This is the seventh annual tabulation of royalty information. It is also the first year in which some data have been deleted to make room for new data. The concept of royalties evolved from a time when the government owned all of the land, including mines, to the situation where free miners won the right to claim minerals but paid a portion of their production to the royal treasury. Today, a mineral royalty is a payment to the owner of the mineral rights for the privilege of producing the mineral commodity. However, some people incorrectly believe that the selling price and the royalty are the same thing. The contract between the owner (lessor) and the mining company (lessee) is the mineral lease. Some clauses that are common to mineral leases include: identification of property, granting clause, reservations, definitions, royalty rate, taxes and title, indemnity, termination, inspection, assignability, successors, and reclamation. There often are variations in royalty rates for a given commodity that reflect differences in location, quality, market conditions or public versus private ownership. History In the time of ancient Rome, the government owned the mining properties by virtue of conquest. It would lease the mines to favored citizens who would pay rent to the State. Various conditions of sovereign ownership of both land and mineral rights continued in Europe until the Renaissance. As the laws evolved for land ownership by private citizens, the concept that minerals belonged to the State (King, Crown, sovereign) continued until about the 15th century. Free miners challenged the notion of sovereign ownership and won the right to discover and claim minerals. But a portion of their production had to be paid to the sovereign - a royalty. So, the original concept of a mineral royalty was a tax on production that was due to the Crown or Church. The term mineral royalty, as it is known today, is a payment to the owner of the mineral rights (formerly the royal owner) for the privilege of mining and producing the mineral commodity. The owner of the mineral rights, the lessor, and the mine operator, the lessee, enter into an agreement to mine the property. The agreement is the lease. While this concept is common, there are some who do not understand that the royalty is a portion of production paid to the owner as agreed on in the lease document. This author has seen reports where the selling price of a commodity has been quoted as the royalty. ("They get 70 cents a ton royalty at their pit and the guy down the road only has a 65 cent royalty.") These reports have been authored by people not familiar with the mining industry. Lease clauses In addition to the amount to be paid the lessor, there are several other items to be addressed in the lease agreement. The following list may not be all inclusive, but briefly describes most of the common clauses any good mining lease should contain. Identification: This opening clause names the owner (lessor) and the operator (lessee), the address of each, and gives the legal description of the property. Granting clause: This part of the lease gives the time period or duration of the agreement and information about renewal periods. It also has language about the exclusive right of the lessee to mine the property. Reservations: If the owner wants to exclude any portion of the property or set some specific conditions about the operation, there needs to be a clause that describes these reservations. Definitions: This section should address some of the technical terms that the lessor may find confusing - short tons versus cubic yards, dollars versus percentage of average selling price, any escalator indices such as consumer price index or producer price index, and material mined versus material sold. Royalty: This section spells out what the royalty rate will be, how often it will be paid, if there is an annual minimum, the pay dates, and how the records will be kept. This section also describes the conditions under which the lessee is exempt from the annual minimum - natural disasters, strikes, governmental actions, or other causes referred to as force majeure. Taxes and title: The lease needs to identify who is responsible for the property taxes, severance taxes (if applicable), and other taxes that relate to the mining activity - taxes on equipment, improvements, or stockpiles. This is a good place in the lease for the owner to certify his ownership of the property and its mineral rights and also certify that no other leases are in effect. The lessees may want language that allows them to pay mortgages or other debts on the property to keep their lease in effect. Indemnity: This portion of the lease identifies that the lessee assumes the risks for lessee's mining operation. Lessor should expect indemnification by the lessee through standard insur¬ance policies - workers compensation, liability and property damage. Termination: Both the lessor and lessee want language that will allow them to terminate the lease. Classical acid-base accounting using modified Sobek titration methods has resulted in interpretation of results for materials with neutralization potential (NP) less than 20 tons of CaCO3/1000 tons of material (2% CaCO3) as "uncertain" due to lack of sensitivity within that content range. Standardization of a "fizzless" acid neutralization potential (ANP) method was undertaken in the American Society for Testing and Materials (ASTM) International using two ranges of sulfuric acid additions based on reaction pH and carbonate carbon estimates rather than subjective fizz testing as well as hydrogen peroxide additions to correct for mineral acidity. The method is identified as the acid neutralization potential acidity (ANPA) titration method. During interlaboratory testing a positive bias was discovered within the "uncertain" range which was further investigated and resolved by increasing the test sample weight from one to five grams for samples needing improved accuracy in materials with ANP <2% CaCO3. Test results from the interlaboratory testing of the low range method is presented and compared with the results from the original ANPA method in the paper.

Hong Kong’s Strategic Sewage Disposal Scheme (SSDS) Stage I involves the provision of a system of deep tunnels for transporting to a central treatment works wastewater collected from a number of catchments around Victoria Harbour. For the SSDS Stage I works, about 24 km of tunnels have been excavated in hard rock at depths ranging from about 80 to 150 m below Victoria Harbour and the surrounding heavily developed areas of Kowloon and Hong Kong. Five tunnel boring machines(TBMs) with diameters ranging from 3.2 m to 4.3 m were used to excavate the tunnels. Tunnel excavation has been completed and tunnel linings are in progress. Major tunnelling issues such as ground stabilisation and water control encountered in the project are summarised. An overview of one of the possible future tunnel systems that might be adopted in subsequent stages of SSDS is also presented.

The ability to track miners and communicate with them while they work in underground coal mines is important during normal daily operation, and critical in emergency conditions. This was evident during recent incidents at underground coal mines worldwide. Communication with miners and the knowledge of their location is of great importance for rescue efforts and the preservation of life. Numerous technologies have been developed, adapted and deployed to meet tracking requirements of the Mine Improvement and New Emergency Response (MINER) Act of 2006. Evaluating the performance of these systems has proven to be dif?cult for mine operators, system manufacturers and regulatory agencies. The MINER Act requires operators to improve accident preparedness by developing an emergency response plan speci?c to each mine. With the recent implementation of the provisions of the MINER Act of 2006, all underground coal mines in the United States are subject to the mandates of legislation concerning communication and tracking system installation. As of June 2011, 203 new or revised tracking and/or communication systems had been approved by the U.S. Mine Safety and Health Administration (MSHA), with nearly 50 other systems or revisions in the approval process (MSHA, 2011). At that time, the available approved systems for underground coal mine use included these types: ? Leaky feeder communication systems. ? Fixed node-based communications and/or tracking systems. ? Wireless node-based communications and/or tracking systems. ? Medium frequency (MF) communication systems. ? Communication system peripherals. Other types of tracking systems have since been developed and some manufacturers are seeking approval for use in this application. Some of the new products include through-the-earth (TTE) systems and various radio frequency (RF) adaptations. New technologies that are currently being developed and deployed in other industrial applications should also be considered, including acoustical, optical, inertial and hybrid technologies. To date, no uniform method has been employed in the industry to effectively compare and evaluate the performance of installed systems. Neither industry operators nor regulatory agencies can accurately assess the capabilities of installed systems in the continuously changing mine environment. There is a need for a uniform evaluation method that provides the ability to assess how different systems and technologies perform in various mining applications, and whether they can satisfy the regulatory requirements.

Installation of a horizontal air blocking shelf around the inside perimeter of the surface mining drill deck shroud is proposed to improve dust capture. Without the use of this shelf, a strong coanda effect airflow pattern results in dust leakage to the environment, especially at the shroud-to-ground interface. Bailing air exits the drill hole and travels along the drill steel to the underside of the table, where it fans out across the bottom of the drill table and continues down the sides of the shroud. This dust-laden bailing air then strikes the ground and fans out under gaps between the shroud and the ground. The proposed shelf prevents dust-laden air from striking the ground by redirecting it toward the center of the enclosure, where it can be captured. Laboratory tests demonstrated that the shelf reduced dust levels outside of the shroud by 81% under operating conditions consisting of a 1.9:1 collector to bailing airflow ratio, and a 5.1-cm (2-in) gap between the shroud and ground. The shelf was 15.2-cm (6-in) wide and located at a height equal to 2/3 the distance measured from the bottom of the shroud to the bottom of the drill table. The air blocking shelf was also capable of overcoming the adverse impact of vertical leakage along the shroud seams as long as this leakage was confined to an area below the horizontal plane defined by the shelf location.

Tunneling requirements are presenting designers with greater challenges. The design and construction of the 2000-ft long unidirectional twin highway tunnels for the approach to one of two bridges of the Louisville-Southern Indiana Ohio River Bridges (LSIORB) Project is no exception. Excavation under low cover, beneath an historic site, with each tunnel of 70-feet wide and 50-feet high dimensions will set precedents for US highway tunnel excavation size. To investigate ground conditions to supplement final design of the highway tunnels, an exploratory tunnel excavated through karstic limestone and shale will be located within the confines of the proposed final alignment. With the LSIORB Project, Jefferson County, Kentucky and Clark County, Indiana will have improved cross-river mobility between them. The Indiana Department of Transportation (INDOT) and the Kentucky Transportation Cabinet (KYTC) are developing the LSIORB Project jointly, in coordination with the Federal Highway Administration (FHWA). Section 4, one of six sections, as shown in Figure 1 is the East End Kentucky Approach and Connections to I-265. Key elements of Section 4 are the twin three-lane highway tunnels under the historic Drumanard Estate. The property is located on the north side of US Highway 42 (US 42) at the intersection with the Gene Snyder Freeway (also KY841) as shown in Figure 2. One aspect of the project consists of the excavation of an Exploratory Tunnel along the southbound alignment tunnel. At the time of preparation of this paper, KYTC has not awarded the Exploratory Tunnel Contract. This paper will focus on the planned geotechnical investigation program that will occur during excavation of the exploratory tunnel and how the design of the twin highway tunnels will incorporate the findings to achieve an innovative and efficient configuration.

INTRODUCTION This paper is the outgrowth of work done by the authors to prepare the seismic design criteria for underground structures on the Southern California Rapid Transit District (SCRTD) Metro Rail Project. It is a follow-on to a similar paper presented at the October, 1984, ASCE National Convention (17). For design, the earthquake-induced distortions recommended herein are to be added to the normal static loading conditions for the underground structure. This design approach has been used by 18 section designers on the SCRTD Project. Preliminary results from two- and three-dimensional finite element solutions have partially verified the approach. Areas where additional research is needed for special cases are identified. EFFECTS OF EARTHQUAKE The effects of earthquakes on underground structures may be broadly grouped into two general classes -shaking and faulting. In response to earthquake motion of bedrock (shaking) , the soil transmits energy by waves. Seismologists identify various types of earthquake waves, but underground engineers are generally interested in the effects of transverse shear waves which produce a displacement of the ground transverse to the axis of wave propagation. A leach pad’s fluid flow characteristics greatly affect the recovery of metals from heap leaching. However, because there are other factors such as particle size distribution, application rate and method, and chemical reactions to consider, mining companies often overlook potential problems associated with fluid flow until it is too late. In an effort to better understand the dynamics of fluid flow in leach pads, a series of experiments were preformed using temperature probes. A model leach pad was set up using a particle size distribution, fluid application rate, and application method common to modern leaching methods. Variable water temperatures were applied in succession and data gathered from the three dimensional grid of temperature probes built in to the model. Current work is analyzing these data along with visual observations of the model, computer simulations, past mining experiences, and other related research, in an attempt to develop a low cost test that could be performed prior to large scale leaching to determine the fluid flow characteristics of a particular ore. This paper will summarize the work and findings to this point as well as suggest areas of additional related research.

Common clay is a natural, fine-grained material composed of hydrous aluminum silicates. Shale is a laminated sedimentary rock that is formed by the consolidation of clay, mud or silt. Production About 150 companies produced common clay and shale in 41 states. In states not reporting production, common clay and shale probably was mined and sold for construction applications by companies not participating in the U.S. Geological Survey (USGS) canvass of producers. Domestic production in 2005 was estimated to be 24.8 Mt (27.3 million st) valued at $176 million. This was based on a preliminary survey of the common clay and shale industry. The leading producer states, in decreasing order by tonnage, were North Carolina, Texas, Alabama, Georgia and Ohio.

The flotation froth structure and motion determines the amount of entrained gangue that is collected to the concentrate. Despite this important role in the overall performance, the behaviour of the froth is still ill understood. To date, predominantly empirical models have been developed to describe entrainment. A fundamentally based model is described and used here in an attempt to improve the understanding of entrainment. This general froth simulator (UMIST FrothSim) allows the modelling of a wide range of flotation conditions, as it takes account of a large number of the physical phenomena that occur within flotation froths. The model firstly describes gas motion and bubble coalescence, and the water motion based on gravitational, viscous and capillary effects. The motion of the solids distinguishes between various solids classes based on hydrophobicity, particle size and density and models them by including the effects of Geometric and Plateau border dispersion, particle settling and the motion of the water. The aim of this paper is to show the applicability of this model to explain the observed entrainment and collection of gangue. This is done by comparing model predictions with the experimentally observed relationship between the gangue and water recoveries. The model predicts the identical trends, which are explained in terms of the interaction between the linear effects of water motion and hindered settling and the non-linear effect of particle dispersion.

This paper describes the microbiology basics underlying heap and tank biooxidation of metal sulfide ores and concentrates. The primary organisms are identified and described along with the reactions they catalyze and their growth requirements. Also described is the interaction between ore leaching bacteria and the leaching environment in terms of solution chemistry, temperature, and mineral precipitation. Specific factors and agents that stimulate or inhibit growth and activity of ore bioleaching will be identified. Some of these factors are organism-specific and others are generic for microorganisms that grow under acidic conditions. Current knowledge of the limits of bioleaching in terms of dissolved ions in leach solutions, pH, and temperature will be summarized.

The National Mining Hall of Fame and Museum (NMHF&M) will celebrate its 25th anniversary on Sept. 22, 2012 when the 2012 class is inducted during a special ceremony in Las Vegas, NV in conjunction with MINExpo 2012. The NMHF&M will induct four men representing the equipment manufacturing, minerals exploration, copper and coal sectors of the mining industry. The diverse cross-section of mining industry giants joining the hall of fame include Glen A. Barton, J. David Lowell, Samuel Newhouse and John Cleveland Osgood. They will join 214 other mining industry pioneers when they are formally inducted into the National Mining Hall of Fame at the 25th Silver Anniversary Induction Banquet & Ceremony. These men were selected for being visionaries, leaders and ambassadors within their own sectors and across the industry at large.

This paper deals with the development of environment performance indicators (EPIs) for the steel industry. Environmental performance has become one of the key measures of business success. Emergence of continuing pressure from customers, employees, government and NGOs for environmental performance evaluation (EPE) of industries has led to evolve a framework for the development of sector specific environmental performance indicators. EPIs can be used by steel industry for assessing the continual improvement in environmental perfromance, selecting various eco-friendly options, benchmarking, environmental reporting, technology assessment and dissemination, evaluating environmental impacts and building EPIs based environmental management systems. The objective of this paper is to develop EPIs for steel industry and provide framework for development of environmental performance indicators based environmental management system and its integration with the overall management system. An indepth discussion has been presented concerning identification of EPIs, eavaluation of significance of EPIs, their prioritization and its integration with Environmental Management Systems. A new methodology has been proposed for implementing EPIs based environmental management systems . The material presented is derived in part from PhD studies of Rajesh Kumar Singh.

Significant deposits (> 4,000 ha) of heavy mineral sands were discovered in the USA Coastal Plain of Virginia and North Carolina in 1989. The majority of these lands support highly productive row crop agriculture, and the development of restoration protocols that would return these lands to agricultural use was deemed to be critical to the long term sustainability of mining operations. Virginia Tech worked closely with all stakeholders to develop appropriate restoration protocols and to coordinate their implementation. Full-scale mining operations at the Old Hickory Project in Virginia were initiated in 1997 by Iluka Resources Inc., and restoration protocols have continued to evolve in response to a variety of economic, technical, and social issues. Approximately 750 ha of land are in various phases of backfilling and final reclamation. Return of these lands to agricultural row-crop production has been complicated by lateral variability in mine soil physical conditions, excessive compaction, and limited topsoil return. However, within the past two years, a series of tailings deposition and soil reconstruction practices have been developed and implemented that significantly improve post-mining soil productivity. Deep ripping and appropriate use of organic soil amendments have been particularly effective at restoring post-mining soil productivity.

The replacement of the dry mining method at Guajú Mine by the dredging method was a means of ensuring its feasibility by maintaining the production levels. Dry mining increased the cost of the deposit with the distance and presented a limited mined volume, while the decreasing grade of the deposit led to a production drop. With the new methodology, there was a considerable reduction in unit cost of the mine and an increase in the production level of a deposit with low heavy minerals content.

On Nov 1, 2007 House Resolution 2262 ? The Hardrock Mining and Reclamation Act of 2007 ? was passed by the U.S. House by a vote of 244-166. HR-2262, among other things, would impose a 4-per-cent royalty on existing mines with commercial production and an 8-percent gross royalty on all new claims. Not surprisingly, this possible new law was one of the hottest topics of discussion at the Northwest Mining Association?s conference that this year returned to Spokane, WA for its 113th annual meeting on Dec. 3-7. More than 1,800 delegates attended the conference that was held under the banner theme of ?Mining ?. For today and tomorrow.? Northwest Mining Association executive director Laura Skaer was one of many speakers during the three-day conference to respond to the threat to the industry posed by HR-2262 with a presentation titled ?Potential changes to the 1872 Mining Law.? In the presentation that she first unveiled at the Alaska Miners Association?s convention and trade show on Nov. 8, Skaer laid out a comprehensive list of problems with HR-2262. In addition to the association?s obvious concerns about the proposed royalty, Skaer noted that the bill includes a mine veto provision that would allow the Secretary of the Interior the authority to deny an operations permit to a project if the secretary determines that the operation would cause undue degradation to public lands and resources. Potential massive withdrawals from mineral entry are also included in HR-2262. Among the lands that could be off limits to miners under HR-2262 are wilderness study areas, areas of environmental concern and 23.6 hm2 (58.5 million acres) identified as Roadless Rule. States, political subdivisions and Indian Tribes would also have more authority to withdraw lands, she said. To combat the proposed changes, Skaer made 10 trips to Washington D.C. on behalf of NWMA members in 2007. In her presentation at the annual meeting, she also objected to provisions that include no life-of-mine permits and uncertain permit renewals and new and duplicative environmental standards that she said are vague, ambiguous and inconsistent with current federal and state environmental laws. Rip van Winkle is back ? and he?s meaner than ever.?

There is no doubt that simulated ventilation networks must be adequately verified before they can be extrapolated and used for predictive purposes. There are two general approaches as to how the verification can be established and these are summarised as follows; The first approach is to measure all individual branches with trailing hoses or barometers to get individual pressure drop and flow per branch and then calculate individual resistance factors for input into the software. The simulator is run, checking that the output makes general sense (check some sensitivities if possible). The network is now considered as verified. The pressure drop to be measured is relatively small and thus it is inherent that the measured set of individual K factors will be imprecise no matter how much care is taken in the measurements and the resultant simulations will inherit the same problem. In the second approach, the network is assembled using estimated (Atkinson) K factors (based on physical features of airway, past experience and catalogued typical K factors). Only the main primary flow rates are measured and hence the relative distribution of the primary ventilation in the main airways is determined (probably about 10 off primary air flow measurements). Main critical pressure differentials at main and booster fans and across critical doors are measured (probably about 6 off primary pressure differential measurements need to be made). The simulator is run and the computer model is used to iterate and select an updated suite of K factors so that the flow balances and pressure differentials are correctly simulated (typically only 2 or 3 iterations are all that is needed). The network is now considered as verified. The pressure differences to be measured will be substantial in absolute terms and can be measured with high precision. Also, because only primary flows are measured, these will generally be measured at higher air speed points and hence improved relative accuracy. This leads to more accurate simulation results. In 2004, management at Unimin’s Gleason, TN operation began implementing ergonomic interventions specifically targeted to reduce risk of musculoskeletal injuries (MSIs). Together with corporate and site management, Unimin identified work site hazards and began to modify work practices/equipment. Some interventions were relatively simple and were implemented immediately. Others, like improvements to a mobile shredder, were more complex but were eventually resolved through a participatory approach with employees, management, manufacturers and NIOSH. This paper discusses ergonomic interventions that were successfully implemented using a bottom-up approach to reducing the risk of injury.

Abstract An extensive drilling and laboratory testing program indicates that a construction aggregate resource is present within the Oligocene Sombrerito Formation limestone, southwestern Dominican Republic. The first part of the testing program included the collection, photographing and geologic logging of diamond drill cores to allow lithologic subdivision of the strata into potential quarry layers. The primary lithostratigraphic units are: I- (youngest) approximately 10 m of white, dense marine limestone II-approximately 5 m of white, interbedded dense and chalky marine limestone III-more than 2 m of tan, chalky, calcitic dolomite. Unit I is often altered by lateritic weathering and/or dolomitization. Unit II is often altered by dolomitization. The cores were individually crushed by quarry layer into coarse and fine aggregate sizes for chemical and physical analyses: specific gravity and absorption, MgSO4 soundness, sand equivalent, Atterberg limits of the minus #40 mesh fraction, and LA degradation. The unaltered portion of Unit I is suitable for all construction aggregate uses. Unit II is best suited for crushed stone base. Each of the non-weathered units decreases in coarse-aggregate yield and quality with depth and diagenetic dolomitization. Dolomitization typically causes about 5% lower yield of coarse aggregate, a sand equivalent of about 20 units below the original value an increase in absorption of about 3%, an increase in the LA of up to 13%, and a decrease in the average five-cycle MgSO4 soundness of about 17%.

The metamorphic terrane of southwestern India is a geological environment containing ilmenite source-rocks, transport drainage systems, and resultant beach sand deposits that contain altered ilmenites greater than 60wt% TiO2. As such, this environment provides a geological laboratory, from source to deposit, for the investigation of ilmenite origin, alteration, and geochemical character. Ilmenite samples from potential source rocks, river sands, and beach sands all show degrees of alteration and a variety of alteration textures (iron leaching) producing leucoxene (here defined as >70 <90wt% TiO2) and progressing to rutile (here defined as >90wt% TiO2). Distinct alteration textures are specific to different source rocks and are used together with trace element geochemistry as provenance criteria. Ilmenites are classified on the basis of their trace element content. In India, the ilmenites are classified principally according to the Mg, Nb, and Mn content and this signature defines potential source rocks, even where the ilmenite is altered to a TiO2 content of 70wt%. The trace element data may fingerprint source rocks whose ilmenite is more prone to iron leaching and that criterion has application in exploration for higher-grade ilmenites.
