This paper analyzes the opinion in Bragg v. Robertson, 72 F.Supp. 2d 642 (S.D. W.Va. 1999), a case which threatens the future of surface mining in West Virginia and which will almost certainly result in new policies or rules that will affect surface mining everywhere. This paper addresses: (1) the jurisdictional bases of the action which relies on the federal surface mining laws to enforce a state mining program; (2) settlement agreements reached in the case that threaten to alter federal policies beyond West Virginia borders; (3) a programmatic environmental impact statement on mountaintop mining being undertaken by the federal government; and (4) an opinion by the Court outlawing excess spoil disposal in intermittent and perennial streams.

Flotation behavior, of magnesite and dolomite pure minerals was studied separately. Rice bran oil (a source of fatty acid ) was used as a collector for both minerals . The aim of this study is to find a separating zone in the flotation of these pure minerals to be used in the separation of their mixture. Factors affecting the flotation process, such as pH and collector, were studied. It was found that magnesite can be separated, from its mixture with dolomite, in the pH range of 5-7. At this pH range flotation recovery of dolomite reaches~98% where magnesite reaches ~20% only. Besides, the effect of collector concentration on the flotation shows that the separation of magnesite from dolomite is feasible at a collector concentration of 3x10-4 M. At such concentration, dolomite recovery reaches ~98%, where magnesite reaches 25%. The differences in the flotation behavior of dolomite and magnesite were investigated by studying the adsorption isotherms of rice bran oil on magnesite and dolomite surfaces. The adsorption study indicates that while there is an excessive adsorption on dolomite surface, the adsorption density on magnesite was restricted to be lower than monolayer capacity. The adsorption behavior of dolomite and magnesite was discussed in the light of their solubility and crystal structure. It was found that due to the higher solubility of dolomite than magnesite, Ca2+ and Mg2+ ions are available and more reactive on dolomite surface increasing collector adsorption. In addition, it was indicated that dolomite mineral has a crystal lattice structure more compatible to the geometry of the fatty acid carboxylic group than magnesite. However, the adsorption of collector on dolomite surface is more compact and more regular than on magnesite surface.

Samuel G. Bonasso The article by Benavides and Schuster provides an in-depth study of three transportation alternatives for a four-mine complex in western Kentucky. The examination of aerial tramways was not undertaken as an alternative solution. We feel this is an oversight since industrial ropeways are competitive with both belt conveyance and overland truck hauling. In fact, there are aerial tramway systems, operational today, which are 100 years old and operating with some original components. Maybe unfortunately, there are no fixed rules or guidelines whereby the most cost-effective means of transporting and handling material for a given situation may be selected. Each situation must be evaluated so the variables that influence the selection of the desired alternative can be clearly defined. However, there are in-place industrial ropeway systems that have proven economically feasible over a range of 1.6-50 km (1-31 miles). The more difficult the terrain, the greater the cost efficiency.

Currently six economic heavy mineral deposits are known on the Penholoway Terrace. These are (from south to north) the Green Cove Springs Mine (GCS), Boulogne Mine, Folkston Mine, Mission, Lulaton, and Ludowici. The GCS deposit is located to the west of Highway 17 between the towns of Green Cove Springs and Palatka in the state of Florida and has been mined since 1972. To the north, the erosion created by Black Creek restricts the northern extension of the orebodies and to the south a karst depression and erosion by the St. Johns River restrict southern extensions. The deposit is 20 miles long and up to 4.5 miles wide. Deposit thickness is from 5 feet up to 45 feet. The deposit is a series of regressive barrier island sequences deposited during the Pleistocene along the ancient Penholoway and Wicomico shorelines. The initial transgression of the ocean up to the location of the western Henry orebody was an extensive sea-level still stand as evidenced by the unit thickness and stacked transgressive regressive sequences. This period was followed by sporadic regressing seas and still stands, progressing eastward and stranding the sand bodies which make up the East Extended, TE, and East TE Ridge orebodies. The orebodies are underlain by predominantly non-mineralized fluvial sands and occasional back barrier lagoonal deposited clays. There is a predominance of wetlands on the southern extents of the zone as the surface elevations decrease due to a large karst depression.

Giant gold deposits are considered products of crustal-scale systems. Reduced fluids stored in mid to lower crustal reservoirs were discharged into mid to upper crustal sites of deposition. Elements of the architecture include crustal-scale structures, reduced packages of rock and regional seals. Gas-rich aqueous fluids were common but non-aqueous fluids may have been significant in the deeper parts of the systems. Fluid fluxes in over pressured domains were maintained by porosity waves. Abnormal heat input from the mantle may not be required once the systems were perturbed. Fluid-mixing and hypogene enrichment were probably the most significant precipitation processes.

At the present time, whether an electric utility uses high-sulfur coal is largely determined by geographical location, clean air legislation, and the age of the power plant. Acid rain legislation may well be the new force to change the use of high-sulfur coal. A number of coal papers were presented at the SME Fall Meeting in St. Louis, MO, Sept. 1986. These papers discussed high-sulfur coal in relation to its economics, trends and prospects, value of cleaned coal, and coal-cleaning technology. The Clean Air Act of 1970 required the reduction of SO, emissions from most stationary electric-generating plant to 0.5 kg (1.2 lbs) SO2, per million Btu of heat input. It was possible for many plants to utilize lower-sulfur coal or a mixture of high-sulfur and low-sulfur coal to meet this emission requirement. This 1970 act greatly increased the use of low-sulfur western coal. The 1978 amendment to the Clean Air Act required all new plants to use Flue Gas Desulfurization (FGD) to meet a requirement of 70% reduction of potential SO2 emissions to 0.3 kg (0.6 lb) SO2 per million Btu of heat input. With the requirement to use FGD, there was little or no demand for low-sulfur western coal in new eastern power plants. If' new acid rain legislation is enacted, it likely will require sizeable reductions in SO2, emissions by existing coal users. There might then be a shift to greater use of low-sulfur coals. The low-sulfur coals could come from either western or eastern mines or from cleaned eastern coals. Economics will dictate the approach older power plants will take to meet new regulationsuse FGD or low-sulfur coal. Coal use for electric power generation has changed from 1970 to 1985. Table 1, (Land, preprint 86-333) shows the change. The table shows that in 1985, US utilities used about 255 Mt (280 million st) of high-sulfur coal. Some 45 to 54 Mt (50 to 60 million st) of high-sulfur coal is being used in plants equipped with FGD and most of this use is in eastern states. This leaves 200 to 209 Mt/a (220 to 230 million st) of high-sulfur coal being used without FGD treatment. These plants are at risk if acid rain legislation is passed. Most of these plants are in the east and are more difficult to supply with low-sulfur coal. Estimates range from $20 to $30 billion capital investment and from $5 to $9 billion dollars per year operating costs to reduce SO2, emissions from those old medium-to-high-sulfur coal-burning plants. G. W. Land, (preprint 86-333), also presents tables relating to power generating costs and coal types. The author's tables are extracted from Land's tables IV and V. Table 2 here presents costs for a new plant. This includes the impact of different heat rates, fuel costs, fuel qualities, operating and maintenance costs, labor costs, and waste disposal costs. Table 3 compares estimated costs to retrofit an older plant with a limestone scrubber versus switching the same plant to low-sulfur eastern or western coal. Costs of switching include upgrading the electrostatic precipitator and - with western coal - costs of derating. Bhagwat, (preprint 86-325), details the trends in high-sulfur coal markets from 1974 to 1984. He also gives some prospects for high-sulfur coal markets, 1984 to 1994. The prospect depends mostly on whether acid rain legislation is enacted. By 1994, if New Source Performance Standards (NSPS) continue to be applied, high-sulfur coal demand from six mid-west and eastern states is expected to increase by 27 Mt (30 million st). • L. A. Twin 1250 m (4100 ft.) long highway tunnels through Cumberland Mountain near Middlesboro, Kentucky are planned to be completed in the early 1990's. The tunnels will be excavated in sandstones, limestones, and shales, dipping at 35 to 50 degrees and striking nearly perpendicular to the tunnel alignment. In 1985-86 a pilot tunnel was excavated as a crown drift along the alignment of the southbound tunnel. The benefits of the pilot tunnel in reducing uncertainties for main tunnel construction are discussed. The cost-benefits of the pilot tunnel are examined in view of estimated main tunnel costs.

This paper presents an evaluation of tailings dam incidents from the 1994 USCOLD Tailings Dam Committee report. Comparisons are also made with water storage dam incidents from USCOLD reports and recent tailings dam incidents. The evaluation results show that tailings dam incidents are due to a number of factors including overtopping, static and seismic instability, seepage and internal erosion, and foundation conditions, and that no particular type of tailings dam or operational condition is more susceptible to incidents. In addition, the results confirm that tailings dams should be located, designed, operated, and reclaimed with a thorough knowledge of site conditions, mill operation, site monitoring, and tailings characteristics.

INTRODUCTION The need for cleaning and recovery of fine (minus 28 mesh or 0.5 mm) coal fraction has increased in recent years. This results from realizing a substantial recovery of ultraclean coal from the waste stream improving overall Btu (heat) recovery, providing extra revenue for the coal industry. Also the potential of using the clean coal so obtained for making coal-water mixture which could replace oil. An additional benefit of recovery clean coal from the waste stream is reducing environmental concern of burning uncleaned coal and in waste disposal. Deashing of coal by physical beneficiation processes is limited by the degree to which ash components are liberated from coal. Conventional processes have been inefficient in terms of Btu recovery, for ultrafine coal. Chemical cleaning methods, which involves leaching of ash material from coal, have provided ultraclean coal at high Btu recoveries, are more costly than the physical cleaning methods. An advanced physical separation technique that appears to address the need discussed above is selective flocculation. This technique which has been successfully utilized in iron ore beneficiation offers the potential of processing fine and ultrafine coal to produce a clean fuel. OBJECTIVES The main objective of the present study is to investigate applicability of selective flocculation technique for recovery of clean coal product from the waste coal slurry supplied by the Peabody Coal co., from their three different coal preparation plants. It is also the objective of the program to conduct preliminary economic study of the selective flocculation process.

The Silver Line Phase III Project is the final one mile underground segment of the new Bus Rapid Transit in downtown Boston. The project is expected to significantly reduce existing and anticipated traffic congestion. The twin one-lane tunnels and two station platforms will be built by NATM in Boston saturated soft clay, sand and till layers in proximity to several historical buildings, underpinning two existing cut and cover subway stations and several major utilities in densely built urban area. This paper presents the analysis and design of the NATM tunnels and stations detailing the excavation sequence and support system and various ground improvement and pre-support techniques used in the preliminary and final design of the project

Bentonite clay is used as a binder for iron ore concentrate pelletization. Bentonites are sensitive to cations such as calcium, magnesium, sodium, and potassium that are known to be dissolved in the moisture remaining in the iron ore concentrate. These cations affect the ability of bentonite to absorb water, as measured by the plate water absorbance (PWA) test. This paper addresses the relationships between plant water chemistry and pellet strength for a wide PWA range of bentonites. Experiments were conducted to determine the effect of concentrate moisture solute chemistry and bentonite PWA value on the wet knock and wet and dry compressive strengths of iron ore pellets. Experiments used seven different types of bentonite that had PWA values ranging from 564 to 1033. Flushing plant concentrate with distilled water to remove the dissolved cations resulted in increased pellet strengths, to a widely varying degree, for each bentonite tested; wet knock values increased an average of 92% and dry compressive strength increased an average of 46%. In addition, pellet strengths were not found to be directly related to the ability of bentonite to absorb distilled water, measured by the PWA test.

However, these emerging products bring both new opportunities and new challenges to the field of industrial minerals. One of the primary challenges is from alternative materials other than industrial minerals. Thus the question is asked whether industrial minerals will truly benefit from the growth in market applications for composite plastics. This article highlights some of the opportunities for industrial minerals while focusing on performance and competitive demands on mineral products intended for use in this developing market.

1.0 PROLOG Since the "end" of the Cold War, revolutionary new research and commercial remote sensing capabilities are being developed that will dramatically change the way we map the earth and address its environmental problems. The technology challenge is not the growth of new environmental remote sensing technologies themselves. It is, rather, how these new innovative observing systems can be accepted and used to the benefit of both the regulatory and the mining communities in the light of present concerns about unknown risks of discovery and liability. To keep Homestake's Bulldog Mountain silver and lead mining and milling operation in southwestern Colorado workable, natural ground water and decant water from the mine's sand backfilling operation must be continually pumped from the workings. Left untreated, this water exceeds maximum allowable levels for various contaminants that may be discharged to the environment. To comply with regulations, a National Pollutant Discharge Elimination System (NPDES) permit was obtained and a mine water treatment plant for heavy metals removal was constructed in 1977. Due to equipment capacity and operational problems, and the lack of on-site technical personnel and analytic equipment, the first water treatment plant could not consistently meet permit limits. In 1979, Homestake entered into a consent decree with EPA and the Colorado Department of Health, calling for the construction of a water treatment facility to meet NPDES permit limits. Initial construction began in the spring of 1980 and the plant now produces effluent acceptable for discharge.

Introduction The growing role of Colombia as a major supplier of internationally traded steam coal has been widely discussed in the industry. Although Colombian coal has been produced and exported in small quantities for a number of years, the country's position as a major coal exporter began in earnest in 1985 with the first commercial exports from the Cerrejon North Block Project. The mine is located on the Guajira peninsula in northeast Colombia, about 145 km (90 miles) from the coast (Fig. 1). In addition to the mine itself, the project involves construction of a dedicated railroad and port. This forms a modern, efficient, and integrated system. The project is embodied in a 50-50 association contract between International Colombia Resources (Intercor), a wholly-owned subsidiary of Exxon, and Carbocol, the Colombian state coal company. Intercor and Carbocol share investment and operating expenses equally. Intercor has the additional responsibility of managing operations on behalf of the partners. Each partner is entitled to 50% of the coal produced, and each markets its share separately. The project is a multi-seam, truck and shovel operation, based on large reserves (2 to 3 Gt or 2.2 to 3.3 billion st) of high quality bituminous coal. Exports began in the first quarter of 1985, at modest levels through what is called Early Coal Facilities. The permanent coal handling system began operation in February 1986. Production will increase rapidly in each of the next few years, reaching the design capacity of 15 Mt/a (16.5 million stpy) in 1989. Based on available resources, however, the resource will support expansion, and continued growth in production into the 1990s is feasible. Importance of transportation The success of a new coal export venture, such as Cerrejon, depends heavily on efficient transportation. In the international coal industry, overland and ocean transport can in some cases account for 40% to 50% of the final value of the product. Many coals, such as western US subbituminous coals, cannot reach export markets at all because of their low heat content and great distance from export markets. By the same token, low-grade resources are often commercially attractive for local markets even in the face of competition with much higher quality coals from distant sources. The 2000 inductee, guest of honor and featured speaker at the banquet will be Ronald C. Cambre, chairman and chief executive officer of Newmont Mining. He will be honored for his role in positioning Newmont as an innovative and key player in the gold mining industry.

The Galatia Mine is a dual-seam underground coal mine located in Saline County, IL. In 1984, it became the first coal mine to be permitted by the Illinois Department of Mines and Minerals to operate diesel equipment underground. And it is one of the larger underground coal mines in the nation to use diesel equipment. From the beginning, Kerr-McGee determined that diesel equipment offered the best approach to the safe and productive development and operation of the Galatia Mine. The flexibility of this equipment and its ability to promptly respond to changing conditions and mining locations made its use desirable for building this large dual-seam coal mine. The mine had a planned nominal annual capacity of 3.6 Mt/a (4 million stpy) and would employ more than 500 people. Galatia's current reserves are estimated at 231 Mt (255 million st) of recoverable coal from two seams of high-quality, high-volatile bituminous coal. The Harrisburg No. 5 seam is shipped primarily as a low-sulfur steam coal or as a metallurgical blend stock. It is also used in the pulverized coal injection (PCI) process for steel making. The Herrin No. 6 seam is a medium-sulfur coal. Annual production is shown in Fig. 1. A good indicator of a mine's success is employee productivity improvement. For many reasons - the proper use of diesel equipment, the introduction of longwalls and increased employee ex¬perience - Galatia employees have achieved a steady growth in annual productivity (Fig. 1) while maintaining an exceptional safety record.

For the past 30 years, surface mines have moved toward more highly mechanized, automatic systems that continuously mine overburden and ore to increase productivity, lower operating costs and minimize manpower needs. To achieve these goals, mine operators must be involved in every step of the machine procurement process. Several factors are involved in making the machines operate economically and efficiently: -Prudent engineering. -Proper planning. -Realistic feasibility studies. -Effective specification. -Thorough training of the mine personnel.
