SYNOPSIS It can be shown that the properties of intact rock are relatively unimportant in rock slope stability and that failures are controlled by structural discontinuities such as bedding planes, joints and faults in the rock mass. The frequency, orientation and inclination of these discontinuities as well as their strength characteristics are important factors to be considered in any rock slope analysis and their influence will be demonstrated by means of a number of practical examples. Methods for determining the mechanical properties of discontinuities will be reviewed and the interpretation of the strength test results for use in stability computations will be discussed.

INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation. SILVER Bell is situated 35 airline miles northwest of Tucson, Ariz., in a small, rugged range rising above the extensive alluvial plains of this desert region. Its geographical relation to other porphyry copper deposits of the Southwest is shown on the inset map in the lower left corner of Fig. 1. The climate is semi-arid. Altitudes range within 2000 and 4000 ft. Opening of the Boot mine, later known as the Mammoth, in 1865 was the first event of note in the district's history. Oxidized copper ores containing minor silver-lead values were mined from replacement deposits in garnetized limestone and treated in local smelters. Copper production had approached 45 million pounds by 1909 when the disseminated copper possibilities in igneous rocks were recognized. Extensive churn drill exploration carried out during the next three years resulted in partial delineation of two copper sulphide deposits, the Oxide and El Tiro. Although the then submarginal tenor discouraged exploitation of these disseminated deposits, selective mining of orebodies in the sedimentary rocks continued intermittently until 1930, providing a production total of about 100 million pounds of copper. The American Smelting & Refining Co. began exploratory and check drilling in 1948 and subsequently made plans for mining and milling the Oxide and El Tiro orebodies at the rate of 7500 tons per day. Production began in 1954 at a rate of about 18,000 tons of copper annually. Formations ranging in age from Pre-Cambrian to Recent are exposed in the Silver Bell vicinity. The more erosion-resistant of these, Paleozoic limestone and Tertiary volcanics, predominate in the scattered peaks and ridges comprising the Silver Bell mountains. The porphyry copper deposits are located along the southwest flank of these mountains in hydrothermally altered igneous rocks. These are principally intrusives which cut Cretaceous and older sediments and are considered to be components of the Laramide Revolution. For three-fourths of its length the zone of alteration strikes west-northwest, Fig. 1. There now is no single structure that accounts for this alignment. However, indirect evidence suggests that a fault representing a line of profound structural weakness existed in this position prior to the advent of Laramide intrusive activity. This line will be referred to as the major structure. It was obliterated by the Laramide intrusive bodies but exerted a degree of control on their emplacement, as evidenced by their shapes and positions. The influence of fault structures on the shapes of intrusives in other porphyry copper districts has been noted by Butler and Wilson' and by others. As shown on the inset map on Fig. 2, a fault of parallel trend and considerable displacement lies to the north. This fault is now marked by a line of small Laramide intrusive bodies. To the south is a third fault of large displacement. Evidence of its age in relation to the Laramide intrusions and mineralization is not recognized, but its conformance in strike with the other two major faults is significant. These three breaks establish a pronounced trend of regional faulting. They are high-angle, and the southerly one may be reverse, Stratigraphic separations on these faults are of the order of several thousand feet. The local Paleozoic section is about 4000 ft thick. It is composed predominantly of limestone with a basal quartzite member. The Cretaceous section appears to exceed 5000 ft. Conglomerates, red shales, and arkosic sandstones (the youngest) characterize the three principal members. Intrusion of alaskite marked the beginning of Laramide igneous activity. It was emplaced as an elongate stock with one side closely conforming to the major structure line throughout a distance of nearly 4 miles. The alaskite was at one time regarded as a thrust block of pre-Cambrian rock'; however, its intrusive relationship and consequent post-Paleozoic age has been established by inclusions of limestone found in outcrops north of El Tiro. The next event was the intrusion of a large stock of dacite porphyry into Paleozoic sediments and alaskite. The stock was some 3 miles wide and at least 6 miles long in a northwesterly direction. It was sharply confined along its southwest side by the major structure line. A number of large pendants of moderately folded Paleozoic sediments occur within and along its southwest edge. Thus the inferred, original major fault between Paleozoic and Cretaceous sediments became a contact between alaskite and Paleozoic sediments and then a contact between dacite porphyry and alaskite. Andesite porphyry may have been intruded later than the dacite porphyry, but relationships are not clear; it may be simply a facies of the latter. The intrusive activity was at this stage interrupted by an interval of erosion. The erosion surface probably was rugged, as there were local accumulations of coarse, angular conglomerate. Subsequently a series of volcanic flows and pyroclastics several thousand feet thick was deposited. A similar unconformity has been recognized elsewhere in the Southwest, particularly in the Patagonia Mountains near the Flux mine some 75 miles southeasterly. Here, as at Silver Bell, volcanics were deposited on an erosion surface cut in Cretaceous and older sediments which had been intruded by alaskite. Though no evidence is offered that closely defines the age of this unconformity, and proper analysis of the problem is beyond the scope of this paper, it is

Before Capitol Hill hearings, primary metal producers are often called "concentrated industries" because there are relatively few companies in each category and most of them are large corporations. Capitol Hill still looks on large companies as inherently wrong, but there are about as many arguments one way as the other. Encourage Imports? Now comes Assistant Attorney General for Antitrust Richard W. McLaren to say that imports of metals and other basic materials should be encouraged to create competition for the concentrated industries here at home. Cloakroom analysts are wondering how this ties in with President Nixon's cabinet task force studying the copper price structure. This is chaired by Dr. Hendrik Houthakker, a member of the White House Council of Economic Advisers who has also indicated that the use of imports to pull down prices may be one way to create less inflation.

And it would be hard to find a mineral region less sought by capital. So many promising mines have come to grief here (perhaps because they were too "promising"), SO many "processes" have been tried and abandoned, so much expensive machinery has been bought and thrown aside, that to invite money here for investing in gold mines is almost sure to cause a smile of incredulity, or a sigh of disappointed hopes. PRIoR to 1936, the Ontario Refining Co. received all incoming blister copper from The International Nickel Company's smelter in the usual form of 460-lb. cakes, or slabs. These were received in open cars in lots of 250 pieces. At the refinery the cakes were unloaded onto narrow- • gauge cars, for convenient handling and pickup by charging cranes. In March 1936, an investigation was started on the feasibility of transferring converter copper in the molten state from the smelter to the refinery anode furnaces, a distance of 1 1/4 miles. Although common in steel practice, the transportation of blister copper in this form had not previoisly been attempted and a preliminary study of the various factors involved was therefore necessary. For this purpose, a series of experiments was made in which molten copper, removed at different stages during the furnace cycle, was held in a small portable holding furnace. This vessel was essentially a refractory-lined steel cylinder provided with ports for filling and emptying, heated by an oil burner. Dimensions of the steel shell were 3 ft. 10 in. diameter by 7 ft. 3 in. long, and thickness of refractories depended on the design and combination used for the particular experiment. The vessel was filled with approximately 2 1/2 tons of copper at a predetermined temperature, the lining having been preheated to a definite point by means of an oil burner. All openings were well luted and temperature readings were made every 15 min. by means of an immersion-type thermocouple. In this manner the rate of heat loss resulting with different refractory design could be developed. The ratio of exterior surface to weight of metal was taken into consideration in comparing the experimental results with what might be expected for a full-sized unit, and observations were also made on type and degree of slag accretion. It was not possible to get as much information on this latter point as desirable, but all evidence showed that the problem would be control of slag build-up rather than attack on refractories. The recovery of arsenic was started at the Washoe Reduction Works (later called the Anaconda Reduction Works) in 1904, when an arsenic plant was constructed adjacent to the lower end of the 60-ft. main flue.' This plant originally consisted of a Brunton roasting furnace for treatment of flue dust and a small reverberatory furnace for treating the crude arsenic produced in the roasting operations, together with the necessary kitchens for condensation of the fumes and grinding and barreling apparatus for preparing the refined white arsenic for market. The Brunton furnace was fired with wood. It was 14 ft. 6 in. in diameter with two outside fireboxes. The hearth revolved upon a central shaft. The charge was fed through a dust-tight hopper on to the center of the hearth and slowly moved to the outer edge of three rows of stationary rabbles fastened in the roof of the furnace. There was a 3-ft. space between the hearth and roof. A crude arsenic was condensed from this furnace. The hot flame from the fireboxes passed directly over the charge, vaporizing the As203 that was carried through brick flues to the condensing chamber. This chamber was 8 ft. high, 16 ft. wide and 240 ft. long, divided into small kitchens by partitions spaced every 7 ft. It was connected with the main flue system to provide draft and to receive any losses from the chamber. The small kitchens were connected by openings in such a way that the fumes took a zigzag course, causing them to come in contact with the cold walls and ceiling and condense the arsenic. There was an opening from the outside into each kitchen, for the removal of the deposited arsenic, which was closed by a wooden door. The refining furnace was a small coke-fired reverberatory having a hearth 10 by 20 ft. in dimensions. It had three hoppers through which the crude charge was introduced, and one firebox placed at one end. The hot gas from the burning coke passed over the charge, volatilizing the arsenic and carrying it to the kitchens.

Experimental production of Al-Si alloys, containing from 33 to 55 pct Al, by direct reduction of aluminum silicates in a three-phase arc furnace is described. Advantages of a smelting technique utilizing hogged wood waste as part of the reductant and for temperature control are discussed. WORK on the problem of producing aluminum by smelting has been in progress since the middle of the eighteenth century. Early work met with little success and in 1782 Lavoisier, an eminent French chemist, expressed the belief that alumina could not be reduced by carbon. It was almost a century later when the Cowles brothers developed a process for the production of aluminum alloys by reducing alumina coincident with the reduction of other metal oxides. In practice, the other metal oxide was usually copper. In 1907 it was first shown that alumina alone could be reduced by carbon at a temperature of 2200°C. The metal produced was volatilized and lost or recombined with the oxides of carbon formed in the reaction.' For a number of years after the Cowles brothers abandoned production of Cu-A1 alloys because their product was not commercially competitive with the aluminum produced by the Hall process, there was little interest in thermal reduction processes. After World War I interest in such processes was renewed and a number of patents were issued on processes for the production of A1-Si alloys.' , "he function of the silicon in these processes was the same as the function of the copper in the Cowles brothers process, namely, to prevent the reduced aluminum from recombining with the oxides of carbon and to promote absorption of the aluminum vapors set free at the high temperature required for the reduction reaction. The advantage of using silicon in place of copper for this function is that silicon has a higher boiling point (2600"C) than copper (2310"C) and its oxides, combined with aluminum oxides, occur in nature in almost unlimited quantities. No A1-Si alloys have been produced commercially in the United States, as far as is known. However, considerable experimental smelting of aluminum silicate materials has been done by the TVA at Wilson Dam, Ala.' Quantitative X-ray diffraction studies of the precipitation of thorium in a Mg + 3.3 Th + 0.51 Zr alloy (HK31A) in both the as-cast and cold-worked states show that the precipitation may be described by f = 1 - e(t/T)1/2 over most of the aging period. The effects of cold work and temperature changes are determined. The precipitation of tile equilibrium Mg-Th compotund is Preceded by the formation of a transition phase of higher thorium content, with the cowposition Mg2Th and with a Laves-phase structure. Thorium-containing alloys of magnesium have assumed considerable commercial importance, especially for applications requiring exposures to temperatures greater than 500°F for appreciable lengths of time. The principal commercial wrought alloys in this system are HK31A, containing nominally 3 pet by weight thorium and about 0.7 pet by weight zirconium: and HM21A. containing 2 pet by weight thorium and 1 pet by weight manganese. These two alloys retain a high level of properties even after exposures of 100 hr at 600°F, while the more common alloys containing aluminum and zinc are badly overaged by these conditions. Therefore, in order to obtain some insight into the mechanism by which thorium produces high temperature stability in these wrought alloys, it seems desirable to investi- gate the effect of temperature and mechanical working on the precipitation processes involving thorium. Since the scattering power of a thorium atom for CuKa X-ray radiation is about ten times that for a magnesium atom, the magnesium alloys containing about 3 pet by weight thorium are ideal for quantitative measurements by X-ray diffraction of the amount of Mg-Th compound present at any time. Such quantitative measurements should be of theoretical importance in the study of the effects of time, temperature, and deformation on precipitation and precipitation hardening. Of the two commercial alloys, HM21A and HK31A, the latter is certainly the most suitable for study: In the Mg-Th-Zr2 system, only Mg-Th compounds need be considered, since no ternary compounds or binary Th-Zr3 and Mg-Zr4 compounds exist. TITANIUM has been estimated to comprise about 0.65 per cent of the earth's crust and ranks fourth in abundance among the metallic elements suitable for engineering uses. In spite of this, applications of titanium for structural purposes have not as yet been developed. Its commercial exploitation has been largely confined to the chemical industries and the production of paints and pigments; no doubt because of the difficulties that lie in the way of preparing the pure ductile metal. Published reports, however, indicate that ductile titanium can be prepared and possesses some unique properties. This, together with the occurrence in this country of several important titaniferous deposits, has led the Bureau of Mines to investigate processes for the production of metallic titanium, 'methods required for its fabrication, and the properties that may be produced in this interesting metal. METHODS OF PREPARING METALLIC TITANIUM Many early investigators claimed to have isolated metallic titanium; but in the light of present knowledge, it seems that they really had produced various mixtures of carbides and nitrides that have a metallic appearance but are brittle, hard, and unworkable. The first metallic titanium pure enough to be malleable when cold was produced by Hunter1 in the early part of the twentieth century. Kroll,2 van Arkel,3 and Fast,4 subsequently confirmed the facts that pure titanium is a ductile metal and that small amounts of impurities were responsible for previous reports of brittleness. When heated, titanium reacts chemically with various gases, such as hydrogen, oxygen and nitrogen; if the volume of gas thus absorbed is too great, the metal becomes brittle and unworkable. The principal difficulty in making ductile titanium is prevention of such contamination, and the success of a given process may be judged by the completeness with which it solves this difficulty in a practical manner. Of the gases mentioned, hydrogen is the least objectionable, since its absorption by the metal is completely reversible and, although dimensional changes occur and absorption of hydrogen embrittles the metal, the gas may be removed readily by heating in a high vacuum for a short time. On the other hand, the absorption of oxygen or nitrogen results in the formation of permanent 'solid solutions of the oxide and nitride, which cannot be decomposed by the strongest reducing agents2 with sufficient completeness to restore the inherent ductility of the metal. During the last few years the use of base-metal thermocouples has increased very considerably in various industries, due to the necessity for more precise control of temperatures. The base-metal couple has the advantages of being robust to a surprising degree, cheap as compared with platinum couples, sufficiently accurate for most operations, rapid in indicating changes in temperature, easily renewed or repaired, and of generating a much higher electromotive force than the noble-metal couples. There are, however, some factors, such as indicating and recording instruments, the insulation on the elements, the constancy and homogeneity of the wires, and the resistance to oxidation in the furnace, that limit the. Usefulness of the temperature-measuring device. It is the purpose of this paper to discuss in what manner these factors affect the usefulness of the couples.

In 1939 Illinois produced 94,302,000 bbl. of oil—almost three times the amount of oil produced at the peak in 1908, when development in the southeastern Illinois field was at its height (Fig. I). A reliable technique has been developed for producing single crystals of tantalum in the form of small diameter wires. By suitably heat treating these and polycrystal samples, first in an oxygen atmosphere and finally in vacuum, it has been found possible to reduce residual resistivities to 10-3 microhm-cm. The purity of these samples is thus comparable to the purities obtained in zone-refined silver, copper, and aluminum. THE growth and purification of pure single crystals of the transition metals is, in general, difficult. ' For a number of years, from an economic standpoint, the ventilation of the Colorado mine of the Davis-Daly Copper Co. has been a difficult problem. The development through the main hoisting shaft was pursued for a number of years and to a depth of about 2500 ft.(762 m.)before large bodies of good commercial ore were opened. This lack of early success in exploration restricted expenditures for ventilation, with the result that the present orebodies were developed at a depth of 2500 ft., and in country rock of relatively high temperature, without adequate means of supplying the development faces and the stopes with cool or fresh air of low humidity and suitable velocity. During the progress of development, two or three connections were made at higher levels with the workings of adjoining operations, but these were of a makeshift and unsatisfactory character and afforded no means for carrying downcast air from the surface, in anything approaching a direct course, to the working faces. During the latter part of 1917, arrangements were made with the Anaconda Copper Mining Co., whereby, during the year 1918 and the early part of the year 1919, a crosscut was driven eastwards on the 2500-ft. level of the Colorado shaft and connection was made by means of an up-raise of approximately 200 ft. to a crosscut driven westwards from the 2800-ft. level of the Belmont mine, this crosscut at the top of the raise being driven at Davis-Daly expense by the Anaconda Copper Mining Co. This connection, in conjunction with a No. 11 Sirocco fan installed near the Colorado shaft, provided the Colorado mine with a maximum of approximately 30,000 cu. ft. per min. of relatively fresh air, most of which came in a fairly direct route from the downcast Belmont shaft through the No. 11 fan to the 2500-ft. level stopes. After passing through these stopes and the stopes of overlying levels, it passed through the main crosscuts on higher levels back to the Colorado shaft, which provided the upcast for this current of air.
