The consumption of barytes in certain paints, polyurethane foams, seamless flooring, glass, brake linings, plastisol gaskets for food containers, and in fluids used for gastrointestinal X-ray examinations relies on the unique properties of barium sulfate. There are no readily available mineral substitutes. Barytes are also the essential raw material for the manufacture of industrially important barium chemicals. High quality barite ore has become scarce throughout the world. Processing ore into quality end products is both capital and energy intensive. These factors have tended to limit availability and increase Prices which have encouraged the use of alternative or competitive materials and restricted market growth.

s-plutonium samples possessing a strong growth texture have been produced by allowing them to transform under pressure from p to a. A fiber texture with [010] parallel to the pressure axis results. The textured samples are expected to be useful in determining the effects of crystallographic orientation on the physical properties of a plutonium, and initial results of measurements of resistivity and mechanical properties are described. THE crystal structure of a plutonium1 is mono-clinic, P21/m, and many of the metal's properties should reflect the crystallographic anisotropy. Unfortunately, it has not yet been possible to grow useful sizes of single crystals of a plutonium. Therefore, few of plutonium's orientation-sensitive properties have been determined as a function of crystallographic orientation. One way to gain information about at least some of the orientation-dependent properties is to study a highly textured sample. Such samples have been produced by cold rolling a plutonium,2 but they are necessarily very small in one dimension. We have now successfully used two other techniques to produce highly textured samples, not limited to small thicknesses. METHODS OF PRODUCING PREFERRED ORIENTATION The texture is produced by causing the plutonium to transform from ß to a while under pressure. It was observed by Gardner3 that applying a compres-sive load during the transformation resulted in the formation of columnar grains of a plutonium, and Cramer4 observed a similar structure in some diffusion couples rolled in the P phase. Neither of these workers, however, investigated the subject beyond these observations. The more flexible of the two methods developed is that of compressive loading. The technique is to enclose a sample of plutonium in a die assembly before applying the load. It is possible, of course, to dispense with the die and simply press the sample between two platens. In this case, however, the unrestrained sample deforms during the pressing, making it difficult to maintain the load and to control the final sample thickness. This compressive loading technique has been used on specimens ranging from 1/4 to 3 in. diameter, with height-to-diameter ratios ranging from 5 : l to 1:6. The procedure begins with loading the sample, a right cylinder of a plutonium, into the pressing die. Plastic deformation of the sample while it is being pressed is minimized by machining the sample so that its diameter is nearly the same as that of the die barrel. Then the loaded die assembly is placed in a vacuum pressing can that fits on a hydraulic press. After a vacuum is achieved the die assembly is heated to 180°C and equilibrated. The load is then applied and the specimen and die are allowed to cool to about 40° to 50°C before the pressure is removed. The resulting sample is composed of rod-shaped a -plutonium grains, the rod axes being parallel to the cylinder axis and the pressing direction. Photomicrographs of the oriented structure are shown in Fig. 1. Although most of the specimen is composed of grains whose rod axes are parallel to the cylinder axis, a thin, peripheral layer consists of rod-shaped grains whose rod axes are perpendicular to the cylinder axis. Presumably, the highly plastic nature of p plutonium leads to approximately hydrostatic conditions during the initial stages of the P — a transformation under pressure. At this time, the grains in the peripheral layer would have grown parallel to the local force direction. During the latter stages of the transformation, the accompanying volume contraction would have eliminated the radial forces, leaving only the axial force and resulting in the growth of the observed structure. E., BRETHERTON, San Francisco, Cal.:-Since preparing my paper, our chemist, F. L. Wilson, has been experimenting with Leadville, Colo., oxidized zinc ore and Leadville zinc sulphides containing lead, operating upon 40-1b. lots at a time. His results on Leadville sulphides are as follows: The raw ore contained a trace of gold, 5.04 oz. of silver, 19.1 per cent of zinc, and 7.24 per cent of lead. After roasting the ore contained a trace of gold, 5.72 oz. of silver, 0.75 per cent of copper, 21.7 per cent of zinc, and 8.29 per cent of lead. The loss in weight by leaching was 38.8 per cent. The extraction was 42.8 per cent of the copper, 80.6 per cent of the zinc, 7.1 per cent of the lead, 0.64 per cent of the silver, and no gold. The little .silver that is extracted would be thrown down with the copper when precipitating it from the zinc and both thrown hack into the residue to be smelted. There would be no trouble in smelting the residue with nearly all the sulphur eliminated and containing less than 7 per cent. of zinc. On zinc carbonates containing silicates the results are not satisfactory. H. O. HOFMAN, Boston, Mass. (communication to the Secretary*) :¬The paper by Mr. Bretherton upon the application of ammonia and carbonic acid to the recovery of zinc as oxide from roasted sulphide ore is of interest to me, as the first installation of the Schnabel process for the extraction of zinc from a mixture of zinc oxide, lead oxide (with some cupric oxide), and pellets of enriched lead, produced in steaming liquated zinc-silver-lead crust of the Parkes process, was made at Lautenthal, Harz mountains, where I was chemist. In that capacity I carried out numerous experiments on the Schnabel process, was active in the erecting of the plant, and later had charge of it. After the Lautenthal plant had been in operation for some time a similar one was built at Hoboken-les-Anvers, but both have been abandoned, as the wet process could not compete with the distillation of the liquated zinc-silver-lead crust, now used universally in the Parkes process.

air-lift and equipped with tapered tubing of proper design, we would have a gas input consumption of about 2500 cu. ft. per bbl., which at 3 to 4c. per 1000 cu. ft. would be 7 1/2 to l0c, per bbl., and there would be very infrequent loss of production due to stoppages. It has been demonstrated that with efficient design of air-gas lift, the production of wells can be increased much beyond that obtained with the former type of air-lift employed; also that small wells can be operated by air-lift with tapered tubing at a cost that places this method in competition with beam pumps in many fields. The next step in conservation that the writer expects to have an opportunity to demonstrate is that of restoring the pressure in a pool and producing by air-gas lift all of the oil possible to lift economically. This combined operation is probably the method toward which we shall eventually be working in recovering the maximum quantity of oil from pools where the oil is recovered through bore holes. General Discussion on the Air-gas Lift H. P. Porter, Tulsa, 0kla.—The papers presented at this meeting contain a great amount of valuable information. Wonderful progress has been shown in the development of air and gas-lifts. There has been nearly everything brought out that touches upon the subject. The real point that is lacking is exact knowledge of the velocity with in the flow column which will produce the best effect—that is the thing we must know more about. Velocity in Gas-lift Flow In other lines of industry the matter of velocity of fluids in pipe lines has been well analyzed and there are known laws by which to calculate velocity of flow; for instance, in irrigation work large pumps are designed with intake pipos to employ an intake velocity of 4 ft. per scc. By reduced cross-sect'ion the velocity is increased rapidly as it enters the pump and the discharge rate is at 12 ft. per src., which in turn is reduced in the discharge column to 4 ft. per sec. Crushed coal, grain and granular material is found to be best conveyed by air when a pneumatic conveyor is employed at 100 ft. per sec. As in the design of a pumping plant or a pneumatic conveyor, the velocity at the lower end of the column in the flowing well must be controlled within certain limits for best results. Mr. Griswold, I believe, stated that they had velocity as low as 15 it. per scc. and from that up to 78 ft. per sec. Mr. Pierce and Mr. Lewis showed an ideal flow column showing how the velocity increased as the fluid was carried up the column, hut did not give any figures as to the velocity. It would be well to take that sort of a diagram to establish an ideal velocity at the lower or intake end, and then calculate the velocity from expansion of the gas as it goes up. It may be that the, ideal intake velocity would vary, depending on the depth of the well, the quantity of liquid to be handled or the pressure which it may be desired to hold. The subject is one that might be worth much research.

Coke with low phosphorus content is required by some of the electrometallurgical and chemical plants recently attracted to the Pacific Northwest by the hydroelectric power available from Bonneville and Grand Coulee dams. Shipping such coke into the area from eastern points involves a high freight charge, and during wartime consumes precious rail and ship-bottom space, so it is highly desirable to produce coke from the coking coals of Washington to meet the requirements of these industries. Although coke has been made from Washington coals since 1884, little has been known about their phosphorus contents or about the extent to which phosphorus could be reduced by cleaning, An investigation was undertaken, therefore, to determine the manner in which phosphorus occurs in the coking coals of Washington and its amenability to removal by ordinary coal-washing methods. Previous Work Phosphorus is a deleterious element in coke used for numerous metallurgical processes, including the production of pig iron, yet comparatively little published information is available on the occurrence and elimination of phosphorus in any of the coals of this country. A variation from 0.009 to 0.062 per cent phosphorus in various horizons of the Pittsburgh bed in the Connellsville region of Pennsylania has been reported,' and a reduction in phosphorus content from 0.020 per cent in the raw coal to 0.018 per cent in the washed coal was obtained in washing coal from the same bed in the Pittsburgh area;2 the latter figures represent average analyses for a year's operation of the washery on about 800,000 tons of coal. A reduction in phosphorus content from 0.018 to 0.011 per cent in washing coal from the Pittsburgh bed at another washery was observed, and the same report provides data on the phosphorus reduction obtained by separating 10 other coals on a bath of 1.35 specific gravity.3 European investigators have been especially active in correlating phosphorus content with petrographic analysis; fusain and durain generally contain the highest percentage of phosphorus, but this relationship is not universal.4 Some of these investigators have found that phosphorus is removed in the coal-washing process,5 but others have observed that the clean coal contained as much or even more phosphorus than the raw coal.'

The predominent method of coal mining in the United States for years has been room-and-pillar mining. The reason for this has been the advantages of room-and- pillar method which is a relatively flexible system and its capital investment. The room-and-pillar method permits some selectivity in mining, especially where gas wells, faults and possible coal quality may be a factor. The mobility of continuous and conventional mining equipment used to develop entries may also be used for retreat mining of rooms and pillars. Longwall mining of coal takes place along a long straight face, or wall, blocked out between two butt or panel entries. The long faces or walls are normally projected in lengths of 61 to 183 m (200 to 600 ft) in this country. The longwall method of mining had its beginning in the United States during the 1800's. During that period, pack wall and wood posts were used for roof support. The longwall face was mined by miners using picks to undercut the coal. To keep the coal face from turning over, short wood posts called sprags were set in a slant position as the coal face was undercut to the depth of two to three feet. When the under-cutting cycle was completed, the sprags were removed to permit the coal to fall from the roof pressure. The longwall mining of coal did not take a firm hold during the 18009s, and room-and-pillar prevailed. In the early 19009s, steel jacks were introduced, and along with it, the modified caving theory. In March of 1950, a retreat longwall mining system, utilizing a plow, manually operated props, wood cribs and chock releases, was installed in one of Eastern Associated Coal Corp.'s mines.

A numerical technique has been developed to permit estimating the pressure gradient associated with laminar flow of thixotropic liquids through long Pipelines. For this purpose the pipeline is divided into a number of radial and longitudinal increments within which rheological properties of the fluid may be considered as constant at any time. Then, provided only that the fluid flow curve is defined at every duration of shear, it is possible to predict the instantaneous pressure gradient at any cross-section along the pipeline for each desired flow rate and pipe size. The technique consists of an iterative integration of shear rate to establish the appropriate value of the wall shear stress at each location. Consistency of fluid in the increment is determined by the flow history of that increment, while the radial flow associated with variations in velocity profile is accounted for by adjusting the width and radial position of the increment. A number of pressure profiles, computed at each of several flow rates, provide a convenient basis for pipeline design and pump selection. INTRODUCTION In recent years considerable attention has been given to predicting pressure drop associated with the isothermal laminar flow of time-independent non-Newtonian fluids in pipes and annuli. 6,11,12 The approach generally has been to develop analytical relationships between flow rate and pressure drop based on simple constitutive models which hopefully provide an approximate description of the rheological properties of the fluid. Analytical solutions are highly desirable since the influence of all pertinent parameters can be readily determined. Unfortunately, however, this approach is restricted to simple flow geometries and- frequently leads to erroneous results due to inadequacies in the model. In certain cases a solution may be obtained through applying appropriate numerical techniques.l,14 For example, a digital computer program is available for predicting the velocity profile and pressure drop encountered by any Newtonian or time-independent non-Newtonian fluid flowing under laminar conditions in a cylindrical pipe or annulus.l In this paper the consistency behavior of the fluid need only be described in terms of basic rheological data. Analyzing flow systems involving fluids with time-dependent rheological characteristics is considerably more complicated since substantial changes in consistency may occur because of sustained shear action. This sensitivity to shear frequently persists for several hours. Consequently, variations in pressure drop and/or flow rate resulting from the aging process and addition of unsheared or partially sheared fluid to the system must be considered for purposes of pipeline design. This paper outlines a numerical method for predicting the transient and steady-state laminar flow behavior of a thixotropic liquid in a pipeline of arbitrary length (i.e., at a specified constant flow rate, the instantaneous pressure gradient may be determined at any time after start up and at any location along the pipeline). Several such pressure gradient profiles, computed at several flow rates, may be combined to produce a complete portrait of the system response. This flow portrait provides a reasonable basis for pipeline design and for selecting a suitable pump characteristic. TIME-DEPENDENT RHEOLOGICAL BEHAVIOR The most familiar time-dependent rheological properties are those exhibited by thixotropic liquids. Many of these materials, particularly thixotropic crude oils, generally display an apparent yield stress in that a finite pressure gradient is required to initiate flow. IN September 1939, the Ohio Copper Co. inaugurated the treatment of its copper-bearing mill tailings at Lark, Utah. These tailings had been accumulated during the regular operation of the Ohio Copper mine and mill over the period 1907 to 1919. Gravity concentration had been employed except for a comparatively short period in 1919, when flotation was used. The ore milled during that period assayed about 1 per cent Cu. The chief copper mineral, chalcocite, was disseminated in a shattered quartzite, mainly along fracture or cleavage planes. The quartzite gangue was extremely hard and grinding to liberation resulted in excessive sliming of the "sooty" chalcocite, with consequent high tailings losses. Recovery on the seven million tons treated was probably less than 6o per cent of the total copper content. As early as 1918, attempts had been made to sample the dump. In 1928, a complete sampling program was undertaken. The sampling consisted of seventy-four 5-in. post auger holes drilled to the full depth of the dump at regular intervals of 250 ft. Each 10-ft. portion thereof comprised a sample for analysis. Each sample was screened, rolled, divided into three parts, dried and assayed. The reject was retained for testing purposes. From the depth of the auger holes a contour map of the dump was plotted, Fig.1, which gives percentages of tonnage and copper content. The tonnage within the limit of the drill holes was estimated at about five million tons with an average content of 0.42 per cent Cu, 31 per cent of which (0.13 per cent) was acid-soluble. A screen analysis of the composite dump sample is shown in Table I. Flotation tests by several companies and individuals were then made, the results of [ ] which ranged from 62 to 74 per cent recovery. On the basis of these, a Zoo-ton pilot plant employing straight flotation was built and operated for a few months. Operation of this plant was unsuccessful, as no provision had been made to handle the copper-bearing solutions resulting from the water-soluble copper, a point that was overlooked in the laboratory test work. Attempts to decant the copper-bearing solution for precipitation in the usual manner ahead of flotation were not satisfactory because of low water recovery (owing to poor settling characteristics of the pulp) and contamination of the copper precipitate with unsettled slime. The number of wells completed in Ohio during I940 was about 20 per cent more than during the preceding year, the comparative totals being 1020 and 1228. Of the 1940 completions, 327 were oil wells, 491 gas wells, and 410 dry. The completions for the past five years, divided into oil wells, gas wells, and dry holes, are shown in Table 2. Wells drilled deeper and input wells in water-flood areas are not included in the tabulation. The annual production of oil has decreased steadily in Ohio from the maximum of 23,941,000 bbl. produced in 1896. Table 3 shows the quantities of oil produced in the last five years. In 1940, the total was 3,052,000 bbl., produced by about 25,500 wells. The number of wells and the approximate quantities by grades are shown in Table I. The symposium on production for the year 1942 contains no papers on the foreign situation except those on Argentina and Mexico. It has always been the policy of officers in charge of the symposium to refrain from publishing information that might possibly injure national or private interests. At the close of the war we hope again to publish full and accurate records of production abroad. Excerpts From Circular to Authors In order to facilitate interpretation of the data in this chapter, we print the following excerpts from the Circular to Authors. The field is the unit in this tabulation. In cases of fields extending across State boundaries, such as Rodessa, it is suggested that each State author treat the section of the field in his State as a unit, and by a footnote indicate that the field extends into an adjacent State. Each space in Table I may represent one of four possibilities; either it is not applicable to the particular field, or the proper entry is not determinable, or the proper entry may be determinable but is not determinable from data available to the author, or the proper entry is determinable. When spaces are not applicable, leave blank; in spaces where the proper entries are determinable but not determinable from data available to the author, please insert y; in spaces where the proper entries are determinable by the author, make such entries. y implies a Rope that in some future year a definite figure will be available. The entry of a zero is a positive declaration, and it is an important declaration where it is in order. Inability to determine precisely the correct entry for a particular space should not lead the author to insert merely y. Contributions of great value may be made by the author in many cases where entries are not subject to precise determination. In such cases the author should use his good judgment and make the best entry possible under the circumstances. For many spaces the correct entries represent the opinion of the author (for example, "Area Proved") and in such cases the entry need not be hedged to such extent as when the quantities are definite yet can be ascertained only approximately by the author. IN times like these, the A. I. M. E. and similar societies have their greatest usefulness. . . . Individuals and companies acting alone in the development of public opinion are merely voices crying in the wilderness. United and organized they make a great force that can and does influence public action. . . . What part, if any, then, shall the A. I. M. E. take in these great stabilization processes of civilization? Shall it help to give direction and force to scientific knowledge which comes within its field of activity or shall it merely develop more of it? . . . Is it the A. I. M. E.'s function to help bring system, order and direction out of this situation so that the world can again have forward economic movement, or should it rest on its oars until other agenciess develop that public understanding and direction so necessary for economic progress? As we understand the functions of the A. I. M. E. Petro¬leum Division, they are to discover and promote knowl¬edge for the benefit of society on the mining of oil and gas. To the individual member of the Petroleum Division, there are certain advantages of social and professional contacts, but the collective purpose is that described. And the individual is benefited by membership only as the Division measures up to the purposes of its existence. Consequently, the welfare of this Division and that of its members depends on the extent to which it keeps pace with the needs of society on matters relating to the mining of oil and gas.

The objective of the study is development of an analytic process based on rock and explosive properties which allows the prediction of the stress distributions and fracture zone around explosive charges. A computer program has been written for this purpose, using a finite difference approximation to the momentum equation, to describe the motion of the surrounding rock by step-wise integration. Its application provides ground motion data such as stress components, displacement and particle velocity as a function of position and time with respect to a spherical charge. The effect of tensile and shear failure on these ground motion parameters can be included. The analytic procedure contained within this program has been used to predict peak stress as a function of distance in rock for rock-explosive combinations for which field data exists to determine peak stress levels directly. Two methods have been used for the spherical charge which in the analysis replaces the actual cylindrical charges: instantaneous application of peak pressure to a charge having a radius equivalent in contained volume to a charge having a length to diameter ratio of 1, and gradual pressure build up to peak pressure with a charge radius equivalent in contained volume to the total charge used in the field test. The agreement with field data would appear best with the latter treatment. The peak stresses obtained are in closer agreement with field measured peak-stress and a better approximation to field stress wave duration exists in the case of gradual pressure build up. One of the assumptions made in the analysis is that, in the case of cylindrical charges, the explosion pressure rather than the detonation pressure of an explosive establishes the peak stresses in the

One of the greatest factors in our industrial development is cheap and convenient power. Long-distance electrical transmission has now reached such a stage that it is feasible, and practicable, to utilize the water-power of the country which was heretofore too remote for consideration. In all of the changes of energy from its various sources to its electrical applications, water-power stands pre-eminent in point of economy. Power-users the world over have endeavored to utilize this force in preference to any other, and until long-distance transmission was found practicable it seemed that every available water-power in this section of the country was doing its full share for the benefit of mankind. The success of each great industrial development has been clue in a greater part to some one man one who is just a step in advance of the rest in his particular field; one who is able to grasp a situation and foresee possibilities; and, above all, one who has that indomitable pluck and perseverance which sees in each obstacle one more step toward success. Such a mail is Eugene L. Ashley, for it was through his efforts that the development of the greatest power on the Hudson river was made possible. For several years prior to 1897 the various properties along the river between Glens Falls and Palmer Falls were in the hands of speculators. These men knew the value of waterrights, but they had not the ability to assemble the properties and finance such an undertaking. In 1897 Mr. Ashley began buying these water-rights, and, after two years of litigation, title mas secured to all of the properties along each side of the river, and the Hudson River Water-Power Company was organized to construct a dam and transmit power to the surrounding cities and villages. L. C. UREn,* BerkelEy, Cal. (written discussion).—I heartily concur with Rlr. .Fobs concerning the need for advanced courses on various phases of Petroleum Engineering. I think that his criticism is probably true of most of the engineering schools that are specializing at all in Petroleum Engineering, that is, that most of their so-called graduate courses are not of graduate caliber but are merely more specialized aspects of undergraduate subjects. It would undoubtedly be to the advantage of the petroleum profession if more advanced work could be offered in a few of the leading engineering institutions so that there would be something substantial to offer graduate students wishing to return after a period of undergraduate work, for additional training. There is no doubt but that a better trained engineer, more useful to the oil industry, could be secured from schools offering such advanced training. The problem of adpting our instruction to fit the needs of engineers trained along other lines who wish, after completion of their undergraduate work, to enter thc petroleum engineering field, is a more difficult one. It has been my experience that such men are usually sadly deficient along certain lines and that they are really not prepared for the more advanced work in Petroleum Production Engineering until they have gone back over the work which they have missed in their undergraduate training. I note that Mr. Fohs suggests that other eastern and western colleges not now stressing Petrolelim Engineering, should be encouraged to take up advanced work of this character. With this, however, I cannot agree unless the institutions arc also prepared to offer a full sequence of undergraduate work on which the more advanced courses may be superimposed. Whether or not there is a need for additional engi-ncering colleges entering the petroleum engineering field is an open qucstion. I believe that we arc turning out enough petroleum engineers at the present time and that none of the six institutions now specializing in this field arc overcrowded. Morc-ovcr, they are fairly well distributed over the country, though there may be room for an additional school in the field in the eastcrn section of the United States. F. W. Padgett, Norman, Okla. The symposium on production for the year 1940 contains few papers on the foreign situation. It is probable that the foreign part of next year's symposium will be even shorter. This is due to rigid censorship in various countries, as the question of the volume of petroleum supplies has become one of great strategic importance. This is even more true than in the last war, owing to greater mechanization of armies. 'It has always been the policy of officers in charge of the symposium to refrain from publishing information that might possibly injure national or private interests. At the close of the war we hope again to publish full and accurate records of production abroad. Excerpts from Circular to Authors In order to facilitate interpretation of the data in this chapter, we print the following excerpts from the Circular to Authors. The field is the unit in this tabulation. In cases of fields extending across State boundaries, such as Rodessa, it is suggested that each State author treat the section of the field in his State as a unit, and by a footnote indicate that the field extends into an adjacent State. Each space in Table I may represent one of four possibilities; either it is not applicable to the particular field, or the proper entry is not determinable, or the proper entry may be determinable but is not determinable from data available to the author, or the proper entry is determinable. When spaces are not applicable, leave blank; in spaces where the proper entries are determinable but not de-terminable frod data available to the author, please inserty; in spaces where the proper entries are determinable by the author, make such entries. y implies a hope that in some future year a definite figure will be available. The entry of a zero is a positive declaration, and an important declaration where it is in order. Inability to determine precisely the correct entry for a particular space should not lead the author to insert merely y. Contributions of great value may be made by the author in many cases where entries are not subject to precise determination. In sucli cases the author should use his good judgment and make the best entry possible under the circumstances. IN any manufacturing business, it is of vital importance that the management should know the exact cost of the units of production. Without such knowledge, a company can sell blindly in the open market, obtaining the best prices it can in competition with other firms, and manage perhaps to continue in business for a time; but at any moment, and especially in a period of falling prices, such a firm is at a loss to know exactly at what point it can sell at a profit and exactly how much it is losing per unit if it sells below that point. Furthermore, it is necessary not simply to know the exact total cost per unit, but to know definitely all the different-factors which enter into that cost. A firm manufacturing pocket knives had been doing a profitable business for many years when it began to earn smaller and smaller profits, until there was scarcely any profit at all being realized. Being unable to determine exactly what its future policy should be, it called in experts who studied the past records carefully and followed out for a period a better cost, system. Investigation then showed that on several different kinds of knives in common use, a small profit per unit was being made. On a number of special kinds of knives, of which the firm was very proud, it had been forced to cut prices under the pressure of outside competition and had believed that a small profit per unit was still being made on that product, while a detailed cost analysis showed that a loss was being incurred on each knife of that kind produced. It then became clear that the company must either give up the special line and concentrate wholly on the cheaper knives and extend their sales to territory not yet developed; or expand its plant and produce more of the higher grade knives and thus lower the cost per unit enough to make money on the higher grade knives also, if conditions warranted such expansion. Investigation revealed that the market for large quantities of the high-grade -knives was decidedly uncertain and that the most promising move would be to manufacture only the less expensive knives on a larger scale. That plan was carried out and the concern began again to make a better profit.

THE development of the natural resources of any district of any magnitude, inevitably gives rise to many problems off title, usually due to the greatly enhanced value of the land. The development of the mining industry in the Quapaw Agency has been no exception to this general rule. Our problems, how-ever, have not been many or particularly serious. The Quapaws were allotted and patents issued by the United States Government in 1895. These patents contained a restriction against alienation for a pe-riod of twenty-five years. The effect of the restric-tion was to prevent the Indian from selling, leasing, or in any way encumbering his land. The Govern-ment, in a paternalistic spirit, sought to teach the Indian thrift and industry and to insure him a place of residence. This is evidenced by the first Leasing Act passed by Congress, which permitted only incom-petents and those physically disabled to lease their land for either agricultural or mining purposes. The able-bodied Indian was denied the right to lease. It soon became apparent to the Government, how-ever, that this was a mistaken policy, and in 1897 a General Leasing Act was passed by Congress and it was under this act that the mining industry in the Quapaw Agency was developed. The act, reads as follows: "That the allottees of land within the limits of the Qua- paw Agency, Indian Territory, are hereby authorized to lease their lands, or any part thereof, for a term not ex-ceeding three years, for farming or grazing purposes, or ten years for mining or business purposes. And said al-lottees and their lessees and tenants shall have the right to employ such assistants, laborers, and help from time to time as they may deem necessary: Provided, That when-ever it shall be made to appear to the Secretary of the Interior that, by reason of age or disability, any such allottee cannot improve or manage his allotment properly and with benefit to himself, the same may be leased, in the discretion of the Secretary, upon such terms and conditions as shall be prescribed by him. All acts and parts of acts inconsistent with this are hereby repealed." It was the interpretation of this Act that gave rise to our first serious problems. It will be noted that the Act says that "allottees of land" within the limits of the Quapaw Agency are authorized to lease their land. Thus, the first question was presented by the use of the term "allottee," and the question was as to whether or not Congress intended to limit the Quapaw Indian to the leasing of his own allotment or did Congress mean that the term "allottee" was synonym-ous with "Indian" and intend to give the Indian a right to lease both his allotment and his inherited land and was an Indian without an allotment an "allottee" even though he was a member of the Qua-paw tribe and the owner of the Quapaw land by in-heritance, and not being an allottee, could he lease his inherited Quapaw land under the authority granted in this Act?
