whole. The work on coal resources appraisal has been proceeding at various rates in a number of coal producing states for various periods. Undoubtedly since there has been no common practice in the method of appraisal the states each have worked independently and independently of the Federal Survey, and each has adopted certain practices to meet local conditions. I do not know how much consideration has been given by the U. S. Geological Survey to these practices. It seems probable that such consideration might result in important modifications of the standards which apparently have been set up by the Federal group in line with local requirements. It is the practice in some state surveys to present the facts in regard to the occurrence and distribution of coal beds and their variations in thickness down to thicknesses of 1 to 1 1/2 ft in relatively narrow stages up to maximum thickness. It is then possible for any one using such figures to compile quantitative estimates of workable coal at various minimum thickness limits. This is a desirable objective where surveys are detailed and information correspondingIy good. However, vast quantities of coal lie in beds that are relatively thin about which little information is available and the quantity of such coal might affect the final appraisal to the extent of several thousand million, depending upon the minimum limitation observed. Thus in the case of Illinois a difference of 1 ft in average thickness of coal in the coal field would make a difference of approximately 35 billion tons in the estimated quantity present. One is dealing with a very large area and small differences in thicknesses are very irnportant in the overall picture. The estimate of 10 years to accomplish the sort of detailed appraisal outlined by Mr. Averitt is viewed somewhat skeptically and certainly would require many more trained geologists than seem to be available. The requisite detailed mapping and study are very time consuming not only because of the geological field work required, which is difficult in certain seasons, but also in order to assemble data from company and personal files, and to study drill records and cores, and to sample and analyze the coal. Unless the staff of geologists could be increased in the order of several hundred per cent the prospects are that the appraisal of the type suggested will require many decades not just one. The permanent value of such appraisal, however, is not questioned and it should be expedited as rapidly as means allow. Satisfactory appraisal is not easily achieved and will vary from time to time. The main function of a geological survey is to collect and present the facts that will make possible appraisal in terms of existing conditions by individuals, particularly engineers, qualified by training and expcrience for making such estimates. Thickness and character of the coal bed, nature of the overlying and underlying strata, position, thickness, and character of "partings," relationship to other coal beds, and a variety of other factors must be assembled by the geologist in order to present a complete picture of the geological setting. The economic and engineering factors are in general outside the field of geological experience. The geologist should see to it that the pertinent geological facts are available; much more information than simply thickness and depth of the coal beds is essential to meet all the requirements of appraisal in the future as well as at present. With respect to the present demand by engineers and coal mine operators and others for a rapid re-appraisal of the available coal resources, in the light of existing practices and those in immediate prospect, the Federal procedure of systematic mapping and appraisal is scarcely in line. It will be necessary for those particularly interested in having such an estimate made to establish standards with respect to the various factors involved so that the scope of the geological work can be definitely restricted for the various coal fields. There is little use in setting up general standards since no such standards will be applicable to all fields. Thus it is folly to establish a standard minimum thickness to be generally applicable which is one-half to one-third the minimum minable thickness in some fields. The greatest difficulty in appraisal of the presently actually workable coal bed lies in the variation in the importance placed on roof, floor, structural conditions, bedded impurities. sulphur content and other factors that affect judgment relative to the value of a coal bed. It is doubtful whether any appraisal will have universal approval in view of the variable factors involved. For this reason if none other, the facts should be carefully and painstakingly assembled after the manner of a systematic geological survey such as that advocated by Mr. Averitt. Only upon the basis of sucb information can reliable estimates be made in line with selected conditions. Paul AveRitt (author's repty)— In this paper I discussed, but did not define as such, two major phases of our activities on coal, which are closely related, and which normally we in the U. S. Geological Survey see as an integrated whole. It is understandable, therefore, that Dr. Cady should assume that my remarks applied only to the current work on coal reserves with which I am directly concerned. In view of Dr. Cady's discussion, however, I think a brief summary of the two phases of U. S. Geological Survey activities on coal will be appropriate. The long-term function of the U. S. Geological Survey on coal investigations is to make detailed geologic studies, involving the preparation of detailed geologic maps showing the outcrops and correlations of coal beds, direction and dip of coal-bearing rocks, nature and thickness of overburden, location of faults and fold axes, and similar features. Such studies also yield many measured sections of coal and associated strata, which show variations in the thickness of the beds, and the intervals between coal beds. Taken as a whole, detailed geologic studies provide much useful information for mine operators and engineers. As Dr. Cady points out, this type of geologic work is arduous and time consuming, but it provides the basic data that are necessary both in the development of our coal fields, and also in the preparation of coal-reserve estimates, which are discussed in the next paragraph. This paper deals with the results of a study of the application and development of mining machines for cutting out and removing dirt bands in bituminous coal beds. Face Preparation When one or more dirt bands1 occur in a seam of coal, the problem of elimination of impurities becomes manifest. The degree of completeness to which these impurities arc removed at the face has an important bearing upon labor costs, haulage costs and outside cleaning costs, and often the ash content of the product is markedly affected. Yet, because the present-day miller is paid for the number of tons he loads he often lacks interest in the quality of the coal. To insure a clean product, a system of penalties for dirty coal is enforced, but control of extraneous impurity content in the loaded coal is often inadequate and ineffectual when coal and banded impurity are shot as one. It seems only logical that to reduce the amount of impurities by proper face preparation before the men are permitted to load the coal is the most efficient method of preparation. Many mines with one or more bands of impurities in their seams are able to mine a desirable product with a comparatively small amount of surface preparation. In fact, three companies in West Virginia have recently changed their methods of fact* preparation, with most gratifying results. The first company (in the Kanawha field) after changing its cutting practice with the hope of relieving a sales problem, was rewarded by an approximate 3 per cent drop in ash in the product. Another company, operating in the same field, reduced its ash approximately 4 per cent by a change in cutting practice. The third company (in the Pocahontas field) found the wet washer inadequate in producing a marketable coal, and installed new cutting machines. Three cuts are now being made in each working place, and the results arc so satisfactory that the cleaning plant has been abandoned.

The paper describes the application of the logarithmic wedge sector method of quantitative spectrography to the estimation of commonly occurring minor impurities in crude and refined tin. Both arc and spark methods of emission were employed and with the former a new device was used to overcome difficulties arising from the low melting point of the metal. The impurities investigated included antimony, arsenic, bismuth, copper, iron, lead, and zinc, their concentrations lying, in general, between 0.01 and 0.50 per cent. The results obtained show that the method may be usefully employed for the estimation of bismuth, copper, iron, lead, and zinc, in amounts ranging from 0.50 per cent to well below 0.01 per cent. Arsenic and antimony, however, could not be estimated in amounts less than 0.03 and 0.07 per cent respectively. Out of a total of 116 estimations by arc and spark emission, in 96 the errors were less than 5 per cent of the total quantity of the element present, whereas in the remaining twenty, the errors lay between 5 and 25 per cent. Spectro-analytical data for the several impurities studied are given in the form of tables, and curves correlating line-intensity with concentration have also been included. DISCUSSION (R. G. Smith, London, England (written discussion).—I am interested in Dr Hitchen's account of his investigations on the application of spectrographic methods to the assay of tin and congratulate him on his valuable contribution to the literature on the subject of quantitative spectrum analysis. Some of the results obtained in the course of investigations carried out for the British Non-Ferrous Metals Research Assn., although obtained under somewhat different experimental conditions, may be of interest in connection with this paper. There seems to be dire need of repeated preachment against the too-frequent sad neglect of instrumental surveying and mapping in geological surveys. The value of the map as an illustration of the statements and opinions of a report is too apt to be overlooked; and its essential necessity in working out during its construction the proper conclusions from the observed facts is generally altogether misunderstood. Practical geology seeks, of course, to ascertain and indicate the character of workable or unworkable beds or veins, their depth, position, dip, and horizontal course, or strike, even below the surface; also their outcrops, and therefore, if workable, their extent; and so, taking account of their thickness and specific gravity, their weight in tons. It might, therefore, be called quantitative geology. For the study of more abstruse geological questions, too, it is in many cases necessary to gain some knowledge, or reasonable opinion, in regard to such hidden facts. In some cases, careful instrumental surveys are made; in others, from necessity or choice, there are few or no instrumental observations. It was said, 15 or 20 years ago, that there was an engineer in the anthracite-regions who was capable of telling, on first glancing at a new place, exactly what coal-bed was to be found there at a certain depth, and how thick—a splendid second-sight! "' 0, there be,' " you may be tempted to exclaim, " geologists ' that I have seen' geologize ' and heard others praise, and that highly, not to speak it profanely, "'—but let them pass without being fully characterized, lest the temptation towards profanity be altogether too strong. Yet such second-sight does not exceed the expectations of many men of imperfect geological knowledge, men who have heard of marvel-ously successful geological predictions, but are unaware of

IT is intended to discuss in this paper the protection appliances used for high-temperature pyrometer installations involving the use of platinum couples and describe some of the characteristics of a new carborundum protection tube. Of all the components that go to make a complete pyrometer installation, the one given the least attention and the one about which there is the least exact information is the outer protection tube. This condition is unfortunate as much, and in some cases even the success of the equipment as a whole, depends on the proper type of protection. In the majority of cases, the installation is allowed to operate without attention until some part of the apparatus breaks clown. The outer tube is the component that usually fails and, more often than not, the failure causes breakage of the porcelain protection and ruin of the couple. This condition should be recognized and studied as it has a very important bearing upon the upkeep cost of pyrometer equipment. The cost of the outer protection tube is small compared with the cost of the platinum couple and procelain protection and it would well repay users of this type of equipment to replace their outer protection tubes at certain definite periods, which experience shows is necessary to prevent destruction of the platinum. Speaking generally, platinum thermocouple equipment is used for measuring temperatures over 2000° F. (1094° C.), and is used extensively for the control of brick and pipe kilns, glass pot furnaces, glass tank furnaces, heat-treating furnaces, open-hearth furnaces, and forge furnaces. A satisfactory protection tube must be sufficiently refractory not to soften at the maximum temperature within the furnace. It must be resistant to cracking clue to temperature changes, should be as nearly gas-tight as possible, and should be made of a material with a high thermal conductivity and great resistance toward erosion by the furnace atmosphere.

The general principles of the gas-lift will not be described in this paper. Only specific details that have not been fully discussed in previous papers, or results that do not fully coincide with conditions previously described, will be dealt with. The principal points to be emphasized and for which supporting data are furnished are as follows: 1. Gas-lift installations usually have comparatively high efficiencies as compared with standard pumping equipment, when reduced to a basis of barrels produced per horsepower installed. 2. Advantages of high-pressure plants from the standpoint of operating efficiency and for the application of the gas-lift early in the life of flowing wells. 3. Evidence of increased ultimate yield through conservation of gas by the gas-lift. 4. Possibility of development of new equipment to increase efficiency of the gas-lift. 5. Indications of the advantages of repressuring as a means of stabilizing gas-lift wells and as a means of increasing ultimate yields. TyPes of Installation The gas-lift installations of the more important companies in California have been of the central-plant type wherever field conditions would permit. This has resulted in greater flexibility and lower installation costs per well than could be obtained with individual well units. In general discussions of the gas-lift method of production, the installation costs are frequently referred to as being too high for economical operation. If the field conditions are carefully analyzed and the plant designed with the idea of obtaining high operating efficiencies, the installation cost per well can be lowered sufficiently to compare favorably with individual well-pumping units, when the operating advantages are considered. Much greater production per horsepower can be obtained with the gas-lift than is possible with pumping equipment. In a gold standard world which possesses insufficient metal to meet the every-day needs of all, confidence becomes the vital factor, the very foundation upon which the machinery for the expansion of gold into currency, and credit, rests. The gold supply, affected by many influences, moves constantly from one point to another, but not always to that point where it is most needed. In the period 1928-1930, the combined gold holdings of the United States and France increased $1,370,936,-000, and this with new gold adding only $600,000,000 to the monetary gold stock.Theref ore, the gold stocks of other countries must have been depleted during the period by $770,936,000. This uncontrolled shifting throws the delicately adjusted instrumentalities of both credit and commerce out of equilibrium. If a given nation's gold stock shifts so as to bring it substantially below the legal reserve ratio set up against it for currency issues, the effect can easily extend to the currency issues and banking credit volume of one or more nations which may have based their gold exchange standards upon the gold stock of such nation. Thus the substitution of paper based on gold in place of the actual gold is an inflation of the currency, which carries through into an uncontrolled pyramiding upon the entire machinery of credit based on gold. In 1929 Europe, South America, Africa and Asia had overissued currency based on gold. America, Oceanica and Japan, which have not overissued their gold currencies, would in normal times require their entire present gold stocks and, as Continental Asia is largely upon a silver credit basis, from a domestic standpoint, it would appear that the gold problem is not so much one of maldistribution, as it is one of inadequate supply. It would appear that some method of increasing greatly the velocity of gold, within the safe reserve point, should be devised, or that silver, of which estimates indicate that 7,000,000,000 oz. are available for

This paper outlines the geophysical investigation of the area covering the Darrow salt dome, Louisiana. Surveys with the refraction seismograph and torsion balance failed to disclose the dome, but reflection dip shooting was successful and was confirmed by later drilling. Introduction The Darrow salt dome and oil field lies in western Ascension Parish, Louisiana, on the outside of a sharp bend and on the east bank of the Mississippi River. The dome occurs about 30 miles south of Baton Rouge and 80 miles northwest of New Orleans. Its geology, shape and structure have been ably described in detail by Carroll E. Cook1 and, except for the general features, will not be repeated here. The purpose of this paper is to record some of the interesting and pertinent geophysical data contributing to the discovery of the dome and eventually the oil field. The salt dome is circular in outline and comes to within about 4625 ft. of the surface. At this depth the diameter of the salt plug is approximately 4800 ft. The dome has only a thin cap rock of less than 75 ft. Some oil has been found and is being produced in Miocene sands above the cap rock, but most of the field's production comes from a narrow ring of wells around the east and south flanks of the dome. Producing horizons on the flank are found at 5670 to 5840 ft. in the Miocene and 6890 to 6985 ft., 7028 to 7060 ft. and 8260 to 8270 ft. in the Oligocene. The deepest well that has been drilled is the Humble Oil and Refining Company's Community B-5, on the south flank of the structure, which reached a depth of 10,013 feet. The size and shape of the field and the area of production are indicated on Fig. I. The line showing the area of production encloses all wells now producing and all abandoned producers, both on the top and flank of the dome. This line of production is shown on all subsequent geophysical maps as a direct means of comparing the early geophysics to later drilling development. Darrow dome occurs on the low, flat flood plain of the Mississippi River; it is protected from flood overflow by high artificial levees. The rich loamy soil supports a high degree of cultivation, principally sugar cane. Drainage is secured by many small canals and the water table of the area is at or near the surface. These particular conditions of topography, drainage and top soil greatly influenced the early geophysical picture, and the influence was always unfavorable. Four magnetic fleld balances and several spare magnetic systems were purchased by the Brazilian National Department of Mineral Production from the Askania Werke A. G., of Berlin, in 1932. Preliminary field tests on this new equipment showed one of the vertical component magnetic systems to be defective. A series of measurements designed to investigate the functioning of these instruments, and particularly the defective system, showed it to have an abnormally low magnetic moment, as compared to the satisfactory systems, and a high-temperature correction that was opposite in sign to that which would be expected for a noncompensated magnetic system. Since these systems were of the "temperature compensated" type, this condition indicated an accidental overcompensation. Attempts to correct for this overcompensation by readjustment of the compensating masses on the aluminum and Invar spindles failed because the distance by which the position of the masses could be shifted was insufficient. The temperature effect was reduced by this readjustment but was not entirely eliminated, as was to be desired. Theoretical deductions indicated that the defective condition of the system could be explained as due to three possible causes: (1) considerable loss of magnetic moment of the system; (2) increase in the magnetic temperature coefficient of the laminas; (3) dislocation of the component parts of the system caused by a shock experienced after it left the factory and before it was tested in Brazil. Later information received from the factory after examination of the returned system indicated that the third cause probably played the most important role. Temperature calibrations of the defective system for various positions of the counterweights brought out an important point, which it is believed

The writer looked over the quarry with care in the search for fossils, having in mind shells or corals of fairly large size. In the brilliant summer sunshine, none were observed on the glaring white ledges. The impression was gained that none were present and the statement to this effect was made in the edition of this paper published in the Bulletin' of the Institute for February, 1915, p. 136. On closer examination in the laboratory it has been discovered that the limestone itself is made up of minute organisms, which are clearly revealed by microscopic examination of thin sections. The principal component of the rock is a small foraminifer, 0.1 to 0.3 in. (2.5 to 7 mm.), of the genus Orbitoides, presumably an Oligocenic form. Figs. 1 and 2. illustrate it. The accompanying description has been kindly summarized by Marjorie O'Connell, M. A., Curator in Paleontology in Columbia University, who first detected the evidences of organisms in the rock. Orbitoides kempi O'CONNELL N. SP.1 The foraminiferan which makes up the Seboruco limestone is an Orbitoides of a Species new to North America. The only Orbitoides heretofore described from this country is 0. mantelli from the lower Oligocenic of the Gulf States. This form from Cuba, then, so different in all of its characteristics from the 0. mantelli, is of great interest as perhaps forming a basis of correlation over wide areas. The most closely related Species is 0. dispansa Sowerby, which occurs in the Nummulite limestone of the Eocenic of the Bavarian . Alps, in the Priabona beds of the lower Oligocenic of Massano, and elsewhere in Italy, as described by Gümbel.2 The age of the limestone in Cuba would thus Seem to be of upper Eocenic or lower Oligocenic age, probably the latter. The fossil has the form of a sphere Surrounded by a wavy rim of horizontal extent, the whole resembling two flat-brimmed, round-crowned hats placed base to base. The total extent of the Shell ranges up to 7+ mm., while the thickness of the central sphere is 2.5 mm. in one of the largest individuals. Like all of the other Species of Orbitoides, this form begins with a Single layer of chambers which multiply in one plane and assume a circular outline; but it is in the subsequent growth that the distinguishing specific characters appear, for the chambers at the central portion of the shell increase more rapidly than do those near the periphery and in consequence a Swelling is produced which finally gives the Spherical form which is so characteristic. The rim, on the other hand, shows little chamber-increase and remains thin. This is clearly Shown in the sections figured, where the central row of larger chambers forms the equatorial zone. Radiating from this row, in section, there appear, a number of solid cones alternating with broad reticulated ones. The solid cones mark the more dense structure forming the walls surrounding the reticulated or chambered cones. These appear upon the Surface as distinct pits, whereas the solid part appears as raised walls.

A high temperature calorimeter designed for use up to 1500°K is described and the theory of its operation presented. This calorimeter was used to measure the heats of formation of Na-Sn alloys ranging in composition from tin to Na2Sn. The values tend to support those reported by Kubaschewski and Seith. ONE method of obtaining the heat of formation of an alloy is to measure the heat of mixing of the elements at high temperature. The principal advantage of this method is that the desired quantity is measured directly, while in conventional room temperature methods the differences of the heats of solution of the elements and the alloy in a suitable solvent are measured. A method of improving the accuracy of the high temperature measurements, when the precision of the measurement is lower than that of the heat capacity values for the elements, is to add one component at room temperature to the other at the high temperature, so that part of the heat of reaction is dissipated in heating the cold component to the high temperature. Thus, only a fraction of the heat of reaction is measured, and a result of higher precision is obtained. The limitations of the high temperature technique are that volatile systems cannot be studied, and that many alloys melt at temperatures higher than those at which the calorimetric apparatus operates readily. Nevertheless, a calorimeter operating at 1500°K would be useful in investigating many of the lower melting alloy systems and the low melting mixed oxide systems. A unit designed for these applications was built and is described here. The Na-Sn system was chosen for investigation because the temperature involved, 880°K, would adequately test the operation of the calorimeter. Further, the data reported in the literature for the various alloys of sodium and tin differ markedly, and it was hoped that this investigation would help to fix the values of the heats of formation in this system. Design of Apparatus A detailed discussion of the considerations involved in the calorimeter design is given by Mc-Kisson and Bromley,' and a brief summary follows. Fig. 1 shows a sectional view of the calorimeter. The inner graphite chamber is maintained at constant temperature by means of the circulating molten tin bath in which it is submerged. The tin is contained in a graphite vat. This unit comprises a thermostat whose heat capacity is about 7000 cal per "C. The main heating element consists of a machined graphite spiral with a room temperature resistance of about 1/2 ohm. These parts are separated from the powdered carbon external insulation by the cage, a cylindrical graphite chamber. The electrical insulators and separators, the auxiliary heater spool, and the loading tube liner are made of sintered alumina. The tin vat stirrers, the sample stir-rer, the melt thermocouple well, and the power leads are made of molybdenum. The auxiliary heater is wound with molybdenum wire and serves to compensate for the heat loss up the loading tube. All of the individual components in the high temperature region of the calorimeter will withstand at least 2000°K, and the various contacting materials should easily withstand 1500°K. The external container for the insulating carbon powder is a copper shell upon which copper tubes are soldered to serve as cooling coils.

The oil business has been relatively quiet in Wyoming during 1934. Only 34 producing wells were completed, 54 dry holes were drilled, and at the end of the year only 30 wells are listed as drilling. Wyoming still has a large reserve of production shut in, mostly in black oil or asphaltic base fields in the northwestern part of the state. The total oil production increased from 11,171,500 bbl. in 1933 to 12,539,470 in 1934, but light oil production continued to decline, and the increase was made by black oil fields. This is partly due to natural decline of light oil fields, especially Salt Creek, Big Muddy and Lost Soldier, but largely because of increased demands for road oil. The Rocky Mountain states spent much money to build and improve roads and a greater amount of road oil was used. The refining of black oil to manufacture road oil produced gasoline as a byproduct that slightly decreased the demand for light oil. The Oregon Basin and Frannie fields, in the Big Horn Basin, moved into second and third places in the list of producing fields in Wyoming because of their increased black oil production, and Big Muddy and Lost Soldier, light oil fields, dropped back. Wyoming stayed close to its allowed production, which was based on the needs of the refiners and purchasers. This activity in black oil resulted in a few more wells in the fields of the Big Horn Basin, but the greatest amount of drilling was in the shallow Osage field in eastern Wyoming. Osage supplies many little topping plants and at the close of 1934 there was not enough oil available there to supply all of them. In the Lost Soldier field and Salt Creek, one major company was rather active in a campaign to deepen, clean out and repair old wells to increase production, and the figures of that work are not included here. Of the light oil fields, Lance Creek promises to be most active during 1935, since the two wells in the recently discovered Sundance sand pool are producing and more wells will he drilled. With wildcatting almost at a standstill, two new oil fields were discovered in Wyoming in 1934. Legal and legislative matters constituted the outstanding features of proration in Texas in 1932. From East Texas emanated most of the political, legal, technical and industrial activity. Conroe and Thompson developed into fields of major importance. Proration orders were issued by the Railroad Commission on many of the producing fields of the Gulf Coast and West Texas not covered in previous years. In Yates, Penn Pool, Winkler, Van, the Panhandle, North Texas and West Central Texas there were 110 changes of importance, except in allowables. New proration schemes were introduced in East Texas, Conroe, Thompson, Saranosa, Government Wells, Tuleta and Howard-Glasscock. Little progress was made in administration or technical development. Legal and Legislative Matters Proration first began in Texas in 1927 as a voluntary attempt to divide the market outlet of a field on an equitable basis. The statutes then in existence were considered somewhat archaic and the Railroad Commission's authority was limited. Subsequent efforts to strengthen the laws were not wholly successful. The 1929 Conservation Act made no mention of market demand but declared that the term "waste" did not mean " economic waste." With the passage of the Pipc Line Act of 1930, providing for ratable purchasing, it was the opinion of many lawyere that a legal means of proration had been found. The 1931 law had ths same provision as that of 1929 with respect to economic waste but specifically prohibited limiting of production to market demand. The law passed Nov. 12, 1932, omitted reference to economic waste and specifically provided for limitation of production to reasonable market demand. Vigorous attacks were being made in State and Federal Courts on the constitutionality of the laws and the validity of the Commission's orders. In Peoples Petroleum Producers, Inc. et al. vs. Lon A. Smith et al., which had been heard before a three-judge U. S. District Court in Houston on May 28, 1932 and again on Sept. 19, the Court's decision for plaintiffs, released Oct. 2, influenced in a large measure the calling of the Legislature and the passage of the Market Demand Law on Nov. 12.
