THE sinking of a new shaft at the Newport mine, Ironwood, Mich., was started in May 1931 and completed on Aug. 3, 1932. During this period, 2665 ft. of shaft in granite was completed, at, an average advance of 6 ft. per 24 hr. In November of 1930, experimental work was con-ducted oil 65 ft. of shaft through 22 ft. of overburden where ledge was encountered, and this work convinced the operators that all drilling could be clone with vertical holes with the blasting relief to a 4 ½ -in. hole drilled vertically in the center of the cut. The reason for not adopting the conventional V-cut was to get away from damaging the shaft steel. The blasting in a V-cut naturally tends to throw the broken material upward, but with the cut as adopted the relief was in a horizontal direction to a large extent. The scheme of mucking employed made it necessary to keep the steel shaft sets within 511 ft. of the bottom at all times. This could not be clone without serious damage with a V-cut when blasting in granite. The cut as drilled also broke 10.53 ft. per round of drilling, which was considerably more than the experience with a V-cut in the sane material. The extended cut reduced proportionately the delays for charging, blowing smoke and handling drilling equipment in the shaft. Another advantage was the ease in drilling vertical over inclined holes, and the preservation of the proper spacing of the drill holes at the bottom of the cut.

During the past decade the genesis of the lead- and zincdeposits of the Mississippi valley has received special attention from many distinguished observers. But their united egorts, instead of settling all disputed questions, have, in many respects, involl-ed the general problem in greater uncertainty than would be thought possible under the circumstances. In place of the harmony of opinion that might be expected, there is unexpected disagreement, largely due to the fact that, instead of giving attention to a possible multiplicity of ore-producing conditions among the different deposits, the attempt has been made to bring all deposits under a single genetic head. To a new observer of the lead- and zinc-deposits of the Mississippi valley, it appears at the outset that all the deposits cannot possibly have had the same genesis. In fact, different modes of origin have been often asserted for the ore-bodies, but the difficulty has been that each writer has referred them either all to one category or all to another, and no intermediate ground has been considered possible. Such a position now appears to be clearly untenable. The opinion that, in the deposits of the region under consideration, the ore-materials represent original depositions, made at the time the rocks themselves were formed, is no longer held by any authority, and therefore need not be considered here. THE continual improvements in. the two extremes of the drilling, unit, the drill and bit, have prompted critical examination of the drill steel, the weak link of this drilling unit. Obviously, little is to be gained from the betterment of the drill and bit if the drill steel which transmits the force needed for drilling from the machine to the bit cannot stand long hard service. The technology of the bit has advanced from the integral type to steel detachables, thence to the tungsten carbide insert. The carbide insert is the most significant advance in the bit, bringing it to the level of a machine tool with its performance records under constant surveillance. Long steel changes have become advantageous because the carbide bit will drill greater footages without replacement than did the steel bit: The development of the tungsten carbide insert opened new fields of endeavor in drilling with percussion drills here- to fore known, but limited by the steel bit. After the introduction of the tungsten carbide bit, drill manufacturers began promotion of long feed shells, lighter drifters and stopers, and easily handled auxiliary equipment. Ultimately this promotion of better equipment was intended to increase the bit-against-rock time of the drill shift. Advantages of the uninterrupted drilling period of a long steel change and faster setup time of lighter drill machines are lost when the shank fails in the machine, rod failure requires continual changing, or the bit breaks off in the hole. The evolution of the modern blast-furnace from the embryonic stages of comparatively few years ago, has been the work of wide praetiee and experiment. That much is still to be desired, the experience of every furnace-manager mill testify. Mr. Walsh's paper on "The Irregularities of the Blast-Furnace Process, and a Practical Way to Avoid Them" (Trans., xv., 419), proposes a new solution of the problem of interior lines, and one that has given rise to not a little speculation and controversy. The investigation described in this paper was undertaken to test experimentally the theory of Mr. Walsh as to maximum reducing capacity. Briefly explained, Mr. Walsh's views (outside of his claim for increased efficiency due to having the bosh wholly within the meltingzone) are, that a furnace of contracted stack and throat, on his lines. may equal in product one of considerably greater cubical capacity. The explanation offered for the theoretical greater capacity per cubic foot of his furnace is, that the increased tension of gases caused by passing through the small area mill promote transpiration, thus facilitating reduction and permitting more rapid driving. This alleged relation will appear from a hypothetical case in which a furnace, A, constructed on Mr. Walsh's lines, has but 1/x of the cubical contents of a furnace, B, of modern type; the two being equal in height. The progress made in testing the strength of rocks and minerals as they are encountered in mine operation is reviewed. An attempt is made to correlate these physical measurements with abrasive hardness, grindability, and behavior in comminution on one hand and fracture of rocks in pillars and roof control on the other. THIS paper reviews the progress made in testing the strength of rocks, ores, coal, salts, and other minerals as they are encountered in mine operations. It attempts to correlate the results of these physical measurements with technological properties more useful to the mining engineer: abrasive hardness, grindability, and behavior in comminution on one hand, and roof control, fracture of rocks in pillars, and mining methods with controlled caving on the other. In the following pages, the materials discussed will be referred to as rocks. Basic to rock mechanics and comminution are the problems of strength, elastic behavior, and failure, common to all brittle materials. A distinction will be drawn as to theoretical and applied research, and discussion of the progress made in each field will include test data obtained by the U.S. Bureau of Standards,1-1 the U.S. Bureau of Mines," the Iowa Engineering Experiment Station,"." the Committee on Geophysical Research at Harvard University,'" Basic Industries Research of the Allis-Chalmers Manufacturing Co.,11,12 by Philipps,13 and by Mueller," to name only a few. With refinements of testing methods and increased standardization. more useful and more comparable results have been achieved. This is especially important in testing a material like rock, as the inherent heterogeneity demands careful and exacting procedures. New measuring procedures that appear to supersede well known standard methods have contributed to faster and less costly testing yet have introduced new concepts, with implications as to comparability of results which must be watched. Reference is made to the sonic method for determining elastic properties," to be discussed in detail below. Basic Investigations Historically, all work in the field has started with the simplest determinations such as those for crushing strength, abrasive hardness, and grindability. These serve the limited objectives in the researcher's field of specialization: building construction, road ballast, roof control in mines, comminution, and seismic prospecting. Occasionally, fundamental properties like the modulus of elasticity E and Poisson's ratio v have been determined with the idea that they might have some bearing on the technological properties of the material under investigation. But it was not until the work of Philipps,13 of Harvard University,'" and of the U.S. Bureau of Mines"' that sufficient basic data were collected to allow researchers to go beyond the technological test and find the fundamental laws behind the behavior of rocks in mine and mill operations. The properties to be looked for are those that describe the elastic behavior of any material, the modulus of elasticity E and Poisson's ratio v being the ones determinable with least difficulties. Only two such properties are required to compute any other property such as the shear modulus, the modulus of rigidity, and the bulk modulus, all of which are related to each other according to well known equations of the theory of elasticity." In spite of their heterogeneous character, all rocks tested have possessed elastic properties. This does not mean that rocks of the same type always have the same modulus of elasticity, which varies exactly as the crushing strength or any other physical property of a rock can spread over a wide range. This has been explained by imperfections of the material always found in rocks, but to some extent this scattering of data is caused by inaccuracies inherent in the testing methods. Modulus of Resilience, a Criterion of Failure Increased availability of E values should allow us to test the validity of the quantity of strain energy theory which has been used in the solution of roof control problems by Philipps13 and by Holland.'" Recently Bond and Wang12 have applied this theory to explain the failure of an elastic material in comminution. Actually it is a very old theory, proposed as far back as 1885 by Beltrami.16 By its assumption the condition of yielding is determined by the term S2 M, = — x volume. Here M, is the modulus of 2E resilience, and its dimension is inch-pounds per cubic inch, that is, work per unit volume. Its numerical value is equal to the area under the stress-strain diagram. In the foregoing equation S is the yield stress (in psi) in tension or compression, whatever the case may be. E, the modulus of elasticity, is in psi. The great appeal of Beltrami's concept of stored energy lies in the fact that the two properties which seem to influence failure most, strength and elasticity, occur in the formula for the modulus of resilience. As an illustration of this, the moduli of resilience in compression of some typical materials tested by the U.S. Bureau of Mines" have been plotted in Fig. 1. The sample of concrete of conventional mix is shown only for the sake of comparison. Its determination was made in the Department of Mining and Metallurgical Engineering, University of Illinois. TWO serious hazards from coal dust confront the bituminous-coal miner- -a physical or safety hazard and a physiological or health hazard. The first threatens the miner with loss of life from coal-dint explosions, and the second with loss of health and earning capacity from inhaling large quantities of the dust. Studies by the Bureau of Mines have shown that coal dust, except some grades of anthracite dust, is capable of initiating an explosion when no explosive gas is present and that its property of extending or propagating an explosion has been responsible for nearly all the widespread explosions that have occurred in bituminous mines in the United States in the present century. For years many mining people believed that low-volatile coal dust was not explosive but not only is it explosive but if the source of ignition is intense, it is as explosive as the dust of many high-volatile coals because the war is creating increased pressure for greater coal production and because of the trend toward greater mechanization in mines, explosion and health hazards from coal dust are likely !n increase considerably.

JOHNSON, Pittsburgh, Pa.-I hope that this contribution of Mr. Washburne's is only the first of a series dealing more in detail with the very important problems involved. Pores are of two kinds: Those which are entirely inclosed, so that they do not belong to a system of communicating pores tapped by the bore hole or shot hole; second, those which do so communicate. Porosity, of course, includes both. But since pores of the first class are valueless to us, we should confine our attention to the latter, for which I propose the term "effective porosity." This should be measured by the Wisconsin method, based on the quantity of fluid that can be introduced by the aid of vacuum. Another factor which requires attention in this connection is the dependence of the extractability upon the rate of loss of pressure, as affected by the number of holes, and the rapidity of their completion, the existence of uncontrolled wells, the use by other operators of vacuum pumps upon the casing head, the exhaustion of a gas field in the same reservoir prior to the discovery of the oil, etc. The extractability depends upon the pressure available for the exclusion of the oil from the reservoir into the hole. The action of gravity in bringing oil into the hole is relatively small where the pores are very small, as is so frequently the case.

A. MALINOVSZKY,* Belleville, Ill. (written discussion?).-I have been very much interested in Mr. Dolman's paper. We all realize, I think, that this question of developing our home industries and support-ing the new industries which have developed during the great war is very important at present. Mr. Dolman has well shown the quantity and quality of the raw magnesite in the United States, and the commercial and industrial possibility of our home magnesite and I believe, with him, that our home industries should receive adequate protection. There are two reasons, however, for believing that this may be difficult. One reason is that much American capital is invested in the Austro-Hungarian magnesite industry. The raw magnesite can be quarried and prepared for the market in Austria with much cheaper labor expense than in the United States; large deposits which are very easy to quarry and good transportation facilities also contribute to the cheapness of production. The second reason is the old saying that the magnesite found in the United States is not of the same quality as the Austro-Hungarian mag-nesite; this I doubt. Even if the magnesite found here does not in a raw state equal the Austro-Hungarian, it can be synthetized so that the finished article will have the same properties as the Austro-Hun-garian finished magnesite refractory possesses. Thaw magnesite from Greece is not the same as the. Austro-Hungarian, but it has linen demon-strated that a good refractory can be made from the Greek product.

WHEN pouring concrete it frequently happens that space prohibits the placing of a mixer at the point, or points, where the concrete is to be used. Usually in such cases recourse is had to some form of pressure chamber, or concrete gun, to blow the mix by compressed air from the mixer to the point of pouring. Recently such a case arose at one of the western mines. The experience obtained there may be of benefit to others, not expert in the means of transporting mixed concrete, when they run up against similar situations. The first stage in pouring in this instance was a vertical drop of 100 ft. from the mixer on one level to the point where horizontal travel began on a lower level. Standard 6-in. pipe with flange joints was used, hung in the shaft space available. A standard 45" bend near the bottom directed the mix, with free discharge, into an air chamber for the horizontal stage of travel. With an air chamber at the mixer and pressure applied to the falling mix in the vertical section, jamming frequently occurred at the turn and the pipe would have to be taken apart for freeing. To obviate this difficulty the mix was poured slowly without the addition of air pressure, when it was found that the mix got through much better.

During the creep of coarse-grained polycrystalline magnesium at elevated temperatures, a nonbasal type of slip was found to play an important role in the deformation processes. The nonbasal slip traces were examined metallographically in eight specimens (13 grains) and the observed glide plane located stereographically for each grain. The tests were run at 500&apos; and 700°F at stresses of 148 to 786 psi. Based on these measurements and theoretical calculations, the crystallographic elements for nonbasal slip were determined. WHEN a metal deforms by slip, the conventional appearance of the slip bands on the surface of a specimen is that of straight lines. Such is the behavior of the face-centered-cubic metals, as for example, aluminum. The particular slip system on which slip occurs in these metals is governed by the criterion of resolved shear stress. Work on the body-centered-cubic metals a-iron,&apos;. &apos; molybdenum, and columbium4 has shown that the process of slip is somewhat more complicated than the simple gliding of one close-packed plane of atoms over another in a close-packed direction and that it results in the formation of wavy and irregular slip traces on the surface. The recent reviews and experiments of Vogel and Brick and Chen and Mad-din3 show that, for the body-centered-cubic metals, the resolved shear stresses along the planes and the degree of close-packing do not necessarily determine the slip system. Theirs and other investigations indicate that a complete understanding of the slip process in the body-centered-cubic metals is not yet possible. However, one behavior displayed by all these metals is that the slip direction is invariably one of the close-packed directions <11l>. The wavy nature of the slip-band traces has been explained on the basis of cooperative slip by planes sharing this same slip direction.1&apos;3l&apos; It is generally acknowledged that, when the hexagonal-close-packed metal magnesium (axial ratio c/a = 1.624) deforms by slip at room temperature, it does so by basal slip in the close-packed direction <1I%>. This type of slip has the conventional appearance of straight lines and is governed by the critical shear-stress law. Schmid and coworkers" showed that basal slip was operative in the temperature range of —185" to 300°C (—300" to 572°F). Work by Servi, Norton, and Grant6 has shown that, during the creep of coarse-grained aluminum at high temperatures, new slip systems come into operation. The existence of a new high temperature slip system at temperatures greater than 225 °C (437°F) for magnesium was suggested also by Schmid. This was later indicated by Bakarian and Mathewson&apos; to be slip along the pyramidal planes (10i1) in the close-packed direction <11%>.* They * Mention will be made in the text of pyramidal planes and prismatic planes. According to them, a possible cause for the appearance of the markings was due to "limited accessory slip on the pyramidal {10i2) planes." Burke and Hibbard," on deforming a single crystal of magnesium at room temperature, found evidence of slip on a pyramidal plane {1011). They explained it as being due to the effect of grip restraints. It is pertinent to note at this point that, although basal slip has received a fair amount of attention, only two specimens have been investigated, that of Bakarian and Mathewson and of Burke and Hibbard, to establish the elements of nonbasal slip in magnesium. THAT management and purchasing have developed a more closely-knit working relationship is evidenced by the fact that more and more companies are appointing the heads of their purchasing departments to the position of vice president. This is concrete and dramatic indication that management is utilizing the knowledge and experience gained in this department and working with it at the policy-making level. When the engineering department is at the planning stage of a project, the purchasing department is being asked to sit in on the preliminary discussions . . .today. One result of this cooperation is that drawings and plans will reflect the current situation on material availability and another is that standardization will be incorporated in new construction and equipment.

ALL critical and strategic materials procurement functions have been transferred from the Defense Minerals Administration, General Service Administration, and the Economic Cooperation Administration and are now centered in a newly formed agency, the Defense Materials Procurement Agency. DWA will report directly to the Director of Defense Mobilization. Mr. Truman stated that he intended to appoint Jess Larson, administrator or General Services to head the new agency (see Trends P. 756). W. C. Schroeder has been named acting director of the Defense Minerals Administration replacing James Boyd. He has been named also to a newly created assistant director position of the Bureau of Mines serving under Mr. Boyd who is director. Schroeder was formerly head of&apos; the Synthetic Liquid Fuels Division of the Bureau of Mines.

There were no easily identifiable tourists. Everybody carried attaché cases and sported the buttoned-down look in dress. They were all there at the Hotel Indonesia to make a deal. But deals don&apos;t come quickly over there and those that staved and persevered became bored. They clung to the air conditioning of the Hotel and sought hobbies to while away the weeks-and even months. It is not an easy life but it can pay off fog sonic company. The government officials are neither stupid nor lazy. They are new at their jobs. Many are ex-army men and they know they must learn before they can enter into a contract with confidence. So they take time, and time is on their side.

The placer gold occurrences at Sart Çayl, Manisa, Turkey, the legendary River Pactolus of King Croessus, were evaluated in this study to determine if this deposit contains sufficient recoverable value to justify development and exploitation. The gold occurs both in the upper Neogene conglomerates and the alluvium derived from these conglomerates. The total reserve in the whole region is estimated to be 500 million cubic metres. Samples were taken of the upper conglomerate and in the alluvium in an attempt to determine the amount and the physical nature of the gold. The gold in samples was recovered by screening out barren oversize followed by washing the sand and gravel through riffled sluices. The resulting sluice concentrate was later panned and amalgamated at site. Laboratory cyanidation testing of some samples for control purposes was also done. The average calculated free gold was found to be about 90-100mg/m3 and the size of gold flakes found was quite small. The field as well as laboratory testing of the samples of Sart Çay1 indicated that the potential reserves in this region could only be developed as a sand and gravel operation and the gold could be recovered together with the heavy minerals as a byproduct.

There is no better way of paying tribute to the memory of a scientist than by developing and carrying forward those ideas which he has contributed to science and which are for us the very essence of his immortality. For a lecturer who has not had the great privilege of stdying under Professor Howe or &apos;ven of knowing him in person, these ideas must be transmitted through the printed word. It is our great good fortune that Professor Howe left to us a rich heritage of publication, not only in his classic monograph on the "Metallography of Steel and Cast Iron" but in a wealth of earlier hooks and papers in the transactions of this Institute arid of other scientific and engineering bodies. An outstanding characteristic of this published record is the great breadth of interest and of vision which it portrays. His was riot a narrow specialization in only the scientific aspects of ferrous metallographg. On the contra1y many of his important contributions had to do with a far broader field of metallurgicial endeavor. He insisted that his students be well grounded in 1 he fundamentals underlying the whole field and not led into the narrow groove of specific applications. Among his first major publications we find papers on copper smelting, extraction of nickel, the efficiency of fans and blowers, thermic curves of blast furnaces, the cost, of coke, and the manufacture of steel. These are the papers of a metalhurgical engineer and it was among engineers that Henry Marion Howe made his early and well-merited reputation. These early engineering contributions display very clearly the strongly sctientific inclination of their author. The classic work on "The Metallurgy of Steel" published in 1890 contains a thorough and critical discussion of all that was known at the time concerning the alloys of iron and of what we would now call the physical metallurgy of steel. In addition it describes steel-making processes in use and some that had become obsolete, and points out in critical fashion the reasons for success and failure. Steel mill design and layout were included as well as some pertinent discussion of refractories. The book is indeed an embodiment of one of Howe&apos;s outstanding characteristics—breadth. It is both the science and the engineering of steel production as known in that day. One of Howe&apos;s earliest technical papers was entitled "What is Steel?" That was nearly seventy-five years ago when many new processes and new kinds of steel were being developed. The time was ripe for such a question and the answers which Howe was able to give were helpful in understanding the phenomena of heat treatment. Twenty-five years ago Professor Sauveur repeated the question as the title of the first Henry Marion Howe Memorial Lecture. It seemed to him that this question, "What is Steel?," had served as Howe&apos;s motto throughout the remainder of his life. Today I shall present for your consideration a question of another sort: "What is Sletallurgy?" Perhaps it is not too much to hope that in the answer we may obtain a clearer and possibly broader view of the nature of our science and our profession. The time is ripe for giving careful consideration to what we mean by metallurgy. If our Metals Branch is to become in fact an American institute of Metallurgical Engineers, it is essential that we understand what is meant by metallurgical engineering. I am convinced that the best interests of the profession have not been served by a narrow interpretation of these terms. We must now place emphasis on the breadth of metallurgy as a science and as an engineering profession. With its usual brevity and wit. Webster&apos;s dictionary definesmetallurgy as "the science and art of extracting metals from their ores, refining them and preparing them for use." I shall riot assume that the words "science" and "art" and "metal" are so well understood as to require no defining but others among our contemporaries are better qualified than either your lecturer or the dictionary to present the broad meanings of these terms. When we say that metallurgy is among the oldest of the arts we are not classing it with painting or sculpture or music but rather with the making of tools or weapons or the building of bridges or chariots or cathedrals. In short we are saying that metallurgy is among the oldest of the engineering professions. The question " What is metallurg ? " has been one of rather more than ordinary concern to those of us who have the task of developing a curriculum for the education of students in this field. This development has been going on in a number of universities over a period of some years. but there seems to be as yet no unanimity as to what such a curriculum should contain. THE ECONOMIC THEORY It will assist in the understanding of the Resource Rent Tax ("RRT") proposals in Australia if the economic theory behind the tax is briefly explained. The idea goes back to the concept of rent put forward by the nineteenth century economist David Ricardo. His analysis was broadly as follows: A tenant who farms land which is just on the margin of economic viability cannot afford to pay his landlord any rent, because the value of the crop produced by such marginal land is equal to the cost of producing the crop, plus the cost of keeping the tenant alive. There is nothing left out of which to pay rent to landlord. A tenant who farms good land can afford to pay his landlord rent -- but the maximum amount of rent that he can be asked to pay is the excess of the value of the crop produced by the good land over the cost of producing the crop and of keeping the tenant alive. Adapting this theory to the taxation of mining projects, modern economists who favour this system of taxation say that a profitable mining (or resource) project produces rent in the Ricardian sense. The amount of the rent is the excess of the profits by the project over the amount of profit which is required to attract the taxpayer to invest in the project in the first place. This explains why the tax is called "Resource Rent Tax". PAPUA NEW GUINEA PRECEDENT Although Papua New Guinea ("PNG") is now independent of Australia, there are still close links between the two countries, and strong similarities between their respective tax regimes. PNG introduced an Additional Profits Tax ("APT") in 1978. In many respects, Australia&apos;s RRT proposals follow the precedent set by PNG1s APT. However, in practical terms, not a great deal can be learned at this stage from PNG&apos;s experiences since, according to the writer&apos;s understanding, no PNG mining project has yet paid any APT. The Bougainville mine is not liable to APT, being subject to tax under its own separate Act, which contains a different formula. Outline of PNG Additional Profits Tax. PNG has two versions of Additional Profits Tax ("APT) - one applying to general mining, the other to petroleum mining. The two versions are very similar. The general mining version is described below. The tax applies on a licence by licence basis. This means that losses on Licence A cannot be offset against profits on Licence B. Expenditure relating to two or more licences, is apportioned "in such manner as the Chief Controller thinks reasonable". Tax is levied on the "accumulated value of net cash receipts" at the rate of (70 - n)% where n=the rate of income tax. The accumulated value of net cash receipts ("av") is calculated as follows: Calculations commence from the first year in which substantial expenditure was incurred on the construction of facilities for the carrying out of mining operations on the licence. For that year the av consists of the total allowable expenditure to date on that lease. For the second year, the av is the av at the end of year one indexed in accordance with the statutory formula set out below, plus the total allowable expenditure in year 2. For year 3, the av is the av at the end of year 2 adjusted by the index factors, plus the total allowable expenditure in year 3. This process is repeated year after year. The application of the cyanide process to complex sulphide ores for the extraction of the gold and silver is no longer a novelty; but, as an example showing modern teudencies in this direction, the following description of the new milling process at the Lucky-Tiger mine is offered: The extraordinary richuess of the ore in the upper workings of this mine made any thought of milling in its early days seem unnecessary. Its location in an almost inaccessible part of the rugged mountains just south of the Arizona boundary-line, and 60 miles from the town of Douglas, made the expense of bringing in machinery and sopplies a very serious consideration. But, after the property had been shipping high-grade ore on mule-back for a few years, there remained in the mine a considerable tonnage of vein-matter that mas too low in value to ship, but which it wag thought could be milled near the mine at a profit. The first milling-experiment consisted in the installation of Nissen stamps in conjunction with concentrating-tables and Frue vanners, but, as the ore from the upper workings contained most of its silver in the form of cerargyrite, this type of mill mas not successful. The proximity of the mine to the great copper-concentrating mills of Cananea and Moctezuma naturally made the influence of copper-milling ideas felt in the company&apos;s next instdlation. At considerable expense a stage-crushing concentrating-mill, with a capacity of 100 tons per day, was built. This mill was modeled along the lines of the most approved practice in copper-concentrators at that time, the main idea being that crushing by stages .in rolls was necessary in order to prevent losses from " sliming." Edgar Hall, Silverspur, Queensland, Australia (communication to the Secretary*):—Dr. Douglas has written on this subject before, and his influence has had a powerful effect on the eide of freedom among the&apos; younger generation of engineers. Moreover, it is not the first time that he has attributed the decline of the copper-smelting industry in Swansea to the secrecy maintained by the firms there engaged in smelting-operations. In this latter statement I think his conclusions are open to criticism. Whether the firms mentioned have suffered by their secrecy is their own business—I hold no brief for them ; but that the decline of the copper-industry at Swansea was inevitable seems to me to he proved conclusively by Dr. Douglas&apos;s own writings. In his paper on The Copper Situation,&apos; Dr. Douglas says : "In comparing iron and copper mining,...it must be remembered that 2 tons of average iron ore from the most prolific source now available ... will make 1 ton of metal; whereas from 33 to 75 tons (say an average of 50 tons) of copper ore must be mined to produce 1 ton of copper." And further: "Last year&apos;s production of iron was made from approximately 50,000,000 tons of ore. Our copper mines, to yield a production of 900,000,000 pounds, must have handled approximately 22,000,000 tons of ore, or nearly half the quantity raised from our iron mines." Is not this the key to the whole situation ? In transporting the 50,000,000 tons of iron-ore, 25,000,000 tons of the metal iron were carried so much nearer to the market, but the transportation of 22,000,000 tons of copper-orc would have carried only 450,000 tons of the metal copper nearer to its ultimate destination. Forty years ago the atom was split and the Age of Fission dawned. Uranium was the element used in this earth-shaking accomplishment. Thitherto almost unknown to the man in the street, uranium soon became widely and persistently sought. And the quest for this unique material is not likely to diminish during this century. To find is one thing; to own is another. Who owns uranium in the ground? Where no mineral rights in the land have been severed by devise, grant, reservation or lease, the uranium belongs to the fee simple owner of the land. But where there has been a conveyance or reservation of all or part of the "minerals", determining WHAT a substance is has been the traditional way of determining WHO owns it. What, then, is this element called uranium? The 1907 edition of Watts Dictionary of Chemistry calls it "a lustrous, hard, silver-white metal". Of nature&apos;s three prime divisions it falls within the embrace of the mineral kingdom - substances neither animal nor vegetable. In its natural state uranium always is combined with other elements or substances in the form of an ore mineral. May we, then, put to rest any doubt or question as to the nature of uranium and classify it for all purposes, including that of ownership, as mineral? Not quite! That self-same logic would find oil and gas primly ensconced in the animal or vegetable kingdom. Technically, oil and gas are not minerals but legally they have been classified as such. Why? The Supreme Court of Tennessee sought the answer in 1897 in the case of Murray v. Allard, 43 S.W. 355. After citing authorities pro and con, and while admitting their origin to be "decomposition of marine or vegetable organises" that court firmly concluded that since they were obtained by a form of mining, oil and gas were minerals. From the above example two elementary truths emerge. First, for purposes of ownership, uranium is and will be whatever the courts say it is. Secondly, the courts historically and currently favor a practical rather than technical test to determine the "mineral" character of a substance. So now we turn to the jurisprudence for enlightenment and definition. EARLY CASES ALLOT URANIUM TO MINERAL OWNERS Two early cases involving the ownership of uranium followed what had been well-settled mineral within the meaning of the conveyances involved, confirming ownership in the mineral owners. In 1956 the U. S. District Court for New Mexico in the case of New Mexico and Arizona Land Company v. Elkins, 137 F. Supp. 767, appeal dism&apos;d 239 F.2d 645 (10th Cir. 1956), found that a 1946 deed reservation of "all oil, gas and minerals underlying or appurtenant to said lands" included uranium and thorium. The court reasoned that uranium and thorium, being minerals within the scientific, geological and practical meaning of the term, would certainly constitute minerals within the purview of the reservation. While agreeing that uranium and thorium were "minerals", defendants argued that at the tine of execution of the conveyance it could not have been the intention of the parties to reserve them because they had no commercial value in the locality and were, in fact, not known to there exist until their later discovery in 1950. The court re¬jected, as a matter of law, this "lack of knowledge" theory citing the Supreme Court of Kentucky holding in Maynard v. McHenry, 113 S.W. 2d 13, that: "The mere fact that a particular mineral has not been discovered in the vicinity of the land conveyed or is unknown at the time the deed is executed rules of construction and held that uranium was a does not alter the rule . . ." that a grant or exception of "mineral" in a deed includes all mineral substances which can be taken from the land unless restrictive language is used indicating that the parties contemplated something less general than all substances legally cognizable as minerals. Further, argued the defendants, the only feasible mining procedure for such substances was open pit or strip mining, which would destroy the value of the land for grazing or agriculture. Finding that the language of the reservation was clear and unambiguous, the court would not permit the admission of extrinsic evidence as to mining procedures required. Elkins is the first uranium case construing the granting clause involved. In 1958 the Texas Court of Civil Appeals at San Antonio, in Cain v. Neuman, 316 S.W. 2d 915, no writ, held that a 1918 lease conveying "all of the oil, gas, coal and other minerals in and under" the land involved covered uranium. The lease provided a royalty of 1/10th on "other minerals." "We find no Texas precedent which discusses uranium," said the court, "but the usual arguments that uranium is not embraced within a lease are that the ejusden generis rule excludes uranium from the meaning of the lease
