In the limestone area of Tintic and other mining districts of the Great Basin region of Utah, it has been observed that surface-outcrops of ore occur but seldom, and are mainly confilled to points of relatively low elevation, where the veins cross some basin or ravine. Nowhere does a considerable body of ore outcrop on the tops or high up on the slopes of the hills. Mining operations, on the other hand, have shown that large and continuous ore-deposits frequently occur in depth in the limestone, beneath large masses of barren rock. Such orebodies, when followed upward in the lodes, are found to terminate at well-defined levels, without reaching the surface. Yet the minerals-bearing fissures themselves extend above the top of the ore, being often traceable, though barren of all valuable minerals, for hundreds of feet above the stopes in the mines, and even observable in outcrops at the surface. This abrupt cessation of the ore at a uniform horizon does not appear to be connected with any change in the countryrock adjacent to the lodes. The strata above and below this horizon seem to be in every way equally favorable to ore-deposition. Explorations above it have developed an open-fissured country, barren not only of ore, but also of indications that minerals bearing gold, silver, lead or copper were ever deposited in the strata at that elevation. The height reached by the ore, while usually constant throughout the length of a given lode, may vary in particular sections, from the operation of local causes. Discussion of the paper of N. V. Hansell, presented at the Cleveland meeting, October, 1912, and published in Bulletin. No. 72, December, 1912, pp. 1497 to 1,517. F. L. GRAMMER, Leesburg, Va. (communication to the Secretary*).:-Mr. Hansell conies from a country where charcoal is the fuel, and fuel is therefore costly. The Swedes appreciate more than most Americans the value of ore-concentration, not only in fuel-economy, but also in its influence on the quality of metal produced. Neither in these particulars nor in our knowledge of the dressing of iron-ore do I think. we can claim to be their equals. A 60 per cent. ore is not merely- twice, but more than four times, as valuable as an ore carrying 30 per cent,. Failure to appreciate this fact explains many idle American stacks, erected in defiance of it. Next to the rule that the equipment-cost of a blast-furnace increases approximately as the square of the hearth-diameter, I know of no mathematical relations involved in smelting iron which are less appreciated than the disadvantages of lean ores. Mr. Orn told me, when I was in Stockholm, that 2,500 patents on magnetic concentration had been taken out. He may have been joking as to the exact figure, but his remark indicated the great activity of inventors in this field. The magnetic separators seem to represent two main ideas, namely, wet and dry separation. The wet separators, such as the Gröndal, are applicable to ores requiring the greatest comminution by reason of the small particles of associated minerals or because of the occurrence of magnetite with a soft mineral likely to cake, as in those of Cornwall, Pa. Of the dry magnetic separators some are well suited for large-grained ores, such as those of Mineville, N. Y. We have also magnetic separators, like the Wetherill, for ores not usually classed as magnetic.

A cyanide leaching process developed at Michigan Technological University was tested in a 12 to 24 tpd pilot plant. Flowsheet layout and equipment are described. Cyclic operation of leaching, copper precipitation by acidification, and regeneration of the cyanide leaching solution are discussed. Copper extraction and reagent consumption were as predicted by laboratory tests, and the process was proven to be technically feasible. The White Pine Copper Co., a wholly-owned subsidiary of the Copper Range Co., produces copper in the Upper Peninsula of Michigan. Production in 1965 amounted to 138 million pounds of metal. An expansion program now under way will increase this by approximately one half. The highly mechanized room and pillar mine produces 18,000 tons of ore per day, which is treated in a flotation plant. The concentrate is smelted in a reverberatory furnace, the matte is blown in converters to blister copper, and the blister copper is further refined to a uniformly high-quality Lake copper, which is 100% conductive and has a silver content of 25 to 40 oz per ton. The run of the mine ore averages 22.5 lbs of copper per ton with the ore mineral occurring in the form of chalcocite. The nature of the mineralization is such that the sand tailings average a little over 4 lbs of copper per ton. Intensive research has improved copper recovery in the flotation operation to some extent, but at the scale of present operation about 12,000 tons of sands containing over 48,000 lbs of copper go to the tailings pond daily. When the plant expansion is completed, the loss of copper will be somewhat greater. In 1959, the White Pine Copper CO, initiated a study of the recovery of copper in the sand tailings. Inasmuch as the flotation operation was considered to be optimized, a logical approach seemed to be leaching. For various reasons ammonia, ferric chloride, acid, and biological leaching were ruled out as impracticable. This led to a consideration of cyanide leach-

It may seem necessary to offer an apology for presenting for consideration a process which is conspicuous by its absence in the literature of the Institute, and which may be thought by some to belong to the past in metallurgy, and to have been already superseded. But the large capital invested in puddling calls for a careful consideration of the question whether the time has certainly arrived when the puddling furnace must be replaced by the converter and open-hearth furnace. May there not still be a place for puddled iron alongside of molten iron and steel, and is not the improvement of the puddling process itself worthy the attention of engineers equally with the Bessemer and open-hearth processes? The changes involved in the conversion of pig iron into wrought iron are well understood and need only be briefly alluded to. The patent of Henry Cort bears the date of 1784. Since that time * the improvements in the process have mainly consisted in the replacement of sand by iron bottoms by Samuel Baldwyn Rogers in 1818, and the still more recent substitution of iron oxide for the refractory materials used for the rides and bridge of the hearth, which distinguishes the wet or boiling process from the dry or pnddling process. Chemically, the process consists in the removal of the metalloids from the pig iron, a result effected mainly by the iron oxide. Silicon is first oxidized, then the phosphorus, and finally the carbon. The silicic and phosphoric acids produced pass into the cinder and the carbonic oxide burns as it escapes from the bath of metal. It is interesting in this connection to note the effect of temperature on the removal of the phosphorus from the iron. As is well known, no phosphorus is eliminated under the oxidizing influences prevailing in the Bessemer converter, while from 70 to 80 per cent. is removed in puddling. The ore deposits at Firmeza have been worked continuously since 1884; those at Daiquiri since 1895. It is surprising, therefore, that they have not been the object of careful geologic study until quite recently. It is true that considerable attention was paid to these deposits by A. C. Spencer, in 1901, in the report on the geology of Cuba, by Hayes, Vaughan, and Spencer,l but this was only incidental to a hasty general reconnaissance of the Island. As far as the Daiquiri deposits are concerned, this gap has been filled by the appearance of the two papers by Prof. James F. Kemp2 and by Prof. Waldemar Lind-gren and Clyde P. Ross respectively.3 Max Roesler, first holder of the Emmons fellowship, made a detailed study of the Firmeza deposits during the past summer, so that soon we can expect a full description of them. Consequently, there is no, demand at the present time for a description of the deposits from other sources, and that is not the purpose of this paper. The papers on Daiquiri, however, leave unsolved problems in regard to the age of the rocks of the district and certain phases of the genesis of the deposits, and it is with the hope of aiding in the solution of some of these problems that this contribution is offered. Kemp, and Lindgren and Ross agree in assigning these deposits to the type of contact metamorphic deposits. They disagree in part on the question of their localization. The deposits occur in an extensive area of diorite which includes numerous blocks of limestone, and sometimes are found in the contact zones between these blocks and the diorite, and in other instances are completely enveloped in the diorite, showing no apparent connection with the limestone. W. ROWLAND Cox,* New York, N. Y. (written discussion?).-The process described by Mr. Malcolmson undoubtedly represents a great stride toward conservation of our natural resources. Without discussing the subject from an economic standpoint, I wish further to emphasize the fundamental principles of the Smith process in order that its economic value may be fully appreciated. The process is essentially a means of producing an ideal fuel, as regards its combustion qualities, by the removal of the so-called volatile matter from the coal, in the form of byproducts, which have value for other purposes far in excess of their fuel value. In other words, coals which contain. large amounts of gas, tar, and ammonia, and are not suitable for domestic or industrial fuel, or for treatment in byproduct coke ovens or gas retorts; because they possess poor coking qualities, can he prepared for commercial use by the. Smith process with a very high degree of efficiency. Much work has been done along this line, both in this country and in Europe, in developing a means of preparing coal, as the economic advantages have long been recognized. To the best of my knowledge, the Smith process is the only one that has proved its commercial adaptability. Distillation of coal at 900° to 1000° F. (480° to 540° C.) yields a large amount of tar and oils. The residue of the distillation, however, is a very friable semi-coke, wholly unsuitable for use as a fuel, unless it can be charged directly into a byproduct gas producer. The problem which confronted the inventor was then to convert this carbon residue into a commercial product, and it is in this step that the Smith process has overcome the obstacles which prevented a number of other methods from becoming commercially practicable.

Oceanographers are tooling up. Back of the build-up is Navy defense work and private business. Business is dipping toes in the ocean gingerly and not sure whether the motivation is based on logic or intuition. The problem is that new business opportunities in the oceans could explode rather than evolve. The question is when. At stake for earthlings are food supplies, mineral resources, oil and gas, weather forecasting, navigational systems, shore erosion control and sewage disposal, as primary targets. "Twenty years ago, offshore oil seemed a remote possibility for economic exploitation but today it is a reality. It became a reality largely because of the development of practical ocean seismic equipment and drilling platforms. Today the oil industry is looking at submerged-type drilling rigs. Mineral exploration in the sea is more expensive than on land now primarily because familiar land tools are being modified for sub- marine work." These were the ideas expressed by C. G. Welling of Lockheed Missiles & Space Co., at one of the many meetings that have taken place so far this year on development of marine resources. Welling's views indicate the rationale of companies that have already invested in the sea. Many companies, including those in mining, have observers who caution, "go slow." The continental shelfs and even the deep ocean floor represent to the mineral industries the age-old, enigmatic confrontation-is this the time to move? To no other industry, except Defense, are the results of correct timing so vital.

There are two methods employed in the development of oil pools. The older and dominant method is one in which the primary object is the protection of the underground deposit from drainage through competing wells, and considerations of efficiency of extraction and cost of production are subordinated thereto. The newer and less prevalent method is one in which maximum efficiency and minimum cost are the first objectives and developments to these ends may proceed undisturbed by the exigencies of competitive drainage. The second method has developed mainly in pools under single ownership and the term "unit operation" has come to be applied to this procedure. A single ownership, however, is not essential to the method, for unity of operation may be achieved by agreement under split ownership, or even by a concert of enlightened purpose. There are examples of unit operation where neither the ownership nor the management is a unit, but merely where unity of procedure has been attained, as in the Yates pool. Throughout this paper "unit operation" is used in its broad sense without implying sole ownership or single management, although unit operation is more conveniently attained where these conditions are present. It is evident, upon reflection, that the second method should yield results far superior to the first, for the work of exploitation can be conducted without extraneous considerations and the natural forces present in the oil reservoir can be utilized to maximum advantage. Experience has amply confirmed this conclusion and were the facts widely known and appreciated, the efforts to extend the applications of the principle of unitization would be greatly intensified. Competitive Development of Oil Pools It has come about that the vast majority of oil pools, or reservoirs, in the United States are subdivided by numerous surface tracts under separate ownerships. This condition arises from the prevalent practice in the oil business of acquiring prospective acreage in checkerboard spreads. One of the most interesting as well as important factors connected with the petroleum industry is the consumption of motor fuel. A few years ago we always spoke of "gasoline," but when natural gasoline and benzol became more important it seemed desirable to include all of these products in the petroleum statistics and so there was adopted the term "motor fuel," which embraces these three products in their entirety. Gasoline always included all stove and motor gasolines, high-grade naphthas, cleaning naphthas, solvents, varnishmakers' and painters' naphtha and gas-machine gasoline. "Motor fuel" includes all of these products also; therefore, technically the term "motor fuel" is incorrect, but as the total quantity of these non-motor naphthas is small their inclusion does not distort the results to any appreciable extent. When the Federal Oil Conservation Board appointed its first semiannual forecasting committee early in 1930 to project the demand for gasoline and crude oil into the year 1930, it was necessary for that committee to formulate a method of forecasting. It adopted the system in use by some of the oil companies at that time, of using automobiles and per-car consumption. Six months later the American Petroleum Institute also formed a committee for forecasting, which adopted the committee principle of asking each member to produce his own forecast of demand by any method he thought best and to give a full explanation to the committee. The result of the latter method was to get the benefit of as many different methods of forecasting demand as there were members. The writer does not recall any two members ever using exactly the same method. By studying the different forecasts and their methods, there evolved a composite opinion, which was presented to the industry as the committee's estimate. The same method has been followed by the American Petroleum Institute or Planning and Coordination Committee ever since.

THE purpose of this note is to show that the dislocation mechanism controlling the creep of Fe-4 pet Si alloy1 may equally account for the behavior of a-Fe2 over the same temperature range. A recent study of the creep behavior of a-Fe has been made by Ishida et al.2 Their results were in agreement with the mechanism of nonconservative motion of jogged screw dislocations over the entire range of temperatures investigated, from 480° to 1045°K. However, the observed creep rate was much higher than that which could be accounted for by the above model unless the authors assumed that pipe diffusion became significant below 775°K. More recently, Cheng et al.1 inves-gated the creep of Fe-4 pet Si alloy over about the same temperature range and found that the results could be correlated fairly well with a dislocation climb mechanism as represented by Eq. [l]. Proceeding as shown previously,1 if creep is controlled by a single climb mechanism, at intermediate stresses, the shear creep rate, y, can be represented by where n and K are material constants {K is independent of the temperature but dependent on the structure, that is, K decreases during the primary stage and reaches a steady-state value over the secondary stage of creep), t is the applied shear stress, G is the shear modulus, gc is the free energy of activation for creep (usually equal to that for self-diffusion, gd), and RT has the usual meaning. By solving for y, the apparent activation energy for creep, Q which can be determined experimentally, is given by where hc is the enthalpy of activation for creep which usually is also equal to that for self-diffusion, h^. By using Eq. [2], the data in Fig. 2 of Ref. 2 can be re-plotted as shown in Fig. 1. By comparing the two figures, it is seen that the slight increase in the apparent activation for creep over Region II, as noted in Fig. 2 of Ref. 2, is due to the influence of temperature on the shear modulus rather than of the stress on the

Commercially, celestite (SrSO4) is the predominant strontium mineral. Among other strontium-bearing minerals, only strontianite (SrCO3) occurs commonly; however, it is rarely an item of commerce. Production of celestite is principally in Mexico, Spain, and Turkey. An attempt to produce celestite in Canada was unsuccessful. The United States, which is wholly dependent on imports, chiefly from Mexico (99%), is the largest consumer of strontium. Lesser quantities are consumed in Japan and Europe. The Federal Republic of Germany is the principal source of strontium compounds imported to the US. Uses The principal uses of strontium are for the manufacture of strontium carbonate and nitrate. Carbonate is used in glass for TV tube face plates and in ceramic ferrites for magnets. Nitrate is used in pyrotechnics, mainly in safety flares, to which it imparts a characteristic brilliant red color. Minor amounts of strontium compounds are used in electrolytic zinc manufacturing where the carbonate is used to remove unwanted lead. Small quantities are consumed in greases, ceramics, soaps, alloys, and pharmaceuticals. Specifications Typical celestite specifications for the carbonate and nitrate markets are shown in Table 1. Specifications of manufactured carbonate, sold in two grades, one to the glass industry and the other for ceramic ferrites, are shown in Table 2. Both grades of carbonate are shipped in palletized 50-lb bags. Glass grade material is shipped in bulk by rail. [ ] Manufacturing Processes The following description is adapted from Anon. (1980) . The manufacturing process for strontium carbonate and strontium nitrate chemicals is conceptually simple. Strontium nitrate is made from strontium carbonate in two additional steps. The production process begins with celestite, the natural form of strontium sulfate. In the first step the ore is crushed, ground, and mixed with coke. This mixture is then fed into a kiln where the ore is reduced at high temperatures to strontium sulfide; the coke is added to the ore as a source of energy and carbon. FRIENDS of the late Charles F. Rand presented in 1930 a sum of money from which the income is available to support various phases of the work of the Institute in which Mr. Rand was so deeply interested. At present the fund amounts to $10,900. The specific terms of the deed of gift are as follows: "The fund collected to establish a memorial to the late Charles F. Rand shall be placed in the custody of the Board of Directors of the American Institute of Mining and Metallurgical Engineers, to be set up as a trust to be known as the `Charles F. Rand Foundation,' the income of which shall each year be applied to a distinct purpose to be decided upon in that year by vote of the Board of Directors. This purpose shall be such as to promote the general welfare of the Institute and to constitute a permanent memorial of the usefulness of Mr. Rand, who for many years gave unstintingly of his time and talents in its service. "It shall be within the discretion of the Board of Directors to establish a medal to be known as the Charles F. Rand Memorial Medal to be awarded at such a time and under such rules as may be determined by the Board of Directors, for Distinguished Achievement in Mining Administration." The establishment of this medal was announced at the annual meeting in February, 1932, the term "mining" being defined in its broad sense to include metallurgy and petroleum. Results of preliminary research on the use of small diameter water jets at high pressure for cutting rocks has demonstrated the possibility of effective cutting of anthracite. Detailed research has, therefore, been conducted at the Skotchinsky Institute of Mining to study the dynamics and structure of the small water jets and the mechanism by which they cut coal. One of the objects of this research was to obtain data for the design of a machine for cutting rock, based on the same principles as that for cutting coal. The productivity of water jet mining machines depends on the hydro- dynamic parameters of the jet. Therefore, the research on small diameter water jets was directed, initially to a study of the nature of the variation of these parameters, and to obtain a profile of dynamic pressure distribution over the section of the jet. As has been confirmed previously, the required jet pressure (to cut coal) lies in the range of 100 to 500 atmospheres. These pressures were utilized for the research. The diameter of the nozzle was changed as ~follows; 0.97; 1.24; 1.5; 2.17; 2.87; and 3.57 mm. Graphs showing dynamic pressures for each nozzle diameter and varied axial dynamic pressure were obtained over distances ranging from 2 to 70 cm from the nozzle. One of the most important hydrodynamic parameters of a jet, closely related to the dynamics of jet disturbance in air, is the magnitude of the axial dynhmic pressure. A study of the variation in this pressure with increasing distance from the nozzle led to the separation of the jet into three specific parts, which differ from each other not only in the nature of the change in dynamic pressure, but also in structural properties.

One of a recent batch of samplcs from the Serra da Baliza, in the state of Paraná, Brazil, contained asphalt and a dark heavy oil; and workmen on the railway from Porto Uniáo to Uruguay discovered asphalt coming from eruptives that outcrop along the Rio de Peixe. The occurrence of asphalt in the triassic eruptives of southern Brazil, however, has been known a long time, according to Dr. Gonzaga de Campos. It is generally believed that the Botucatd sandstone is always a hard vitrified rock, from the metamorphic action of the overflowing eruptive contacts. In this region, howeyer, the contact metamorphism is almost nil; the sandstone is slightly hardened in a narrow zone about 20 to 30 cm. wide. In many places, the sandstone is so friable as to be easily reduced to sand, which is used in mortar for building in Guara-puava and Palmas. South and west from Porto Uniáo, this bench of sandstone is about 50 m. thick, and is capped by a heavy bed of basic eruptives, many of which are amygdaloids. Nature of Rocks Dr. Geo. P. Merrill, after studying the triassic eruptives collected by the Coal Commission, reached the conclusion that "All these rocks are of typical basalt-diabases, not in any essential different other than in structure. An interesting mineralogical phase is its paucity in olivine, which in many cases is completely lacking." Professor Hussak, who carefully studied these rocks and their accessory minerals, decided that in the dikes they are granular (diabase) and that in the lava sheets, porphyritic (augite-porphyrite or melaphyre), and that the latter pass evidently to normal diabases and are always typical of effusive rocks. The examination of many slides from dikes and sheets leads us to adopt the opinion of Professor Hussak; the rocks of the dikes are of ophitic structure, while that of the sheets show a great variety of structure and may vary from almost granular to basaltic. The great paucity in olivine had been noted by Hussak, who classes as melaphyres, the porphyritic triassic rocks in Brazil which contain olivine.

IT is likely that among most races, owing to the ease of finding and working clay, the making of clay utensils was learned earlier than the molding of metal implements. The ancients made good pottery and durable brick in kilns that wasted fully one-half the heat and spoiled fully one-fourth of the ware; and, taking the clayworking industry as a whole, we are doing the same today. The chemical and physical changes involved in the burning of clay are so many and vary so much with the composition of the clay that it is not surprising that the rule-of-thumb methods so commonly employed fail to give uniform results. In its passage from plastic clay to the vitreous or stonelike character the mingled minerals and accidental organic impurities of which the clay is blended must pass through four stages, the second and third usually overlapping, and the fourth often beginning before the third is complete. These stages in their order with the rising temperature are drying, dehydration, oxidation, vitrification. In the first part of the drying stage, usually accomplished in part outside the kiln, the water mixed with clay is dried out at temperatures not much exceeding the boiling point of water. In the later part of this stage, within the kiln, the hygroscopic water, absorbed from the air is expelled at somewhat higher temperatures, this stage being known as watersmoking. Some clays are very sensitive to temperature during the drying stage and if the temperature exceeds 100°, the ware becomes checked. Other clays may be dried more rapidly without danger. In down-draft kilns, the draft is slight during the watersmoking stage and the water driven off from the top rows condenses on the ware in the bottom of the kiln, with the result that high temperatures are likely to be reached at the top of the kiln before the bottom is fully dry. The lag in temperature of the bottom persists to the second stage in spite of the better draft then prevailing.

Improving economic conditions are reflected in the statistical picture of the petroleum and natural gas industry for 1933. Prices were better, demand was greater and the volume of production increased. The increase in the production of gas has been due mainly to the utilization of outlets to the new prolific gas fields of Potter and Tioga counties; of oil, to the growing demand for Pennsylvania grade lubricants. It should be emphasized that nowhere is volume of production more subject to control due to the extensive use of secondary methods of recovery and regional peculiarities than in Pennsylvania. A summary of developments in production for Pennsylvania in 1933 of necessity is brief. The data listed in Table 1 are all too few in number and not all that is desirable from the standpoint of accuracy. No state agency for the collection of data exists, no reports are compulsory. Nevertheless, because of the hearty cooperation of many individuals and public spirited corporations, it is believed that the data are as reliable as are obtainable at the present time. Furthermore, records of the past too often are lost, were never in existence or are fragmentary, to say the least. Illustrative of the condition is the fact that no thorough study of the oil and gas-producing regions has ever been made. The publications of the Pennsylvania Topographic and Geologic Survey upon the subject are noteworthy and valuable, especially the most recent one.' The Survey has been handicapped in the work by lack of time, personnel and funds in addition to the difficulties mentioned previously. It is obvious, therefore, that Table 1 cannot be completed for Pennsylvania. The data simply are not in existence. Officially there are 328 oil and gas pools or fields known by name and 58 distinct sands or horizons, one or more of which are productive of oil and gas in the various pools, but reliable data for only three general regions could be assembled.

THE need for new or improved refractory materials has caused metal phosphides to be given renewed scrutiny. Some metal phosphides show high-temperature inertness, are exceptionally hard, and exhibit a marked resistance to chemical attack. Various metal phosphides have been prepared for study by direct combination of the elements,'-' by reaction of metal or metal compounds with phosphine or phosphorus trichloride,'"' by thermal decomposition of a metallic phosphate or phosphite,"-'8 and by molten salt electrolysis.19 Electrolytic preparation of phosphides of titanium, manganese, and chromium from their oxides is reported in this paper. An externally heated 3-in.-ID by 6-in.-deep graphite cell, that served as the anode as well as a container for the electrolyte, was used in these investigations, and a suspended, centrally positioned graphite rod served as the cathode. A closely fitting silicon carbide furnace liner minimized atmospheric oxidation of the crucible. Electrolyses were performed for predetermined periods and current settings. Preliminary research had indicated the more efficient current and potential settings that could be used. Upon completion of the deposition period, the deposit was hot-stripped from the cathode. The mass of crystalline deposit, plus occluded and adhering salt, was crushed to minus 10 mesh and hot-leached in dilute hydrochloric acid. The leached crystalline material was water-washed, dried, and sampled for analysis. Products were identified by X-ray diffraction and standard analytical procedures. Electrochemical studies were initiated to establish the optimum conditions necessary to produce manganese phosphide (MnP), titanium phosphide (Tip), and chromium phosphide (CrP). Among the factors studied were the operating temperature, the imposed current, and the electrolyte system. If the temperature, or imposed current, was too high, deposition of phosphorus resulted, and if either were too low, partially reduced lower oxides were deposited. The operating conditions established for repetitive high-quality production of metal phosphides of the MP structure are presented in Table I. The metal phosphide crystals varied in size, but all had a definite metallic appearance. Typical are the crystals of CrP shown in Fig. 1. Evaluation data and analysis of the crystals are presented in Table 11. Efforts to measure resistivity of these three compounds over the temperature ranges of 250o to 400°K were hampered by the small physical size of the crys-

JUDGE Samuel E. Schull, in the Court of Quarter Sessions of Monroe County, Pa., handed down a decision on July 2, declaring the Pennsylvania law for the Licensing of Professional Engineers and Land Surveyors to be in violation of the Constitution of the State of Pennsylvania and also of the 14th amendment of the Constitution of the United States. The case was that of George E. Stevenson, who was arrested in June, 1922, charged with the practice of the profession of land surveying without first obtaining a state license. Mr. Stevenson had had forty years of practical experience as an engineer and land surveyor, and as set forth in the findings "had attained unusual skill, distinction and reputation in his said profession, and, on said date and for a considerable period thereto-fore and down to the present time, was and is President of the Engineer's Society of Northern Pennsylvania." That part of the decision referring to the unconsti-tutionality of the act is quoted in full as follows: This matter now comes on to be heard on argument as to the constitutionality of the said Act of May 25, 1921, P. I. 1131. The defendant urges that the same is unconstitutional: First: Because it is in violation of Article 3, Section 3, of the Constitution of Pennsylvania, which provides: "No bill, except general appropriations bills, shall be passed containing more than one subject which shall be clearly expressed in its title." Second: That the same is discriminatory and, therefore, in violation of the 14th Amendment of the Federal Constitution. In this case, we: are confronted by the Act of Assembly bearing the title "an act to regulate the practice of profession of Engi-neering and Land Surveying; creating a State Board for Regis-tration of Professional Engineers and Land Surveyors; defining its powers and duties, imposing certain duties upon the Common-wealth and Political subdivisions thereof, in connection with public work and providing penalties." We meet in the title of this act, a recognition of the fact that it is the legislative intent to deal with two professions: First: Engineering. Second: Land Surveying.

PRIOR to July, 1919, the sampler at each mine of the Anaconda Copper Mining Co. in Butte did his work in his own way and was responsible to the mine foreman only. At that time, the sampling at all the company's Butte mines was placed in charge of a member of the geological department and stand-ardized methods of doing the work, were adopted. These standards were incorporated in a set of instruc-tions accompanied by blueprints representing typical conditions. The main features of the instructions were as follows: All samples to be cut at breast height and horizontally, regardless of dip of vein, and the horizontal width reported. A single sample to include not more than a 5-ft. width of the breast and to weigh not less than 4 lb. for this width. Where the vein is made up of two or more streaks of different hardness or mineral content, each streak is to be sampled sepa-rately and the average value of the combined width figured. If two streaks of ore are separated by a streak of waste, which is not sampled, in obtaining the average value of the breast the waste must be figured in with a zero assay. Drifts to be sampled in the breast after each round. Raises to be sampled for each floor raised. Each end to be sampled separately and the average width and value of the two ends to be used as the average of the floor. All veins cross-cut to be sampled along the side of the cross-cut, at breast height and horizontally. Where the vein strikes at an acute angle to the line of the cross-cut, the width of sample must be corrected to show the horizontal width at right angles to the line of strike of the vein. Rill stopes must be sampled across the full mining width. In square-set stopes, each set must be sampled separately along the line of the caps. Waste portions of the vein which are mined for filling must not be included in the sample.
