When mining operations of The Eagle-Picher Co. began in the Illinois-Wisconsin zinc mining field in 1949, all underground loading of broken ore and waste was by caterpillar-tracked machines. Beginning in 1956 rubber-tired end-loaders were brought in; ultimately they completely supplanted the tracked units. End-loaders proved to have the mobility needed for the mining conditions and additional merit in auxiliary capacities. Eagle-Picher operates five mines in this area; two are entered by shafts and three by inclined adits. Several ore zones, some of which are attenuated over a considerable distance, are worked from the same entry. Consequently underground haulage roads connecting or following these orebodies have attained great length. In addition, working places are often widely separated because of the character of the mining operations which include pillar recovery and extending haulage connections into old workings. At one mine, the haulage distance is 5000 ft on either side of the shaft, at another the maximum one-way distance is 8400 ft, and at another the present road system of 6800 ft is expected to reach 10,000 to 12,000 ft.

EARLIER investigations of the potential-drop-ratio method of electrical prospecting have indicated that under suitable conditions this method is well adapted to the location of formation boundaries in stratified ground. A description of this development was given several years ago by H. Lundberg and Th. Zuschlag.1 The curves published by these authors for the potential-drop-ratio variation above a horizontal contact indicated a definite relation of the position of the curve peak to the depth of the interface. The theory underlying this relation was subsequently studied by Z. Mitera in greater detail,2 and the theoretical deductions were compared with the results of tank experiments. The investigations available at this writing were confined to studies of horizontal formation boundaries. It is the purpose of this paper to extend the scope of the previous work to the problem of dipping layers. THEORY Consider the case of three media of different resistivities, whose interfaces are not parallel. If a point-source is located in one of these interfaces, its images do not lie in a straight line, but on the circumference of a circle whose center is at the hypothetical junction of the interfaces. R. F. Aldredge3 determined the relation that exists between the degrees of dip of the two interfaces and the distances between the various images and the point for which the potential is to be found. As seen in Fig. I, three media of resistivities po, pi, and p2 are involved, and the source I is located at the interface of the media (po) and (pi). The perpendicular depth of the lower interface is h,? is the dip, R is the distance between source I and potential point P, and r is the distance between the images and that point. To distinguish between images lying above the ground interface and those below, the notation "odd" and "even" images will be employed; images below the ground interface will be termed "odd" and those above "even." The following relations govern the distances between either kind of images and the potential point: [ ] As previously pointed out, the images of the source are on the circumference of a circle. INTRODUCTION Three major plant processes control the operation of an uranium in-situ mining plant. The three pro- cesses can be categorized under the headings termed - loading, elution, and precipitation. All other plant processes can be subcategorized under the three. In summary, the major plant processes in an in- situ mining plant are: 1. Loading - The pregnant lixiviant from the production wells flows through anion exchange resin. The loading of the uranium on the resin is controlled by various factors, such as ionic strength, valence, functional groups, etc. 2. Elution - The uranium-loaded resin is eluted or regenerated by a high ionic strength solution. The effluent from this process is de- fined as the pregnant eluate. 3 . Precipitation - The pregnant eluate is chemically treated to attain the ideal conditions for the selective precipitation of uranium. Hydrogen peroxide is an ideal precipitating agent under URI conditions. This paper will focus on two of the major processes: Elution and Precipitation. For the most part this relatively young industry has grasped the theory of liquids in continuous flow for the operation of the plant processes. Likewise, URI initially operated the two processes of interest with the continuous flow concept. Through laboratory experiments, URI has abandoned the flow concept and operates the eluting and precipitating stages with the concept of "batch" processes, whereby only one container, filled to a specified liquid level, is chemically processed. In the proceeding sections, each of the two pro- cesses will be discussed in detail, from their original concept to the present operation. Only minor modifications were made to the existing circuits for the conversion with results revealing a greater level of efficiency. ELUTION The elution of the loaded anion exchange resin can be achieved by different high ionic strength solutions. The selection of constituents is dependent on both chemical and economic considerations (i .e., efficiency and operating/restoration factors). The regenerant presently used is a pH 9.5 solution containing 7.5% NaCl and a mixture of Na2C03/NaHC03. expressed as 2.5% NaHC03.

Tensile tests were carried out on a! titanium containing 850, 1250, and 2700 ppm 0, and up to -500 ppm H. The tests were performed at -196", -78", 20°, 150°, and 300°C at a strain rate of -1.0 x 10??3 sec-1. Increasing oxygen content, increasing grain size, and decreasing test temperature resulted in enhanced embrittlement of the a titanium by the hydrogen additions. Metallographic observations showed that this can be correlated with the influence of these parameters on the introduction of cracks into the a! titanium by fracture of titanium hydride precipitates. CRAIGHEAD et al.1 reported that the hydrogen content normally found in commercial-purity a! titanium (60 to 100 ppm) was sufficient to cause a substantial lowering of the impact strength, and they attributed this embrittling effect of hydrogen to the precipitation of titanium hydride. Lenning et al.&apos; found that in commercial-purity a titanium there is an almost complete loss of impact strength at about 200 pprn H, which is approximately half the value needed to eliminate the impact strength of high-purity a titanium. They also showed that the presence of 3000 ppm hydrogen reduces the room-temperature tensile ductility of commercial-purity material to a value of the order of 10 pct; the corresponding hydrogen concentration for high-purity titanium is over 9000 ppm. It thus appears that the detrimental effect of hydrogen on the mechanical properties of commercial-purity titanium becomes evident at much lower hydrogen contents than for high-purity titanium. The main difference between the two types of a titanium might be expected to be the higher level of interstitial impurity in the commercial-purity grade. Jaffee et a1.3 studied the influence of temperature and strain rate on the hydrogen embrittlement of high-purity and commercial-purity ! titanium. In general, the behavior was the same for both materials; embrittlement was enhanced by decreasing temperature and increasing strain rate. Recent results from tests on commercial-purity a titanium containing 850 ppm O and varying amounts of hydrogen up to -500 ppm showed that the degree of embrittlement by hydrogen is intimately related to the fracture characteristics of titanium hydride precipitates.4 The present paper considers the interrelationship between the mechanical properties and micro-structural features of commercial-purity a! titanium containing 850, 1250, and 2700 ppm 0 and varying amounts of hydrogen up to -500 ppm. 1. EXPERIMENTAL PROCEDURE Three types of commercial-purity titanium supplied by IMI* were used in the investigation, and for the *Address: Witton, Birmingham 6, United Kingdom. purpose of this paper are designated Ti 115, Ti 130, and Ti 160. The principal impurity elements are given in Table I. The material was received in the form of 12.7 mm diam bars having a fully recrystallized structure. Tensile specimens with a round cross-section of 4.5 mm diam and a gage length of 15.2 mm were machined from the bars. In order to develop the same grain size (mean linear intercept of grain boundaries) in each of the three types the specimens were annealed under a dynamic vacuum of <10?5 mm Hg, Table 11. Specimen hydriding was carried out in a modified Sieverts apparatus;&apos; hydrogen was taken into solution at 450°C and after holding the specimens at this temperature for 24 hr they were furnace-cooled to room temperature at an average rate of -100 C deg per hr. By this method nominal hydrogen contents of 0, 50, 100, 250, and 500 ppm were introduced into specimens of Ti 115, Ti 130, and Ti 160 (100 ppm (wt) -0.5 at. pct). The actual hydrogen contents were calculated from the weight differences obtained by weighing the specimens before and after the hydriding treatment. Tensile tests were carried out at temperatures of -196", -78", 20°, 150°, and 300°C on a 10,000 kg In-stron machine at a nominal strain rate of -1.0 x 10-3 sec-1. Fractured specimens were sectioned in planes parallel to the tensile axis, mechanically polished to 0.25 µm grade of diamond paste, and then attack polished using a solution containing by volume 99 parts H2O, 1 part HF, and 1 part HNO3. Although the latter treatment unavoidably opened out cracks and voids visible after mechanical polishing, it did reveal the grain structure, titanium hydride morphology, and deformation twinning structure.

ACCEPTED current practice for A the valuation of mineral property is based upon Hoskold&apos;s theory and valuation tables first published in 1877, and popularized by Herbert Hoover&apos;s "Principles of Mining" issued in 1909. In more recent years the procedure has been developed further in the course of the extensive valuation work required for Federal taxation purposes. The 1-aluation of oil and gas properties and of mines is based upon the same principle-the estimation of the present worth of future net revenues. However, in valuing oil and gas properties the method used for discounting future revenues differs somewhat from that adopted for mines, owing principally to the nature of the re- source. production from oil and gas properties usually declines from year to year, whereas coal and ore de- posits are adapted to a more uniform rate of output.

THE (110) [001] texture in silicon iron is of considerable interest both from the technological and scientific points of view. Its occurrence was reported more than 20 years ago.1-4 The texture develops by means of secondary re crystallizatjon5 and can be very strong, that is, greater than 90 pct alignment even thouh the primary re crystallization texture is weak or complex. This behavior is in contradistinction to the face-centered metals which develop their strong secondary recrystalliza-tion texture from a strong primary recrystalliza-tion texture.&apos;, The microstructural changes accompanying the (110) [001] texture formation in silicon iron are as follows: When properly prepared cold-rolled sheet (i.e., 0.015 in. thick) is annealed at about 800°C, primary recrystallization occurs and a fairly stable fine-grained primary recrystallized matrix of about 0.02-mm-diam grain size is produced. The material at this stage does not have the strong (110) [110] texture. As the temperature is raised to about 900°C, relatively large grains appear in the finegrained matrix and they grow at the expense of the smaller grains to many times the sheet thickness. In time the complete sample is consumed by these large grains. This process of the growth of relatively few grains (about one in 105 primary grains) at the expense of many grains is called secondary recrystallization. Since all the secondary grains are of essentially (110) [001.] orientation, the strong texture is developed by this secondary recrystallization process. Theories of the (110) [001] texture in polycrystal-line silicon iron have been proposed by Decker and Harker and by Dunn.Decker and Harker have shown that grains initially in the (110) [001] orientation will upon annealing after cold-rolling, re-crystallize back to the initial orientation. To account for the sharp texture in silicon iron they propose that (110) [001] grains become more highly strained than grains in other orientations and therefore recrystallize first. They are then the lowest energy grains and can consume their higher energy neighbors. Grains in orientations other than (110)

Cast X-40 alloy with the lowest nitrogen content studied had a 100-hr rupture stress at 1500°F about equal to the reported value for the commercial alloy. Increases in nitrogen content progressively decreased the rupture strength, and with about 0.1 to 0.2 pct N a minimum strength was reached, but there was no accompanying change in microstructure. Further increases in nitrogen resulted in the fomzation of progressively increasing amounts of a lamellar, pearlitic-type structure at the grain boundaries, with accompanying increases in rupture strength, and above about 0.25 to 0.33 pct N, the rupture strength exceeded the normally reported values. Two series of melts representing different melting stocks exhibited minimum rupture strengths at different nitrogen contents. This suggests that some unidentwed trace element not removed by vacuum melting has a strong influence on the response of this alloy to variations in nitrogen content. In a series of melts with manganese contents ranging from 0.6 to 3.2 pct, the material with the lowest manganese content had the highest 100-hr rupture strength at 1500°F. The manganese variations had no appreciable effect on the microstructure. CAST cobalt-base alloys such as X-40* exhibit high strengths at elevated temperatures (1500°F and above), but they also show considerable scatter in high-temperature properties. Since the design of parts for critical applications must be based on the minimum expected properties, this broad scatter appreciably lowers the design strength of the alloy. If the relatively poor properties exhibited by a few test parts from any given group could be improved, the spread in properties would be narrowed, and the design stress could more closely approach the average expected properties. The purpose of this research investigation was to learn what were the causes of these erratic properties and, if possible, to find methods for eliminating them. Earlier unpublished work showed that vacuum melting markedly influenced the high-temperature strength of cast X-40 alloy. There were indications that this behavior may have been the result of changes in the nitrogen or manganese content of the castings. Consequently, in the current investigation, the influence of variations in nitrogen and manganese content on the structure and high-temperature properties of cast X-40 alloy was studied. In this program, X-40 melting stock was vacuum melted to produce a base material that was very low in nitrogen content and in volatile trace elements. Additions were then made to this base material to produce alloys of the desired composition. The metal was cast into investment molds producing coupons which were machined into stress-rupture bars. These bars were subjected to stress-rupture tests and me-tallographic study to determine the influence of changes in analyses (nitrogen and manganese content) on the structure and properties. Material—The melting stock used for these experi-ments was in the form of shot from two master heats of commercial X-40 alloy. Only one master heat was used in a given series of melts. Thus, any differences in structure or properties that showed up in the specimens from a given series would be the result only of the intended variations in composition. During the past year there have been a number of significant investigations that have furnished evidence on the driving forces governing grain growth and on the role played by boundary impurities. Thus Burke has shown that in high purity alpha brass the rate of grain growth in the earliest stages is approximately inversely proportional to the existing grain size. This relation agrees with one derived by Zener assuming that surface energy was the driving force in grain growth. Also in confirmation of the surface energy hypothesis, Burke found that growth virtually stopped when the grain boundaries or even only the grain corners were melted.

The object of this paper is to bring to notice a method in use at the Cedar Point laboratory of Witherbees, Sherman & Co., for determining the phosphorus in the ore mined at Mineville, N. Y. This ore is magnetite, with a gangue containing crystals of apatite. In 1886, Mr. H. F. Dawes, then head chemist at the works, suggested that as all the phosphorus seemed to be in the apatite, it could be obtained in solution by dilute nitric acid. After some experimenting the following method was adopted, and has proved invaluable for rapidity and ease; half a dozen determinations requiring very little more time or trouble than one. From + to 10 grammes of ore are weighed into a 150 c.c. beaker; 50 C.C. hot water and 10 c.c. strong nitric acid are added; the beaker is covered and the contents are boiled for 1/2 hour (10 minutes sometimes proves sufficient; but 4 hour is safer). The bumping which ensues if more than & gramme is used need cause no trouble. The hot solution is filtered into a 250 C.C. beaker. The filtration and washing (with hot water) proceed rapidly, as the magnetite itself is but slightly acted upon. After the addition of 15 C.C. ammonia and 15 c.c. nitric acid, the solution is cooled to 45&apos; C., and from 15 to 40 C.C. of molybdic acid solution is added and stirred vigorously. In 5 minutes the precipitate will be down, and the determination can be finished by any good method. At Cedar Point the method more commonly used is weighing as yellow salt. Good washed filter-paper is used, No. 0 Swedish being preferred; and dozen 3 1/2-inch filters are numbered and dried and weighed at 110°C. These are always kept in stock. The yellow salt is filtered on one of these, washed with dilute nitric acid (2 per cent. by volume); dried for 1 hour at 110&apos; C., and then weighed, 1.63 per cent. of weight being calculated as phosphorus. THE heavy postwar demand for Portland Cement has created shortages that are gradually being overcome by increases in plant capacity. In the post-war period, the Lone Star Cement Corp. has expanded several of its existing 15 plants and has built 2 new plants, now in operation, with a third new plant under construction in Brazil, of design somewhat different from that of the two preceding ones. The new domestic plants are located at Lone Star, Va., near Roanoke, and at Maryneal, Tex., near Sweetwater, and went into operation during 1951. Each plant is equipped with two rotary kilns and has an initial capacity of 1,500,000 bbl per year, or 6,000,000 sacks. The total cost of each plant was about $10,500,000, and on this basis $7.00 in 1951 money are required per bbl of annual capacity; at 376 lb per bbl, this corresponds to $37.00 per ton of output. The investment corresponds to approximately $80,000 per hourly-wage earner employed. The purpose of this paper is to describe the most interesting design features of the two new and almost identical Lone Star plants. Why the Dry Process Was Chosen The two new domestic Lone Star mills employ the dry process because: 1-The raw materials at both properties are particularly suitable and can be dried very, readily. 2-The Maryneal, Tex., plant does not have water available for slurry. 3-Very substantial kiln fuel savings can be obtained. 4-Dry raw grinding reduces ball and liner wear and- general maintenance, without any sacrifice in power. Operating costs to date have more than justified the choice of the dry process for these two plants. Raw Materials The chemical composition of Portland Cement raw material after crushing, grinding, and mixing, but before burning, is about as follows: [ ] sometimes tailings from an iron ore concentrating plant. Certain objectionable materials occur in raw mix: magnesia, limited in cement to 5 pct, in excessive amounts; alkalies, as sodium and potassium; phosphorous; and sulphur, generally present in coal and oil. The Roanoke raw, materials are dense limestone and shale. The Maryneal materials are soft limestone and a hard brittle clay that can be handled much like shale. Sand and iron ore are required in small quantities. General Plant Layout and Construction The two plants are so similar that one joint description will cover both, with such exceptions as will be especially indicated. The crushing plant is located in the quarry, and raw material is conveyed by belt to the storage building, where all materials are stored and handled. Fig. 1 identifies the various structures of the Roanoke plant. The large storage building is used for the storing and handling of all materials, including limestone, shale, sand, iron ore, coal, clinker, and gypsum. Directly adjoining the storage building is a structure under a similar arched roof, containing the raw and clinker grinding departments and the electrical substation. The discharge ends of kilns and coolers, and coal or gas burning equipment are also placed at one end of the mill building. The 340ft long kilns extend away from the main buildings to form the long leg of an L, at the end of which is the feeding and kiln dust collecting equipment, and the raw blending silos are conveniently located adjacent to the feed end of the kilns. The machine shop, storeroom, electrical shop, foremen&apos;s office, service rooms, and meeting hall are combined in one structure in the center of the plant, and the office and laboratory are close by. The cement silos and packhouse do not have to be tied directly into the manufacturing process and are therefore located at a point convenient to the railroad tracks.

THE present organization of Copper Queen employ-ees, known as the Employees&apos; Conference Com-mittee, is really an outgrowth of the former Grievance Committee, which, in turn, had developed from the original Hospital Committee. The relatively small membership of these older organizations, the practical limitation of their activities to the presenting of grievances, and their lack of initiating powers, were the principal defects which the plan now in operation seeks to overcome. A somewhat parallel scheme was instituted in our Sacramento Hill division about four years ago; this gradually developed into the Ways and Means Committee, which, in addition to providing a forum for the discussion of operating problems, was instrumental in establishing an excellent and mutually satisfactory bonus system. Before recommending adoption of the plan now in force, we made extensive inquiries among those who have had any experience in such matters, and ended by proposing a modification of a scheme developed by John Leitch,1 which was characterized by its similarity to the constitution of the Federal Government. As finally remodeled, the. plan was submitted to vote of the entire working forces at the Copper Queen mines, and was adopted by them in May, 1920. Mining opera-tions since that date have been so interrupted that it is scarcely possible to state exactly what the results have been. The following quotations are from a printed pamphlet containing the constitution of the organization, as finally adopted. The first extract is from a letter addressed by the management to the employees: The plan submitted for your approval and adoption is modeled after the constitution of our own country, under which every individual is given an opportunity for advancement, according to his ability and determination, and every citizen is given a voice in the laws that shall govern him. So it is to encourage the individual employee in advancement, and to give him a voice in making the rules that shall govern his conduct, that we favor the adoption of the proposed constitution.

The Ti-Cr-O ternary system has been studied in detail near the titanium-rich corner within the limits of 10 wt pct 0, and 20 wt pct Cr. Studies were extended, but not in detail, to the region beyond 25 wt pct 0, (50 atomic pct) and 62 wt pct Cr (60 atomic pct). Four isothermal sections at 1400°, 1200°, 1000°, and 800°C are presented as well as two vertical sections at 1 and 2 wt pct 02. DURING the last decade much interest has been shown in the development of high strength titanium alloys for high temperature and corrosion resistant applications. Extensive research is being carried out at present, as the current literature indicates, in order to study the properties of titanium and to develop improved alloys. Two of the important alloying elements in commercial titanium alloys are chromium and oxygen and it would be desirable to know their combined influence upon titanium. For this purpose the present work was carried out to investigate the titanium-rich corner of the ternary system TiICr-0. The binary systems Ti-Cr and Ti-0 have been published recently. The Ti-Cr system was studied by several investigators " and their results are in close agreement. The eutectoid decomposition of the B phase has been shown to be extremely sluggish. TiCr, was the only intermetallic compound found in this binary system and was formed at 1350°C by a transformation from the p phase. TiCr? was established as the cubic C 15 (MgCu,) type of structure with 24 atoms per unit cell and was designated as the y phase. This terminology will be adopted in the present work. There was disagreement about the actual composition of this compound among the several investigators, although it is evident from their data that the compound probably has a solubility range of about 2 to 3 pct and is in the vicinity of 65 pct Cr. It has been indicated recently that a high temperature modification of this y phase (TiCr,) existed at a temperature above 1300°C." &apos; This high temperature modification was identified as a hexagonal C 14 (MgZn,) type of structure with 12 atoms per unit cell. The exact transformation temperature from the high temperature phase to the low temperature phase has not been established. A considerable hysteresis was observed and, due to the sluggishness of this transformation, the high temperature phase often co-existed with the low temperature phase at temperatures below 1300°C. A preliminary study of several Ti-0 compounds and the Ti-0 system had been carried out by Ehr-1ich."-"&apos; The most complete binary Ti-0 system was the one reported recently by Bumps, Kessler, and Hansen." The first intermediate phase found in the system was the 8 phase which formed by a peritec-toid reaction of the phases a and Ti0 at temperatures below 925 °C. This reaction is extremely sluggish. The structure of this 8 phase was tentatively identified by these authors as being tetragonal and the lattice constants were found as c,, - 6.645A, a,, = 5.333A and c/a = 1.246A. Experimental Procedure The raw materials used for this investigation were TiO,, electrolytic chromium, iodide titanium, and sponge titanium. The TiO, was in the form of powder of chemically pure grade (99.8 pct pure). The chemical analysis of the electrolytic chromium was: 0, 0.50 pct; Fe, 0.07; Cu, N, and C, 0.01; and Pb, 0.001. The oxygen in the chromium was calculated as part of the final oxygen content of the alloys. The alloys were prepared by the cold crucible method using a tungsten arc. The entire system was evacuated and flushed with purified helium three times and then filled with helium. Each alloy was melted, turned over, and remelted at least four times to insure homogeneity. The total melting time was generally from 6 to 10 min. A master alloy of 25 pct 0,-75 pct Ti was prepared to facilitate alloying by melting compacts of TiOl powder with either iodide or sponge titanium, yielding the compound TiO. It was found necessary to bake the TiO, powder compact at about 150°C to remove adsorbed moisture. This was done to prevent the disintegration and spattering of the compact when the arc was struck. TiO, powder dissolved quite readily into the melt and no other trouble was encountered.

THIS Appendix contains a series of tables, more or leas complete, of minerals arranged according to chemical composition or to certain prominent crystallograhic or physical characters. These, it is believed, will be of service not only to the student, but ago to the skilled mineralogist. The type used in the printing of the mineral names indicates their relative importance. Table I is a complete list of the species named in this book arranged fist according to the prominent basic elements which they contain and secondly according to their acid radicals. Table II is of Minerals arranged according to their System of Crystallization The other tablets make no claim to completeness, being limited often to common ah important species. For an exhaustive system of Determinative Tables based particularly upon blowpipe and chemical characters, the student is referred to the work of Professors Brush and Pen- field, mentioned on p. 330.

THE public generally has-become aware that there is something wrong with the coal industry and a clamor has arisen for an explanation if not a remedy for this disorder. It is only reasonable that this Institute be looked to for a diagnosis to show the way for some other .agency to prepare the patient for prescription or operation. The subject is extensive, widely diversified, and beyond the efforts of an individual to cover completely; one of the objects of this paper is the initiating of a symposium on the non- technical factors essential to an understanding of the bituminous coal industry. The present condition of the coal industry cannot be described in a few words but, in effect, it resolves itself into a simple statement: The average coal operator is losing money notwithstanding a firm conviction on the part of the consumer that he pays too much for his coal. Without enumerating the many and varied. factors which contribute to this condition, this paper will be devoted to the interrelation of taxation and ownership of coal and its effect on finance

Apparently the widespread agitation for the codification of our mining laws has had its effect, and it is quite possible that Congress will take up the question during this present session. The greatest objection to our present statutes pertaining to metalliferous deposits seems to be directed against the law of the apex. Those who are not in favor of changing this law are very far in the minority and they apparently realize that it is useless to urge its retention. Next in importance to the repeal of the law of the apex, seems to be a widespread advocacy for the repeal of the law requiring discovery of mineral before a valid location of a mining claim can be made. To a lesser extent there appears to be a desire to have the law changed so as to allow patent for claims without mineral discoveries. The purpose of this article is to review the arguments in favor of the proposed change of the discovery requirement, to show some of the evils that may be expected to result therefrom, and to consider whether a system may be devised to correct the undesirable features of the present law in this respect and at the same time not expose the mining fraternity and the general public to the evils which would result from the repeal of this fundamental requirement. Under the law as at present framed, the validity of a mining location is dependent upon the fact of discovery of mineral within the boundaries of the land claimed. " * * * but no location of a mining claim shall be made until the discovery of the vein or lode within the limits of the claim located" (Sec. 2,320, U. S. Rev. Stat.). All authorities agree that discovery is the source of the miners&apos; title. Lindley, in his valuable work on Mines (3d Ed., Sec. 335), lays down the rule in part as follows: "Discovery is the initial fact. Without that no right can be acquired. * * * Such discovery must precede the location, or be in advance of intervening rights. The proof of recording and marking a claim will not authorize the court to presume a discovery." As is well stated by the U. S. Supreme Court in Erhard v. Boaro (113 U.S. 536):

CARBONIFEROUS CLAYS FROM a geological standpoint, but scant attention has been paid to fire-clay beds. Only within the last few years have they been the subject of individual investigation, prior to this time having been considered only in their relation to coal seams. While the relative importance of coal and fire clay is still immeasurably in favor of coal, yet an industry as large as that of fire clay is entitled to a measure of attention. A discussion of the Carboniferous clays is practically a discussion of the clay beds in the Appalachian basin, since more than 90 per cent. of these clays mined are from this region. The clays are confined to the northern end of the basin, or the States of Pennsylvania, Ohio, Kentucky, Maryland and West Virginia, ranking in importance about in the order named. The clay deposits of the Carboniferous period have been divided into two classes; those found in the Pottsville conglomerate series of rocks, and all those that are found in the formations above, for the reason that the clay beds above the Pottsville series all resemble each other in properties, composition and appearance, and all are distinctly different from the bed found in the Pottsville formation. The bed of clay found in the latter formation is unique in that flint clay is practically restricted to it. (A variety of flint clay is occasionally found in these upper deposits but this is in such small amounts as to be negligible.) Carboniferous clays occur between stratified rocks; sandstones, limestones, etc., in the same manner as coal veins. They are often accompanied by a coal vein although where the clay is of a workable thickness the coal is generally too thin to work. The clay beds are sometimes known by the name of the coal seam at which horizon they occur. Clay beds may be from a few inches up to 20 ft. in thickness. They may consist of all soft clay all flint or both soft and flint.

THE properties of the Patiño Mines and Enterprises Consolidated, Inc., a New York corporation, are near Llallagua in the department of Chayanta in the west central part of Bolivia, South America, about 80 miles southeast of Oruro and 250 miles southeast of La Paz, the largest city in Bolivia and its virtual capital. The properties are accessible by railroad from three points on the west coast-from Mollendo, Peru, across Lake Titicaca, from Arica by way of La Paz, and from Antofagasta, Chile. The latter route, although the longest, is recommended by the companies as affording a more gradual introduction to the high altitudes; the mine being 13,000 ft. above sea level. The company operates its own railroad from its properties at Uncia to Machacamarca on the Chile & Bolivia R. R., a distance of 60 miles. This railroad is well equipped and well operated, and its location among the mountains surrounding Uncia represents excellent engineering skill. In fact all of the railroads, although they are of only a meter gage, are remarkable for the excellence of their construction, the arrangement of their dining and sleeping cars and the precision of their operation. There is only one drawback to rail- road and hotel accommodations and that is the absence of heating facilities, which does not seem to affect the natives but keeps a tenderfoot&apos;s teeth chattering continually. The company is a consolidation of the Patiño company, owning properties at Uncia, with the Compafiia Estanfera de Llallagua, a&apos; Chilean corporation owning contiguous properties at Llallagua. Before the consolidation these companies were deadly enemies, and there still remain at the surface plant at Uncia the fortifications and underground defences provided during the warfare between the two factions. Also, in the Azul, or "Blue" tunnel at the junction line between the two properties is a strong steel barricade still bearing marks of the bullets fired during the various armed tilts between the workmen of the two companies. The headquarters for the mining operations and the milling plant have been moved since the consolidation from the original location at Uncia to the Llallagua side of the mountain, where the Chilean company&apos;s operations were carried on. The historic old town of Uncia, with its massive stone buildings of Spanish design, is a wreck, while the Llallagua side is being rapidly built up with modern structures.
